<div>Respected Madam,</div>
<div>With due regards, your attention is invited to meeting held with your good self and BPMS reps on 12.12.2013 wherein one of the issues was raised regarding grant of incentive bonus to Examiners of Quality Control in Ordnance &amp; Ordnance Equipment Factories and you had assured to do the needful.</div>
<div></div>
<div>This letter is to bring to your kind notice that vide OFB letter No. 108/POLICY/TS/QCS, Dated 12.09.2012 addressed to Sr GM /GM of all Ord Fys, the then DGOF &amp; Chairman OFB had reflected his concerns over the ‘Quality Management System in Ordnance Factories’ which needs improvement to enhance User’s confidence in our products.</div>
<div></div>
<div>In this regard, this federation vide letter no. BPMS / OFB / 72(7/3/R), dated 19.09.2012 urged the then DGOF &amp; Chairman, OFB to give some incentive to Examiners at least on par with Maintenance workers to motivate the Examiners, to contribute their knowledge, experience cent percent to the organization.</div>
<div>This federation has been grateful to the OFB on considering the above in correct perspective and for inviting the comments from Sr GMs/GMs of all Ordnance Factories whether Examiners may be provided some incentives. It is learnt that almost all Sr GMs/GMs have recognized the role of Examiners and recommended to grant incentive to Examiners at least on par with Maintenance workers. Since then the matter is pending in OFB.</div>

<div>Therefore, you are requested to take necessary action on priority to give Incentive Bonus to Examiners of QC at least on par with Maintenance Workers to boost the morale of Examiners and remove their apathetic attitude.</div>

<div>It is for your kind information that our delegates S/Sri V L Nawade , Sadhu Singh, Mukesh Singh &amp; Virendar Sharma today had a meeting with Hon’ble Finance &amp; Defence Minister, Shri Arun Jaitley at 1300 hrs. It was scheduled as a courtesy meeting but we invited his attention to the news articles on 100% FDI in defence sector because it was a great concern for all the stake holders. We reflected our concern vide a memorandum submitted by Shri Sadhu Singh (copy of the same is enclosed for ready reference).</div>

<div></div>
<div>Hon’ble Minister narrated how the Secretary, DIPP came to his office with the concerned minister on the same day of assuming the charge of ministry and shown the discussion paper prepared during the previous Government on 100% FDI in defence sector which he rejected at once. He has assured us that he is not in favour of 100% FDI in defence sector as neither it is required nor it is in the interest of the Nation. Not only that, he would take all the necessary steps to strengthen the existing Ordnance Factories &amp; DPSUs but on the same time these defence installations require introspection.</div>

<div></div>
<div>Apart from above, some of the following issues were also brought to his notice which were considered by him very sympathetically and assured that appropriate action would be taken by concerned authorities:-</div>
<div></div>
<div></div>
<div>1. Defence installations should be exempted from 5% limit of Compassionate ground appointment and one time relaxation for all pending cases,</div>
<div></div>
<div>2. Re-draft the role of Defence (Finance) so that service matters like Recruitment Rules, Cadre Review, revival of sanctioned posts, payment of arrears, revision of allowances etc. may be settled at the earliest,</div>
<div></div>
<div>3. Judicial pronouncements may be extended to similarly placed non-petitioner employees,</div>
<div></div>
<div>4. The meeting of Departmental Council (JCM), MOD is not being convened regularly,</div>
<div></div>
<div>5. None of the Administrative Joint Secretaries of Departments of MOD has implemented the instruction {MOD I.D. No. 1(1)/2013/D(JCM), dated 22.10.2013} on the Mechanism to provide additional meeting opportunities to Staff Side to sort out their grievances,</div>
<div></div>
<div>6. The minimum benefit under Central Government Employees Groups Insurance Scheme should be enhanced to Rs. 10 lakh,</div>
<div></div>
<div>7. Dearness Allowance should be merged with Basic Pay,</div>
<div></div>
<div>8. Scrap the New Pension Scheme and restore old Pension Scheme,</div>
<div></div>
<div>9. CSD Canteen facilities may be provided to the retired Defence Civilian Employees,</div>
<div></div>
<div>10. A separate meeting to discuss the issues related to Department of Defence Production (OFB, DGQA, DGAQA etc.).</div>
<div></div>
<div></div>
<div>After that we met Shri Navin Kumar Chaudhari, Joint Secretary (Establishment), Min of Defence and discussed following issues besides all the above issues;</div>
<div></div>
<div>1. Probable date of completion (PDC) on the pattern of citizen charters should be fixed for resolving the issues, for movement of file/paper from desk to desk/section in respect of issues raised by JCM/Federations and latest position should be updated in website,</div>
<div></div>
<div>2. A permanent cell of empowered officers from Min of Defence, Finance, Law, Labour, DoPT etc. should be constituted in MoD so that the Cadre Review &amp; Recruitment Rules of Group ‘B’, ‘C’ &amp; ‘D’ may be revised expeditely.</div>
<div></div>
<div>3. Remove the artificial restriction of 40 days PLB for AOC, Navy, Air Force, EME &amp; Ordnance Factories. The PLB should not be less than the Adhoc Bonus of 30 days, and all ceilings on payment and eligibility of Bonus should be removed, JS (E) immediately called the DS (E) &amp; DS (CP) and instructed to convene regular meetings of JCM and next meeting of Departmental Council (JCM), MOD may be convened on 24.06.2014 in Sena Bhawan.</div>

<div>Dear Sir,</div>
<div>I have come to know that a meeting of the Standing Committee of the National Council JCM is scheduled to be held on 07.05.2014 under the Chairmanship of Secretary (P). Being a constituent of National Council (JCM) but not of Standing Committee, I would like to submit one of the issues regarding grant of MACP benefit in the hierarchy of promotional grade instead of hierarchy of grade pay.</div>
<div></div>
<div>An affected employee had challenged the Government’s decision on the subject vide his O.A. No. 1038/CH/2010 in CAT Chandigarh and that the Hon’ble CAT Chandigarh vide its order dated 31.05.2011 granted the prayer of the petitioner and directed the authorities to grant MACP benefit in the hierarchy of promotional grade. Thereafter, the Union of India represented by the Secretary, DoP&amp;T appealed to the Hon’ble High Court of Punjab and Haryana vide CWP No. 19387 of 2011. This appeal of the DoP&amp;T was subsequently dismissed vide order dated 19.10.2011. The Government thereafter approached the Hon’ble Supreme Court vide SLP No. 7467/2013, the Hon’ble Supreme Court dismissed the said SLP. In view of the above, the issue now stands settled that eligible employee needs to be given MACP benefits in the promotional hierarchy only.</div>
<div></div>
<div>Recently, CAT Principal Bench has issued direction on 12.03.2014 in OA No. 864/2014 that once an order has been passed by this tribunal and it has also been upheld at the level of the Supreme Court, there is no question of waiting for an approval from any Govt. department for implementation of the same.</div>
<div></div>
<div> Further, your attention is invited to Para 126.5 of 5th Central Pay Commission which reads as under:</div>
<div></div>
<div>Extending judicial decisions in matters of a general nature to all similarly placed employees. &#8211; We have observed that frequently, in cases of service litigation involving many similarly placed employees, the benefit of judgement is only extended to those employees who had agitated the matter before the Tribunal/Court. This generates a lot of needless litigation. It also runs contrary to the judgment given by the Full Bench of Central Administrative Tribunal, Bangalore in the case of C.S. Elias Ahmed and others v. UOI &amp; others (O.A. Nos. 451 and 541 of 1991), wherein it was held that the entire class of employees who are similarly situated are required to be given the benefit of the decision whether or not they were parties to the original writ. Incidentally, this principle has been upheld by the Supreme Court in this case as well as in numerous other judgments like G.C. Ghosh v. UOI, [ (1992) 19 ATC 94 (SC) ], dated 20-7-1998; K.I. Shepherd etc. Accordingly, we recommend that decisions taken in one specific case either by the judiciary or the Govt. should be applied to all other identical cases without forcing the other employees to approach the court of law for an identical remedy or relief. We clarify that this decision will apply only in cases where a principle or common issue of general nature applicable to a group or category of Government employees is concerned and not to matters relating to a specific grievance or anomaly of an individual employee.</div>
<div></div>
<div>Contrary to above, DoP&amp;T has replied (letter No. No. P-26012/5/2011-AT, 19.08.2013 &amp; No. P-13025/11/2014-AT, dated 04.04.2014) under RTI Act that the SLP was dismissed on technical grounds and not on merit, hence, the Department had decided to implement the order dated 31.05.2011 of CAT Chandigarh Bench for grant of financial upgradation in the promotional hierarchy under MACP to Shri Rajpal on personal basis not to be treated as a precedent</div>
<div></div>
<div>The stand taken by DoP&amp;T is a matter of great concern for the trade unions as whether Govt of India wants to add 35 Lakh more court cases filed by each and every Central Government Civilian employees where the courts are already overloaded and several lakhs of litigants are waiting for judgment for decades.</div>
<div></div>
<div>You may be agree that the JCM Forum has been evolved for promoting harmonious relations and securing the greatest measure of cooperation between the Government, in its capacity as employer, and the general body of its employees in matters of common concern and increasing the efficiency of the public service. Hence, it is our moral and legal responsibility to protect the rights of our fellow members through JCM forum also.</div>
<div></div>
<div>Therefore, you are requested to add the above agenda point in the meeting and try your level best to prove the worthy of existence of this National Council (JCM) by resolving the issue without further delay and litigations in the interest of employees.</div>

<p>Subject:<strong> Grant of MACP benefit to the eligible employees in the hierarchy of promotional grade: Compliance of CAT Principal Bench Directive on 12.03.2014 in OA No. 864/2014.</strong></p>
<p>Respected Sir,<br />
With due regards, I would like to draw your kind attention on the subject wherein the issue of grant of MACP benefit in the hierarchy of promotional grade instead of hierarchy of grade pay is being demanded &amp; discussed by this Federation at every forum.</p>
<p>It has now been brought to our notice that an affected employee had challenged the Government’s decision on grant of MACP benefit in the hierarchy of promotional grade vide his O.A. No. 1038/CH/2010 in CAT Chandigarh and that the Hon’ble CAT Chandigarh vide its order dated 31.05.2011 granted the prayer of the petitioner and directed the authorities to grant MACP benefit in the hierarchy of promotional grade. Thereafter, the Union of India represented by the Secretary, DoP&amp;T appealed to the Hon’ble High Court of Punjab and Haryana vide CWP No. 19387 of 2011. This appeal of the DoP&amp;T was subsequently dismissed vide order dated 19.10.2011. The Government thereafter approached the Hon’ble Supreme Court vide SLP No. 7467/2013, the Hon’ble Supreme Court dismissed the said SLP.</p>
<p>Recently, CAT Principal Bench has issued direction on 12.03.2014 in OA No. 864/2014 that once an order has been passed by this tribunal and it has also been upheld at the level of the Supreme Court, there is no question of waiting for an approval from any Govt. department for implementation of the same.</p>
<p>In view of the above, the issue now stands settled that eligible employee needs to be given MACP benefits in the promotional hierarchy only.</p>
<p>As such, you are requested to kindly issue necessary directives to all units under your jurisdiction to implement the same immediately.</p>

<p>Respected Sir,</p>
<p>With due regards, it is submitted that OFB had asked the comments/views of this Federation vide letter cited under reference (1) whereupon this federation forwarded its views vide letter cited under reference (2) whereby it had been requested that vide DOP&amp;T O.M. No. 20/49/2009-CS.II (B), Dated 22.06.2011 a new grade of UDC (Non Functional Selection Grade) has been created in Central Secretariat Services cadre in the grade pay of Rs. 4200/- in the Pay Band-2 with immediate effect with the condition that UDCs shall be eligible for placement in ‘NFSG’ on completion of 05 years service as UDC and the total number in the grade will be restricted to 30% of the sanctioned strength of UDC, hence, it should be incorporated in the proposed Recruitment Rules that 30% of UDCs (total sanctioned strength of UDC is 2125 in OFB) should also be placed in the new grade of UDC(NFSG) in the grade pay of Rs. 4200/- in the Pay Band-2 on completion 05 years regular service as UDC in the grade pay of Rs. 2400/-.</p>
<p>Employees were much hopeful that OFB would incorporate the above suggestion of BPMS but it is very painful to see the SRO 43, dated 24.06.2013 forwarded by OFB letter No. 288/RR/SRO/Clerical/A/NI, dated 14.08.2013 that nothing has been done in this regard.</p>
<p>However, you are requested to reconsider the issue and take appropriate action so that 30% of UDCs may be placed in the Grade Pay of Rs. 4200/- after completion of 05 yrs regular service.</p>
