<p>Sub:<strong> All India General Strike by Central Trade Unions – 2nd September, 2016 – reg.</strong></p>
<p>The INTUC and other Central Trade Unions in the country have decided to go on One Day General Strike on 2nd September 2016 on 12 Points Charter of Demands submitted to the Central Government as below:-</p>
<p><strong> </strong></p>
<p><strong>1. Urgent measures for containing price rise through universalization of public distribution system and banning speculative trade in commodity market.</strong></p>
<p><strong>2. Containing unemployment through concrete measures for employment generation.</strong></p>
<p><strong>3. Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws.</strong></p>
<p><strong>4. Universal social security cover for all workers.</strong></p>
<p><strong>5. Minimum wage of not less than Rs. 18000/- per month with provisions of indexation (for unskilled worker).</strong></p>
<p><strong>6. Assured enhanced pension not less than 3000 p.m. for the entire working population (including unorganized sector workers).</strong></p>
<p><strong>7. Stoppage of disinvestment in Central/state Public Sector undertakings.</strong></p>
<p><strong>8. Stoppage of contractorisation in permanent/perennial work and payment of same wage and benefits for contract workers as that of regular workers for the same and similar work.</strong></p>
<p><strong>9. Removal of all ceilings on payment and eligibility of bonus, provident fund and increase in quantum of gratuity.</strong></p>
<p><strong>10. Compulsory registration of Trade Unions within a period of 45 days from the date of submitting application and immediate ratification of ILO conventions C-87 and C-98.</strong></p>
<p><strong>11. No. FDI in Railways, Defence and other strategic sectors.</strong></p>
<p><strong>12. No unilateral amendment to labour laws.</strong></p>
<p><strong> </strong></p>
<p>In support of one day General Strike, the NFIR affiliates are called upon “to hold demonstrations and rallies throughout the lndian Railways” on 2nd September 2016. A report in this regard should be sent to the Federation latest by 7th September 2016.</p>

<p><b>2ND SEPTEMBER 2016 — ALL INDIA GENERAL STRIKE:</b></p>

<p><b>The Joint platform of Central Trade Unions (CTUs) of the Country along with Independent National Federations of employees of different industries and services including Confederation of Central Govt. Employees and Workers, have decided to organize All India General Strike on 2nd September 2016, against the anti-people, anti-workers policies and authoritarian attitude of the NDA Government. Intensive campaign and preparation to make the general strike a resounding historical success is going on in full swing throughout the country. The attitude of the NDA Government is profoundly negative and hugely challenging to the working class including Central Govt. employees. The issues in the Charter of demands submitted by the Trade Unions to the Govt. relate to basic interest of the country’s economy and also issues concerning the livelihood of the working people of both organized and unorganized sectors.</b></p>

<p><b>Govt. has not taken any meaningful step to curb price rise of essential commodities and to generate employment except making tall baseless claims. Govt. is mysteriously silent on the question of retrieving the black money stashed abroad and recovering lakhs of crores of rupees of bad debts of public sector banks. Whole range of social security measures are under severe attacks including the pension of post — 2004 entrants in Central Govt. Services. Govt. has launched atrocious attack of drastic cut in interest on small savings deposits. Totally ignoring the united opposition of the working class, the Govt. has been moving fast to demolish existing labour laws thereby empowering the employers with unfettered rights to “hire and fire” and stripping the workers and trade union of all their rights and protection provided in laws. Along With the peasantry and agri- labourers are also under severe attack. Attack on public sector has been pushed to unprecedented height with Govt. announcing mega strategic sale and also allowing unlimited FDI in strategic sectors like Railways, Defence and financial Sector as complimentary to the move of privatization and Public Private partnership etc. The anti-worker and authoritarian attitude of the Government is also nakedely reflected in their refusal to implement the consensus recommendations of 43rd, 44th and 45th Indian Labour Conference for formulations of minimum wages, equal wage and benefits of regular workers to the Contract workers.</b></p>

<p><b>The neo-liberal economic policies pursued by the Govt. has landed the entire national economy in distress and decline affecting the working people the most.</b></p>
</div>
<h3 data-blogger-escaped-style="text-align: justify;"><b>Central Govt. Employees worst affected:</b></h3>
<div data-blogger-escaped-style="text-align: justify;">
<p><b>The policy offensives of the Govt. like downsizing, outsourcing, contractorisation, corporatization and privatization has affected the Central Govt. departments and employees in a worst manner. Ban on creation of new posts and non-filling up of about six lakhs vacant posts had increased the work load of the existing employees and adversely affected the efficiency of the services. The New Pension Scheme (NPS) implemented with affect from 01.01.2004, is nothing but a “No Pension Scheme”, as it is fully dependent on the vagaries of share market forces. The Govt. is not ready to grant civil servant status to Gramin Dak Sevaks and to regularize the services of causal, contingent and contract workers. The 5% ceiling on compassionate appointment is not yet removed. The bonus ceiling enhancement from Rs.3500/- to Rs. 7000/- is not made applicable to Central Govt. Employees. Govt. is not ready to modify the 7th CPC recommendations, which is worst ever made by any pay commissions. The assurance given to the staff side regarding enhancement minimum pay and fitment formula is yet to be implemented. All other retrograde recommendations like reduction in the percentage of HRA, abolition of 52 allowances etc. are yet to be modified. Overall the attitude of the Modi Govt. is totally negative towards the Central Govt. employees and pensioners. The National Secretariat is of the firm opinion that unless the policy of the Govt. is changed, more attacks are likely to come on the Central Govt. employees and working class. To change the policy the united struggle of entire working class is required. It is in this background the Confederation of Central Govt. employees and workers has decided to join the General Strike along with other sections of the working class of our country.</b></p>

<p><strong>Entire Postal and RMS services came to a standstill</strong></p>
<p>We (NFPE &amp; FNPO) once again extend our warm greetings and congratulations to all Postal and RMS employees who made the two days nationwide strike a thundering success. About 1,50,000 Postal and RMS offices including Branch Post offices remained closed for two days. About more than five lakhs employees including GDS struck work. Though the strike will be over tonight, the struggle against the anti-worker policies will continue. Let us keep this unity and fighting spirit intact.</p>

<p>Dear Sir/Madam,</p>
<p>The Joint Platform of Action of Government and Associate Services Employee’s Organizations — All India Committee has given a notice that the affiliated organizations of JPA and the mass of employees working in Government services throughout the country will boycott work and resort to various forms of protest action on two days Nationwide General strike on 20th &amp; 21st February, 2013 in pursuance of their Charter of Demands.</p>
<p>2. The instructions issued by the Department of Personnel &amp; Training prohibit the Government servants from participating in any form of strike including mass casual leave, go-slow etc. or any action that abet any form of strike in violation of Rule 7 of the CCS (Conduct) Rules, 1964. Besides, in accordance with the proviso to Rule 17(1) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgments that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with the law. Any employee going on strike in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. In this connection, your kind attention is also drawn to this Department’s OM No. 33012/1(s)/2008-Estt (B) (pt) dated 12th September, 2008 (copy enclosed).</p>
<p>3. A Joint Consultative Machinery for Central Government employees is already functioning. This scheme has been introduced with the object of promoting harmonious relations and of securing the greatest measure of co-operation between the Government, in its capacity as employer, and the general body of its employees in matters of common concern, and with the object, further of increasing the efficiency of the public service. The JCM at the different levels have been discussing issues brought before it for consideration and either reaching amicable settlement or referring the matter to the Board of Arbitration in relation to pay and allowances, weekly hours of work and leave, whenever no amicable settlement could be reached in relation to these items.</p>
<p>4. The Central Government Employees under your Ministry / Departments may, therefore, be suitably informed of the aforesaid instructions under the Conduct Rules issued by this Department and other regulations upheld by the Hon’ble Supreme Court and dissuaded from resorting to strike in any form. You may also issue instructions not to sanction Casual Leave or other kind of leave to employees if applied for, during the period of the proposed strike and ensure that the willing employees are allowed hindrance free entry into the office premises. For this purpose, Joint secretary (Admn) may be entrusted with the task of coordinating with security personnel. Suitable contingency plan may also be worked out to carry out the various functions of the Ministry/Department.</p>
<p>5. In case the employees go on strike, a report indicating the number of employees who took part in the proposed strike may be conveyed to this Department on the evening of the day.</p>

<p>The undersigned is directed to say that the Instructions issued by the Department of Personnel &amp; Training prohibit the Government servants from participating In any form of strike including mass casual leave, go-slow etc. or In any way abet any form of strike which will be in violation of Rule 7 of the CCS(Conduct) Rules, 1964. The Supreme Court has also agreed in several that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with inaccordance with law. Any employee going on strike in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action.</p>

Therefore, apart from the fact that any form of strike/mass casual Leave / boycott of work would be in violation of the CCS(Conduct) Rule, going on any form of strike will also not be in the Interest of the employees. Accordingly,the undersigned is directed to convey that if any employee or an association / group<br />
of employees, under any nomenclature, indulge in any form of strike/boycott of work in pursuance of any alleged demands, or send any letter conveying of their intention to organize any such event, in terms of the provisions mentioned in para-I above, the salary of such employees for the day/days in question shall not be paid and the details of such employees shall have to be intimated by the concerned office where such an event took place to the Administrative Ministry/Department concerned, within 15 days of such incident for a decision on how to treat the unauthorized absence occasioned by such an action by the employees.  This will be without prejudice to any disciplinary action that may be intimated against such employees. All Ministries/Departments are requested to bring the contents of this O.M. to the notice of all concerned offices under them.</p>

<p>Jamshedpur, Feb 18 (PTI) Congress in Jharkhand today threatened stringent action against any party worker taking part in the two-day strike called by trade unions, including Congress-affiliated INTUC.</p>
<p>Jharkhand Pradesh Congress Committee president and Rajya Sabha MP Pradip Kumar Balmuchu told a press conference here that Congress is opposed to the strike and would take stringent action if any party worker participated in it.</p>

<div>Eleven Central trade unions tonight stuck to their call for a two-day nation-wide strike from Wednesday after talks with senior ministers convened at the instance of Prime Minister Manmohan Singh failed.</div>
<div></div>
<div>Rejecting the prime minister’s appeal on Sunday to the unions to call of the stir, the trade unions said the panel of ministers failed to give them any concrete proposal and that not even one of their demands were accepted.</div>
<div></div>
<div>&#8220;The strike is on… They are only asking for time. They say they will study the demand and will give proper reply or take necessary action later on… We said it is not possible, there should be some concrete decision over demands of the workers,&#8221; INTUC President G Sanjeeva Reddy told reporters.</div>
<div></div>
<div>INTUC is affiliated to the Congress.</div>
<div></div>
<div>AITUC General Secretary Gurudas Dasgupta also endorsed Reddy’s views.</div>
<div></div>
<div>The two-hour long meeting was attended by representatives of all the 11 trade unions.</div>
<div></div>
<div>Prime Minister Manmohan Singh had on Sunday appealed to the unions to call off their strike as it would cause loss to economy besides inconvenience to people and offered talks.</div>
<div></div>
<div>The Prime Minister had requested his senior Cabinet colleagues A K Antony, Sharad Pawar and P Chidambaram besides Labour Minister Mallikarjun Kharge to hold discussions with the union leaders.</div>
<div></div>
<div>Finance Minister P Chidambaram could not attend the meeting because of ongoing budget meetings.</div>
<div></div>
<div>The meeting took place in Antony’s office at the Defence Ministry.</div>
<div></div>
<div>Reddy also said that government failed to offer any alternative to their call for strike.</div>
<div></div>
<div>&#8220;If no demand is settled and no concrete assurance is given, it is very difficult for the trade unions to withdraw or postpone the strike,&#8221; he said.</div>
<div></div>
<div>Asked what were the offers given to unions from the government, he said, &#8220;No offer, they wanted more time. We said we have already given two years time. We placed the demands three years before, so three years time we already gave, so there is no question of giving more time.&#8221;</div>
<div></div>
<div>The government could not give any concrete assurance on any one single demand,he said, adding therefore we are sticking to our strike plan.</div>
<div></div>
<div>The 10 demands mainly related to checking of price rise, generation of employment, halting of disinvestment in public sector enterprises and implementation of labour laws.</div>

										<content:encoded><![CDATA[<p><strong>PSU bank staff to go on two-day strike from Feb 20</strong></p>
<p>Normal banking operations may be hit as employees unions of public sector banks have decided to join the two-day strike call given by central trade unions beginning February 20 to press for wage hike in the backdrop of rising inflation.</p>
<p>The nation-wide strike call has been given by United Forum of Bank Unions (UFBU) consisting of nine national level unions including AIBEA, NCBE, BEFI, INBEF, NOBW and AIBOC in support of their demand.</p>
<p>Apprehending disruption in their normal banking operation, many banks have already informed their customers about the proposed strike.</p>
<p>&#8220;A section of the bank’s employees may participate in the proposed strike on the said date, if the strike materializes. In view of the above, it is likely that the normal functioning of the bank branches and offices may get affected,&#8221; Corporation Bank said in a statement.</p>
<p>Delhi State Bank Employees Federation said, clearing function of RBI will be affected and other banking operations.</p>
<p>Meanwhile, sources said, banks would be taking steps to ensure that public do not face problem at least on the cash front during the strike period.</p>
<p>Banks would be feeding additional cash in ATMs to take care of cash needs of their customers.</p>
<p>Bank unions are also opposing banking sector reforms and any plan for merger of banks.</p>
<p>The bank strike is part of general strike call given by all 11 central trade unions including Indian National Trade Union Congress (INTUC), All India Trade Union Congress (AITUC), Bharatiya Mazdoor Sangh (BMS), Centre of Indian Trade Unions (CITU) and All India United Trade Union Centre (AIUTUC).</p>

<p>I appeal to the Central Trade Unions to withdraw their call for a countrywide General Strike on 20 and 21 February, 2013. Such a strike would lead to avoidable loss to our economy and inconvenience to the public through disruption of services.</p>
<p>While some of the issues raised by the Trade Unions are already being acted upon and others are at various stages of consideration, I have requested my senior Cabinet colleagues Shri A K Antony, Shri Sharad Pawar, Shri P Chidambaram and Shri Mallikarjun Kharge to together hold discussions with the leaders of the Trade Unions. I am confident that these discussions would result in a course of action that is acceptable both to the Trade Unions and the Government.</p>

<p>Detailed report of the last Trade Union Strike, which was held on 28.2.2012 was submitted in the Lok Sabha by the Minister Shri.Praful Patel&#8230;</p>
<p>The Major Central Trade Unions viz. Indian National Trade Union Congress, Bharatiya Mazdoor Sangh, Centre of Indian Trade Unions, All India Trade Union Congress, Hind Mazdoor Sabha, United Trade Union Centre and their affiliated unions observed countrywide general strike on 28th February 2012 to press the following 10 points charter of demands;-</p>
<p>(1) Concrete measures to contain price rise,<br />
(2) Concrete measures for linkage of employment protection with the concession/iVicentive package offered to the entrepreneurs,<br />
(3) Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws,<br />
(4) Universal social security cover for the unorganized sector workers,<br />
(5) Stoppage of disinvestment in Central and State PSUs,<br />
(6) No contractorisation of work of permanent/perennial nature of job,<br />
(7) Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs. 10,000/-<br />
(8) Remove all ceilings on payment and eligibility of Bonus, Provident Fund, increase the quantum of gratuity,<br />
(9) Assured Pension for ail,<br />
(10) Compulsory registration of trade unions within a period of 45 days and immediate ratification of the ILO conventions No. 87 and 98.</p>
<p>All the Deputy Chief Labour Commissioner (Central) and Regional Labour Commissioner (Central) in the field had intervened on the strike notices received by them pertaining to Central Sphere.</p>
<p>Some of the remedial measures taken/initiated by the Government are as under:<br />
(i) The Government has taken various fiscal as welt as administrative measures to contain price rise as a result of which inflation is moderating;</p>
<p>(ii) So far as enforcement of labour laws in Central sphere is concerned, there exists a well defined and effective machinery consisting of Labour Enforcement Officers (Central), Assistant Labour Commissioners (Central), Regional Labour Commissioners (Central) and Deputy Chief Labour Commissioners (Central) under Chief Labour Commissioner (Central). Similarly, Employees State Insurance Corporation and Employees Provident Fund Organisation have their own enforcement machinery. Similar arrangements are also available in the States for enforcement of labour laws in the State sphere;</p>
<p>(iii) Keeping in view the recommendations of National Commission for Enterprises in Unorganised Sector and Parliamentary Standing Committee, the Government has enacted Unorganised Workers` Social Security Act, 2008. The Government has also set up National Social Security Fund with a corpus of Rs.1000 crore. National Social Security Board has also been constituted which is advising the Government from time to time on new Social Security Schemes.</p>
<p>(iv) To ensure universal coverage of employment under Minimum Wages Act, a proposal for amendment in the Act has already been mooted. Regarding fixation of statutory minimum wages at not less than Rs.10, 000, the matter was discussed in the 44th Indian Labour Conference held on 14th and 15th February, 2012 but no consensus could emerge.</p>
<p>(v) So far as removal of wage ceilings under Provident Fund Act is concerned, the matter was debated in the 44th Indian Labour Conference held on 14th and 15th February, 2012 and a broad based consensus emerged for raising wage ceiling from present level of Rs. 6500 to Rs. 10000 or Rs. 15000.</p>
<p><strong>Some major Central Trade Unions viz., INTUC, BMS, CITU, HMS, AITUC and Federation of Bank Unions had given a call for general strike to press their demands.</strong></p>
<p><strong>The year wise details of their demands are given below:</strong><br />

<p><strong>2010 &#8211; Major Central Trade Unions i.e. INTUC, CITU,  AITUC and HMS,  had given nation- wide strike call to be observed on 07.09.2010 for following demands to be considered by the Government :-</strong><br />
(i) To check price rise of essential commodities.<br />
(ii) Concrete proactive measures to be taken for linkage of employment protection.<br />
(iii) Strict enforcement labour laws.<br />
(iv) Schemes under the un-organised Social Security Act, 2008 and<br />
(v) Disinvestment of shares of Central Public Sector Enterprises.</p>
<p><strong>2011 &#8211; United Forum of Bank Unions comprising 8 unions / association had given strike notice for resorting to nation-wide strike on 07.07.2011  to press their following demands:-</strong><br />
(i) Not to privatize Public Sector Banks,<br />
(ii) Not to reduce Government’s  equity in Public sector Banks,<br />
(iii) Not to avail World Bank Loan to capitalize Public Sector banks,<br />
(iv) Not to proceed with merger of Banks including the Associate Banks with SBI,<br />
(v) Not to issue license to Industrial house to start their own Banks,<br />
(vi) Not to violate provisions of Bipartite Settlement on outsourcing,</p>
