<h3 class="wp-block-heading"><strong>Dopt Order Dated 30.11.2022 Regarding Allowances Applicable to Central Government Employees</strong></h3>



<p><strong>Children Education Allowance, Risk Allowance, Night Duty Allowance, Over Time Allowance, Special Allowance and Special Allowance for Child Care for Women with Disabilities are payable to Central Government Employees</strong></p>

<p class="has-text-align-center"><strong>Allowances</strong></p>



<p>Department of Personnel &amp; Training has issued various instructions from time to time on various Allowances applicable to Central Government Employees. The essence of these instructions has been summarized in the following paras for guidance and better understanding.</p>



<h3 class="wp-block-heading">1. Children Education Allowance (CEA)</h3>



<p>Consequent upon the decisions taken by Government to implement the recommendation of 7th CPC, this department has issued an OM No. A-27012/01/2017-Estt.(AL) dated 17.07.2018. The salient features of CEA are:</p>



<ul class="wp-block-list">
<li>(i) CEA/Hostel Subsidy can be claimed only for the two eldest surviving children.</li>



<li><strong>(ii) The amount of CEA will be Rs. 2250/- per month per child.</strong></li>



<li><strong>(iii) The amount of hostel subsidy is Rs. 6750/- per month.</strong></li>



<li><strong>(iv) The reimbursement of CEA for Divyang Children of Government servant shall be payable at double the normal rate of CEA i.e. Rs. 4500/- per month.</strong></li>



<li>(v) The rate of CEA would be raised by 25% every time the DA on the revised pay structure goes up by 50%.</li>



<li>(vi) The CEA and Hostel subsidy is admissible in respect of children studying from two class before class one to 12th standard.</li>

<h3 class="wp-block-heading">2. Risk Allowance</h3>



<ul class="wp-block-list">
<li>(i) As per decision taken by the Government on the recommendation of 7th CPC rates of Risk Allowance were revised.</li>



<li>(ii) Risk Allowance is presently given to Central Government employees engaged in hazardous duties or whose work will have a deleterious effect on health over a period of time.</li>



<li>(iii) The Risk Allowance will not be treated as “Pay” for any purpose.</li>

<h3 class="wp-block-heading">3. Night Duty Allowance (NDA)</h3>



<p>Consequent upon the decision taken by Government on the recommendations made by 7th CPC on the subject following guidelines has been issued:</p>



<ul class="wp-block-list">
<li>(i) Night duty will be defined as duty performed between 22:00 hours and 6:00 hours.</li>



<li>(ii) A uniform weightage of 10 minutes shall be given for every hour of night duty performed.</li>



<li>(iii)&nbsp;<strong>The ceiling of basic pay for entitlement of NDA shall be Rs 43600/- per month.</strong></li>



<li>(iv) The hourly rate of NDA equal to [(BP+DA)/200] will be paid and the basic pay and DA for the calculation of NDA rates shall be the basic pay and DA prevalent as per 7th CPC.</li>



<li>(v) The amount of NDA will be worked out separately for each employee depending upon the basic pay the concerned employee is drawing on the date of performing the night duty.

<h3 class="wp-block-heading">4. Over Time Allowance (OTA)</h3>



<p>Consequent upon the recommendations of 7th CPC as accepted by the Government, it has been decided that:</p>



<ul class="wp-block-list">
<li>(i) “Ministries/Departments to prepare a list of those staff coming under the category of ‘Operational Staff’. Rates of Overtime Allowance not to be revised upwards”.</li>



<li>(ii) The following definition has been used to define Operational Staff: “All non-ministerial, non-gazetted Central Government Servants directly involved in smooth operation of the office including those tasked with operation of some electrical or mechanical equipment.”</li>



<li>(iii) The concerned Administration Wing of the Ministries/ Departments will prepare a list of operational staff with full justification based on the above parameters for inclusion of a particular category of staff in the list of operational staff with the approval of JS(Admn.) and Financial Adviser of the concerned Ministry/ Department.</li>



<li>(iv) The grant of OTA may be linked to biometric attendance.</li>
</ul>

<h3 class="wp-block-heading">5. Special Allowance Payable to Parliament Assistants</h3>



<ul class="wp-block-list">
<li>(i) As per the decision taken by the Government on 7th CPC recommendations to enhance the rates of&nbsp;<strong>Special Allowance payable to those wholly engaged in Parliament work during Parliament session by 50% from the existing levels of Rs. 1500/- and Rs. 1200/- payable to Assistants and UDCs respectively to the level of Rs. 2250/- and Rs 1800/-.</strong></li>



<li>(ii) The allowance will be admissible at full rates for every calendar month in which the Parliament is in session for at least 15 days in that month. For month with shorter period, the allowance will be admissible half the rates prescribed for the full month.</li>



<li>(iii) No OTA shall be paid to Parliament Assistants for the calendar months in which the Parliament is in session.</li>

<h3 class="wp-block-heading">6. Special Allowance for Child Care for Women with Disabilities</h3>



<ul class="wp-block-list">
<li>(i) For providing extra benefits to women employees with disabilities especially when they have young children and children with disabilities, it has been decided that&nbsp;<strong>women with disabilities shall be paid Rs. 3000/- per month on Special Allowance for child care.</strong>&nbsp;The allowance shall be payable from the time of the child’s birth till the child is two years old.</li>



<li>(ii) The above limit would be raised by 25% every time the Dearness Allowance on the revised pay structure goes up by 50%.</li>

<h3 class="has-text-align-center wp-block-heading"><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">ADVISORY ON PAY &amp; ALLOWANCES RELATED ISSUES</mark></strong></h3>



<p>1. Issue pertaining to restriction/rejection on pay &amp; allces by the paying auth were taken up with HQ Defence Account Department (DAD)/HQ CGDA for resolution. Details are as given in succeeding paras.</p>



<p>2.&nbsp;<strong>Reimbursement of Hotel Accn /Guest Room charges</strong>. Hotel Accn /Guest room charges are entitled to Def pers as per MoD letter No 12630/Mov Ci24e D(Mov)/2017 dt 15 Sep 2017 as under:-</p>



<p>(a) Reimbursement upto<strong>&nbsp;₹7,500+GST</strong>&nbsp;per day,&nbsp;<strong>₹4,500</strong>+GST per day and ₹2,250+GST per day is permitted for&nbsp;<strong>Maj Gen and above,</strong>&nbsp;Brig to Lt Col and Maj to Lt to Maj respectively. However, reimbursement of these charges were being restricted to max of ₹2,000 quoting letter of QMG Br (an internal circulation).</p>



<p>(b)&nbsp;<strong>It has now been clarified by HQ DAD that entitlement of the subject&nbsp;</strong><strong>charges will be strictly based on MoD letter ibid.</strong></p>



<p>(c) Admissibility of the allowances w/o vouchers/ on production of voucher is as mentioned at Para 2 (E) (ii) of MoD letter dated 15 Sep 2017.</p>



<p>3.&nbsp;<strong>Road Mileage Alice (RMA)</strong>&nbsp;Admissibility of Road Mileage allowances is as per Para 2 (D) of MoD letter dt 15 Sep 2017 as under :-</p>



<p>(a) Reimbursement on per km basis from starting point as per prescribed rates of Dte of Tpt of the State or the neighbouring States.</p>



<p><strong>(b) Restrictions were being placed on these claims based on veh unladen weight.&nbsp;</strong></p>



<p>(c)&nbsp;<strong>It has now been confirmed by HQ DAD</strong>&nbsp;that reimbursement will be on per km basis from starting point as per prescribed rates of Dte of Tpt of the State or the neighbouring States. In case such prescribed rates are not specified, rates as given at Para 2 (D) (ii) of MoD letter would apply.</p>



<p>(d) In order to confirm ownership of the veh, relevant docus of the veh, if sought, must be provided for admitting the claim in audit.</p>



<p>4.&nbsp;<strong>Ex-post-facto Sanction for Time Barred TA/DA/LTC claims</strong>. – Claims for travelling allowances of tour / transfer / training/ journey on retirement etc including LTC, not preferred within 60 and 30 days for LTC if adv drawn, succeeding the completion of journey, are&nbsp;<strong>deemed forfeited under normal circumstances</strong>&nbsp;as per GFR 2017 provisions. Claims were rejected due to non adherence of timelines of submission and case was taken up with HQ DAD with an SOP under FR Para 188.<strong>&nbsp;HQ DAD has agreed&nbsp;</strong>with the proposed SOP as under:-</p>



<p>(a) Provisions are given to process time barred cases beyond 60 days upto three years by Head of the Department (All Fmn Cdrs and ADG level offrs at Army HQ) as per provisions of Rule 188 of FR-I, Vol-I.&nbsp;<strong>Detailed instrs is being issued by DG OL/SM to the envt.</strong></p>



<p>(b) In case adv is drawn and claim is not submitted within stipulated time frame, it shall be recovered till such time fresh claim with time barred sanction is submitted.</p>



<p>(c) The powers of time barred sanction shall be ex by the Head of Department in concurrence with associated IFAs, hence, due care should be taken in ex the powers which should not become a routine ex. Genuineness of the reasons for delay in submitting the claims must be checked before granting ex-post-facto sanction.</p>



<p>5. Comd /Corps HQs/Line Dtes are requested to disseminate the contents of this letter&nbsp;to all lower unit/fmn/est for info and necessary action. Envt may also be sensitised not to&nbsp;do any direct correspondence with HQ DAD/CGDA office and in case of any issue/&nbsp;representation/grievance, this HQ be apch for taking up case at appropriate level.&nbsp;<strong>HQ&nbsp;</strong><strong>DAD is more than willing to resolve all queries within the ambit of Govt provisions&nbsp;</strong><strong>and take necessary remedial action in case of any discrepancies of service.</strong></p>

<p>I am directed to refer to this Department’s OM No. 1401714/2005-AIS dated 10th February 2009 regarding Additional monetary incentive to All India Service officers belonging to North East Cadres.</p>



<p>2. It has now been decided to extend ipso facto the provisions contained in the above-mentioned OM dated 101h February, 2009 to the All India Service officers working in UT of Ladakh, subject to the ceiling mentioned in &nbsp;letter &nbsp;No. 11022/1/2017-AIS-II dated 25th July, 2017 and instructions issued in this regard from time to time.</p>

<p>The undersigned is directed to refer to the subject cited above and to say that the question of granting additional monetary incentive to officers belonging to  North-East  Cadres of the  All India Services has been engaging the attention of the Government for some time.  Accordingly, it has now been decided to grant a special allowance to the officers belonging to North-East Cadres of All  India Services who are working in the North-Eastern  Region. The allowance will be called “Special Allowance for Officers belonging to  North-East Cadres of  All   India  Services” and will be payable to the officers belonging to North-East  Cadres of  All  India Services while they are actually working in the North-East Region @ 25% of their basic pay in addition to other allowances presently payable to them. These orders will take effect from the date of their issue.</p>

<h2 class="has-text-align-center wp-block-heading"><strong>BANK DA of Clerical Staff and Subordinate Staff</strong></h2>



<p>In substitution of Clause 7 of Bipartite Settlement dated 25th May 2015 with effect from 1st November 2017, the <strong><a href="https://centralgovernmentnews.com/category/dearness-allowance/" target="_blank" rel="noreferrer noopener">Dearness Allowance</a></strong> shall be payable as per the following rates: </p>



<h4 class="wp-block-heading">Clerical and Subordinate Staff</h4>



<p>0.07 % of &#8216;pay&#8217; per slab of four points.</p>



<p><strong>Note:</strong> Dearness Allowance in the above manner shall be paid for every rise or fall of 4 points over 6352 points in the quarterly average of the All India Average Working-Class Consumer Price Index General) Base 1960=100.</p>



<ul class="wp-block-list"><li>It is clarified that there shall be no ceiling on Dearness</li><li>Dearness Allowance shall be calculated and paid on the following components:<ul><li>Basic Pay including Stagnation increments,</li><li>Special Pay,</li><li>Graduation Pay/ Professional Qualification Pay,</li><li>Special Allowance,</li><li>Transport Allowance and</li><li>Officiating Pay,</li></ul></li></ul>



<p>if any, payable under this settlement in respect of both clerical and subordinate staff.</p>

<p>The total quantum of <strong>wage revision increase (Pay slip component) shall be 3385 crores being 15% of the Pay slip component of Establishment Expenses of Public Sector Banks which are parties to this settlement for the financial year ending March 2017</strong>.</p>

<p class="has-text-align-center"><strong>ORDER:</strong></p>



<p>Government hereby order revision of the Dearness Allowance (DA) sanctioned vide reference 13th read above to all the employees of Government of Telangana from 33.536% of basic pay to 38.776% of basis pay from 1st or july, 2019</p>



<p>2. The Dearness Allowance sanctioned in the above para shall also be payable to:</p>



<ul class="wp-block-list"><li>The employees of Zilla Parishads, Mandal Parishads, Gram Panchayats, Municipalities, Municipal Corporations, Agricultural Market Committees, Zilla Grandhalaya Samasthas and Work charged Establishment, who are drawing pay in a regular scale of pay in the Revised Pay Scales,2015.</li><li>Teaching and Non-Teaching Staff of Aided Institutions including Aided polytechnics who are drawing pay in a regular scale of pay in the Revised Pay Scales, 2015.</li><li>Teaching and Non-Teaching Staff of all Universities, who are drawing pay in a regular scale of pay in the Revised Pay Scales, 2015.</li></ul>



<p>3. Government also hereby order revision of the Dearness Allowance sanctioned vide reference 13th read above to the State Government employees, who are drawing pay in the Revised Pay Scales, 2010 from 118.128% of the basic pay to 126.688% of the basic pay with effect from 1st of July, 2019.</p>



<p>4.The Dearness Allowance sanctioned in the para 3 above shall also be payable to:</p>



<ul class="wp-block-list"><li>The employees of Zilla Parishads, Mandal Parishads, Gram Panchayats, Municipalities, Municipal Corporations, Agricultural Market Committees, Zilla Grandhalaya Samasthas and Work Charged Establishment, who are drawing pay in a regular scale of pay in the Revised Pay Scales, 2010 and to the full time contingent employees whose remuneration has been revised from Rs.3850/- to Rs.6700/- per month vide G.O.Ms.No.171, Finance (P.C.III) Department, dated 13.05.2010.</li><li>Teaching and Non-Teaching Staff of Aided Institutions including Aided Polytechnics who are drawing pay in a regular scale of pay in the Revised Pay Scales, 2010</li><li>Teaching and Non-Teaching Staff of Universities who are drawing pay in a regular scale of pay in the Revised Pay Scales, 2010.</li></ul>



<p>5. Government hereby order revision of Dearness Allowance from 12% to 17% with effect from 1st of July, 2019 in respect of the following categories of employees:</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>i. The Teaching staff of Government and Aided Affiliated Degree Colleges who are drawing pay in the Revised U.G.C Pay Scales, 2016.</p><p>ii. The Teaching staff of the Universities and the Teaching staff of  Government Polytechnics, who are drawing pay in the Revised UGC /AICTE Pay Scales, 2016.</p></blockquote>



<p>6. Government also hereby order revision of the Dearness Allowance from 154% to 164% of the basic pay with effect from 1st of July, 2019, in respect of the following categories of employees:</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>i. The Teaching staff of Government and Aided Affiliated Degree Colleges who are drawing pay in the U.G.C Pay Scales, 2006.</p><p>ii. The Teaching staff of the Universities and the Teaching staff of  Government Polytechnics, who are drawing pay in the UGC/ AICTE Pay Scales, 2006.</p></blockquote>



<p>7. Government also hereby order revision of Dearness Allowance in respect of Judicial Officers whose pay scales were revised as per Government orders issued vide G.O.Ms.No.73, Law (LA&amp;J, SC-F) Department, dated: 01.05.2010 from 154% to 164% of the basic pay with effect from 1st of July, 2019.</p>



<p>8. Government hereby sanction an ad-hoc increase of Rs.100/- per month to the Part-Time Assistants and Village Revenue Assistants from 1st of July, 2019.</p>



<p>9. The revised <strong><a href="https://centralgovernmentnews.com/category/dearness-allowance/" target="_blank" rel="noreferrer noopener">Dearness Allowance</a></strong> sanctioned in paras 1-8 above shall be paid with the salary of November, 2020 payable on 1st of December, 2020.</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>9.1 The arrears on account of payment of Dearness Allowance for the period from 1st July, 2019 to 31st October, 2020 shall be credited to the General Provident Fund Account of the respective employees during December, 2020.</p><p>9.2 In the case of employees who are due to retire on or before 31st March, 2021,the arrears of Dearness Allowance shall be drawn and paid, as the employees due to retire on superannuation are exempted from making any subscription to the General Provident Fund during the last four months of service.</p><p>9.3 In respect of the employees who were appointed to Government service on or after 01.09.2004 and are governed by the Contributory Pension Scheme (CPS), 10% of the Dearness Allowance arrears from 1st of July, 2019 to 31st October, 2020 shall be claimed and credited to the PRAN accounts of the individuals along with the Government share as per the existing orders. The remaining 90% of Dearness Allowance arrears shall be paid in four (04) equated installments starting from December 2020.</p><p>9.4 In respect of Full Time Contingent Employees, who are not eligible for GPF Accounts, the arrears shall be paid during the month of December, 2020.</p><p>9.5 In the event of death of any employee before the issue of these orders, the arrears of Dearness Allowance shall be drawn and paid to the legal heir(s).</p></blockquote>



<p>10. The term ‘Pay’ for this purpose shall be as defined in F.R.9 (21) (a) (i).</p>

<p>11. All the Drawing Officers shall prefer the bill to the Pay &amp; Accounts Officer, Hyderabad or the Pay &amp; Accounts Officer/ Assistant Pay &amp; Accounts Officer of the Telangana Works Accounts Service or the District Treasury Officer, as the case may be, for the amount of arrears for the period from 1st of July, 2019 to 31st October, 2020 to be adjusted to the General Provident Fund Account in the case of an employee who has opened a General Provident Fund Account.</p>



<p>12. The Drawing Officers shall ensure that the Bills are supported by proper schedules in duplicate indicating the details of the employee, General Provident Fund Account Number and amount to be credited to the General Provident Fund Account, to be submitted to the Pay &amp; Accounts Officer/District Treasury Officers/ Assistant Pay &amp; Accounts Officers or Pay &amp; Accounts Officers of the Telangana Works Accounts Service, as the case may be. The Pay &amp; Accounts Officer/ Assistant Pay &amp; Accounts Officer or Pay and Accounts Officer of the Telangana Works Accounts Service/District Treasury Officer/ Sub-Treasury Officer shall follow the usual procedure of furnishing one copy of the schedules along with bills to the Accountant General based on which the Accountant General shall credit the amounts to the General Provident Fund Accounts of the individuals concerned. The second copy of the schedules shall be furnished to the Drawing Officers with Voucher Numbers.</p>



<p>13. In respect of employees working in Government Offices the Director of Treasuries , Director of Works Accounts an Pay and Accounts Officer, Hyderabad shall consolidate and furnish information in the proforma annexed (Annexure-I) to this order to the Finance (HRM.IV) Department to reach on or before 15th of April, 2021. In respect of employees of Local Bodies, the Director of State Audit shall furnish the consolidated information to the Finance (HRM.IV) Department by 15th April, 2021.</p>



<p>14. All the Drawing and Disbursing Officers and Audit Officers are requested to intimate to the employees working under their control as to how much amount of arrears of Dearness Allowance is credited to the General Provident Fund Account/Compulsory Savings Account as per the Proforma annexed (Annexure-II) to this order. They are further requested to adhere to the above instructions and any deviation or non-compliance of these instructions will be viewed seriously.</p>



<p>15. The expenditure on the Dearness Allowance to the employees of Agricultural Market Committees and Greater Hyderabad Municipal Corporation shall be met from their own funds in view of the orders issued in G.O.Ms.No.9, Finance (PC-I) Department, dated: 18.01.2010</p>



<p>16. All Departments of Secretariat and Heads of the Departments are requested to issue suitable instructions to the Drawing and Disbursing Officers under their control and to see that these instructions are followed scrupulously. The Director of Treasuries and Accounts/ Director of Works Accounts/ Director of State Audit/ Pay &amp; Accounts Officer/, Telangana, Hyderabad, are requested to issue suitable instructions to their subordinate Audit Officers so that these instructions are carefully followed by them.</p>

<p>1. Scrap New Contributory Pension Scheme (NPS). Restore old defined benefit Pension Scheme (OPS) to all employees. Guarantee 50% of the last pay drawn as minimum pension.</p>



<p>2. (a) Scrap the draconian FR 56(j) and Rule 48 of CCS (Pension) Rules 1972. Stop terrorizing and victimizing employees.</p>



<p>(b) Withdraw the attack against the recognised status of Associations and Federations.</p>



<p>(c) Withdraw the anti-worker Wage/Labour codes and other anti-labour reforms.</p>



<p>(d) Stop attack on trade union rights.</p>



<p>3. (a) <a href="https://centralgovernmentnews.com/freezing-of-dearness-allowance-to-central-government-employees-and-dearness-relief-to-central-government-pensioners-at-current-rates-till-july-2021/" target="_blank" rel="noreferrer noopener">Withdraw the orders freezing the DA and DR of employees and Pensioners</a> and impounding of arrears till 30.0-.2021.</p>



<p>(b) Implement five year wage revision and Pension revision to Central Government employees and Pensioners. Appoint 8th Central Pay Commission and revise the Pay, Allowances and Pensionary benefits of Central Government employees and Pensioners with effect from 01-01-2021.</p>



<p>(c) Honour the assurance given by Group of Ministers (GoM) to NJCA leaders on 30-06-2016. Increase minimum pay and fitment formula recommended by 7th CPC. Grant HRA arrears from 01-01-2016.</p>



<p>(d) Withdraw “Very Good” bench mark for MACP, grant promotional heirachy and date of effect of <a href="https://centralgovernmentnews.com/latest-macp-orders-from-dopt/" target="_blank" rel="noreferrer noopener">MACP </a>from 01-01-2006.</p>

Scrap National Recruitment Agency and introduce Department wise recruitment and Regional recruitment for Group B and C posts. Stop re-engaging retire personnel in Central Govt. services.</p>



<p>5. Stop Corporatisation and privatisation of Railways, Defence and Postal Departments. Withdraw closure/ merger orders of Govt. of India Printing Presses and Postal Stores depots/ Postal Stamp depots. Stop proposed move to close down salt department. Stop outsourcing and closure of Govt. establishments.</p>

<p>8. Grant equal pay for equal work for all. Remove disparity in pay scales between Central Secretariat staff and similarly placed staff working in field units of various departments.</p>



<p>9. Implement 7th CPC wage revision and pension revision to remaining Autonomous body employees and pensioners. Ensure payment of full arrears without further delay. Grant Bonus to Autonomous body employees pending from 2016-17 onwards.</p>



<p>10. Remove arbitrary 5% ceiling imposed on compassionate appointments. Grant appointment in all eligible cases.</p>



<p>11. Grant five time-bound promotions to Group B &amp; C employees. Complete cadre review in all departments in a time bound manner.</p>



<p>12. Ensure prompt functioning of various negotiating forums under the JCM Scheme at all levels.</p>

<p>Attention is invited to instructions contained in F(E)Spl.90/FR/ Misc./2 dated 06.05.1992 (RBE N0.64/92) providing reckoning of additional pay/presumptive pay for DA HRA/CCA. References have been received in this office from Zonal Railways seeking clarification whether dearness allowance/ house rent allowance etc. other than special pay will be payable on APA.</p>

<p>The recommendations of 7th CPC on allowances were accepted by government with 34 modifications as per Ministry of Finance’s Resolution No. 11-1/2016-IC dated 06.07.2017 which was also adopted by Ministry of Railways and orders regarding various allowances admissible to Indian Railway personnel were issued by Railway Board.</p>

<p>2. In this regard, an Office Memorandum had been issued by Ministry of Finance in accordance with Para 8.2.5 of the Report of the <a href="https://centralgovernmentnews.com/category/7cpc/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">7th CPC</a> wherein it was mentioned that any allowance not mentioned in the Report (and hence not reported to the Commission), shall cease to exist immediately. This order shall apply <a href="https://centralgovernmentnews.com/tag/mutatis-mutandis/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">mutatis mutandis</a> in Ministry of Railways also.</p>



<p>3. In this regard, it is advised that payment of any allowance not mentioned in 7th Central Pay Commission’s Report or Ministry of Finance’s Resolution dated 06.07.2017 shall be stopped with immediate effect and any payment that has been made inadvertently, recovery may also be made w.e.f. 01.07.2017, date of such payment being made. Further, if any such allowance is required to be restored, a detailed self contained proposal, containing suitable functional justification along with expected financial implications may be forwarded to the concerned Directorate in Railway Board after the same being concurred by Associate Finance of the concerned Railway and approval of Competent Authority for further processing in consultation with Ministry of Finance as mandated in their resolution dated 06.07.2017.</p>



<p>4. This issues with the concurrence of Finance Directorate and approval of competent authority of Ministry of <a href="https://centralgovernmentnews.com/category/railways/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">Railways</a>.</p>

<p>G.S.R. 451 (E) In exercise of the powers conferred under proviso to sub-section (1) of section 102 of the Consumer Protection Act, 2019 (35 of 2019), the Central Government hereby makes the following rules, namely:</p>



<p>1. <strong>Short title and commencement </strong>&#8211; (1) These rules may be called the <strong><em>Consumer Protection (Salary, allowances and conditions of service of President and Members of the State Commission and District Commission) Model Rules, 2020.</em></strong></p>



<p>(2) They shall come into force on the 20th day of July, 2020.</p>



<p>2. <strong>Definitions</strong>. &#8211; (1) In these rules, unless the context otherwise requires, &#8211;</p>



<ul class="wp-block-list"><li>‘Act’ means the Consumer Protection Act, 2019 (35 of 2019);</li><li>‘Member’ means a Member of the District Commission or the State Commission, as the case may be;</li><li>‘President’ means the President of the District Commission or the State Commission, as the case may be;</li><li>‘State Government’ includes an administrator of a Union territory appointed under article 239 of the Constitution except in rule 13.</li></ul>



<p>(2) The words and expressions used herein and not defined and defined in the Act shall have the same meaning respectively assigned to them in the Act.</p>



<p>3. <strong>Salaries and allowances payable to President and members of District Commission.</strong></p>



<ul class="wp-block-list"><li>The President shall be entitled to the salary and allowances as are admissible to a District Judge in the super time scale of pay.</li><li>A Member shall receive a pay equal to the pay at the minimum of the scale of pay of a Deputy Secretary of the State Government and other allowances as admissible to such officer.</li><li>The pay of a person appointed as President or member, who is in receipt of any pension, shall be reduced by the gross amount of pension drawn by him.</li><li>There shall be an annual upward revision of the pay of the President and member at the rate of 3%.</li></ul>



<p>4. <strong>Salaries and allowances payable to President and members of the State Commission</strong>.</p>



<ul class="wp-block-list"><li>President of the State Commission shall receive the salary and other allowances as are admissible to a sitting judge of the High Court of the State.</li><li>A Member of the State Commission shall receive a pay equivalent to the pay at minimum of the scale of pay of an Additional Secretary of the State Government and other allowances as are admissible to such officer.</li><li>The pay of a person appointed as President or member, who is in receipt of any pension, shall be reduced by the gross amount of pension drawn by him.</li><li>There shall be an annual upward revision of the pay of a member at the rate of 3%.</li></ul>



<p>5. <strong>Medical fitness</strong>. No person shall be appointed as President or Member unless he is declared medically fit by an authority specified by the State Government in this behalf.</p>

<p>6. <strong>Casual vacancy</strong>. In case of a casual vacancy in the office of President in the State Commission or District Commission, as the case may be, the State Government shall have the power to appoint the senior most Member to officiate as President.</p>



<p>7. <strong>House rent allowance</strong>. &#8211; The President or member shall be entitled to house rent allowance at the same rate as are admissible to Group ‘A’ Officer of the State Government of a corresponding status.</p>



<p>8. <strong>Transport allowance</strong>. &#8211; The President or member shall be entitled to transport allowance at the same rate as are admissible to Group ‘A’ Officer of the State Government of a corresponding status.</p>



<p>9. <strong>Leave and medical treatment and hospital facilities.</strong> &#8211; The President and members of the State Commission and the District Commission shall be entitled to leave, Leave Travel Concession, medical treatment and hospital facilities as per the provisions applicable to Group A Government servants in the State Government.</p>



<p>10. <strong>Declaration of Financial and other Interests.</strong> &#8211; The President or member shall, before entering upon his office, declare his assets, and his liabilities and financial and other interests.</p>



<p>11. <strong>Other conditions of service.</strong></p>



<ul class="wp-block-list"><li>The terms and conditions of service of the President or member with respect to which no express provision has been made in these rules, shall be such as are admissible to a Group ‘A’ Officer of the State Government of a corresponding status.</li><li>The President or member shall not practice before the National Commission, the State Commission or the District Commission after retirement from the service of the State Commission or the District Commission, as the case may be.</li><li>The President or member shall not undertake any arbitration work while functioning in these capacities in the State Commission or the District Commission, as the case may be.</li><li>The President or member of the State Commission or the District Commission, as the case may be, shall not, for a period of two years from the date on which they cease to hold office, accept any employment in, or connected with the management or administration of, any person who has been a party to a proceeding before the State Commission or the District Commission:<ul><li>Provided that nothing contained in this rule shall apply to any employment under the Central Government or a State Government or a local authority or in any statutory authority or any corporation established by or under any Central, State or Provincial Act or a Government company as defined in clause (45) of section 2 of the Companies Act, 2013 (18 of 2013).</li></ul></li></ul>



<p>12. <strong>Oaths of office and secrecy</strong> &#8211; Every person appointed to be the President or member shall, before entering upon his office, make and subscribe an oath of office in Form I and oath of secrecy in Form II annexed to these rules.</p>



<p>13. The salary, remuneration and other allowances shall be defrayed out of the Consolidated Fund of the State Government and in the case of the Union Territories, from the Consolidated Fund of India.</p>



<p>14. The terms and conditions of the service of the President and the members of the District Commission and the State Commission shall not be varied to their disadvantage during their tenure of office.</p>

<h3 class="wp-block-heading">Promulgated by the President in the Seventy-first Year of the Republic of India.</h3>



<h3 class="wp-block-heading">An Ordinance further to amend the Salary, Allowances and Pension of Members of Parliament Act, 1954.</h3>



<p>WHEREAS India, as the rest of the world, is grappling with Corona Virus (<strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a></strong>) pandemic which has severe health and economic ramifications for the people of the country;</p>



<p>AND WHEREAS the Corona Virus (COVID-19) pandemic has shown the importance of expeditious relief and assistance and therefore, it is necessary to take certain emergency measures to prevent and contain the spread of said pandemic;</p>



<p>AND WHEREAS in order to manage and control such situation, it has become necessary to raise resources by reduction of salaries and allowances of Members of Parliament;</p>

<p>AND WHEREAS Parliament is not in session and the President is satisfied that circumstances exist which render it necessary for him to take immediate action;</p>



<p>NOW, THEREFORE, in exercise of the powers conferred by clause (1) of article 123 of the Constitution, the President is pleased to promulgate the following Ordinance :</p>



<ol class="wp-block-list"><li>(1) This Ordinance may be called the<strong> Salary, Allowances And Pension </strong>of Members of Parliament (Amendment) Ordinance, 2020.<br />(2) It shall come into force at once.</li><li>In the Salary, Allowance and Pension of Members of Parliment Act, 1954, in section 3, after sub-section (1), the following sub-section shall be inserted, namely :-</li></ol>



<p>“ (1A) Notwithstanding anything contained in sub-section (1), the salary payable to Members of Parliment under sub-section(1) shall be reduced by thirty percent for a period of one year commencing from the 1st April, 2020, to meet the exigencies arising out of Corona Virus (COVID-19) pandemic,”.</p>
