<p><strong>Subject: An appeal to release 3% of Dearness Relief installment due wef 01.07.2021</strong>.</p>



<p>Respected Madam,</p>



<p>Govt. Pensioners of the country always look to you as their savvier. As you are well aware of the plight of pensioners who are essentially the Sr Citizens. We need not point out that post Carona-Pandemic cost of living for this category with old age vagaries has steeply risen. Pensioners do not get Bonus or other allowances except the Dearness Relief which as per ground reality though not sufficient to 100% neutralize the rising cost of living but undoubtedly provide some solace.</p>



<p>Normally, DR due from Ist of July is released before ‘Durga Puja’. This year though the Bonus is paid to the Government employees. Pensioners who were very hopeful that DR due will be credited to their Bank/PO accounts before “Vijay Dashmi” are disappointed. Alas! they are still looking to you with hope.</p>

<h3 class="wp-block-heading">Sub: Brief of the meeting held today with the Cabinet Secretary (Government of India)</h3>



<p>Met today with the Cabinet Secretary (Government of India) and handed him over a copy of our letter dated 16th January 2021, expressing our anguish over the freezing of Dearness Allowance/ Dearness Relief payable to the Central Government Employees and Pensioners/ Family Pensioners. I also demanded for payment of Dearness Allowance/ Dearness Relief with arrears since 01.01.2020.</p>



<h2 class="has-text-align-center wp-block-heading"><strong><a href="https://centralgovernmentnews.com/expected-da-2021/" target="_blank" rel="noreferrer noopener">Expected DA 2021</a></strong></h2>



<p>During the course of the discussion, the Cabinet Secretary said that the country was passing through an unprecedented situation, that is why, Government had to take such an action, but he further said that there should not be any doubt that freezing of Dearness Allowance/ Dearness Relief will continue even after 30th June 2021.</p>



<p>I also asked him that, no action has been taken in our letter dated 11th January 2021 (Reg. the undue delay in settling the issues discussed in the meeting of the Standing Committing of NC/JCM and 47th meeting of the NC/JCM). He immediately called Addi. Secretary(Esstt.), DoP&amp;T, and asked her to organize all the meetings due as well as to get implemented the issues agreed in the meetings of the NC/JCM referred to above.</p>

<p>The Union Cabinet, chaired by the Prime Minister, Shri Narendra Modi has approved to release an additional instalment of <a href="https://centralgovernmentnews.com/category/dearness-allowance/" target="_blank" rel="noreferrer noopener" aria-label="Dearness Allowance (opens in a new tab)">Dearness Allowance</a> (DA) to Central Government employees and <a href="https://centralgovernmentnews.com/category/dearness-relief/" target="_blank" rel="noreferrer noopener" aria-label="Dearness Relief (opens in a new tab)">Dearness Relief</a> (DR) to pensioners w.e.f. 01.01.2020.  </p>



<p><strong>There will be an increase of 4 percent over the existing rate of 17 percent of the Basic Pay / Pension, to compensate for price rise.</strong></p>



<p>The combined impact on the exchequer on account of both Dearness Allowance and Dearness Relief would be Rs.12,510.04 crore per annum and Rs.14,595.04 crore in Financial Year 2020-21 (for a period of 14 months from January, 2020 to February, 2021). It will benefit about 48.34 lakh Central Government employees and 65.26 lakh pensioners.</p>



<p>The increase is in accordance with the accepted formula, which is based on the recommendations of the 7th Central Pay Commission.</p>

<p>Today, the central government increased the dearness allowance (DA) and the dearness relief by 4% to 21%, helping 30 lakh central government employees and 50 lakh retired citizens.</p>



<p>“Release of additional installment of DA is an increase of 4 per cent over the existing rate of 17 per cent of the basic pay/pension, to compensate for price rise,” according to an official statement.</p>

<p>At its meeting today, the Union Cabinet led by Prime Minister Narendra Modi, approved the introduction of an additional installment of Dearness Allowance for Central Government employees and Dearness Relief for pensions with effect from 01.01.2020 reflecting an increase of 4 percent over the current rate of 17 percent of Basic Pay / Pension to account for the price rise.</p>



<p>According to this Central Government DA statement, with this 4 percent Dearness Allowance Hike, total DA has to be paid at a rate of 21 percent from 1 January 2020. Payment of additional DA for January and February 2020 months will be payable as arrears.</p>

<p><strong>Heard</strong>.</p>



<p>The petitioner has filed this petition under Article 226 of the Constitution of India seeking following relief:</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>(i) To issue a writ in the nature of mandamus by directing the respondents to pay the annual increment fell due on 01.07.2015 to the petitioner.</p><p>(ii) To direct the respondents to pay the annual increment i.e. pay scale of 20440-5400 and arrears due from 01/07/2015 with interest of 6% per annum.</p><p>(iii) To grant any other relief, which this Hon’ble Court may deem fit and proper in the facts and circumstances of the case including cost of the litigation in favour of the petitioner.</p></blockquote>



<p>On 30.09.2019, learned counsel for the respondents was granted time to seek instructions as to how the petitioner can be refused the benefit of grant of annual increment which is to be added on 1st of July of every year, but, no response has been filed.</p>

<p>The petitioner was retired from service w.e.f. 30.06.2015. The increment, which was to be granted on 1st of July, 2015 was denied to him on the ground that he retired on 30.06.2016 and was not in service on 1st of July, 2015.</p>



<p>Learned counsel for the petitioner has relied upon a decision of the Madras High Court in the case of P. Ayyamperumal vs. The Registrar, Central Administrative Tribunal and others-WP No.15732/2017 decided on 15.09.2017, which was later on affirmed by the Supreme Court. Considering the law laid down by the Division Bench of the Madras High Court it is clear that the petitioner cannot be denied the increment which was due on 01.07.2015 merely because he got retired on 30.06.2015, since he has completed full years of service and was eligible to get the said increment. Since the case on which the petitioner is placing reliance is squarely covered with the case of the petitioner, nothing is required to be adjudicated in this petition.</p>



<p>Accordingly, the petition is allowed directing respondents to extend the benefit of annual increment to the petitioner which was due on 01.07.2015 and accordingly the retiral dues of the petitioner be revised and he be also paid arrears within a period of three months from submitting certified copy of this order.</p>

<p>I would like to brought this to the kind notice of the Secretary, Department of Posts that after implementation of new TRCA to the GDS vide order dated 25-06-2018, all regularly working GDS have been dawn new TRCA w.e.f 01-07-2018. In case of substitutes working in place of GDS viz., vacant posts. officiating to Departmental posts (Postman/MTS/MG) and on other reasons has not drawn their allowances as per new TRCA slabs w.e.f 01-07-2018.</p>
<p>Further it is requested to issue the instructions to draw the arrears also from 01-01-2016 to 30- 06-2018 to the substitutes working in place of GDS. As it was drawn also at the time of implementation of Natarajamurty Committee recommendations vide Lr.No. No.6-1/2009-PE.II, Dated : 30-05-2012.</p>
<p>Hence it is requesting our Hon’ble Secretary. Department of Posts kindly cause to issue necessary instructions to the concerning authorities on the subject at the earliest in favour of GDS.</p>

<p>University Grant Commission has published an important order regarding the arrears of 7th Pay Commission for Non-Teaching Staff of Central Universities.</p>
<p>As per the instructions received from the Ministry of Human Resources Development(MHRD), 30% of additional liability by Central Universities for implementation of 7th CPC recommendations for Non-Teaching Staff of Central Universities.</p>
<p>The UGC (Under MHRD) has already released 70% of arrears from 1.1.2016 to 31.12.2017 to University/College Teachers and Other Academic Staff, University Officers, Non-Teaching Staff and Teachers working in Model Schools.</p>

<p>Sub: <strong>Payment of revised pension including arrears w.e.f. 1.1.2016 to the pensioners.</strong></p>
<p>Kindly refer to RBA No.170/2017 dated 30.11.2017 on the above subject. requesting Railways to verify the scrolls received from various Pension Paying Banks to establish that payment of revised pension has commenced in favour of all pensioners for whom revised PPOs have been issued. It is understood that despite lapse of nearly 6 months, revised pension is not being received by many pensioners and the issue is being raised in various Pensioners’ Forums including SCOVA.</p>
<p>Follow up on payment of revised pension by the banks is necessary to take the benefits to the pensioners in a timely manner. Therefore, a special drive may be launched in the EDP centres to reconcile the debit scrolls with the revised PPOs to ascertain the number of cases where payment of revised pension has not yet been initiated by the banks despite issue of revised PPOs. The matter may be taken up with defaulting Banks and a report sent at jda@rb.railent.gov.in in the following format by 30th June,2018 for Board&#8217;s information:</p>
