<p class="has-text-align-center"><strong>Allowances</strong></p>



<p>Department of Personnel &amp; Training has issued various instructions from time to time on various Allowances applicable to Central Government Employees. The essence of these instructions has been summarized in the following paras for guidance and better understanding.</p>



<h3 class="wp-block-heading">1. Children Education Allowance (CEA)</h3>



<p>Consequent upon the decisions taken by Government to implement the recommendation of 7th CPC, this department has issued an OM No. A-27012/01/2017-Estt.(AL) dated 17.07.2018. The salient features of CEA are:</p>



<ul class="wp-block-list">
<li>(i) CEA/Hostel Subsidy can be claimed only for the two eldest surviving children.</li>



<li><strong>(ii) The amount of CEA will be Rs. 2250/- per month per child.</strong></li>



<li><strong>(iii) The amount of hostel subsidy is Rs. 6750/- per month.</strong></li>



<li><strong>(iv) The reimbursement of CEA for Divyang Children of Government servant shall be payable at double the normal rate of CEA i.e. Rs. 4500/- per month.</strong></li>



<li>(v) The rate of CEA would be raised by 25% every time the DA on the revised pay structure goes up by 50%.</li>



<li>(vi) The CEA and Hostel subsidy is admissible in respect of children studying from two class before class one to 12th standard.</li>

<h3 class="wp-block-heading">2. Risk Allowance</h3>



<ul class="wp-block-list">
<li>(i) As per decision taken by the Government on the recommendation of 7th CPC rates of Risk Allowance were revised.</li>



<li>(ii) Risk Allowance is presently given to Central Government employees engaged in hazardous duties or whose work will have a deleterious effect on health over a period of time.</li>



<li>(iii) The Risk Allowance will not be treated as “Pay” for any purpose.</li>

<h3 class="wp-block-heading">3. Night Duty Allowance (NDA)</h3>



<p>Consequent upon the decision taken by Government on the recommendations made by 7th CPC on the subject following guidelines has been issued:</p>



<ul class="wp-block-list">
<li>(i) Night duty will be defined as duty performed between 22:00 hours and 6:00 hours.</li>



<li>(ii) A uniform weightage of 10 minutes shall be given for every hour of night duty performed.</li>



<li>(iii)&nbsp;<strong>The ceiling of basic pay for entitlement of NDA shall be Rs 43600/- per month.</strong></li>



<li>(iv) The hourly rate of NDA equal to [(BP+DA)/200] will be paid and the basic pay and DA for the calculation of NDA rates shall be the basic pay and DA prevalent as per 7th CPC.</li>



<li>(v) The amount of NDA will be worked out separately for each employee depending upon the basic pay the concerned employee is drawing on the date of performing the night duty.

<h3 class="wp-block-heading">4. Over Time Allowance (OTA)</h3>



<p>Consequent upon the recommendations of 7th CPC as accepted by the Government, it has been decided that:</p>



<ul class="wp-block-list">
<li>(i) “Ministries/Departments to prepare a list of those staff coming under the category of ‘Operational Staff’. Rates of Overtime Allowance not to be revised upwards”.</li>



<li>(ii) The following definition has been used to define Operational Staff: “All non-ministerial, non-gazetted Central Government Servants directly involved in smooth operation of the office including those tasked with operation of some electrical or mechanical equipment.”</li>



<li>(iii) The concerned Administration Wing of the Ministries/ Departments will prepare a list of operational staff with full justification based on the above parameters for inclusion of a particular category of staff in the list of operational staff with the approval of JS(Admn.) and Financial Adviser of the concerned Ministry/ Department.</li>



<li>(iv) The grant of OTA may be linked to biometric attendance.</li>

<h3 class="wp-block-heading">5. Special Allowance Payable to Parliament Assistants</h3>



<ul class="wp-block-list">
<li>(i) As per the decision taken by the Government on 7th CPC recommendations to enhance the rates of&nbsp;<strong>Special Allowance payable to those wholly engaged in Parliament work during Parliament session by 50% from the existing levels of Rs. 1500/- and Rs. 1200/- payable to Assistants and UDCs respectively to the level of Rs. 2250/- and Rs 1800/-.</strong></li>



<li>(ii) The allowance will be admissible at full rates for every calendar month in which the Parliament is in session for at least 15 days in that month. For month with shorter period, the allowance will be admissible half the rates prescribed for the full month.</li>



<li>(iii) No OTA shall be paid to Parliament Assistants for the calendar months in which the Parliament is in session.</li>

<h3 class="wp-block-heading">6. Special Allowance for Child Care for Women with Disabilities</h3>



<ul class="wp-block-list">
<li>(i) For providing extra benefits to women employees with disabilities especially when they have young children and children with disabilities, it has been decided that&nbsp;<strong>women with disabilities shall be paid Rs. 3000/- per month on Special Allowance for child care.</strong>&nbsp;The allowance shall be payable from the time of the child’s birth till the child is two years old.</li>



<li>(ii) The above limit would be raised by 25% every time the Dearness Allowance on the revised pay structure goes up by 50%.</li>

Therefore, the compassionate appointments data furnished by CCAs needs to be updated.</p>

<p>Subject: <strong>Aid to processing of departmental proceedings under the CCS (CCA) Rules, 1965- Simplification regarding.</strong><br /><br />It has been observed that the Disciplinary Authorities, while processing the disciplinary cases under the Central Civil Services (Classification, Control and Appeal) Rules, 1965, sometimes fail to appreciate the vital procedural requirements/timelines provided under the said Rules, albeit unintentionally, which are required to be mandatorily followed to ensure justice and bringing the cases to logical conclusions. Non-conformity to the requirements as per the established rules also leads to intervention by the Courts on the ground of denial of proper opportunity to the Charged Officers for defending themselves appropriately and, consequently, setting aside of disciplinary proceedings. The Charged Officers also tend to take advantage of these procedural flaws in processing of disciplinary cases at various stages of their examination e.g. sharing of documents, approval of Article of Charge by the DA, sharing of UPSC advice and General Examination of the CO, to quote the few. These procedural lapses have also been noticed in various cases referred to this Department for advice.</p>



<ol class="wp-block-list" start="2"><li>In this regard, an attempt has been made to indicate the various steps involved in the disciplinary cases in a simple form through the enclosed Flow Chart, for better understanding of Rules in their application by the DAs. It is felt that this exercise will facilitate the Administrative Ministries/Departments to deal with the disciplinary cases effectively. It is, however, clarified that the detailed provisions under relevant Rules and instructions issued thereunder may be duly followed in its application and, in case of any ambiguity or conflict of the indicative flow Chart with any of the existing Rules/ Instructions, the extant Rules and Instructions will prevail.</li></ol>

If he pleads guilty to any of the articles of charge, the IA shall record the plea, sign the record &amp; obtain the signature of GS thereon. Thereafter, the IA to return a finding of guilt in respect of admitted charge(s). [Rule 14(9) &amp; 14(10)]</p>

<p> if the GS fails to appear within the specified time or refused or omits to plead, IA Shall require the PO to produce the evidence by which he proses to prove the articles of charge. </p>

<p>The IA shall adjourn the case to a later date, not exceeding 30 days, after recording an order that the GS may :-<br />(i) inspect the document (s) within 5 days of the order , extendable to not more than 5 days by the IA, attached with the Charge-Sheet ;<br />(ii) submit a list of witnesses to be examined on behalf of GS; and<br />(iii) give a notice within 10 days of the order or within such further time not exceeding 10 days as the IA may allow, for discovery or production of any documents which are in possession of the Government but not mentioned in the charge sheet. <p><span style="text-decoration: underline;">Production of documents<br /></span>Authority, having the custody of requisitioned documents, may inform the IA that production of document(s) would be against public interest or security of State.<br />IA shall thereafter communicate this to GS and withdraw the requisition made by it for production of document (s). <strong>[Proviso to Rule 14(13)]</strong></p>

<p><span style="text-decoration: underline;">[Requisition of Documents ]<br /></span>Request of GS for production of document shall be forwarded to concerned authority in whose custody the documents are kept. IA may, however, refuse, for the reasons to be recorded in writing, to requisition documents if in its opinion such documents not relevant to the case.<br />Authority shall produce the documents by the due date or issue a non-availability certificate before the IA within 1 month <strong>[Rule 14(12) &amp; 14(13)]</strong></p>

PO shall be entitled to re-examine the witnesses. [Rule 14(14)]</p>

<p><span style="text-decoration: underline;">[New Evidence]<br /></span>❖Before closing the case on behalf of DA, PO may be allowed to produce new evidence or itself call for new evidence or recall and re-examine any witness. In all such eventualities, the GS shall be entitled to have a copy of list of new evidence.<br />❖IA to adjourn the inquiry for three clear days, excluding the day of adjournment and day of hearing.<br />❖IA to give an opportunity to GS for inspection of such new documents and to allow GS to produce new<br />evidence if necessary in the interests of justice.<br />[Rule 14(15)</p>

<p>❖ Bias petition of CO [OM No. 39/40/70-Estt.(A) dated 9.11.1972]<br />Whenever an application is moved by a Government servant against whom disciplinary proceedings are initiated under CCS (CCA) Rules, 1965 against the Inquiry Authority on ground of bias, the proceeding should be stayed and the application referred alongwith the relevant material, to the appropriate authority for considering the application and passing of appropriate order thereon.<br />❖ Ex parte inquiry [Rule 14 (20) of the CCS (CCA) Rules, 1965].<br />Ex-parte inquiry can be resorted to only when the following conditions are satisfied:<br />a) Articles of charge should have been delivered<br />b) The charged officer had failed to submit the written statement of defence on or before the specified date or<br />c) Does not appear in person before the Inquiring Authority or<br />d) Fails or refuses to comply with the provisions of the CCS(CCA) Rules.<br />❖ Daily Order Sheet:<br />Daily Order Sheet is the record of the progress of the case handled by the IA during a day. It is prepared and maintained by the IA. It needs to be appreciated that Daily Order Sheet will be the most authentic record for ascertaining as to what happened in the course of inquiry because it is signed by all present.<br />❖ Abbreviations used in the flow chart.<br />a) DA – Disciplinary Authority<br />b) IA – Inquiring Authority is a Inquiry officer appointed by DA to inquire into the charges.<br />c) GS – Government Servant against whom disciplinary proceedings are initiated<br />d) PO – Presenting Officer</p>



<h2 class="has-text-align-center wp-block-heading">Steps for holding the Minor Penalty proceeding under Rule 16</h2>



<p class="has-text-align-center"><span style="text-decoration: underline;">Decision of the DA to take action<br /></span>When the Disciplinary Authority (DA) decides to hold minor penalty proceeding.</p>



<p class="has-text-align-center"><br /><span style="text-decoration: underline;">[Charge Sheet &#8211; Minor Penalty]<br /></span>Inform the Government servant in writing of the proposal to take action against him along with the imputations of misconduct or misbehavior on which it is proposed to be taken and give him reasonable opportunity of making such representation as he may wish to against the proposal [Rule 16(1)(a)]</p>



<p class="has-text-align-center">DA considers the representation of GS and decides not to hold any inquiry, for reasons recorded in writing.</p>



<p>In Case no consultation with UPSC required, DA can impose any minor penalty.</p>



<p>DA forwards the representation of GS, along with his comments to UPSC for advice wherever consultation necessary.<br />DA shall forward or cause to be forwarded a copy of the advice of the UPSC to GS who shall be required to submit, if he so desires, his written representation within 15 days time. [Rule 16(1)(d)]</p>



<p>DA can impose penalty from clause (i) to (iv) of the Rule 11 [Minor Penalties]</p>

<h2 class="has-text-align-center wp-block-heading">Steps for holding the Minor Penalty proceeding under Rule 16</h2>



<p><span style="text-decoration: underline;">Holding a detailed inquiry in the manner laid down in sub-rules (3) to (24) of Rule 14 in the following circumstances:</span><br />a) in every case in which the Disciplinary Authority is of the opinion that such inquiry is necessary or <br />b)If in case it is proposed, after considering the representation, if any, made by the GS, to withhold<br />increments of pay and such withholding of increments is likely to affect adversely the amount of pension<br />payable to the Government servant or to withhold increments of pay for a period exceeding three years<br />[Rule 16(1)(b) and Rule 16(1-A)]</p>

<h3 class="wp-block-heading"><strong>Sub: Calendar for Cadre Review of Central Group &#8216;A&#8217; Services.</strong></h3>



<p>The undersigned is directed to say that the Department of Personnel &amp; Training (DoP&amp;T) is the nodal agency of the Government of India for personnel management policies. Cadre management and cadre review are primarily the concern of Cadre Controlling Authorities (CCAs) but the responsibility for laying down standards in the matter and co-ordination rests with DoP&amp;T. Provisions governing the process of cadre review of Central Group ‘A Services were issued as consolidated guidelines vide Office Memorandum (OM) No. 1-17014/1/2005-CRB dated 14.12.2010 along with a Monograph. Under the said Guidelines, every cadre should be reviewed once in five years. The review should first be carried out by the CCA, preferably in consultation with the representative of the Service/cadre in question.</p>



<p>2. It has, however, been observed that despite repeated reminders and regular meeting with CCAs. the prescribed periodicity of cadre review is not followed. Prime reason for the delay being non-submission of cadre review proposal by the concerned COA With the objective to get one round of cadre review completed in 5 years for all the services, this Department had issued a calendar in year 2018 and 2019 for strict compliance. However, various CCAs citing one or other reason (which includes COVID pandemic) defaulted on the prescribed timeline laid down in the Calendars.</p>



<h2 class="has-text-align-center wp-block-heading"><a href="https://centralgovernmentnews.com/holidays-to-be-observed-in-central-government-offices-during-the-year-2021/" target="_blank" rel="noreferrer noopener">Calendar 2021 Government Holidays</a></h2>



<p>3. A good number of cadre reviews have been undertaken in the last two years and some proposals are under various stages of review. Amongst the cases Under examination of DoP&amp;T, few are pending for want of clarifications from CCA concerned i.e. Indian Skill Development Service and Medical Cadres of BSF/CRPFATEP. It would be appreciated if a reply/ clarification/ revised proposal (if needed) is provided to this Department within one month.</p>



<p>4, For the Services where reviews are pending, a Calendar for year 2021 is being circulated&nbsp;<strong>for strict compliance by CCAs (Annexure)</strong>, The deadline month mentioned in the Calendar is the time by which the complete cadre review proposal should be submitted by the concerned CCAs to DoPT positively. There may be instances, where CCA do not require any change in cadre structure. in those cases also, the CCA may move the proposal for other changes, if required. If no changes are required at all, a certificate to this aspect may be sent to this Department with approval of Minister in charge. DoPT may, however, take its own view on the same.</p>



<p>5 It is well known that proposals Involving the creation of posts. restructuring, merger, encadrement, etc. resulting in a change of cadre strength of any Central Group A Service are required to be considered during cadre review. Any creation of posts in these Services is through cadre review or in consultation with DoPT and DoE (in exigencies), This was reiterated in OM No.-11049/17/2016-CRD dated 15.02.2017 to all CCAs (with a copy to DoE). Creation of posts and other measures outside cadre review, while cadre review is due, would not be supported and may result in freezing of the cadre strength for a specific period or even reduction.</p>



<p>6. There are Services which have been declared dying or where few posts are left. Status of such Services and pending issues may be brought to the notice of this Department immediately by concerned CCA but not tater than the month prescribed in the Calendar. These Services include Indian Supply Service, Indian Inspection Service. Indian Broadcasting Engineering Service, Indian Broadcasting Programme Service</p>



<p>7. There may be cases where due to court cases the submission of cadre review proposal is delayed or Orders of Count for conduct of cadre review, All such instances should be brought to the notice of this Department immediately with full details of the directions of the Court without waiting for time/month prescribed in the Calendar. It need not be emphasized that the CCA must ensure compliance of the Order of the Court for avoiding any complexities later.</p>



<p>8. CCA with Service pending for cadre review prior to January 2021 may submit the proposal earlier than the prescribed time/month in the Calendar. CCA with Service whose cadre review will be due in 2021 should start the preparation of the proposal to ensure timely submission by the prescribed month or even earlier.</p>



<p>9. A nodal officer (not below the rank of Joint Secretary) may be nominated by each CCA for matters related to cadre review and for ensuring compliance of the timeline given In the Calendar, Name of the nodal officer may be provided within one month to this Department.</p>

<p>Ref: DoPAPW Order No 181-2020-PAPWIC +6681 dated 11 September, 2020</p>



<p>It 1s to inform that pensioners receiving pension directly from CCA offices via SAMPANN/ FMS have been given relaxation to submit their Life Certificates (LC) in a staggered manner by way of staggering. a pensioner has to submit the Life Certificate within one scar of last submission of in November as per convenience.</p>

<p>2. Further, several such pensioners did not submit <a href="https://centralgovernmentnews.com/tag/life-certificate/" target="_blank" rel="noreferrer noopener">Life certificate</a> in November, 2019 who were due to submit their LCs in the months between February, 2020 and July, 2020 as one-year period was getting over by then keeping in mind the vulnerability of senior citizens to <strong><a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">Covid-19</a></strong> pandemic and convenience of pensioners, the timelines for submission of Life Certificates were extended from time to time. The last extension was given till 30th September, 2020 by which pensioners had to submit their Life certificates i.e. for such pensioners, for whom the pension till August has been paid. Additionally, CCA offices had been advised to reach out to pensioners via SMS and calls to ensure submission of the Life certificates on time.</p>



<p>3. Thereafter several additional measures have been taken to facilitate pensioners for submission of Life certificate in Aug-Sep 2020.</p>



<ul class="wp-block-list"><li>I. BSNL has directed its units to set up DLC facility at one CSC in each SSA and the same is being coordinated by CCA offices.</li><li>II. Banks have been asked to provide <a href="https://centralgovernmentnews.com/tag/digital-life-certificate/" target="_blank" rel="noreferrer noopener">Digital Life Certificate</a>/ Life certificate to pensioners having hank account with them. SBI has already directed its branches for the same. Further, list of pensioners- hank branch wise has been circulated among all CCA offices so that pensioners can be assisted.</li><li>III Further, CSC e-Governance Services India Ltd has also been asked to continue its support for generation of DLC across all of the branches of CSCs across India.</li><li>IV. Further, a user friendly video on the process of generation of Life certificate generation has been circulated among CCA offices and Pensioners Associations. It is already hosted on YouTube channel of DOT and the websites of DOT and SAMPANN.</li></ul>



<p>4. In the meantime, in view of the ongoing Covid-19 pandemic and keeping in view of the vulnerability of elderly population to Corona Virus, it has been decided by DoP&amp;PW to extend the existing timeline for submission of Life Certificate vide letter under reference (enclosed)</p>

<p>5. Therefore, in the light of above. I am directed to convey that:</p>



<ul class="wp-block-list"><li>I. Those SAMPANN/FMS pensioners whose Life Certificate would be expiring on 31st October 2020 (1. pension payable till October 2020) or 10th November 2020 (i.e. pension payable till November 2020), may be allowed to submit DLC/LC from 1st November, 2020 onward till 31st December 2020. However, the pensioners in the age group of 80 years and above. in above category. can submit Life Certificate from 1st October, 2020 onwards, to 31st December, 2020. Further. the pension shall continue to be paid by the CCA offices uninterrupted till Dec 2020 in above cases.</li><li>II. Pensioners whose LC/DLC has expired by 30 September 2020 or prior to it (including those who have been given relaxation for submission of LC/DLC by previous orders) may once again be requested to submit their LC/DLC to ensure uninterrupted disbursement of pension.</li><li>III. Pensioners who are due to submit their LC in Jan 2021 – Feb 2021 of onwards, including the BSNL/ MTNL VRS 2019 retirees, may also be motivated for submitting their LC/DLC well in advance as per their convenience to avoid any difficulty in the event of deterioration in local Covid-19 pandemic conditions.</li><li>IV. CCA offices may take all measures to inform the pensioners regarding above measures taken by the department to facilitate the submission of LC/DLC by SMS etc.</li></ul>

<p style="text-align:center"><strong>Child Care Allowance for Divyang Women</strong></p>



<p style="text-align:right">26 JUN 2019</p>



<p>Consequent upon implementation of the recommendations of the <strong>7th Central Pay Commission</strong>, the rates of special allowance for women with disabilities have been increased from Rs.1500 per month to Rs.3000 per month for child care which shall be payable from the time of child’s birth till the child is two years old. This special allowance shall be payable for a maximum of two eldest surviving children and would be automatically raised by 25% every time the Dearness Allowance on the revised pay structure goes up by 50%. It is effective from 1st July, 2017 and applicable to all Central Government disabled woman employees, irrespective of their place of posting.</p>



<p>This information was provided by the Union Minister of State (Independent Charge) Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances &amp; Pensions, Atomic Energy and Space, Dr Jitendra Singh in written reply to a question in Lok Sabha today.</p>

<p>Subject: <strong>Regulation of pay on imposition of a penalty under CCS (CCA) Rules, 1965.</strong></p>



<p>The Undersigned is directed to say that the following penalties prescribed in the Rule 11 of CCS (CCA) Rules, 1965, have a bearing on the pay of the officer:</p>



<h2 class="wp-block-heading">11. Penalties</h2>



<p><strong>Minor Penalties &#8211;</strong></p>



<p>(iii) (a) reduction to a lower stage in the time-scale of pay by one stage for a<br /> period not exceeding three years, without cumulative effect and not adversely affecting his pension.</p>



<p>(iv) withholding of increments of pay;</p>



<p><strong>Major Penalties &#8211;</strong></p>



<p>(v) save as provided for in clause (iii) (a), reduction to a lower stage in the<br />
time-scale of pay for a specified period, with further directions as to whether or not the Government servant will earn increments of pay during the period of such reduction and whether on the expiry of such period, the reduction will or will not have the effect of postponing the future increments of his pay</p>



<p>(vi) reduction to lower time-scale of pay, grade, post or service for a period to be specified in the order of penalty, which shall be a bar to the promotion of the Government servant during such specified period to the time-scale of pay, grade, post or service from which he was reduced, with direction as to whether or not, on promotion on the expiry of the said specified period &#8211;</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>(a) the period of reduction to time-scale of pay, grade, post or service shall operate to postpone future increments of his pay, and if so, to what extent; and<br /> (b) the Government servant shall regain his original seniority in the higher time scale of pay , grade, post or service;</p></blockquote>



<p>2. Vide Central Civil Services (Revised Pay) Rules,2016 notified vide notification No. GSR 721(E) dated 25.07.2016, the present system of Pay Bands and Grade Pays have been dispensed with and a new system of pay matrix as specified under Part A of Schedule of Central Civil Service (Revised Pay) Rules, 2016 have been introduced. The status of the employee so far determined by Grade pay, will now be determined by Level in the Pay Matrix. Further, as per Rule 10 (1) of the CCS (Revised Pay) Rules, 2016, there are two dates for grant of increment namely, 1st January and 1st July of every year, instead of the existing date of 1st July.</p>



<p>3. As per clause 3 of the Central Civil Services (Revised Pay) Rules, 2016 &#8216;Level&#8217; is defined as under:</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>&#8216;Level&#8217; in the Pay Matrix shall mean the Level corresponding to the existing Pay Band and Grade pay or Scale specified in Part A of the Schedule.&#8221;</p></blockquote>



<p>4. In the light of implementation of the Revised (Pay) Rules, 2016, the regulation of pay on imposition of these penalties, is discussed in the subsequent paras:</p>



<p><strong>A. Reduction to a lower stage of pay by one stage {Rule 11( iii a)}</strong></p>



<p>On imposition of a penalty under this Rule, the pay would be fixed at the<br /> next upper vertical cell in the same level in the pay matrix. In other words, in case of reduction by one stage, the revised pay would be the pay drawn in the same level at the stage before the last increment.</p>



<p><strong>Note</strong>: The above mentioned penalty cannot be imposed on a Government<br /> Servant drawing pay at the minimum of the Level.</p>



<p><strong>B. Withholding of increment {Rule 11(iv)}</strong><br /> As already noted in para 2 above, increment is granted either on 1st<br /> January or 1st July of every year, as per the eligibility. Therefore, on imposition of penalty of withholding of increment, the next increment(s) due after the date of imposition of the penalty would be withheld. In case where penalty of withholding of multiple increments is imposed, increments due on 1st January or 1st July, as the case may be, in the subsequent years would similarly be withheld. The increment would be restored at the end of the period for which the penalty is imposed. The increments will be given on notional basis without arrears and without affecting date of next increment on restoration of increment.</p>



<p>This also applies to cases where the penalty is imposed for part of a year.<br /> For instance, if the penalty of withholding of one increment for six months is imposed on a Government servant in October 2017, then withholding of<br /> increment will be on following manner:</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><strong>When the date of increment is 1st January ?</strong></p><p>The increment falling due on 1.01.2018 will be withheld for a period of next six months, that is, till 30.06.2018. The increment would be released on 1.07.2018 without arrear.</p><p><strong>When the date of increment is on 1st July ?</strong></p><p>The increment falling due on 1 07.2018 will be withheld for a period of next six months, that is, till 31.12.2018. The increment would be released on 01.01 .2018 without arrears.</p></blockquote>



<p><strong><span style="text-decoration: underline;">C.  Reduction to a lower stage in the time-scale of pay for a specified period [Rule 11( v)]</span></strong></p>



<p>The process of imposition of penalty of reduction by one stage under<br /> Rule 11(iii a) explained above shall be repeated for every additional stage of reduction to the lower vertical cell in the same level of pay in the Pay Matrix.</p>



<p><strong>Note 1</strong>: It is not permissible to impose a penalty under this rule if the pay after imposition of the penalty would fall below the first cell of the same Level.</p>



<p><strong>Note 2</strong>: Disciplinary Authority may weigh all factors before deciding upon the quantum of penalty i.e. the number of stage by which the pay is to be reduced.</p>



<p><span style=""><b><u>D. </u></b></span><strong><span style="text-decoration: underline;">Reduction to lower time-scale of pay under Rule 11(vi)</span></strong></p>



<p>In the case of imposition of penalty of reduction to lower time-scale of<br /> pay, the pay of the Government servant would be reduced to the stage of pay he/she would have drawn had he/she continued in the lower post for the period of penalty. The mode of fixation of pay in this case is similar to reversing the mode of fixation of pay on promotion.</p>



<p>However, Disciplinary Authority has the power, in terms of FR 2g, to indicate the pay which the Government servant on whom a penalty of reduction in rank has been imposed, would draw.</p>



<p>It may also be noted that a Government servant cannot be reduced in rank to a post not held earlier by him in the cadre.</p>



<p><span style="text-decoration: underline;">For example.</span></p>



<ul class="wp-block-list"><li>A direct recruit Assistant Section Officer cannot be reduced to the lower rank like SSA/JSA.</li><li>A Government servant holding any post like LDC/ Tax Assistant etc. who qualifies as Assistant Section Officer as a Direct Recruit and is later promoted as section officer cannot be reduced to the rank, which was earlier held by him before ASo (DR) but only to that of an Assistant Section Officer.</li></ul>



<p>5. Some illustrations on pay fixation on the above cases are annexed</p>



<p>6. In so far as the personnel serving in Indian Audit and Accounts Department are concerned, these instructions are being issued after consultation with the Comptroller and Auditor General of India.</p>

<p>** In the above illustration, a penalty of reduction by more than two stages<br /> would fall below the first cell of the same Level, such a penalty therefore,<br /> would not be implementable. Therefore, while imposing the penalty of<br /> reduction to a lower stage in time-scale of pay under Rule 11 (v) of the CCS (CCA) Rules, 1965, Disciplinary Authority may weigh all factors before<br /> deciding upon the quantum of penalty, i.e. the number of stages by which the pay is to be reduced.</p>

<p>Sub: <strong>Calendar for Cadre Review of Central Group &#8216;A&#8217; Services</strong></p>
<p>The undersigned is directed to say that in terms of this Department&#8217;s OM No. I. 11011/1/1009-CRD dated 14/12/2010 the ideal periodicity of cadre review is 5 years. Despite the said instructions and repeated reminders, it has been observed that the said periodicity is not followed. The cadre review in some cases is pending for even more than 40 years.</p>
<p>2. In view of the above, this Department has prepared a calendar (Annexure) for cadre review of the Central group &#8216;A&#8217; Services, which is required to be followed by the Cadre Controlling Authorities (CCA) strictly. The months and year mentioned in the calendar is the time frame by which the cadre review proposal should be submitted by the Cadre Controlling Authorities to DoPT positively.</p>
<p>3. All the CCAs are therefore requested to submit cadre review proposals in accordance with the calendar without any exemption. For other service which have not been mentioned in the calendar and the cadre review is not due, the Cadre Controlling Authority concerned may submit their proposal in accordance with the Cadre Review Guidelines, as and when they feel that the cadre review is required.</p>
<p>4. Any proposal for addition in cadre strength of Central Group &#8216;A&#8217; Services (Creation, encadrement, upgradation, merger etc.) must be routed through DoPT as reiterated in this Department&#8217;s OM No. I. 11019/17/2016- CRD dated 15/2/2017.</p>

1. For IPESS Cabinet approval obtained. Notification/Order to be issued by the Department.<br />
2. For Indian Economic Service, CCA is required to provide information sought by DoPT latest by 30/5/2018<br />
3. The month indicated above is the target month for the CCAs for submission of cadre review proposal to this department.<br />
4. Services, where cadre review could not be undertaken due to any court cases (s) related to cadre review, the concerned CCA may provide detail of such case and reason(s) for non conducting cadre review with approval of Minister-in-charge. In remaining cases, even if the CCA is of the view that no change required in the cadre, objective of the formation of service, changes which took place since last Cadre Review, requirement of service/posts in present scenario may be assessed and sent to this department with the approval of Minister-in-Charge.<br />
5. CCA concerned may develop their own calendar for cadre review of Group &#8216;B&#8217; and &#8216;C&#8217; posts. No requirement for sending proposal of cadre review of Group &#8216;B&#8217; and &#8216;C&#8217; to this department unless question of policy or up gradation of posts from Group &#8216;B&#8217; to Group &#8216;A&#8217; is involved.</p>
