<p>Subject: <strong>Amendment in Central Civit Services (Conduct) Rules, 1964 regarding acceptance of gifts by Government servants.</strong></p>



<p>The undersigned is directed to say that the following rules of Central Civil Services (Conduct) Rules, 1964 prescribing ceiling for receiving gifts by Government servants, have been amended vide G.S.R. No. 531 (E) dated 29.07.2019 (copy enclosed) so as to bring the uniformity in provisions of CCS (Conduct) Rules, 1964, AIS (Conduct) Rules, 1968 and Foreign Contribution (Acceptance or Retention of Gifts or Presentations) Rules, 2012:</p>



<table class="wp-block-table"><tbody><tr><td><strong>Before Amendment</strong></td><td><strong>After Amendment</strong></td></tr><tr><td><strong>Sub-rule (3) of Rule 13</strong><br /> In any other case, a Government servant<br /> shall not accept any gift without the<br /> sanction of the Government, if the value<br /> exceeds &#8211;<br /><br /> (i) rupees<strong> one thousand Five hundred</strong> in<br /> the case of Government servants<br /> holding any Group A&#8217; or Group B&#8217;<br /> post; and<br /><br /> (ii) rupees five hundred in the case of<br /> Government servant holding any Group<br /> &#8216;C&#8217; or Group &#8216;D&#8217; posts.</td><td><strong>Sub-rule (3) of Rule 13</strong><br /> In any other case, a Government servant shall not accept any gift without the sanction of the Government, if the value exceeds &#8211;<br /><br /> (i) rupees <strong>five thousand</strong> in the case of Government servants holding any Group &#8216;A&#8217; or Group B&#8217; post: and<br /><br /> (ii) rupees two thousand in the case of Government servant holding any Group &#8216;C&#8217; post.</td></tr><tr><td><strong>Sub-rule (4) of Rule 13</strong><br /> Notwithstanding anything contained in  sub-rule (2) and (3), a Government servant,  being a member of India delegation or otherwise, may receive and retain gifts from foreign dignitaries, if the market value of gifts received on one occasion does not exceed rupees one thousand. In all other<br /> cases, the acceptance and retention of such gift shall be regulated by the instructions issued by the Government in this regard from time to time.</td><td><strong>Sub-rule (4) of Rule 13</strong><br /> Notwithstanding anything contained in<br /> sub-rule (21 and (3), a Government servant, being a member of the Indian delegation or otherwise, D&amp;y receive and retain gifts from foreign dignitaries in accordance with the<br /> provisions of The Foreign Contribution (Acceptance or Retention of Gifts or<br /> Presentation) Rules, 2012, as amended from time to time.</td></tr></tbody></table>

<p>As per the Maternity Benefit (Amendment) Act, 2017, it has been made mandatory for the establishments employing 50 or more employees to provide crèche facility, either separately or along with common facilities within a prescribed distance.</p>
<p>This information was given by Shri Santosh Kumar Gangwar, Union Minister of State (I/C) for Labour and Employment in written reply to a question in Rajya Sabha today.</p>

										<content:encoded><![CDATA[<p><strong>Maternity Benefit Act for Women Employees</strong></p>
<p>The main provisions of the Maternity Benefit Act are:</p>
<blockquote><p>i) No employer shall knowingly employ a woman in any establishment during the six weeks immediately following the day of her delivery or her miscarriage. Also, no woman shall work in any establishment during the six weeks immediately following the day of her delivery or her miscarriage.</p>
<p>ii) Every woman shall be entitled to, and her employer shall be liable for, the payment of maternity benefit at the rate of the average daily wage for the period of her actual absence immediately preceding and in- cluding the day of her delivery and for the six weeks immediately following that day.</p>
<p>iii) No woman shall be entitled to maternity benefit unless she has actually worked in an establishment of the employer from whom she claims maternity benefit, for a period of not less than eighty days in the twelve months immediately preceding the date of her expected delivery.</p>
<p>iv) The maximum period for which any woman shall be entitled to maternity benefit shall be twelve weeks, that is to say, six weeks up to and including the day of her delivery and six weeks immediately following that day.</p>
<p>v) No deduction from the normal and usual daily wages of a woman entitled to maternity benefit shall be made by reason only of –</p>
<p>(i) the nature of work assigned to her by virtue of the provisions of the Act; or<br />
(ii) breaks for nursing the child allowed to her under the provisions of the Act.</p>
<p>vi) If a woman works in any establishment after she has been permitted by her employer to absent herself for any period, during such authorised absence, she shall forfeit her claim to the maternity benefit for such period.</p></blockquote>

<p>Subject: <strong>Amendment to Central Civil Service (Leave) Rules, 1972 &#8211; Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (PWD Act, 1995)-regarding</strong></p>
<p>The Central Civil Services (Leave) Rules, 1972 were amended vide the Department of Personnel and Training Notification No. 13026/1/2002-Estt(L) dated the 15/16thJanuary, 2004 consequent to the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (PWD Act, 1995) which came into force from 7thFebruary, 1996.</p>
<p>2. Section 47 of the PWD Act, 1995 provides that services of no employee can be terminated nor can he be reduced in rank in case the employee has acquired a disability during his service. The first proviso to the Section 47 lays down that if such an employee is not suitable for the post he was holding, he could be shifted to some other post.<br />
However, his pay and service benefits would be protected. The second proviso provides that if it is not possible to adjust such an employee against any post, he would be kept on a supernumerary post until a suitable post is available or he attains the age of superannuation, whichever is earlier. Further, the Clause (2) of Section 47 provides that no promotion shall be denied to a person merely on ground of his disability. In Kunal Singh v. Union of India, [2003] 4 SCC 524, Hon&#8217;ble Supreme Court has observed that the very frame and contents of Section 47 of the PWD Act, 1995 clearly indicate its mandatory nature.</p>
<p>3. The issues relating to leave or absence of Government servants who have acquired a disability while in service are required to be dealt with in the light of the provisions of the Section 47 of Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. The case of a disabled government servant who is declared fit to resume duty but who may not able to perform the duties of the post he was holding earlier may be dealt with as per the first proviso to Section 47 of the PWD Act, 1995. The second proviso shall apply if it is not possible to adjust him against any existing post. In all such cases, the Government servant so adjusted shall be entitled to the pay scale and other service benefits attached to the post he was holding.</p>
<p>4. A disabled Government servant who is not fit to return to duty shall be adjusted as per second proviso to the Section 47 mentioned above, until he is declared fit to resume duty or attains the age of superannuation whichever is earlier, with the same pay scale and service benefits. On being declared fit for resuming duty, the Government servant who is not fit for the post he is holding, may be adjusted as per the first proviso to Section 47.</p>
<p>5. Leave applied on medical certificate in connection with disability should not be refused or revoked without reference to a Medical Authority, whose advice shall be binding. The ceiling on maximum permissible leave laid down in Rule 12 may not be applied to leave on medical certificate applied in connection with the disability. Any leave debited for the period after a Government servant is declared incapacitated shall be remitted back into his/her leave account.</p>
<p>6. For a government servant who is unable to submit an application or medical certificate on account of disability, an  application/medical certificate submitted by a family member may be accepted. The provisions relating to examination of  disabled Government servants and the Medical Authorities competent to issue such certificates are also being amended.</p>
<p>7. Necessary amendments to the Central Civil Services (Leave) Rules, 1972 are being notified separately.</p>

<div>The undersigned is directed to say that the Ex-servicemen (Re-employment in Central Civil Services and Posts) Amendment Rules, 2012, inter-alia provides as follows:-</div>
<div></div>
<p>&nbsp;</p>
<blockquote><p>“5 (b) For appointment to any vacancy in Group A and Group B services or posts filled by direct recruitment otherwise than on the results of<strong> an Open All India Competitive Examinatio</strong>n, the upper age limit shall be relaxed by the length of military service increased by three years in the case of ex-servicemen and commissioned officers including Emergency Commissioned Officers or Short Service Commissioned Officers.</p></blockquote>
<blockquote><p>(c) For appointment to any vacancy in Group A and Group B service or posts filled by direct recruitment <strong>on the results of an All India Competitive Examination</strong>, the ex-servicemen and Commissioned Officers who have rendered at least five years military services and have been released:</p></blockquote>
<blockquote><p>(i) on completion of assignment (including those whose assignment is due to be completed within one year) otherwise than by way of dismissal or discharge on account of misconduct or inefficiency; or</p></blockquote>
<blockquote><p>(ii) on account of physically disability attributable to military service or on invalidment, shall be allowed maximum relaxation of five years in the upper age limit.</p></blockquote>

<div>2. This Department has been receiving representations and RTI applications to clarify the meaning of the phrases “recruitment otherwise than on the results of an Open All India Competitive Examination” and “posts filled by direct recruitment on the results of an All India Competitive Examination” mentioned in the above paragraph.</div>
<div></div>
<div>3. it is hereby clarified that instructions on the subject already exist that the expression &#8216;<strong>direct recruitment on the results of an All India Competitive Examination</strong>’ means (i) all recruitment by UPSC whether through written examination or by interview or both and; (ii) recruitment made by other authorities including Staff Selection Commission or any other appointment authority through written competitive examination or tests (but not by interview only). The expression ‘<strong>direct recruitment otherwise than by open competition means</strong>’ (i) any recruitment not made by the UPSC or (ii) recruitment not made through written competitive tests held by any other authority.</div>

										<content:encoded><![CDATA[<p><strong>Proposal to Amend Railway Protection Force Act</strong></p>
<p>A proposal to amend the Railway Protection Force (RPF) Act, 1957, has been approved by the Ministry of Railways. The proposal seeks to achieve the objective of replacing the presently prevailing three tier security system of RPF, Government Railway Police (GRP) and District Police with a two tier security system of RPF and District Police over Railways. The Ministries of Home Affairs and Law &amp; Justice have already approved the above proposal. Matter has been forwarded to the States for soliciting their opinion on the above proposal.</p>
<p>Security has been identified as one of the priority areas by Railways for strengthening and up-gradation. Efforts made to strengthen railway security in recent past include installation of an integrated Security System, procurement of modern security related equipment, setting up of All India Security Help Line, networking of RPF Posts and Security Control Rooms and strengthening of manpower etc.</p>
<p>This information was given by the Minister of State for Railways Shri Adhir Ranjan Chowdhury in written reply to a question in Lok Sabha today.</p>

<div>G.S.R.&#8212;&#8212;&#8212; (E).- In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the Governments of the States concerned hereby makes the following rules further to amend the All India Services (Medical Attendance) Rules. 1954, namely:-</div>

<div>1. (1) These rules may be called the All India Services (Medical Attendance) Amendment Rules, 2012.</div>
<div></div>
<div>(2) They shall come into force on the date of their publication in the Official Gazette.</div>
<div></div>
<div>2. In the All India Services (Medical Attendance) Rules, 1954. in rule 2 (C), in Explanation 1, for the letters and figures &#8220;Rs.1500/-’, the words and figures “rupees 3500/- plus dearness allowance thereon as on the date of consideration” shall be substituted.</div>

<div>The policy for allotment of vacant quarters in BSNL to retired BSNL/DOT Employees for their use was issued vides dated 30.12.2011.</div>

<div>Management Committee has approved to amend the existing policy and allow CGMs to allot the vacant staff quarters to the retired BSNL/DOT employees with following additional option to the existing policy for utilization of vacant staff quarters in BSNL issued vide No.482-16/2007-BG (Staff Qrs. ) dated 30.12.2011.</div>

<div>“<em><strong>The vacant quarters can be leased out to retired employees for a period of 11 months subject to the condition that the lease deed is registered at the cost of the lessee and the lessee pays four months’ rent advance as security deposit. This will be an additional option for retired employees in addition to existing conditions of allotment. Other conditions of the existing policy shall remain same.”</strong></em></div>

<div>G.S.R. 744(E).— In exercise of the powers conferred by section 5, read with sub-section (1) of section of the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 (19 of 1952). the Central Government hereby makes the following Scheme further to amend the Employees’ Provident Funds Scheme, 1952, namely:</div>

<div>1. (I) This Scheme may be called the Employees’ Provident Funds (Fourth Amendment) Scheme, 2012.</div>
<div></div>
<div>(2) It shall come into force on the date of its publication in the Official Gazette.</div>
<div></div>
<div>2. In the Employees’ Provident Funds Scheme, 1952 (hereinafter, referred to as the principal Scheme), under paragraph 83 relating to special provisions in respect of International/Workers.</div>
<div></div>
<div>(a) in paragraph 69 of the principal Scheme&#8221; as modified by para 6 of aforesaid paragraph 83, for sub-paragraph (4). the following sub-paragraph shall be substituted, namely:“</div>
<div></div>
<div>(4)<strong><em> In respect of a member covered under social security agreement entered into between Government of India and any other country, on ceasing to be an employee in an establishment covered under the Act</em></strong>.”;</div>
<div></div>
<div>(b) in paragraph 72 of the principal Scheme, as modified by para 7 of aforesaid paragraph 83, for sub-paragraph (2), the following sub-paragraph shall be substituted, namely:“</div>

<div>(2) The due amount in respect of the member shall be payable in the payees bank account directly or through the employer”.</div>

<div>G.S.R. 745(E) :- In exercise of the powers conferred by section 6A. read with sub section (I) of section 7 of the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 (19 of 1952). the Central Government hereby makes the following Scheme further to amend the Emp1oyees Pension Scheme. 1995, namely:</div>

<div>1. (I) This Scheme may be called the Employees Pension (Amendment) Scheme. 2012.</div>
<div></div>
<div>(2) It shall come into force on the daze of its publication in the Official Gazette.</div>
<div></div>
<div>2. In the Employees’ Pension Scheme, 1995 (hereinafter referred to as the principal Scheme) under paragraph 43A relating to special provisions in respect of International Workers:-</div>
<div></div>
<div>(a) in paragraph 2 of the principal Scheme, as modified by sub-pars (2) of aforesaid paragraph 43A, clause (xv) shall be omitted,</div>
<div></div>
<div>(b) after sub-pars (4) of aforesaid paragraph 43A, the following sub-para shall be inserted, namely:</div>
<div></div>
<div>(4A) For paragraph 9 of the principal Scheme, the following paragraph shall be substituted, namely:.</div>
<div></div>
<div>“9. Determination of eligible service in respect of International Workers. – The eligible service shall be determined as follows:</div>
<div></div>
<div>(1) in the case of the existing member” or the “new entrant”, the “actual service” shall be treated as eligible service.</div>
<div></div>
<div>(ii) in the case of the member covered by a social security agreement, the period of coverage under relevant social security programme in mother country shall be added to actual service and the aggregate thereof shall be treated as eligible service as may be provided in the social security agreement” ‘;</div>
<div></div>
<div>(e) in paragraph 10 of the principal Scheme, as modified by sub-pars (5) of the aforesaid paragraph 43A, sub-paragraph (I) shall be omitted.</div>
