Sub : Guidelines under BSNLMRS in view of Covid-19 pandemic

In order to facilitate quick and smooth treatment to our employees during Covid-19 pandemic, following guidelines undei BSNLMRS are issued

1. Visit of designated officer – There is a provision that in all cases involving hospitalization of two or more than two days, a designated officer of BSNL shall visit the hospital and give a prescribed certificate (Guidelines issued vide Order No BSNL/Admn.1/15-2/05(Pt.) dated 8th August 2005). Considering the infectious nature of this disease and to protect our employees from exposure to this virus while visiting the hospital, the requirement of visit of designated officer of BSNL to the hospital and giving the prescribed certificate is dispensed with for all the diseases. However, a random check may be made, if felt necessary. Further, all other instructions including attachment of a certificate by the concerned doctor identifying the patient in the copy of BSNLMRS Card as conveyed by this office OM No. BSNL/Admn.I/15-4/04(Pt) dated 15 10.2004 and authorization for indoor treatment shall be strictly followed.

2 Treatment in non-empanelled hospitals – In normal circumstances, indoor treatment should be taken only from BSNL empanelled hospitals. As per the existing provisions in MRS policy “In emergency cases, the reimbursement will be allowed for treatment in non-recognized hospitals with the approval of CGM for field office employees and concerned Director of BSNL Board for C.O. employees The amount will be restricted to the CGHS rates applicable at Delhi”. However, in view of the present crisis in availability of treatment of Covid-19 in empanelled hospitals, the requirement of taking indoor treatment of Covid patients only from BSNL empanelled hospitals is dispensed with. However, the amount shall be restricted to the CGHS rates as decided for Covid-19.

3. Reimbursement of Tele-consultation – During this pandemic tele-consultation is preferred mode of consultation from a doctor. Hence, Tele-consultation by a registered medical practitioner from India, supported by duly signed/computer generated prescription on doctor’s letter head and accompanied by valid, printed (system generated) or signed receipt shall be valid.

4. Charges of RTPCR / Rapid antigen test – Charges shall be reimbursed against the production of valid receipt but without the need of medical prescription. However the rates shall be restricted to the prescribed sates by the concerned State Govt. In case no rate has been prescribed by the State Govt. the rates prescribed by the Govt of NCT shall be applicable. These charges shall be reimbursable as part of the annual ceiling for out-door limit under BSNLMRS.

The above orders will be applicable w.e.f. 01.04.2021 and remain in effect for 6 months i.e. up to 30.09.2021 or till further orders, whichever is earlier. All other provisions of BSNLMRS shall be strictly followed.

Sub: Grant of annual increment falling due on the next day of superannuation/ retirement, for the purpose of pensionary benefits – Guidelines regarding.

Sir,

Of late, this Office has been receiving many Court Cases as well as letters from various Telecom Circles seeking guidelines for disposal of representations received from retired employees, regarding grant of national increment falling due on the next day of superannuation/ retirement etc. for the purpose of pensionary benefits.

2. . In this regard , I am directed to forward herewith DOP&T O.M . No. 19/2 /2018-Estt (Pay-I) dated 03/02/2021 , along with its enclosures, with regard to grant of notional increment for pensionary benefits in pursuance of the judgement dated 15/09/2017 of Hon ‘ble High Court of Madras in W. P. No. 15732 of 2017 in the case of P. Ayyamperumal Vs. Union of India & Ors.

3. DOP&T vide its aforesaid O.M has mentioned that the judgment dated 15/09/2017 of Hon’ble High Court of Madras in W.P. No. 15732 of 2017 in the case of P.Ayyamperumal Vs Union of India & Ors is in personal in nature. In this regard, a brief note reflecting the Government’s stand on the instant issue has been attached as Annexure-1.

4 . Further, it has been mentioned that in a similar case, the Hon ‘ble Supreme Court, vide judgement dated 29/03/2019, while dismissing the SLP (C) Dy. No. 6468/2019 filed by DOT against the judgement dated 03/05/2017 of Hon ‘ble High Court, Lucknow Bench in W .P. No. 484 /2010 in the matter of UOI & Ors. Vs. Sakha Ram Tripathy & Ors., has inter alia, observed the following :

” There is delay of 566 day s in filing the special leave petition. We don’t see any reason to condone the delay. The Special leave petition is dismissed on delay, keeping all the questions of law open.”

5. Since the question of law on the instant issue is open and not yet decided, the decision for implementation of the judgment dated 15/09/2017 of Hon’ble High Court of Madras in W .P. No. 15732 of 2017 in Shri P. Ayyamperumal case, in rem has not been taken.

5. Accordingly, all the Telecom Circles/ Other Administrative Units/Cadre Controlling Units of BSNL Corporate Office are requested to dispose of the grievances/ representations received from various retired employees of BSNL in the light of the aforesaid guidelines issued by DOP&T. Further, where Court Cases have been filed by the retired employees in various Courts of Law, for grant of notional increment after retirement for pensionary benefits, it is, requested to defend these Courts cases in the above light and also to suitably incorporate the guidelines issued by DOP&T vide it’s O.M. dated 03/02/2021 while preparing the Counter Reply in such cases. Further, since the issue involves grant of pension and pensionary benefits, all the Telecom Circles/Administrative Units are requested to consult the concerned CCA Unit, while defending the Court Cases pertaining to their respective Circle/ Unit.

This issue with the approval of the Competent Authority .

Subject: Payment of final instalment of Ex-Gratia in respect of retirees of BSNL VRS-2019 instructions thereof.

Sir,

I am directed to refer to the above cited subject and to inform that sanction of fund for the payment of final instalment of Ex-Gratia is being released by DOT shortly. Accordingly, all circles are requested to initiate the process for release of final instalment of Ex-Gratia in ERP / SAP as per the existing guidelines. It must be ensured that Ex-Gratia is calculated as per details of PPO finalised by CCA offices i.e. last pay drawn and service particulars etc. In cases of discrepancy, Ex-Gratia may be processed strictly as per Annexure-D verified by the CCA. ERP cell may be contacted in case of any technical doubt related to running of ERP process / opening of T-code etc.

2. The processing of payment of Ex-Gratia may be completed by 14.01.2021. Fund request, indicating the amount to be paid VRS optees, including all kind of recoveries and TDS may be emailed to Banking Cell of BSNL Corporate Office on email address: budget.corporate[at]bsnl.co.in by 15.01.2021.

3. PGM(ERP), ALTTC, Ghaziabad shall also in parallel provide consolidated circle wise fund to be authorized for payment of VRS retirees and the TDS to be paid, to Banking Cell by 15.01.2021.

4. In case of recoveries, all the recoveries should be posted in SAP simultaneously.

I am directed to refer to this office letter of Even no. dated 06.08.2020 on the above cited subject and to say that the updation of service particular e.g. Last pay drawn, qualifying service etc in the ERP / SAP as per the details in PPOs generated by CCAs have not been carried out in respect of large number of retirees under BSNL VRS-2019. The task was required to be completed by 14.08.2020. Non-updation in ERP/ SAP is delaying the finalizing of the Ex-gratia amount, Leave encashment and calculation of arrears / over-payment. This activity has to be completed on top priority before the amount of 4th instalment of Ex-gratia amount is received from DOT so that total Ex-Gratia is calculated accurately before the payment of 4th installment of Ex-Gratia and there is no mismatch in the PPO data and ERP data.

2. Further, the ERP HCM team has reported that in respect of around 640 retirees (circlewise summary enclosed) under the BSNL VRS-2019 Leave encashment has not been paid. In this regard, it is again requested to release the payment of encashment of EL / HPL immediately as per the extant instructions on the issue.

3. Non completion of activity by 14.8.2020 has been viewed very seriously by DIR(HR). Therefore, CGMT concerned may bestow their personal attention to complete the task latest by 05.09.2020 without fail.

Subject: Grant of time bound financial up-gradation under EPP/NEPP in respect of the VRS- 2019 retirees, which was due before their voluntary retirement on 31.01.2020.

Sir,

Attention is invited to Para 2 (j) of VRS Scheme circulated vide letter No.1-15/2019-PAT (BSNL) dated 4th November, 2019, which stipulates that “salary” means Basic Pay plus Dearness Allowance thereon as applicable on the effective date of voluntary retirement. Para 6.1(a) of the Scheme further stipulates that ex-gratia compensation will be payable on the basis of salary i.e. Basic Pay plus Dearness Allowance drawn by the employees on the effective date of voluntary retirement. It was expected that time bound financial up-gradation under EPP/NEPP in respect of the VRS-2019 retirees were granted from the dates on which it was due. However, it has come to notice of the Corporate Office that time bound financial up-gradation in respect of some of the VRS-2019 retirees, which was due before their voluntary retirement on 31.01.2020, have not been granted so far. This will have a bearing on the pension and terminal benefits including Ex-Gratia of such VRS retirees. As you are already aware, the amount of Ex-Gratia is to be paid by DOT, Govt. of India and the fourth installment of Ex-Gratia is also to be released by DOT shortly.

2. As a one-time measure, time bound financial upgradation under the EPP /NEPP, which was due to VRS retirees before their retirement, may be completed latest by 30th August, 2020. It may also be ensured that no case of upgradation under EPP/NEPP in respect of VRS optees is left out. The Circles are required to furnish a certificate signed by CGM, GM(HR) and IFA that all such cases have been completed. Any case of time bound upgradation of VRS retirees being reported later on will be viewed seriously and the concerned officers / official will be held personally responsible for any short payment received from DOT.

The undersigned is directed to refer to this office instructions vide letter no. BSNL CO­A/11(11)/ 2/2020-ESTAB dated 21.05.2020 on the above cited subject and to state that Telecom being an essential service, field units of BSNL handling the operation & maintenance of services are already working in full capacity. However, with regard to circle offices the instructions were issued vide this office letter referred above that all employees of ES & above level shall attend the office on all working days and the employees below ES were called on alternate days as per roster ensuring 50% attendance.

2. Now, the competent authority has reviewed the above instructions and it has been decided that w.e.f. 01.08.2020 all Circle offices of BSNL shall also work with full attendance. However , social distancing norms like staggering of working hours may be followed on need basis .

3. Further, the employees residing in declared Containment zone who are not able to attend office may inform their controlling officers and Work from Home during the notified period.

4. Other instructions of MHA and MoH&FA, Govt. of India issued from time to time with regard to exempted category of employees / containment of the spread of COVID-19 related to maintenance of Social distance at workplaces etc. may be scrupulously followed.

Subject: Release of Pensionary benefits to employees against whom Personal Court Case (other than departmental) is pending in the court.

Sir,

This refers BSNL letters No. 1-15/2019- PAT (BSNL) (Part) dated 30.01.2020, No. 22-92/2017/ General/Vol.I dated 5.7.2018 mentioned therein, and earlier references from BSNL on the subject. :

2. The matter has been examined in light of the advice rendered by Department of Pension & a Pensioners Welfare vide ID Note No. 4-9/2018-Vig.I (pt) dated 28.09.2018 (copy enclosed).

3.. Department of Pension & Pensioners’ Welfare vide the above referred ID Note on the question whether judicial proceedings initiated against a Government servant by the state police on the basis of a complaint by a private party for any action-other than in any official capacity would come under the ambit of Rule 69 of CCS (Pension) Rules 1972 – conveyed the following:

• If a Government servant is convicted during the period of service, action is taken under Rule 19 of the CCS (CCA) Rules and a penalty under Rule 11 of the CCS (CCA) Rules is imposed. Such action under said Rules is taken irrespective of whether the conviction is on account of charges connected with his official capacity or otherwise. Once a Government servant retires, action cannot be taken against him under CCS (CCA) Rules. After retirement, if the Government servant is found guilty of misconduct during service action can be taken under Rule 9(i) of the CCS (Pension) rules and his pension/ gratuity can be withhold/ withdrawn.
• DoP&PW is of the view that all misconduct under CCS (Conduct) Rules for which the Government servant could be punished under the CCS (CCA) Rules, during the period of service would be covered by the provisions of Rule 9 and Rule 69 of the CCS (Pension) Rules, 1972. Therefore, after retirement, in cases where the judicial proceedings for any act during service (whether in official capacity or otherwise) which could be termed as misconduct under the provisions of CCS (Conduct) Rules are continued after retirement, such judicial proceedings shall come under the purview of Rule 9 and Rule 69 of CCS (Pension) Rules, 1972.

4. The applicability of the above advice on other cases of similar nature has been examined. In view of the explicit advice rendered by Department of Pension & Pensioners’ Welfare reproduced above, the previous DoT letter No. 36-9/2002- Pen(T) dated 24.03.2003 in this regard is hereby superseded by the above advice rendered by Department of Pension & Pensioners’ Welfare.

5. As regards the applicability of the above to VRS optees under BSNL VRS-2019, it is to intimate that there is no ruling for any differential treatment to these retirees.

Sub: Implementation of BSNL Voluntary Retirement Scheme, 2019 – Augmentation of staff strength in Pension Cells in Circles and other administrative units for smooth and timely settlement of pension cases.

Sir,
I am directed to invite your kind attention to this office letter no. 1-15/2009-PAT (BSNL) dated 04.11.2019 regarding introduction and implementation of BSNL Voluntary Retirement Scheme, 2019.

As per the said scheme, employees aged 50 years or above are eligible to opt for voluntary retirement w.e.f. 31.01.2020 and it is expected that a sizable number of eligible employees would be opting for voluntary retirement under the scheme. Consequently, the workload of the pension settlement units in circles and other administrative units are expected to increase manifold. Moreover, some of the eligible employees who are presently posted in pension settlement units may also opt for voluntary retirement under the scheme. It would, therefore, be necessary to arrange for suitable substitutes for such employees for maintaining continuity

In view of above, you are requested to ensure posting of suitable and sufficient number of Executives/ Non-Executives in sections handling pension settlement in Circle/ SSA at the earliest, so that the newly posted employees could be accustomed with the nature of work and pension cases can be processed and settled in timely manner.

BSNL Voluntary Retirement Scheme 2019

1. Eligibility Criteria :-

All regular employees, both absorbed and directly recruited, of BSNL who attains 50 years or above as on effective date of VRS, ie 31/01/2020, are eligible.

2. Important Dates :-

• Start of option : 04/11/2019
• Closing of option : 03/12/2019 up to 1730 hrs.

3. Benefits :-

• Ex-gratia- 35 days salary for each completed year of service+25 days salary for each year of service left, until superannuation, provided further ex-gratia shall not exceed the salary he/she would have drawn at the existing level for the service period left.
• For employees absorbed in BSNL under Rule 37A, ex-gratia shall be restricted to the amount which taken together with the pension that the employee would be drawing for the balance period left till superannuation. Provided further that the ex-gratia shall not exceed 125% of the salary of the employee would have drawn at the existing level for service period left.

4. Employees opting VRS are entitled for the terminal & other benefits under existing rules as below:-

i. For Absorbed employees :-

» Pension /Family Pension from the next day of effective date of VRS

» Retirement Gratuity :-

• For employees above 59 years- within one month from the date of attaining 60 years
• For employees 55 and below – in February 2025.

» Incase of death of the retired employee before due date of payment of gratuity , the amount shall be released immediately to family along with interest.

» Simple interest @GPF rates (currently 7.9%) will be paid till the date of release of gratuity

ii. For BSNL Recruited employees and those appointed under Rule 37, gratuity shall be paid without deferment.

iii. Commutation of Pension :-

Full pension will be paid till the employee opt for commutation as below:-

» For employees above 50 years- on attaining 60 years
» For employees 59 and below- on 01/02/2025.

iv. Encashment of EL /HPL, TA/DA to place of settlement after VRS, Retention of staff quarters, RTC, Post-retirement medical facilities allowed as per existing rules and procedures, amended from time to time.

5. The eligible employees are required to login to the ERP / ESS portal for exercising his option for seeking voluntary retirement under the BSNL Voluntary Retirement Scheme -2019. Physical copies in triplicate signed in blue ink by the employee concerned shall be submitted to the administrative office concerned, within three days of giving option in ESS.

The option once exercised under this Scheme shall be final and decision of the competent authority shall be binding on the employee(s). Provided that the employee(s) will be allowed to withdraw the option only once at any time till the closing time and date of option.
