<h3 class="wp-block-heading">Subject: Instructions under AIS (Study Leave) Regulations, 1960 regarding Leave Salary for AIS officers on Central Deputation during Study Leave and grant of ex-India Study Leave for pre or post course formalities.</h3>



<p>Sir / Madam,</p>



<p>I am directed to refer to letter No. 11020/09/2008 -AIS-III dated 14/07/2008 (copy enclosed) which provides for Regulation of grant of Study Leave to the members of the All India Services who are on deputation to the Government of India under Central Staffing Scheme.</p>



<p>2. Instances have come to notice of this Department of Study Leave proposals of AIS officers whose Central Deputation tenure is ending during the period of Study Leave, which causes inconvenience to the members of the All India Services in drawing leave salary.</p>



<p>3. Accordingly, in continuation of procedure provided as per letter dated 14.07.2008, it is decided that while granting the Study Leave in such cases, the salary of the concerned AIS officer till the approved period of Central Deputation shall be borne by the Central Government and for the period beyond Central Deputation, coinciding with the Study Leave period, shall be borne by the respective State Cadre/ Government.</p>



<p>4. In view of the above, the State Cadres/Governments while giving its concurrence/NOC in respect of Study Leave of AIS officers on Central Deputation, shall also affirm that the salary of the concerned officer for the period beyond Central Deputation, coinciding with the Study Leave period, shall be borne by the State Government.</p>



<p>5. Further, it has also been decided that, subject to Regulation 4 of AIS (Study Leave) Regulations, 1960, while submitting the application for ex-India Study Leave, the officer concerned may take a total 15 days of ex-India Study Leave, beyond the scheduled commencement and end dates of study course as per academic calendar of the University/ Institute. Such combination of 15 days ex-India Study Leave can be taken in parts or in total, either before commencement or after the end of Study Course abroad for pre or post course formalities. Further, such pre/post Study Leave period beyond the academic calendar of the University/ Institute needs to be duly specified while submitting proposals for ex-India Study Leave.</p>



<p>6. This issues with the approval of Competent Authority.</p>

<p>I am directed to refer to DoPTs letters vide dated 27.05.2024 regarding extension of timelines for recording of PARs for the year 2023-24. In this regard, it has come to notice that some AIS officers have not submitted self &#8211; appraisal of PARs and also some officers may not be able to review and record their remarks in PARs on time due to engagement in completion of General Election, 2024.</p>



<p>2. Accordingly, the matter has been duly considered in this Department. Therefore, keeping in view of the circumstances and in order to ensure filing of PARs by all AIS officers. It has been decided to further extend the timelines of PAR by 01 month, as indicated below:</p>

<h3 class="wp-block-heading">Sub: Extension of timelines for recording of PAR for the year 2022-23 in respect of AIS officers by the reporting / reviewing / accepting authorities &#8211; reg.</h3>



<p>Sir / Madam,<br />I am directed to refer to DoPT&#8217;s letter dated 30.05.2023 extending timelines for recording PAR for the year 2022-23 and the request received from State Govt. of Manipur for further extending timelines on the grounds of prolonged internet ban due internal disturbance in various parts of Manipur. Also, there may be some AIS officers in other State Cadres who could not complete their PAR within extended timelines of 15 days due to similar exigencies.</p>



<p>2. Accordingly, the matter has been duly considered in this Department and it has been decided with the approval of the Competent Authority to further extend timelines for recording PAR for the year 2022-23 by one month, in relaxation of rule 5(1) read with Schedule 2 of AlS (PAR) Rules so as to give sufficient time to each authority, as indicated below: –</p>

<h3 class="wp-block-heading"><strong>Subject:- Reviewing of guidelines for timely disposal of departmental proceedings against the officers of All India Services serving in connection with the affairs of the State Government / UTs &#8211; reg.</strong></h3>



<p>The undersigned is directed to refer to the subject cited above and to say that the timelines for departmental proceedings against the officers of All India Services were last reviewed vide DoPT&#8217;s Letter No. 106/7/2015-AVD.I (Part) dated 15/03/2017 in amendment of All India Services (Discipline and Appeal) Rules, 1969. With a view to streamline the processing of disciplinary proceedings (DP) against the officers of All India Services working in connection with the affairs of the State Government / UT, the following timelines/time frames are being stipulated:</p>

<p>2. In view of the introduction of time frames as elaborated above, all State Governments/UTs are advised to adopt the following measures, as contained in DoPT’s letter dated 15/03/2017 that was issued after amendment to All India Service (Discipline &amp; Appeal) Rules, 1969 and re-iterated herewith, so that the time frames can be strictly adhered to and the inquiry process can be completed expeditiously:-</p>



<ol class="wp-block-list" type="i">
<li>All listed documents on the basis of which the proposed disciplinary proceeding is to be initiated must be in the Custody of the DA.</li>



<li>In case disciplinary proceedings are initiated simultaneously with criminal proceedings on the same set of charges, a copy of all the documents and files should be kept in the custody of the DA prior to handling over the records, in case the said records are to be submitted in a court of law. In this regard, CVC OM No. 3(v)/99/7 dated 6<sup>th</sup>&nbsp;September, 1999 may be referred to.</li>



<li>Care may be taken to ensure that all listed documents are provided to the charged officer along with charge-sheet to enable him to submit his representation within the stipulated time.</li>



<li>The charge-sheet/ advice of UPSC served on the CO may clearly indicate that in the absence of a Statement of Defence or comments on the advice from the CO within the stipulated time frame as mentioned in Rule 8(5) and Rule 9(5) or a request from CO for extension of time, it would be assumed that the CO has no views to offer.</li>



<li>During the course of inquiry, where the CO seeks additional documents, the IO may decide on the relevance of the documents so sought expeditiously. The IO may be advised to procure the permitted additional documents from the custodian Departments in State Governments/UTs and supply of copies of documents to CO within one month. In case of delays at the level of the Departments in State Governments/UTs, the same may be brought to the notice of the DA by the IO to resolve the issue expeditiously and DA should issue a non-availability certificate with regard to the documents which are not available.</li>



<li>The time taken during the inquiry process may be regularly monitored and a register of all pending inquiries may be maintained. The IO should be advised to complete inquiry within six months. However, if he is unable to do so for any good and sufficient reasons, he should make a request for extension in terms of new sub-rule 8(25) to the DA well within the stipulated time frame. Every such&nbsp;&nbsp;extension must be approved by the State Disciplinary Authority (SDA) before expiry of the six months time period.</li>



<li>The State Governments/UTs should appoint a Nodal Officer of the rank of Under Secretary, Government of India with contact details (mobile/ e-mail/fax) for effective coordination between the Central and the State Government/UT.</li>

<h3 class="wp-block-heading">Subject: Payment of leave encashment in respect of AIS officers who were under suspension or disciplinary / criminal proceeding (s) pending against them at the time of retirement / superannuation &#8211; reg.</h3>



<p>Sir/Madam,</p>



<p>I am directed to refer to various references received in the Department seeking clarification on the subject noted above and the scope of applicability of 20A(4)(a) of AIS (Leave) Rules, 1955.</p>



<p>2. In this context, it may be noted that 20A(4)(a) of AIS (Leave) Rules, inter-alia, mentions about payment of cash equivalent of leave salary of the applicable leaves standing at the credit of a member of Service (moS), who has been permitted by the State Government to voluntarily retire from service while under suspension or who is retired by the Central Government in public interest while under suspension.</p>



<p>However, reference are being received in this Department seeking clarifications regarding payment of leave encashment to such members of service who were under suspension or against whom the disciplinary/criminal proceeding (s) were pending at the time of retirement / superannuation.</p>



<p>3. In view of the above, the matter has duly been examined under AIS (Leave) Rules, 1955 and other relevant rule provisions / instructions. Accordingly, it is clarified that “<strong>In case of a moS who is under Suspension or against whom Disciplinary / Criminal Proceedings are pending at the time of his retirement / superannuation, the authority competent to grant leave may withhold whole or a part of leave encashment, if in the view of such authority there is a possibility of some money becoming recoverable from him on conclusion of the proceedings against him. On conclusion of the proceedings, he will become eligible to the amount so withheld after adjustment of Government dues, if any</strong>”.</p>



<p>4, The aforesaid clarification may kindly be brought to the notice of all officials / authorities concerned for necessary action.</p>



<p>5. This issues with the approval of Competent Authority.</p>

<h3 class="wp-block-heading">Subject: Review of incentives/special allowances granted to AIS and Central Government Group &#8216;A&#8217; Service Officers working in North East Region &#8211; regarding</h3>



<p>Reference is invited to this Directorate’s OM No. 12035/31/96-Pol.II dt. 07.09.1998 granting benefit of retention of GPRA on posting to North East Region (including Sikkim) treating the region as non-family station. The benefit was subsequently extended time to time vide OMs dt. 30.09.1999, 30.04.2002, 15.07.2005, 01.07.2008, 03.06.2011, 09.07.2014, 07.04.2015, 10.04.2018 &amp; 08.04.2021.</p>



<p>2. Now, the Government has reviewed the incentives/special allowances granted to AIS Officers and Central Government Group ‘A’ Service Officers working in North Eastern Region and, accordingly, it has been decided to withdraw the benefits of retention of Govt. Accommodation at the last station of posting in so far as it relates to Group ‘A’ Officers including AIS Officers as was granted vide above quoted OMs.</p>



<p>3. As per above, no fresh retention at the last place of posting shall be granted to Group ‘A’ Officers including AIS Officers with immediate effect in case of their posting to North Eastern Region including Sikkim. However, provision of such retention to officers posted in remaining non-family stations i.e. J&amp;K, Ladakh, A&amp;N Islands, Lakshadweep and LWE areas as declared by M/o Home Affairs from time to time shall remain in force.</p>



<p>4. Moreover, the retention already granted to such officers who have earlier been posted to North Eastern Region including Sikkim will also be withdrawn, subject to any stay already granted by any court of law against any vacation order, giving opportunity to the allottee officers to vacate the accommodation latest by 31.03.2023.</p>



<p>5. In all above cases as mentioned in para 3 &amp; 4, the normal retention period allowed on transfer under Rule 40 of CGPRA Rules, 2017 shall remain applicable from the date of transfer.</p>



<p>This issues with the approval of Competent Authority.</p>

<p>Subject:- <strong>Consolidated Guidelines regarding grant of &#8216;Vigilance Clearance&#8217; to AIS Officers &amp; Central Civil Services/ Central Civil posts.</strong></p>

<p>D/o Personnel &amp; Training (DoPT) has from time to time issued instructions / guidelines regarding grant of Vigilance Clearance to AIS officers &amp; Central Civil Services/Central Civil posts. An effort has been made to consolidate and update the said guidelines at one place for better understanding and guidance, which are as follows:</p>



<h4 class="wp-block-heading">2. Part A-Grant of Vigilance Clearance to AIS Officers</h4>



<p>(i) These orders regarding accordance of vigilance clearance to AJS officers shall be applicable with respect to (a) inclusion in the offer list (b) empanelment {c) any deputation for which Central Government clearance is necessary, including deputation under Rule 6(1) and 6(2)(ii) of the AIS (Cadre) Rules (d) appointments to sensitive posts (e) assignments to training programmes (except mandatory training) (f) premature repatriation to the cadre. In all these cases, the vigilance status may be placed before and considered by the Competent Authority before a decision is taken.</p>



<p>(ii) The circumstances under which vigilance clearance shall not be withheld shall be as under:</p>



<ul class="wp-block-list"><li>Vigilance clearance shall not be withheld due to the filing of a complaint, unless it is established on the basis of at least a preliminary inquiry or on the basis of any information that the concerned Government may already have in its possession, that there is, prima facie, substance to verifiable allegations regarding (i) Corruption (ii) Possession of assets disproportionate to known sources of income (iii) Moral turpitude (iv) , violation of AIS Conduct Rules.</li><li>Vigilance clearance shall not be withheld if a preliminary inquiry mentioned in 2(ii)(a) above takes more than three months to be completed.</li><li>Vigilance clearance shall not be withheld unless (i) the officer is under suspension (ii) the officer is on the Agreed List, provided that in all such cases the position shall be mandatorily revisited after a period of one year (iii) a chargesheet has been issued against the officer in a disciplinary proceeding and the proceeding is pending (iv) orders for instituting disciplinary proceeding against the officer have been issued by the Disciplinary Authority, provided that the chargesheet is served within three months from the date of passing such order (v) chargesheet has been filed in a Court by the Investigating Agency in a criminal case and the case is pending (vi) orders for instituting a criminal case against the officer have been issued by the Disciplinary Authority, provided that the chargesheet is served within three months from the date of initiating proceedings (vii) sanction for investigation or prosecution has been granted by the Competent Authority in a case under the PC Act or any other criminal matter (viii) an FIR has been filed or a case registered by the concerned Government against the officer, provided that the charge sheet is served within three months from the date of filing/registering the FIR/case (ix) the officer is involved in a trap/raid case on charges of corruption and investigation is pending.</li><li>Vigilance clearance shall not be withheld due to an FIR filed on the basis of a private complaint unless a chargesheet has been filed by the investigating agency, provided that there are no directions to the contrary by a competent court of law.</li><li>Vigilance clearance shall not be withheld even after sanction for prosecution if the investigating agency has not been able to complete its investigations and file charges even after a period of two years. However, such vigilance clearance will entitle the officer to be considered only to be appointed to non-sensitive posts and premature repatriation to the cadre and not for any other dispensation listed in Para 2(i) above.</li><li>Vigilance clearance shall be denied to an officer if he fails to submit his annual Immovable Property Return of the previous year latest by 31st January of the following year, as required under Government of India decisions under Rule 16 of the All India Services (Conduct) Rule, 1968.</li></ul>



<p>(iii) In cases where complaints have been referred to the State, and no substantive response has been received from the State within three months from the date on which the reference was made, the Cadre Controlling Authority may provide a copy of the complaint to the officer concerned to seek his comments. If the comments are found to be prima facie satisfactory by the Competent Authority, vigilance clearance shall be accorded.</p>



<p>(iv) Vigilance clearance shall be decided on a case-by-case basis by the Competent Authority keeping in view the sensitivity of the purpose, the gravity of the charges and the facts and circumstances, in the following situations:</p>



<ul class="wp-block-list"><li>Where the investigating agency has found no substance in the allegation but the Court refuses to permit closure of the FIR.</li><li>Where the Investigating Agency/ IO holds the charges as proved but the State Government differs on the converse.</li></ul>



<p>(v) While considering cases for grant of vigilance clearance for the purpose of empanelment of AIS officers of a particular batch, the vigilance clearance/status will continue to be ascertained from the respective State Government. In respect of officers serving in connection with the affairs of the Central Government, the vigilance status/clearance will be obtained from the respective Ministry. In all cases, the comments of the CVC will also be obtained. However, if no comments are received within a period of three months, it will be presumed that there is nothing adverse against the officer on the records of the body concerned.</p>



<p>(vi) Vigilance clearance will be issued in all cases with the approval of the Head of Vigilance Division for officers up to one level below their seniority in service. In the case of officers of the level of Additional Secretary/Secretary, this will be issued with the approval of the Secretary. In case of doubt, order of Secretary will be obtained keeping in view the purpose for which the ‘vigilance clearance’ is required by the indenting authority.</p>



<p>(vii) Vigilance clearance will not normally be granted for a period of three years after the currency of the punishment, if a minor penalty has been imposed on an officer. In case of imposition of a major penalty, vigilance clearance will not normally be granted for a period of five years, after the currency of punishment. During the period, the performance of the officer should be closely watched.</p>

<p>(iii) In cases where complaints have been referred to the administrative authority concerned, and no substantive response has been received from such administrative authority concerned within three months from the date on which the reference was made, the Disciplinary Authority may provide a copy of the complaint to the officer concerned to seek his comments. If the comments are found to be prima facie satisfactory by the Competent Authority, vigilance clearance shall be accorded.</p>



<p>(iv) Vigilance clearance shall be decided on a case-by-case basis by the Competent Authority keeping in view the sensitivity of the purpose, the gravity of the charges and the facts and circumstances, in the following situations</p>



<ul class="wp-block-list"><li>where the investigating agency has found no substance in the allegation but the Court refuses to permit closure of the FIR; and</li><li>where the investigating agency/ inquiry officer holds the charges as proved but the Competent Administrative Authority differs on the converse.</li></ul>

In all such cases, the comments of the Central Vigilance Commission will be obtained. However, if no comments are received within a period of three months, it will be presumed that there is nothing adverse against the officer on the records of the body concerned.</p>



<p>(vi) Vigilance clearance will be issued in all cases with the approval of the Head of Vigilance Division for officers up to one level below their seniority in service. <p>Sir/Madam,</p>



<p>Reference is invited to Rule 18(1-A) of AIS (DCRB) Rules, 1958 which provides that in addition to pension admissible in accordance with clause Rule 18(1)(b) of AIS (OCRB) Rules, 1958, after completion of eighty years of age or above, additional pension shall be payable to the retired member of the service in the following manner:</p>

<p>2. In this context, as per the admissible Rules/provisions, additional pension shall be payable from first day of the calendar month in which it falls due and not from the date of completion of 80 years of age. For example, a pensioner born either on 01.08.1942 or on 20.08.1942 shall be eligible for additional pension at the rate of 20% of the basic pension with effect from 01.08.2022.</p>



<p>3. State/UT Governments are requested to ensure that there is no discrepancy in the interpretation of the aforementioned Rule and the retired AIS officers are paid additional pension as per the above provision.</p>

<p>Sir,<br />I am directed to state that the Government, after review of the various incentives/ Special Allowances being granted to the AIS officers working in the North Eastern Region, has decided that the incentives/ Special Allowances granted through the following letters/ OMs issued by this Department be withdrawn with immediate effect:</p>

<p><strong>Subject: Proposal for amendments in IAS (Pay) Rules, 2016, IPS (Pay) Rules, 2016 and IFS (Pay) Rules, 2016 -reg.</strong></p>



<p>Sir / Madam,</p>



<p>I am directed to say that with the objective to ensure timely submission of Immovable Property Return (IPR) by AIS officers i.e. IAS, IPS and IFS, a proposal to amend the respective pay Rules viz. IAS (Pay) Rules, 2016, IPS (Pay) Rules, 2016 and IFS (Pay) Rules, 2016 by way of incorporating the following Note below the Rule 3(1) of IAS (Pay) Rules, 2016 is under consideration of the Central Government:</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><em>“Note 4: A member of the service shall mandatorily file Immovable Property Return (IPR) for the previous year within the time frame specified for the purpose, i.e. 315 January, for being considered for appointment in the next level of pay in the pay matrix.</em><br /><em>Provided that a member of service, who has not filed the IPR for any of the year(s) prior to coming into effect of the above provision, shall mandatorily file the same within such period, as may be prescribed by the Central Government in this behalf. for being considered for appointment in the next level of pay in the pay matrix.”</em></p></blockquote>



<p>The identical Note will also be incorporated at the appropriate places of pay rules applicable to the IPS and the IFS.</p>



<p>2. In this regard, the State Governments are requested to furnish comments on the proposed amendments latest by 17.12.2021. This may kindly be accorded top priority.</p>



<p>3. This issues with the approval of the Competent Authority.</p>
