<p>Subject : <strong>Fixation of Pay of Assistants of CSS in the Revised Pay structure as per the CCS (Revised Pay) Rules, 2008 – Clarification regarding.</strong></p>
<p>The undersigned is directed to say that references are still being received from Ministries/Departments regarding fixation of pay of Assistants in the revised pay structure. In this connection OM of even number dated 22.12.2010, enclosing there with Department of Expenditure UO No.10/1/2009-IC dated 14.12.2009, refers.</p>
<p>Instructions issued by this Department have to be read along with the under mentioned Rules and orders (as clarified, wherever required):</p>
<p><span style="text-decoration: underline;"><strong>(i) Department of Expenditure’s OM No.1/1/2008-IC dated 30th August, 2008, para 2(ii)</strong></span></p>
<p>“The tables in Annex-I will be applicable in cases where normal replacement pay scales have been approved by the Government. <span style="text-decoration: underline;"><strong>In cases of upgaradation of posts and merger of pre-revised pay scales, fixation of pay will be done as prescribed in Note 2A and 2B below Rules 7(1) and in the manner indicated in illustrations 4A …..</strong></span>“</p>
<p>(Therefore in the case of Assistants of CSS who have been given the upgraded post, the fixation of pay is to be done as prescribed in Note 2A below Rules 7(1) of CCS(RP) Rules, 2008)</p>
<p><span style="text-decoration: underline;"><strong>(ii) Note 2A below Rule 7 of CCS(RP) Rules, 2008</strong></span></p>
<p>&#8220;<strong>Where a post has been upgraded</strong> as a result of the recommendations of the Sixth CPC…. the fixation of pay in the applicable pay band will be done in the manner prescribed in accordance with Clause (A) (i) and (ii) of Rule 7 by multiplying the existing basic pay as on 1.1 .2006 by a factor of 1.86 and rounding the resultant figure to the next multiple of ten. The grade pay corresponding to the upgraded scale will be payable in addition. Illustration 4A in this regard is in the Explanatory memo to these Rules”.</p>
<p><span style="text-decoration: underline;"><strong>(iii) Rule 11 of CCS (Revised Pay) Rules, 2008</strong></span></p>
<p>&#8220;<strong>11. Fixation of pay in the revised pay structure subsequent to the 1st day of January, 2006. &#8211;</strong> Where a Government servant continues to draw his pay in the existing scale and is brought over to the revised pay structure from a date later that the 1st day of January 2006, his pay from the later date in the revised pay structure shall be fixed in the following manner :-</p>
<p>(i) Pay in the pay band will be fixed by adding the basic pay applicable on the later date, the dearness pay applicable on that date and the pre revised dearness allowance based on rates applicable as on 1.1.2006. This figure will be rounded off to the next multiple of 10 and will then become the pay in the applicable pay band. In addition to this, the grade pay corresponding to the pre-revised pay scale will be payable….”</p>
<p>(<strong>The fitment tables</strong> given in the Annex-I to the Department of Expenditures OM dated 30.8.2008 <strong>are to be used for pay fixation as done on 1.1.2006 only and incase of normal replacement pay scales</strong> as per para 2(i) and para 2(u) respectively of the aforesaid OM For fixation of pay in the revised pay structure <strong>subsequent to 1.1.2006</strong>, the Rule 11 of CCS(RP) Rules, 2008 refers).</p>
<p>2. The issue of fixation of pay with references to the pre-revised pay scale of Rs.7450-11500 and payment of arrears was taken up by Establishment Division of this Department with Department of Expenditure. A clarification dated 10.12.2013 issued by Estt (Pay) is enclosed.</p>
<p>3. It is further clarified that inclusion in the Select List does not ante date the seniority of the officers. However, the Select Lists as specified in this Departments OM No.6/3/2009CS.I(S) dated 9.7.20 10 may be deemed to be effective from 1st July of the year of the Select List, for the purpose of fixation of pay on notional basis only.</p>

<p>Vide the U.0. dated the 14th December, 2009, D/o Expenditure had allowed fixation of pay with reference to the pre-revised pay scale of Rs.7450-11500 to those promoted as Assistants / PAs between 1.1.2006 to 31.8.2008. They were, however, not allowed arrears from 1.1.2006 till the date of their promotion, as they had come over to the revised pay on the date of their promotion.</p>
<p>2. Seniors to such promotee Assistants / PAs, however, were subsequently allowed stepping up of their pay with reference to these officials. Such senior officials were also not allowed arrears on the ground that the officials with reference to whom they had got their pay stepped up were also not entitled toso.</p>
<p>3. The issue has been reconsidered in consultation with D/o Expenditure as this amounts to compelling the senior official, who was already serving as Assistant /PA prior to 1.1.2006 and opted for fixation of his pay under revised pay rules from 1.1.2006, to opt for revised pay structure from the date of stepping up with the junior.</p>
<p>4. It is, therefore, clarified that the senior is entitled to arrears of pay from the date he opted to come over to the Revised Pay Scales till the date of stepping up of pay. These will be paid on the basis of pay actually fixed as on 1. 1.2006.</p>
<p>5. The CS Divisions are, therefore, advised to issue a clarification in respect of similarly placed persons in CSS / CSSS.</p>

2. This Federation’s letter no. BPMS/OFB/SRO/22(7/2/L), dated 14.06.2012</p>
<p>Respected Sir,</p>
<p>With due regards, it is submitted that OFB had asked the comments/views of this Federation vide letter cited under reference (1) whereupon this federation forwarded its views vide letter cited under reference (2) whereby it had been requested that vide DOP&amp;T O.M. No. 20/49/2009-CS.II (B), Dated 22.06.2011 a new grade of UDC (Non Functional Selection Grade) has been created in Central Secretariat Services cadre in the grade pay of Rs. 4200/- in the Pay Band-2 with immediate effect with the condition that UDCs shall be eligible for placement in ‘NFSG’ on completion of 05 years service as UDC and the total number in the grade will be restricted to 30% of the sanctioned strength of UDC, hence, it should be incorporated in the proposed Recruitment Rules that 30% of UDCs (total sanctioned strength of UDC is 2125 in OFB) should also be placed in the new grade of UDC(NFSG) in the grade pay of Rs. 4200/- in the Pay Band-2 on completion 05 years regular service as UDC in the grade pay of Rs. 2400/-.</p>
<p>Employees were much hopeful that OFB would incorporate the above suggestion of BPMS but it is very painful to see the SRO 43, dated 24.06.2013 forwarded by OFB letter No. 288/RR/SRO/Clerical/A/NI, dated 14.08.2013 that nothing has been done in this regard.</p>
<p>However, you are requested to reconsider the issue and take appropriate action so that 30% of UDCs may be placed in the Grade Pay of Rs. 4200/- after completion of 05 yrs regular service.</p>

Subject: <strong>Appointment of direct recruit Assistants, Central Secretariat Service based on Combined Graduate Level Examination (CGLE), 2012-reg.</strong></p>
<p>The undersigned is directed to nominate the successful candidates recommended by Staff Selection Commission based on the CGLE, 2012 to the various participating Ministries/ Departments (Cadre Units) of Central Secretariat Service as detailed in Annexure.</p>
<p>2. The procedure for joining and imparting training (Foundation Course) to direct recruit Assistants of CSS shall be as per the revised design detailed in this Department O.M. No 7/8/2008-CS I(A) dated 16.10.2012.</p>
<p>3. The Cadre Units shall be responsible for completing the pre and post appointment formalities viz, character and antecedents verification in accordance with the instructions issued from time to time, medical examination etc in respect of nominated DR Assistants. Those candidates who are already in Government servile, their present employers may be requested to furnish copies of Verification/Medical Report The Cadre Units shall issue offers of appointment to the DR Assistants only after completing pre -appointment formalities. In the offer it may be stated in clear terms, inter alia, the mandatory nature of Foundation Course and its direct linkage to their probation period and their subsequent confirmation.</p>
<p>4. The Cadre Units will immediately inform the CS.I Division about the nominated candidates who join the allocated Cadre Units. On their appointment the Cadre Units should immediately enter their complete data in the web based Cadre Management System. The appointed Assistants will be nominated by CS.I Division in batches to the Foundation Course programme at ISTM for a period of 12 weeks Once CS I Division nominates DR Assistants for the training, they shall stand relieved from the concerned Cadre Units. No formal relieving order would be required to be issued by the concerned Cadre Units. It is once again reiterated that the Cadre Units shall indicate in unambiguous terms in the offer of appointment that successful<br />
completion of training is mandatory for completing the probation by the DR Assistants and their confirmation<br />
.<br />
5. In terms of this Departments OM. No.16/11/1993 dated 26/11/993 if offer of appointment is issued after completion of pre-appointment formalities, the time period allowed to join the post should in no case exceed three months. This condition should also be incorporated in the offer of appointment. After receiving verification and medical reports, the Cadre Units may issue the offer of appointment immediately to the candidates Cadre Units may also pursue the matter with the concerned District Authorities to expedite the matter so as to ensure that the candidates are appointed at the earliest.</p>
<p>6. The original certificates with reference to date of birth and educational qualification etc. shall be verified before appointments are made by the Cadre authorities. Copies of certificates submitted by candidates claiming to belong to the SC/ST/OBCs etc, may also be verified by the Cadre Units concerned.</p>
<p>7. In case of any doubt or suspicion as regards the eligibility or otherwise in respect of any of the recommended / appointed candidates, concerned administrative Ministry/ Department may correspond with the Staff Selection Commission giving therein complete details for getting such case(s) enquired through appropriate Government Agency.</p>

Nomination of successful candidates to the Assistants&#8217; Grade of Central Secretariat Service (CSS), on the basis of results of Combined Graduate Level Examination 2012 is expected very shortly, from Staff Selection Commission. These candidates will be allocated to the cadre units of <a href="http://centralgovernmentnews.com/category/css/">CSS</a> keeping in view the existing vacancies and other relevant factors. The participating Ministries and Departments are, therefore, requested to furnish the following information in respect of Assistants Grade to enable this Department to decide the allocations:-</p>

Subject : <strong>Posting of Section Officer and Assistant of CSS to the posts located at Faridabad and Nagpur under the Cadre controlling of M/o Agriculture.</strong></p>
<p style="text-align: left;">The undersigned is directed to refer to D/o Agriculture &amp; Cooperation OM No. 22013/2013-F.I dated 30th May, 2013 vide which they have requested to circulate the vacant posts of Section Officer and Assistant in the Directorate of Marketing &amp; Inspection located at Faridahad &amp; Nagpur and Directorate of Plant Protection Quarantine &amp; Storage at Faridabad among all Cadre Units of CSS. As these posts are outstation posts, they are required to be filled up in terms of guidelines laid don in <a href="http://centralgovernmentnews.com/category/dopt-orders/">DOP&amp;T</a>&#8216;s OM No. 21/2/2009-CS.I(P)  dated 5th October, 2012.</p>
<p>2. The Cadre Units of <a href="http://centralgovernmentnews.com/category/css/">CSS</a> are, therefore, requested to forward applications along  with the personal particulars in the enclosed format in respect of willing Section Officers / Assistants of CSS for being considered to the aforesaid vacancies by 12th July, 2013  positively. Substitutes in places of the selected officers will be provided in due course. While forwarding the request, vigilance status of the officer should also he indicated.</p>

<p style="text-align: left;">
Subject :- <strong>Continuation of ad-hoc appointment in the grade of Assistant of CSS-regarding.</strong></p>
<p>The undersigned is directed to refer to this Department&#8217;s OM of even number dated 21.12.2012 on the subject mentioned above, vide which Cadre Units were permitted to continue ad-hoc appointments in the grade of Assistant upto 30.06.2013. Further continuance of these appointments has been reviewed in this Department and it has been decided that the period of the ad-hoc appointment of those <a href="http://centralgovernmentnews.com/category/ldc-udc/">UDCs </a>of CSCS who are working as Assistants of CSS on ad-hoc basis may be extended upto 31.12.2013 or till regular Assistants become available, whichever is earlier.</p>
<p>2. Continuance of ad-hoc appointment shall not confer on the appointees any right to continue in Assistant Grade indefinitely or for inclusion in the Select List of Assistants of CSS or to claim seniority in Assistant Grade of <a href="http://centralgovernmentnews.com/category/css/">CSS</a>.</p>
<p>3. Further, extension of the ad-hoc appointment would be continued only if the ad-hoc Assistant attend and qualify the mandatory Level &#8216;A&#8217; training as and when nominated by CS.I (Training) Section of this Department, failing which their ad-hoc appointment would be terminated.</p>
<p>4. Other terms and conditions mentioned in the relevant OMs will remain unchanged.</p>

Subject : <strong>Rotational Transfer of officers Assistants’ Grade of CSS.</strong></p>
<p>The rotational transfers of regular officers of Assistants’ Grade of Central Secretariat Service who had completed the prescribed tenure in a Ministry under ‘Rotational Transfer Policy’ (RTP) were ordered vide this Department’s order of even number dated 27.12.2012. A copy of the same is availble on the website of this Department: www.persmin.nic.in  –&gt; Central Secretariat –&gt; CSS –&gt; Rotational Transfer Policy. Later on, in OM of even number dated 1.2.2013, the action to be tgaken in respect of officers posted outside National Capital Region, on deputation or on adhoc basis, was clarified.</p>
<p>2. Although many a participating Ministries/Departments have endorsed the relieving orders of the transferred officers to this Department, it has still to come from some of them. The Cadre-units are, therefore, again requested to comply with the orders dated 27.12.2012 and relieve the officers immediately. Attention of officers concerned is also invited to para 4 of order dated 27.12.2012 and they are advised to comply with it accordingly, under intimation to this Department.</p>
<p>3. A list of officers of Assistants’ Grade who have completed more than seven years in a same Ministry/Department and concerned officers are requested to check the list and bring to the notice of this Department if any of these is posted outside NCR or is on deputation etc or if there is any other error/omission in the list.</p>

<div>The undersigned is directed to inform that the procedure for joining and imparting training (Foundation Course) to DR Assistants of CSS as enunciated in Department of Personnel &amp; Training OM No 4/11/2005-CS-I dated 15.12.2006 and OM No. 1/1/2009-CSI (Trg) dated 24.2.2010 has been re-visited by this Department in consultation with various stake holders. Based on the suggestions and feedback, it has been decided to adopt a revised design of joining procedure for DR Assistants and their nomination for Foundation course from this year onwards. The modalities of the revised design are detailed below:-</div>
<div></div>
<div>2(i) After the receipt of dossiers of candidates from the SSC, CS-I Division of D0P&amp;T would allocate the candidates to different Ministries/Departments (hereinafter Cadre Units), who shall be responsible for completing the pre and post appointment formalities, viz. police verification, medical examination etc in respect of the DR Assistants allocated to them. The cadre units shall also be issuing offers of appointments to the DR Assistants after completing pre appointment formalities, delineating in clear terms, inter alia, the mandatory nature of Foundation Course and its direct linkage to their probation period and their subsequent confirmation.</div>

<div>(ii) The Cadre Units will immediately inform the CS Division about the DR Assistants who join the allocated Cadres. Based on the joining information of these DR Assistants in the Cadre Units. CS-I Division will nominate them in batches of 100-120 for their Foundation Course programme at ISTM for a period of 12 weeks.</div>
<div></div>
<div>(iii) Once CS Division nominates DR Assistants for the training, they shall stand relieved from the concerned Cadre Units. No formal relieving order would be required to be issued It is once again reiterated that the cadre units shall indicate in unambiguous terms in the offer of appointment that successful completion of training is mandatory for completing the probation by the DR Assistants and their confirmation.</div>
<div></div>
<div>(iv) The existing instructions on the subject which inter alia provides that Assistants who qualify Combined Graduate level Examination (hereinafter CGLE) would be directly nominated to ISTM for undergoing Foundation Course training thus stand superseded with the revised design spelt out in above paragraph.</div>
<div></div>
<div></div>
<div>(v) The successful candidates recommended by Staff Selection Commission based on the CGLE-2011 are accordingly allocated to various Cadre Units as detailed in the Annexure.</div>
<div></div>
<div>3. Till now all the pre appointment formalities were being carried out centrally by the CS Division of DoP&amp;T, concerned District Authorities were requested for verification of character and antecedents of the candidates qualified as DR Assistants through CGLE-2011.  Concerned District Medical Officers/Chief Medical Officers were also requested to conduct the medical examination of the candidates, Verification Reports and Medical Certificates received till date from the authorities are placed in the respective dossiers. For those candidates who are already in Government service, their present employers had been requested to furnish copies of Verification/Medical Report. These reports wherever received are placed in the respective dossiers of the candidates Verification/Medical Reports received in CS Division after dispatch of dossiers will be sent to concerned Cadre Units as and when the same are received.</div>

<div>4. In terms of this Departments OM No 16/11/93-CS.I dated November 26, 1993 if offer of appointment is issued after completion of pre-appointment formalities, the time period allowed to join the post should in no case exceed three months. This condition should also be incorporated in the offer of appointment. The Cadre Units may accordingly issue the offers of appointment immediately to those candidates whose verification and medical reports have been received. Where the verification reports ar yet to be received, Cadre Units may pursue the matter with concerned District Authorities to expedite the matter so as to ensure that the candidates are appointed at the earliest.</div>

<div>5. The original certificates with references to date of birth and educational qualification etc, shall be verified before appointments are made by the Cadre authorities. Copies of certificates submitted by candidates claiming to belong to the SC/ST/OBC etc in support of their Claim have been added to their respective dossiers. These claims may also be verified by the Cadre Units concerned.</div>

<div>6. ISTM has scheduled to start the 1st batch of Foundational Training Programme for DR Assistant for about 120 candidates from 21st November 2012 for a duration of 12 weeks. As such, Cadre Units are requested to Issue offers appointment in clear cases without any delay and inform the CS Division about the joining of the candidates so that timely action in the matter of conduct of the scheduled Foundation Course Programme may be taken.</div>

<div>7. In case of any doubt or suspicion as regards the eligibility or otherwise inrespect of any of the recommended/appointed candidates, concerned administrative Ministry/Department may correspond with the Staff Selection Commission giving therein complete details for getting such case(s) enquired through appropriate Government Agency</div>

<div><strong>Change in designations of Assistants of CSS</strong></div>

<div>When answering in Rajya Sabha to the unstarred question about change of designation of the Assistant and Section Officers of CSS, the Minister of State in the Ministry of Personnel, Public Grievances and Pensions Shri.V.Narayanasamy said that there was no such agreement between Government and CSS/CSCS associations. In the 57th Ordinary Meeting of the Departmental Council (JCM) of DoP&amp;T, held on 8.5.2010, a demand was raised by the staff side to re-designate the posts of LDC/UDC and Assistant in Central Secretariat. The Official side had expressed its “No Objection” to the proposal. The staff side was asked to come up with their suggestions in this regard. These posts have not been re-designated.</div>

<div>The Department Related Parliamentary Standing Committee on Home Affairs in its Sixtieth Report and Eighty-third Report had recommended conferment of Group ‘A’ status to the Section Officer of CSS and re-designate the post as ‘Assistant Secretary to the Government of India’.</div>

<div>The Fifth Central Pay Commission had not agreed to the restoration of designation of Assistant Secretary to the Section Officers which was accepted by the Government. Accordingly it was not found feasible to re-designate the post of Section Officer. This was mentioned in Action Taken Note to 60th Report of Parliamentary Standing Committee on Home Affairs published in 68th Report. This was reiterated in Action Taken Report to 83rd Report of the Committee also.</div>
