<p style="text-align:center"><strong>5th CPC DA from Jan 2019 @295% for CGE and Central Autonomous Bodies continuing to draw pre-revised pay</strong></p>

<p style="text-align:center">OFFICE MEMORANDUM</p>



<p>Subject: <strong>Rate of Dearness Allowance applicable w.e.f. 01.01.2019 to the employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scales as per 5th Central Pay Commission.</strong></p>



<p>The undersigned is directed to refer to this Departments O.M. No, 1/3/2008-E.II(B) dated 11th September, 2018 revising the rate of Dearness Allowance (DA) w.e.f. 01.07.2018 in respect of employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scales as per 5th Central Pay Commission.</p>



<ol class="wp-block-list"><li>The rate of DA admissible to above categories of employees of Central Government and Central Autonomous Bodies shall be enhanced from the existing 284% to 295% w.e.f. 01.01.2019.</li><li>The provisions contained in paras 3, 4 and 5 of this Ministry’s O.M.No.1(13)/97-EII(B) dated 3rd October, 1997 shall continue to be applicable while regulating Dearness Allowance under these orders.</li><li>The payment of arrears of Dearness Allowance shall not be made before the date of disbursement of salary of March, 2019.</li><li>The contents of this Office Memorandum may also be brought to the notice of all organisations under the administrative control of the Ministries/Departments which have adopted the Central Government scales of pay.</li></ol>

<p style="text-align: center;"><strong>OFFICE MEMORANDUM</strong></p>
<p>Subject :- <strong>Grant of Dearness Relief to Central Government Employees who had drawn lump sum amount on absorption in a PSU/Autonomous body and are in receipt of 1/3rd restored commuted portion of pension. – Revised rate effective from 1.1.2017</strong>.</p>
<p>The undersigned is directed to refer to this Department’s OM No. 42/15/2016-P&amp;PW(G) dated 16th December, 2016 and the OM No. 42/15/2016-P&amp;PW(G) dated 07.04.2017 and to say that the President is pleased to decide that the Dearness Relief (DR) to the Central Government employees who had drawn lump sum amount on absorption in a PSU/Autonomous body and are in receipt of 1/3rd restored commuted portion of pension shall be enhanced from the existing rate of 132% to 136% w.e.f. 01.01.2017.</p>
<p>2.These employees will be entitled to the payment of DR @ 136% w.e.f. 01.01.2017 on full pension i.e. the revised pension which the absorbed employee would have received had he not drawn lump sum payment on absorption and Dearness Pension subject to fulfilment of the conditions laid down in para 5 of the OM. dated 14.07.98 as amended from time to time. In this connection, instructions contained in this Department’s OM No.4/29/99-P&amp;PW (D) dated. 12.7.2000 refers.</p>
<p>3.Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.</p>
<p>4.Other provisions governing grant of DR in respect of employed family pensioners and re-employed Central Government Pensioners will be regulated in accordance with the provisions contained in this Department’s OM No. 45/73/97-P&amp;PW (G) dated 2.7.1999 as amended vide this Department’s OM No. F.No. 38/88/2008-P&amp;PW(G) dated 9th July, 2009. The provisions relating to regulation of DR where a pensioner is in receipt of more than one pension will remain unchanged.</p>
<p>5.It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.</p>
<p>6.The offices of Accountant General and authorised Pension Disbursing Banks are requested to arrange payment of relief to pensioners etc. on the basis of these instructions without waiting for any further instructions from the Comptroller and Auditor General of India and the Reserve Bank of India in view of letter No. 528-TA, II/34-80-II dated 23/04/1981 of the Comptroller and Auditor General of India addressed to all Accountant Generals and Reserve Bank of India Circular No. GANB No. 2958/GA-64 (ii) (CGL)/81 dated the 21st May, 1981 addressed to State Bank of India and its subsidiaries and all Nationalised Banks.</p>
<p>7.In their application to the pensioners/family pensioners belonging to Indian Audit and Accounts Department, these orders issue after consultation with the C&amp;AG.</p>
<p>8.This issues in pursuance of Ministry of Finance, Department of Expenditure vide their OM No. 1/3/2008-E.II(B) dated 07th April, 2017.</p>

<p><b>Drastic Reduction of Dearness Allowance (DA) to Central Government Employees, Opted in 7th Pay Scale</b></p>

<p>Dear friends,</p>

<p>As you are aware that 7th Pay Commission has computed 125% DA out of 125.75% due as on 1.1.2016 and 0.75% become due has been ignored. But according to earlier practice/agreement, this 0.75% has to be carry forwarded for calculating DA as on 1.7.2016. If the fraction carries forwarded the actual DA due as on 1.7.2016 shall work out to 3.28%. Thus 3% DA has to be announced in place of present 2% <span style="color: #0000ff;" data-blogger-escaped-style="color: blue;">(Order placed in Annexure I)</span>. In this respect secretary staff has written a letter to the government on 06/09/2016. But the government ignored the staff side demand on this matter.</p>

<p>Now the Government of India has issued orders for 7% dearness allowance w.e.f. 1.7.2016 to the employees of Central Government who had exercised option to continue the 6th CPC Pay scale and also the employees of Central Autonomous body to whom 7th pay commission has not implemented as yet <span style="color: #0000ff;" data-blogger-escaped-style="color: blue;">(copy of the order enclosed in Annexure II)</span>.</p>

<p>In this respect a chart comparing the amount of DA getting to the employees in new and old rates is given in annexure III.</p>

<p>From the above, the demand of the staff side for 3% DA w.e.f. 1.7.2016 is justified. Thus staff side should take up the matter for immediate rectification and also the entirety of central Government should join the 25th December parliament march to achieve the 20 point charter of demands which include grant of 3% DA, increase of minimum pay &amp; fitment formula, immediate implementation of allowances etc.</p>

<p>May I write the following for your kind consideration and necessary action.</p>
<p>Recently Government of India have revised the pay of central Government Employees and issued necessary orders citing recommendation to be implemented on 25th July 2016.</p>
<p>I am given to understand that the usual practice is to implement the pay benefits to the employees working in Autonomous Organisations, such as Sree Chitra Tirunal Institute of Medical Sciences and Technology and to the Central Government Employees who are working in Autonomous bodies on deputation.</p>
<p>The disbursal of bonus to Group B, C and D employees are also awaited.</p>
<p>Since the above mentioned employees are awaiting formal orders from the Government, may I request your good-self to look into the matter and do the needful.</p>

<p><strong>REVISION OF MINIMUM PAY AND FITMENT FORMULA</strong><br />
<strong>2ND MEETING OF THE GROUP OF SENIOR OFFICERS WITH JCM (NC) STAFF SIDE</strong></p>
<p style="text-align: center;"><strong>DISAPPOINTING</strong></p>
<p>2nd Meetings of the Group of Senior Officers (Constituted as per the assurance given by Group of Minister to NJCA) to discuss the grievances arising out of recommendations related to 7th Central Pay Commission, was held with JCM (NC) staff side on 24.10.2016 at 4 PM. The staff side explained in detail the justification for modification in the minimum pay and fitment formula, which was already explained in the memorandum submitted to Cabinet Secretary on 10th December 2015 and also in the presentation made before Joint Secretary Implementation Cell and Empowered Committee of Secretaries headed by Cabinet Secretary.</p>
<p>From the response of the Senior Officers, it is not clear whether they are mandated to submit a proposal on increasing the Minimum Pay and Fitment formula to Government, as assured by the Group of Ministers on 30th June 2016. Eventhough, the time frame of four months is almost over, the urgency and seriousness was lacking on the part of the Group of officers. It seems that that Government is adopting a delaying tactics or to deny the assured increase. Perhaps, they may recommend an increase in minimum pay and fitment formula at a later date, but it is quite uncertain.</p>
<p>Confederation National Secretariat after reviewing these developments has decided to intensify the campaign and agitational programmes demanding the Government to honour its assurance given to NJCA leadership and also to settle the 20 point charter of demands. Make the 7th November 2016 mass dharna programme a grand success. Ensure maximum participation of employees in the 15th December 2016 massive Parliament March. Get ready for strike.</p>
<p><strong>ALLOWANCE COMMITTEE MEETING ON DOP&amp;T SPECIFIC ALLOWANCES</strong></p>
<p>Meeting of the Allowance Committee to discuss the DOP&amp;T Specific allowances was held on 25.10.2016. Secretary, Department of Personnel Chaired the meeting. Important allowances like Children Education Allowance, Night Duty Allowance, Overtime Allowance, Cash Handling Allowance, Dress Allowance, Nursing Allowance, Patient Care Allowance, Family planning Allowance, Risk Allowance etc. are discussed. The Secretary, Department of Personnel gave a patient hearing and interacted with staff side on certain points. No commitment on any allowance was given.</p>
<p><strong>JCM NATIONAL COUNCIL : STANDING COMMITTEE MEETING</strong></p>
<p>The JCM (NC) Standing Committee meeting under the Chairmanship of Secretary, Department of Personnel was held on 25.10.2016. All agenda items were discussed. Some of the items are &#8211; JCM functioning, Compassionate appointments, amendment to the definition of anomaly, Changing MACP conditions, Ex-Servicemen pay fixation, Pay fixation option on promotion after the date of notification of CCS (RP) Rules 2016, GDS bonus enhancement to 7000/-, casual labour regularization and bonus enhancement, filling up of vacancies, upgradation of LDCs to UDCs, one time relaxation of LTC-80 availed by air by purchasing tickets from other than authorized agents, Restoration of Festival Advance, Natural Calamity Advance and Advance of leave salary, grant of entry pay recommended by 6th CPC to the promotes, reimbursement of actual medical expenditure incurred by the employees in a recognised hospital etc.</p>
<p>Secretary, Department of Personnel gave a patient hearing and clarified certain points. No final decision was taken on any of the agenda items. Gist published below. Minutes will be published later. It was informed that based on the discussion, each item will be examined further and decision will be taken.</p>
<p><strong>AUTONOMOUS BODIES : EXTENSION OF 7TH CPC REVISED PAY STRUCTURE AND PENSIONARY BENEFITS</strong></p>
<p>The issue was raised in the JCM Standing Committee meeting held on 25.10.2016 by the staff side. The official side informed that an overall review regarding the performance and financial viability etc. of each Autonomous body is being carried out by the Government. Only after completing the process decision regarding extension of 7th CPC revised pay structure and pensionary benefits, Bonus etc. will be taken. Extension of the benefits depends upon the policy decision of the Government. Hence the official side has not told any time frame for final decision. It is likely to be delayed.</p>
<p>Confederation has already included the demands of the employees of the autonomous bodies in its 20 point charter of demands. All Unions/Associations/Federation and employees of all autonomous bodies are requested to understand the gravity of the situation and make the 7th November 2016 mass dharna programme and 15th December 2016 Parliament March a grand success. Join the Parliament March with your flags, banners and placard with demands. Let the Government understand the discontentment and protest of employees and pensioners of Autonomous bodies. There is no short-cut to get our justified demand accepted by the Government.</p>
<p><strong>GDS BONUS ENHANCEMENT TO 7000</strong></p>
<p>This issue was discussed in the JCM Standing Committee meeting as a notified agenda. The official side informed that the file is still under process in the Finance Ministry and a decision is yet to be taken. Once the approval of the Finance Ministry is given the proposal is to be submitted to Cabinet for approval.</p>
<p>All affiliates and C-O-Cs are once again requested to extend full support and solidarity to the proposed Postal Strike on 9th &amp; 10th November 2016, demanding bonus calculation ceiling limit enhancement to 7000/- for GDS and immediate payment of revised wages to casual labourers from 01.01.2006. Conduct solidarity demonstration in front of important Postal/RMS office on 9th &amp; 10th November 2016.</p>
<p><em><strong>GIST OF THE JCM STANDING COMMITTEE MEETING HELD ON 25.10.2016</strong></em></p>
<p>Meeting was held under the chairmanship of Secretary, Department of Personnel. Items discussed and outcome is given below.</p>
<p><strong>1. JCM FUNCTIONING</strong></p>
<p>Decision: After discussion Secretary (P), assured that the JCM would be activated and steps may be taken to hold regular meetings of JCM at National and Departmental level.</p>
<p><strong>2. COMPASSIONATE APPOINTMENT:</strong></p>
<p>Decision: The demand of the staff side to remove 5% ceiling would be considered after studying the various. Supreme Court Judgments and the decisions of previous National Council JCM meetings.</p>
<p><strong>3. RESTORATION OF INTEREST FREE ADVANCES WITHDRAWN BY THE GOVERNMENT BASED ON 7TH CPC RECOMMENDATIONS</strong></p>
<p>Decision: The demand of the staff side to restore Festival advance, Natural Calamity advance and leave salary advance will be examined further.</p>
<p><strong>4. AMENDMENT TO THE DEFINITION OF THE TERM “ANOMALY”</strong></p>
<p>Decision: The proposal given by the staff side would be considered is consultation with Department of Expenditure.</p>
<p><strong>5. FIXATION OF PAY OF RE-EMPLOYED EX-SERVICEMEN</strong></p>
<p>Decision: The anomalies in the fixation of pay of re-employed Ex-Servicemen is under consideration of DOP&amp;T.</p>
<p><strong>6. OPTION FOR THOSE TO BE PROMOTED AFTER 25.07.2016, I.E. AFTER THE NOTIFICATION OF CS (REVISED PAY) RULES 2016.</strong></p>
<p>Decision: This issue would be considered by the Implementation Cell of 7th CPC.</p>
<p><strong>7. WITHDRAWL OF NEW CONDITIONS FOR THE GRANT OF MACP</strong></p>
<p>Decision: The demand of the Staff Side for withdrawl of “Very Good” grading would be re-examined. Some more items related to Ministry of Defence was also discussed.</p>
<p><strong>8. BONUS CEILING TO BE RAISED TO 7000 FOR GRAMIN DAK SEVAK EMPLOYEES OF POSTAL DEPARTMENT</strong></p>
<p>Decision: Revision of Bonus ceiling for GDS and Casual Labourers would be considered by Department of Expenditure.</p>
<p><strong>9. REGULARISATION OF CASUAL LABOURERS</strong></p>
<p>Decision: The proposal of the staff side for regularization of all casual labourers would be considered after considering various Supreme Court judgements.</p>
<p><strong>10. FILLING UP OF EXISTING VACANT POSTS</strong><br />
Decision: Since there is no ban on recruitment, vacancies can be filled up. Instructions in this regard will be issued once again.</p>
<p><strong>11. UPGRADATION OF THE POSTS OF LOWER DIVISION CLERKS TO UPPER DIVISION CLERKS</strong></p>
<p>Decision: The demand of the staff side would be considered in consultation with other Ministries.</p>
<p><strong>12. GRANT OF ONE TIME RELAXATION TO THE CENTRAL GOVERNMENT EMPLOYEES WHO HAVE AVAILED LTC-80 AND TRAVELLED BY AIR BY PURCHASING TICKETS FROM OTHER THAN AUTHORIZED AGENCIES</strong></p>
<p>Decision: The proposal of Ministry of Defence in this regard is under examination of DOP&amp;T</p>
<p><strong>13. GRANT OF ENTRY PAY RECOMMENDED BY 6TH CPC TO THE PROMOTEES UNDER THE PROVISION OF CCS (RP) RULES 2008</strong></p>
<p>Decision: &#8211; The Judgment of Chennai CAT and Principal Bench New Delhi would be examined by DOP&amp;T and Department of Expenditure.</p>
<p><strong>14. REIMBURSEMENT OF ACTUAL MEDICAL EXPENDITURE INCURRED BY THE EMPLOYEES IN A RECOGNIZED HOSPITAL</strong></p>
<p>Decision:  A separate meeting would be held by the Health Ministry with the staff side to discuss this demand.</p>

<strong>OFFICE MEMORANDUM</strong></p>

Subject: <strong>Permanent absorption of Central Government employees and employees of the Union Territories in the autonomous bodies of the Union Territories counting of service for pension.</strong></p>
<p>The undersigned is directed to refer to the Department of Personnel &amp; AR‘s (now Department of Pension and Pensioners’ Welfare) O.M. No, 28/10/84-Pension Unit dated 29.8.84 down the provisions for regulating the cases of the Central Government employees going over to a Central autonomous; body or vice-versa for purpose of counting of past service for pension in the new organisation, and to say that certain Union Territory Administrations have sought clarification if the autonomous bodies of the UT’s financed wholly or substantially by the UT Administrations can be treated at par with the autonomous bodies of the Central Government for the purpose of implementing the instructions contain in O.M of 29.8.84 referred to above.</p>
<p>In this context it has also been pointed out by the UT Administrations that there are similarities between the administrations of the UTs and the Central Government extending to the terms and conditions of employment of the staff of the UTs, their scales of pay, then governance by the CCS (Pension) Rules, 1972 etc. It has, therefore, been urged that the benefit available to the employees of the Central Government when absorbed in autonomous bodies wholly or substantially financed by the Central Government and vice versa for counting of past service for pension, should also be extended to the employee of the UTs when absorbed in the autonomous bodies wholly or substantially financed by the Govts. Of UTs and vice versa.</p>
<p>2. The matter has been examined by this Department in consultation with the Ministry of Finance (Department of Exp.) and the following decisions have been taken:</p>
<p>(a) Central Govt. employees moving to autonomous/statutory bodies of the Union Territory will also get the benefit of O.M. dated 29.8.1984.</p>
<p>(b) Employees of the Union Territory moving to the Central autonomous / statutory bodies or Autonomous / Statutory Bodies of the same Union Territory will also be entitled to the benefit of O.M. dated 29.8.1984.</p>
<p>3. In so far as persons serving in the Indian Audit &amp; Accounts Department are concerned, these order are issued with the concurrence of the C&amp;AG.</p>

<div style="text-align: justify;">Subject: &#8211; <strong>Grant of Non-Productivity Linked Bonus (Ad-hoc Bonus) to Central Government Employees for the year 2011-12 — Extension of orders to Autonomous Bodies.</strong></div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Orders have been issued vide this Ministry’s Office Memorandum No.7/24/2007 E-III (A) dated 5th October, 2012 authorizing 30 days emoluments as Non-PLB (Ad-hoc bonus) for the accounting year 2011-12 to the eligible Central Government employees not covered by the Productivity Linked Bonus Schemes, subject to terms and conditions laid down therein.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">2. The undersigned is directed to say that it has now been decided that the Non-PLB (Ad-hoc) bonus so admissible subject to the terms and conditions laid down in the aforesaid orders, may be extended to the</div>
<div style="text-align: justify;">employees of autonomous bodies, partly or fully funded by the Central Government which (i) follow the pattern of pay structure and emoluments identical to that of the Central Government and (ii) do not have any bonus or ex-gratia or incentive scheme in operation.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">3. In case of doubt as to the operation of these orders the clarifatory orders, circulated vide this Ministry’s O.M No.14(10)E-Coord/88 dated 4.10.88, as amended from time to time, may be kept in view, mutatis</div>
<div style="text-align: justify;">mutandis.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">4. Any request for funding by the Government to meet the liability on account of Non-PLB (Ad-hoc bonus) in respect of various autonomous organizations would not be considered by the administrative Ministries</div>
<div style="text-align: justify;">concerned, having regard to the stipulation of aforesaid O.M. dated 5th October, 2012 that the expenditure on Non-PLB (Ad-hoc bonus) should be met from within the existing budgetary provisions of the respective</div>
<div style="text-align: justify;">organizations. While the Autonomous Bodies not funded by the Central Government may also adopt these orders as per their own administrative and financial judgment in respect of their employees, no liability for funding will in any case lie on the Central Government on this account.</div>

<div>The above subject was directed to the Competent Authority for extension of CGHS facilities, on their retirement, to all those Central Government employees who have proceeded to Statutory Bodies (SB) / Autonomous Bodies (AB) of Central SB / AB or proceeded to SB / AB on absorption basis subject to the condition that they are in receipt of Central Civil pension. The contributions to be made were to be decided by the Grade Pay that they would have now drawn in the Government in the post held by them but for their absorption in SB /AB.</div>

<div>In this context, it is clarified that all those Government employees who are on deemed deputation of Autonomous Bodies (Abs) Statutory Bodies (SBs) of the Central Government and retiring while on such deemed deputation to Abs / SBs will be eligible for CGHS facility, provided they are receiving Central Civil Pension and are not availing the medical facility provided by the ABs / SBs after their retirement. The contributions to be made will be decided by the Grade Pay that they would have now drawn in the Government in the post held by them but for their absorption of SBs /Abs.</div>
