<p><strong>Diwali Bonus for Tamil Nadu State Government Employees 2019</strong></p>



<p><strong>Diwali Bonus for Tamil Nadu State Government (PSU) Public Sector Undertakings Employees 2019</strong></p>



<p>By a press release dated 15 October 2019 the State Government of Tamil Nadu has confirmed the 2018-19 Diwali Bonus.</p>



<p>The bonus pay limit is Rs. 21000, according to the press release. The monthly incentive estimate salary limit is Rs. 7000. The maximum amount of Rs 16800 and Rs 8400 is the minimum salaries for workers in the public sector.</p>



<p>All qualifying PSU employees receive a 20 percent bonus and other PSU employees also receive a bonus of 10 percent. TNEB and TNSTC worker and Staff will receive a bonus of 8.33% with an ex gratia of 11.67%, a maximum bonus of 20% for 2018-19.</p>

<p><strong>Bonus for Central Para Military Forces and Armed Forces &#8211; 7th Pay Commission Latest News 2019</strong></p>



<p><strong><a href="https://centralgovernmentnews.com/category/7cpc/" target="_blank" rel="noreferrer noopener" aria-label="7th Pay Commission Latest News 2019 (opens in a new tab)">7th Pay Commission Latest News 2019</a></strong> &#8211; In the lead of great festival season the Centre has declared ad hoc bonus to Central Para Military Forces and Armed Forces as per the recommendations of 7th Pay Commission.</p>



<p>In the lead of great festival season the Centre has declared Non Productivity Linked Bonus (ad hoc bonus) to all eligible Central Para Military Forces and Armed Forces and Non Gazetted Central Government Employees as per the recommendations of 7th Pay Commission.</p>



<p><strong>Bonus for Central Para Military Forces and Armed Forces</strong></p>

<p>The payment of ad-hoc Bonus under these orders will also be admissible to the eligible employees of Central Para Military Forces and Armed Forces. The orders will be deemed to be extended to the employees of Union Territory Administration which follow the Central Government pattern of emoluments and are not covered by any other bonus or ex-gratia scheme.</p>



<p><strong>Bonus for Non Gazetted Central Employees</strong></p>



<p>According to the notification, Non Productivity Linked Bonus (ad hoc bonus) equivalent to 30 days emoluments for the accounting year 2018-19 to all eligible Central Government employees in Group &#8216;C&#8217; and all Group &#8216;B&#8217; Non Gazetted Central Government Employees who are not covered by any Productivity Linked Bonus monthly emoluments of Rs. 7000 as revised with effect from 1st April 2014.</p>

<p>Productivity Linked Bonus amounting to 78 days wages for over 11.5 lakh non-gazetted Railway employees (excluding RPF/ RPSF personnel) approved Expenditure of over 2 thousand crores for FY 2018-19 Acknowledgement of employees contribution to efficient Railway operations Aimed at maintaining high levels of motivation among railway personnel</p>

<p><strong>Calculation of Ad hoc Bonus</strong></p>



<p>Example calculation for 30 days</p>



<p>Rs. 7000 × 30 / 30.4 = Rs.6907.89 (Rounded off to Rs.6908)</p>



<p>While calculating Non-PLB (Ad-hoc bonus) for one day, the average emoluments in a month will be divided by 30.4 (average number of days in a month).</p>

<p><strong><em>7th Pay Commission Bonus Latest News 2019 and Eligibility for Bonus for Central Government Employees</em></strong></p>



<p><strong>Clarification No.1</strong></p>



<p>Point: <strong>Whether the employees in the following categories are eligible for the benefit of ad-hoc bonus for an accounting year</strong></p>



<p><em>Clarification</em>: Subject to completion of minimum six months continuous service and being in service as on 31st March, 2019.</p>

<p><strong>Clarification No.2</strong></p>



<p>Point: <strong>Employees appointed on purely temporary ad-hoc basis.</strong></p>



<p>Clarification: <em>Yes, if there is no break in service.</em></p>



<p><strong>Clarification No.3:</strong></p>



<p>Point: <strong>Employees who resigned, retired from service or expired before 31st March, 2019.</strong></p>



<p>Clarification: <em>As a special case only those persons who superannuated or retired on invalidation on medical grounds or died before 31st March, 2019 but after completing at least six months regular service during the year will be eligible for the ad-hoc bonus on pro rata basis in terms of nearest number of months of service.</em></p>



<p><strong>Clarification No.4</strong></p>



<p>Point: <strong>Employees on deputation/foreign service terms to state governments, U.T.Governments, Public Sector Undertakings, etc., on 31st March, 2019.</strong></p>



<p>Clarification:<em> Such employees are not eligible for the ad-hoc bonus to be paid by the lending departments. In such cases the liability to pay ad-hoc bonus lies with the borrowing organization depending upon the ad-hoc bonus/PLB/ex-gratia / incentive payment scheme, if any, in force in the borrowing organization.</em></p>



<p><strong>Clarification No.5</strong></p>



<p>Point: <strong>Employees who reverted during accounting year from deputation on foreign service with the organizations indicated in &#8216;C&#8217; above.</strong></p>



<p>Clarification: <em>The total amount of bonus ex-gratia received for the accounting year from foreign employer and the ad-hoc bonus, if any, due from a central government office for the period after reversion will be restricted to the amount due under ad-hoc bonus as per these orders.</em></p>

<p><strong>Clarification No.6</strong></p>



<p>Point: <strong>Employees from state Government / U.T. Admn. / Public Sector Undertakings on reverse deputation with the Central Government.</strong></p>



<p>Clarification: <em>Yes, they are eligible for ad-hoc bonus to be paid by the borrowing departments in terms of these orders provided no additional incentive as part of terms of deputation, other than Deputation Allowance, is paid and the lending authorities have no objection.</em></p>



<p><strong>Clarification No.7</strong></p>



<p>Point: <strong>Superannuated employees who were re-employed.</strong></p>



<p>Clarification: <em>Re-employment being fresh employment eligibility period is to be worked out separately for re-employment period; the total amount admissible, if any. for prior to superannuation and that for re-employment period being restricted to the maximum admissible under ad-hoc bonus under these orders.</em></p>



<p><strong>Clarification No.8</strong></p>



<p>Point: <strong>Employees on half-Pay leave / E.O.L / Leave not due/study leave at any time during the accounting year.</strong></p>



<p>Clarification: <em>Except in the case of leave without pay the period of leave of other kinds will be included for the purpose of working out eligibility period. The period of E.O.L. / dies non will be excluded from eligibility period but will not count as break in service for the purpose of ad-hoc bonus.</em></p>



<p><strong>Clarification No.9</strong></p>



<p>Point: <strong>Contract employees.</strong></p>



<p>Clarification: <em>Yes. if the employees are eligible for benefits like dearness allowance and interim relief. Categories not eligible for these benefits would be considered at par with casual labor in terms of ad-hoc bonus orders.</em></p>



<p><strong>Clarification No.10</strong></p>



<p>Point: <strong>Employees under suspension at any time during the accounting year.</strong></p>



<p>Clarification: <em>Subsistence allowance given to an employee under suspension for a period in the accounting year cannot be treated as emoluments, Such an employee becomes eligible for the benefit of ad-hoc bonus if and when reinstated with benefit of emoluments for the period of suspension, and in other cases such period will be excluded for the purpose of eligibility as in the case of employees on leave without pay.</em></p>



<p><strong>Clarification No.11</strong></p>



<p>Point: <strong>Employees transferred from one Ministry./Department/Office covered by ad-hoc bonus orders to another within the Government of India or a Union Territory Government covered by ad-hoc bonus orders and vice versa.</strong></p>



<p>Clarification: <em>Employees who are transferred from any of the Ministry/ Department/ Office covered by ad-hoc bonus orders to another such office without break in service will be eligible on the basis of combined period of service in the different organizations. Those who are nominated on the basis of a limited departmental or open competitive exam from one organization to a different organization will also be eligible for the ad-hoc bonus. The payment will be made only by the organization where he was employed as on 31st March, 2019 and no adjustments with the previous employer will be necessary.</em></p>



<p><strong>Clarification No.12</strong></p>



<p>Point: <strong>Employees who are transferred from a Government Department/ Organization covered by ad-hoc bonus orders to a Government Department/Organisation covered by productivity &#8211; Linked Bonus scheme or vice versa.</strong></p>



<p>Clarification: <em>They may be paid what would have been paid on the basis of emoluments in ad-hoc bonus covered department for the entire year less the amount due as productivity-linked bonus. The amount so calculated may be paid by Department where he was working on 31s’ March, 2019 and/or at the time of payment.</em></p>



<p><strong>Clarification No.13</strong></p>



<p>Point: <strong>Part-time employees engaged on nominal fixed payment</strong></p>



<p>Clarification: <em>Not eligible.</em></p>



<p><strong>Clarification No.14</strong></p>



<p>Point: <strong>Whether ad-hoc bonus is payable to casual labour for an accounting year in the following cases:-</strong></p>



<p>(a) <strong>Those who have put in specified number of days of work in different offices during each of the three years ending with the said accounting year.</strong></p>



<p>Clarification: <em>The eligibility is to be worked out for three years from the said accounting year backwards. The period of 240 days of work in each of these years may be arrived at by combining the number of days worked in more than one offices of the government of India, for which bonus. ex-gratia or incentive payment has not been earned and received.</em></p>



<p>(b) <strong>Casual labour who were not in work on 31st March, 2019 .</strong></p>



<p>Clarification: <em>The condition of being in on 31st March, 2019 employment as laid down in these orders is applicable to regular Government Employees and not to casual labour.</em></p>



<p>(c) <strong>Those who have put in at least specified number of days of work in each of two years preceding the accounting year but are short of this limit due to regularization in employment in the said accounting year.</strong></p>



<p>Clarification: <em>If a casual labour, who has been regularized in the accounting year does not fulfill the minimum continuous service of six months as on 31st March, 2018 and therefore, cannot be granted benefit as a regular employee, he may be allowed the benefit as for a casual labour provided the period of regular service in the said year if added to the period of work as casual labour works out to at least specified number of days in that accounting year.</em></p>

<p>Calculation ceiling for payment of ad-hoc Bonus shall be monthly emoluments of Rs.7000 for Central Government employees.</p>



<p>Non-PLB (Ad-hoc Bonus) for thirty days would work out to Rs. 7000 × 30 / 30.4 = Rs.6907.89 (rounded off to Rs.6908/-).</p>

<p>Casual labour who have worked in offices following a 6 day week for at least 240 days for each year for 3 years or more (206 days in each year for 3 years or more in the case of offices observing 5 day week), will be eligible for this Non-PLB (Ad-hoc Bonus) Payment.</p>



<p>The amount of Non-PLB (ad-hoc bonus) payable will be (Rs.1200×30/30.4 i.e.Rs.1184.21 (rounded off to Rs.1184/-).</p>

										<content:encoded><![CDATA[<p><b>Grant of of ad-hoc bonus for RPF/RPSF Personnel for the financial year 2015-16</b></p>
<blockquote class="tr_bq"><p><i><b>Grant of ad-hoc bonus for 30 days to Group ‘C’ &amp; ‘D’ RPF/RPSF Personnel for the financial year 2015-16. The calculation ceiling has been enhanced to Rs.7000 with effect from 1.4.2016.</b></i></p></blockquote>
<p>The benefit will be admissible subject to the following and conditions:- Only those Group C &amp; D RPF/RPSF personnel who were in service on 31.3.2011 and have rendered at least six months of continuous service during the year 2015-2016 will be eligible for payment under these orders. Pro-rata payment will be admissible to the eligible personnel for period of continuous service during the year ranging from six months to a full year, the eligibility period being taken in terms of number of months of service (rounded to the nearest number of months).</p>
<p>The quantum of ad-hoc bonus will be worked out on the basis of average emoluments/calculation ceiling whichever is lower. To calculate ad-hoc bonus for one day, the average emoluments in a year will be divided by 30.4 (average number of days in a month). This will there after be multiplied by the number of days of bonus granted. To illustrate, taking the calculation ceiling of Rs.7000/- (where actual average emoluments exceed 7000), ad-hoc bonus for thirty days would work out to 7000&#215;30/30.4 = Rs.6907.89 (rounded off to Rs.6908/-).</p>
<p>All payments under these orders will be rounded off to the nearest rupee.</p>
<p>In the matter where the aforesaid provisions are silent, clarificatory orders issued vide this Ministry’s letter No.E(P&amp;A)II-88/Bonus-3 dated 29.12.1988, as amended from time totime, would hold good.</p>
<p>All the Group C &amp; D RPF/RPSF personnel. regardless of whether they are in uniform or out of uniform and regardless of place of their posting, shall be eligible only for ad-hoc bonus in terms of these orders.</p>

<div>We invite your kind reference to the above cited letter granting Non PLB to Central Govt employees &amp; casual/ contingent workers. Similar orders have also been issued for the personnel in Railways, Defence and Postal Establishments etc where PLB is applicable.</div>

<div>While in the cam of regular employees &#8211; both PLB &amp; Non PLB &#8211; the calculation ceiling for payment of Bonus was raised to Rs 7000/- for the years 2014/15 &amp; 2015.16. In the case of Casual Labourers and casual labourers with temporary status, the said ceiling continues to be pegged down at Rs 1,200/-. It may kindly be noted that the said ceiling of Rs 1,200/- in the case of Casual Workers end casual workers with temporary status was determined in the yew 1999 when the ceiling for regular employees was Rs 2500/-</div>

<div>In the case of regular employees the said ceiling was raised to Rs 3.500/- in the year 2006 and again to Rs 7,000/- in 2016 (retrospectively from 2014-15) whereas for casual workers and Casual workers with temporary status it remained at Rs 1.200/- all along slaw 1999-2000. The emoluments of Casual Workers and Casual workers with temporary status is now proportionate to the wages of regular employees.</div>

<div>We request you to kindly get the matter examined and explore the possibilities of raising the ceiling limit to Rs 7000/- for casual workers and casual workers with temporary status on par with the regular employees.</div>

<p>Subject: <strong>Grant of Non-Productivity Linked Bonus (ad-hoc bonus) to Central Government Employees for the year 2015-16.</strong></p>
<p>The undersigned is directed to convey the sanction of the President to the grant of Non-Productivity Linked Bonus (Ad-hoc Bonus) equivalent to 30 days emoluments for the accounting year 2015-16 to the Central Government employees in Groups &#8216;C&#8217; and &#8216;D&#8217; and all non-gazetted employees in Group &#8216;B&#8217;, who are not covered by any Productivity Linked Bonus Scheme. The calculation ceiling for payment of ad-hoc Bonus under these orders shall be monthly emoluments of Rs. 7000/-, as revised w.e.f 01/04/2014 vide OM No.7/4/2014-E.III(A), dated 29th August, 2016. The payment of ad-hoc Bonus under these orders will also be admissible to the eligible employees of Central Para Military Forces and Armed Forces. The orders will be deemed to be extended to the employees of Union Territory Administration which follow the Central Government pattern of emoluments and are not covered by any other bonus or ex-gratia scheme.</p>
<p>2. The benefit will be admissible subject to the following terms and conditions:-</p>

To calculate NonPLB (Ad-hoc bonus) for one day, the average emoluments in a year will be divided by 30.4 (average number of days in a month). This will, thereafter, be multiplied by the number of days of bonus granted. To illustrate, taking the calculation ceiling of monthly emoluments of Rs. 7000 (where actual average  emoluments exceed Rs. 7000), Non-PLB (Ad-hoc Bonus) for thirty days would work out to Rs. 7000×30/30.4=Rs.6907.89 (rounded off to Rs.6908/-).</p>
<p>(iii) The casual labour who have worked in offices following a 6 days week for at least 240 days for each year for 3 years or more (206 days in each year for 3 years or more in the case of offices observing 5 day week), will be eligible for this Non-PLB (Ad-hoc Bonus) Payment. The amount of Non-PLB (ad-hoc bonus) payable will be (Rs.1200×30/30.4 i.e.Rs.1184.21 (rounded off to Rs.1184/-). In cases where the actual emoluments fall below RS.1200/- p.m., the amount will be calculated on actual monthly emoluments.</p>
<p>(iv) All payments under these orders will be rounded off to the nearest rupee.</p>
<p>(v) The clarificatory orders issued vide this Ministry’s OM No.F.14 (10)-E.Coord/88 dated 4.10.1988, as amended from time to time, would hold good.</p>
<p>3. The expenditure on this account will be debilable to the respective Heads to which the pay and allowances of these employees are debited.</p>
<p>4. The expenditure to be incurred on account of Non-PLB (Ad-hoc Bonus) is to be met from within the sanctioned budget provision of concerned Ministries/Departments for the current year.</p>
<p>5. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders are issued in consultation with the Comptroller and Auditor General of India.</p>

<p><em><strong>A minimum wage is the lowest remuneration that employers may legally pay to workers or it is the price floor below which workers may not sell their labour.</strong></em></p>
<p>The concept of minimum wages first evolved with reference to remuneration of workers in those industries where the level of wages was substantially low as compared to the wages for similar types of labour in other industries. As far back as 1928, the International Labour Conference of International Labour Organization, at Geneva, adopted a draft convention on minimum wages requiring the member countries to create and maintain a machinery whereby minimum rates of wages can be fixed for workers employed in industries in which no arrangements exist for the effective regulation of wages and where wages are exceptionally low. Also, at the Preparatory Asian Regional Labour Conference of International Labour Organisation held at New Delhi in 1947 and then at the 3rd session of the Asian Regional Labour Conference, it was approved that every effort should be made to improve wage standards in industries and occupations in Asian Countries, where they are still low. Thus, the need of a legislation for fixation of minimum wages in India received an impetus after World War II, on account of the necessity of protecting the interest of demobilized personnel seeking employment in industries.</p>
<p>The justification for statutory fixation of minimum wage is obvious. Such provisions which exist in more advanced countries are even necessary in India, where workers organizations are yet poorly developed and the workers bargaining power is consequently poor.</p>
<p>To provide for machinery for fixing and revision of minimum wages a draft Bill was prepared and discussed at the 7th session of the Indian Labour Conference in November, 1945. Thereupon the Minimum Wages Bill was introduced in the Central Legislative Assembly. The Minimum Wages Bill having been passed by the Legislature received the assent on 15th March, 1948. It came on the Statute Book as the Minimum Wages Act, 1948.</p>
<p>The Act provides for fixation by the appropriate Governments of minimum wages for employments covered by Schedule to the Act. The Central Government is the appropriate Government in respect of 45 scheduled employments in the Central Sphere. The minimum wages fixed for Central sphere are applicable to the scheduled employments in the establishments under the authority of Central Government, railway administrations, mines, oil-fields, major ports or any corporation established by a Central Act. Employments other than the scheduled employment for Central Sphere come under the purview of the State Government and accordingly State Government wages are applicable in such employments. The minimum wages for Central Sphere are revised from time to time based on the increase in Consumer Price Index effective from April and October.</p>
<p>According to Section 3(1)(b) of the Minimum Wages Act, 1948, the appropriate government shall review at such intervals, as it may think fit, such intervals not exceeding five years, the minimum rates of wages so fixed and revise the minimum rates if necessary.</p>
<p>The norms recommended by the Indian Labour Conference, in 1957, fox fixing the minimum wages are: (a) consumption units for one wage earner; (b) minimum food requirements of 2700 calories per average Indian adult; (c) clothing requirements of 72 yards per annum per family; (d) rent corresponding to the minimum area provided for under Government&#8217;s Industrial Housing Scheme; and (e) fuel, lighting and other miscellaneous items of expenditure to constitute 20% of the total minimum wage.</p>
<p>In 1991, the Hon&#8217;ble Supreme Court delivered a historic judgement and directed that children&#8217;s education, medical requirement, minimum recreation including festivals/ceremonies, provision for old age, marriage etc. should further constitute 25% of the minimum wage and be used as a guide in fixation of minimum wage.</p>
<p>The Act envisages appointment of an Advisory Board, by the appropriate Government, for the purpose of advising the appropriate Government in the matter of fixing and revising minimum rates of wages.</p>
<p>The Central Government revises the wages in the scheduled employments from time to time in accordance with the provisions of the Minimum Wages Act, 1948. Draft Notifications for all the Scheduled Employments in the Central Sphere were issued on 1st September, 2016 simultaneously, in fact for the first time. The basic rate of minimum wages for an unskilled worker in the scheduled employment other than agriculture has been proposed at Rs.350 in Area &#8216;C&#8217; from the current minimum wage (basic wage + variable dearness allowance) of Rs.246 resulting in an increase of about 42%. The basic rate of minimum wages for an unskilled worker in the scheduled employment &#8216;agriculture&#8217; has been proposed at Rs.300 in Area &#8216;C&#8217; from the current minimum wage (basic wage + variable dearness allowance) of Rs.211 resulting in an increase of about 42%.</p>
<p>The proposed revision in the rates of basic minimum wages would indeed provide much needed solace to the labour fraternity.</p>
<p><span style="color: #ff0000;"><strong>Bonus</strong></span></p>
<p>Bonus payment is an extra payment given for doing one&#8217;s job well also known as performance related pay or pay for performance.</p>
<p>The practice of paying bonus in India appears to have originated during First World War when certain textile mills granted 10% of wages as war bonus to their workers in 1917. In certain cases of industrial disputes demand for payment of bonus was also included. In 1950, the Full Bench of the Labour Appellate Tribunal evolved a formula for determination of bonus. A plea was made to raise that formula in 1959. At the second and third meetings of the eighteenth Session of Standing Labour Committee (G.O.I) held in New Delhi in March/ April 1960, it was agreed that a Commission be appointed to go into the question of bonus and evolve suitable norms. A Tripartite Commission was set up by the Government of India to consider in a comprehensive manner, the question of payment of bonus based on profits to employees employed in establishments and to make recommendations to the Government. The Government of India accepted the recommendations of the Commission subject to certain modifications. To implement these recommendations the Payment of Bonus Act, 1965 was enacted, which came into force on 25.9.1965.</p>
<p>The objective of the Payment of Bonus Act, 1965 is to provide for the payment of bonus to the persons employed in certain establishments on the basis of profits or on the basis of production or productivity and for matter connected therewith.</p>
<p>It applies to (i) Every Factory; and (ii) Every other establishment in which 20 or more persons are employed on any day during an accounting year subject to the exemptions under section 32. Every employee shall be entitled to be paid by his employer in an accounting year, bonus, in accordance with the provisions of this Act, provided he has worked in the establishment for not less than thirty working days in that year. While the minimum bonus is 8.33% of the salary or wage earned by the employee during the accounting year, the maximum bonus is 20% of such salary or wage.</p>
<p>Two ceilings are available under the said Act generally known as eligibility limit and calculation ceiling respectively. Clause 13 of Section 2 of Payment of Bonus Act, 1965 defines an employee based on salary or wage per mensem. This is usually taken as the &#8216;<strong>eligibility limit</strong>&#8216; for computation of bonus. Similarly, Section 12 of the Payment of Bonus Act, 1965 provides for calculation of bonus of an employee based on salary or wage per mensem. This is known as &#8216;<strong>calculation ceiling</strong>&#8216;.</p>
<p>The two ceilings are revised from time to time to keep pace with the price rise and increase in the salary structure. At present, the calculation ceiling has been enhanced to Rs.7000 or the minimum wage for the scheduled employment, as fixed by the appropriate Government, whichever is higher and the eligibility limit has been enhanced to Rs.21,000/-.</p>
<p>Due to this revision, additional 55 lakh workers would be benefited. This would indeed, be a good gesture on the part of the Government towards the labour fraternity.</p>
