<p>The undersigned is directed to refer to this Department s OM of even number dated the 3.1.2022 on the above-mentioned subject and to state that the biometric attendance shall remain suspended till 15th February, 2022 or till further orders, whichever is earlier. It is reiterated that the employees shall mark their attendance in the Attendance Registers to be maintained manually. All the Heads of Departments shall also ensure that all employees wear masks, at all times, and continue to follow COVlD-appropriate behavior strictly.</p>

<p>The undersigned is directed to refer to this Department’s O.M. of even number dated 14.06.2021, whereby instructions regulating the attendance of Central Government employees with reduced staff, staggered timings and exemption to certain categories of employees from attending offices, which were in force up to 30.06.2021, were issued. It was also provided in the said OM dated 14.6.2021 that the biometric attendance would continue to remain suspended and physical attendance registers maintained until further orders.</p>



<p>2. The matter has since been reviewed and it has been decided to resume biometric attendance for all levels of employees, with effect from Monday the 8th November, 2021. It shall be the responsibility of Heads of Department to ensure that :-</p>



<ul class="wp-block-list"><li>(a) Sanitizers are mandatorily placed beside biometric machines and all employees sanitize their hands before and after marking of attendance.</li><li>(b) Physical distancing of six feet must be maintained by all employees while marking their attendance. If required, additional biometric attendance machines may be installed to avoid overcrowding;</li><li>(c) All employees shall be required to wear mask/face covers, at all times, including while waiting to mark their attendance;</li><li>(d) As far as possible, designated personnel should be deployed near bio-metric stations to clean/wipe the touchpad/scanner areas of biometric scanners frequently. Such personnel will also guide employees to maintain COVID appropriate behavior while in queue;</li><li>(e) As far as possible, adequate number of biometric stations should be placed in an outside/open air environment. If indoor, adequate natural ventilation must be maintained; and</li><li>(f) All offices shall undertake orientation of the employees on precautions to be followed.</li><li>(g) Meetings, as far as possible, shall continue to be conducted on video-conferencing and personal meetings with visitors, unless necessary in public interest, are to be avoided.</li><li>(h) All officers/staff shall strictly follow the COVID-appropriate behavior, at all times, in offices.</li></ul>

<p>Subject: <strong>Exemption to employees to mark biometric attendance in Aadhar Based Biometric Attendance System (AEBAS) &#8211; reg.</strong></p>



<p>Though only a small number of novel coronovirus (COVID-19) cases are reported in our country but keeping in view the nature of virus, it is a must to take all possible preventive measures to stop spread of virus.</p>

<p>It is learnt that most common method of transmission of virus seems to be through infected surfaces. Therefore, it is desirable to avoid touching surfaces, which might be infected due to human touch.</p>



<p>In view of the above, all the Ministries / Departments are requested to exempt their employees to mark biometric attendance in Aadhar Based Biometric Attendance System (<strong><a href="https://centralgovernmentnews.com/tag/aebas/" target="_blank" rel="noreferrer noopener" aria-label=" (opens in a new tab)">AEBAS</a></strong>) till 31st March, 2020. However, all the employees are required to mark their attendance in Attendance register, (as done prior to launch of biometric system), during this period.</p>

<p>Sub: <strong>Aadhaar enabled Biometric Attendance System for Railway Staff</strong></p>



<p>Aadhaar-enabled Biometric Attendance System (<strong>AEBAS</strong>) was introduced in the Railways vide Office Order No.08 of 2014 dated 01.12.2014 of the Railway Board.</p>



<p>In the year 2016, Ministry of Law and Justice got Aadhaar Act, 2016, enacted in the Parliament, which was notified on March 26, 2016. Aadhaar Act, 2016 clearly states that identity of an individual through Aadhaar can only be established in case of receipt of subsidy and other benefit of services which are being provided by the Government. Meanwhile Hon’ble Supreme Court in its landmark judgement on Aadhaar Act, 2016, delivered on 26th September, 2018, has categorically struck down Section 57 of Aadhaar Act, 2016, which says that, “Nothing in the Act shall prevent the use of Aadhaar for establishing the identity of an individual for any purpose whether by the state or anybody, corporate or person”. In view of the Aadhaar Act, 2016 and Hon’ble Supreme Court’s judgement, the following points are highlighted:-</p>



<ul class="wp-block-list"><li>AEBAS was introduced in the year 2014 in the Indian Railways and the system has not been revised after implementation of Aadhaar Act, 2016 and the judgement of Hon’ble Supreme Court thereafter in September 26, 2018.</li><li>Section 8(2) of the Aadhaar Act, 2016 made it mandatory to obtain the consent of an individual before collecting his identity information for the purposes of authentication. In this connection, it is to be pointed out that, getting consent of the employee for Biometric Attendance, as per Aadhaar Act, 2016, is totally against the Act, which says that, authentication, as per Aadhaar Act, 2016, is only for welfare scheme.</li><li>An additional step has been introduced in the Biometric Machines which seeks consent of the Railway Employees and demographic locations before Biometric Attendance is marked, making marking of attendance cumbersome and the employees are made to wait in long queues to mark their attendance on Biometric Machines.</li><li>Section 57 of the Aadhaar Act, 2016 says that, “Nothing contained in this Act shall prevent the use of Aadhaar number for establishing the identity of an individual for any purpose, whether by the State or anybody Corporate or Person, pursuant to any law for the time, being in force or any contract to this effect. As per Aadhaar Act, this is the only section where anybody, Corporate or Person can use Biometric for authentication, but Section 57 of the Aadhaar Act, 2016 has been declared void and unconstitutional by Hon’ble Supreme Court in its judgement in September 2018.</li><li>Since Biometric Machines belong to the Third Party, and having software developed and modified by the manufacturer and these machines are connected with the internet, thus make data vulnerable for misuse. Consent of the Railway Employees to use their Aadhaar Number and Biometrics on Third Party’s entity for attendance has put personal data (Biometric and Aadhar Number) of Railway Employees at severe risk in the hands of hackers, who can peep into various Aadhaar linker services of an individual, such as Bank Accounts, Income Tax details and other welfare services linked with the Aadhaar Card.</li></ul>



<p>“Classic example of leakage of Aadhaar linked data has been witnessed in the case of Shri R.S. Sharma (TRAI Chairman and Former Director General of UIDAI (Aadhaar) by the country, in whose case leakage of Aadhar Number made hackers to sneak into 14 services being used by him, that include his Bank Accounts, PAN details and other details, including his family members”.</p>

<p>Taking consent from the <a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener" aria-label="Railway Employees (opens in a new tab)">Railway Employees</a> before usage of Biometric and Aadhar Number, as per Aadhaar Act, 2016, virtually means that, Railways will not take any responsibility if Aadhar or Biometrics of the Railway Employees are misused or in case of fraudulent transaction happens with Aadhaar linked Bank Accounts.</p>



<p>It is evident that, use of Biometric Attendance System in the Railways, to authenticate an individual for attendance, as per Aadhaar Act, 2016, is totally unconstitutional and violates Aadhaar Act, 2016, against the judgement of Hon’ble Supreme Court and blatant attack on the privacy of the Railway Employees.</p>



<p>AIRF, therefore, is of the considered opinion that the above-mentioned issues be given thorough consideration and remedial action taken urgently.</p>

<p>NEW DELHI: To efficiently manage crew, Indian Railways is planning to start biometric sign on and sign off for 100,000 locopilots and 30,000 guards which will also lead to effective train operations.</p>
<p>The railways business plan for 2017-18 says that Indian Railways would be migrating in a big way towards biometric attendance of crew which will be far more accurate and will greatly enhance crew availability.</p>
<p>“Efficient management of crew is fundamental to effective train operations as it is a vital and costly input. Crew management on Indian railways has already been computerized through crew management systems rolled out over Indian Railways- with sign-on and sign-off being recorded on the system,” says the plan.</p>
<p>At present 15 percent of the crew is covered under biometric sign on signoff and it is targeted to increase coverage of crew under biometric sign on sign off to over 50 percent during 2017-18.</p>
<p>According to railway ministry, this will ensure that locopilots attend to compulsory 10 hours of duty hours as there have been complaints of data being tempered with. Earlier, the attendance was marked on a duty register maintained at platforms.</p>
<p>Under the biometric attendance, crew will now have to punch at station before joining of duty and sign off at end of duty and the database will be centrally integrated so that they can mark the presence across any station in the country.</p>
<p>Biometric attendance has been started in all central government offices so that employees don’t skip office or leave before stipulated time.</p>

<p>The Central Government employees are marking their attendance in the Aadhar Enabled Biometric Attendance System (AEBAS). There is a difference between the number of registered employees and number of employees marking their attendance. The Department of Personnel &amp; Training has issued fresh instructions to all Ministries/ Departments on 28.01.2015 that necessary directions may be issued to all employees to mark their attendance in the Biometric Attendance Portal on regular basis.</p>
<p>Biometric attendance system is an enabling platform for marking of attendance. There is no change in the instructions relating to office hours, late attendance etc. There is no proposal to introduce an alternative system.</p>
<p>This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in Prime Minister’s office Dr. Jitendra Singh in a written reply to a question by Shri Dushyant Chautala in the Lok Sabha today.</p>

<p>How to mark Attendance using the common biometric attendance system on wall mounted terminals</p>
<p>To get your Attendance ID, register online at attendance.gov.in. The Attendance ID will be generated from you Aadhaar number, the 6 digit number will be generated based on the last 6 or first 6 digits of your Aadhaar number. The attendance ID will only be active to mark attendance only when your Aadhaar information is verified by UIDAI and activated by you Nodal officer.</p>
<ul>
<li>Attendance ID has been sent by SMS to your registered Mobile Number.</li>
<li>Enter your 6-digit Attendance ID on Screen</li>
<li>A Red light will start to glow on Finger Print Scanner</li>
<li>Now put any one of your fingers on the Finger Print Scanner</li>
<li>DO NOT move your finger on scanner otherwise finger prints will not be properly scanned</li>
<li>DO NOT Press very hard on Finger Print Scanner</li>
<li>Once the screen shows “Authenticating, Please Wait”. Remove your finger from the scanner</li>
<li>A pop-up screen will show your Photo and Attendance Type as “Opening” for the first time you mark the attendance for that day</li>
<li>If Attendance Type is “Closing” then it will be counted as OUT Time. However, OUT time would be the LAST “Closing” time marked by you. Any “Closing” time in-between “Opening” time and Last “Closing” time would be ignored</li>
<li>If, you see a CROSS instead of your photo, then some ERROR has occurred while marking attendance.</li>
<li>You will be able to mark your attendance in any bio-metric terminal installed in various Central Government buildings</li>
<li>You can also mark your attendance in any of finger print devices, which have been connected on Windows 7 or Windows OS. Presently client attendance software is not available for MAC OS</li>
<li>If you are having difficulty in marking attendance-using fingerprints scanning devices, please try marking your attendance through Iris Device, which may be available with NIC In-charge in your organization</li>
</ul>

<p>Soon all ministries and central departments will get biometric attendance system, which will be linked with Adhaar number of each employees.</p>
<p>Sources said that the entire project across all departments will be implemented by National Informatics Centre (NIC) and an order will be issued soon. Though at present, quite a few central offices have installed biometric attendance, the need to link it to Adhaar is being done to ensure that the employees cannot do any fraud to mark their attendance.</p>
<p>“This additional provision will ensure that the genuine employee is recording attendance while coming to office and when he clocks out,”said a government source.</p>
<p>Following recent surprise checks by two central ministers – Venkaiah Naidu and Prakash Javedekar – when they detected huge number of late comers, they had directed installation of biometric system so that there is proper record of when the employees reached office and when they left for the day.</p>
<p>Biometric attendance system is a foolproof technology to ensure the accuracy of attendance and is useful to big organizations and government entities. What makes a biometric time clock one of the best time and attendance systems is that it has a biometric fingerprint scanner built in that is much more accurate in time keeping that a time card or time sheets because employees can’t clock in other employees.</p>

Implementation of PRIS</p>
<p>The Performance Related Incentive Scheme (PRIS) is to provide pecuniary benefit over and above the regular salary, based on the targeted performance, out of the Non-Plan budgetary savings, for the Central Government employees.<br />
Some Ministries and Departments have installed Bio-metric Access Control System in their offices. The instructions on punctuality envisage that necessary measures for enforcement of punctuality are to be evolved by the Head of Offices and Departments in the light of broad objective.</p>
<p>This was stated by Shri V. Narayanasamy, Minister of State in the Ministry of Personnel, Public Grievances and Pension and Minister of State in the Prime Minister’s Office in written reply to a question by Shri Baijayant Jay Panda in the Lok Sabha today.</p>
