<p>Cabinet approves encashment of accumulated leave to certain Defence Services Personnel who died or were invalidated out while in service between 30 December 1991 to 29 November 1999 with less than 15 years of service</p>
<p>The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has approved leave encashment up to 180 days in respect of those Defence personnel who died or were invalidated out of service between 30.12.1991 to 29.11.1999 with less than 15 years of service.</p>
<p>The decision will benefit the families of 9777 Officers and other personnel of Defence Services who died or were invalidated out of service during this period. This period is very significant as a large number of casualities took place during the Kargil conflict (&#8220;Operation Vijay&#8221;) and in counter insurgency operation in J&amp;K and North East during the period.</p>

<p>Sub:- <strong>Revision of enhanced rate of Ordinay Family Pension in respect of Pre- 2006 Armed Force Pensioners.</strong></p>
<p>The undersigned is directed to refer to this Ministry’s letter No. dated 11.11.2008, issued for implementation of Government decisions on the recommendation of 6th CPC for revision of<br />
pension/family pension in respect of pre-2006 Armed Force Pensioners/family Pensioners.</p>
<p>2. As per provision contained in Para-3 of this Ministry letter No. 2(1)/2012/D(Pen/Policy) dated 16.1.2013. the revised consolidated enhanced rate of Ordinary Family Pension 01.01.2006 in respect of Pre-2006 Armed Forces Family Pensioners shall not be less than 50% of the minimum of the pay in the pay-band plus the grade pay including Military Service Pay corresponding to the pre-revised scale from which the pensioner had retired field.</p>
<p>3. Now, arter issue of GOI, MOD letter No.1(04)/2015(II)-D(Pen/Pol) dated 03.09.2015 on the basis of GOI, Ministry of Personnel, PG &amp; Pensioners, Department of Pension &amp; Pensioners’ Welfare 0M No. dated 30.7.2015, it has been decided that the minimum guaranteed enhanced rate of Ordinary Family Pension of all Pre-2006 pensioners may be revised w.e.f.01.01.2006 on the basis of the minimum of fitment table for the rank in the revised Pay Band as indicated under fitment tables annexed with SAI 1/S/2008, SAI 2/S/2008 &amp; SAI 4/S/2008 as amended and equivalent instructions for Navy and Air Force. The revised consolidated enhanced rate of Ordinary Family Pension w.e.f. 01.01.2006 in respect of Pre-2006 Armed Force Family Pensioners shall not be less than 50% of the minimum of the fitment table for the rank in the revised Pay Band. In case where full revised pension is otherwise not authorized to a retired employee in terms of 6th CPC order, the revised enhanced rate of Ordinary Family Pension shall be restricted to that amount. The amount of revised enhanced rate of Ordinary Family Pension in no case shall be less than thirty percent ot the minimum of fitment table for the Rank or thirty percent of the minimum of fitment table in the case of HAG and above.</p>
<p>4. However, in respect of consolidated enhanced rate of Ordinary Family Pension calculated as per Para 4.1 of this Ministry’s letter No. 17(4)/2008(1)/D(Pen/Policy) dated 11.11.2008 is higher than the Family Pension calculated in the manner indicated above, the same shall be continued.</p>
<p>5. This order will take effect from 01.01.2006 and arrears, if any: shall be payable from 01.01.2006 to 23.09.2012 or till effective period of enhanced rate of Ordinary Family Pension admissible. whichever is earlier.</p>
<p>6. All other terms and conditions shall remain unchanged.</p>
<p>7. Pension Regulations Of all the three services will be amended in due course.</p>
<p>8. This issues with the concurrence of Finance Division of this Ministry vide their ID No.PC.2 to dated 02.06.2016.</p>

										<content:encoded><![CDATA[<p><strong>Reviewing Pay and Allowances of Armed Forces Personnel</strong></p>
<p>The Government entrusted the task to a Pay Commission in 1973, at the time of setting up of 3rd Central Pay Commission. The Government had set up a Post War Pay Committee in 1947, a departmental pay committee (Raghuramiah Committee) during 1959-60 and another Departmental Committee in 1967 for review of pay and allowances of Defence Forces Personnel. There was general discontentment amongst the Services with respect to the recommendations of these Committees. Thereafter, the Government decided to entrust the examination of structure of emoluments, including benefits in cash and kind and death cum retirement benefits of the Armed Forces to the 3rd Central Pay Commission.</p>
<p>The terms of reference with respect to the Armed Forces personnel were different to the extent that the 3rd Central Pay Commission was not required to make recommendations on the conditions of service of the Armed Forces personnel. Though, the matters related to pension of Defence Service personnel was referred to 3rd Pay Commission, there has been no clubbing with civilians. The Commission felt that by and large, the principles followed by Armed Forces Pension Revision Committee (AFPRC) continue to be valid. The 3rd Pay Commission had considered the peculiar conditions of service and hierarchical set up of the Services, age of retirement, period of qualifying service pension etc. in respect of Armed Forces personnel. As such there has been no mistake in entrusting the matter to 3rd Central Pay Commission.</p>
<p>This information was given by Defence Minister Shri Manohar Parrikar in a written reply to Shri Mahendra Singh Mahra in Rajya Sabha today.</p>

<p>Subject: <strong>Payment of Constant Attendance Allowance (CAA) on monthly basis with disability pension to Armed Forces personnel – Reg.</strong></p>
<p>Sir,<br />
The undersigned is directed to state that as per Regulation 89 of Pension Regulation for the Army Part-l (Edn-2008) and equivalent provisions in Navy and Air Force Pension Regulations, payment of Constant Attendance Allowance is made in arrears twice in a year along with disability pension/ war injury pension on the basis of declaration/certificate submitted by the pensioner to his/ her pension disbursing agency (PDA) in May and November each year subject to fulfillment of other prescribed conditions.</p>
<p>2. Keeping in view of the hardships being faced by the disabled pensioners in claiming Constant Attendance Allowance. Government was reviewing the said provision from quite some time. In partial modification of above provision, the President is now pleased to decide that henceforth Constant Attendance Allowance shall be paid on monthly basis during the period of award along, with disability or war injury pension as the case may be.</p>
<p>3. Concerned Armed Forces Pensioners shall submit a declaration on the format enclosed as Annexure with this order to their pension disbursing agency at the time of initial payment of CAA and thereafter on annual basis at the time of his/her annual identification. During initial declaration pensioner shall state in item III of the Annexure that he/she will employ an attendant for the upcoming one year or up to the date for which CAA has been sanctioned whichever is earlier. During subsequent annual declarations pensioner would also complete item II of the Annexure providing a declaration for the period from the date of last declaration. Payment made against declaration under item III of Annexure shall be treated as provisional and would be final on submission of subsequent declaration under item II.</p>
<p>4. In case a pensioner drawing CAA becomes inpatient in any Government Hospital / Institution or is gainfully employed, he shall immediately report the matter to the FDA. Since, CAA is being paid, on the basis of annual declaration, any overpayment on account of CAA noticed with reference to the declaration quoted above, shall be adjusted from the monthly pension due to the pensioner.</p>
<p>5. All other team and conditions. for grant and payment of Constant Attendance Allowance which are not. affected by this order, shall remain unchanged. Pension Regulations of the three Services shall be amended in due course.</p>
<p>6. This issues with the concurrence of Finance division of this Ministry vide their ID. No. 10(08)/2014/Fin/Pen dated 09/04/2015.</p>

										<content:encoded><![CDATA[<p><strong>&#8216;One Rank One Pension&#8217; Scheme to Cost Exchequer Rs. 7,500 &#8211; 10,000 Crore</strong></p>
<p>NEW DELHI: Implementation of &#8216;One Rank One Pension&#8217; scheme, the long-standing demand of Armed Forces veterans, is likely to cost the exchequer Rs. 7,500 crore to Rs. 10,000 crore, Union Minister Rao Inderjit Singh said today.</p>
<p>The government has already made it clear that One Rank One Pension (OROP) will be implemented with effect from April 1, 2014, the Minister of State for Defence told reporters in Chandigarh.</p>
<p>He said that the Defence Ministry had recently forwarded to the Finance Ministry the cost which the scheme&#8217;s implementation would entail.</p>
<p>&#8220;It is likely to cost us somewhere between Rs. 7,500 crore to Rs. 10,000 crore,&#8221; he said, adding that the previous UPA government had made a mere announcement with regard to OROP.</p>
<p>&#8220;During the past four to five months, we have gone deep into this. We have calculated the entire cost now,&#8221; he said.</p>
<p>On being asked about Jammu and Kashmir Chief Minister Mufti Mohmmad Sayeed&#8217;s statement that his government will proceed with phased removal of AFSPA after consulting the Army, Mr Singh said that it is true that the Army has expressed its reservations about it.</p>
<p>The Army had yesterday said it was against any move to dilute the Armed Forces Special Powers Act (AFSPA) in Jammu and Kashmir.</p>
<p>&#8220;One thing is clear that there cannot be any unilateral decision on this,&#8221; he said.</p>
<p>He said that gradual withdrawal is everybody&#8217;s hope, &#8220;though that can only be possible when peace returns to the state.&#8221;</p>
<p>Responding to another question, Singh said that he would like the PDP-BJP coalition in Jammu and Kashmir to be given a chance to deliver.</p>
<p>&#8220;Before people start taking potshots at us, I would say let we be given a chance to deliver. If we fail, then may be, people have the right to criticise,&#8221; he said.</p>
<p>Meanwhile, Mr Singh said that more Sainik Schools would be set up in various states of the country so that students could be trained to become competent officers to serve the Armed Forces which faces a shortfall of 7,500 officers.</p>
<p>He said that efforts will also be made to woo people to join the Army in areas where joining the force was a tradition.</p>
