<p>Your attention is invited to the letter cited under reference above wherein beneficiaries under CGHS have been extended the facility to avail <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">Covid-19</a></strong> related treatment in private hospitals empanelled under <a href="https://centralgovernmentnews.com/category/cghs/" target="_blank" rel="noreferrer noopener">CGHS</a>.</p>



<p>The pandemic is spreading rapidly with the passage of every day and it is observed that those personnel who are covered under the CSMA scheme are finding it extremely difficult to avail timely and proper treatment in the absence of guidelines.</p>

<p>It is also observed that at most of the occasion, beds in Government hospitals are not available as a result of which CSMA governed employees are forced to avail treatment at private hospitals at enormous rates.</p>



<p>In view of the above, you are requested to kindly examine the matter and issue necessary directives at the earliest.</p>

<p>Subject: <strong>Extension of benefit of Insurance Scheme as announced by Hon’ble Finance Minister on 26 March 2020 for health workers fighting COVID-19 in Government Hospitals and the health Care Centers to Defence Civilian employees engaged in various essential services for supporting the front warriors of war against Covid-19.</strong></p>



<p>Respected Sir,</p>



<p>With due regards, your kind attention is drawn to the announcements made by Hon’ble Minister of Finance and Corporate affairs Smt.Nirmala Sitharaman on 26/March/2020 whereby it was made public that</p>



<p>“Safai Karmacharis, Ward boys, Nurses, Asha workers, Paramedics, Technicians, Doctors, Specialists and other health workers would be covered by a special Insurance Scheme.</p>



<p>Any health professional, who while treating <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">Covid-19</a></strong> patients, meet with some accident, then she/he would be compensated with an amount of Rs 50 lakh under the scheme.</p>



<p>And all government health centres, wellness centres and hospitals of Centre as well as States would be covered under this scheme. Approximately 22 lakh health workers would be provided insurance cover to fight this pandemic.</p>



<p>Further, it is for your kind information that employees of various Ordnance factories have been deployed to manufacture essential equipment like mask, coverall, sanitizer etc for our front warriors viz. Health professionals, Police personnel, Sanitation workers to protect them from this pandemic.</p>



<p>Ordnance Factory Board (OFB) has designated 285 beds as isolation wards for handling Covid -19 cases in various Ordnance Factories hospitals located in different parts of the country. Sufficient staff has also been engaged for the task.</p>



<p>DRDO employees are also serving the establishment as well as the Nation by manufacturing ventilators and sanitizer.</p>



<p>Besides above, essential duty employees like Durwan, Firefighting staff, Electrical and Maintenance staff etc are being deployed in various defence establishments like MES Depots ,Workshops under Army HQ, Civilian employees under AIR HQ and Naval HQ, DGQA &amp; DGAQA so as to maintain the establishments properly and prepare them for any untoward situation. They are continuing their services/support to Armed forces of India in this vulnerable time so as to prove them “ the strongest” at any situation.</p>



<p>In above circumstances, these employees may expose/ fall prey to this pandemic. Yet they are feeling proud of being part of this war against Covid-19.</p>



<p>Though these employees do not seek any additional favour/ remuneration from their employers, yet in case of any mishappening /accident happens with employees attributed to Covid-19 their families will have to face misery and sufferings.</p>



<p>Therefore, you are requested to extend the benefit of Rs 50 lakhs under Special Insurance Scheme as announced by Hon’ble Finance Minister to <a href="https://centralgovernmentnews.com/category/defence/" target="_blank" rel="noreferrer noopener">Defence</a> Civilian Employees too so as to mitigate the hardships of families of the employees, if any accident attributed to Covid-19 occurs with them while performing their duties.</p>

<p>It is hoped that all of you are well and busy in accelerating trade union activities. As all of you know that the Central Executive Committee Meeting of this federation was held on 26, 27 and 28 March 2018 in Dehu Road, Pune where it was decided to hold one day agitational programme on 24.04.2018 on Minimum Guaranteed Pension under National Pension System (NPS).</p>
<p>A resolution to this effect was also passed in the CEC Meeting held at Hyderabad during September 2015 and subsequently several correspondence were made. However, in spite of lapse of such a large time, no tangible action has been seen from the Govt side on the issue.</p>
<p>Therefore, in absence of any concrete step from the Govt side on the issue it becomes necessary to register our displeasure over the lethargic attitude of the Government and register our protest to constrain the machinery to redress the Grievance.</p>
<p>Hence, you are requested to hold one day agitation programme on 24.04.2018 using all feasible and effective trade union instruments like Gate Meeting, Use of Black Badges, Slogan Shouting, publicizing of programme at humongous level through posters/ hoardings/ banners/ pamphlets/ social media so that the issue may be resolved at the earliest. Further, you are requested to submit a memorandum addressed to Prime Minister of India through proper channel on 24.04.2018.</p>

<p>Respected Sir,</p>
<p>I have been directed to bring the following for your kind immediate intervention.</p>
<p>Vide Ministry of Defence letter cited under reference above, Ordnance Factory Board has been directed to completely stop Holiday Overtime in the Factories.</p>
<p>In this connection we submit that the said order issued by concerned officials is totally unjustified and is without proper application of mind, suffice to say that Over time in the Ordnance Factories is not granted as a matter of routine or luxury but there is a time tested and logical formula vis-à-vis production output on the basis of which the action is taken and it is quantifiable.</p>
<p>Here it may also be pertinent to note that as per the annual statement of accounts of the factories, the total cost of labour on the cost of production is constant between 12 to 13% whereas other elements like Material, Fixed Over heads ,Variable Over heads consumes bulk of cost of production.</p>
<p>Thus targeting Labour to cut cost is not only an unprofessional approach but also shows the biased mindset of the concerned Officials of MoD which is adversely affecting the moral, dedication of the employee and output of the OFB organization.</p>
<p>There is large scale resentment amongst employees as a result of which whimsical diktat of the Ministry and we seek your immediate personal intervention in the matter to provide justice to the workmen.</p>
<p>We therefore once again demand that status quo ante be restored, pending further discussion on the matter.</p>

<p>I hope that all of you will be quite well. This is to inform you that today (07.05.2016), a meeting held with Hon’ble MoS, DoP&amp;T Dr. Jitendra Singh, attended by Shri Sadhu Singh, Shri Virendra Sharma along with other office bearers of Railways, Postal, Autonomous Bodies under the leadership of Shri Pawan Kumar, Regional Organizing Secretary Bharatiya Mazdoor Sangh.</p>
<p><strong>Hon’ble MoS has assured that the Government of India is considering positively to enhance the minimum pay, multiplying factor of 07th CPC.</strong> But exact amount / number would be decided / declared by the Cabinet Committee.</p>
<p>He further assured that DoP&amp;T is actively considering for grant of one time relaxation for compassionate appointment in Ministry of Defence.</p>
<p>For payment of Bonus arrears to Central Government employees, he is going to write a letter to finance Minister, Govt of India to issue necessary directives.</p>
<p>Hon’ble Defence Minister has fulfilled his promise / statement of 17th Triennial Conference of BPMS regarding Ordnance Factories Recruitment Centre (OFRC) on 29th April, 2016.</p>

<p>From above it may be deduced that more than 7 lakh sanctioned posts are lying vacant for a long period which is not only adversely affecting the efficiency of good governance but give ample opportunity for exploitation of contract worker employed in the Government sector. Bharatiya Mazdoor Sangh has been demanding for abolition of contract work system and regularization of the contract workers.</p>
<p>Now, our  Hon’ble Prime Minister, Shri  Narendra  Modi  has also  assured  the unemployed youth to give them proper employment.</p>
<p>Hence,  it  is  requested  to  your  good  self  to  intervene  into<br />
the  matter  and  issue necessary directives to all the Ministries of<br />
Govt of India to fill up the vacant posts without further delay.</p>

<p>Subsequently, vide ID No. 2(1)/2009-D(Civ-I), dated 26.07.2010, MOD issued instructions for grant of upgraded pay scales to the Fire Fighting Staff as per 6th CPC recommendations which is mentioned below:-</p>

<p>Para 3 of the above MOD ID states that as for the four grade promotional scheme applicable to the civilian drivers as extended to the Fire Engine Drivers, they may continue where they exist at present and in remaining establishments, the posts of Fire Engine Drivers shall be merged with the Fire Fighting Cadre.</p>

<p>This upgradation and merger have disturbed the horizontal parity between Fire Fighting Cadre and Fire Engine Drivers as under:-</p>

<div> To remove this disparity some of the incumbents (FEDs) filed O.A. (No.060/00443/2015) in Central Administrative Tribunal – Chandigarh. On 25.05.2015 the CAT Chandigarh disposed off the O.A. with direction to respondents to take a view on the pending representations of the applicants by passing reasoned and speaking order in accordance with Law and Rules within a period of 03 months.</div>

<p>In such circumstances, you are requested to consider the above in correct perspective and issue necessary instructions so that the horizontal disparity between Fire Fighting Cadre and Fire Engine Drivers may be removed without further delay.</p>

<p>Subject: <strong>Recruitment of Ex-Trade Apprentices in Ordnance Factories: Compliance of the amended provisions of The Trade Apprentices Act, 1961.</strong></p>
<p>Respected Sir,<br />
With due regards, it is submitted that the Apprentices (Amendment) Bill, 2014 was introduced in Lok Sabha on 07th August, 2014 and passed on 14th August, 2014 and the Bill was passed in Rajya Sabha on 26.11.2014. Prior to this amendment it was not obligatory on the part of the employer to offer any employment to any apprentice who had completed the period of his apprenticeship training in his establishment, nor it was obligatory on the part of the apprentice to accept an employment under the employer. This was one of the impediments which discouraged youth to join the apprenticeship training as they were not sure whether they would get employment after completion of the apprenticeship training.</p>
<p>It was felt that by making it obligatory on part of the establishment to give preference to apprentices at the time of regular recruitment could lead to unwanted litigations. Hence, Section 22 of the Apprentices Act, 1961 has been amended so that establishments may formulate their own policies for recruiting trained apprentices.</p>
<p>In such circumstances, the OFB instruction issued vide letter No. 570/A/I (Pt)/54/Vol.IV/294 dated 06.01.2011 has become irrelevant regarding the recruitment processes to the post of Industrial Employees (Semi-Skilled tradesmen).</p>
<p>Therefore you are requested to intervene into the matter so that the OFB’s instruction mentioned hereinabove may be withdrawn / cancelled and issue necessary directives to appoint the ex-trade apprentices of Ordnance Factories on batch wise seniority basis, without conducting any written examination in compliance with the provisions of the Apprentices (Amendment) Act, 2014 in letter and spirit by incorporating the same in the relevant Recruitment Rules.</p>

<div>It has been decided by Government Employees National Confederation that all the constituent Federations of GENC will observe an Agitation Programme throughout the country from 15.09.2014 to 20.09.2014 to remove the ceiling of Rs. 3500/- per mensem under the Payment of Bonus Act, 1965 and Productivity Linked Bonus Scheme. You are aware that Section 12 of the Payment of Bonus Act has been amended by Act 45 of 2007 (w.e.f. 01.04.2006) regarding calculation of bonus with respect to certain employees which states as under:-</div>
<blockquote>
<div><strong>“Where the salary or wage of an employee exceeds three thousand and five hundred rupees per mensem, the bonus payable to such employee under Section 10 or, as the case may be, under Section 11, shall be calculated as if his salary or wage were three thousand and five hundreds rupees per mensem.”</strong></div>
</blockquote>
<div>Meanwhile, Central Government accepted the recommendations of 06th CPC with effect from 01.01.2006 and fixed the minimum basic pay plus grade pay as Rs. 5200 + 1800 = 7000.</div>
<div></div>
<div>Therefore 28,06,369 Group ‘C’ (Non Gazetted) and 1,13,477 Group ‘B’ (Non Gazetted) total thirty lakh approx. Central Government employees are getting the bonus @ Rs. 3500/- per mensem under the Payment of Bonus Act, 1965 or Productivity Linked Bonus whereas none of them is drawing wages less than Rs. 7000/- per mensem excluding other allowances which has beencausing discontentment amongst the employees.</div>

<div>In this agitation programme Gate Meetings, Demonstration at Main Gate, Rallies, Wearing Black Badges and may include other peaceful methods decided at your levels will be organized as per feasibility. This demand week will be concluded with the giving Memorandum to respective Head of Department on last working day (20.09.2014) addressed to Hon’ble Prime Minister of India and copy to the Minister of Labour &amp; Employment, Govt of India.We hope for full support and co-operation to give a great success to this programme.</div>

2. This Federation’s letter no. BPMS/OFB/SRO/22(7/2/L), dated 14.06.2012</p>
<p>Respected Sir,</p>
<p>With due regards, it is submitted that OFB had asked the comments/views of this Federation vide letter cited under reference (1) whereupon this federation forwarded its views vide letter cited under reference (2) whereby it had been requested that vide DOP&amp;T O.M. No. 20/49/2009-CS.II (B), Dated 22.06.2011 a new grade of UDC (Non Functional Selection Grade) has been created in Central Secretariat Services cadre in the grade pay of Rs. 4200/- in the Pay Band-2 with immediate effect with the condition that UDCs shall be eligible for placement in ‘NFSG’ on completion of 05 years service as UDC and the total number in the grade will be restricted to 30% of the sanctioned strength of UDC, hence, it should be incorporated in the proposed Recruitment Rules that 30% of UDCs (total sanctioned strength of UDC is 2125 in OFB) should also be placed in the new grade of UDC(NFSG) in the grade pay of Rs. 4200/- in the Pay Band-2 on completion 05 years regular service as UDC in the grade pay of Rs. 2400/-.</p>
<p>Employees were much hopeful that OFB would incorporate the above suggestion of BPMS but it is very painful to see the SRO 43, dated 24.06.2013 forwarded by OFB letter No. 288/RR/SRO/Clerical/A/NI, dated 14.08.2013 that nothing has been done in this regard.</p>
<p>However, you are requested to reconsider the issue and take appropriate action so that 30% of UDCs may be placed in the Grade Pay of Rs. 4200/- after completion of 05 yrs regular service.</p>
