Kindly refer to the above Subject.<br />
2. The matter was referred to Department of Expenditure who have now conveyed their final advice as under :-</p>
<p>&#8220;Accordingly, Department of Revenue is informed that the fixation of pay as on 1.1.2006 is to be done only with reference to the actual pay scale of Rs. 6500-10500 and pay in the pay band so fixed will be the revised pay and thereafter, the Grade pay of Rs. 4600/.now admissible in the revised structure will he paid. In case there is anomaly whereby a senior promote officer draws less pay than the Minimum Entry pay of DRs who has joined after 01.01.2006, then the stepping up of pay senior promote may be considered at par with the pay of the junior DR appointed on or after 01.01.2006, subject to the following conditions:-</p>
<p>a.Stepping up of the pay of seniors can be claimed only if in these cadres there is an element of direct recruitment and in cases where a direct recruited junior appointed on or after 01.01.2006 is actually drawing more basic pay than the seniors. In such cases, the basic pay of the seniors will be stepped up with reference to the pay of the directly recruited junior provided they belong to the same seniority list for all purposes.</p>
<p>b.Government servants cannot claim stepping up of their revised basic pay with reference to the entry pay in the revised structure for direct recruits appointed or after 01.01,2006, as lain down in section 11 of part A of the first schedule to the<br />
CCS (RP) Rules, 2008, if their cadre does not have in element of direct recruitment or in cases where no junior is drawing basic pay higher than them.</p>
<p>c.Stepping up of pay of the seniors shall not be applicable in cases where direct recruits have been granted advance increments at the time of recruitment.<br />
Overpayment over and above this will have to be recovered in an administratively suitably way.&#8221;</p>
<p>3. In pursuance to the final advice given by Department of Expenditure it is directed that pay fixation of the Inspectors/PAs/AOs in the Sixth CPC revised pay scales should be done w.r.t. the pre revised scales of Rs.6500-10500 along with Grade Pay of Rs.4600 with stepping up being resorted to whenever applicable as advised by DOE.</p>
<p>4. In so far as the issue of recovery of excess payments already made in deserving cases, it is clarified that such excess payments already made can be waived as per provision of Rule 17 of the DFPRs. Under certain specific circumstances all the CCIT(CCAs) may accordingly a analyse all the cases in which recoveries are to be made and refer the deserving cases for further necessary action under Rule V of the DFPRs to the Board. The cases should be referred to the DIT(B&amp;E) under DIGIT (Logistics) as separate budget will need to be provided for the proposed remissions and the matter will need to be taken up first with the IFU before it is sent to the DOE.</p>
<p>5. This issues with the approval of the Chairperson, CBDT.</p>

<div>The second meeting of this Central Executive Committee of the All India Central Excise Inspectors&#8217; Association was held in Bhubaneswar on the 24th and 25th of August, 2012. The Secretary General Com. Kousik Roy laid down office following his promotion as Superintendent. The CEC expressed it sappreciation and thanks for his massive contribution in strengthening the Association and widening its base by his ustained and determined efforts. Under the leadership of Com.Shibaji Nayak the Odisha Circle of the Odisha Circle for this.</div>

<div>The CEC also unanimously resolved that</div>
<div>a. Com.Kousik Roy was requested to be the Advisor of the AICEIA, which he accepted.</div>
<div>b. Asstt. Secretary General Ajit Kumar K G shall take over as the new Secretary General.</div>
<div>c. Com.&#8217;A Satish shall be the new Assistant Secretary General.</div>
<div>d. Com. E.Sami shall be the Working President designate, and he shall take charge from Com. N. Venkitakrishnan, when the latter gets promoted which is expected soon.</div>
<div></div>
<div>Other major decisions that were taken at the meeting included :</div>
<div>1. In response to the call of the <strong>Joint Action Committee of Staff Associations in the CBEC, AICEIA would participate in the Protest Programme on 26.09.2012</strong>. All members of the AICEIA in all offices of the CBEC all across the country should observe a fast on that day and wear black badges. During lunch break, meeting, should be held at all Hqrs offices &#8211; Commissioners&#8217; and Chief Commissioners offices, and also at other locations/ lower formations too like Division Offices. Co-ordination Committees may be formed with office bearers of other Association, participating in the JAC, which now Includes Associations from both Customs and Excise sides representing Superintendents, Ministerial Officers, Gr C Executive (Sepoys, Drivers, Hawaldars etc.) and Telecommunication Staff, apart from us Inspectors. Notices may be served well in advance to all Chief Commissioners and Commissioners and Divisional Heads etc. by the respective Circle Secretaries and Branch/Unit Secretaries regarding the Protest Programme. The Notice served to Revenue Secretary by the Joint Conveners of the JAC is enclosed. Wherever possible similar joint notices may be served signed by Representatives of all Associations, or even those available. If joint notices with other Associations is getting delayed then notices may be served signed by our Circle Secretaries and Branch/Unit Secretaries.</div>

<div>Active campaigning should be undertaken by all Office bearers at all levels to make the 26th programme a resounding success.</div>
<div>2. To take up again with the Board urgently the problems in Transfer of Inspectors from one Seniority Zone under a CCA to another, especially regarding non-forwarding of applications, and also demand lifting of the requirement of completion of probation period for being eligible to apply for such transfer.</div>
<div>3. To propose to the Central Excise Superintendents&#8217; Association formation of a Federation of the All India Central Excise Inspectors&#8217; Association and The All India Association of Central Excise Gazetted Executive Officers.</div>
<div>4. To augment funds to meet legal expenses since the Fund created earlier has almost depleted.</div>
<div>5. To hold the next Convention of the AICEIA at Patna in December 2012.</div>
<div>6. To take up with the CBEC the issue of Inspectors posted to Cigarette Factories getting hounded by the Administration for no fault of theirs, as pointed out by AICEIA Branch Indore, and also by the delegates from Chandigarh and Gujarat.</div>
<div>7. To demand immediate sanction of more posts especially of Superintendents and Inspectors for Service Tax work, which has increased by leaps and bounds, and which in view of the acute staff shortage is causing extreme hardship by work overburden on the available officers.</div>
<div>8. To reiterate emphatically before the CBEC the demand already voiced several times earlier -Removal of regional disparities in promotions from Inspector to Superintendent of Central Excise.</div>

<div>All Circle/Branch Secretaries are requested to collect DDO Certificates for the current financial year and send them to the SG at the earliest. This needs to be accorded topmost priority since we need to furnish the same to the Board urgently for the pending renewal of our Association&#8217;s recognition. The same would also be required for the Convention. All pending dues may please be cleared at the earliest. Any issues in this regard may be addressed to Com. Pradip Banerjee [email: banerjee pradipkumar(5)rediffmail.com , cell no. 09831647206] who has graciously acceded to the request to continue as Treasurer of the AICEIA till the Convention.</div>

<div>1. Furnish the Board&#8217;s proposal after the submission of the Federations/Associations on 25.01.2011 to CBEC, New Delhi and ensure obtaining Federations/Associations views and comments on the D.O.P&amp;T&#8217;s decision on Board&#8217;s Proposal. Inclusion of all isolated cadres like Telecommunication wing, Marine wing and Chemical staffs whose restructuring is pending in the ongoing Restructuring of Cadres.</div>
<div></div>
<div>2. A committee be constituted with the representatives of all Recognised Federations/Associations of Joint Action committee and the officials from the CBEC to finalise the ensuing Restructuring of the cadre of CBEC as was done in CBDT.</div>
<div></div>
<div>3. No reduction/abolition of posts in any of the grade belonging to Group &#8216;C&#8217; (non-ministerial), Group  &#8216; C&#8217; (Ministerial) &amp; Group &#8216;B&#8217; (Gazetted &amp; Non-Gazetted) &amp; Group &#8216;A&#8217; officers taking into account the submissions made by different Associations consequent to the meeting held with the CBEC officials on 18.01.2011.</div>

<div>4. Ensure at least 04(four) functional promotions in the service life across the cadre.</div>
<div></div>
<div>5. One time relaxation for regularisation of the daily wagers/casual labours through the on going cadre restructuring.</div>
<div></div>
<div>6. The vacancies that would crop up out of the cadre restructuring exercise should be filled up first by giving appointment to all the pending Compassionate appointment cases as one time measure, disregarding the cap of 5% of the Direct Recruit vacancies as provided in the relevant instructions.</div>
<div></div>
<div>7. Prompt and adequate consideration and redressal of the proposals in respect of ongoing restructuring of cadres of the CBEC submitted by the respective Federations/Associations.</div>
<div></div>
<div>8. Redefining the role of employees in conformity with the procedural changes of the department,deployment of all categories of Officers be made in an appropriate manner after importing proper training.</div>
<div></div>
<div>9. Restructuring of the cadres in consonance with the recommendation of the 6th CPC in Chapter 3.1.</div>
