<p>The undersigned is directed to say that this Department propose to frame the rules for appointment of Multi Tasking Staff in the Institution of Lokpal. A copy of the draft Lokpal (Group &#8216;C&#8217; Posts- Multi Tasking Staff) Rules, 2019 is enclosed. In terms of instructions contained in this Department&#8217;s OM No. AB-14017/61/2008-Estt.(RR) dated 13.10.2015, the above draft rules are hereby placed on the website of this Department for perusal of all concerned. It is requested that the comments of stakeholder, if any, may please be sent to this Department by post or email at &#8220;m.kumar1965gov.in&#8221; within 30 days from the date of uploading.</p>

<p style="text-align:center">MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS<br /> (Department of Personnel and Training)</p>



<p>In exercise of the powers conferred by sub-section (1) of section 59 of Lokpal and Lokayuktas Act, 2013, the President hereby makes the following rules for Group &#8216;C&#8217; Multi Tasking Staff posts in the Lokpal, namely:-</p>



<p>1. <strong>Short title and commencement</strong> &#8211; (1) These rules may be called the Lokpal (Group &#8216;C&#8217; PostsMulti Tasking Staff) Rules, 2019.<br /> (2) They shall come into force on the date of their publication in the Official Gazette.</p>



<p>2. <strong>Power of Lokpal to make Regulations</strong>. </p>



<p>The Central Government hereby vests powers in the Lokpal to make Regulations for the recruitment process.</p>



<p>Provided such recruitment shall be made on the recommendation of the Personnel Committee to be constituted by the Chairperson Lokpal and the said Committee shall be chaired by the Secretary, Lokpal or any other Officer of the Lokpal as authorized by him and shall have at least three Members.</p>



<p style="text-align:left">3. <strong>Number of post, classification, Pay level in the Pay Matrix</strong>:&#8211; The number of post, its classification, the pay level or pay scale attached thereto shall be as specified in columns (1) to (4) of the Schedule annexed to these rules.</p>



<p>4. <strong>Method of recruitment, age-limit, qualifications, etc</strong>. &#8211; The method of recruitment to the said post, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.</p>



<p>5. <strong>Disqualification</strong> &#8212; No person, &#8212;</p>



<ul class="wp-block-list"><li>(a) who has entered into or contracted a marriage with a person having a spouse living; or</li><li> (b) who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts:</li></ul>



<p>Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.</p>



<p>6. <strong>Power to relax</strong> &#8211; Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.</p>



<p>7. <strong>Savings</strong> &#8211; Nothing in these rules shall affect reservations, relaxations of age limit and other concessions required to be provided for the Schedule Castes, the Scheduled Tribes, other backward classes, ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.</p>

<p>Subject: <strong>Exemption from payment of examination fee and application fee in respect of Persons with Benchmark Disabilities</strong>. -reg.</p>



<p>The undersigned is directed to say that in a w.P. (Civil) No. 521/2008 with Civil Appeal No. 5389/2016, the Hon&#8217;ble Supreme Court, vide Judgment, dated 30.06.2016, inter alia, declared the Office Memorandum No. 36035/3/2004 &#8211; Estt.(Res) dated 29.12.2005, as illegal and inconsistence with the Persons with Disability (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. This OM, among other, contained a provision for exemption from payment of application fee and examination fee in respect of Persons with Disabilities.</p>



<p>Thereafter, with the enactment of &#8216;THE RIGHTS OF PERSONS WITH DISABILITIES ACT, 2016&#8217; and issue of notification titled &#8216;THE RIGHTS OF PERSONS WITH DISABILITIES RULES, 2017&#8217;, this Department has issued an Office Memorandum No. 36035/2/2017-Estt.(Res), dated 15.01.2018, regarding reservation for Persons with Benchmark Disabilities, in the posts and services of the Central Government. The said Office Memorandum dated 15.01.2018, however, does not contain any provision for exemption from payment of examination and application fee in respect of Persons with Benchmark Disabilities.</p>



<p>The issue has been deliberated upon at length in the Department and it has, now, been decided that the Persons with Benchmark Disabilities shall continue to be exempted from payment of application fee and examination fee, prescribed in respect of competitive examinations held by the Staff Selection Commission, the Union Public Service Commission, etc. for recruitment to various posts. This exemption shall be available only to such persons who would otherwise be eligible for appointment to the post on the basis of standards of medical fitness prescribed for that post (including any concession specifically extended to the Persons with Benchmark Disabilities) and who enclose with the application form, necessary certificate from a competent authority in support of their claim of disability.</p>

<p>Subject: <strong>Filling up the post of Executive Director (Engg&#8217;/IT) (JS Level) in Food Corporation of India, New Delhi under the Department of Food &amp; Public Distribution.</strong></p>



<p>Sir/ Madam,<br />
It is proposed to fill up the post of Executive Director (Engg.llT) (JS Level) in Food Corporation of India, New Delhi under the Department of Food &amp; Public Distribution with pay at Level 14 (Rs. 1,44,200-2,18,200/-) of the Pay Matrix on deputation basis vice Shri Syedian Abbasi , lAS (AM 1990).</p>



<p>2. Names of willing and eligible officers, who have been empanelled to hold Joint Secretary or equivalent posts at the Centre under the Central Staffing Scheme, may be recommended to this office along with cadre clearance, vigilance clearance, detailed bio-data, viz name, date of birth , service, batch , contact telephone number, email address, educational qualifications, complete experience/posting details etc. CR dossiers/certified ACRs for the last five years and details of debarment &amp; cooling off in respect of past central deputation. In case the officers are currently on Central deputation , the nomination may be forwarded with the approval of the Minister- in-charge concerned.</p>



<p>3. The post is a Non-Central Staffing Scheme post to be filled up through the Civil Services Board (CSB) procedure. It may be noted that no &#8216;Mandatory Posting Certificate&#8217; for allotment retention of Government accommodation would be issued by this office to the officer appointed on the above referred post. However, those officers who have served and are currently serving on Central Staffing Scheme post in Delhi for at least four years and require to retain Government accommodation, would be issued a certificate to the effect that the officer concerned has served for at least four years in CSS post and he/she needs to retain Government accommodation for his/her tenure on non-CSS post.</p>



<p>4. It is requested that the applications of the eligible candidates may be forwarded so as to reach this Department by 13.09.2019.</p>

<p>Subject: <strong>Amendment in Central Civit Services (Conduct) Rules, 1964 regarding acceptance of gifts by Government servants.</strong></p>



<p>The undersigned is directed to say that the following rules of Central Civil Services (Conduct) Rules, 1964 prescribing ceiling for receiving gifts by Government servants, have been amended vide G.S.R. No. 531 (E) dated 29.07.2019 (copy enclosed) so as to bring the uniformity in provisions of CCS (Conduct) Rules, 1964, AIS (Conduct) Rules, 1968 and Foreign Contribution (Acceptance or Retention of Gifts or Presentations) Rules, 2012:</p>



<table class="wp-block-table"><tbody><tr><td><strong>Before Amendment</strong></td><td><strong>After Amendment</strong></td></tr><tr><td><strong>Sub-rule (3) of Rule 13</strong><br /> In any other case, a Government servant<br /> shall not accept any gift without the<br /> sanction of the Government, if the value<br /> exceeds &#8211;<br /><br /> (i) rupees<strong> one thousand Five hundred</strong> in<br /> the case of Government servants<br /> holding any Group A&#8217; or Group B&#8217;<br /> post; and<br /><br /> (ii) rupees five hundred in the case of<br /> Government servant holding any Group<br /> &#8216;C&#8217; or Group &#8216;D&#8217; posts.</td><td><strong>Sub-rule (3) of Rule 13</strong><br /> In any other case, a Government servant shall not accept any gift without the sanction of the Government, if the value exceeds &#8211;<br /><br /> (i) rupees <strong>five thousand</strong> in the case of Government servants holding any Group &#8216;A&#8217; or Group B&#8217; post: and<br /><br /> (ii) rupees two thousand in the case of Government servant holding any Group &#8216;C&#8217; post.</td></tr><tr><td><strong>Sub-rule (4) of Rule 13</strong><br /> Notwithstanding anything contained in  sub-rule (2) and (3), a Government servant,  being a member of India delegation or otherwise, may receive and retain gifts from foreign dignitaries, if the market value of gifts received on one occasion does not exceed rupees one thousand. In all other<br /> cases, the acceptance and retention of such gift shall be regulated by the instructions issued by the Government in this regard from time to time.</td><td><strong>Sub-rule (4) of Rule 13</strong><br /> Notwithstanding anything contained in<br /> sub-rule (21 and (3), a Government servant, being a member of the Indian delegation or otherwise, D&amp;y receive and retain gifts from foreign dignitaries in accordance with the<br /> provisions of The Foreign Contribution (Acceptance or Retention of Gifts or<br /> Presentation) Rules, 2012, as amended from time to time.</td></tr></tbody></table>



<p>2. All Ministries/ Departments/ Offices are requested to bring the above amendments to the notice of all administrative authorities under their control.</p>
