Subject: All India Protest Day for 26th November, 2018 – Instructions under CCS (Conduct Rules), 1964 – Regarding

It has been brought to the notice of the Government that National Movement for Old Pension Scheme (NMOPS) has decided to observe ‘Gherao of Parliament House’ on 26th November, 2018 in order to demand withdrawal of New Pension Scheme (NPS).

2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike including mass casual leave, go slow etc. or any action that abet any form of strike/protest in violation of Rule 7 of the CCS (Conduct) Rules, 1964. Besides, in accordance with the proviso to Rule 17(1) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike/protest. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgments that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with law. Any employee going on strike in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. Kind attention of all employees of this Department is also drawn to this Department’s O.M. No.33012/1 /(s)/2008- Estt.(B) dated 12.9.2008, on the subject for strict compliance (enclosed as Annexure-A).

3. All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees, if applied for, during the period of proposed protestlGherao, and ensure that the willing employees are allowed hindrance free entry into the office premises.

4. In case employees go on protest/Gherao, all Divisional Heads are requested to forward a report indicating the number and details of employees, who are absent from duty in the day of protest/Gherao, i.e., 26.11.2018.

It has been brought to the notice of the Government that National Joint Council of Action (NJCA), New Delhi has decided to observe “All India Protest Day” on 19th September, 2018 in support of the following issues:

i. Upward Revision of Minimum Wage and Fitment Formula,
ii. Scrapping of the New Contributory Pension Scheme; and
iii. Allow Option No. 1 as one of the Pension Fitment Formula.

2. The meeting of the Central Trade Unions held on 22nd February 2018 at INTUC Office New Delhi expressed indignation and strongly condemned the Government of the day for their intensified attack on the lives and livelihood of the people and seriously compromising the national interest.

Attack on working class centering around dismantling labour laws designed to completely casualise employment conditions through various routes like amending Contract Labour Act, introducing Fixed Term Employment etc has assumed aggressive height. Further it is noted that the Government is out to erase the public sector from the industrial map of the country. Specific cases of attack on privatization of railways, opening coal mining to private and foreign companies without any restriction whatsoever, mass scale privatization as well as destruction of defence production network through widespread outsourcing, thereby dismantling the almost half of the ordinance factories are some of the examples of the gross anti-people and anti-national actions of the Govt. Accumulation of huge non-performing assets of the public sector banks arising out of pilferage of bank-funds by deliberately defaulting private corporate coupled with recent explosion of frauds with bank fund engineered by the same corporate class is also a reflection of the anti-national act of the Govt indulging and patronizing the same big-business class.

The Central Trade Unions reiterated their utter condemnation against the Union Budget 2018-19 which is basically anti-worker and anti-people in character and engineered a deception on the mass of the people through loud populist slogans without actually making any resource allocation.

The Central Trade Unions denounced the Govt of India’s surreptitious move in postponing the 47th session of Indian Labour Conference, thereby reducing tripartism to a mockery.

CTUOs noted with satisfaction the surging struggles by the working people in different sectors throughout the country, both organised and unorganized.

The workers and federations of coal and transport have been preparing for united industry wide actions to be undertaken shortly. All the Federations of Defence Production workers have jointly decided to go in for nationwide strike on 15th March 2018. Many more sectoral actions are in the offing.

The CTUOs while reiterating their resolve to intensify preparation for indefinite strike in the days to come, calls upon all their constituents and working people in general irrespective of affiliations to jointly observe

ALL INDIA PROTEST DAY ON 15TH MARCH 2018

• In solidarity with the striking Defence Production workers against anti-national privatization move
• Against the Anti-people Deceptive Union Budget 2018-19.

The CTUOs will meet shortly after 15th March 2018 to decide their next course of united countrywide action.

You also know that AIRF has been making all out sincere efforts with the Railway Board to get the rates of Running Allowance and other allowances related to Running Staff revised, but till date no fruitful outcome has emerged……

At the outset I convey my hearty best wishes to all of you, along with the entire family members, for a very very Happy and Prosperous New Year 2018.

As you all are aware, revision of rates of the Running Allowances and other allowances related to Running Staff are overdue and are delayed inordinately by the Ministry of Railways.

You also know that AIRF has been making all out sincere efforts with the Railway Board to get the rates of Running Allowance and other allowances related to Running Staff revised, but till date no fruitful outcome has emerged.

It has, therefore, been decided that, while celebrating New Year on 1st January, 2018, a “Protest Day” would simultaneously be observed by holding mass meetings, dharnas, rallies at all the Branches, Installations and Divisional levels to lodge our strong anguish against the dillydallying attitude of the Ministry of Railways on the subject.

You are, therefore, requested to take necessary steps in this regard, and the comprehensive reports may be sent to this office for better appreciation of the same.

Dear Comrades,

National Secretariat of the Confederation of Central Govt Employees & Workers held on 27-11-15 at New Delhi after detailed deliberations on the recommendations of the 7th Central Pay Commission (CPC) has decided as follows :

1.The National Secretariat has come to the unanimous conclusion that many of the recommendations of the 7th CPC are most retrograde and require to be modified before implementation by the Government, especially the faulty and depressed minimum wage arrived at by the 7th CPC and the fitment formula. Some of the recommendations such as abolition of certain allowances etc., are to be rejected.

2. The National Secretariat is of the firm opinion that a united struggle of entire Central Govt Employees including Railways, Defence and Confederation under the banner of National Joint Council of Action (NJCA) can only compel the Government to modify or reject the retrograde recommendations of the 7th CPC and hence it is decided to further strengthen the unity.

3. The National Secretariat further resolved that the form of the united struggle of NJCA should be an indefinite strike, within a time frame, as Govt is moving fast to implement the recommendations. Negotiation with the Government should precede declaration of indefinite strike and intensive campaign among the employees and mobilization, to create sanction behind the demands.

4. In case the requisite movement is not coming about for any reason, Confederation National Secretariat will meet and chalk out its own independent action.

5. Regarding the sector-wise issues relating to the employees of each department, the affiliated organizations of the Confederation in those departments shall take initiative for uniting all like-minded Federations/Associations/Unions in their department and shall organize agitational programmes on departmental specific demands.

6. The National Secretariat decided to insist that the charter of demands of the NJCA and Confederation should include the demands of Gramin Dak Sevaks, Casual/Contract labourers, filling up of vacancies and scraping the New Contributory Pension Scheme.

7. All affiliated organizations of Confederation are requested to intimate by e-mail to the Confederation CHQ (confederationhq@gmail.com or mkrishnan6854@gmail.com) on the required modifications or additions / deletions in the common recommendations (not department-specific) of the 7th Pay Commission on or before 05-12-2015.

8. Available Secretariat members of the Confederation will meet on 07-12-2015 at New Delhi and finalize the common demands to be included in the charter of demands of NJCA. (NJCA meeting is being held at JCM National Council, Staff-side office on 08-12-2015 to finalize the charter of demands and the further course of action).

9. The National Secretariat congratulated all the Central Govt Employees who made the 27th November 2015 ‘All India Protest Day’ at the call of NJCA, a grand success all over the country by wearing ‘black badges’ and participating in protest demonstrations.

Other Decisions:

1. Next All India Workshop-cum-Trade Union Camp of Confederation will be held at Dehradun (Uttarakhand) before March 2016.

2. The National Secretariat extended full support and solidarity to the proposed agitational programmes of Passport Employees Association including ‘Indefinite hungerfast’.

Shri Shiva Gopal Mishra, General Secretary, All India Railwaymen’s Federation said that inspite of the continuous negotiation with the Government of India & Railway Ministry, the genuine pending demands of the Ratiwaymen has not so far been resolved & lying as unattended.

Shri. Mishra further said that the 36 points charter of demands was discussed in the Central Council Meeting of AIRF on 3-4 July 2014 at and also on Working committee Meeting of AIRF held on 25-26 Aug, 2014 at Nanital, where the serious concern over the 36 point Charter of demand were engaged the attention of all members. The major demands are as regards- Scrapping New Pension Scheme, Filing up of the lakh of the Vacancies in Railways, Stop privatization & contractization in Railways, Removal of the ceiling limit of Rs. 3500/- for calculation of the Productivity Linked Bonus, Removal of anomalies of VI CPC, Merger of Dearness Allowances, Interim Relief not yet granted although, the demand were raised in JCM forum, Redressai of pending problems of Running staff, stop Anti labour amendment in the various labour laws such as I.D Act. Factory Act, and Apprentice Act etc, Employment of ward of Railway employees.  Exemption limit on Income Tax be raised to Rs. 5 Lakh, Provision of basic amentias to the women workers at their work place etc,

Shri Mishra further mentioned that there is great resentment amongst the Railway Workers on the account of the unattended charter of demands in general and FDI, PPP in particular. The FDI, will definitely not be beneficial to the Indian Railway system and the Government decision is aimed to divide the activities of Railway into two different mode of functioning and hand it over to Multi National Private Companies through this dis-investmeflt & Privatization.

The Anti labour attitude of the Railway Ministry & Govt. of India has compelled us to organize a countrywide “Jan Jagran Abhiyan” from 3rd to 18 Sept, 2014 in all over Indian Railway by AIRF affiliates and on 19th Sept, 2014 the countrywide “All India Protest Day” wifl be organized in front of All the Administrative Officers of Zonal Railway, workshop, Production units, station etc,. if the genuine demands of the Railwaymen are not addressed properly by the Govt of India and Railway Ministry, the Railway employee will be compelled to March for indefinite Strike as done in the past in year of 1974 for which Govt. of India / Railway Ministry will be responsible.
