<h3 class="wp-block-heading">Subject: Cadre Restructuring of Group &#8216;C&#8217; employees in Department of Posts &#8211; Clarification w.r.t. HSG-I (NFG) &#8211; reg.</h3>



<p>Sir/Madam,</p>



<p>Kindly refer to this office letter of even number dated 10.11.2017, on the subject mentioned above, vide which following guidelines/clarifications were issued, w.r.t.&nbsp;<strong>identification of NFG posts in HSG I</strong>:</p>



<p><em><strong>“Only 70 percent of HSG I posts i.e. 235 posts have been approved for NFG scale. Therefore it is not possible to promote all HSG I officials who are completing 2 years of service in HSG I. Although there is need to identity these posts for promotion from HSG I, in order to avoid inconvenience to staff in the initial stage and purely as a temporary measure, the officials can be given NFG on the basis of seniority wherever they are posted in HSG I by upgrading the HSG I post to NFG and simultaneously downgrading the NFG position to HSG-I elsewhere. In due course of time the posts need to be identified”</strong></em></p>



<p>2. Further, w.r.t. some queries of Tamilnadu Circle, following clarification was also issued to&nbsp;<strong>all HoCs</strong>&nbsp;vide this office letter of even number dated 16.03.2018 [refer Para3 (z) (i) &amp; (ii)]:</p>

As per Dte. instructions they have to be posted in the same office where they are working. In that case the Postmaster post of Sr. PM office and PM Gr. III office will be in lower/equal pay scale than that of newly created HSG I NFG post. When more than one eligible officials for consideration to HSG I (NFG) are working in the same office, on upgradation of the said HSG I posts to NFG, more than one official in HSG I NFG cadre have to be allowed to work in the same office.</td><td>HSG I (NFG) is just a Non-Functional Grade, it should not affect the hierarchical Order or Channel of Reporting of the office as the purpose of introducing the NFG was to provide some financial benefit to the senior most employees in the HSG-I Grade. HSG-I (NFG) officials will continue to do the same work and man the same post in the hierarchy. However, higher responsibilities may also be assigned to the NFG officials in the exigencies of work.</td></tr></tbody></table></figure>



<p>3. In this regard, it is instructed/ clarified that HSG-I (NFG) posts/offices are not to be identified separately and the HSG-I (NFG) may be given <em>in-situ</em> to the eligible officials subject to the number of posts allotted to the Circle in the grade.</p>

<p>Sir/Madam,</p>



<p>Kindly refer to this of6ce letter of even number dated 03.02.2022, on the subject mentioned above, vide which the instructions issued vide this office letter of even number dated 05.12.2018 were reiterated that &#8220;<strong><em>LSG HSG-II, HSG-I and HSG-I (NFG) posts will be deemed to have been upgraded to these grades only w.e.f the dates they are filled up, ie. from the date the promoted official assumes the charge. Otherwise, the post will remain in the lowest grade</em></strong>&#8220;.</p>



<p>2. In this regard, it is further clarified that <span style="text-decoration: underline;"><strong>the additional (new) posts of LSG, HSG-II, HSG-I &amp; HSG-I (NFG), allocated to the Circles after the Cadre Restructuring, which have not been created by the Circles due to un-availability of eligible officials in feeder grades, shall remain in the lowest grade i.e. Postal Assistant</strong></span> while ensuring that the total sanctioned strength of PA, LSG, HSG-II, HSG-I &amp; HSG-I (NFG), must not exceed the total number of posts in these grades as mentioned in this office letters of even number dated 27.05.2016/10.11.2017.</p>

<h3 class="wp-block-heading">Sub: Implementation of Cadre restructuring &#8211; Date of effect &#8211; reg.</h3>



<p>Ref: 1. Directorate No.25-4/ 2012/PE-1 (Vol.II) dated 27-05-2016.<br />2. Directorate No.25-4/ 2012-PE-1 (Vol.II) dated 1101102916.<br />3. Directorate No.25-4/ 2012-PE-1 (Vol.II) dated 09-06-2017.<br />4. CO No.EST/1-6/ 2016 dated 21-07-2016.<br />5. CO No.ST/5-2/ CADRE REST/ 2019 dated 21-01-2020.</p>



<p>Our union wish to point out the following factual position regarding the implementation of the cadre-restructuring and plead for the fixation of the date of effect notionally as 27-05-2016 as per the Directorate instructions.</p>



<p>1. Orders of Cadre-restructuring of Group-C Employees were issued by the Directorate vide No.25-4/2012-PE-I (Vol.II) dated 27-05-2016. Clarification as to how it is to be implemented is also issued by the Directorate vide Letter No.25-4/2012-PE-I (Vol.II) dated 11-11-2016. Subsequently a committee under the Chairmanship of Shri. Charles Lobo, CPMG Karnataka Circle was set up to find out solutions and eliminate the queries raised by the Circles and service unions. Vide Directorate No.25-4/2012-PE-I (Vol.II) dated 09-06-2017. Accordingly, the committee examined all the queries raised by the staff side and submitted the report on22-09-2017. Based on the report the circles started the implementation process.</p>



<p>2. In Kerala Circle as the first step the Posts/ offices for upgradation were identified. A circle gradation list was also circulated. Some officials approached the Hon’ble CAT challenging the gradation list. The Hon’ble Court has stayed the process of Cadre Re-structuring and our Circle could not go further on the matter observing Directorate instructions either by completing DPC process by 31-12-2017 or issuing orders of posting by 31-01-2018. Completing the Court proceedings the Hon’ble CAT has lifted the stay orders and permitted the department to go ahead with the cadre re-structuring process with the existing gradation list. Accordingly, after a long gap of 4 years, the cadre-restructuring of Group C officials has been implemented in the month of July 2020.</p>



<p>3. All other circles except Kerala has completed the Cadre Re-structuring process and extended the benefits to the eligible officials within the time frame fixed by the Directorate. Kerala Circle could not implement and extend the benefits for the last 4 years due to the simple reason of a court case. Though the cadre re-structuring is a Pan-India issue and orders has been in force at National level, the denial of the benefit to a section of employees in a circle for more than 4 years based on a locally promulgated court case is unjustified. More over the Hon’ble Court has not mentioned any adverse comment about the date of effect while disposing the case. Normally the date of effect fixed by the Directorate is applicable to our circle also. Para 4.5 of the Charles Lobo Committee report reads as under:</p>



<p>“<strong>For the sake of uniformity, the promotions will be effective from the date of the original order dated 27-05-2016. It will be applicable to all eligible officials including those were in service but now retired.</strong>”</p>



<p>4. In Kerala Circle uniformity has tampered and as a result, the benefit of Cadre Re-structuring is delayed by 4 years. In other circles, the officials promoted to the cadre of LSG with effect from 27-05-2016 will get promotion to the higher cadres i.e. HSG-II and HSG-I after the completion of 6 years and 5 years as stipulated in the existing recruitment rules. But the officials in our circle will have to wait more years to get their promotion to the higher cadres. Many officials are at the fag end of their service and naturally they will be compelled to retire from the existing cadre without enjoying the benefits of the approved promotion scheme.</p>



<p>5. The proposal for giving adhoc promotion to HSG-II Cadre in relaxation of normal recruitment rules is under process at directorate level. Recently directorate has called for a proforma report by fixing the eligibility period as 3 years in LSG cadre for adhoc promotion to HSG-II cadre. If the date of effect of cadre re-structuring is taken as per the Directorate instructions, all the officials in LSG cadre in our circle will be eligible for adhoc promotion. The proforma report is to be prepared accordingly.</p>



<p>Considering the above valid points, we would like to urge upon you to kindly issue suitable orders to ensure the date of effect of cadre restructuring as stipulated by the directorate i.e. 27-05-2016.</p>

<p>2. In this connection it is intimated that Secretary (Coordination), Cabinet Secretariat convened a meeting on 21.10.2020 at 10.30 A.M. through video conference lo discuss the rules/ provisions in MO recruitment/career management of sportsperson in their organization/PSUs.</p>



<p>3. Joint Secretary &amp; Additional FA(AN) attended the meeting and directed to obtain the information on the following issues:</p>



<ul class="wp-block-list"><li>a) No. of recruitment of the meritorious sportsperson made by the Defence Accounts Department in terms of DoP&amp;T OM dated 04.08. 1980.</li><li>b) As on date, in which grade/post, candidates who are recruited as meritorious sportsperson (Group B &amp; C) in Defence Accounts Department are placed. Total no. in each grade to be indicated.</li><li>c) Provision in the existing RRs (Group &#8216;B&#8217; &amp; &#8216;C&#8217;) for the recruitment in r/o of sportsperson in DAD.</li><li>d) Provisions regarding career Progression in the existing RRs in r/o sportsperson.</li></ul>

<p>*As per the prov1s10ns contained in existing recruitment rules of Hindi Pradhyapak, eligible Hindi Pradhayapaks for promotion will be given promotion to the post of Assistant Director (Language) as per the vacancies available. Accordingly, the posts of those Hindi Pradhayapaks will be deemed abolished. The remaining Hindi Pradhayapaks will remain in the Hindi Pradhayapak’s post, till they complete the qualifying service and mandatory training according to the provisions of recruitment rules for promotion. In future, when the remaining Hindi Pradhayapaks will also complete qualifying service and compulsory training as per the provisions of the existing recruitment rules, they will also be promoted to the post of Assistant Director (Language) as per the rules, after which the posts of all Hindi Pradhayapaks will be deemed to be abolished.</p>

<h3 class="wp-block-heading">Sub: Combined Cadre Restructuring of Group A, B and C services on the Railways</h3>



<ol class="wp-block-list"><li>Senior Section Engineers (SSE) in the category of Technical Supervisors were given no improvement in the Cadre Restructuring since 1984 and Junior Engineers (JE) are eligible for only one promotion in their cadre as apparent from the following table – in spite of manifold increase in duties and responsibilities of the Technical Supervisors&nbsp;<em>I&nbsp;</em>Rail Engineers:</li><li><strong>NO IMPROVEMENT FOR SSE IN THE CADRE STRUCTURE OF TECHNICAL SUPERVISOR</strong></li></ol>

<ol class="wp-block-list" start="3"><li>There has been no upgrading or Cadre Restructuring of the Apex Grade of Group ‘C’ ever on the Railways – (either in 1979, 1984, 1993, 2003 or 2013). Consequently there is extreme stagnancy &amp; resultant frustration amongst the incumbents of the Apex Grade ‘C’- especially amongst the Technical Supervisors&nbsp;<em>I&nbsp;</em>Rail Engineers on the Railways.</li><li>The post of SSE in the pay scale 2375-3200 in 4th CPC, Rs.7450-11500 in 5th CPC, G.P Rs.4600 in 5th CPC and Pay Level-7 in 7th CPC had not received any upgradation in the past five cadre restructuring exercises.</li></ol>



<ol class="wp-block-list" start="5"><li>There has been substantial increase in the duties and responsibilities over the years of the Technical Supervisors&nbsp;<em>I&nbsp;</em>Rail Engineers (JEs &amp; SSEs) due to modernisation and advancement of technology on the Railways – but this has not been recognised or remunerated in any manner whatsoever – especially in the case of Senior Section Engineers.</li><li>Most of the employees get 3 or 4 promotions or even more in their service in Railways, except JEs &amp; It is pertinent that JEs with Diploma in Engineering and one year training and SSEs with Graduate in Engineering and one year of on the job training – are getting stagnated in the Apex Group C scale without any further avenue of promotion except in rare 2% cases. JEs enter in Pay Level-6 will get only one promotion to Pay Level-7. SSE with Graduate in Engineering qualification enter in Pay Level-7 and will remain stagnant in the entry grade itself. The JEs &amp; SSEs rot at Pay Level-7 throughout their career since they have very meager number of posts in Group-B.</li></ol>



<ol class="wp-block-list" start="7"><li>Less than 2% of Technical Supervisors – (entering with Diploma or Degree in Engineering) – reach Group B level and only a small fraction thereof reach Group A level- due to very meager number of Posts in Group A &amp; B vis-a-vis Group ‘C’ and non­ implementation of DoPTs orders regarding Classification of Posts – issued after the last five Pay Commissions on the Railways. Large majority of Technical Supervisors do not get promotion to the Gazetted cadre except in a very few cases and that too at the fag end of their career. Even after acquiring long years of experience and expertise they remain and mostly retire in the Supervisory cadre itself.</li></ol>



<ol class="wp-block-list" start="8"><li>Terms of reference of Cadre Restructuring Committees have not allowed the CRC Committees to do the cadre restructure exercise in pan-railways approach taking all management &amp; cadre issue into Instead work of CRC committee had been restricted to Group ‘C’ defeating basic purpose of CRC.</li><li>In the new scenario of high speed train operation, technological improvements, improved passenger amenities, handling of higher volume of traffic and management requirements thereof, it is requested that Combined “Cadre Restructuring” of posts in Group ‘A’, ‘B’ &amp; ‘C’ may please be considered to upgrade adequate number of Group C posts to Group A &amp; B – to fully meet with the job requirements of the posts of Technical Supervisors on Railways – keeping in view the following facts:</li><li>In the Technical Departments of Engineering, Mechanical, Electrical, Signal &amp; Telecommunications and Stores, only 3447 Group B posts for 77 lakh posts of Group C &amp; D, i.e. just 0.44% posts are available in Group-B – as indicated in the Tables below:</li><li><strong>Analysis of Staff Strength in the Technical departments of IR as on 31st March 2019</strong></li></ol>

<ol class="wp-block-list" start="12"><li>In fact, number of Group-B posts in Technical departments of Railways had witnessed negative It was reduced from 4274 to 3447 between the year 2009 and 2019. Thus strength of Group-B posts was reduced by 20% in a period of ten years.</li><li>In spite of more complex nature of duties and higher responsibilities on account of requirements of Safety &amp; modernisation, Railways have the lowest %age of Gazetted posts in Group A &amp; B vis-a-vis total strength – in comparison to total strength of all Central Government departments.</li></ol>

<ol class="wp-block-list" start="14"><li>In the present scenario of huge investments and fast &amp; prompt completion of new projects, more number of posts in gazetted cadre is essentially required, so that decision making and accountability can be broadened in the administrative hierarchy.</li><li><strong>Railway Board made a principle decision for combined cadre restructuring long back, part of minutes of Board meeting is given under,</strong><ol><li>It would be relevant to point out that on Indian Railways, Group ‘B’ officers constitute only 5% of its total workforce whereas, the average in respect of Group ‘B’ officers for All India Central Government employees comes to 5.6% i.e. 10.6 times higher as compared to Railway Group ‘B’ officers. Further, with reference to the Ministry of Culture which has the second lowest percentage of Group ‘B’ officers this ratio is 1:6 as compared to Railways. In this context, it is imperative that for efficient and effective utilization of existing manpower resources on Railways, the ratio of Group ‘B’ officer vis-a-vis non gazetted employees is to be improved keeping in view the functional consideration.</li><li>b) While the proposal for upgradation on above lines was under consideration the earlier AM (Staff) discussed the matter with both the Federations regarding upgradation of certain percentages of Group ‘C’ posts to Group ‘B’ gazette post and also regarding simplification in the selection procedure for Group ‘B’ Based on the said deliberations a Note for Discussion in Board’s Meeting was submitted. The said Note was considered in full Board meeting held on 29.11.2011 and Board directed as under:-</li><li>c) <strong>“Board directed that a comprehensive proposal on restructuring involving Group ‘C’, Group ‘B’ and Group ‘A’ cadres be worked out to enable Board to take a considered view”</strong></li></ol></li><li>7th CPC in its report for Technical Supervisors vide para 40.113 recommended that, <em>“Considering</em> <em>the feedback provided by the Railway Board and upon close analysis of the cadre structure, we are of the view that there is </em>some <em>element of stagnation at the GP 4600 stage. Accordingly , it is suggested that Railway Board should consider enhancing</em> <em>the number of posts in the next higher level” </em>…</li><li>It is therefore requested that the combined cadre strength of Technical Departments including all posts in Group- A, B and C on Indian Railways may please be restructured as under – so as to be comparable with, if not higher than, the All India Average % age of Group A, B &amp; C of Central Government employees in other Departments:</li></ol>

<p><strong>G.S.R. 556(E).</strong>&#8211;  In exercise of the powers conferred by clause (2) of Article 146 of the Constitution, Hon’ble the Chief Justice of India hereby makes the following amendments to the Supreme Court Officers and Servants (Conditions of Service and Conduct) Rules, 1961 regarding the change of the nomenclature/ designation of the posts of Gestetnor Operator Grade-I and Gestetnor Operator Grade-II mentioned as Category No. 48 &amp; 53 in the Schedule attached to the said Rules:</p>



<p>I. The following be substituted in Column No. 2 relating to Designation of the post mentioned against Category No. 53 (Gestetnor Operator Grade-II) of the Schedule attached to the said Rules:-</p>
