<h2 class="has-text-align-center wp-block-heading">DUAL BENEFITS OF FIXED MEDICAL ALLOWANCE AND ECHS MEMBERSHIP</h2>



<ol class="wp-block-list"><li>It is reiterated that as per policy, dual benefits of Fixed Medical Allowance (FMA) and ECHS Membership cannot be availed simultaneously. FMA has to be foregone before acquiring ECHS Membership. However, vide MoD (DoESW) letter No 22(01)/2011/WE /D(Res-l) dt 01 Nov 2018, sanction has been accorded by the Govt to those ECHS members who reside in districts not having any ECHS Polyclinics, MH Rooms or Service Hospitals to choose to claim FMA with conditions as mentioned in the governing letter.</li><li>Cases have been brought to the notice of this HQ where ECHS beneficiaries have been availing the benefits of FMA and ECHS simultaneously, whether willingly or inadvertently. This is violation of poticy on the subject. Therefore, while receiving new 64KB ECHS cards, the primary ECHS beneficiary will submit a certificate of non-drawal of FMA issued by the bank/CPPC/DPDO.</li><li>There maybe instances as mentioned at Para 2 above wherein an ECHS beneficiary may have been drawing FMA while also simultaneously being an ECHS member. In such cases, FMA will have to be ceased followed by submission of non drawal of FMA certificate to the Polyclinic. In addition, there will be a requirement to recover the non entitled previously claimed FMA by the PCDA from the ECHS beneficiary. <strong>However, in all such cases, medical benefits through ECHS will immediately commence on submission of the non-drawal of FMA certificate and recovery of previously claimed FMA will not be kept as a condition for commencement/ restoration of ECHS benefits.</strong></li><li>Recovery cases as brought out at Para 3 above will be communicated by the concerned Polyclinic to the ECHS Regional Centre who will further communicate the same to the respective Records Offices to undertake necessary steps with PCDA (P) to effect reimbursement as applicable.</li></ol>

<p><strong>Subject:- Grant of dual (Two) family pension from Military as well as Civil employment.</strong><br />Reference:- This office Circular No. 504 dated 17.01.2013 and Circular no. 514 dated 05.09.2013</p>



<p>A reference is invited to this office circular no. 514 dated 05.09.2013 under which PDA will make payment of family pension from both side i.e. Army in addition to Civil side w.e.f. 24.09.2012 in the cases where name of spouse has already been jointly notified.</p>



<p>2. The complaints received in this office regarding non payment of dual family pension in some cases wherein jointly notification was cancelled after getting option to draw beneficial family pension either from civil side or military side in accordance to Gol, MoD letter no. 10(6)/92/D(Pen/Sers) dated 28/09/1992 and it takes a lot of time to get sanction his/her legitimate right of dual family pension on or after 24/09/2012 as applicable after demise of the deceased soldier. <strong>In such cases the beneficiaries are advise to process the case for notifying his/her entitlement for grant dual family pension w.e.f. 24/09/2012 from Army by issuing afresh PPO for joint notification or family pension, as the case may be, through Record office concerned and other cases will be dealt with accordance to provisions of Circular no. 514 of this office</strong>.</p>

Hence, Direct Entry Pay would be admissible only to Sgts of Education Instructor trades As an illustration, if a Col acquires sufficient qualification and re-musters to Education Instructor and thereafter. he is promoted to the rank of Sgt on or after 1.1.2006 and on promotion it the pay is fixed at a rate less than the pay of the Direct Entry of an Education instructor Sgt, his pay would be stepped up to the Direct Entry Pay from the date of promotion on or after 1.1.2006.</li><li>These instructions will be applicable with effect from 01.01.2006.</li><li>This issues with the concurrence of Finance Division of this Ministry vide their Dy. <h3 class="wp-block-heading">Sub: Revision of Regulation relating to rate of Family Pension (Normal rate &amp; Enhanced rate) of Pension Regulation for the Army, Part-I (2008) in the line of amendment done in Sub Rule (3) of Rule 54 of CCS Pension Rule, 1972 by DoP&amp;PW-reg.</h3>



<p>Sir,</p>



<p>The undersigned is directed to refer to the provision of Note 3 (i) &amp; (ii) below Army Instruction 51/80 and Regulation 64 (b) in Pension Regulation for Army, Part-I (2008) under which the minimum of 7 years of continuous qualifying service is required for grant of enhanced rate of Family Pension for the Armed Forces personnel.</p>



<p>2. Consequent upon issue of Gazette Notification No. 550 dated 19.09.2019 of the Ministry of Personnel, Public Grievances &amp; Pensions, Department of Pension and Pensioners’ Welfare (DoP&amp;PW), the condition of minimum requirement of 7 years of continuous service for grant of enhanced rate of Ordinary Family Pension in the sub rule (3)(a) &amp; (b) of Rule 54 of CCS Pension Rule, 1972 has been deleted w.e.f 1st October, 2019 and now Government servants who died in service/ invalided out even with less than 7 years of qualifying service shall be eligible for enhanced rate of Family Pension. This notification also has a provision where a Government servant who died within ten years before the 1* day of October 2019 without completing continuous service of seven years, his family shall be eligible for family pension at enhanced rates in accordance with sub rule (3) with effect from the 1° day of October 2019, subject to fulfillment of other conditions for grant of family pension.</p>



<p>3, . Now, the President is pleased to decide that the same provision shall be extended to Armed Forces Personnel also. Accordingly, the clause &#8220;after having rendered not less than 7 years continuous qualifying service&#8221; of Regulation 64{b) of Pension Regulations for the Army, Part-I (2008) stands deleted w.e.f. 01.10.2019.</p>

<p>4. It has also been decided that where an Armed Forces Personnel died within ten years before the 1° October, 2019 without completing continuous service of seven years, his family shall be eligible for ordinary family pension at enhanced rate as per Regulations 64(b) of Pension Regulations for the Army Part-I (2008) with effect from the 1st October 2019 subject to fulfillment of other conditions for grant of Ordinary Family Pension.</p>



<p>5. Further, the provision of Army Instruction No. 51/1980 would stand modified upto this extent w.e.f. 01.10.2019. The regulation and their instructions for grant of Ordinary Family Pension in Navy and Air Force shall also be amended accordingly.</p>



<p>6. This issues with the concurrence of the Finance Division of this Ministry vide their ID No. 10(02)/2020/FIN/ PEN dated 23.09.2020.</p>

<p>2. All Ex-Servicemen/ Primary beneficiaries who apply online for new 64 Kb ECHS Cards have been permitted to download online temporary slip as per category given at Para 2 of CO, ECHS letter No B/49711-New Smart Card /AG/ ECHS dated 19 Dec 2018 (copy attached).</p>



<p>3. Due to backlog in printing of Cards and disruption in distribution of 64 Kb ECHS Cards due to <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">COVID-19</a></strong>, the Competent Authority has approved the extension of the validity of online temporary slip till <strong>31 Dec 2020</strong>. All the temporary slips endorsed as &#8220;valid upto 30 Jun 2020&#8221; will need no further validation from OIC Polyclinic and will be deemed as valid till 31 Dec 2020. All Polyclinics and empanelled hospitals may be informed accordingly to accept the same.</p>



<p>4. It may also be noted that all temporary slips will be collected back at the time of issue of 64 Kb Cards by issuing tin HQ.</p>

<p>2. The rates for investigations from S No 1(a) to 1(z) are for NABL/ NABH accredited &#8220;COs. The rates for Non-NABL/ Non-NABH accredited HCOs shall be 15% less.</p>



<p>3. The revised rates mentioned in above be disseminated to the ECHS Polyclinics, Empanelled HCOs and to the SEMOs.</p>



<p>4. The rates would be applicable from the date of issue of this letter.</p>

<p>Reference: GoI, MoD letter No. 1(1)/2001/D (Pen-C) dated 24 June 2005</p>



<p>Of late it has been observed that the complaints are being received from widow of Armed force personnel died prior to 01.01.1996 regarding non-payment of Liberalised family pension to the widows who were in receipt of LFP and subsequently LFP was stopped / converted into OFP due to her remarriage before 01.01.1996 with a person other than the real brother of her deceased husband. In terms of Gol, MoD letter no. 200847/Pen-C/71 dated 24.02.1972, the LFP sanctioned to widow was stapped and further converted into OFP after her remarriage with a person other than real brother of the deceased soldier.</p>



<p>In accordance to Gol, MoD letter No. 1(1)/2001/D(Pen-C) dated 24 June 2005, Liberalised family pension of such widows who remarried before 01.01.1996 and whose LFP were stopped and concerted into OFP due to their remarriage are now regulated in terms of para 6.6 of Gol, MoD letter No. 1(2)/97/D(Pen-C) Dated 31.01.2001. The actual benefit arising out of this order will be payable w.e.f 24.06.2005.</p>



<p>In view of the above you are requested to review all the affected cases where LFP was not yet restored to widaw as per Gol, MoD letter No.-1(1)/2001/D(Pen-C) dated 24 June 2005 by issuing afresh PPO. Such cases after review may please be sent to OI/C, G-4 section of this Office enclosing following documents-</p>



<p>i) Corr. LPC- cum datasheet along with the proforma (attached as annexure &#8216;A&#8217; duly supported with sheet roll.</p>



<p>ii) Family pension claims for restoration of  LFP.</p>



<p>iii) A certificate regarding supporting/non-supporting of child (ren) countersigned by the zila sainik along with family details as per annexure B.</p>



<p>iv) An application from widow for restoration of Liberalised family pension</p>



<p>v) Last payment certificate by PRA, where date upto which Liberalized Family Pension was paid to widow and date of stoppage of Liberalized family pension is clearly mentioned.</p>



<p>vi) Descriptive roll of widow duly affixed recent photographs.</p>

<p>Sir,</p>



<p>In continuation of this Ministry&#8217;s letter No. PC 1(2)/97-D (Pen-C), dated the 16th May, 2001 on the subject mentioned above, I am directed to convey the sanction of the President to grant Liberalised Family Pension to a widow whose liberalised family pension was stopped on her remarriage before 01.01.96 with a person other than the real brother of the deceased. Such pension may be regulated in terms of para 6.6 of this Ministry’s letter No. 1(2)/97/D(PEN-C) dt. 31.01.2001.</p>



<p>2. The actual benefit arising out of this order will be payable from the date of issue of this letter. </p>



<p>3. Pension Regulations of the three Services will be amended in due course.</p>



<p>4. This issues with the concurrence of Defence(Finance) vide their UO No. 2907/Fin/ Pen dated 24.6.05.</p>

<p><strong>PRIORITY FOR WAR DISABLED VETERANS AND BATTLE CAUSALITIES IN OPD OF ARMED FORCES HOSPITALS</strong></p>



<p>War Disabled Veterans form a very distinguished class of veterans. A large number of War Disabled Veterans/ Battle causalities are arnputation cases, amputated due to injuries sustained in war and war like conditions and have restricted mobility. In view of this special disposition, they rightfully deserve certain privileges. AFMS has always remained committed in providing them priority in AFMS hospitals.</p>



<p>Henceforth, War Disabled Veterans/Battle Causalities (self only) may be offered Specialist consultation directly at the OPDs of Armed Forces hospitals on OPD days, without obtaining a referral from the ECHS Polyclinics. However, these veterans will continue to avail services of their dependant polyclinic for routine illnesses.</p>



<p>Necessary instructions may please be issued to all concerned.</p>

<p style="text-align:center">Ministry of Defence<br /> <strong>Army conducts Children Summer Adventure Camp 2019 at Mount Abu</strong></p>



<p style="text-align:right">28 MAY 2019</p>



<p>Southern Command Children Summer Adventure Camp 2019 is being organised at Mount Abu from 27 May to 03 June 2019. The eight day camp is being conducted under the aegis of 8 MADRAS Battalion of Battle Axe Division.  This camp offers opportunity to the participating children to instill a spirit of adventurism and personality development.</p>



<p>Around 125 children from units of entire Southern Command of Indian Army subscribe to attend the camp. During their stay in camp children enthusiastically participate in various indoor &amp; outdoor activities, including trekking, caving, boating, various games &amp; competitions.</p>



<p>The camp provides opportunities to explore the nature, make new friends, develop new &amp; diverse interests and create lasting memories.  The organisers of the camp also intend to motivate the children towards adoption of new hobbies, shouldering responsibilities, goal setting &amp; achieving the same.  Towards that, various activities like introduction to yoga &amp; meditation techniques, lectures on safety, security &amp; social graces are also conducted.</p>



<p>This camp is conducted every year by Army at Mount Abu during the summer vacations of children, providing them a platform of learning and adventure coupled with fun &amp; frolic.</p>

<p>S.R.O ……. (E) .- In exercise of the powers conferred by the proviso to alticle 309 of the Constitution, the President hereby makes the following rules to amend the Army Pay Rules, 2017, namely: &#8211;</p>



<p>Short title and commencement. &#8211; (1) These rules may be called the Army Pay (Amendment) Rules, 2019.</p>



<p>(2) They shall be deemed to have come into force on the 1st day of January, 2016.</p>



<p>In the Army Pay Rules, 2017, in rule 5, in sub-rule (3), for clause (v), the following clause shall be substituted, namely:-</p>



<p>&#8220;(v) Group &#8216;X&#8217; Pay shall be counted as pay for the purpose of computation of dearness allowance and pension&#8221;.</p>

<p><strong>Explanatory Memorandum</strong>&#8211; The recommendations of the Seventh Central Pay Commission have been implemented with effect from the 1st day of January, 2016. Likewise, the Defence Personnel of the Union of India are eligible for Seventh Central Pay revision with effect from the 1st day of January, 2016. Accordingly, the said rules have been given retrospective effect with effect from the 1st day of January, 2016. It is hereby, certified that by giving retrospective effect to the said rules no one , will be adversely affected.</p>



<p><strong>Note</strong>:- The Army Pay Rules, 2017 were published in the Gazette of India, Extraordinary, Part II, section 4 vide notification, number S.R.O. 9(E), dated the 3rd May, 2017.</p>
