<p>NEW DELHI: Officers of the police and revenue services have petitioned the 7th Pay Commission seeking scrapping of the Centre&#8217;s empanelment process for appointments to the posts of secretary, additional secretary and joint secretary.</p>
<p>The Indian Revenue Service (IRS) association has demanded scrapping of the empanelment process which is dominated by the IAS and sought higher pay. The IPS association has quoted statistics to demonstrate how other services have always been discriminated both in pay and positions compared to the &#8216;elite&#8217; Indian Administrative Service (IAS).</p>
<p>About 75% of the joint secretaries, 85% of the additional secretaries and 90% of the secretaries are from IAS. The proportion of IAS dramatically increases from 10-12% at the level of directors to 75% at the JS level, a presentation from the IPS association says.</p>
<p>The 7th Pay Commission was constituted in February 2014 and is expected to give its report by October this year. Its recommendation will guide how the salary and various allowances of central staff will be revised besides improving their service condition.</p>
<p>&#8220;Strong entry barriers have been erected for other services, with 5-10 years gap in empanelment to prevent them from reaching JS level,&#8221; the IPS officers have pleaded before the pay commission, saying this is causing frustration among the forces that is leading country&#8217;s fight against terror and left-wing terrorism.</p>
<p>Out of 20 joint secretaries in the home ministry, only one is from the IPS and the department of internal security is not even headed by an IPS. &#8220;The system over a period of time created the ruling class who occupy JS and above posts and the working class which are compelled to remain at directors&#8217; level and below,&#8221; the presentation says.</p>
<p>The IRS officers have asked the pay panel to consider giving them more pay over the IAS as they are &#8220;performing the most important sovereign function of revenue collection.&#8221; The two-year edge being enjoyed by the IAS should be reconsidered in the present context when they are no longer handling revenue collection for central government, the IRS presentation says.</p>
<p>The IRS officers have also questioned the two-year edge enjoyed by the Indian Foreign Service, seeking the pay panel to reconsider this &#8220;in the light of service conditions particularly whether any hardships are faced by them.&#8221;</p>
<p>A change in the composition of the civil services board, committee of secretaries and the special committee of secretaries has been sought with representation of members of other cadres.</p>
<p>&#8220;A rule should be made which prevents no two persons belonging to a single service to be appointed as members of these three bodies,&#8221; the IRS officers have demanded to bring in the required change in the central staffing scheme.</p>
<p>The IPS officers have claimed that the present system of batch-wise empanelment for senior posts is causing huge discrimination. Merit and right man for the right post is not the norm followed for selection, they said, demanding transparency in empanelment.</p>

<p>Subject: <strong>Clarification on crucial date of determination of age of 56 years for induction into AIS and its applicability with reference to the year of select list-regarding</strong></p>
<p>The undersigned is directed to refer to the subject cited above and to say that on the direction of Hon’ble Supreme Court, and in consultation with Ministry of Home Affairs, Ministry of home affairs, ministry of environment and forest, UPSC and the state Governments, the central government has decided to raise maximum age limit from 54 years to 56 years for promotion/induction from state service/Non-state Civil Service to All India Service with effect from the Select List of 2015 with crucial date of determination of age as 01.01.2015. In order to implement this decision, this Department has issued four notifications dated 17.03.2015 amending the following date of their publication in the official gazette:-</p>
<blockquote><p>(i) Regulation 5 (3) of Indian Administrative Service (Appointment by Promotion) Regulations, 1955;<br />
(ii) Regulation 5 (3) of Indian police service (Appointment by Promotion) Regulations, 1955;<br />
(iii) Regulation 5 (3) of Indian Forest Service (Appointment by Promotion) Regulations, 1966; and<br />
(iv) Proviso 1 below Regulation 4(1)(iii) of Indian Administrative Service (Appointment by Selection) Regulation, 1997</p></blockquote>
<p>2. Further, as decided by the Government, anomaly in Non-SCS Select List vis-à-vis SCS Select List for the vacancies arising during the same year has been removed through OM dated 17.3.2015. As per this OM, for the Vacancies arising during the period 1.1.2014 to 31.12.2014, the select list of Non-SCS officers will be styled as Selected List-2014-A instead of Selected List 2015. The select list of SCS officers had already been styled coinciding with the year of the vacancies from the year 2010, after the clarificatory OM dated 25.08.2010. Thus, for the vacancies arising during the year 2015 (between 1.1.2015 to 31.12.2015), the Select List for both SCS officers as well as Non-SCS officers will be styled as Select List-2015.</p>
<p>3. Now, for the benefit of all stakeholders, it is clarified that the above amendments are applicable for the Select Lists of 2015 (vacancies arising between 01.01.2015 to 31.12.2015) and onwards with crucial date for determination of age as 1 st January of that Select List year. For example, for the Select List of 2015, the upper age limit for consideration will be 56 years with crucial date for determination of age as 01.01.2015.</p>
<p>4 In so far as the Select Lists of State Service/Non-State Civil Service officers of 2014/2014-A to be prepared for the vacancies arisen between 1.1.2014 to 31.12.2014 are concerned, the same would be prepared in accordance with the regulations existing in 2014. In other words, up-to the Select Lists of 2014/2014-A, the maximum age limit for consideration for induction into AIS would be 54 years and the same would be reckoned as on 1st January of the respective Select List year.</p>
<p>5(i). For further clarity, for example, 10 and 2 vacancies arose during 01.01 .2014 to 31.12 2014 in West Bengal cadre in the SCS and Non-SCS category respectively. The Select List for SCS officers would be styled as Select List 2014 and for Non-SCS officers, it would be styled as Select List 2014-A. The Selection Committee Meetings would be held in 2015 and the upper age limit will be 54 years with crucial date of determination as 01.01.2014 for both the category of officers.</p>
<p>(ii) Similarly, if 6 and 2 vacancies arise during 01.01.2015 to 31.12.2015 in Odisha cadre in the SCS and Non-SCS category respectively the Select Lists would be styled as Select List 2015 for both the category of officers. The Selection Committee Meetings for Select List 2015 would be held in 2016 and the upper age limit will be 56 years with crucial date of determination as 01.01.2015 for both SCs and Non-SCs officers.</p>
<p>6. All State Governments/Cadre Controlling Authorities and UPSC are, therefore, requested to implement the aforementioned amendments in accordance with the above clarifications,</p>

<p>Comprehensive and united representation of demands planned</p>
<p>When the country is in the midst of electing a new government, the executive is busy drafting its wish list for the Seventh Pay Commission.</p>
<p>As per a recent resolution, the Central Indian Administrative Service Officers’ Association has decided to present a comprehensive and united representation of its demands before the Seventh Pay Commission, the setting up of which was announced by the government last month.</p>
<p>The association has asked the Andhra Pradesh, Punjab and Uttar Pradesh IAS officers’ units to work on proposals for pay revision. Andhra Pradesh, Jammu and Kashmir and Rajasthan Associations have been allocated the job of drafting various aspects of essentials for IAS officers including security, transportation or car facility or allowance, camp office and attendant allowances.</p>
<p>Dearness, travel and other allowances like entertainment and perks will be looked into by the Himachal Pradesh, Maharashtra and Tamil Nadu associations while issues of loans for children’s education, housing, vehicles and gadgets have been entrusted to the Gujarat, Rajasthan and Arunachal Pradesh, Goa, Mizoram and Union Territory (AGMUT) cadre.</p>
<p>Health insurance and risk coverage and health facilities will be dealt with by the IAS officers of Karnataka, Madhya Pradesh, Tamil Nadu, Maharashtra, AGMUT and Haryana.</p>
<p>Government residential quarters and housing schemes for members will be studied and proposals submitted to the commission by officers of the Andhra Pradesh, Kerala and Uttar Pradesh cadre.</p>

(a) the action that has been taken by Central Government to recruit extremely talented personnel in cadre like IAS, IPS, IRS, IFS, etc. so that, these talented personnel would execute properly the policies of Government;</p>
<p>(b) the action that has been taken by Union Public Service Commission (UPSC) to avoid any external influence while recruiting above said cadre and the details thereof; and</p>
<p>(c) whether Central Government intends to depute or recruit officials from State Government in Indian Foreign Services (IFS) as currently State Government officials are not to get IFS cadre?</p></blockquote>
<p><span style="text-decoration: underline;"><strong>ANSWER</strong></span><br />

<blockquote><p>(a): Recruitment to IAS, IPS, IRS, IFS etc. is done through the Civil Services Examination (CSE) conducted by Union Public Service Commission (UPSC) every year within the parameter of CSE Rules notified by the Central Government. With a view to ensure that extremely talented personnel are recruited to the above services, the Central Government keeps on reviewing the scheme/pattern of the examination etc. from time to time. Recently with the same objective the Central Government has approved some changes in the Civil Services (Main) Examination, 2013.</p>
<p>(b): The UPSC discharges its duties as mandated by the Constitution of India. The examinations are conducted as per Rules notified by Government and merit is the only criteria for selecting the candidates. As such, there is no scope for external influence while recruiting civil servants for various services, viz, IAS, IPS, IFS, IRS, etc.</p>
<p>(c): There is no such proposal</p></blockquote>

<p style="text-align: left;">
Subject: <strong>Amendment in the policy relating to reversion of officers belonging to All India Service as well as Central Services on pre-mature cessation of their tenure as Private Secretary/Officer-on-Special Duty to Ministers.</strong></p>
<p>A review of the policy on the above subject has been under consideration of the Government for some time. The Appointments Committee of the Cabinet (ACC) has now approved certain amendments to the existing policy as mentioned below:-</p>
<p>(i) Officers of all the three All India Services (including IPS) as well as Central Services who are appointed as PS/OSD without completing their &#8220;cooling off&#8221; should be reverted to their cadre once their term as PS/OSD ends for whatever reason. While appointing such officers as PS/OSD an informed consent should be obtained from them that they are willing to be appointed as PS/OSD in waiver of the &#8220;cooling off&#8221; requirement, fully aware of the condition that they would be reverted back to their cadre once their term as PS/OSD ends for whatever reason and that they would be further required to complete the &#8220;cooling off&#8221; afresh;</p>
<p>(ii) Officers of all the three All India Services as well as Central Services who are appointed as PS/OSD from the &#8220;Offer List&#8221; may be allowed to complete their normal period of central deputation if their term, as PS/OSD ends for whatever reason before the completion of such term.</p>
<p>(iii) Officers of all the three All India Services as well as Central Serviced who are not on the Offer List but are appointed as PS/OSD after completing their &#8220;cooling off requirement&#8221; should also normally be allowed to complete their full term of Central deputation, subject to their willingness and suitability, in case their term as PS/OSD ends for whatever reason before the completion of such term.</p>
<p>(iv) The revised policy would have a prospective effect and cover all those who:, are appointed as PS/OSD after the date of revision of the policy. Those who are already working as PS/OSD in the Central Government at present as well as those who have already been appointed to posts under the <a href="http://centralgovernmentnews.com/category/css/">CSS</a> and non-CSS following cessation of their appointment as PS/OSD shall continue to be governed by the pre-revised policy till the completion of their present tenure.</p>
<p>2. All the Ministries/Departments of Government of India, Cadre Controlling Authorities of all participating units under the Central Staffing Scheme and the State Governments are requested to take note of the above revised instructions for information and compliance.</p>
