Sub: Submission of Annual Life Certificate by the Pensioners / Family Pensioners – Reg.

I would like to bring to your kind notice that the Pr. CCA T.N. Circle issued a notification today (06.10.2023) to hold a Mela for Life Certificate in CCA Office in Chennai for those pensioners / Family Pensioners whose LC expired on 30.09.2023 and earlier. This is not constrained to the pensioners residing in and around Chennai & City Suburban. It is for the pensioners/ Family pensioners of the entire circle from Chennai to Kanyakumari.

Hither to the life certificate was given in the month of November each year as per para 15.1 and 15.2 of Scheme for payment of pension to Central Government Civil Pensioner through Authorised banks. The Post Offices also were following the same procedure and there was no complaint of Non-drawal of Pension / FP for want of LC. The Dept. of Telecom has introduced a portal called “Jeevan Pramaan” and asked the DOT/BSNL Pensioners / Family Pensioners to submit LC digitally on this portal. For doing this the following documents are compulsorily required.

1) Aadhar Card Copy
2) PPO Copy (First Page with Name & PPO details)
3) PAN Card Copy
4) Filled in LC Form.

Actually when the pensioners / Family pensioners try to give digital life certificate it is not updating the Jeevan Pramaan software due to some differences in the name and other details of the pensioners, particularly family pensioners. At the time of issue of Aadhaar card initially the name of the family pensioners i.e. widows are noted with the name of their husband’s name or father’s name as surname. This is not tallying with the name in the PPO where only the name of the widow or divorced, daughter etc are available without any surname. Because of this difference the LC is not updated n the Pramaan Software leading to the stoppage of drawal of FP to the Family pensioners. Further many of the centers are not clearly aware of the procedure for printing life certificate properly. Thus the family pensioners are suffering a lot due to non-drawal of FP for want of LC. It may please be noted that the Dept. of Pension and Pensioners welfare has prescribed so many procedures for submission of Life Certificate by giving a list of persons specified for signing the LC as per para 14.3 of Scheme Booklet by CPAO. This has been followed by the pensioners and family pensioners hither to without any problem.

Only after the migration of the drawal of pension and FP from various Banks / Post offices to CCA Offices the pensioners and family pensioners are suffering a lot due to stoppage of drawal of pension / FP due to non receipt of LC or not updating the LC in the Sampan software. This Association therefore request the CGCA and the DOT to kindly continue to hold the old practice on submission of LC singed by various authorities as usual. Such life certificates may be accepted and updated by engaging separate staff in the CCA offices. This work will be only for two or three months i.e. November, December and if necessary for January also in the CCA offices. It may be noted that many pension disbursing authorities are still following the existing methods also in the matter of life certificate.

In the above instant case of T.N. Circle it is highly impossible to pensioners /  family pensioners to travel long distance of about 700 kms from Kanyakumari to Chennai to give life certificates. Such Melas may be conducted in all SSAs in the General Managers offices. It is also suggested that all the existing pensioners / family pensioners have already submitted LC during November 2022 in the Banks and Post officers, and therefore they may be allowed to submit the same again in November. All Pensioners / family pensioners may be allowed to submit LC in the month of November only by whatever means possible to them instead of Sampann procedure being introduced by the Dept. of Telecom as its own to avoid hardship to the Pensioners / family pensioners.

Subject: Issue of life time CGHS Card to BSNL pensioners.

The matter regarding issue of life time CGHS card to BSNL pensioners who had deposited CGHS contribution before switching over to the health scheme of BSNL and are desirous of switching over again to CGHS was under examination in the Ministry for quite some time past.

2. It has now been decided that BSNL pensioners who draw their pension from Central Civil Estimates are entitled for CGHS facilities. In case of their switch over again to CGHS from the health scheme of BSNL, they are required to pay subscription at the prevalent rates only for the balance period for life time membership i.e. the number of years for which subscription was already paid by them to CGHS before being switched over to BSNL health scheme, will be deducted from the ten-year subscription period. However, the option of payment of subscription at prevalent rate on annual basis will continue to be available to them for the balance period and the life time CGHS card will be issued on completion of payment of subscription for the total period of ten years.

3. This issues with the approval of competent authority.

Subject: Guidelines to the circles regarding processing of the cases of Superannuation Pension Scheme (SPS) for BSNL Direct recruitee -reg.

Sir,
I am directed to refer to the subject mentioned above and to say that BSNL CO has introduced Superannuation Pension Scheme (SPS) for direct recruit employee w.e.f. 05.05.2016. CA Branch of BSNL CO has issued necessary instructions from time-to-time for operation of the scheme. Of late, it has been noticed that some of the employees, who were members of the Scheme have superannuated/retired/deceased and such employees/their beneficiaries have become eligible for benefits under SPS.

2. In connection with processing of cases, the required forms for settlement of claims under the scheme have been finalized in consultation with the fund manager i.e. LIC of India and these are enclosed herewith. The circles/ units will be required to send the duly completed forms along with requisite documents [as per list indicated in forwarding letter addressed to Sr. GM(Estt.), which is part of the forms/documents enclosed] while forwarding the cases of SPS after verification of all the inputs.

2. It has been further decided that a nodal officer (SDE/AO or above) may be designated in each circle/unit for forwarding of SPS claims to BSNL CO. All SPS cases may be routed through nodal officer to BSNL Corporate Office. It should be the duty of nodal officer to check that all the SPS claim forms are in order and necessary documents are attached along with SPS claim forms. The circles/units will forward the hard copies of claim forms, in original along with requisite documents.to Corporate Office and also a soft copy (in PDF) at Email ID- bsnlcodrsps@gmail.com.

3. The SPS claim will be settled in the following manner :-

• a) Employee/ bedeficiary, as the case may be, will fill the SPS claim form/ papers on superannuation/retirement/death and submit the same to the office where the employee last attended.
• b) There are a number of options under the Scheme out of which one option is to be chosen by the employee/beneficiary. The pension option must be filled by the employee/beneficiary only and once opt-ion is exercised it will be final, Any change in the option exercised by the employee/beneficiary will be within the jurisdiction of LIC. BSNL will have no role in this regard.
• c) The duly filled in SPS claim forms will be forwarded to designated Nodal officer in the Circle/Unit. It will be the duty of nodal officer to check that the claim is in order and all necessary documents have been attached. After verification of the claim, the Circle/Unit will forward the complete SPS claim to Estt. Branch, BSNL Corporate Office for further processing.
• d) After receiving the complete SPS claim, Estt. Branch will scrutinize the claim. Incomplete claims will be returned to the concerned office. If the claim is in order, the claim will be forwarded to Corporate Accounts Branch, BSNL CO for verification of deposit of actual contribution in respect of concerned employee to LIC. The Corporate Accounts Branch will issue a certificate to the effect that contribution has been remitted to LIC along with related details in respect of the particular employee. After receipt of certificate from BSNL CA Branch, the complete case will be forwarded to LIC office for release of SPS benefits to the member/ beneficiary.
• e) Once the SPS case was finally settled, BSNL will not be concerned with regard to annuity benefits. The employee/beneficiary will communicate directly with LIC with regard to dispute/ discrepancy in annuity amount.

4. Any clarification with regard to the Superannuation Pension Scheme and contribution made under the scheme will be provided by CA Branch, BSNL CO.

5. Sincere efforts may also be made by the Circle/Units to intimate the eligible employees or their beneficiary, as the case may be, to submit the claim form for SPS benefit by sending SMS or contacting through telephone or any other means of communication.

Subject: Clarification on CGHS facilities to the retired BSNL/MTNL Employees who are in receipt of pension from Central Civil Estimates.

This refers to DoT O.M. No. 4-12(11 /2012-PAT(Part) dated 31 08.2016 and O.M. No. 4-12(12)/2018-PAT-Part (1) dated 01.07.2019 regarding CGHS facilities to pro-rata pensioners. In this regard, it is mentioned that the matter has been examined in consultation with Ministry of Health & Family Welfare In this regard, it is clarified that:

The above mapping is applicable for the Combined Service Optees who retired from BSNL/MTNL with IDA pay scale.
This mapping is not applicable for pro-rata pensioners who retired from DoT under CDA pay scale. Also, as per guidelines issued from Directorate of CGHS, MoHFW, ward entitlement is based on the last basic pay and CGHS subscription is based on the pay scale as mentioned in the Pension Payment Order (PPO) of a particular retiree. Accordingly, ward entitlement and CGHS subscription in case of pro-rata pensioners of BSNL/MTNL is to be decided based on last pay drawn in DoT before absorption, as mentioned in their respective PPO while retiring from DoT, Govt. of India. Hence, no mapping of IDA/CDA scale is required in case of pro-rata pensioners.

Ref: Our letter of even No, dated 22nd September, 2020.

Hon’ble Sir,

1. We happy to write to invite your kind attention of our captioned letter on the subject under reference. We are addressing you, once again Sir, as we have confident and trust that you are concerned for the citizen of the country and keeping in view that virtual fact, the government is taking all the steps to not only to revive but to make BSNL a Competitive Entity in the country; so that the private communication are not getting free hand to exploit the citizen of the country in providing them communication and other value added services.

2. Aiming to have success in time, Govt. has taken firm and time basis decisions and is being implemented. As desired by the Govt. more than 80,000 employees have been retired under VRS 2019 scheme and present superannuation system. Now, after issuance of sovereign guaranty and bonds to a tune of 8500 crore, we are sure the BSNL will once again flourish in its pre-era of earning handsome profit in short time as expenditure towards salaries is curtailed drastically.

3. To keep a company in most competitive form, the employees also play a vital role and their interest is required to be taken care of by the Company. The BSNL Employees/ Pensioners are due for their Wage/ Pension Revision as per 3rd Pay Revision Committee Recommendations and the Cabinet has also taken affirmative stand in this direction long back.

4. Admittedly, we know that our issue comes under exclusive administrative powers of the Ministry of Communication, as the Department of Telecom and Bharat Sanchar Nigam Limited and should have been settled there and there only but unfortunately having representing our burning issue to all concerned authorities and despite the instructions from your office, we could not get any result. We had represented Memorandum to your office on 25.02.2019 and this was also followed by our various branches throughout the country and we were informed that DoT is being asked to settle the grievance.

5. We, therefore, once again reiterate our desire to consider our just and genuine long pending demand and furnish the brief of our say in brief as under:

• A. BSNL Pensioners were accorded for approval of recommendations of 1st P.R.C. w.e.f. 01.10.2000 at par with working employees simultaneously.
• B. BSNL Pensioners were accorded for approval of recommendations of 2nd P.R.C. w.e.f. 01.01.2007 at par with working employees after Cabinet Approval.
• C. Accordingly, BSNL Pensioners should have been extended the benefit of Pension Revision for BSNL Pensioners w.e.f. 01.01.2017 with fixation of 15% as recommended by the 3rd Pay Revision Committee
• D. Now, the recommendations of 3rd P.R.C. are approved by the Cabinet for working employees of PSUs and the way for its Employees/Pensioners is cleared by MOC’s assurance on 24.03.2018 to AUAB. But it is inordinately delayed.
• E. According to Rule 37-A, of CCS Pension) Rules 1972, sub-rule 8, which says pension/ family pension shall be calculated at par with C.G. Employee retiring on superannuation. The said rule is silent about Pension revision for C.G. Employees but it is in practice in light of Constitutional Bench of Apex Court judgment delivered on 17.12.1982 in D.S. Nakara case.
• F. It is in practice that whenever the pension of Central Government Employees are revised periodically as Per CPC recommendations, the pension Revision of BSNL absorbed DOT employees is also revised as per recommendations of the 3rd P.R.C. Recommendation.
• G. In turn, now as per 3rd Pay Revision Committee recommendations; as they all governed by CCS (pension) Rules 1972 and once upon a time they were C.G. Employees and also conferred status of Govt. Pensioners on retirement, they get their Pension from C.G. i.e. DoT’; they are eligible for their Pension Revision w.e.f. 01.01.2017.
• H. A clarification issued by the DoP&PW vide it’s No: 4/19/2009-P&PW (D) dated 27.3.2009 to DoT reads “BSNL is the only PSU that has been granted a special dispensation under sub-rule (21) of Rule 37-A of CCS (Pension) Rules, 1972 to the effect that the Pensionary benefits including family pension to the absorbed employees of BSNL is paid by the government. This Department is of the view that the change as per DoP&PW O.M. dated 02.09.2009 as mentioned in Para 2 above are also applicable to IDA Pensioners of BSNL.
• I. All these three P.R.Cs did not have in the terms of reference any provision for pension revision as they were exclusively meant for executives. And all the PSUs have their own Pension Scheme barring BSNL Pensioners.
• J. In BSNL wage revision for BSNL Employees is done after the acceptance of PRC recommendation and through bi-lateral agreement with Unions/ Associations and they have no legitimate claim to discuss for Pension Revision for Pensioners as the competent authority is the Govt. of India who through a cabinet note accord its approval for Pension Revision. Thus BSNL Management/BSNL Associations have no role play in the Pension Revision of BSNL Pensioners.
• K. Liability of payment of pension/ family pension to BSNL retirees lies squarely with Government of India as per Cabinet Decision and DoT order dated 20.07.2016 and also the BSNL has paid pension contribution in Cash to the Govt. for the period of their service in BSNL till superannuation.
• L. Consequential to apex court judgment dated 03.05.1990, the DPE has issued orders saying that all employees appointed on or after 01.01.1989 in the PSEs following CDA pattern are deemed to have been appointed on IDA pattern and related scale of pay. As such, BSNL has adopted IDA Pay scales with Pensionary benefit on IDA pattern.
• M. The issue of Pension Revision was not raised while implementing the wage revision to implement the recommendations of 2nd P.R.C. as the Pension Revision was governed by the agreement with the Unions/ Association at the time of corporatization of DOT as BSNL from 01.10.2000.
• N. Now for obvious reasons, the Working Unions/Associations it seems influenced by the political ideology, delaying the process of Wage Revision since last three years and there is no possibility of settlement even till the end of September 2020.

• O. To supplement our view, we write that as per a special provision contained in Chapter – 3 which reads as:

“Assessment and Recommendations, Para 3.2 (IV) – There are also certain CPSEs which have been formed as an independent Government company under a statute to perform specific agenda / regulatory functions. The revenue stream of such CPSEs are not linked to profits from the open market competitive scenario but are governed through the fees & charges, as prescribed and amended from time to time by the Government. There is no budgetary support provided by the Government to such CPSEs. In consideration that the impact of the revised compensation structure including Performance Related Pay) would supposedly form the part of revenue stream for such CPSEs, the Committee recommends that affordability condition shall not be applicable to these CPSEs; however the implementation of same shall be subject to the approval of Administrative Ministry upon agreeing and ensuring to incorporate the impact of the revised compensation structure into the revenue stream.”

The above provision is conditional and applicable to certain PSUs, but BSNL Unions/ Associations are deliberately making movement to make the clause applicable to all the PSU which clearly indicates their motive to delay the process and create unrest amongst PSU Workers.

• P. For your kind information, the BSNL Employees and Pensioners were given assurance by Hon’ble Manoj Sinha, MOSC in the meeting with All Unions/Associations on 24th March, 2018 that the DoT and ministry will move in right directions to get clearance for our Pension Revision w.e.f. 01.01.2017 implementing the 3rd P.R.C. Recommendation at the earliest.

Our submission in light of above:

• 1) We the BSNL Pensioners are due for our Pension Revision w.e.f. 01.01.2017 and for which there is no need to ask consent of the BSNL Corporate Office, as our Pension Contribution has already been collected by the DoT from BSNL on maximum of our Pay.
• 2) The DoT has taken clear stand while accepting and considering proposal of Pension Revision of BSNL Pensioners that the BSNL has no power and no legal authority to say anything in this regard. BSNL can only recommend the pay scale for its employees.
• 3) DoT has given green signal to BSNL Corporate Office to start negotiation with the Unions/ Associations and finalize their pay revision.
• 4) Further, recently, in a Further Discussion on implementation of 3rd P.R.C. Recommendations for BSNL Employees Shri A.K. Sinha, DGM BSNL in a Conciliation Meeting held on 07.12.2020 by the Assistant Labour Commissioner (Central) with Unions has assured that the negotiations will start soon.
• 5) BSNL is extending certain benefits as per Central Pay Commission Reports, whenever it is asked to do with the DoT authority. It cannot straightway accept and extend any facility of Central Pay Commissions.
• 6) As such, it is concluded that Authority to revise the Pension of BSNL Pensioners is exclusively rest with the DoT.
• 7) Even the recommendation of 3rd P.R.C. will be implemented ONLY WHEN, the DoT gives its approval for BSNL Employees considering the proposal of BSNL Corporate Office; when received.

We, therefore, request you to kindly consider our request of Pension Revision of BSNL Pensioners as per 3rd P.R.C. Recommendations w.e.f. 01.01.2017 implementing the 15% fitment formula as suggested/acceptedby the Govt. as now BSNL Pensioners Pension Revision has no relativity with profit/loss of BSNL. The Secretary, DoT may kindly be asked to submit Cabinet Note and should not wait for BSNL Management to entering in to negotiate for Pay Revision for its employees as BSNL has no power to recommend any Pension Revision for Pensioners as per standing instructions of the Ministry.

Sir,

Of late, it has come to the notice of BSNL Corporate Office that in many cases different Courts of f Law have directed UOI/ BSNL for payment of  interest on delayed payment of Gratuity ( DCRC) to the applicant, which have resulted in huge financial burden on BSNL. These cases had been caused due to unnecessary delay in releasing/ payment of Gratuity (DCRG) to the employees by the Circles.

2 . In this regard, it is intimated that in case of retirement of an employee, Gratuity (DCRG) is to be released/ paid immediately to the retired employee. As per GOl Decision (2) under Rule 68 of CCS ( Pension) Rules, 1972 , where the payment of DCRG has been delayed beyond three months from the date of retirement, an interest at the rate applicable to GPF deposits is to be paid to retired / dependants of deceased Government servants. However, of late it has been observed that various Telecom Circles of BSNL are withholding/ delaying the release/ payment of Gratuity on the pretext of pendency of disciplinary proceedings against the concerned BSNL employee, citing instructions given vide Rule 9 of CCS (Pension) Rules, 1972 .

3. In this regard, it is intimated that as per Rule 9 of CCS (Pension) Rules, 1972, the President reserves the right of withholding a pension or gratuity, or both, either in full or in part, or withdrawing a pension in full or in part, whether permanently or for a specified period , and or ordering recovery from a pension or gratuity of the whole or part of any pecuniary loss caused to the Government , if, in any departmental or judicial proceedings, the pensioner is found guilty of grave misconduct or negligence during the period of service. However , as per GOI Decision (6) under Rule 9 of CCS ( Pension) Rules, 1972, minor penalty proceedings have no effect on pension . Further, various instructions under GOI Decision (10) under CCS ( Pension) Rules, 1972 clearly explains the situations under which pension/gratuity cannot be withheld.

4 . It may be seen from the above that the main purpose of withholding pension and/ or gratuity is for recovering pecuniary loss caused to the Government/ BSNL. Hence, withholding the Gratuity in the cases should be done judiciously and as per the provisions of rules only and not as a matter of routine.

5. Further, it has been observed in many instances that the concerned Circles are not taking up the matters immediately with the BSNL Corporate Office, where the decision of the Courts of Law have gone against the Government/ BSNL in the cases involving BSNL employees. Had the Circles taken up the matters immediately with the BSNL Corporate Office, appropriate remedial measures could have taken/appropriate instructions could have been issued on the matter.

6. Accordingly, it has been decided that in the cases where any Court of Law directs for payment of interest on delayed payment of Gratuity, action might be taken for recovery of the said amount from the Officers/ Officials responsible for the delayed release/ payment of Gratuity, in addition to initiation of disciplinary action against them.

7. Hence, All Heads of Telecom Circles/ Other Administrative Units/ Cadre Controlling Authorities in BSNL Corporate Office are requested to release/ pay the Gratuity (DCRG) to the retired employee, without any delay. Further, the Circles arc requested to take up the matter immediately with the BSNL Corporate Office, where the decisions of the Courts of Law have gone against the Government/ BSNL in the cases involving BSNL employees.

The matter has been reviewed and on account of no orders on freezing of IDA/ IDR, it has been decided that in partial modification of previous order under reference all pension related benefits be released as per rate of Dearness Relief as per latest extant order from DPE i.e. @ 160.7%.

I would like to bring to your attention the delay in the pension revision allowing the benefit of merger of 50% DA/DR with Basic/Pension to 78.2% DA/DR for BSNL pensioners/family pensioners, who retired prior to 10.06.2013. Though, the revision in all cases was to be completed by 31.12.2016 as per DoT HQ letter No.40-13/2013-Pen (T) dated 18.07.2016, there is still a huge pendency as on date and the BSNL employees welfare unions have been approaching DoT asking for early settlement of the same.

On review, it is seen that some units of BSNL are sending incomplete papers or are yet to send many of the cases to the CCA offices while there is also pendency in some of the CCA units also (copy of pendency status is enclosed). To complete the task in a structured time frame, concerted efforts both by the BSNL units and CCAs office is required. Target dates both for submission of pension papers and issue of PPOs has now been reviewed both for BSNL and CCA units, which is to be strictly complied to as per the timelines given below.

You are requested to kindly give your personal attention for compliance of the target dates by the BSNL units, from you end.

Sub:Revision of pension of BSNL pensioners/ family pensioners, who retired prior to 10.06.2013 by allowing the benefit of merger of 50% DA/ DR with Basic Pay/ pension, effectively amounting to 78.2% DA/ DR for the purpose of fitment

The pension to combined service optee absorbed employees in BSNL is paid by Government as per sub-rules 21 to 23 of Rule 37-A of CCS(Pension) Rules 1972.

2. Consequent to the Department of Public Enterprises (DPE) orders dated 26.11.2008, revision of pay of employees of BSNL was allowed with effect from 1.1.2007 vide Letter No. 61-01/2009-SU dated 27.02.2009. Subsequently, pension/family pension of employees retired from BSNL who retired between 01.10.2000 and 1.1.2007, was revised vide this office a.M. No. 40-17/2008-Pen (T) Vol.lll dated 15.3.2011.

3. Further to Department of Public Enterprises O.M. No. 2(70)/08-DPE (WC)-GL- VII/09 dated 02.04.2009, the benefit of merger of 50% DA with Basic Pay effectively amounting to 78.2% IDA as on 1.1.2007 for the purpose of fitment, was granted to the BSNL serving employees w.e.f. 10.6.2013 vide Order No. 61-01/2012-SU dated 10.6.2013.

4. The issue regarding revision of pension/ family pension of BSNL IDA pensioners/ family pensioners, who retired prior to 10.06.2013 has been considered by the Government, and the following has been decided:

(a)The pension/ family pension of BSNL IDA pensioners/ family pensioners, who retired prior to 01.01.2007, may be revised as on 01.01.2007 notionally with actual benefit w.e.f. 10.06.2013 by adding together

(i)Existing basic pension/ family pension including commuted portion of pension, if any

(ii)Dearness relief (IDA) @ 78.2%

(iii)Fitment weightage @ 30% of the existing pension/ family pension and dearness relief (IDA) thereon.

The amount so arrived will be regarded as consolidated pension/ family pension with effect from 10.06.2013.

(b)The pension/ family pension of BSNL IDA pensioners/ family pensioners, who retired between 01.01.2007 and 09.06.2013, their pay may be revised notionally with effect from 01.01.2007 by allowing the benefit of merger of 50% DA/DR with Basic Pay/ Pension effectively amounting to 78.2% IDA for the purpose of fitment, and consequential revision of pension on notional pay with actual benefit w.e.f. 10.06.2013, at par with the serving employees of BSNL. However, these pensioners do not get actual benefit of increase in pay/ pension during the period between 01.01.2007 to 09.06.2013, and they would not get increase in the amount of DCRG, leave encashment and commutation of pension on this account.

5.The other conditions with regard to commuted portion of pension, minimum pension and increase in the quantum of pension/ family pension to the old pensioners/ family pensioners, as mentioned in this office O.M. No. 40-17/2008-Pen (T) Vol.lll dated 15.3.2011 shall remain the same.

6.Action to revise pension/ family pension in terms of these provisions may be initiated suo-moto by the concerned Heads of offices. All administrative offices of BSNL handling preparation of pension papers of BSNL pensioners may be directed to initiate the process of consolidation of pension/ family pension to the BSNL IDA pensioners/ family pensioners, who retired prior to 10.06.2013, at the consolidated rates in terms of para 4 above immediately and forward the same to the concerned CCAs for consolidation and issue of revised Pension Payment Orders (PPOs).

7. The exercise to extend benefit of these orders to the pensioners/ family pensioners should be completed by 31.12.2016.
