<h2 class="wp-block-heading">ENTITLEMENT RULES FOR CASUALTY PENSION AND DISABILITY COMPENSATION AWARDS TO ARMED FORCES PERSONNEL, 2023</h2>



<p>1.&nbsp;<strong>Title</strong>. These Rules shall be called the Entitlement Rules for Casualty Pension and Disability Compensation Awards to Armed Forces Personnel, 2023 and supersedes the Entitlement Rules for Casualty Pensionary Awards to Armed Force Personnel, 2008.</p>



<p>2. (i) These Rules shall be read in conjunction with the following documents as amended from time to time: –</p>



<p>(a) Pension Regulations for the Army, 2008.<br />(b) Navy (Pension) Regulations, 1964.<br />(c) Pension Regulations for the Air Force, 1961.<br />(d) Guide to Medical Officers (Military Pension), 2023 and subsequent amendments, if any.<br />(e) Government of India, Ministry of Defence policy letters on the subject issued from time to time.</p>



<p>(ii)&nbsp;<strong>Superseding Clause</strong>. These Rules shall supersede all previous Entitlement Rules for Casualty Pensionary Awards to Armed Forces Personnel. Where any provision in these rules is found contrary to the provisions of any previously existing rules, regulations or policies, on the subject of Casualty Pensionary Awards, the provisions given in these rules shall take precedence.</p>



<h3 class="wp-block-heading"><strong>3. Extent of Application.</strong></h3>



<p>(a) These Rules shall apply to all Officers, JCOs, WOs, OR and equivalent ranks in other services including officers, JCOs, WOs and OR of the Territorial Army, when embodied, called out or attached as the case may be.<br />(b) These Rules do not apply in cases where disablement or death, on which the claim to casualty pensionary awards is based, took place</p>



<p>(i) During the period 3rd September, 1939 to 31st March, 1948, which will be dealt with in accordance with the entitlement criteria laid down in&nbsp;<strong>Annexure I</strong>: and</p>



<p>(ii) During the period of emergency post-1948 which will be dealt with in accordance with Annexure II to these Rules.</p>



<p>(c) Cases of death/ disablement of Cadets (Direct), due to causes attributable to or aggravated by military training shall be governed under the provisions contained in the Ministry of Defence letter No 1(5)/ 93/ D (Pen — C) dated 16th April, 1996, amended from time to time in so far as entitlement of ex-gratia is concerned. However, the claims for ex- gratia award shall be governed in accordance with these Rules. A copy of the letter dated 16th April 1996 is appended as Annexure III to these Rules.</p>



<p><strong>4. Definitions</strong>: Unless the context otherwise dictates, the following terms shall mean as under: –</p>



<p>(a)&nbsp;<strong>Categories of Disabilities.</strong>&nbsp;For the purpose of determining the casualty pension and disability compensation for death or disability which is attributable to or aggravated by military service, the circumstances shall be broadly classified from Category A — E as specified in Paragraph 4.1 of Government of India, Ministry of Defence Letter No 1 (2)/ 97/ D (Pen — C) dated 31 Jan 2001.</p>



<p>(b) <strong>Disability</strong>. ‘Disability’ means a condition of a person resulting in long term physical, mental, intellectual or sensory impairment which in interaction with barriers, hinders full and effective participation in society, equally with others. In respect of Armed Forces personnel, a ‘Disability’ also means a functional impairment that inhibits an individual from effectively discharging duties of a military nature or to be provided an alternate employment within the service, even though the individual may otherwise be fit to participate normally in civil society. Two such Illustrations (though not an exhaustive list of the same) could be as given below: –</p>



<p>(i) Amputation of the index finger of the dominant arm, thereby precluding operation of the trigger of a personal weapon.<br />(ii) Personnel affected with seizure, who cannot be issued weapons or detailed on sentry duties.</p>



<p>(c)&nbsp;<strong>Entitlement</strong>. Entitlement is the determination by the Competent/ Appellate Authority, after considering both medical and non-medical evidence, as to whether or not a wound. Injury or any bodily disability has been influenced in its onset or course by conditions of military service or is a War Injury. Disabilities that fall under Categories ‘B’, ‘C’, ‘D’ or ‘E’ are called “Accepted Disabilities” and those that fall under Category ‘A’ are ‘Rejected Disabilities’.</p>



<p>(d) <strong>Assessment</strong>. The term “assessment” defines the process of evaluating the functional impairment suffered by an individual following a disability or disabilities in terms of percentage, for the purpose of calculating disability compensation. Assessment shall be determined by the competent medical authority on the basis of a physical examination of the individual.</p>



<p>(e)&nbsp;<strong>Disability Pension</strong>. A Disability Pension is a monthly composite pension comprising of a Service Element and Disability Element, each calculated separately, as a defined percentage of the last reckonable emoluments. There shall be no condition of minimum qualifying service for earning Service Element.</p>



<p>(f)&nbsp;<strong>Liberalized Disability Pension</strong>. Liberalized Disability Pension is a monthly composite pension comprising of a Service Element and a Disability Element, each calculated separately, as a defined percentage of the last reckonable emoluments, where the aggregate of Service Element and Disability Element shall in no case be less than 80 per cent of the last reckonable emoluments.</p>



<p>(g)&nbsp;<strong>War Injury Pension</strong>. A War Injury Pension is a composite monthly pension comprising of a Service Element and a War Injury Element, each calculated separately, as a defined percentage of the last reckonable emoluments.</p>



<p>(h)&nbsp;<strong>Invalid Pension</strong>. Invalid Pension is a monthly pension equal to the Retiring Pension as on the date of invaliding out of service.</p>



<p>(i)&nbsp;<strong>Impairment Relief</strong>. Impairment Relief is a monthly disability compensation, Calculated as a defined percentage of the last reckonable emoluments, awarded to Armed Forces personnel who are retired or discharged from service voluntarily or otherwise with a disability sustained under circumstances accepted as Category ‘B’ or ‘C’ and assessed not less than 20 per cent. ‘Impairment Relief shall hereinafter replace the term ‘Disability Element’ in as far as disability compensation to Armed Forces personnel who are retired or discharged from service. This is not a pension and shall cease upon the demise of the recipient.</p>



<p>(j)&nbsp;<strong>Liberalized Impairment Relief</strong>. Liberalized Impairment Relief is a monthly disability compensation, calculated as a defined percentage of the last reckonable emoluments, awarded to Armed Forces personnel who are retired or discharged from service voluntarily or otherwise with a disability sustained under circumstances accepted as Category ‘D’ and assessed not less than 20 per cent. ‘Liberalized Impairment Relief shall hereinafter replace the term ‘Liberalized Disability Element’ in as far as disability compensation to Armed Forces personnel who are retired or discharged from service. This is not a pension and shall cease upon the demise of the recipient.</p>



<p>(k)&nbsp;<strong>War Injury Relief</strong>. War Injury Relief is a monthly disability compensation, calculated as a defined percentage of the last reckonable emoluments, awarded to Armed Forces personnel who are retired or discharged from service voluntarily or otherwise with a disability sustained under circumstances accepted as Category ‘E’ and assessed not less than 20 per cent. ‘War Injury Relief shall hereinafter replace the term ‘War Injury Element’ in as far as disability compensation to Armed Forces personnel who are retired or discharged from service. This is not a pension and shall cease upon the demise of the recipient.</p>



<p>(l) <strong>Constant Attendance Allowance</strong>. A Constant Attendance Allowance is a monthly allowance (revised from time to time), paid in addition to Disability Pension/ Liberalized Disability Pension/ War injury Pension or Impairment Relief/ Liberalized Impairment Relief/ War injury Relief, only to Armed Forces personnel whose degree of impairment has been assessed at 100 per cent. This is not a pension and shall cease upon the demise of the recipient.</p>



<p>(m)&nbsp;<strong>Capitalized Impairment Relief/ Liberalized Impairment Relief/ War Injury Relief.</strong>&nbsp;&nbsp;A Capitalized Impairment Relief/ Liberalized Impairment Relief/ War Injury Relief (to be hereinafter referred in short as ‘Capitalized Impairment Relief in these rules) is the commuted present value of the future payout of an accepted Impairment Relief/ Liberalized Impairment Relief/ War injury Relief calculated by adopting the current commutation tables. The provision of Broad Banding shall not apply for calculating the percentage of impairment for the award of ‘Capitalized Impairment Relief. The terms Capitalized Impairment Relief/ Liberalized Impairment Relief/ War Injury Relief shall replace the terms Lump-Sum Compensation in Lieu of Disability Element/ Liberalized Disability Element/ War injury Element.</p>



<p>(n)&nbsp;<strong>Special Family Pension</strong>. Special Family Pension is a monthly pension, calculated as a defined percentage of the last reckonable emoluments, awarded to the Next-of-Kin of an Armed Forces personnel whose death occurs in circumstances accepted as Category ‘B’ or ‘C’.</p>



<p>(0)&nbsp;<strong>Liberalized Family Pension</strong>. Liberalized Family Pension is a monthly pension, calculated as a defined percentage of the last reckonable emoluments, awarded to the Next-of-Kin of an Armed Forces personnel whose death occurs in circumstances accepted as Category ‘D’ or ‘E’.</p>



<p>(p)&nbsp;<strong>Ex-Gratia Lump Sum Compensation in Cases of Invalidment.</strong>&nbsp;A one-time Ex-Gratia Lump-Sum Compensation is paid to Armed Forces personnel who are invalided from service on account of a disability held attributable to or aggravated by military service or a war injury, at a fixed rate (that is revised from time to time) for 100 per cent impairment, to be proportionally reduced for lesser degree of impairment up to a minimum of 20 per cent. The provision of Broad Banding shall not apply for calculating the percentage of impairment for the award of Ex-Gratia Lump Sum Compensation.</p>



<p>(q)&nbsp;<strong>Ex-Gratia Lump-Sum compensation to Next-of-Kin of Deceased Armed&nbsp;</strong><strong>Forces&nbsp;Personnel.</strong>&nbsp;An Ex-Gratia Lump-Sum Compensation is paid to the Next-of-Kin of Armed Forces personnel who die under circumstances clearly specified in the relevant policy letter on this subject (duly amended from time to time), at rates specified against each circumstance (duly amended from time to time). However, the aggregate of all Government relief provided for the same circumstance of death of the Armed Forces personnel, shall not exceed a the specified maximum amount of Ex-Gratia Lump-Sum Compensation payable (duly amended from time to time)</p>



<p>(r)&nbsp;<strong>Monthly Ex-Gratia</strong>. Monthly Ex-Gratia is paid to Cadets who are invalided from military training at a monthly rate that is revised from time to time. This is not a pension and shall cease upon the demise of the recipient.</p>



<p>(s) <strong>Ex-Gratia Disability</strong>. Ex-Gratia Disability Award is paid to Cadets who are invalided from military training with a disability held attributable to or aggravated by military training, in addition to Monthly Ex-Gratia, at a monthly rate (that is revised from time to time) for 100 per cent impairment to be proportionally reduced for lesser degree of impairment up to a minimum of 20 per cent. This is not a pension and shall cease upon the demise of the recipient. The provision of Broad Banding shall not apply for calculating the percentage of impairment for the award of Ex-Gratia Disability Award.</p>



<h3 class="wp-block-heading">5.&nbsp;<strong>Invaliding from Service</strong>.</h3>



<p>(a) Invaliding out of service is a condition precedent to considering an individual’s case for the award of Disability Pension, subject to such disability being sustained under circumstances that is accepted by the Competent/ Appellate Authority as Category ‘B’ or ‘C’.</p>



<p>(b) Liberalized Disability Pension or War Injury Pension may be awarded if the impairment has been sustained under the circumstances that is accepted by the Competent/ Appellate Authority, as Category ‘D’ or ‘E’ respectively.</p>



<p>(c) Armed Forces personnel who are invalided out of service with a disability sustained under circumstances that is accepted by the Competent/ Appellate Authority as Category ‘A’ are eligible for the award of Invalid Pension, subject to their completing 10 years reckonable service or being declared medically unfit for service both in the military as well as civil.</p>



<p>(d) Only those Armed Forces personnel who are placed in medical classification SHAPE — 5 and boarded out of service by a Competent/ Appellate Authority on the recommendations of an Invaliding Medical Board, before completing their terms of engagement, shall be treated as invalided out of service.</p>



<p>(e) JCOs/WOs/ OR and equivalent rank in other services who are placed permanently in a medical category other than SHAPE — 1 or equivalent and are discharged because (i) no alternative employment suitable to their low medical category can be provided, or, (ii) they having been retained in alternative employment, are discharged before the completion of their engagement, shall be deemed to have been invalided out of service.</p>



<p>(f) Retired officers who are not granted re-employment or JCOs/ WOs/ OR who are not granted extension of service, beyond their prescribed term of engagement, for not meeting the laid down medical standards, shall not be deemed to have been invalided from service.</p>



<p>(g) Cadets whose training is terminated and who are boarded out on the orders of the Competent Authority, solely on account of a wound, injury or any medical condition shall also be deemed to have been invalided from military training.</p>

<h3 class="wp-block-heading">Subject : Implementation of the Government decision on the recommendations of the fifth CPC regarding casualty pensionary awards for the Armed Forces Officers and JCOs &amp; Other Ranks.</h3>



<p>Sir,</p>



<p>The undersigned is directed to refer to this Ministry’s letter No. 1(2)/97/D(Pen-C) dated 31st January 2001. In terms of Para 4.1 of this letter, various categories have been enumerated for determining the pensionary benefits for death or disability under different circumstances due to attributable or aggravated by military service causes. One of the circumstances enumerated under Category ‘E’ (f) (ii) of the said para of the above mentioned MoD letter is ‘battle inoculation training exercises or demonstration with live ammunition.</p>



<p>2. Subsequently, it was decided to vide MoD letters No. 1(11)/2006-D (Pen-C)/PC dated 8th September 2009 and No. 1(11)/2006- D(Pen-C)/PC dated 5th March, 2010 that the term &#8216;Battle Inoculation Training Exercises&#8217; would cover the following six categories :</p>



<ul class="wp-block-list"><li>(i) Flying operation involved in rehearsing of war plans and implementation of OP instructions inclusive of international exercises.</li><li>(ii) All combat and Tactical Sorties in preparation of war.</li><li>(iii) Valley flying and missions involving operating at ultra low levels.</li><li>(iv) All operational missions undertaken during peace like Special operations, Live ORP, Recce, Elint, Survey and induction trials of new weapons.</li><li>(v) Missions undertaken in support of troops and security forces deployed in forward areas.</li><li>(vi) Flying missions involving landings on the ALGs.</li></ul>



<p>3. Para 2 of the MoD letter dated 08th September 2009 states that “cases already settled prior to the date of issue of this letter will not be reopened”.</p>



<p>4. The matter has been examined in this Ministry and it has been decided that the flying accidents cases that occurred on or after 01.01.1996 and which fall strictly under six categories mentioned at para 2 above may also be considered for grant of pensionary benefits in terms of MoD letter No. 1(2)/97/D(Pen-C) dated 31.01.2001. Accordingly, Para 2 of the MoD letter No. 1(11)/2006/D (Pen-C)/PC dated 8th September 2009 stands removed.</p>

<p>Subject: <strong>Expeditious processing of Second Appeal cases &#8211; Entitlement Rules for Casualty Pensionary Awards to the Armed Forces Personnel, 2008.</strong></p>



<p>Kindly refer to the various entitlements envisaged in the Entitlement Rules for Casualty Pensionary Awards to the Armed Forces Personnel, 2008 .</p>



<ol class="wp-block-list" start="2"><li>Entitlement Rules for <a href="https://centralgovernmentnews.com/tag/casualty-pensionary-award/" target="_blank" rel="noreferrer noopener">Casualty Pensionary Awards</a> to the Armed Forces Personnel, 2008 provide that an Armed Forces Personnel, who is boarded out on medical grounds or is discharged/ released/ retired in low medical categories, has the right to appeal against the denial of disability pension. These Rules also provide that, if a person is aggrieved by the denial of entitlement, he may, if he so desires, submit an appeal before Record Office/ Service HQrs within six months, which would be considered by the Appellate Committee for First Appeal. The Appellate Committee’s decision for upholding or rejecting the appeal will be by consensus. Any person, aggrieved by the decision in the First Appeal, may file a Second Appeal within six months of the decision of the Appellate Committee for First Appeal. The extant instructions also provide that in cases of non-consensus among the Members of the Second Appellate Committee on Pension, the Vice Chief of the respective Services shall forward the file to MoD for consideration of Hon’ble RRM.</li><li>During the processing of Second Appeal cases in this Department, It has been observed that in the majority of the cases, there has been inordinate delay at each level and the final disposal of Second Appeal applications is taking almost two years.</li><li>There is, thus, an urgent need for expeditious processing of Second Appeal cases. SHQs are, therefore, requested to not only streamline the entire process but also sensitize officials at all levels starting from the record office to examine and process such appeals in a time-bound manner so that the final decision involving the entire process is taken within 3-4 months.</li><li>This issues with the approval of the Secretary (ESW).</li></ol>

<p>Sub:- <strong>Revision of Casualty Pensionary Awards in respect of Pre-2006 Armed Forces Officer and JCOs/Ors pensioners: Clarification.</strong></p>
<p>Ref:- This office Circular No. 569 dated 19.10.2016.</p>
<p>There are several representations from various War Veteran Associations demanding the benefit of Maximum of Term of Engagement in OROP as well as in 7th CPC revision quoting the Para-3 of Circular No. 569 dated 19.10.2016. Thus, it appears that there are some misinterpretation /confusion about Para-3 of Circular No. 569 dated 19.10.2016, which needs to be clarified in this regard.</p>
<p>Earlier vide Annexure No.-II of MoD letter No. 200847/Pen-C/71 dated 24.02.1972, there was a provision that Service Element of War Injury Pension will be equal in amount to the normal retiring pension of the rank held at the time of disablement for maximum service of rank. It means Service Element of War Injury Pension was admissible for maximum term of engagement subject to restriction that War Injury Pension should not be more than last pay drawn. Prior to 6th CPC the Service Element/ Service Pension was given 50% of the reckonable emoluments for 33 years of Qualifying Service including weightage, and for lesser period it was proportionately reduced. It is pertinent to mention that after evolution of 6th CPC provision concept of pro-rata reduction has been dispensed with. As per 6th CPC orders pension will be 50% of the last pay drawn irrespective of Qualifying Service. Therefore, relevance of Maximum Term of Engagement becomes obsolete.</p>
<p>The minimum guaranteed pension after implementation of 6th Central Pay Commission, was initially determined on the basis of minimum of the Pay in Pay Band plus Grade Pay vide MoD letter dated 11.11.2008 (Circular No. 397 of this office). This was further modified with issue of MoD letter No. 1(04)/ 2015 / (1)-D (Pen/ Pol) dated 03.09 .2015 for revision of Service Pension/ Service Element in respect of Pre-2006 Commissioned Officers/JCOs/ORs pensioners on the basis of minimum of fitment table for the Rank in the revised Pay Band as indicated under fitment tables, and accordingly Circular No. 547 and 548 has been issued for PBORs and Commissioned Officers respectively. The ibid minimum guaranteed pension was calculated as 50% of minimum of fitment table for 33 years of Qualifying Service including weightage with pro-rata reduction for lesser period.</p>
<p>The minimum guaranteed disability element/war injury element was not covered in the ibid MoD letter dated 03.09.2015. Therefore, .MoD letter No. 16(01)/2014/ D(Pen/ Pol) dated 18.05.2016 was issued (Circular No. 560) for revision of Casualty Pensionary awards in respect of Pre-2006 Armed Forces Officers and JCO/ORs Pensioners/ Family Pensioners, which provides for minimum guaranteed Disability Element/War Injury Element. The clause of pension upto Maximum Term of Engagement in case of War Disabled Pensioners which was admissible prior to 6th CPC was omitted in both the above circulars of minimum guaranteed pension. Therefore, there was a need to clarify this issue and hence the Para-3 has been inserted in Circular No. 569 dated 19.10.2016. After issue of GOI MoD letter No. 1(2)/2016-D(Pen/Pol) dated 30.09.2016 for delinking of qualifying service of 33 years for revision of pension under minimum guaranteed pension, Para No, 3 of Circular No. 569 has become redundant and therefore this Para-3 may be treated as deleted.</p>
<p>After implementation of 6th CPC and subsequently also in 7th CPC, pension will be determined on the basis of 50% of last pay drawn irrespective of Qualifying Service, so the relevance of pro-rata reduction for lesser qualifying service become redundant as full pension is admissible for each qualifying service in each rank. Therefore, pension upto term of engagement has also become redundant. Further, the pension as per OROP rates was based on the live data of 2013 retirees where pension was given as per 6th CPC provisions. Therefore, the demand of pension upto term of engagement has also become obsolete.</p>
<p>Therefore, it is requested that the issue may be dealt with accordingly and the pensioner approaching for this may be clarified on similar lines duly stating that pension upto term of engagement in case of war disabled pensioners in OROP as well as 7th CPC revision is irrelevant.</p>

<p>Reference: This office Circular No.456 dated 18.03.2011, Circular No.503 dated 17.01.2013, Circular No. 542 dated 27.05.2015, Circular No. 547, 548 dated 11.09.2015 and Circular No.560 dated.08.06.2016</p>
<p style="text-align: center;"><strong>(Available on this office website www.pcdapension.nic.in)</strong></p>
<p>Consequent upon issue of GOI, MOD letter No.16(01)/2014/D(Pen/Pol) dated 18.05.2016, the Circular No. 560 dated 08.06.2016 was issued by this office for revision of Casualty Pensionary Awards in respect of Pre-2006 Armed Forced Officers and JCOs/ORs w.e.f. 01.01.2006. As per above Govt. letter, ‘the minimum guaranteed rates of Disability Element/ Liberalised Disability Element/ War Injury Element which were already revised w.e.f. 24.09.2012 vide GOI, MOD letter No 16(01)/2014-D(Pen/Pol) dated 10.04.2015 circulated vide this office Circular No. 542 dated 27.05.2015 has now been made applicable w.e.f. 01.01.2006 instead of 24.09.2012.</p>
<p>2. As per Para-5 of ibid Govt. letter, the aggregate of Service Element (revised in terms of Para 2.1 of GoI, MoD letter No 16(6)2008(1)/D(Pension/Policy) dated 04.05.2009 circulated vide Circular No. 410 dated 13.05.2009 and War Injury Element as amended from time to time, shall not exceed the minimum of the fitment table for the rank in the revised pay structure issued for implementation of recommendations of 6th CPC introduced from 01.01.2006 corresponding to the pre-revised Pay Scale held by the Armed Forces Personnel at the time of retirement/ discharge/ Invalidment. This ceiling of aggregate of War Injury Pension (Service Element plus War Injury Element) with reference to minimum of fitment table in the revised pay structure applicable from 01.01.2006 as mentioned above shall stand removed with effect from 01.07.2009 vide GoI, MoD letter No.10(01)/D(Pen/Pol)2009/Vol.II dated 19.01.2010.</p>
<p>3. Therefore, the arrears in respect of War Injury Pension shall be calculated in two phase viz. w.e.f <strong>01.01.2006 to 30.06.2009</strong> with ceiling/ cap as mentioned in Para-2 above and w.e.f<strong>. 01.07.2009 to 23.09.2012</strong> without cap. It is also mentioned that the Service Element has also been revised vide GoI, MoD letter No.1(04)/2015(II)-D(Pen/Pol) and 1(04)/2015(I)-D(Pen/Pol) dated 03.09.2015 circulated vide this office Circular No. 547 and 548 dated 11.09.2015 respectively to ascertain current entitlement of the service element.</p>
<p>4. Accordingly, to facilitate the PDA’s for the revision of War Injury Pension, corrigendum PPO was considered to be necessary. Annexure attached with Circular No.560 dated 08.06.2016 in all such affected cases was called for with certain information. <strong>Now, considering the hardship to the Ex- Servicemen located in remote areas, it has been decided that the requirement of Annexure to the Circular No. 560 for revision of War Injury Pension will be dispensed with and revision will be done by the PDAs on the basis of minimum of fitment table attached herewith. No corrigendum PPO will be issued by this office in this regard.</strong></p>
<p><strong>5. For revision of War injury Pension, minimum fitment table has been enclosed as annexure ‘A’ to ‘F’ and PDAs are authorized for revision of pension within the cap (i.e. aggregate of Service Element and War Injury Element to revised amount till 30.06.2009. Thereafter, the revision shall be done as per table annexed to GoI, MoD letter No. 16(01)/2014/D(Pen/ Pol) dated 18.05.2016, circulated vide Circular No. 560 dated 08.06.2016 for calculating the arrears up to 23.09.2012 i.e. without cap.</strong></p>
<p>6. It is also mentioned that vide this office circular No. 560 dated 08.06.2016 cited under reference, rates/ tables for modified parity of Special/ Liberalized Family Pension and Disability/ War Injury Element for various ranks was already prepared and circulated. In the said circular, there is no table for Hony. Naik, Hony. Havildar and Havildar granted Hony. rank of Nb Subedar. In view of above, it is hereby clarified that since Hony. Rank of Naik, Havildar and Havildar holding Hony rank of Nb Sub are drawing pay in the pay scale of Sepoy, Naik and Havildar respectively, therefore, they are entitled for modified parity with reference to substantive rank held at the time of retirement/ discharge/ invalidment except Naik (TS) who draws the pay of Naik. Therefore, Naik (TS) should be entitled for modified parity with respect to Naik rank.</p>
<p>7. All the Public Sector Banks disbursing defence pension would render a monthly progress report to the office of the PCDA(P) Allahabad as per the Proforma attached as <strong>APPENDIX- ‘Y’</strong> (both for ICOs and JCOs/ ORs). All PDAs are therefore, requested to ensure rendition of the said monthly report both in hard and soft copy <strong>(Excel Format)</strong> by name to <strong>Shri S. Basumatary, Sr. Accounts Officer (P) (Audit Co-ordination)</strong> on e-mail ID: <strong>cda-albd@nic.in</strong> by 15th of the following month. It is also enjoined upon that all the columns of<strong> APPENDIX- ‘Y’</strong> must be filled in complete and correct manner. It is also requested that one more copy of the requisite <strong>APPENDIX- ‘Y’</strong> may invariably be sent along with the pension payment scrolls in which arrears of pension will be shown.</p>
<p>8. The DPDOs will render the said monthly progress report in <strong>APPENDIX- ‘Y’ to the office of the PCDA (P) Allahabad</strong> as well as respective CDAs i.e. CDA (PD) Meerut and CDA Chennai as the case may be.</p>
<p>9. A copy of arrear sheet shall invariably be provided to the concerned pensioner by the PDAs for information.</p>
<p>10. All other terms and conditions shall remain unchanged.</p>
<p>11. The provisions of this circular shall take effect from 01.01.2006 and arrears, if any, shall be allowed from 01.01.2006 up to 23.09.2012.</p>
<p>12. This circular has been uploaded on this office website www.pcdapension.nic.in for dissemination of Defence pensioners and Pension Disbursing Agencies.</p>

<p>Subject: <strong>Rationalization of casualty Pensionary Awards for the Armed Forces Officers and Personnel below Officer Rank (PBOR) invalided out from service prior to 1.1.1996: Extension of benefit of broad banding of percentage of disability/ war injury.</strong></p>
<p>Reference: GOI, MOD letter No. 12(16)/2009/D(Pen/Policy) dated 15.09.2014 and this office Circular No. 429 dated 04.03.2010.</p>
<p>A copy of the Government of India, Ministry of Defence letter No. 12(16)/2009/D(Pen/Policy) dated 15/09/2014 is enclosed herewith for information and necessary action.</p>
<p><strong>BACK GROUND</strong></p>
<p>2. Consequent upon issue of letter No.1 (2)/97/D (Pen-C) dated 31.01.2001 the benefit of Broad Banding i.e. Rounding of Disability, 50% (for disability less than 50%) and 75% (for disability from 50% to 75%) and 100% (for disability from 76% to 100%) provision has been made for those pensioners who have been invalided out from the service on medical ground attributable to or aggravated by military service on or after 01.01.1996. The demand of this benefit for Pre-96 Defence pensioners was pending with the Govt. which had been considered by Cabinet Secretary Committee and recommended for extension of this benefit to Armed Forces Officers and PBORS who were invalided out of service prior to 01.01.1996 and were in receipt of disability/ war injury pension as on 01.07.2009. The Govt. had accepted the above said recommendations and issued order vide MOD letter No. 10(01)/D(Pen/Policy)/2009/Vol-ll dated 19.01.2010.</p>
<p><strong>NEW PROVISION IN BROAD BANDING</strong></p>
<p>3. Now in partial modification of above said GOI, MOD letter dated 19.01.2010, the Government vide MOD letter No. 12(16)/2009/D(Pen/Policy) dated 15.09.2014 has allowed the benefit of broad banding of percentage of disability/ war injury w.e.f. 01.01.1996 to Armed Forces Officers and PBOR pensioners who were invalided out of service prior to 1.1.1996 and were in receipt of disability element/ war injury element as on 1.1.1996. In such cases, where the pensioner was not in receipt of disability element as on 1.1.1996 but became entitled at a later stage due to reassessment of disability more than 20%, this benefit shall also be allowed from the same date i.e. from the date of reassessment.</p>
<p><strong>AFFECTED CASES</strong></p>
<p>4. With effect from 01.01.1996, the concept of broad banding of percentage of disability/ war injury, as provided in Para 7.2 of MOD letter dated 31.01.2001 quoted above, shall be extended to Armed Forces Officers and PBOR who were invalided out of service prior to 01.01.1996 and are in receipt of disability/ war injury pensions as on 01.01.1996. In such cases where the pensioner was not in receipt of disability element as on 01.01.1996, but became entitled at later stage due to re-assessment of disability more than 20%, this benefit shall be allowed from the same date i.e. from the date of reassessment.</p>
<p>5. Further, as per above GOI MOD letter, those cases where the pensioners were in receipt of disability element/ war injury element as on 1.1.1996 but the same was discontinued at a later stage due to reassessment of disability as less than 20%, the disability element/ war injury element shall be discontinued from the later date as hithertofore. However, in those Pre 1.1.1996 cases where the disability element/ war injury element was not allowed for disability being accepted as less than 20% at initial stage or subsequent stage on reassessment of disability, the same will continue to be disallowed and such cases will not be re-opened.</p>
<p><strong>APPLICATION TO BE SUBMITTED</strong></p>
<p>6. For this purpose, each affected Armed Forces pensioner who were invalided out of service prior to 1.1.1996 and were in receipt of disability element/ war injury element on 1.1.1996 or thereafter, shall submit an application in the format enclosed as Annexure to this letter to the PSAs concerned through their Pension Disbursing Agencies and Record Offices thereof in the case of PBOR and through Pension Disbursing Agencies in the case of Commissioned Officers to PSAs concerned for revision of disability element/ war injury element.</p>
<p>7. For the grant of LTA of deceased invalided out of service prior to 01.01.1996 and who were in receipt of disability element/ war injury element as on 01.01.1996 or thereafter, a certificate is to be submitted by the Family Pensioner/ his heir in the format enclosed as CERTIFICATE FOR THE PAYMENT OF LTA to this circular. However, the Part-II &amp; Part-III of ANNEXURE will also be filled up with CERTIFICATE FOR THE PAYMENT OF LTA.</p>
<p><strong>ACTION ON THE PART OF THE PDA</strong></p>
<p>8. Pension Disbursing Authorities are requested that the affected cases of disability/war injury element where Armed Forces Officers and PBOR who were invalided out from service prior 01.01.1996 and were in receipt of disability element/ war injury element as on 1.1.1996 may be reviewed and application obtained in triplicate from them may be endorsed and submitted to the concerned Record Office in the cases of PBOR and directly to the PSA in the cases of Commissioned Officer so that the necessary Corr. PPO for Broad Banding may be issued by the PSA concerned.</p>
<p>9. If a pensioner, to whom benefit accrues under the provisions of this letter, had already died on or after 01.01.1996 but before date of issue of this letter (i.e. 15.09.2014), the application for revision shall be submitted by the family pensioners or by his/ her heir, as the case may be. Payment of LTA shall, however, be regulated as per the extant Government orders on the subject matter.</p>
<p>10. PDA to ensure that format enclosed in cases for ‘CERTIFICATE FOR THE PAYMENT OF LTA’ is properly filled along with Part-ll of Annexure and the same is verified by them.</p>
<p><strong>ACTION ON THE PART OF THE RECORD OFFICE</strong></p>
<p>11. ROs are requested that on receipt of the ANNEXURE for Broad Banding from the individual or CERTIFICATE FOR THE PAYMENT OF LTA from the family pensioner/ his/her heir duly filled by the PDAs the same may please be forwarded to concerned PSAs duly verified along with completed LPC-Cum-Data Sheet, photo copy of original and latest D/ DE PPOs for issue of necessary Corr PPO. The following documents may invariably be forwarded along with the claim-</p>
<p>(i) CTC of Sheet Rolls’ page indicating clause of discharge.<br />
(ii) Discharge Part-ll order showing the clause of discharge and where Part-II order is not available, a certificate, certifying that the individual had been invalided out/ deemed to be invalided out duly showing the clause of discharge.<br />
(iii) A certificate to the effect may also be enclosed that “no claim on this account has earlier been initiated” to avoid recurrence of double PPO for the same claim.</p>
<p>12. ROs are also requested to review all such cases where Broad Banding benefit has already been notified by concerned Pension Sanctioning Authorities wef 01.07.2009 and where disability was assessed as for life before 01.01.1996.</p>
<p>A list of such cases indicating individual’s details i.e. Name, Regt. Number, Original PPO Number, Corrigendum (Broad Banding) PPO No. and Current PDA details may be forwarded to concerned PSA for further necessary action.</p>
<p>13. This may please be given wide publicity.</p>
<p>14. This circular has been uploaded on PCDA (P) website www.pcdapension.nic.in for dissemination across the Defence pensioners and PDAs.</p>

<p>Subject: <strong>Implementation of Government decision on the recommendations of the Committee Secretaries Committee- 2012 on the issues related to Defence Service Personnel and Ex-Servicemen- Improvement in Casualty Pensionary Awards for pre- 2006 Armed Forces Officers and JCO/ ORs and equivalents.</strong></p>
<p>Reference:    This Office Circular No. 503 dated 17.01.2013.</p>
<p>Kindly refer to Table No. 1 appended in this office circular cited under reference. Your attention is invited wherein to various nomenclature columns (Column 6, 8, 11, 13, 17,19) the 2nd Life awards of SFP and 2nd Life awards of LFP have been shown. However, in the case of Commissioned Officers it should be Dependent Pension (Special) and Dependent Pension (Liberalised). In order to facilitate the PDAs for smooth revision and implementation, the same has been rectified and an amended Table No. 1(Revised) is enclosed for necessary revision/ action.</p>
<p>It is also mentioned that the rates of Dependent Pension (Liberalised) in case both parents are alive are @ of 75% of LFP. This has been left out inadvertently which has now been reproduced in the revised table.</p>
<p>2.    All Pension Disbursing Authorities are authorized to revise/ update the family pension in respect of Commissioned Officers equivalent as per tables attached to this circular, if the same is beneficial. Table No. 1 appended in Circular No. 503 is replaced by Table No. 1(Revised) annexed with this circular.</p>
<p>3.    All other terms and conditions for revision of family pension in respect of pre-2006 Armed Forces family pensioners drawing pension under casualty pensionary awards shall remain unchanged.</p>
