<p>The second meeting of the reconstituted Joint committee was held on 3.12.2021 in the Board Room, 3 Floor, Bharat Sanchar Bhawan, Janpath, New Delhi. The following were present in the meeting.</p>

<p>At the outset, Sr. GM(SR) welcomed the worthy Chairman and all the esteemed participants from management and staff side. It was informed that in the first meeting held on 18.11.2021, the staff side had requested the management side to present a draft proposal in the next meeting for further discussions. The proposal had been drafted and a power point presentation of new scales was shared /discussed.</p>



<p><strong>2.0 Discussions.</strong></p>



<p><strong>2.1 Broad Principles.</strong></p>



<p>At present there are total 33048 non-executive employees comprising of 18553 absorbed employees &amp; 14495 BSNL recruitees and around 30% employees are stagnating.</p>



<p>It was explained to the staff side that new Pay scales have been designed on the following principles:</p>



<p>(1) There is no reduction in the Pay (basic+DA) of any employee after implementation of new pay scales.</p>



<p>(2) Stagnation in the existing pay scales has been largely addressed.</p>



<p>(3) As pension contribution is linked to the maximum of the Pay scale, the new Pay scales have been designed optimally to minimise increase in Pension contribution.</p>



<p>(4) Financial burden has to be minimum so as to make the Proposal viable, as any additional financial burden is to be met only from internal resources of the company.</p>



<p><strong>2.2 Multiplication Factors and Span.</strong></p>



<p>a) It was informed that the Pay scales in 2007 were designed as per details given below:</p>



<ul class="wp-block-list"><li>Multiplication factor of 1.91 to 1.94 was used for the minimum of the pay scale.</li><li>Multiplication factor of 2.30 to 2.53 was used for the maximum of the pay scale.</li><li>Span of scale was 18 Stages.</li></ul>



<p>b) New pay scales proposed by the management side notionally w.e.f from 1.1.2017 are designed as below:</p>



<ul class="wp-block-list"><li>Multiplication factor of 2.20 to 2.24 has been used for the minimum of the pay scale.</li><li>Multiplication factor of 2.33 to 2.62 has been used for maximum of pay scale.</li><li>Span of pay scale is from 20-28 stages.</li></ul>



<p><strong>2.3 Financial Impact</strong></p>



<p>Staff side was informed that:</p>



<p>a) New pay scales have been designed to take care of Stagnation issue and BSNL recruitees will get additional benefit on account of increase in EPF contribution by BSNL.</p>



<p>b) The implementation of new Pay scales will result in an additional burden of increased pension contribution in case of absorbees and increased EPF contribution in case of Direct Recruitees.</p>



<p>c) There are a number of CPSUs which are loss making and the government has to decide in totality. Whatever Proposal Joint Committee recommends, should be with minimum financial implication.</p>



<p>d) Feedback was sought from staff side on following points:</p>



<ol class="wp-block-list"><li>Will implementation of new pay scale result in any anamolous situation where pay in new pay scales is less than pay in old pay scales?</li><li>Will new pay scale remove stagnation in majority of the cases?</li></ol>



<p><strong>2.4 Staff side comments.</strong></p>



<p>The Staff side agreed to examine the draft pay scales proposed by the Management and to discuss in the next meeting. However, they stated that:</p>



<ul class="wp-block-list"><li>Incase of Executive’s 3th PRC, new pay scales have been fixed by DPE and which cannot be changed. Whereas in case of Non-Executives. already negotiated scales in the earlier held meetings are being proposed to be changed and this will have long term effect on the next pay revision due in 2027.</li><li>The new pay scales should be designed considering Five Percent fitment instead of Zero percent.</li></ul>



<p><strong>3.0 Conclusion.</strong></p>



<p>The management suggested that the staff side can send suggestions/proposals based on the actual Stagnation/pay anomaly cases of the employees for further discussion. The meeting closed with a vote of thanks to the chair, all the participants and to the SR Cell team.</p>

<p>The undersigned is directed to forward herewith the Ministry of Finance, Department of Public Enterprises (DPE) OM No. W-02/0002/2014-DPE(WC)-GL-11/2021 dated 02.08.2021 on the above cited subject with regard to increase in IDA from 159.9% to 170.5% w.e.f. 01.07.2021. The same may be implemented in respect of Board level and below Board level executives and Non-executive employees drawing pay in IDA pay scales (2007) revised w.e.f. 01.01.2007.</p>



<p>2. The increase subsumes the additional instalments arising on 01.10.2020, 01.01.2021 and 01.04.2021. The rate of Dearness Allowance for the period from 01.10.2020 till 30.06.2021 shall remain at 159.9%.</p>

<h3 class="wp-block-heading">Subject: Release of terminal benefits to the family of employees, who died due to COVID-19 infection or other reasons.</h3>



<p>Sir,</p>



<p>As you are aware, due to surge of COVID-19 pandemic in our country a number of employees of BSNL have become victim of this deadly pandemic and passed away untimely. In this hour of grief, it must be our endeavor to support the bereaved families in every possible way. Accordingly, it has been decided that the terminal benefits, viz. Gratuity, Leave Encashment, GSLSI, GPF/EPF, GTI (if the deceased employee was a member) etc., payable to the eligible family member(s) of deceased employees may be processed with utmost priority and all due payments are released within a period of 30 days. In respect of the deceased employees having pensionable service, the family pension cases may be processed immediately on receipt of requisite papers and the same may be submitted to respective CCA.&nbsp;Similarly, the superannuation benefit admissible to directly recruited employees may also be processed immediately. The above process may also be followed in cases of death of an employee due to other reasons.</p>



<p>2. In order to ensure that the terminal benefits are paid to the family of deceased employee in time, it has been decided that GM(HR) and IFA of the circle will function as nodal officers to supervise the progress of payment in each case and they will be responsible for timely payments of eligible dues. Further, the Welfare Officer of the Business Area/Unit may be deputed to apprise the families of their due payments and also arrange to get the requisite procedures/papers/forms completed by the eligible family member. The Heads of Circles/Administrative Units are also requested to personally monitor the progress of payments to the family of deceased employee. A progress report on the payments made in respect of deceased employees may also be sent to Corporate Office on weekly basis till such time the pandemic wanes.</p>

<h3 class="wp-block-heading"><strong>Sub : Guidelines under BSNLMRS in view of Covid-19 pandemic</strong></h3>



<p>In order to facilitate quick and smooth treatment to our employees during Covid-19 pandemic, following guidelines undei BSNLMRS are issued</p>



<p>1. <strong>Visit of designated officer</strong> – There is a provision that in all cases involving hospitalization of two or more than two days, a designated officer of BSNL shall visit the hospital and give a prescribed certificate (Guidelines issued vide Order No BSNL/Admn.1/15-2/05(Pt.) dated 8th August 2005). Considering the infectious nature of this disease and to protect our employees from exposure to this virus while visiting the hospital, the requirement of visit of designated officer of BSNL to the hospital and giving the prescribed certificate is dispensed with for all the diseases. However, a random check may be made, if felt necessary. Further, all other instructions including attachment of a certificate by the concerned doctor identifying the patient in the copy of BSNLMRS Card as conveyed by this office OM No. BSNL/Admn.I/15-4/04(Pt) dated 15 10.2004 and authorization for indoor treatment shall be strictly followed.</p>



<p>2&nbsp;<strong>Treatment in non-empanelled hospitals</strong>&nbsp;– In normal circumstances, indoor treatment should be taken only from BSNL empanelled hospitals. As per the existing provisions in MRS policy “In emergency cases, the reimbursement will be allowed for treatment in non-recognized hospitals with the approval of CGM for field office employees and concerned Director of BSNL Board for C.O. employees The amount will be restricted to the CGHS rates applicable at Delhi”. However, in view of the present crisis in availability of treatment of Covid-19 in empanelled hospitals, the requirement of taking indoor treatment of Covid patients only from BSNL empanelled hospitals is dispensed with. However, the amount shall be restricted to the CGHS rates as decided for Covid-19.</p>



<p>3.&nbsp;<strong>Reimbursement of Tele-consultation</strong>&nbsp;– During this pandemic tele-consultation is preferred mode of consultation from a doctor. Hence, Tele-consultation by a registered medical practitioner from India, supported by duly signed/computer generated prescription on doctor’s letter head and accompanied by valid, printed (system generated) or signed receipt shall be valid.</p>



<p>4. <strong>Charges of RTPCR / Rapid antigen test</strong> – Charges shall be reimbursed against the production of valid receipt but without the need of medical prescription. However the rates shall be restricted to the prescribed sates by the concerned State Govt. In case no rate has been prescribed by the State Govt. the rates prescribed by the Govt of NCT shall be applicable. These charges shall be reimbursable as part of the annual ceiling for out-door limit under BSNLMRS.</p>



<p>The above orders will be applicable w.e.f. 01.04.2021 and remain in effect for 6 months i.e. up to 30.09.2021 or till further orders, whichever is earlier. All other provisions of BSNLMRS shall be strictly followed.</p>

<p>Attention is invited towards this office letter of even No. dated 06.03.2019 vide which special concession/ facilities to employees working in Kashmir Valley was extended for a period of two years upto 31.12.2019. Approval of Competent Authority is hereby conveyed for a further extension of special concessions from 01.01.2020 to 31.07.2021.</p>

<p>Sir,</p>



<p>Of late, this Office has been receiving many Court Cases as well as letters from various Telecom Circles seeking guidelines for disposal of representations received from retired employees, regarding grant of national increment falling due on the next day of superannuation/ retirement etc. for the purpose of pensionary benefits.</p>



<p>2. . In this regard , I am directed to forward herewith DOP&amp;T O.M . No. 19/2 /2018-Estt (Pay-I) dated 03/02/2021 , along with its enclosures, with regard to grant of notional increment for pensionary benefits in pursuance of the judgement dated 15/09/2017 of Hon ‘ble High Court of Madras in W. P. No. 15732 of 2017 in the case of P. Ayyamperumal Vs. Union of India &amp; Ors.</p>



<p>3. DOP&amp;T vide its aforesaid O.M has mentioned that the judgment dated 15/09/2017 of Hon&#8217;ble High Court of Madras in W.P. No. 15732 of 2017 in the case of P.Ayyamperumal Vs Union of India &amp; Ors is in personal in nature. In this regard, a brief note reflecting the Government’s stand on the instant issue has been attached as Annexure-1.</p>



<p>4 . Further, it has been mentioned that in a similar case, the Hon ‘ble Supreme Court, vide judgement dated 29/03/2019, while dismissing the SLP (C) Dy. No. 6468/2019 filed by DOT against the judgement dated 03/05/2017 of Hon ‘ble High Court, Lucknow Bench in W .P. No. 484 /2010 in the matter of UOI &amp; Ors. Vs. Sakha Ram Tripathy &amp; Ors., has inter alia, observed the following :</p>



<p><em>” There is delay of 566 day s in filing the special leave petition. We don’t see any reason to condone the delay. The Special leave petition is dismissed on delay,<strong>&nbsp;keeping all the questions of law open.”</strong></em></p>



<p>5. Since the question of law on the instant issue is open and not yet decided, the decision for implementation of the judgment dated 15/09/2017 of Hon&#8217;ble High Court of Madras in W .P. No. 15732 of 2017 in Shri P. Ayyamperumal case, in <em>rem </em>has not been taken.</p>



<p><strong><a href="https://centralgovernmentnews.com/court-cases-for-granting-notional-increment-for-pensionary-benefits-in-pursuance-of-the-judgement-dated-15-09-2017-of-honble-high-court-of-madras-in-w-p-no-15732-of-2017-in-the-case-of-p-a/" target="_blank" rel="noreferrer noopener">Court cases for granting notional increment for pensionary benefits in pursuance of the judgement dated 15.09.2017 of Hon’ble High Court of Madras in W.P. No. 15732 of 2017 in the case of P. Ayyamperumal Vs Union of India</a></strong></p>



<p>5. Accordingly, all the Telecom Circles/ Other Administrative Units/Cadre Controlling Units of BSNL Corporate Office are requested to dispose of the grievances/ representations received from various retired employees of BSNL in the light of the aforesaid guidelines issued by DOP&amp;T. Further, where Court Cases have been filed by the retired employees in various Courts of Law, for grant of notional increment after retirement for pensionary benefits, it is, requested to defend these Courts cases in the above light and also to suitably incorporate the guidelines issued by DOP&amp;T vide it&#8217;s O.M. dated 03/02/2021 while preparing the Counter Reply in such cases. Further, since the issue involves grant of pension and pensionary benefits, all the Telecom Circles/Administrative Units are requested to consult the concerned CCA Unit, while defending the Court Cases pertaining to their respective Circle/ Unit.</p>

<p>Sub: <strong>Recovery of dues other than Government dues from the retirement benefits of BSNL VRS-2019 Scheme retired employees &#8211; regarding.</strong><br /></p>



<p>Sir,<br />I am directed to refer to this office letter of even no. dated 29/09/2020, wherein guidelines to recover the due amount from the BSNL retirees, other than those retired under BSNL VRS-2019 Scheme has been issued. This is in accordance with the instructions issued vide DOT letter No.1/ misc/ Pen/ Issues/ BSNL/ DDG(Accts)/ 2019-Part(2)/2525 to 2958 dated 24/08/2020.</p>



<p>2. After issuance of the aforesaid letter, the guidelines to recover dues from the BSNL VRS-2019 retirees, who have been occupying BSNL accommodation after retirement, from their terminal benefits were under consideration.</p>



<p>3. Now, with the approval of the Competent Authority, it has been decided to recover the dues from the 2019 BSNL VRS optees, who are still in occupation of BSNL accommodation and also from those who have not submitted “No Dues Certificate” (NDC) in the following manner till they submit NDC after vacation of quarters :-</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>i) The amount of Leave Encashment payable by BSNL to the BSNL VRS-9019 retiree will be withheld;<br />ii) The remaining 8% of Ex-Gratia amount payable to BSNL VRS-2019 retiree will be withheld;<br />iii) Recovery will be made from the amount of reimbursement of Outdoor/ Indoor Medical claims submitted by the retiree;<br />iv) Recovery will be made from the amount of reimbursement of <a href="https://centralgovernmentnews.com/category/ltc/" target="_blank" rel="noreferrer noopener">LTC</a>/ TA claims submitted by the retiree;<br />v) Recovery will be made from the amount of reimbursement of Mobile Handset/ Briefcase / Bag/News Paper claims etc. Submitted by the retiree.</p></blockquote>



<p>4, In this regard, the Unit/Branch, dealing with the allotment of BSNL Quarters may be asked to send Notice/ reminders to the concerned retirees for submitting the “No Dues Certificates” (NDC). After receiving the NDC, only the withheld amount in respect of the concerned retiree may be released by the Circle.</p>



<p>5. Further, as per the Clause 3,B 4 &amp; 5 of Public Premises (Eviction of Unauthorised Occupants) Act, 1971, Estate Officer is having full powers to issue Show Cause Notice to the Retired Employees, who were unauthorizedly occupying the Residential Accommodation, stating “Why an order of eviction should not be made within a period of three working days”. Hence, Estate Officers of the Circles are required to take necessary action, accordingly.</p>

<p>6. Estate Officers of the Territorial Circles may take extra care to collect the details of the staff quarters in merged Units in their concerned Circle either through REM in ERP or otherwise and take necessary action to evict the unauthorised occupants under the provisions of the powers vested with them as per the “Eviction of Unauthorised Premises Act of 1971”.</p>



<p>7. The Estate Officers of the Circle/ SSA are responsible for any loss caused to BSNL, if they do not exercise the powers vested with them. Suitable action may also be initiated to recover the outstanding dues, if any, from the unauthorised occupants. Action taken in this regard may be intimated to this Office from time to time.</p>



<p>8, All the Heads of Circles/Administrative Units of BSNL are, therefore, “requested to take necessary action, in accordance with the aforesaid guidelines.</p>

<p>Sir,</p>



<p>I am directed to refer to the above cited subject and to inform that sanction of fund for the payment of final instalment of Ex-Gratia is being released by DOT shortly. Accordingly, all circles are requested to initiate the process for release of final instalment of Ex-Gratia in ERP / SAP as per the existing guidelines. It must be ensured that Ex-Gratia is calculated as per details of PPO finalised by CCA offices i.e. last pay drawn and service particulars etc. In cases of discrepancy, Ex-Gratia may be processed strictly as per Annexure-D verified by the CCA. ERP cell may be contacted in case of any technical doubt related to running of ERP process / opening of T-code etc.</p>



<p>2. The processing of payment of Ex-Gratia may be completed by 14.01.2021. Fund request, indicating the amount to be paid VRS optees, including all kind of recoveries and TDS may be emailed to Banking Cell of BSNL Corporate Office on email address: budget.corporate[at]bsnl.co.in by 15.01.2021.</p>



<p>3. PGM(ERP), ALTTC, Ghaziabad shall also in parallel provide consolidated circle wise fund to be authorized for payment of VRS retirees and the TDS to be paid, to Banking Cell by 15.01.2021.</p>



<p>4. In case of recoveries, all the recoveries should be posted in SAP simultaneously.</p>

<p>Ref: Our letter of even No, dated 22nd September, 2020.</p>



<p>Hon’ble Sir,</p>



<p>1. We happy to write to invite your kind attention of our captioned letter on the subject under reference. We are addressing you, once again Sir, as we have confident and trust that you are concerned for the citizen of the country and keeping in view that virtual fact, the government is taking all the steps to not only to revive but to make <strong><a href="https://centralgovernmentnews.com/category/bsnl/" target="_blank" rel="noreferrer noopener">BSNL</a></strong> a Competitive Entity in the country; so that the private communication are not getting free hand to exploit the citizen of the country in providing them communication and other value added services.</p>



<p>2. Aiming to have success in time, Govt. has taken firm and time basis decisions and is being implemented. As desired by the Govt. more than 80,000 employees have been retired under VRS 2019 scheme and present superannuation system. Now, after issuance of sovereign guaranty and bonds to a tune of 8500 crore, we are sure the BSNL will once again flourish in its pre-era of earning handsome profit in short time as expenditure towards salaries is curtailed drastically.</p>



<p>3. To keep a company in most competitive form, the employees also play a vital role and their interest is required to be taken care of by the Company. The BSNL Employees/ Pensioners are due for their Wage/ Pension Revision as per 3rd Pay Revision Committee Recommendations and the Cabinet has also taken affirmative stand in this direction long back.</p>



<p>4. Admittedly,&nbsp;<em>we know that our issue comes under exclusive administrative powers of the Ministry of Communication</em>, as the Department of Telecom and Bharat Sanchar Nigam Limited and should have been settled there and there only but unfortunately having representing our burning issue to all concerned authorities and despite the instructions from your office, we could not get any result. We had represented Memorandum to your office on 25.02.2019 and this was also followed by our various branches throughout the country and we were informed that DoT is being asked to settle the grievance.</p>



<p>5. We, therefore, once again reiterate our desire to consider our just and genuine long pending demand and furnish the brief of our say in brief as under:</p>



<ul class="wp-block-list"><li>A. BSNL Pensioners were accorded for approval of recommendations of 1st P.R.C. w.e.f. 01.10.2000 at par with working employees simultaneously.</li><li>B. BSNL Pensioners were accorded for approval of recommendations of 2nd P.R.C. w.e.f. 01.01.2007 at par with working employees after Cabinet Approval.</li><li>C. Accordingly, BSNL Pensioners should have been extended the benefit of Pension Revision for BSNL Pensioners w.e.f. 01.01.2017 with fixation of 15% as recommended by the 3rd Pay Revision Committee</li><li>D. Now, the recommendations of 3rd P.R.C. are approved by the Cabinet for working employees of PSUs and the way for its Employees/Pensioners is cleared by MOC’s assurance on 24.03.2018 to AUAB. But it is inordinately delayed.</li><li>E. According to Rule 37-A, of CCS Pension) Rules 1972, sub-rule 8, which says pension/ family pension shall be calculated at par with C.G. Employee retiring on superannuation. The said rule is silent about Pension revision for C.G. Employees but it is in practice in light of Constitutional Bench of Apex Court judgment delivered on 17.12.1982 in D.S. Nakara case.</li><li>F. It is in practice that whenever the pension of Central Government Employees are revised periodically as Per CPC recommendations, the pension Revision of BSNL absorbed DOT employees is also revised as per recommendations of the 3rd P.R.C. Recommendation.</li><li>G. In turn, now as per 3rd Pay Revision Committee recommendations; as they all governed by CCS (pension) Rules 1972 and once upon a time they were C.G. Employees and also conferred status of Govt. Pensioners on retirement, they get their Pension from C.G. i.e. DoT’; they are eligible for their Pension Revision w.e.f. 01.01.2017.</li><li>H. A clarification issued by the DoP&amp;PW vide it’s No: 4/19/2009-P&amp;PW (D) dated 27.3.2009 to DoT reads “BSNL is the only PSU that has been granted a special dispensation under sub-rule (21) of Rule 37-A of CCS (Pension) Rules, 1972 to the effect that the Pensionary benefits including family pension to the absorbed employees of BSNL is paid by the government. This Department is of the view that the change as per DoP&amp;PW O.M. dated 02.09.2009 as mentioned in Para 2 above are also applicable to IDA Pensioners of BSNL.</li><li>I. All these three P.R.Cs did not have in the terms of reference any provision for pension revision as they were exclusively meant for executives. And all the PSUs have their own Pension Scheme barring BSNL Pensioners.</li><li>J. In BSNL wage revision for BSNL Employees is done after the acceptance of PRC recommendation and through bi-lateral agreement with Unions/ Associations and they have no legitimate claim to discuss for Pension Revision for Pensioners as the competent authority is the Govt. of India who through a cabinet note accord its approval for Pension Revision. Thus BSNL Management/BSNL Associations have no role play in the Pension Revision of BSNL Pensioners.</li><li>K. Liability of payment of pension/ family pension to BSNL retirees lies squarely with Government of India as per Cabinet Decision and DoT order dated 20.07.2016 and also the BSNL has paid pension contribution in Cash to the Govt. for the period of their service in BSNL till superannuation.</li><li>L. Consequential to apex court judgment dated 03.05.1990, the DPE has issued orders saying that all employees appointed on or after 01.01.1989 in the PSEs following CDA pattern are deemed to have been appointed on IDA pattern and related scale of pay. As such, BSNL has adopted IDA Pay scales with Pensionary benefit on IDA pattern.</li><li>M. The issue of Pension Revision was not raised while implementing the wage revision to implement the recommendations of 2nd P.R.C. as the Pension Revision was governed by the agreement with the Unions/ Association at the time of corporatization of DOT as BSNL from 01.10.2000.</li><li>N. Now for obvious reasons, the Working Unions/Associations it seems influenced by the political ideology, delaying the process of Wage Revision since last three years and there is no possibility of settlement even till the end of September 2020.</li></ul>



<ul class="wp-block-list"><li>O. To supplement our view, we write that as per a special provision contained in Chapter &#8211; 3 which reads as:</li></ul>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>“<em>Assessment and Recommendations, Para 3.2 (IV) – There are also certain CPSEs which have been formed as an independent Government company under a statute to perform specific agenda / regulatory functions. The revenue stream of such CPSEs are not linked to profits from the open market competitive scenario but are governed through the fees &amp; charges, as prescribed and amended from time to time by the Government. There is no budgetary support provided by the Government to such CPSEs. In consideration that the impact of the revised compensation structure including Performance Related Pay) would supposedly form the part of revenue stream for such CPSEs, the Committee recommends that affordability condition shall not be applicable to these CPSEs; however the implementation of same shall be subject to the approval of Administrative Ministry upon agreeing and ensuring to incorporate the impact of the revised compensation structure into the revenue stream.</em>”</p></blockquote>



<p>The above provision is conditional and applicable to certain PSUs, but BSNL Unions/ Associations are deliberately making movement to make the clause applicable to all the PSU which clearly indicates their motive to delay the process and create unrest amongst PSU Workers.</p>



<ul class="wp-block-list"><li>P. For your kind information, the BSNL Employees and Pensioners were given assurance by Hon’ble Manoj Sinha, MOSC in the meeting with All Unions/Associations on 24th March, 2018 that the DoT and ministry will move in right directions to get clearance for our Pension Revision w.e.f. 01.01.2017 implementing the 3rd P.R.C. Recommendation at the earliest.</li></ul>



<p><strong>Our submission in light of above:</strong></p>



<ul class="wp-block-list"><li>1) We the BSNL Pensioners are due for our Pension Revision w.e.f. 01.01.2017 and for which there is no need to ask consent of the BSNL Corporate Office, as our Pension Contribution has already been collected by the DoT from BSNL on maximum of our Pay.</li><li>2) The DoT has taken clear stand while accepting and considering proposal of Pension Revision of BSNL Pensioners that the BSNL has no power and no legal authority to say anything in this regard. BSNL can only recommend the pay scale for its employees.</li><li>3) DoT has given green signal to BSNL Corporate Office to start negotiation with the Unions/ Associations and finalize their pay revision.</li><li>4) Further, recently, in a Further Discussion on implementation of 3rd P.R.C. Recommendations for BSNL Employees Shri A.K. Sinha, DGM BSNL in a Conciliation Meeting held on 07.12.2020 by the Assistant Labour Commissioner (Central) with Unions has assured that the negotiations will start soon.</li><li>5) BSNL is extending certain benefits as per Central Pay Commission Reports, whenever it is asked to do with the DoT authority. It cannot straightway accept and extend any facility of Central Pay Commissions.</li><li>6) As such, it is concluded that Authority to revise the Pension of BSNL Pensioners is exclusively rest with the DoT.</li><li>7) Even the recommendation of 3rd P.R.C. will be implemented ONLY WHEN, the DoT gives its approval for BSNL Employees considering the proposal of BSNL Corporate Office; when received.</li></ul>



<p>We, therefore, request you to kindly consider our request of Pension Revision of BSNL Pensioners as per 3rd P.R.C. Recommendations w.e.f. 01.01.2017 implementing the 15% fitment formula as suggested/acceptedby the Govt. as now BSNL Pensioners Pension Revision has no relativity with profit/loss of BSNL. The Secretary, DoT may kindly be asked to submit Cabinet Note and should not wait for BSNL Management to entering in to negotiate for Pay Revision for its employees as BSNL has no power to recommend any Pension Revision for Pensioners as per standing instructions of the Ministry.</p>

<h2 class="wp-block-heading">Subject: Holidays to be observed in BSNL Offices during the year 2021- reg.</h2>



<p>In accordance with Ministry of Personnel, Public Grievances &amp; Pensions (Deptt. of Personnel &amp; Training O.M. No. 12/9/2020-JCA-2 dated 10th June 2020, it has been decided by the Competent Authority that the holidays as specified in the Annexure I to this O.M. will be observed in all the BSNL Offices located at Delhi / New Delhi during the year 2021. In addition, each employee will also be allowed to avail himself/ herself of any two holidays to be chosen by him/her out of the list of Restricted Holidays in Annexure II.</p>



<p>BSNL Administrative Offices located outside Delhi / New Delhi shall observe the following holidays compulsorily in addition to three holidays as per para 3.1 below:</p>



<ol class="wp-block-list"><li><strong>REPUBLIC DAY</strong></li><li><strong>INDEPENDENCE DAY</strong></li><li><strong>MAHATMA GANDHI&#8217;S BIRTHDAY</strong></li><li><strong>BUDDHA PURNIMA</strong></li><li><strong>CHRISTMAS DAY</strong></li><li><strong>DUSSEHRA (VIJAY DASHMI)</strong></li><li><strong>DIWALI (DEEPAVALI)</strong></li><li><strong>GOOD FRIDAY</strong></li><li><strong>GURU NANAK&#8217;S BIRTHDAY</strong></li><li><strong>IDUL FITR</strong></li><li><strong>IDU&#8217;L ZUHA</strong></li><li><strong>MAHAVIR JAYANTI</strong></li><li><strong>MUHARRAM</strong></li><li><strong>PROPHET MOHAMMAD&#8217;S BIRTHDAY (ID-E-MILAD)</strong></li></ol>



<p>3.1 In addition to the above 14 Comnpulsory holidays mentioned in para 2, three holidays shall be decided from the list indicated below by the Circle Heads of Territorial Circles in consultation with the Circle Staff Welfare Board and the representative Union and keeping in view the recommendation of the Central Government Employees Coordination Committee in the State Capitals. The final list applicable uniformly to all BSNL offices within the territorial jurisdiction of the concerned State shall be notified accordingly and a copy endorsed to the Corporate Office within a period of 4 weeks of issue of this letter and no change can be carried out thereafter. It is also clarified that no change is permissible in regard to festivals and dates as indicated.</p>

<p>3.2 No substitute holiday should be allowed if any of the festival holidays, initially declared, subsequently happens to fall on a weekly off or any other non-working day or in the event of more than one festival falling on the same day.</p>



<p>4. The list of Restricted Holidays appended to this O.M. is meant for BSNL Offices located in Delhi/ New Delhi. The Heads of Territorial Circle in consultation with the Circle Staff Welfare Board and the representative Union and keeping in view the recommendations of the Central Government Employees Co-ordination Committee in the State Capitals may draw up separate list of Restricted Holidays keeping in view the occasions of local importance but the 9 occasions left over, after choosing the 3 variable holidays in para 3.1 above, are to be included in the list of restricted holidays.</p>



<p>5.1 For offices in Delhi New Delhi, any change in the date of holidays in respect of Idu&#8217;l Fitr, Idu&#8217;l Zuha, Muharram and Id-e-Milad, if necessary, depending upon sighting of the Moon, would be declared by the Ministry of Personnel, Public Grievances and Pensions after aScertaining the position trom the Govt. of NCT of Delhi (DCP, Special Branch, Delhi Police).</p>



<p>5.2 For offices outside Delhi / New Delhi, the Heads of Territorial Circles are authorized to change the date of holiday, if necessary, based on the decision of the concerned State Governments / Union Territories, in Muharram respect of ldu&#8217;l Fitr, Idu&#8217;l Zuha, and Id-e-Milad.</p>



<p>5.3 It may happen that the change of date of the above occasions has to be declared at a very short notice. In such a situation, announcement could be made through P.I.B/ T.V. /A.l.R. / Newspapers and the Heads of Territorial Circles may take action according to such an announcement without waiting for a formal order, about the change of date.</p>



<p>6. During 2021, Diwali (Deepavali) falls on Thursday, November 4, 2021 (kartika 13). In certain States, the practice is to celebrate the occasion a day in advance, i.e., on &#8220;Naraka Chaturdasi Day&#8221;. In view of this, there is no objection if holiday on account of Deepavali is observed on- &#8220;Naraka Chaturdasi Day (in place of Deepavali Day) compulsory for the holiday BSNL Offices for Diwali in a State if in that State that day alone is declared as a for the offices of the State Government.</p>



<p>7. BSNL Offices which include industrial, commercial and would observe upto 16 trading establishments holidays in a Republic Day, year including three national holidays viz. Independence Day and Mahatma Gandhi&#8217;s birthday, as holidays. The compulsory of Circle remaining holidays / occasions may be determined by respective Heads themselves for the year 2021, subject to para 3.2 above.</p>
