<p><strong>Subject: One day Agitational Programme on 24.04.2018 on Minimum Guaranteed Pension under National Pension System (NPS).</strong></p>
<p>Dear Brothers and Sisters,</p>
<p>Sadar Namaskar</p>
<p>It is hoped that all of you are well and busy in accelerating trade union activities. As all of you know that the Central Executive Committee Meeting of this federation was held on 26, 27 and 28 March 2018 in Dehu Road, Pune where it was decided to hold one day agitational programme on 24.04.2018 on Minimum Guaranteed Pension under National Pension System (NPS).</p>
<p>A resolution to this effect was also passed in the CEC Meeting held at Hyderabad during September 2015 and subsequently several correspondence were made. However, in spite of lapse of such a large time, no tangible action has been seen from the Govt side on the issue.</p>
<p>Therefore, in absence of any concrete step from the Govt side on the issue it becomes necessary to register our displeasure over the lethargic attitude of the Government and register our protest to constrain the machinery to redress the Grievance.</p>
<p>Hence, you are requested to hold one day agitation programme on 24.04.2018 using all feasible and effective trade union instruments like Gate Meeting, Use of Black Badges, Slogan Shouting, publicizing of programme at humongous level through posters/ hoardings/ banners/ pamphlets/ social media so that the issue may be resolved at the earliest. Further, you are requested to submit a memorandum addressed to Prime Minister of India through proper channel on 24.04.2018.</p>

<div><strong>Memorandum on FDI in Defence Sector</strong></div>

<div>Respected Sir,</div>
<div></div>
<div>Government Employees National Confederation (GENC), an affiliate of Bharatiya Mazdoor Sangh, represents the 02 crores Government employees working in Central Government, State Government and Local Bodies. It has been working since last 45 yrs for the rights and welfare of employees besides taking into consideration the progress and interest of the Nation as well.</div>
<div></div>
<div>Vide this memorandum GENC is reflecting its concern over the news article published in Time of India on 30th May, 2014 that Govt has approved 100% FDI in Defence Sector. As usual TV Channels started debate on this issue and trade unions started opposing the Govt move. Naturally, this news also created a heated debate amongst BMS Cadres because BMS/ GENC/BPMS have strongly opposed the policy of FDI in Defence Sector.</div>
<div></div>
<div>It has to remind your good self that a meeting was held with the then Hon’ble Raksha Mantri Shri Jaswant Singh on 18.07.2001 wherein BPMS expressed its apprehension on the issue of 26% FDI in Defence Sector and explained the threats to National Security as well as the Public Sector Undertakings and Ordnance Factories. Hon’ble Raksha Mantri stated that the apprehension of BPMS on 26% FDI in defence sector would be brought to the notice of Government of India and assured that full utilization of OFB shall be strived. Later, another meeting held with the Hon’ble Raksha Mantri ji on 22.04.2002 wherein he assured that there was no proposal for privatization/corporatization of the Ordnance Factories or any other defence establishment. The same assurance was given by the Hon’ble Raksha Mantri Shri Pranab Mukherji in the meeting held on 18.09.2006. When we reflected our concern before Hon’ble Raksha Mantri Shri A K Antony in the meeting held on 26.06.2007 that 26% FDI allowed in the private sector (for defence equipments) was to bring technology but no foreign company had so far given technology and <strong>the Govt is going to clear for 50% FDI in defence sector, Hon’ble Raksha Mantri ji assured that this was only a proposal from the Ministry of Commerce and as far as MOD was concerned , it had not been agreed to the proposal and conveyed its disagreement to the Ministry of Commerce.</strong></div>
<div></div>
<div>Last year (in the month of July, 2013), news articles published in print and electronic media that Government is considering the report of Arvind Mayaram Committee on removal of ceiling of FDI in Defence, Retail, Banking etc.. It agitated the defence civilians and BMS / GENC / BPMS activists burnt the effigy of committee’s recommendations countrywide.</div>
<div></div>
<div>We know that the Department of Industrial Policy and Promotion under the Ministry of Commerce &amp; Industry, Govt of India releases Discussion Papers on various aspects related to FDI and invites the views and suggestions on the observations made in the discussion papers. In the series of these Discussion Papers, this Paper is on ‘Foreign Direct Investment in Defence sector’.</div>
<div></div>
<div>We also keep in the mind that the views expressed in this discussion paper issued by department of Industrial Policy &amp; Promotion under the Ministry of Commerce &amp; Industry, Govt of India, should not be construed as the views of the Government. The Department hopes to generate informed discussion on the subject, so as to enable the Government to take an appropriate policy decision at an appropriate time.</div>
<div></div>
<div>But India is one of the largest users and importers of conventional defence equipment. It ranks among the top ten countries in the world in terms of military expenditure and most of the global defence equipment suppliers are only system integrators and they manufacture various equipment keeping in view the requirements of a particular order placed upon them. Since the companies keep on winding-up their operations and changing hands, it is virtually impossible to ensure maintenance and product support through their life cycle. This problem exists, in particular, with indigenous equipment manufactured with critical imported components. This raises the issue of the reliability of defence supplies in times of need. Contrary to above the Indian Ordnance Factories and other Defence Public Sector Undertakings are having the capabilities to repair, mordenize or upgrade the defence equipments which they are supplying through their life cycle.</div>
<div></div>
<div>Defence industry is highly technology driven and capital intensive. There is no doubt that it may take some time for domestic companies to acquire a technical edge, but we are against the accessing the technology through the modality of allowing foreign companies to set up production bases/ facilities within the country itself in the Defence sector. Manufacturing within the country, through India Inc. / Members of FICCI/CII/ASOCHEM in addition to OFB/DPSUs, with full transfer of state-of-the-art technology will be a better option than importing the equipment from abroad.</div>
<div></div>
<div>The major reason for reluctance in encouraging the Private Sector into defence production and welcome FDI in the sector is on account of concern for the Defence PSUs and the Ordnance Factories. However, it is clear that if the import continues at the present level, the role of the Defence PSUs and the Ordnance Factories would only be further marginalised. But this may be redressed by modernizing the Ordnance Factories &amp; DPSUs and their capacities may be enhanced by removing the hindrances.</div>
<div></div>
<div>Another concern is that FDI could lead to ownership and control of firms operating in a critical and highly sensitive industry being passed on to foreign hands. Even if ownership or control does not pass on fully to the foreign investors, raising of the cap could lead to their enhanced influence and say in affairs of the company’s management. A related concern is that this could lead to an increased dependence on foreign investment, for meeting our defence needs. Taken to an extreme, this could lead to a situation where a clear relationship of dependency, in terms of foreign capital and technology, develops with regard to investment drawn from specific countries/ blocs.</div>
<div></div>
<div>There can also be concern relating to availability or reliability of supplies in times of war. The availability of maintenance and repair capability, spare parts, material and other support to keep critical systems functioning in all circumstances is a vital concern. This is related to the vital question of whether the foreign investor would continue to serve India’s defence needs in the times of war. This concern cannot be met by imposing a condition that the Government has a right to expropriate a manufacturing facility in case there is a need to do so due to the exigencies of national security, by payment of suitable compensation.</div>
<div></div>
<div>The next concern is related to the issue of passing on of the critical equipment, design or source code to other players-particularly, countries inimical to Indian interests. There can be an issue of export of Defence equipment manufactured in India and exported to inimical countries. There is a general concern about the internal security aspect of manufacture of defence equipment especially small arms and ammunition.</div>
<div></div>
<div>There are other reasons also due to which defence civilians are opposing the FDI in Defence Sector but due to shortage of time some of those are mentioned hereinabove. Hence, kindly consider the above view in correct perspective and convey the disagreement to the proposal of Ministry of Commerce on removal of ceiling of FDI in defence sector.</div>

<div><strong>ANSWERS TO THE QUESTIONNAIRE OF 7TH CPC</strong></div>

<div>1 <strong>SALARIES</p>
<p></strong></div>
<div>1.1 The considerations on which the minimum salary in case of the lowest Group ‘C’ functionary and the maximum salary in case of a Secretary level officer may be determined and what should be the reasonable ratio between the two.</div>
<div></div>
<div>Answer 1.1:- We are of the opinion that the consideration on which the minimum salary in case of lowest Group ‘C’ functionary should be based on the norms set by the 15th International Labour Conference (ILC) with certain amendments. Earlier Central Pay Commissions have kept in the mind that the minimum salary is applicable at the time a person joins the Government which will usually be at a young age when a person may be married and may not have responsibility of parents or many children and accordingly, the family unit for minimum salary can only be taken as three.</div>
<div></div>
<div>Contrary to this, Indian family is considered strong, stable, flexible and enduring and normally it consist of three to four living generations, including brothers, sisters, uncles, aunts, nieces, nephews and grandparents living together in the same home. The official statistics reveal that large segments of the elderly in India are illiterate, out of work force, partially or totally dependent on others and suffering from health problems or physical disabilities. Hence, a person when joins the Government he has to look after his parents, wife, children, brothers and grandparents also. The Maintenance and Welfare of Parents and Senior Citizens Act, 2007 also compels him to take care of his/her parents.</div>

<div>Dear Sir,</div>
<div>I have come to know that a meeting of the Standing Committee of the National Council JCM is scheduled to be held on 07.05.2014 under the Chairmanship of Secretary (P). Being a constituent of National Council (JCM) but not of Standing Committee, I would like to submit one of the issues regarding grant of MACP benefit in the hierarchy of promotional grade instead of hierarchy of grade pay.</div>
<div></div>
<div>An affected employee had challenged the Government’s decision on the subject vide his O.A. No. 1038/CH/2010 in CAT Chandigarh and that the Hon’ble CAT Chandigarh vide its order dated 31.05.2011 granted the prayer of the petitioner and directed the authorities to grant MACP benefit in the hierarchy of promotional grade. Thereafter, the Union of India represented by the Secretary, DoP&amp;T appealed to the Hon’ble High Court of Punjab and Haryana vide CWP No. 19387 of 2011. This appeal of the DoP&amp;T was subsequently dismissed vide order dated 19.10.2011. The Government thereafter approached the Hon’ble Supreme Court vide SLP No. 7467/2013, the Hon’ble Supreme Court dismissed the said SLP. In view of the above, the issue now stands settled that eligible employee needs to be given MACP benefits in the promotional hierarchy only.</div>

<div>Recently, CAT Principal Bench has issued direction on 12.03.2014 in OA No. 864/2014 that once an order has been passed by this tribunal and it has also been upheld at the level of the Supreme Court, there is no question of waiting for an approval from any Govt. department for implementation of the same.</div>
<div></div>
<div> Further, your attention is invited to Para 126.5 of 5th Central Pay Commission which reads as under:</div>
<div></div>
<div>Extending judicial decisions in matters of a general nature to all similarly placed employees. &#8211; We have observed that frequently, in cases of service litigation involving many similarly placed employees, the benefit of judgement is only extended to those employees who had agitated the matter before the Tribunal/Court. This generates a lot of needless litigation. It also runs contrary to the judgment given by the Full Bench of Central Administrative Tribunal, Bangalore in the case of C.S. Elias Ahmed and others v. UOI &amp; others (O.A. Nos. 451 and 541 of 1991), wherein it was held that the entire class of employees who are similarly situated are required to be given the benefit of the decision whether or not they were parties to the original writ. Incidentally, this principle has been upheld by the Supreme Court in this case as well as in numerous other judgments like G.C. Ghosh v. UOI, [ (1992) 19 ATC 94 (SC) ], dated 20-7-1998; K.I. Shepherd etc. Accordingly, we recommend that decisions taken in one specific case either by the judiciary or the Govt. should be applied to all other identical cases without forcing the other employees to approach the court of law for an identical remedy or relief. We clarify that this decision will apply only in cases where a principle or common issue of general nature applicable to a group or category of Government employees is concerned and not to matters relating to a specific grievance or anomaly of an individual employee.</div>

<div>Contrary to above, DoP&amp;T has replied (letter No. No. P-26012/5/2011-AT, 19.08.2013 &amp; No. P-13025/11/2014-AT, dated 04.04.2014) under RTI Act that the SLP was dismissed on technical grounds and not on merit, hence, the Department had decided to implement the order dated 31.05.2011 of CAT Chandigarh Bench for grant of financial upgradation in the promotional hierarchy under MACP to Shri Rajpal on personal basis not to be treated as a precedent</div>
<div></div>
<div>The stand taken by DoP&amp;T is a matter of great concern for the trade unions as whether Govt of India wants to add 35 Lakh more court cases filed by each and every Central Government Civilian employees where the courts are already overloaded and several lakhs of litigants are waiting for judgment for decades.</div>
<div></div>
<div>You may be agree that the JCM Forum has been evolved for promoting harmonious relations and securing the greatest measure of cooperation between the Government, in its capacity as employer, and the general body of its employees in matters of common concern and increasing the efficiency of the public service. Hence, it is our moral and legal responsibility to protect the rights of our fellow members through JCM forum also.</div>

<div>Therefore, you are requested to add the above agenda point in the meeting and try your level best to prove the worthy of existence of this National Council (JCM) by resolving the issue without further delay and litigations in the interest of employees.</div>

<p>Subject : <strong>Indefinite Strike</strong></p>
<p>Dear Colleagues,</p>
<p>Three Recognised Defence Federations (INDWF, AIDEF &amp; BPMS) have jointly decided and issued a Joint Declaration on 19.09.2013 to call for a Joint Agitation by the Defence Civilian Employees including of a indefinite strike. Notice of the Joint Declaration was sent to Defence Secretary Dt. 19.09.2013 alongwith the charter demands. The Joint Declaration and the programme of action together with the charter of demands was sent to all our affiliated unions for conducting Strike Ballot. Accordingly strike ballot was conducted by our affiliated unions as per our programme on 19.12.2013 and reports were sent to the Federation HQrs. It has been observed as per reports that more than 98% of the Defence Civilian Employees all over the country have voted in favour of the indefinite strike as the demands are very much genuine and long pending.</p>
<p>After receiving the reports of the strike ballot, we have sent further intimation to the secretary, Ministry of Defence that the majority employees have supported the strike and the Ministry of Defence should settle the problems forth with failing which, the Defence Civilian Employees will go on indefinite strike and the date for strike will be intimated.</p>
<p>Three recognized Federation have met at New Delhi on 27.01.2014 and noted with serious concern that even after more than 4 month after forwarding the Joint Declaration alongwith charter of demands, there is no progress in settlement of the issues pertaining to Defence Civilian Employees and the Govt. has not taken any step forward for a negotiated settlement/Agreement on the charter of demands.</p>
<p>Considering the negative attitude of the Government and Ministry of Defence towards the demands of the Defence Civilian Employees and its negligence, three Federations have decided in the meeting held on 27.01.2014 at New Delhi to organize Defence Civilian Employees for an indefinite strike starting from 17.02.2014 from 0600 AM in support of the following charter of demands. The meeting also calls upon the affiliated unions of the three Federations to jointly mobilize the Defence Workers by various agitational programmes during the period of serving strike notice on 03.07.2014 and make the strike a grand success.</p>
<p>The meeting also appeals to the CDRA, its affiliates and all other trade unions and associations functioning in the Defence Establishments to join the indefinite strike in the interest of unity of the Defence Employees and also realize the out standing demands of the Defence Civilian Employees.</p>

<p><strong>Demands on Service Matters</strong></p>
<p>1) Grant of 2nd / 3rd MACP in Grade Pay Rs. 4600/- to the Artisan Staff of Defence Establishments who were granted 2nd ACP in the Chargeman Pay Scale of Rs. 5000-8000 upto 31.12.2005 (inspite of MoD’s recommendation matter is pending with Defence Finance)</p>
<p>2) Correlation of the hourly rate of Industrial Workers deployed on Piece Work system in Ordnance Factories in 6th CPC Pay Scale w.e.f. 01.01.2006 (inspite of MoD’s recommendation matter is pending with Defence Finance)</p>
<p>3) Grant of Departmental Overtime Wages to the Industrial Workers deployed on Piece Work system in the Ordnance Factories (inspite of MoD’s recommendation matter is pending with Defence Finance)</p>
<p>4) Grant of hourly rate to the Piece Workers of Ordnance Factories who were given MACP benefits, (inspite of MoD’s recommendation matter is pending with Defence Finance)</p>
<p>5) Grant of revised ACP benefits to the labourers who have completed 30 years of service by granting an one time exemption of Trade Test. (MoD’s recommendation in the matter is pending with DOP&amp;T)</p>
<p>6) Grant of revised ACP benefits to the erstwhile Group “D” NIEs (MoD’s recommendation in the matter is pending with DOP&amp;T)</p>
<p>7) Revision of Night Duty Allowance w.e.f. 01.01.1996 and from 01.01.2006 in the 5th and 6th CPC rates respectively by implementing the Court Judgments on the subject.</p>
<p>8) Doubling of the Risk Allowance for Defence Civilian Employees w.e.f, 01.09.2008 has agreed in the National Anomaly Committee Meeting.</p>
<p>9) Implementation of the following judgment to the similarly placed employees. As per the provisions of DOP&amp;T OM No. A11019/2/98-AT dated 03rd September, 1998</p>
<p>i) Grant of MACP in promotional hierarchy (Government’s SLP dismissed in the case of CAT Chandigarh Bench Judgment on OA No. 1038/CH of 2010)-</p>
<p>ii) Placement from HS Grade to HS Grade-I should be ignored for . granting MACP (Judgment of CAT Principal Bench New Delhi in the case of Employees of 505 ABW, New Delhi referring various Supreme Court Judgments)</p>
<p>iii) Restoration of the opportunity of Chowkidars and Safaiwalas of MES for redesignation as Mate (SS) (Judgment of the Hon’ble CAT Ernakulam Bench in OA No.109/2012 dated 12.12.2012)</p>
<p>iv) Removal of discrimination and grant of skilled pay scale of Rs. 260-4000/950-1500 to non-petitioner Valvemen of MES (Judgment of Hon’ble CAT Jodhpur Bench in OA No. 51/2002 dated 21st July, 2003)</p>
<p>v) Inclusion of HRA and Transport Allowance etc. for computation of OT Wages under Factories Act 1948 based on the judgment of Madras High Court, vi) Implementation of higher Pay Scale and grade structure for the similarly placed Cooks of all Defence Establishments as granted to the Cooks of Air Force vide MoD Letter No. Air HQ./23064/Cooks/PC-4/444-CC/D (Air-!II) dated 12th November, 2013 based on the judgment of Hon’ble Principal Bench CAT, New Delhi.</p>
<p>10) Approval of all cadre review proposals of MTS, Durwan, Fireman, Drivers, Storekeeping Staff, Industrial Canteen Staff, Para Medical Staff, Stenographers, DEO, JJWM and Clerical Staff of OFB, DRDO, DGQA, Navy, EME, AOC, Air Force and other Directorates pending at different level.</p>
<p>11) Grant of PRIS to the DRDO Employees at par with Department of Atomic Energy and ISRO.</p>
<p>12) Revision of Fixed Medical Allowance to the Defence Employees posted at hard stations / isolated places and also grant of medical reimbursement for inpatient treatment for such employees by implementing the judgment of Punjab and Haryana High Court.</p>
<p>13) Grant of Four Grade Structure to the Ammunition Mechanic of NAD under Navy.</p>
<p>14) Grant of Four Grade Structure to the Meter Reader of MES at par with the Artisan Staff,</p>
<p>15) Extension of CSD Canteen facilities for retired defence civilian employees at par with Ex-Serviceman.</p>
<p>16) Revision of Bonus Payment ceiling and Gratuity Ceiling limit.</p>
<p>17) Opening of CGHS Dispensaries in all major cities and recognition of Hospitals under CGHS in Hill Stations.</p>

<span style="text-decoration: underline;"><strong>DEMANDS ON POLICY ISSUES</strong></span></p>
<p>1) Withdraw DPP-2013 which is against the interest of DRDO and Ordnance Factories.</p>
<p>2) No FDI in Defence Sector.</p>
<p>3) No disturbance in the functioning of DRDO by implementing Professor Rama Rao Committee recommendations.</p>
<p>4) No arbitrary reduction of manpower in the various Army Units in the name of ASEC Report in violation of the Cabinet Secretary’s directions.</p>
<p>5) No closure of any Defence Units including Military Farms,</p>
<p>6) Stop all types of outsourcing / contract and regularize all the existing contract/casual workers.</p>
<p>7) Fillup all the posts lying vacant in all the Defence Establishments.</p>
<p>8) Withdraw the New Pension Scheme.”</p>
<p>9) Grant of Compassionate Appointment 100% as being granted by the Railway Ministry.</p>
<p>10) No reduction of sanctioned strength of the Ordnance Factories based on Sourab Kumar Committee Report.</p>

<span style="text-decoration: underline;"><strong>DEMANDS ON TRADE UNIONS RIGHTS AND FUNCTIONING OF JCM</strong></span></p>
<blockquote><p>1) Regular meeting with the recognized Federations by the MoD and other Directorates should be ensured.</p>
<p>2) Three meetings of the Departmental Council (JCM) and four meeting of the JCM-III Level Council as per the constitution of the JCM Scheme should be ensured.</p>
<p>3) Grant of Trade Unions rights to all the non gazetted employees working. in the Defence Establishments as being given in the case of Railway.</p>
<p>4) Grant of Trade Unions rights to the Employees of Hospitals and Training Establishments under MoD since these Establishments are already recognized as Industry by the Labour Ministry.</p>
<p>5. Grant of Trade Unions rights to the Defence Civilian Employees postedat area declared under SRO-17E.</p></blockquote>

<span style="text-decoration: underline;"><strong>DEMANDS ON 7th CPC ISSUES</strong></span></p>
<blockquote><p>1) Settle all the 6th CPC Anomalies and all Cadre review proposals before 7th CPC starts functioning.</p>
<p>2) Accept all the terms of reference of 7th CPC submitted by the staff side of National Council (JCM) to the DOP&amp;T.</p>
<p>3) Implement the revised comprehensive pay packet for the Central Government Employees as on 01.01.2014.</p>
<p>4) To Consider the demand of merger of Dearness Allowance/Dearness Relief with Basic Pay and Basic Pension and also grant of interim relief.</p></blockquote>
<p>The 4 lakhs Defence Civilian Employees who are the fourth force of the Defence of our country are committed and dedicated workforce and they work side by side with the uniformed personnel for the security of our great natioi. Their contribution to the Defence preparedness cannot be underestimated. Any disturbance in the industrial relations in the Defence Estatlishments will hamper the Defence preparedness. The Defence Civilian Employees and their Trade Unions with this responsibility in mind were patiently waiting for settlement of their demands. However, since there is no positive outcome inspite of our best efforts, the Defence Civilian Employees are forced to proceed with an indefinite Strike from 17.02.2014</p>

<p>Respected Sir,</p>
<p>With due regards, it is submitted that OFB had asked the comments/views of this Federation vide letter cited under reference (1) whereupon this federation forwarded its views vide letter cited under reference (2) whereby it had been requested that vide DOP&amp;T O.M. No. 20/49/2009-CS.II (B), Dated 22.06.2011 a new grade of UDC (Non Functional Selection Grade) has been created in Central Secretariat Services cadre in the grade pay of Rs. 4200/- in the Pay Band-2 with immediate effect with the condition that UDCs shall be eligible for placement in ‘NFSG’ on completion of 05 years service as UDC and the total number in the grade will be restricted to 30% of the sanctioned strength of UDC, hence, it should be incorporated in the proposed Recruitment Rules that 30% of UDCs (total sanctioned strength of UDC is 2125 in OFB) should also be placed in the new grade of UDC(NFSG) in the grade pay of Rs. 4200/- in the Pay Band-2 on completion 05 years regular service as UDC in the grade pay of Rs. 2400/-.</p>
<p>Employees were much hopeful that OFB would incorporate the above suggestion of BPMS but it is very painful to see the SRO 43, dated 24.06.2013 forwarded by OFB letter No. 288/RR/SRO/Clerical/A/NI, dated 14.08.2013 that nothing has been done in this regard.</p>
<p>However, you are requested to reconsider the issue and take appropriate action so that 30% of UDCs may be placed in the Grade Pay of Rs. 4200/- after completion of 05 yrs regular service.</p>
