Controller General of Accounts are requested to arrange to provide attendance statement in respect of their verticals, in the following format so that a compiled report could be sent to M/o Finance:</p>

<p>Sub: <strong>Breath Analyser (BA) test and Bio-metric verification of Running staff during signing On/Off in the backdrop of <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a> pandemic.</strong></p>



<p>Ref: Order of Hon’ble High Court of Delhi dated 27.03.2020 in case no. ‘W.P.(C) URGENT 4/2020 (to be numbered subsequently)’.</p>



<ol class="wp-block-list"><li>The Hon&#8217;ble High Court of Delhi, in the above-mentioned case, by order dated 27.03.2020 has stayed the operation of this office letter of even no. dated 20.03.2020 on the subject. Further Hon’ble High Court has given certain directions. Copy of Hon’ble High Court’s order is enclosed herewith for necessary action by all Zonal <a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener">Railways</a>.</li><li>Railway Board has vide letter of even no. dated 27.03.2020 (copy enclosed) already permitted zonal railways to issue relaxations regarding BA test and bio-metric verification. This letter was issued based on request of recognised federations and the same was perhaps not brought to the notice of Hon’ble High Court.</li><li>Many directions given vide Hon’ble High Court’s orders were already included in Railway Board letter dated 27.03.2020. This letter dated 27.03.2020 had given the relaxation till 14.04.2020 or till the end date of complete lockdown, whichever is earlier. However, in accordance with Hon’ble High Court’s orders, the applicability of such directions is extended till the next date of hearing in the case (to be listed on 16.04.2020). Hon’ble High Court has also specified the format for self-declaration to be taken from running staff, which is enclosed with the order.</li><li>Further, Hon’ble High Court has given the following additional directions, which may be noted by zonal railways for compliance (many of these are also being implemented by railways already) :</li></ol>



<p><a href="https://centralgovernmentnews.com/whether-macp-scheme-entitles-financial-upgradation-of-pay-to-the-next-grade-pay-or-to-the-grade-pay-of-the-next-promotional-post-as-envisaged-under-the-acp-scheme/" target="_blank" rel="noreferrer noopener"><strong>Whether MACP scheme entitles financial upgradation of pay to the next grade pay or to the grade pay of the next promotional post as envisaged under the ACP scheme</strong></a></p>



<ul class="wp-block-list"><li>Running staff while signing On/Off should use their own pen. Common pens, if any, may be removed.</li><li>Special watch may be kept on the staff to eliminate drunkenness on duty.</li><li>Sufficient Liquid soap and hand sanitizers should be made available in the lobbies and running/Rest Rooms.</li><li>Equipments / apparatus and other commonly used items in the crew lobbies and running rooms may be frequently cleaned / sanitized.</li><li>Sharing of linen and use of blankets is to be stopped in running rooms.</li><li>The bed rooms / wash room areas, dining halls other common rooms/ halls, offices in the crew lobbies and running rooms may be kept frequently cleaned, sanitized and well ventilated by keeping the windows and doors open.</li></ul>

<p>Reference MoD ID Nos. 16(18)/2017/D(Works-II) dated 04.07.2017 and 19.12.2017 regarding Bio-metric Attendance System for punctuality in Defence Establishment.</p>



<p>Ministry has observed that till date Aadhar Enabled Bio-metric Attendance System is not implemented in E-in-C’s Branch. Further, it is also observed that subordinate offices are not maintaining proper leave record of Officers. The Ministry has taken a very serious view in this regard as non-maintenance of leave record will result in various administrative issues and loss to government exchequer.</p>



<p>In view of above, it is once again directed that Aadhar Enabled Bio-metric Attendance System shall be implemented in E-in-C’s Branch and all, the offices of Military Engineer Services. Non-implementation shall be viewed seriously and appropriate action as per relevant service rules/conduct rules shall be taken against the erring officials. As informed by E-in-C’s Branch, the case for exemption of Service Personnel is still under consideration in this Ministry, therefore, presently Service Personnel are not covered under ibid instructions.</p>

<blockquote class="tr_bq"><p><b>Govt Stresses on Punctuality</b></p></blockquote>
</div>
<p>The Government has directed all Government servants to strictly observe punctuality in attendance. All Ministries and Departments besides Autonomous Bodies, CBI, Lok Sabha and Rajya Sabha Secretariats and the Union Territories Administrations have been asked to issue necessary directions to all employees at all levels to mark their attendance in the Biometric Attendance System (BAS) portal on regular basis.</p>
<p>In a recent Office Memorandum, it is reiterated that the BAS is only an enabling platform and there is no change in the instructions relating to Office Hours, late attendance etc.</p>
<p>Citing provisions under the CCS (Conduct) Rules, 1964 the Memorandum reiterates that habitual late attendance will be viewed as conduct unbecoming of a Government servant and disciplinary action may be taken against such offenders.</p>

<p>Subject: <strong>Implementation of Common Biometric Attendance System</strong></p>
<p>Madam/Sir,</p>
<p>As a part of the “Digital India” program of Government of India, it has been decided to implement common Biometric Attendance System (BAS) which will enable an employee to register attendance by simply presenting his I her biometric (finger print/ Iris) which will be authenticated online by doing one to one match with the bio-metric stored in the UIDAI data base against the employee’s Aadhaar number. This Aadhaar Enabled Biometric Attendance System needs only Aadhaar number, basic demographic details and a photograph of the user at the time of user registration which can be done by employee himself I herself by simple web based system. The biometric details are already available with the UIDAI which are then used for authentication.</p>
<p>2. To overcome the challenges in the present attendance systems, Common Biometric Attendanc System is envisaged with following featuree:</p>
<p>2.1 Cloud-based attendance software installed and operated from NIC National Data Centre<br />
(Further details can be noted from para 2 of “On-boarding Manual for Biometric Attendance System” which is available on the ‘attendance.gov,in’ web site)</p>
<p>2.2 Dedicated secure connectivity will be provided between National Data Centre &amp; UIDAI Data Centre by NIC for authentication.</p>
<p>2.3 All Ministries I Departments I subordinate organisations can access the system using the NIC network provided in the Bhawans.</p>
<p>2.4 Offices using the system will install biometric enabled terminals I devices to mark the attendance; the number and location of required devices will be assessed by the offices; the offices concerned will be responsible for day-today maintenance of the devices.</p>
<p>2.5 Connectivity of the devices /terminals will be established through Wi-Fi I GPRS.</p>
<p>2.6 Customised reporting formats for various levels of employees will be developed by UIDAI/ NIC.</p>
<p>2.7 Facility for centralised compilation and publication of attendance data in public domain will be provided as per requirements.</p>
<p>3. This setup costs extremely less and management information system does not require any resources or manual intervention. To facilitate the implementation and thereafter operate the Biometric Attendance System (BAS), it is desired to nominate a Nodal Officer (NO) for acting as a Single Point of Contract (SPoC) for driving the Boimetric attendance initiative. The Deputy Commissioner will be the Nodal Officer in case of Regional Offices. The Director will be the Nodal Officer in case of ZIETs and Principal shall be the Nodal Officer in case of Kendriya Vidyalaya concerned. The Nodal Officer shall be responsible for:-</p>
<p>3.1 Monitoring and co-coordinating with the stakeholders for smooth functioning of the Biometric Attendance System</p>
<p>3.2 providing update facility for bio-metric updating in case of poor bio-metric capture during enrolment process and in cases where there are failure in detecting the fingerprints by organising Aadhaar camps.</p>
<p>3.3 Organising special Aadhaar Enrolment Camps (AECs), if considerable numbers of employees are not able to register on the portal due to nonavailability of Aadhaar numbers.</p>
<p>3.4 Aadhaar number generation for the enrolments done in the AECs.</p>
<p>3.5 e-Aadhaar access.</p>
<p>3.6 Best Finger Detection and other Aadhaar related issues.</p>
<p>3.7 The Nodal Officers concerned are required to register the Unit online (once) on the portal for using attendance.gov.in by giving number of employees and their existing website name. Once the registration of the KVS unit (i.e Regional Office/ZIET/KV, as the case may be) is complete, the name of Unit concerned will be listed in the portal for enrolment of the employees and generation of various types of reports pertaining to that Unit.<br />
(For further details and steps for on-boarding the unit in the attendance portal can be found in Appendix ‘B’ of para 5.2 of On-boarding Manual for Biometric Attendance System-)</p>
<p>3.8 Subsequent step after registration of Unit concerned is, registration of employees. The employees of the Unit concerned are required to do online registration on attendance.gov.in portal for enabling them to mark attendance. The employees need to fill an online form using the fink ‘Employees Registration’ on the attendance portal. After the quality check y the UIDAI I Nodal Officer the employee becomes active in the attendance portal and can mark its attendance through the devices installed.<br />
(The details required for on boarding of employees in the attendance portal can be found in Appendix ‘C’ of para 5.3 to 5.6 of ‘On-boarding Manual for Biometric Attendance System’·)</p>
<p>4. In the first phase of implementation, approximately 150 Central Government Organisations have on boarded about 50,000 employees on common attendance portal {attendance.gov.in). 1000 wall mounted bio-metric attendance terminals, 5000 finger prints scanning devices and 200 IRIS devices have been procured through an open tender process floated by NICS I for 100 Government Bhawans I buildings. In the second phase of the program, the Gol has proposed that Central Government organisations shall use the common biometric attendance portal, which is hosted at NIC data center and shall procure I maintain biometric attendance terminals and desktop fingerprint scanning devices I IRIS devices in a decentralised manner, through open tenders, DGS&amp;D rate contract &amp; NICSI empanelled vendors. The Central Government Organisations shall procure the required Wi-Fi Access point for enabling network connectivity in the biometric attendance terminals through DGS&amp;D rate contract.<br />
(Further details for the plan of action can be noted from para 4, 5.7 of On-boarding Manual for Biometric Attendance System-)</p>
<p>5. It is estimated that for every 50 employees, one wall mounted bio-metric attendance terminal would be required and one finger print scanning device on a desktop would be sufficient for a unit (i.e. RO/ZIET/KV). Therefore, the total requirement of wall mounted biometric terminals as well as desktop devices could be estimated based on the total number of employees. However, depending upon the justified ground – based circumstances, the additional number of such devices can be<br />
procured for the smooth implementation of the BAS. The device(s) [i.e. wall mounted bio-metric attendance terminals, desktop finger print and iris scanning devices] can be procured through following methods:-</p>
<p>5.1 NICSI – devices are readily available for procurement through tho empanelled venders.</p>
<p>5.2 OPEN TENDERS devises can also be procured through open tenders but device specification should adhered to as appended in Appendix ‘D’ of the On-boarding Manual for Biometric Attendance System.</p>
<p>5.3 DGS&amp;D – rate contracts are being finalised,. However, present status may be inquired at your level and document(s) in this regard be kept in your office record before taking further action.<br />

<p>6. The bio-metric attendance terminals would require Wi-Fi connectivity through the internet I NICNET for communicating with the back-end attendance servers, which are installed at NIC data centers. Therefore, there is need to procure connectivity (GPRS/Wi-Fi using NICNET/Broadband /Internet) from suitable service providers. For proper functioning of the Biometric attendance terminals, minimum 1 mbps of bandwidth connectivity is advised. The format placed at Appendix ‘E’ of the On-boarding Manual for Biometric Attendance System for capturing the connectivity requirements may be used.</p>
<p>7. The site for installation of the wall mounted biometric terminals under 24 hours security shall be vigilantly &amp; intelligently identified by the Nodal Officer ensuring the following:-</p>
<p>7.1 220 V/5A Electrical points with suitable security.</p>
<p>7.2 Protection from environmental conditions like rain, sun etc.</p>
<p>7.3 LAN point for connecting Wi-Fi access devices.</p>
<p>7.4 Good data connectivity through GPRS I 3G as a backup connectivity. Appendix ‘F’ of the On-boarding Manual for Biometric Attendance System for site requirements may be referred to.</p>
<p>8. The Nodal Officer shall take up the installation, commissioning and maintenance of the Biometric attendance terminals with the help of vendors who are empanelled with DGS&amp;D, UIDAI, NIC and DeitY who shall extend all technical support for integrated back-end infrastructure.</p>
<p>9. The Nodal Officer of the respective Unit (i.e. Regional Offices, ZIETs and Kendriya Vidyalayas) shall be responsible for maintenance of the devices installed in his I her Unit. The agencies will also be responsible for taking suitable on-site warranty support for smooth functioning of BAS.</p>
<p>For any suspicion, you may visit the ‘On-boarding Manual for Organisations to install Aadhaar-enabled Biometric Attendance System’ which is readily available on the KVS web-portal and also the FAQs available on ‘http://attendance.gov.in/fag/public fag’.</p>
<p>10. The Nodal Officers in case of KVS, Regional Offices and ZIETs shall ensure to complete the process of procurement of devices as per requirement &amp; norms and make the Biometric Attendance System functional by 07.07.2015.</p>
<p>11. The Deputy Commissioner of respective Regions will further ensure that the Biometric Attendance System is put on fully functional in each of the Kendriya Vidyalaya of his I her Region.</p>
<p>12. It is also intimated that M/s MGRM Net Ltd have been recently awarded the work of MIS/ERP of all KVs through NICSI by KVS. M/s MGRM Net Ltd will be providing one Bio-metric terminal with no additional cost to each school while implementing MIS/ERP (KV Shaala Darpan) in all Kendriya Vidyalayas. One Biometric Terminal seems to be sufficient for 50 to register attendance. So, a KV up to the strength of 50 employee, need not spend on hardware (Biometric device) The compliance report may be sent to this office. Suggestions, if any, to improve the system are solicited.</p>

<p>The Government has decided to use an AADHAR Enabled Bio-metric Attendance System (AEBAS) in all offices of the Central Government, including attached / sub-ordinate Offices, in India as an enabling platform for marking of attendance.</p>
<p>As per the information collected, the status of implementation of the AEBAS in Central Government Offices in Delhi is as follows:</p>

<p>National Informatics Centre has incurred an expenditure of Rs. 4.8 crores in procuring and installing the front end devices like Wall mounted Biometric Terminals, desktop based finger print and Iris scanners, etc. for the above offices. Installation is part of the cost of procurement.</p>
<p>This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office Dr. Jitendra Singh in a written reply to a question by Shri Jose K.Mani in the Lok Sabha today.</p>

<li><strong>GPS Enabled Device Monitoring to Improve Performance of SDI Scheme</strong></li>
</ul>
<p>The Ministry of Labour &amp; Employment has made it mandatory for registered Vocational Training Providers (VTPs) to install GPS enabled Bio-metric attendance to capture the attendance of the trainees during the start and end of training daily, which is stored at the central server. This will ensure VTPs to conduct training regularly. This is one of the many meaningful initiatives taken recently by the Ministry to monitor and improve the quality of training under Skill Development Initiative (SDI) scheme. GPS enabled device ensures that the correct attendance is tracked for the students who belong to the geographical location where biometric device is installed. Trainees having minimum 80% attendance will be allowed to take assessment for getting National Council of Vocational Training (NCVT) approved certificate. Besides this, Placement Tracking Module has also been integrated with SDI portal in order to track the placement of the passed out trainees for one year and only those VTPs get 20% of last instalment of training after one year who enters the data of the trainees namely: salary/wages etc into SDI Portal.</p>
<p>To bring the construction workers into mainstream, a scheme “Recognition of Prior Learning (RPL) of construction workers has been launched to test the competencies of the construction workers registered with Building and Other Construction Workers Welfare Board on pre-determined parameters and thereafter, if workers found wanting in support or core training, are imparted skill gap training as the case may be. Final assessment will be conducted leading to NCVT certification. In order to simplify and ease the process of implementation of RPL scheme, software module from registration to certification has been developed.</p>
<p>The Ministry of Labour &amp; Employment always endeavours to provide quality training to the beneficiaries so that they get employment after successful completion of training. The Skill Development Initiative (SDI) scheme is being implemented since May, 2007 to develop skilled manpower through network 10173 Vocational Training Providers (VTPs) located in various parts of the country. Skill of the persons is assessed by the independent Assessing Bodies and successful persons are awarded NCVT certificates which are recognised for the purpose of employment. There is a provision in the scheme wherein the competencies of the persons acquired by any means are tested on the pre-determined parameters and successful ones are awarded NCVT certificates. As on date more than 34.65 lakhs persons have been trained/ tested and 565 modules have been developed in 68 sectors of economy.</p>
<p><strong>Salient features of the scheme are:</strong></p>
<blockquote><p>-Additions and deletions of modules is continuing process.</p>
<p>-Flexi delivery time of training quality and it depends upon the target group.</p>
<p>-No training cost and assessment fee is charged from the trainee.</p>
<p>-A provision of providing lodging and boarding charges to the trainees belonging to North Eastern States, Left Wing Extremist Affected Areas, J&amp;K , Himachal Pradesh, Andaman &amp; Nicobar Islands and Lakshadweep when they come out of such place for getting training under SDI scheme.</p></blockquote>

<p>Aadhar cannot be made mandatory says Supreme Court, asks Government to abide by the interim order passed: Live Law</p>
<p>Erasing the sense of doubt about the legitimacy of Aadhaar card for availing benefits given by government, the Supreme Court on Monday affirmed that the Aadhar card is not mandatory, and further, authorities who demand them will be taken to task.</p>
<p>A seething Supreme Court issued a stern warning to the government on discovering that numerous government agencies still demand Aadhaar for giving subsidies and essential services to common citizens.</p>
<p>A Bench of Justices J. Chelameswar, S.A. Bobde and C. Nagappan elucidated that requests made by authorities for Aadhaar card is in clear violation of the Supreme Court’s earlier order of September 23, 2013.<br />
In the 2013 order, the Apex Court had said, “no person should suffer for not getting the Aadhaar card, inspite of the fact that some authority had issued a circular making it mandatory”.</p>
<p>While hearing the matter today, Justice Chelameswar observed, “Aadhaar is being insisted upon by various authorities. We do not want to go into specific instances. We expect the Union of India and all the States to adhere to the order dated September 23, 2013. We will take the officers concerned to task if any order comes on record making it (Aadhaar) mandatory.”</p>
<p>Appearing for the petitioners, senior advocate Gopal Subramanium submitted to the Court“It is a matter of great public importance. The issue has serious implication in terms of Constitution. Notwithstanding the court’s order, there is insistence for Aadhaar. There is complete apathy on the part of officials.” He also gave an example, Delhi government’s notification on March 9, 2015 after which it is compulsory for couples to produce Aadhaar cards to get their marriage registered under the Special Marriage Act.</p>
<p>Senior advocate Anil Divan also submitted that Registrar of the Bombay High Court had received an official communication regarding Aadhar. The Registrar was asked to make Aadhar mandatory for disbursal of salary to staff and even judges.</p>
<p>After this, the Apex Court observed, “You better advise the States, if the officials insist, it would have consequences. We will take them to task. This is absolutely not right.”</p>
<p>Mr. Gopal Subramanium also questioned the mechanism of Aadhar, he said, “On the surface it (Aadhaar) is a simple document of identity, but it has linkages by means of iris scans and biometric details. God forbid if identities are exchanged or mistaken. the Executive’s scheme involves private partners. Who are these private partners?” He also said, “Sovereign State also has the duty to protect its citizens, to protect his identity, his personal information against possible misuse.”</p>
<p>Meanwhile over 750 million Aadhar numbers have already been issued as the battle over validity of the card carries out in Supreme Court.</p>

<p><strong>Biometric Attendance System</strong></p>
<p>The Government has decided to use an AADHAR Enabled Bio-metric Attendance System (AEBAS) in all offices of the Central Government, including attached / sub-ordinate Offices, in India. There is no change in the instructions relating to office hours, late attendance etc. Biometric attendance system is only an enabling platform.<br />
As per the available information, there is a difference between the number of registered employees and number of employees marking their attendance. This Department has issued fresh instructions to all Ministries that necessary directions may be issued to all employees to mark their attendance in the Biometric Attendance Portal on regular basis.</p>
<p>As per the available information, the present status of implementation of the biometric attendance system is as under:</p>

<blockquote class="tr_bq"><p><b>Subject: Employee Registration for Aadhar based Biometric attendance- reg.</b></p></blockquote>
<div> The undersigned is directed to refer to OM of even number dated 16.12.2014 on the subject noted above under which all Pr.CCsIT/DGsIT were requested to take necessary steps to install Aadhar Enabled Diametric Attendance System(AEBAS) in the offices under their administrative control within the time prescribed by the Government (by 31.12 2014 in Delhi and 26.1.2015 in rest of India) and to submit a compliance report by 15th February,2015.</div>
<p>Further, pursuant to a letter dated 29.12.2014, received from the D/o Electronics &amp; Information Technology pointing to the low registration of employees. in Delhi by CBDT for the Aadhar Enabled Biometric Attendance System, all Fr.CCsIT/DCisIT were also requested vide OM of even number dated 7.1.2015 to ensure that necessary steps for expediting registration of all officers/employees are taken on priority by the nodal officers for implementation of the AEBAS in their offices and a report submitted by 20.1.2015. A reminder in this regard recapitualating in brief the action to be taken and details of the officers in NIC who may be contacted by the nodal officers for seeking any clarification/guidance was also issued vide OM of even number dated 22.1.2015.</p>

<div>Based on the feed back received from different officers the position on the implementation of AEBAS has been reviewed by the Chairperson, CBDT who has observed as under:-</div>

<div>&#8220;<b>Very tardy Progress. It appears that field offices have assumed that their work ended </b><b>with appointment of nodal officers. Please send a self contained advance reminder w.r.t </b><b>compliance report due on 15.2.2015</b>&#8220;</div>
<div></div>
<div>It is therefore requested that the matter may he looked into and nodal officers appointed for the implementation of the AEB. AS may be directed to take necessary action in this regard keeping in view the compliance report that is to be submitted to this office by 15.2.2015 as  directed by the Chairperson, CBDT</div>
