<h4 class="wp-block-heading">Order to provide a huge relief to young Central Armed Police Force (CAPF) personnel</h4>

<p>In a significant New Year announcement, Union Minister of State (Independent Charge) Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr. Jitendra Singh today informed of the government decision to extend &#8220;Disability Compensation&#8221; for all serving employees, if they get disabled in the line of duty while performing their service and are retained in service in spite of such disablement.</p>



<p>Today’s order will particularly provide a huge relief to young Central Armed Police Force (CAPF) personnel like CRPF, BSF, CISF, etc since disability in performance of duties is generally reported in their case due to constraints of job requirement as well as hostile or difficult work &#8211; environment.</p>



<p>Pertinent to mention that this new order will remove an anomaly in service rules, considering the hardship faced by the employees, since as per the earlier OM dated 5/5/2009, the provisions of disability benefits under Central Civil Services(CCS) (EOP) Rules did not provide such compensation to those government servants who were appointed on or after 1.1.2004 and covered under National Pension System (NPS). However, with the new order issued by the Department of Pensions in the Ministry of Personnel, the employees covered under <strong><a href="https://centralgovernmentnews.com/category/nps/" target="_blank" rel="noreferrer noopener">NPS</a></strong> will also get benefits under Rule (9) of Extra Ordinary Pension (EOP).</p>



<p>In other words, if a government servant gets disabled while performing his duties and this disablement is attributed to government service, in that case if he is still retained in the service in spite of disablement, a lump sum compensation will be paid to him by arriving at the capitalized value of the disability element, with reference to the Commutation Table in force from time to time.</p>



<p>Expressing his satisfaction on today’s order, Dr. Jitendra Singh said, the Modi Government is making all efforts to simplify the rules and to do away with discriminatory clauses. The ultimate objective of all these new initiatives is to provide ease of living for the Government servants even after they have superannuated and become pensioners or family pensioners or elder citizens, he said.</p>

<p>In another employee-friendly decision, the Ministry of Personnel recently did away with minimum qualifying service of 10 years for pension, if a government servant is incapacitated due to bodily or medical infirmity and retired from government service. Accordingly, Rule 38 of CCS (Pension) Rules was amended to provide Invalid Pension at 50% of the last pay, even if the employee had not completed minimum qualifying service of 10 years.</p>



<p>In addition to above, in yet another reform in the Pension Rules, a decision was also taken to amend the rule and provide pension at enhanced rate to the family of an employee who died during service before completing the requisite service of minimum 7 years. As a result, now the family pension of 50% of the last pay is also admissible to the family of employees who die even before completing 7 years of service.</p>

<p><strong>Retirement Age of CAPF Personnel &#8211; 57 to 60 Years</strong></p>



<p>&#8220;7th Pay Commission recommendations on Retirement Age of CRPF, BSF, ITBP and SSB. Enhancement of Age of Retirement from Existing 57 years to 60 Years of Age&#8221;</p>



<p>According to the PTI News, the Retirement age of CAPF Personnel is set to be fixed at 60 years after the Supreme Court recently dismissed a special leave petition (SLP) filed by the government against the direction of the Delhi High Court to resolve an existing anomaly, official sources said today.</p>



<p>Sources in the security establishment said the Central government has time till May-end to implement the directive of the Delhi High Court and after consultations with all the Central Armed Police Forces (CAPFs), it is “certain” that the age of superannuation in all the forces will be made uniform, well before the deadline.</p>



<p><strong>7th Pay Commission recommendations on Retirement Age</strong></p>

<p>This demand has been made by CRPF, BSF, ITBP and SSB. As per the existing position the age of retirement in Assam Rifles and CISF is 60 while it is 57 in rest of the CAPFs up to the rank of Commandants.</p>



<p>DoPT has stated that although the issue was dealt with by the V and the VI CPCs, neither of the Commissions recommended any changes in the age of superannuation. MHA has also declined to enhance the age of superannuation on the ground that the age of retirement has been fixed depending on operational need of that particular Organisation.</p>



<p>Having considered the entire position and the views of MHA and DoPT on this issue, the Chairman, Seventh CPC feels that the grounds stated for justifying differential age of superannuation are not very convincing. Further, members of the CAPFs squarely form a part of the civilian work force. Hence, the Chairman recommends a uniform age of superannuation of 60 years to all CAPFs. Dr. Rathin Roy, Member, Seventh CPC is in<br />
agreement with this recommendation.</p>



<p>However, Shri Vivek Rae, Member, Seventh CPC has not agreed with this recommendation for the following reasons:-</p>



<ul class="wp-block-list"><li>Ministry of Home Affairs is of the considered view that the age of superannuation cannot be enhanced from existing 57 years to 60 years for all ranks of CRPF, BSF, SSB and ITBP. Force personnel up to the rank of Commandant have operational/combat roles in the field, which require higher physical fitness and efficiency. The higher ranks of DIG and above in these four CAPFs are more supervisory and administrative in nature, which do not require physical fitness of the level required in field units. Therefore, in the ranks of DIG and above in the four CAPFs, the age of retirement is 60 years, while for ranks till the level of Commandant, the retirement age is 57 years.</li><li>Stipulating a lower age of superannuation up to the rank of Commandant in these four CAPFs is a well thought and conscious decision of the government based on ground realities and as per the administrative and operational requirement of the forces. Even in the Army, there are different ages for retirement, which increase in accordance with rank.</li><li>MHA has further observed that it is not correct to say that in Assam Rifles the age of retirement up to the rank of Commandant is 60 years. Assam Rifles is officered by the Army, and the retirement age at the level of Colonel is not 60 years but 57 years.</li><li>CAPFs like ITBP, BSF are posted on border/high altitude/difficult terrain duties and CRPF is generally deployed for internal security duties and CI operations. Hence their functional profile is more akin to Army, justifying younger age of the Force. Thus, 57 years in other CAPFs and 60 years in CISF is commensurate with the different roles assigned to them.</li></ul>

<p>As per information received from CAPFs &amp; AR, <strong>4202</strong> personnel died during service and on duty due to non-combat causes during the last three years and current year upto 31.01.2018.</p>
<p>CAPFs &amp; AR personnel and officers (upto the rank of Commandant, who are deployed in field formation only) are entitled to Ration Money Allowance @ Rs. 97.85 per head per day.</p>
<p><strong>The details of facilities provided to CAPF personnel is as per details given below:</strong></p>
<ol>
<li>Continuous endeavours are made to improve the living conditions of the CAPF personnel, including enhancing the level of their housing satisfaction and appropriate budgetary allocations are also made for this purpose.</li>
<li>Forces have taken adequate steps to provide potable drinking water to its troops and families even in remotest areas. Borewells in permanent locations, water supplies from State Water bodies, installing commercial Reverse Osmosis (RO) system and water-harvesting are some of the measures undertaken by the forces for providing water.</li>
<li>CAPF personnel deployed at borders are provided with barrack accommodation with cook house, dining hall and toilet blocks. In harsh areas, integrated composite building with central heating and freeze proof toilets are provided. Medical facilities, Air Courier Services, dedicated rail coaches in some major trains, Central Police Canteen, recreation and transit camp facilities are also available to the personnel deployed at borders.</li>
<li>Ex-gratia lump-sum compensation @ Rs.35 lakhs for death on active duty and Rs.25 Lakhs for death on duty, as the case may be, is entitled to the Next of Kin of the deceased personnel.</li>
<li>Under the Prime Minister Scholarship Scheme, amount @ Rs.2250/- pm for girls and Rs.2000/- pm for boys is being released to the wards of serving/retired CAPFs, AR and NSG personnel. Prime Minister Scholarship is admissible to 1000 girls and 1000 boys.</li>
<li>5% vacancies are reserved in Group &#8216;C&amp;&#8217; for compassionate appointments for NoK of the deceased personnel.</li>
<li>There is a reservation in MBBS and BDS seats for the wards of CAPFs &amp; AR personnel in Medical Colleges.</li>
<li>Central Police Canteens are functioning at various locations in the country.</li>
<li>A Welfare &amp; Rehabilitation Board has been established for the welfare and rehabilitation of CAPF &amp; AR personnel and their families including disabled personnel.</li>
<li>The NOKs of deceased CAPFs &amp; AR personnel who sacrificed their lives for the cause of nation are eligible for &#8216;Operational Casualty Certificate&#8217;.</li>
<li>The Government has accepted the recommendations of 7th Central Pay Commission (CPC) on various allowances, inter alia, Risk &amp; Hardship Allowance, Dress Allowance, Additional Free Railway Warrant/LTC, etc.</li>
</ol>
<p>This was stated by the Minister of State for Home Affairs, Shri Kiren Rijiju in a written reply to question in the Lok Sabha today.</p>

<p>The rate of ex-gratia lump sum compensation for 100 percent disability to CAPFs &amp; Assam Rifles personnel, who are disabled in the performance of their bonafide official duty under various circumstances and are boarded out from service on account of disability attributable to aggravated in service, has been revised vide this Ministry OM No.27011/64/2010-R&amp;W (Part) dated 07/06/2017 from Rs. 09 lakhs to Rs. 20 lakhs w.e.f 01/01/2016.</p>
<p>The 7th CPC has recommended a common regime of Risk and Hardship Allowance for Army and CAPFs which has been accepted by the Government.</p>
<p>This was stated by the Minister of State for Home Affairs, Shri Kiren Rijiju in a written reply to question by Shri Bahadur Singh Koli in the Lok Sabha today.</p>

										<content:encoded><![CDATA[<p><b>Efforts to improve better living, working and service condition for CAPF Personnel</b></p>
<p>&nbsp;</p>
<p>The Government keeps on making efforts to improve better living, working and service condition for force personnel. The following measures have been taken in this regard:-</p>
<blockquote class="tr_bq"><p>i) Implementing a transparent, rational and fair leave policy;</p>
<p>ii) Grant of leave to the force personnel to attend to their urgent domestic issues and social commitments;</p>
<p>iii) Regular interaction, both formal and informal, among Commanders, officers and troops to find out and address their problems;</p>
<p>iv) Revamping of grievances redressal machinery;</p>
<p>v) Regulating duty hours to ensure adequate rest and relief;</p>
<p>vi) Improving living conditions through provision of basic amenities/facilities for troops and their families;</p>
<p>vii) Government has approved extensionof the facility of retention of Government accommodation at the last place of posting for CAPF personnel deployed/posted in Left Wing Extremism affected areas/ districts (except State capitals), as notified by the Government of India from time to time, on payment of flat rate/normal license fee. This facility is already being given to the Force personnel in case of posting to NE States and J&amp;K State.</p>
<p>viii) Motivating the forces through increased risk/hardship and other allowances such as Detachment Allowance, Kit Maintenance Allowance, Washing Allowance, Ration Money Allowance, MARCOS etc;</p>
<p>ix) Provision of STD telephone facilities to the troops to facilitate being in touch with their family members and to reduce tension in the remote locations;</p>
<p>x) Officers and Jawans serving in hard area are being given preference for posting to soft/static locations as per their choice to the extent possible;</p>
<p>xi) Better medical facilities for troop and their families including introduction of Composite Hospitals with specialized facilities;</p>
<p>xii) Organising talks by doctors and other specialists to address their personal and psychological concerns;</p>
<p>xiii) Yoga and meditation classes for better stress management;</p>
<p>xiv) Treating the hospitalization period due to injury suffered by CRPF personnel during the course of duty to be treated as duty.</p>
<p>xv) Adequate steps have been taken in all establishments to provide and upkeep the recreational and sport facilities. Force personnel are encouraged constantly to actively participate in sports and games;</p>
<p>xvi) Providing welfare measures like Central Police canteen facility to the troops and their families, scholarships to their wards, etc;</p>
<p>xvii) Giving status of ex-CAPF personnel to the retired personnel of CAPF, which is expected to boost the morale of the existing CAPFs personnel and also expected to provide better identity, community recognition and thus higher esteem and pride in the society to the Ex-CAPF personnel;</p>
<p>xviii) CRPF campus at various locations are renewed and upgraded according to present scenario. Adequate basic amenities like toilets, bathrooms, drinking water points, messing for both male and female are available. Mobile toilets are also provided to troops for use during operational duty.</p>
<p>xix) Force campuses are kept clean and sanitation rounds are done by medical officers to monitor and keep up the hygiene status of the campus.</p>
<p>xx) Schemes have been implemented for facilitating the women personnel i.e. Gender Sensitization, Health care Centre, improvised service, nutritional care centre etc;</p>
<p>xxi) in addition to the above, the female personnel are liberally given Child Care Leave (CCL);</p>
<p>xxii) Crèche is also established at various group Centres/Units locations to facilitate the female employees;</p>
<p>xxiii) The air courier service facility has been extended to CAPF personnel deployed in remote areas of North east and Jammu &amp; Kashmir region including Leh as a welfare measure;</p>
<p>xxiv) Promotions are being released regularly to the eligible personnel as and when vacancies arise in the next higher rank;</p>
<p>xxv) To increase the promotional avenues for CRPF Jawans. CRPF has been instructed to carry out Cadre Reviews regularly as per the DoP&amp;T guidelines.</p>
<p>xxvi) The financial benefits under Modified Assured Career Progression (MACP) Scheme and Senior Time Scale (STS) Scheme are given in time as per the rules to the eligible personnel in case they do not get promotion for want of vacancies;</p>
<p>xxvii) Relaxations are considered in residency/qualifying service, where there exist vacancies but the personnel in feeder grade are short of meeting the eligibility condition;</p>
<p>xxviii) The doctors are given time bound promotion upto the rank of Commandant (Grade Pay of Rs. 8,700/-) and time bound financial up-gradation to the further two ranks i.e. to Deputy Inspector General (Grade Pay Rs. 8,900/-) and Inspector General (Grade Pay Rs. 10,000/-).</p>
<p>xxix) On the recommendations of the 6th CPC, Government has introduced ASI rank in the General Duty of CAPFs including CRPF. This has reduced the stagnation in the rank of Head Constable.</p></blockquote>

<p>(a) whether a recent report prepared on the state of affairs of the Central Reserve Police Forces (CRPF) has indicated that continuous deployment in high intensity conflict areas is forcing the jawans and officers to suffer from large scale `Social Ostracism`;</p>
<p>(b) if so, the details thereof and the corrective steps taken/being taken by the Government in this regard;</p>
<p>(c) whether there are reports that the youths are reluctant to join CRPF and if so, the details thereof and the reaction of the Government thereto; and</p>
<p>(d) the comprehensive measures being taken by the Government for ensuring better living and working conditions of both male/female personnel, bringing more promotional avenues for CRPF jawans, boosting the morale of the personnel and to facilitate their involvement in society?</p>

(a) &amp; (b): No Madam, there is no such report in the recent.</p>
<p>(c): There are no such reports. However, as per the information received from the Central Reserve Police Force (CRPF), only about 6% of candidates selected in the year 2012 and 5% in the year 2013 did not join.</p>
