<p>I would like to draw your kind attention towards non declaration of the due installment of DA/ DR w.e.f. from 01-07-2024, normally it used to be declared in the last week of September and three months arrears paid in first week of October.</p>



<p>Severe discontent is there amongst employees and pensioners, over the delay in Announcement of the same.</p>



<p>Similarly, Durga Puja festival is approaching and the PLB and Adhoc Bonus too, are to be declared.</p>



<p>The Confederation seeks your immediate intervention in the above matter and request you to kindly cause the Declaration/Issuance of DA/ DR order’s and the Bonus order’s, timely.</p>

<p>Dear Comrades,</p>



<p>A meeting of the Standing Committee of National Council &#8211; JCM took place on 15/12/2023 under the Chairmanship of Additional Secretary (PP) DOPT, in which officials from various Departments/Ministries participated the following Staff Side Members attended the meeting:-</p>



<p><strong>Shri Shiva Gopal Mishra(Secretary), Shri M. Rghavaiah(Leader), Dr. N. Kannah, Shri J.R. Bhosle, Shri B.C. Sharma, Shri C. Srikumar, Shri Rupak Sarkar, Shri R. Srinivasan, Shri Tapas Bose,</strong></p>



<p>After the introductory remark of the Chairman on behalf of the Staff Side the following issues were raised:-</p>



<ol class="wp-block-list">
<li>To issue instructions to the MOD to hold regular meeting with Staff Side to resolve the issues arising after Corporatization of Ordnance Factories. It was also raised by staff side that Standing Committee as well as National Council should be held in time.</li>



<li>To issue Government orders to extend the period of Option to switch over to the 7th CPC Pay Scale at least for a period of one year i.e. up to 25/7/2017</li>



<li>To issue instructions that Service Association under CCS (RSA) Rule 1993 and Employees Cooperative Societies/ Banks which are covered under the Central Cooperative Societies Act and the respective State Governments Cooperative Societies Act are out of the purview of Rule 15 (1) of the CCS (Conduct) Rules, 1964.</li>



<li>Not to withdraw the 3rd MACP in Grade Pay Rs. 4600/- granted to the Industrial Employees of Defence Ministry (Master Craftsman up to 31/12/ 2005 ince the same was given · based on various Court judgements).</li>



<li>Orders to be issued by Ministry of health for extending CGHS benefits to the employees in Industrial Establishments under Western Naval Command Mumbai.</li>



<li>Revision of Deposit linked Insurance Scheme under the GPF for Central Government Employees.</li>



<li>Restoration of festival advance to the Central Government Employees(Item No.6/SC/62/23).</li>



<li>Extending revised option for the employees who were given entry pay benefit on promotion in the 6th CPC Pay Scale to switch over to 6th CPC Pay Scale w.e.f. 01.01.2006.</li>



<li>Extension of LTC 80 one time relaxation in the case of employees who availed LTC to Andaman &amp; Nicobar Island (A&amp;N) by purchasing air tickets from other than authorized agents,</li>
</ol>



<p>After the above discussion took place on the 13 agenda points and the decision taken are given below:-</p>



<ol class="wp-block-list">
<li>Payment of FMA to Pensioners of the National Institute of Ayurveda and bring the employees of the institutes within the ambit of CCS(MA) Rules.</li>
</ol>



<p><strong>Decision</strong></p>



<p>Staff Side protested against the Government decision to file an SLP in the Supreme Court against the High Court Judgement given in favour of the employees / Pensioners. We demanded that the SLP should be withdrawn and Government should implement the Court Judgement. After discussion Additional Secretary directed the Department of AYUSH to reconsider its decision and explore the possibility of implementing the Judgement considering the less number of employees / Pensioners of the Institute.</p>



<ol class="wp-block-list" start="2">
<li>Restoration of facilities and concession withdrawn by Railways to Senior Citizens.</li>
</ol>



<p><strong>Decision</strong></p>



<p>Staff Side demanded that to start with at least Central Government Pensioners may be allowed the Railway concessions since they are not eligible for LTC after Retirement. Additional Secretary Stated that it is a policy matter to be decided by the Government and hence Staff Side may raise this in the main meeting of NC – JCM.</p>



<ol class="wp-block-list" start="3">
<li>Pension to be exempted from the purview of income taxation.</li>



<li>Disability pension of war heroes to be exempted from Income tax.</li>
</ol>



<p><strong>Decision</strong></p>



<p>Additional Secretary Informed that Government have not agreed to exempt pension from the purview of income tax . We protested against this stand of the government.</p>



<ol class="wp-block-list" start="5">
<li>Revision of the benefit of Deposit Linked Insurance Coverage from GPF.</li>
</ol>



<p><strong>Decision</strong></p>



<p>Staff Side protested against the non cooperation of the Department of Expenditure in not settling the genuine demand of the Staff Side. After discussion Additional Secretary desired that the Department of Expenditure and Department of Pension should reconsider the matter and if required to have a meeting with the Staff Side for reaching an agreement on the issue.</p>



<ol class="wp-block-list" start="6">
<li>Enhancement of Bonus Ceiling Limit of Casual Labourers consequent on enhancement of Bonus Calculation Ceiling of Central Govt Employees.</li>
</ol>



<p><strong>Decision</strong></p>



<p>After discussion it was decided that the Department of Expenditure will issue a circular to all the Ministries/Department to find out the number of casual employees and there after a decision would be taken.</p>



<ol class="wp-block-list" start="7">
<li>Modification for grievance redressal mechanism .</li>
</ol>



<p><strong>Decision</strong></p>



<p>Staff Side complained that the grievances of pensioners and family pensioners are not being addressed properly and hence the grievance redressal mechanism in the DOP&amp;PW and all other Ministries should be strengthened and should be properly monitored. DY. Secretary DOP&amp;PW informed that a detailed guidelines in this regard was issued by the DOP&amp;PW. Additional Secretary desired that a copy of the DOP&amp;PW instructions may be forwarded to the Staff Side and the DOP&amp;PW should ensure that the pensioner’s grievances should be attended and settled in a time bound manner. Staff side mentioned that as per norms Pension and PW department should hold minimum three meetings during year but instead of continuous persuasions and sending agenda no meeting could be held. Additional Secretary, DOP&amp;T informed that meetings will be arranged.</p>



<ol class="wp-block-list" start="8">
<li>Implementation of Govt. decision on 7th CPC recommendations on Risk Allowance to the Central Govt. Employees including Defence Civilian Employees.</li>
</ol>



<p><strong>Decision</strong></p>



<p>Staff Side argued that Risk Allowance should be at par with the Risk and Hardship matrix and the left out operations organisations and categories should be included for the payment of Risk Allowance. Additional Secretary informed that the report of the Railway Risk Allowance Committee has been received and the same will be studied. After receipt of Risk Allowance Committee Report of Defence Ministry further Action in this regard would be taken. It was also assured by ADS that the recommendations send by railways will be analysed and hard duty allowance for various categories will be examined and replied shortly.</p>



<ol class="wp-block-list" start="9">
<li>Restoration of the commuted portion of pension after 12 years:</li>
</ol>



<p><strong>Decision</strong></p>



<p>Staff Side protested against the stand taken by Department of Expenditure that the Staff Side should wait till the next Pay Commission and that now this demand is premature. We stated that the Staff Side have already given full justification for restoration of the commuted pension after 12 years and the DOP&amp;PW have already recommended for restoration of the commuted pension after 12 years and hence the issue needs to be settled. After discussion Additional Secretary desired that the DOP&amp;PW and the Department of Expenditure should hold a meeting with Staff Side and if the issue is not resolved then the same·can be raised in the main meeting of the National Council – JCM.</p>



<ol class="wp-block-list" start="10">
<li>MACP to be made effective from 1.12006 in implementation of the judgement of the Supreme Court.</li>
</ol>



<p><strong>Decision</strong></p>



<p>The Supreme Court in two cases have rejected the above matter. Only in the case of Armed Force Personnel the Supreme Court gave a different Judgement and MOD of their own have implemented the judgement for Armed Forces Personnel. The matter will be further studied.</p>



<ol class="wp-block-list" start="11">
<li>Grant of one notional increment for those who retired on superannuation on 30th June,</li>
</ol>



<p><strong>Decision</strong></p>



<p>Staff Side protested against the undue delay in deciding this issue despite many judgements by the Supreme Court and we demanded that the Government Orders should be issued. Additional Secretary stated that the issue is in an advanced stage of consideration and the DOPT would take a decision in this regard very soon.</p>



<ol class="wp-block-list" start="12">
<li>Applicability of the 7th CPC. Pay revision benefit for those retired on 31.12.2015.</li>
</ol>



<p><strong>Decision</strong></p>



<p>The Matter is pending before the Supreme Court</p>



<ol class="wp-block-list" start="13">
<li>To specify time frame for the completion of disciplinary cases in the case of pensioners.</li>
</ol>



<p><strong>Decision</strong></p>



<p>Staff Side stated that there are many disciplinary cases of retired employees remaining unsettled and pending for 5 to 10 years period and hence there should be a time limit fixed for the disciplinary proceedings pending against retired government employees. Additional Secretary informed that the matter is under examination in the DOPT and detailed guidelines will be issue very soon in this regard.</p>



<p>After discussion on the above agenda points we raised the following important issue:</p>



<ol class="wp-block-list">
<li>After the issue of DOP&amp;PW OM Dated 03.03.2023 on the subject of option for those Central Government employees who were recruited on the basis of Notification / Advertisement issued prior to 22/12/2003 for conversion from NPS to OPS the following anomalies have cropped up and in the lower formations I field units the above OM is not properly implemented.</li>
</ol>



<p>a. Ex Apprentices of Railways and Defence who were recruited directly on batch wise seniority basis in their cases there is no notification / advertisement and hence the vacancies sanctioned for recruitment prior to 22/12/2003 should be treated as notification. This is not happening in the units.</p>



<p>b. In the case of Compassionate Appointment also there is no notification and hence the employees recruited on the basis of the Call Letters issued to them / date of application for compassionate appointment etc should be treated as notification. This matter is also remaining unsettled.</p>



<p>c. In some cases the senior employees are kept in NPS and the Junior employees are converted to Old Pension Scheme .</p>



<p>To settle all the above issues and for extension of the cut of date for the appointing Authorities to take the decision etc were represented to the DOP&amp;PW by the Secretary Staff Side and have demanded the</p>



<p>DOP&amp;PW to hold a meeting with the Staff Side to decide all the various anomalies in the implementation of DOP&amp;PW OM dated 03/03/2023. However there is no positive response from the DOP&amp;PW. Additional Secretary directed that the DOP&amp;PW should hold a meeting with the Staff Side to resolve the issues represented by the Staff Side.</p>



<p>While concluding the meeting Additional Secretary assured that the meeting of the National Council JCM under the Chairmanship of Cabinet Secretary would take place soon.</p>

<h3 class="wp-block-heading">Sub: Productivity Linked Bonus for the eligible Defence civilians of the Army Ordanance Corps (AOC) for the year 2020-2021.</h3>



<p>Sir,</p>



<p>I am directed to refer to the Productivity Linked Bonus Scheme already circulated vide this Ministry letter No.F-24(9)/80/D(JCM), dated 28th September, 1983 as amended from time to time and to convey the sanction of President to the payment of 40 days(forty days) wages in cash as PLB for the year 2020-2021 to the eligible civilian employees of the AOC/Indian Army.</p>



<p>2. The entitlement has been worked out on the basis of the working results for the year 2020-2021 in accordance with the agreed formula.</p>



<p>3. The PLB shall be paid to all eligible Gp. &#8216;B'(Non-Gazetted) and Gp. ‘C’ civilian employees of Indian Army(AOC) who are covered under PLB Scheme for the accounting year 2020-2021. The calculation ceiling of Rs.7000/-(7000×40/30.4) and other terms and conditions of the PLB Scheme will remain unchanged.</p>



<p>4. Productivity Linked Bonus to the casual labourer will be paid at the assumed wages of Rs.1200/-p.m. (1200×40/30.4) for the accounting year 2020-2021 . However, in cases where the actual wages fall below Rs.1200/- p.m., the amount will be calculated on the actual monthly wages. The other conditions remain unchanged.</p>



<p>5. The expenditure on this account will be debitable to Defence Service Estimates under respective Heads to which the pay and allowances of these employees are debited. The entire expenditure on the payment of PLB is to be met out of the sanctioned budget grant for the year 2021-2022, without any additionality.</p>



<p>6. This issues with the concurrence of the Ministry of Finance,Deptt. of Expenditure vide their l.D. No.11/8/2019-E.lll A(300506031/2021) dated 26.10.2021 and Mod (Fin/AG/PB) vide their Dy. No. 71/AG/PB/2021 dated 01.11.2021.</p>

<ol class="wp-block-list" start="2"><li>The proposal has been examined in this Department and it has been decided to <strong>restrict </strong>the PLB to <strong><span style="text-decoration: underline;">Sixty 60 days wages</span></strong> only in respect of eligible employees of Department of Posts.</li></ol>



<ol class="wp-block-list" start="3"><li>The payment of bonus will be governed by the existing terms and conditions and expenditure on this account will be met from the existing budget provisions for financial year 2021-22 without any additional support from the Government.</li><li>This issues with the approval of Hon&#8217;ble Finance Minister.</li></ol>

<p class="has-text-align-center"><strong>ORDER:</strong></p>



<p>Government has decided to grant Ad-hoc Bonus to celebrate harvest festival “Pongal”, equivalent to 30 days emoluments on a base of 30 days a month to all ‘C’ and ‘D’ Group regular and temporary Government employees, employees of Local Bodies and Aided Educational Institutions including teachers on regular time scales of pay and Special Ad-hoc Bonus of Rs.1000/- to full time and Part time employees paid from contingencies / employees paid from Special time scale of pay for the accounting year 2019-2020.</p>



<p>2. In the Government Order read above, orders were issued to grant Ad-hoc Bonus for the Accounting Year 2018-19 equivalent to 30 days emoluments subject to a ceiling of Rs.3000/- to ‘C’ and ‘D’ Group regular and temporary Government employees, employees of Local Bodies in Government aided educational institutions.</p>



<p>3. Accordingly, Government direct that all “C and D” Group regular and temporary employees who are on regular time scales of pay, employees of Local Bodies and Aided Educational Institutions including Teachers on regular time scales of pay in C and D Group be paid adhoc bonus equivalent to 30 days emoluments subject to a ceiling of Rs.3,000/- for the accounting year 2019-20.</p>



<p>4. Government also direct that, Special Ad hoc Bonus of Rs.1,000/- be paid to full-time and part-time employees paid from contingencies at fixed monthly rates, employees on consolidated pay/ special time scale of pay including employees in Nutritious Meal Programme/ Integrated Child Development Service (ICDS) Scheme (Anganwadi Workers /Mini Anganwadi Workers), Village Assistants, employees on daily wages and the employees partly worked on daily wages and subsequently brought under regular establishment and worked continuously for atleast 240 days or more during the accounting year 2019-2020.</p>



<p>5. The Ad-hoc Bonus shall be computed on the basis of actual emoluments as on 31st March 2020. The amount of ad-hoc bonus shall be calculated as if monthly emoluments were Rs.3,000/- per month. In respect of those drawing pay in the pre-revised/revised scales of pay, the calculation of Ad-hoc bonus shall be based on the emoluments drawn subject to the upper ceiling limit of Rs.3,000/- per month.</p>



<p>6. The Ad-hoc Bonus/ Special Ad-hoc Bonus sanctioned above shall be admissible subject to the conditions prescribed in the Annexure to this order.</p>



<p>7. The expenditure on Ad-hoc Bonus/ Special Ad-hoc Bonus shall be debited to the sub-detailed head “04. Other Allowances” under the detailed head “01. Salaries” or the detailed head “02 wages” as the case may be, under the relevant service head of the department concerned.</p>

<p><strong>[G.O.Ms.No.1, Finance (Allowances) Department, Dated: 04.01.2021]</strong></p>



<ul class="wp-block-list"><li>(i) The emoluments for purposes of Ad-hoc Bonus under these orders shall be worked out on the basis of basic pay/ personal pay and dearness allowance as on 31st March, 2020. The eligible Government servants of C and D Group shall be as ordered in G.O.Ms.No.21, Personnel and Administrative Reforms (A) Department, Dated: 05-03-2019.</li><li>(ii) The employees who were in service on 31st March 2020 and have rendered a full year of service from 1st April 2019 to 31st March 2020 shall be eligible for the full amount of Ad-hoc Bonus sanctioned in this Order at the rate of 30/30 days of emoluments.</li><li>(iii) The employees who have rendered service of six months and above, but less than a year during 2019-2020 shall be eligible for proportionate amount of Ad-hoc Bonus. For the purpose of this rule, period less than 15 days shall be ignored and fifteen days and above shall be treated as a full month of service.</li><li>(iv) The Ad-hoc Bonus shall be rounded to the nearest rupee, i.e., fraction of 50 paise and above shall be rounded to the next higher rupee and fraction below 50 paise shall be ignored.</li></ul>



<p>(v) The period of service for the purpose of computing Ad-hoc Bonus shall include all leave other than the extraordinary leave without Allowances. In the case of employees who were on extraordinary leave without allowances / Half Pay / Study Leave without pay during the month of March 2020, the Ad-hoc Bonus shall be determined based on the emoluments last drawn before proceeding on leave.</p>



<p>(vi) In the case of employees under suspension at any time, during 2019-2020 Subsistence allowances paid during suspension shall not be treated as emoluments. Such an employee may be paid Ad-hoc Bonus / Special Ad-hoc Bonus as and when the period of suspension is treated as duty. In other cases, the period of suspension shall be excluded for the purpose of Ad-hoc Bonus/ Special Ad-hoc bonus. In the case of suspension, if any, after 31st March 2020 there shall be no bar for the payment of Ad-hoc Bonus / Special Ad-hoc Bonus.</p>

<p><strong>Pongal Festival, 2021 &#8211; Grant of Pongal Prize to &#8216;C&#8217; and &#8216;D&#8217; Group Pensioners / All Family Pensioners &#8211; Orders &#8211; Issued.</strong></p>



<p>Read the following:-</p>

<p>The Government sanction a lumpsum Pongal Prize amount of Rs.500/- (Rupees Five Hundred only) to all Government Pensioners who retired from the categories of &#8216;C&#8217; and &#8216;D&#8217; Group (C and D Group of Scales of Pay (Ordinary Grade) is annexed to this order) including all &#8216;C&#8217; and &#8216;D&#8217; Group of Pensioners of Aided Educational Institutions, Local Bodies, Ex-Village Establishment (Ex-Village Officers and Village Servants / Assistants), ad-hoc Pensioners of all categories (Pensioners those who are drawing special pension of Rs.2,000/- with effect from 1-10-2017 i.e. Noon Meal Organisers, Anganwadi Workers, Mini Anganwadi Workers, Cooks, Cook Assistants, Anganwadi Helpers, Panchayat Secretaries, Village Librarian, Sweepers / Sanitary Workers / Scavengers, Plot Watchers, Anti-poaching Watchers, Police Station Cleaners, Ayah) and to all Family Pensioners irrespective of the Groups from which the Pensioners / Deceased Government employee had retired / died while in service.</p>



<p>2. This order shall also be applicable to all &#8216;C&#8217; and &#8216;D&#8217; Group provisional <a href="https://centralgovernmentnews.com/category/pension/" target="_blank" rel="noreferrer noopener">pensioners</a>. The Pongal Prize amount shall not be admissible to those employees who retire on or after 04-01-2021.</p>



<p>3. Those who have retired/ died in harness on or after 06.01.2020 are not eligible for the Pongal Prize amount if they are paid Adhoc Bonus as per the orders issued in the Government Order second read above. For this purpose, the Pension Disbursing Officers shall obtain non-drawal certificates from the departments concerned before making payment to these Pensioners.</p>



<p>4. This order is not applicable to the following categories of pensioners:-</p>



<ul class="wp-block-list"><li>(i) Special Pensioners such as Ulema Pensioners, State Freedom Fighters Pensioners and Social Pension for Scholars and Eminent persons, etc.</li><li>(ii) Family Pensioners who are appointed on compassionate grounds if adhoc bonus/special adhoc bonus is paid to them as applicable to the employees in service.</li><li>(iii) All Pensioners who retired from Group ‘A’ and ‘B’ posts including All India Service Officers and Officers governed by University Grants Commission (UGC) / All India Council for Technical Education (AICTS) / Indian Council of Agricultural Research (ICAR) Regulations.</li></ul>



<p>5. The Government also direct that the procedure indicated below shall be followed for disbursement of Pongal Prize amount in respect of Pensioners/ Family Pensioners coming under the pension Pilot Scheme.</p>



<p>(i) In respect of those Pensioners / Family Pensioners to whom pension/ family pension is sent by Money order at Government cost, the Pongal Prize amount also shall be sent by Money Order at the Government cost.</p>



<p>(ii) In respect of Pensioners/ Family Pensioners to whom pension/ family pension is paid through Banks.</p>

<ul class="wp-block-list"><li>(a) In Pension Pay Office, Chennai and District Treasuries/ Sub-Treasuries where the cheque system of payment of bills/ Electronic Clearing System is in vogue, the pension pay officer, Chennai and District Treasury Officers/ Sub Treasury Officers are permitted to issue cheques and send the cheques to the respective paying branches of the bank with a covering list of Pensioners/ Family Pensioners for crediting the amount to the pensioners/ family pensioners savings bank account.</li><li>(b) As regards Banking Sub-Treasuries where the cheque system of payment of bills/ Electronic Clearing System is not in vogue, the Sub-Treasury Officers are permitted to get Banker’s cheque/ Bank draft and send them to the respective Pensioners for crediting the amount to the pensioners/ family pensioners savings bank account.</li></ul>



<p>6. In respect of pensioners/ family pensioners coming under the public sector bank scheme, all public sector banks are authorized to credit the lumpsum amount to the C &amp; D pensioners to the pensioners/ family pensioners account.</p>



<p>7. In respect of pensioners/ family pensioners for whom expenditure is met from State Consolidated Fund, the expenditure shall be debited to the following head of account:</p>

<p>In respect of payment of pongal prize to Ex-village officers, the expenditure shall be debited to the following head of account</p>

<p>8. In respect of Pensioners (&#8216;C&#8217; and &#8216;D&#8217; Group) /Family Pensioners of Local Bodies for whom expenditure is met from the fund maintained by the Director of Local Fund Audit or Municipal Funds, as the case may be, the expenditure shall be met from the respective funds. In respect of Special Pensioners of Noon Meal Organisers, Anganwadi Workers, Mini Anganwadi Workers, Cooks, Cook Assistants and Anganwadi Helpers, the Block Development Officers / Child Development Project Officer concerned shall debit the expenditure under the head of account mentioned in para-7 above.</p>



<p>9. The Pongal Prize amount sanctioned above shall be paid to the eligible Pensioners/ Family Pensioners and Ex-Village Officers immediately.</p>



<p>10. Necessary provisions have been made under the relevant head of account in Budget Estimate 2020-2021.</p>

<h3 class="wp-block-heading"><em>Subject: Grant of ad-hoc bonus to State Government employees for the financial year 2019-2020.</em></h3>



<p><br />The matter relating to grant of ad-hoc bonus&nbsp;for the financial year 2019-20 to State Government employees has been considered and the Governor is pleased to order that the State Government employees may be granted ad-hoc <a href="https://centralgovernmentnews.com/category/bonus/">bonus</a> equivalent to <strong>30 days emoluments for the financial year 2019-20</strong> on the following terms and conditions:</p>



<p>(I) Government Servants who were in service on 31-03-2020 and continuing in service on 1st April 2020 and drawing pay in Pay Level in the&nbsp;Pay Matrix&nbsp;L-12 or less under Rajasthan Civil Services (Revised Pay) Rules, 2017 or Grade Pay of Rs.4800 or less drawing pay in Rajasthan Civil Services (Revised Pay) Rules, 2008 (excluding officers of State Services) are entitled for ad-hoc bonus.</p>



<p>(II) For drawing ad-hoc bonus Government employee must have rendered at least six months of continuous service during the year 2019-20. Ad-hoc bonus equal to 30 days emoluments will be admissible to eligible employees who have rendered continuous twelve month service during the year 2019-20. Pro-rata payment will be admissible for continuous service from six months to twelve months. The eligibility period shall be taken in terms of number of months or service rounded to the nearest number of months. Rounding to the nearest number of months will, however, not be permissible for service of less than six months.</p>



<p>(III) The amount of ad-hoc bonus payable to the eligible employees for the financial year 2019-20 will be computed on the basis of actual emoluments as on 31st March 2020 and for the purpose of calculation of ad-hoc bonus the maximum amount of emoluments will be restricted to Rs.7000/- per month.</p>



<p>(IV) The term ’emoluments’ occurring in this order will include basic pay, personal pay, deputation allowance and&nbsp;dearness allowance&nbsp;but will not include other allowances such as house rent allowance, compensatory (city) allowance etc.</p>



<p>(V) The amount of ad-hoc bonus payable shall be computed assuming the month of 31 days.</p>



<p>(VI) The amount of ad-hoc bonus payable will be rounded off to the nearest rupee.</p>



<p>(VII) 25% of the ad-hoc bonus shall be paid in cash and 75% of the ad-hoc bonus shall be credited to the General Provident Fund Account of the respective employees who are recruited to the Civil Services before 1-1¬2004.<br /><br />(VIII) For the employees recruited to the Civil Services on or after 1-1-2004 and who are governed by Contributory&nbsp;Pension&nbsp;Scheme the 25% of the ad-hoc bonus shall be paid in cash and 75% of the ad-hoc bonus shall be credited in a Scheme being put in place on lines of GPF. The procedure for operation of this Scheme will be prescribed in due course of time. Meanwhile amount of 25% of ad-hoc bonus which is to be paid in cash can be drawn by DDO for the employees appointed on or after 1¬1-2004.</p>

<p>It is further clarified that: </p>



<p>(a) Except in the case of extra-ordinary leave (leave without pay), the period of leave of other kinds will be included for the purpose of working out eligibility period. The period of extra-ordinary leave (leave without pay) will be excluded from eligibility period but will not count as break in service for the purpose of ad-hod bonus. In case a Government servant is on leave on 31-03-2020 the emoluments last drawn immediately before proceeding on leave shall be taken into account for the purpose of eligibility and calculation of ad-hoc bonus.</p>



<p>(b) The subsistence allowance given to an employee under suspension shall not be treated as emoluments. Such an employee will become eligible for the benefit of ad-hoc bonus if he is re-instated with benefit of full emoluments for the period of suspension and in other cases such period will be excluded for the purpose of eligibility as in the case of employees on leave without pay. In case a Government servant is under suspension on 31-03-2020 no ad-hoc bonus for the year 2019-20 shall be given for the present. If he is reinstated later on, eligibility of the period under suspension for the purpose of ad-hoc bonus shall be decided on the lines indicated above.</p>



<p>(c) The employees who retired on superannuation or on invalidation on medical grounds or on voluntary retirement or died on or before 31st March 2020 will not be eligible for ad-hoc bonus.</p>



<p>(d) The eligibility of the re-employed Government servants for the purpose of ad-hoc bonus shall be determined on the basis of service rendered during the year 2019-20 after re-employment. The basic pay in respect of such persons shall mean basic pay fixed on re-employment or as increased thereafter and admissible on 31-03-2020 plus pension (including commuted part, if any).</p>



<p>(e) Employees who resigned from service on or before 31-03-2020 shall not be eligible for ad-hoc bonus under these orders.</p>



<p>(f) Employees engaged on part time / casual or on a daily wage or on contract basis will not be eligible for ad-hoc bonus.</p>



<p>(g) Employees appointed as probationer trainee shall not be eligible for ad-hoc bonus.</p>



<p>(h) (1) Government servants who were on deputation on 31-03-2020 if have opted for deputation allowance in terms of this department order No. F.1(47)FD(Gr.2)/ 82 dated 27th June, 1989, as amended from time to time and are eligible for ad-hoc bonus under this order, shall be paid, the admissible amount of ad-hoc bonus by the borrowing organization. The eligibility period shall include the continuous service rendered under the Government as also the period spent on deputation upto 31st March 2020. Similarly, Government servants who returned from deputation during the year 2019-20 shall be paid ad-hoc bonus by the Government which may be calculated on the basis of eligible and continuous service rendered under the borrowing organization and the Government.</p>



<p>(2) In the case of Government servants who were on deputation to Public Sector Undertakings, Cooperative Societies, Autonomous Bodies etc. and who have opted for deputation allowance in terms of this department order No.F.1(47)FD(Gr.2)/82 dated 27th June, 1989, as amended from time to time and are eligible for ad-hoc bonus under this order, out of the amount of bonus paid under the Payment of Bonus Act, 1965 by the aforesaid organization the amount equal to the amount of ad-hoc bonus admissible under this order shall be retained by the Government servants and the residual amount shall be deposited in the Government account.</p>



<p>(3) Government servants on deputation who have opted for bonus and / or ex-gratia payable to the employees of the borrowing organization in terms of this department order referred to above will be entitled to ad-hoc bonus equal to an amount by which, the bonus and / or ex¬gratia admissible as per order of the borrowing organization falls short of the total of (a) the deputation allowance which would have been admissible and (b) the ad-hoc bonus admissible under this order.</p>



<p>(4) In the case of Government servants belonging to the Cooperative Department and on deputation to Cooperative Institutions registered under the Rajasthan Cooperative Societies Act, 1965 whose terms of deputation are governed by the Cooperative Department Order No. F. 18 (75) Coop. /76 dated 13.07.1976 as amended from time to time, ad-hoc bonus, equal to an amount by which the bonus/ex-gratia paid/payable as per terms of deputation falls short of the total of (a) 1.5% of basic pay in Rajasthan Civil Services (Revised Pay) Rules, 2017 or 2.5% of Basic Pay in Rajasthan Civil Services (Revised Pay) Rules, 2008 subject to Rs.600/- per month drawn during the year 2018-19 and (b) the amount of ad-hoc bonus admissible under this order shall be payable by such borrowing Cooperative Institution.</p>



<p>(i) In cases where it is in the notice of Head of Office that the Government servant eligible for ad-hoc bonus on 31-03-2020 will definitely become ineligible for grant of ad-hoc bonus due to retrospective grant of pay in Pay Level in the Pay Matrix L-13 in Rajasthan Civil Services (Revised Pay) Rules, 2017 or Grade Pay of Rs, 5400/- in Rajasthan Civil Services (Revised Pay) Rules, 2008 and above or promotion in State Services, only pro-rata ad-hoc bonus be permitted provided that the eligibility period is six months or more.</p>



<p>(j) The payment of ad-hoc bonus, except to those Government servants who were on deputation on 31-03-2020, under these orders shall be made by the office in which an employee is posted on the date of issue of this order and it will be chargeable to the Budget Head to which the pay and allowances of the employees are charged. The payment of ad-hoc bonus to those Government servants who were sent on deputation after 31-03-2020, but before issuing of this order, shall be made by the office where the employee was posted as on 31-03-2020.</p>

<p>(k) This order shall also be applicable to the employees of the Zila Parishads &amp; Panchayat Samities and the Work-Charged employees who are drawing pay in the pay scales prescribed for them.</p>



<p>(l) In the case of those PSUs / Boards / Corporations to which the payment of bonus under Bonus Act, 1965 is not applicable but who have been paying ad-hoc bonus / ex-gratia in the past as per orders issued by the State Government, ad-hoc bonus I ex-gratia may be paid at rates not exceeding the rate at which ad-hoc bonus is payable under the orders issued by the State Government for payment of non-productivity linked ad-hoc bonus to its employee. In such case ad-hoc bonus / ex-gratia shall be payable strictly in accordance with the principle on which ad-hoc bonus / ex-gratia is paid by the State Government. Therefore, 25% of the ad-hoc bonus / ex-gratia shall be paid in cash and 75% of the ad-hoc bonus / ex-gratia shall be credited in a Scheme being put in place on lines of General Provident Fund. The procedure for operation of this Scheme will be prescribed in due course of time. Meanwhile amount of 25% of ad-hoc bonus which is to be paid in cash can be drawn by DDO for the employees. State Enterprises Department i.e. BPE will issue necessary orders on the lines of orders as applicable to State Government employees and deduction from ad-hoc bonus / ex-gratia will be deposited in the Scheme to be issued in due course. State Enterprises Department will ensure that ad-hoc bonus / ex-gratia will be granted only for the employees of PSUs / Boards I Corporations which are financially in a position to pay the ad-hoc bonus / ex-gratia. For this purpose no grant will be issued by the State Government. Any deviation / exception .to the above would be treated as violation of provisions of RAPSAR Act, 1999.</p>

<p>Sir/ Madam,</p>



<p>The Central Government has conveyed its approval to the existing Productivity Linked Bonus Scheme for the year 2019-2020 for the employees of <strong>EPFO </strong>vide letter No A- 26022/1/94 -SS-1 (Pt) dated 22nd October, 2020.</p>



<p>2. Accordingly, the competent authority is pleased to convey the approval for payment of the Productivity Linked Bonus for the year 2019-2020 for <strong>60 (Sixty) days</strong> in all the offices of EPFO. The bonus of 60 days has been assessed on the basis of data/ information submitted by the Zonal Offices in compliance to Head Office letter dated 07.10.2020. The payment of bonus is to be released to all Group ‘C’ and Group ‘B’ (Non-Gazetted) employees of EPFO.</p>

<h2 class="has-text-align-center wp-block-heading">FAQ regarding regulation of Ad-hoc/ Non-PLB Bonus</h2>



<ol class="wp-block-list"><li><strong>Employees appointed on purely temporary ad-hoc basis?</strong><br />Yes, if there is no break in service</li><li><strong>Employees who resigned, retired from service or expired before 31st March, 2020?</strong><br />As a special case only those persons who superannuated or retired on invalidation on medical grounds or died before 31st March, 2020 but after completing at least six months regular service during the year will be eligible for the ad-hoc bonus on pro rata basis in terms of nearest number of months of service.</li><li><strong>Employees on deputation/ foreign service terms to state governments, U.T. Governments, Public Sector Undertakings, etc., on 31st March, 2020?</strong><br />Such employees are not eligible for the ad-hoc bonus to be paid by the lending departments. In such cases the liability to pay ad-hoc bonus lies with the borrowing organization depending upon the ad-hoc bonus/ PLB/ ex-gratia/ incentive payment scheme, if any, in force in the borrowing organization.</li><li><strong>Employees who reverted during accounting year from deputation on foreign service with the organizations indicated in ‘C’ above?</strong><br />The total amount of bonus/ex-gratia received for the accounting year from foreign employer and the ad-hoc bonus, if any, due from a central government office for the period after reversion will be restricted to the amount due under ad-hoc bonus as per these orders.</li><li><strong>Employees from state Government/U.T. Admn./ Public Sector Undertakings on reverse deputation with the Central Government?</strong><br />Yes, they are eligible for ad-hoc bonus to be paid by the borrowing departments in terms of these orders provided no additional incentive as part of terms of deputation, other than Deputation Allowance, is paid and the lending authorities have no objection.</li><li><strong>Superannuated employees who were re-employed?</strong><br />Re-employment being fresh employment, eligibility period is to be worked out separately for re-employment period; the total amount admissible, if any, for prior to superannuation and that for re¬employment period being restricted to the maximum admissible under ad-hoc bonus under these orders.</li><li><strong>Employees on half-Pay leave/ E.O.L./ Leave not due/study leave at any time during the accounting year?</strong><br />Except in the case of leave without pay the period of leave of other kinds will be included for the purpose of working out eligibility period. The period of E.O.L./ dies non will be excluded from eligibility period but will not count as break in service for the purpose of ad-hoc bonus.</li><li><strong>Contract employees?</strong><br />Yes, if the employees are eligible for benefits like dearness allowance and interim relief. Categories not eligible for these benefits would be considered at par with casual labor in terms of ad-hoc bonus orders.</li><li><strong>Employees under suspension at any time during the accounting year?</strong><br />Subsistence allowance given to an employee under suspension for a period in the accounting year cannot be treated as emoluments. Such an employee becomes eligible for the benefit of ad-hoc bonus if and when reinstated with benefit of emoluments for the period of suspension, and in other cases such period will be excluded for the purpose of eligibility as in the case of employees on leave without pay.</li><li><strong>Employees transferred from one Ministry/ Department/ Office covered by ad-hoc bonus orders to another within the Government of India or a Union Territory Government covered by ad-hoc bonus orders and vice versa?</strong><br />Employees who are transferred from any of the Ministry/ Department/ Office covered by ad-hoc bonus orders to another such office without break in service will be eligible on the basis of combined period of service in the different organizations. Those who are nominated on the basis of a limited departmental or open competitive exam from one organization to a different organization will also be eligible for the ad-hoc bonus. The payment will be made only by the organization where he was employed as on 31st March, 2020 and no adjustments with the previous employer will be necessary.</li><li><strong>Employees who are transferred from a Government Department /Organization covered by ad-hoc bonus orders to a Government Department/ Organisation covered by productivity &#8211; Linked Bonus scheme or vice versa?</strong><br />They may be paid what would have been paid on the basis of emoluments in ad-hoc bonus covered department for the entire year less the amount due as productivity-linked bonus. The amount so calculated may be paid by Department where he was working on 31st March, 2020 and/or at the time of payment.</li><li><strong>Part-time employees engaged on nominal fixed payment?</strong><br />Not eligible.</li><li><strong>Those who have put in specified number of days of work in different offices during each of the three years ending with the said accounting year?</strong><br />The eligibility is to be worked out for three years from the said accounting year backwards. The period of 240 days of work in each of these years may be arrived at by combining the number of days worked in more than one offices of the government of India, for which bonus, ex-gratia or incentive payment has not been earned and received.</li><li><strong>Casual labour who were not in work on 31st March, 2020?</strong><br />The condition of being in employment on 31st March, 2020 as laid down in these orders is applicable to regular Government Employees and not to casual labour.</li><li><strong>Those who have put in at least specified number of days of work in each of two years preceding the accounting year but are short of this limit due to regularization in employment in the said accounting year?</strong><br />If a casual labour, who has been regularized in the accounting year does not fulfill the minimum continuous service of six months as on 31st March, 2020 and therefore, cannot be granted benefit as a regular employee, he may be allowed the benefit as for a casual labour provided the period of regular service in the said year if added to the period of work as casual labour works out to at least specified number of days in that accounting year.</li></ol>

<p><strong>Subject: Grant of Non-Productivity Linked Bonus (ad-hoc bonus) to Central Government Employees for the year 2019-20</strong></p>



<p>The undersigned is directed to convey the sanction of the President to the grant of Non-Productivity Linked Bonus (Ad-hoc Bonus) equivalent to <strong>30 days</strong> emoluments for the accounting year 2019-20 to the Central Government employees in Group ‘C’ and all non-gazetted employees in Group ‘B’, who are not covered by any Productivity Linked Bonus Scheme. The calculation ceiling for payment of ad-hoc <strong><a href="https://centralgovernmentnews.com/category/bonus/" target="_blank" rel="noreferrer noopener">Bonus</a></strong> under these orders shall be monthly emoluments of Rs.7000/-, as revised w.e.f 01/04/2014 vide OM No.7/4/2014-E.III(A), dated 29th August, 2016. The payment of ad-hoc Bonus under these orders will also be admissible to the eligible employees of Central Para Military Forces and Armed Forces. The orders will be deemed to be extended to the employees of Union Territory Administration which follow the Central Government pattern of emoluments and are not covered by any other bonus or ex-gratia scheme.</p>



<p>2. The benefit will be admissible subject to the following terms and conditions:-</p>

<ul class="wp-block-list"><li>Only those employees who were in service as on 31.3.2020 and have rendered at least six months of continuous service during the year 2019-20 will be eligible for payment under these orders. Pro-rata payment will be admissible to the eligible employees for period of continuous service during the year from six months to a full year, the eligibility period being taken in terms of number of months of service (rounded off to the nearest number of months);</li><li>The quantum of Non-PLB (ad-hoc bonus) will be worked out on the basis of average emoluments/calculation ceiling whichever is lower. To calculate Non-PLB (Ad-hoc bonus) for one day, the average emoluments in a year will be divided by 30.4 (average number of days in a month). This will, thereafter, be multiplied by the number of days of bonus granted. To illustrate, taking the calculation ceiling of monthly emoluments of Rs. 7000 (where actual average emoluments exceed. Rs.7000), Non-PLB (Ad-hoc Bonus) for thirty days would work out to Rs. 7000×30/30.4=Rs.6907.89 (rounded off to Rs.6908/-).</li><li>The casual labour who have worked in offices following a 6 days week for at least 240 days for each year for 3 years or more (206 days in each year for 3 years or more in the case of offices observing 5 day week), will be eligible for this Non-PLB (Ad-hoc Bonus) Payment. The amount of Non-PLB (ad-hoc bonus) payable will be (Rs.1200×30/30.4 i.e.Rs.1184.21 (rounded off to Rs.1184/-). In cases where the actual emoluments fall below Rs.1200/- p.m., the amount will be calculated on actual monthly emoluments.</li><li>All payments under these orders will be rounded off to the nearest rupee.</li><li>Various points regarding regulation of Ad-hoc/Non-PLB Bonus are given in the Annexure.</li></ul>



<p>3. The expenditure on this account will be debitable to the respective Heads to which the pay and allowances of these employees are debited.</p>



<p>4. The expenditure to be incurred on account of Non-PLB (Ad-hoc Bonus) is to be met from within the sanctioned budget provision of concerned Ministries/ Departments for the current year.</p>
