<p>G.S.R.457(E). &#8211; In exercise of the powers conferred by sub-section (1) read with sub-section (1A) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the Government of Jammu and Kashmir, hereby makes the following rules, further to amend the All India Services (Death-Cum-Retirement-Benefits) Rules, 1958, namely :-</p>
<p>1 (1) These rules may be called the All India Services (Death-Cum-Retirement-Benefits) Amendment Rules, 2018.</p>
<p>(2) They shall be deemed to have come into force from the date of their publication in the Official Gazette.</p>
<p>2. In the All India Services (Death-Cum-Retirement-Benefits) Rules, 1958 in rule 16, after the third proviso under sub-rule 1, the following proviso shall be inserted, namely :-</p>
<p>&#8220;provided also that a Member of the Service holding the post of Chief Secretary to the Government of Jammu &amp; Kashmir may be given extension of service, under exceptional circumstances, for a period beyond six months but the total term as Chief Secretary not exceeding three years and up to the age of sixty-two years, whichever is earlier, on the recommendations made by the State Government of Jammu &amp; Kashmir, with full justification and in public interest, with the prior approval of the Central Government&#8221;.</p>

<p>I am directed to refer to this Department’s D.O. No. 6(1)/2014-E0(PR) dated 22.12.2016, wherein instructions regarding online filing of Immovable Property Returns under rule 16(2) of AIS(Conduct) Rules, 1968 were issued. In this regard, it is reiterated that all members of the All India Services shall continue to file Immoveable Property Returns (IPR) as on 1st January and latest by 31st January under rule 16(2) of AIS(Conduct) Rules, 1968. Accordingly, the same may please be brought to the notice of all concerned for strict compliance.</p>

										<content:encoded><![CDATA[<p><strong>Govt lays down specific &#8216;timeline&#8217; for completing enquiry against officers and members of All India Services</strong></p>
<p>Government has laid down specific timeline for completing enquiry against officers and members of All India Services (AIS) within a given deadline, in a time-bound manner. Giving details about the DoPT (Department of Personnel &amp; Training) decision, Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr Jitendra Singh said that the AIS (D&amp;A) Rules, 1969 have been amended to provide specific timelines at different stages of the enquiry, with a view to complete the disciplinary proceedings against the members of All India Services in a time-bound manner.<br />
As per the amended rules, a time limit of six months has been fixed for completion of departmental enquiry and submission of report. In case it is not possible to complete the enquiry within six months for justifiable reasons to be recorded in writing, additional time limit not exceeding six months at one time can be granted by the Disciplinary Authority, thereby ensuring accountability for completion of enquiry. Further, 30 days’ timeline has been fixed for the delinquent officers to give his representation to the charge-sheet which can be extended to not more than 30 days by the Disciplinary Authority and, in any case, no extension will be provided beyond 90 days. Similarly, a period of 15 days has been provided to send a representation on the advice of UPSC regarding the penalty to be imposed on the delinquent officer and for such representation also, no extension will be provided beyond 45 days.<br />
Dr Jitendra Singh said, this amendment in the All India Service Rules has been brought, in keeping with the spirit of the Union Government led by the Prime Minister Shri Narendra Modi, to bring in more accountability and time-bound completion of every exercise in the course of governance. The new amendment in the Rules, he said, will certainly strengthen the culture of working within deadlines and timelines without showing any slackness.<br />
Meanwhile, Chairperson, Uttar Pradesh State Social Welfare Board (UPSSWB), Dr (Ms) Rupal Agarwal today called on Dr Jitendra Singh and provided her assessment about the performance of the various functionaries in the Board. She also brought to the notice of the Minister acts of omission or commission by certain officials. Dr Jitendra Singh took a note of the different issues raised by Dr Rupal Agarwal. He said, the Central Government accords high priority to programmes relating to upliftment of women, children and poor sections of the society. He also assured her that the issues raised by her will be brought to the notice of the concerned quarters.</p>

<p>2.2016, wherein instructions regarding online filing of Immoveable Property Returns under rule 16(2) of AIS(Conduct) Rules, 1968 were issued. In this regard, it is reiterated that all members of the All India Services shall continue to file Immoveable Property Returns (IPR) as on 1 st January and latest by 31 st January under rule 16(2) of AIS(Conduct) Rules, 1968. Accordingly, the same may please be brought to the notice of all concerned for strict compliance.</p>

<p>Subject: <strong>Consolidated Deputation Guidelines for All India Services.</strong></p>
<p>Sir,</p>
<p>This Department&#8217;s instruction No.14017/33/2005-AIS(11)(pt.II) dated the 28th November, 2007 provides the guidelines for All India Service Officers with respect to Rule 6 of the IAS (Cadre) Rules, 1954 and the analogous provision for the Indian Police Service and the Indian Forest Service.</p>
<p>2. Further to the issue of the above mentioned instructions, it has now been decided with the approval of the competent authority that if the administrative Ministries/Departments and other borrowing organisations wish to retain an officer beyond five years, they may extend the tenure of deputation covered under consolidated Deputation Guidelines issued vide letter No.14017/33/2005-AIS- (II)(Pt.1) dated the 28t11 November, 2007, where absolutely necessary in the public interest, upto a period not exceeding 7 years at a stretch. This shall be done with the approval of the Minister of the borrowing Ministry/Department concerned and in respect of other organisations with the approval of the Minister of the borrowing Ministry/Department with which they are administratively concerned, keeping in view the exigencies and subject to fulfilment of all other requirements such as willingness and vigilance clearance of the Officer concerned, NOC of the lending authority/State Government, UPSC/ACC approval wherever applicable. Thus no case of extension shall be referred to the Department of Personnel &amp; Training, New Delhi.<br />
3. All other terms and conditions issued vide OM No. 20011/2/2010-AIS-11 dated the 29th March, 2012 will remain unchanged.</p>
<p>4. In cases where the necessity to have deputation tenures longer than seven years is felt, the concerned administrative Ministries/Departments/borrowing organisations may amend the relevant Recruitment Rules of such deputation post accordingly, after following the requisite procedure. No extension of deputation beyond 7 years is to be allowed unless provided in the relevant Recruitment Rules of such deputation post. It is reiterated that no case for extension beyond five years shall referred to DoPT.<br />
5. It is also clarified that cases which are not covered by the OM dated 29.3.2012 including those where Central Government is neither a lending authority nor borrowing authority, will continue to be decided in terms of the relevant provisions/rules/instructions etc. governing them.</p>
<p>6. These order shall come into effect from the date of issue of this instruction .</p>

<p>Subject: <strong>Clarification on crucial date of determination of age of 56 years for induction into AIS and its applicability with reference to the year of select list-regarding</strong></p>
<p>The undersigned is directed to refer to the subject cited above and to say that on the direction of Hon’ble Supreme Court, and in consultation with Ministry of Home Affairs, Ministry of home affairs, ministry of environment and forest, UPSC and the state Governments, the central government has decided to raise maximum age limit from 54 years to 56 years for promotion/induction from state service/Non-state Civil Service to All India Service with effect from the Select List of 2015 with crucial date of determination of age as 01.01.2015. In order to implement this decision, this Department has issued four notifications dated 17.03.2015 amending the following date of their publication in the official gazette:-</p>
<blockquote><p>(i) Regulation 5 (3) of Indian Administrative Service (Appointment by Promotion) Regulations, 1955;<br />
(ii) Regulation 5 (3) of Indian police service (Appointment by Promotion) Regulations, 1955;<br />
(iii) Regulation 5 (3) of Indian Forest Service (Appointment by Promotion) Regulations, 1966; and<br />
(iv) Proviso 1 below Regulation 4(1)(iii) of Indian Administrative Service (Appointment by Selection) Regulation, 1997</p></blockquote>
<p>2. Further, as decided by the Government, anomaly in Non-SCS Select List vis-à-vis SCS Select List for the vacancies arising during the same year has been removed through OM dated 17.3.2015. As per this OM, for the Vacancies arising during the period 1.1.2014 to 31.12.2014, the select list of Non-SCS officers will be styled as Selected List-2014-A instead of Selected List 2015. The select list of SCS officers had already been styled coinciding with the year of the vacancies from the year 2010, after the clarificatory OM dated 25.08.2010. Thus, for the vacancies arising during the year 2015 (between 1.1.2015 to 31.12.2015), the Select List for both SCS officers as well as Non-SCS officers will be styled as Select List-2015.</p>
<p>3. Now, for the benefit of all stakeholders, it is clarified that the above amendments are applicable for the Select Lists of 2015 (vacancies arising between 01.01.2015 to 31.12.2015) and onwards with crucial date for determination of age as 1 st January of that Select List year. For example, for the Select List of 2015, the upper age limit for consideration will be 56 years with crucial date for determination of age as 01.01.2015.</p>
<p>4 In so far as the Select Lists of State Service/Non-State Civil Service officers of 2014/2014-A to be prepared for the vacancies arisen between 1.1.2014 to 31.12.2014 are concerned, the same would be prepared in accordance with the regulations existing in 2014. In other words, up-to the Select Lists of 2014/2014-A, the maximum age limit for consideration for induction into AIS would be 54 years and the same would be reckoned as on 1st January of the respective Select List year.</p>
<p>5(i). For further clarity, for example, 10 and 2 vacancies arose during 01.01 .2014 to 31.12 2014 in West Bengal cadre in the SCS and Non-SCS category respectively. The Select List for SCS officers would be styled as Select List 2014 and for Non-SCS officers, it would be styled as Select List 2014-A. The Selection Committee Meetings would be held in 2015 and the upper age limit will be 54 years with crucial date of determination as 01.01.2014 for both the category of officers.</p>
<p>(ii) Similarly, if 6 and 2 vacancies arise during 01.01.2015 to 31.12.2015 in Odisha cadre in the SCS and Non-SCS category respectively the Select Lists would be styled as Select List 2015 for both the category of officers. The Selection Committee Meetings for Select List 2015 would be held in 2016 and the upper age limit will be 56 years with crucial date of determination as 01.01.2015 for both SCs and Non-SCs officers.</p>
<p>6. All State Governments/Cadre Controlling Authorities and UPSC are, therefore, requested to implement the aforementioned amendments in accordance with the above clarifications,</p>

<div>G.S.R.&#8212;&#8212;&#8212; (E).- In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the Governments of the States concerned hereby makes the following rules further to amend the All India Services (Medical Attendance) Rules. 1954, namely:-</div>

<div>1. (1) These rules may be called the All India Services (Medical Attendance) Amendment Rules, 2012.</div>
<div></div>
<div>(2) They shall come into force on the date of their publication in the Official Gazette.</div>
<div></div>
<div>2. In the All India Services (Medical Attendance) Rules, 1954. in rule 2 (C), in Explanation 1, for the letters and figures &#8220;Rs.1500/-’, the words and figures “rupees 3500/- plus dearness allowance thereon as on the date of consideration” shall be substituted.</div>
