Shiva Gopal Mishra
Secretary

Ph.: 23382286
National Council (Staff Side)
Joint Consultative Machinery
for Central Government Employees
13-C, Ferozshah Road, New Delhi – 110001
E Mail: nc.jcm.np@gmail.com

No. NC-JCM-2014/ACP

July 14, 2014

The Secretary,
Department of Personnel & Training,
North Block, New Delhi

The Secretary,
Department of Defence
Production & Supplies,
D.G.Q.A., D.H.Q, New Delhi

Sub:- Grant of ACP to Draftsmen.

Dear Sir,
I may draw your kind attention to the following judgments of Tribunal / High Court and the Supreme Court:

1. CAT Bombay Bench order dated 28.2.2005 in O.A. No.124/2004 Shri K.M. Khopkar & others Vs UoI.
2. Bombay High Court order dated 11.12.2006 in writ petition No. 5269/2005 Union of India & others Vs K.M.Khopkar
3. Supreme Court order dated 10.7.2007 in Petition for SLP (C) CC5027/2007 Union of India & others Vs K.M. Khopkar.

The Hon’ble CAT Bombay has ruled that the placement irregular scale on the basis of Ministry of Defence letter dated 15.9. 1995 granted to Draftsmen of other Departments in pursuance of CPWD Arbitration award cannot be treated as regular promotion and ACP benefit rightly granted to the applicants cannot be withdrawn.

The High Court Bombay has upheld the above ruling of the CAT Bombay.

The Supreme Court had dismissed the appeal observing that they do not find any merit to interfere in this case.

2. The question is whether all draftsmen of other departments would be granted the benefit of this judgment. They are similarly placed employees and there are several directions of the apex court that in the case of similarly placed employees, a decision given by Courts should be treated as judgment in rem and Government should extend such benefits to all similarly placed employees so that there is no multiplication of litigation in a matter which has already been adjudicated.

3. I, therefore, request you kindly to consider and extend the benefit of above ruling which has already attained finality to all the draftsmen not only working in Department of Defence Production & Supplies but also in all other Central Government Departments.

4. Action Taken on this matter may kindly advice to us.

Thanking you,

Yours faithfully,
sd/-
(Shiva Gopal Mishra)
Secretary

Sir,

We the undersigned employees belonging to the post of LDC/UDC are working in Farakka Barrage Project, under your kind control as well as under Govt. of India, Ministry of Water Resources beg to lay the following facts for your kind consideration and necessary appropriate action please.

01. That, most of us have joined in Govt. Service between 01-09-1984 prior to 1990 as LDC category, then our Pay Scale was Rs. 260-400/- as per 3rd CPC later on as per 4th CPC w.e.f. 01-01-1986 the Pay Scale was Rs. 950-1500/- and gradually promotional post was UDC / Head Clerk or Assistant respectively and the Pay Scale of UDC was Rs. 4000-6000/- and the Scale of Head Clerk was Rs. 5000-8000/- (Copy of Fixation of Pay or pre-revised and Revised are enclosed for ready reference).

02. The Financial Up-gradation under ACP Scheme was initially introduce in year 1999 i.e. on 09-08-1999 and as per this Scheme a Govt. servant (LDC in the instant case) with 12 years of regular service in the same post, Financial up-gradation to the next Scale of Pay Rs. 4000-6000/- in the same way the 2nd Up-gradation to the Scale of Pay Rs. 5000-8000/- was admissible after 24 years of regular service. There was no further Up-gradation in the ACP Scheme.

03. Consequent upon the recommendation of the 6th CPC and acceptance of GOI, DOPT was pleased to issue MACP Scheme vide OM NO. dated 19-05-2009 in which it was clearly indicated that the MACP Scheme will take prospective effect from 01-09-2008. It was also clearly mentioned in the OM that this order is issued in supersession of all previous orders i.e. ACP Scheme. In the OM a schedule regarding placement from one PB/GP to other upgraded PB/GP has been indicated in the Section-I, Part – A of the First Schedule of the CCS (Revised Pay) Rules 2008.

04. It is further stated that, under the modified MACP Scheme the above said two financial Up-gradation were converted into three Up-gradation as under :-

Sl. No.

Description

PB-1

Grade Pay

01

First Up-gradation on completion of 10 years of regular service

5200-20200

Rs. 2000/-

02

Second Up-gradation on completion of 20 years of regular service

5200-20200

Rs. 2400/-

03

Third Up-gradation on completion of 30 years of regular service

5200-20200

Rs. 2800/-

From the above it is evident that in the PB-1, 5200-20200 having GP Rs. 2400/- and the same PB-1 having GP Rs. 2800/- bears same and identical scale of pay, therefore placement from GP Rs. 2400/- in Pay Band 1 to GP Rs. 2800/- in same Pay Band-1, can not be termed as promotional/up-gradational benefit.

Thus granting of GP Rs.2800/- in same PB i.e. PB-1 is a cause of utter deprivation upon us from having our legitimate and lawful payments i.e. we instead of getting GP of Rs.4200/- in PB-2 is presently getting GP of Rs. 2800/- in PB-1.

In view of the above fact, it is further stated that who have joined before 01-09-1984 in various categories in the Govt. service they have got benefit second financial Up-gradation as per ACP Scheme, later on said employees are entitled for third Up-gradation as per MACP Scheme. In this connection a copy of Judgment of Hon’ble Principal Bench CAT, NewDelhi is enclosed for ready reference and kind

Therefore, we the petitioners are fervently request you to kindly process the case immediately for solving the utter discrimination caused upon us.

Hence we pray before your goodself to kindly unfurl the banner of Justice and save us from the financial crunch we are facing for.

With regards.

AIRF urged to Railway Board to stop recoveries from the employees, due to messy implementation of 2nd & 3rd upgradation under MACP Scheme…

AIRF writes to Railway Board regarding to deny to eligible employees granting of 2nd & 3rd upgradation under MACP Scheme in Railways with appropriate orders and illustrations.

He said in the letter, “The Board are therefore, requested to further look into the matter in totality, as this would undo the provision already made vide Railway Board’s letter dated 10/6/2009 & 29/12/2011, resulting in a lot of recoveries from the staff in case of whom the MACPS has been implemented in terms of Railway Board’s letter under reference at S.No-1.

This issue may be discussed with AIRF threadbare, so that there is no contradiction creating confusion in implementation of MACPS prevailed over Indian Railways and recoveries, if any being initiated on this account in any Zonal Railway, may be stopped till finalization of this issue.

5th CPC had ACP, 6th CPC had MACP; what does 7th CPC have?

Assured Career Progression (ACP) is a boon to employees who have been suffering without promotions for years.

Employees who got their jobs towards the end of 1960s had to face countless hurdles. One of them was the problem with promotions.

There were many who didn’t get any promotions for 30 years. Countless others retired without getting a single promotion in their careers.

To put an end to this, all the Federations fought together and made the Government to implement the ACP (Assured Career Progression) promotion scheme. It enabled the employees, who didn’t get any promotion for 12 and 24 years, to get one or two promotions respectively. A number of employees benefited from this.

These promotions were given to the employees based on their ‘Promotional Hierarchy’. This was introduced in the 5th CPC and continued to be enforced until 31.08.2008.

In the 6th CPC, MACP was introduced instead of ACP. Though both were almost the same, there were some differences. These differences created a lot of confusions.

The special feature of MACP was that instead of 12 and 24 years, it ordered promotions for employees who weren’t given any career advancements in 10, 20 and 30 years.

The promotions given under MACP were not in accordance to the ‘Promotional Hierarchy’. Instead, they followed the ‘Grade Pay Hierarchy’. This was the biggest drawback of MACP.

Getting promotions for a raise of Rs 100 or 200 remained unacceptable for many. Finally, one could say that MACP earned the anomaly of being dragged to the court the most number of times.

This is also one of the features that are creating the most expectations this time. Let us wait and see what changes the 7th CPC makes in this.

What is the Necessity for MACP to Emulate ACP’s Promotional Hierarchy?

For a number of years, Federations have been demanding that employees who had not been given promotions for 10, 20 or 30 years be given promotions or upgradations by MACP (Modified Assured Career Progression Scheme) on the basis of their respective Promotional Hierarchy. The Government refused to oblige by stating very clearly in the 6th CPC that promotions will be given only on the basis of Grade Pay Hierarchy.

There are no such recommendations in the ACP Scheme (Assured Career Progression Scheme), which was introduced by the 5th CPC. In fact, there was not even a Grade Pay format in its Pay Structure. There was also no usage of ‘Hierarchy’ in it. A lot of confusion was created after the introduction of the Grade Pay Structure by the 6th CPC. Two distinct hierarchies were created – Promotional Hierarchy and Grade Pay Hierarchy.

Promotional Hierarchy is based on the pay structure depending upon the employee’s grade and department. Two employees with similar designations and ranks, but in different departments, will notice this difference. This is not applicable to everybody.

On the other hand, Grade Pay Structure is common for all. This is the reason why there are differences between an employee who gets promotions under the regular system and one who gets promotion under MACP. In order to rectify this discrepancy, a number of employees had approached the courts and had succeeded.

This would become clearer with this example:

Let us assume that an LDC employed with a Central Government office under a promotional hierarchy of 1900-2400-4200. Regular Promotion is given on this basis only.

If the employee has not been given a promotion for 10 years, then, instead of the next Grade Pay of Rs. 2400, he will be given a grade pay hike of Rs. 2000. Instead of Rs. 4200 Grade Pay, he will be given Rs. 2800. This is the reason for all the confusion.

But, the point to be observed here is that it was granted on the basis of Promotional Hierarchy, introduced by the ACP of the 5th CPC.

Let us also look at the explanation given by the Government.

Only those who haven’t received any promotion for 10 years are given promotions or upgradations under MACP. Pay fixation is done based on 3% increment and the differences between Grade Pay. If the employee gets a regular promotion a month after getting pay fixation, then, the difference in the Grade Pay will be calculated on the basis of his entitlement and given immediately. The intention of the scheme was to remove the anguish of the employees who weren’t given any promotion for more than 10 years.

Subject: Grant of MACP benefit to the eligible employees in the hierarchy of promotional grade: Compliance of CAT Principal Bench Directive on 12.03.2014 in OA No. 864/2014.

Respected Sir,
With due regards, I would like to draw your kind attention on the subject wherein the issue of grant of MACP benefit in the hierarchy of promotional grade instead of hierarchy of grade pay is being demanded & discussed by this Federation at every forum.

It has now been brought to our notice that an affected employee had challenged the Government’s decision on grant of MACP benefit in the hierarchy of promotional grade vide his O.A. No. 1038/CH/2010 in CAT Chandigarh and that the Hon’ble CAT Chandigarh vide its order dated 31.05.2011 granted the prayer of the petitioner and directed the authorities to grant MACP benefit in the hierarchy of promotional grade. Thereafter, the Union of India represented by the Secretary, DoP&T appealed to the Hon’ble High Court of Punjab and Haryana vide CWP No. 19387 of 2011. This appeal of the DoP&T was subsequently dismissed vide order dated 19.10.2011. The Government thereafter approached the Hon’ble Supreme Court vide SLP No. 7467/2013, the Hon’ble Supreme Court dismissed the said SLP.

Recently, CAT Principal Bench has issued direction on 12.03.2014 in OA No. 864/2014 that once an order has been passed by this tribunal and it has also been upheld at the level of the Supreme Court, there is no question of waiting for an approval from any Govt. department for implementation of the same.

In view of the above, the issue now stands settled that eligible employee needs to be given MACP benefits in the promotional hierarchy only.

As such, you are requested to kindly issue necessary directives to all units under your jurisdiction to implement the same immediately.

Thanking you.

Subject: Grant of MACP benefit to the eligible employees in the Hierarchy of promotional grade.

Respected Sir,
With due regards, I would like to draw your kind attention on the subject wherein the issue of grant of MACP benefit in the hierarchy of promotional grade instead of hierarchy of grade pay is being demanded & discussed by this Federation at every forum.

It has now been brought to our notice that an affected employee had challenged the Government’s decision on the subject vide his O.A.

In view of the above, the issue now stands settled that eligible employee needs to be given MACP benefits in the promotional hierarchy only.

D.O. No. 55/4/2-13-S&D

Dated 13-08-13

Dear Dr.Sayamal,

Issue of redressal of anomalous and disadvantageous provisions of MACPS for the Subordinate Engineering cadre and similarly placed cadres of CPWD has been taken up with DoPT through several proposals since Me very inception of the scheme but none of the proposals has found favour. This has resulted in great discontent to the Subordinate Engineering cadre of CPWD.

Above issue was also discussed with you informally on 1.8.2013. It was apprised that individual option to choose either earlier ACPS or MACPS by the employee is the only solution to cater to the concerns of all individuals. A proposal of this Ministry in this regard under consideration in DoPT.

As the matter concerns above 6000 subordinate Engineers of CPWD, I would request that they may be allowed to exercise their individual option to choose either earlier ACPS or MACPS. This will not only alleviate the discontent in the cadre but also avoid cropping up of the court cases.

Dated 01 Oct 2013

Dear Dr. Sarkar,

Kindly refer to my DO letter of even No dt. 13.8.2013 in connect:on with redressal of disadvantageous provisions of MACPS for the Subordinate Engineering cadre and similarly placed cadres CPWD.

The proposal sent by this Ministry in Jul’2013 for allowing individual option to choose either earlier ACPS or MACPS by the employee is a balanced and just one and caters to the concerns of all individuals. DoPT must not have any reservation in accepting the same since change of the scheme by the Government should not be to the disadvantage of the individual employee.

Already many court cases for review of the MACPS have cropped in. In this regard, would like to quote a Court Case (OA No. 275/2013) by some Assistant Engineers of CPWD for review of MACPS, draft counter reply to which quoting anomalous end disadvantageous provisions of MACPS was sent to DoPT for vetting. DoPT has not agreed to the reply and intimated that reply should be modified by the administrative ministry mentioning that operation of the both the schemes in the same cadre is against the provisions of MACPS other words individual option to employees to opt for either ACPS or MACPS is not permissible.

In this context, I would also bring to the notes that CAT, Chandigarh in OA No. 1038/2010 has allowed grant of financial upgradations under MACP in the promotional hierarchy, which has been upheld by Hon’ble High Court of Chandigarh in CWP 1938712011. Although the the case has not achieved fatality as the SLP had by the Government the in the Hon`ble Supreme Court was dismissed though not on merits but on account of non condonation of delay. Thus by allowing individual option. Government shall be saved of many expected court cases and possible grant of financial upgradations in the promotional hierarchy under MACPS.

Discontent in tno cadres is affecting the efficient functioning of the Department. The problem shall further aggravate, if above proposal of this ministry does not find favour or DoPT in the circumstances would once again request to consider the proposal favourably, for allowing option to choose either ACP or MACPS by the individual.

With regards

ALL INDIA RAILWAYMEN’S FEDERATION
4, STATE ENTRY ROAD, NEW DELHI, INDIA

No.AIRF/PNM/4/2011(154)

Dated: September 2, 2013

The Member Staff,
Railway Board,
New Delhi
Dear Sir,
Sub: Grant of financial upgradation under MACPS to Pharmacists

Pursuant to decision, taken in the National Council(JCM) in respect of Pharmacists, to place them in Grade

Pay of Rs.4200(PB-II) on completion of two years’ regular service without insisting on any Selection/ Suitability Test etc., who are initially recruited in PB-I with GP Rs.2800, All India Railwaymen’s Federation vide letters dated 22.02.2012, 24.04.2012 and 04.05.2012 have been persistently demanding that the initial recruitment grade of the Pharmacists needs to be taken as Grade Pay Rs.4200(PB-II) in place of G. Rs.2800(PB-I) for the purpose of granting financial upgradation under MACPS.

AIRF has repeatedly contented that considering the educational qualification, prescribed for the Pharmacists, which is 10+2(with PCM) + Diploma in Pharmacy with Experience, it was rightly decided to place them in PB-II with GP Rs.4200 just after formal completion of two years’ regular service, which should not be construed as “Promotion” for the purpose of financial upgradation under MACPS as they are not required to undergo any Selection/Modified Selection/Suitability Test etc. while placing them in PB-II with GP Rs.4200.

AIRF is, therefore, of the firm view that the aforesaid placement of the Pharmacists in PB-II with GP Rs.4200 on completion of two years’ service can no way be treated as “Promotion” while granting them benefit of financial upgradation under MACPS.

It is, therefore, urged that, in case of Pharmacists, the recruitment grade should be considered as PB-II with GP Rs.4200 instead of PB-I GP Rs.2800 for the purpose of granting them benefit of financial upgradation under MACPS and necessary clarification to this effect may be issued to all the Railway administrations for immediately implementing the same under advise to this office.

An early action in the matter shall be highly appreciated.

Yours faithfully,
sd/-
(Shiva Gopal Mishra)
General Secretary
