<h3 class="wp-block-heading">Sub: Exemption of Single mother employees from the purview of periodical transfer to other stations-Clarifications reg.</h3>



<p>As the Railway administration are aware, detailed consolidated instructions regarding periodical transfer of non-gazzeted Railway employees exists vide RBE No. 48/2012 and further instructions issued from time to time.</p>



<p>AIRF vide agenda Item No. 28/2012 has demanded that lactating mothers should be exempted from the purview of periodical transfers.</p>



<p>Attention in this connection is invited to instructions contained in Board’s letter no. E(NG)I/2022/TR/19 dated 23.08.2022 which provides that single mother, if she holds a sensitive post cannot be exempted from the scheme of periodical transfer. However she may be shifted as far as possible to a different seat in the same place / adjoining area to meet the requirements of periodical transfer. These provisions would henceforth be applicable to lactating mothers holding sensitive posts also in such a way that lactating mothers when transferred as per periodical transfer policy may be adjusted by shifting laterally during the period of breast feeding or 1 year from child birth whichever is less.</p>

In this regard, it is to be stated that instructions issued to WR vide Board’s letter of even no. dated 05.08.2022 was in reference to their letter dated 01/8/22, and refers to mutual transfers within same seniority unit and not for requests of mutual transfer across seniority units.</p>

<p>AIRF vide agenda Item No.28/2022 had demanded that single mothers should be exempted from the purview of periodical transfer to outstations. Their transfers should be invariably managed at the same stations by change of seat/work-place within the same station.</p>



<p>The matter has been considered by the Board and it is clarified that single mother employee, if she holds a sensitive post, cannot be exempted from the scheme of periodical transfer. However, she may be shifted as far as possible to a different seat in the same place/ adjoining area to meet the requirements of periodical transfer and to avoid any hardship, including school admission, safety of girl child, mental stress &amp; tension. The existing instructions on the subject are hereby reiterated.</p>

<h3 class="wp-block-heading">Sub: Vaccination of the Railway Staff and their families aged between 18-44 years</h3>



<p>Today I discussed the issue of vaccination to the Railway Staff and their families, aged between 18 to 44 years, with Hon’ble Minister for Railways and impressed upon him that the Railway Employees are Frontline Workers and they are feeling restless due to non-vaccination, particularly those in the age group of 18 &#8211; 44 years and also members of their families.</p>



<p>Hon’ble M.R. informed me that, he had already asked the Chairman to take immediate steps on the issue of vaccination of all the Railway Employees.</p>



<p>I also informed Hon&#8217;ble M.R. that the Chairman-Cum-CEO, Railway Board, all the General Managers, and even some of the DRM’s are actively trying their level best for arranging vaccination from the State Governments, but the State Governments are not cooperating. I requested to Hon’ble M.R., that this issue must be taken up at the political level with the Chief Ministers to provide sufficient vaccine to the Railway Staff and their families in their State Jurisdiction, or otherwise Railways should purchase the vaccines and they should be administered to the Railway Employees and their families by the Railways itself, and there should be no delay on this issue.</p>



<p>Hon&#8217;ble M.R. had agreed to pursue this matter and resolve the issue at an earliest.</p>

<p>The following important issues related to the Railwaymen are hanging fire in Rail Bhawan despite our repeated persuasions with Railway Board, resulting in serious unrest and discontentment amongst the Railwaymen:-</p>



<ol class="wp-block-list"><li>Promotion of the staff working in GP Rs.1800 to GP Rs.1900.</li><li>Promotion of the staff working in GP Rs.4600 to GP Rs.4800.</li><li>Regularisation of Course Completed Act Apprentices in Railways.</li><li>Curtailing 10% posts from D.R. Quota &#8211; LDCE “Open to All”.</li><li>Payment of Night Duty Allowance to all the Railwaymen performing Night Duty without any pay ceiling.</li><li>Implementation of accepted recommendations of <a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">7th CPC</a> in case of S.S.O.(A/Cs), CMT Cadre under Mech. Deptt., O.T. Asstt. of Medical Deptt., Lab. Supdt. of Medical Deptt.</li><li>Career Progression of Pointsman (they should be granted a four-grade structure as has been done in the case of Track Maintainers Category with other associated benefits) in consultation with Organised Labour.</li><li>Upgradation of posts of S&amp;T Cadre.</li><li><strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">Covid-19</a></strong> &#8211; Removal of the ceiling of maximum 30 days Special Casual Leave and restoration of Quarantine Leave in Indian Railway Establishment Code Vol. I for Railway Staff.</li><li>Validation of Privilege / Post Retirement Complimentary Passes / PTOs in Festival / Special Trains</li><li>Payment of ALK (HQ) to Running Staff during lockdown period.</li><li>Implementation of SALUTE in consultation with Organised Labour.</li><li>Withdrawal of closure decision of five Railway Printing Presses.</li><li>Absorption of Quasi-Administrative Staff in Railways.</li></ol>



<p>It would be highly appreciable if a Fast Track Mechanism is evolved for early redressal of aforementioned important issues of the Railwaymen.</p>

<p>Your kind attention is invited towards AIRF’s letter bearing number even dated 19.11.2020, addressed to Director General (Human Resources), <a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener">Railway</a> Board (photocopy enclosed for kind perusal), whereby this Federation had elaborately explained the facts necessitating in-house system of medical facilities presently available for Serving / Retired Railwaymen and their dependent family members.</p>



<p>As we have already explained, keeping in view the peculiar nature of duties of the Railwaymen, who work under various arduous conditions in all weathers 24X7 throughout the year for keeping the wheels of the Indian Railways moving to ensure the overall development of the country, the existing medical facilities were created for them and their dependent family members.</p>



<p>It would be pertinent to mention here that, even in the Colonial Days, British Rulers had recognized the need for medical facilities for Railwaymen and established many Dispensaries and Hospitals during those days. Even after the Independence, Medical System over the Indian Railways has been expanded to a greater extent to meet the medical requirements of the Railwaymen and their families.</p>



<p>Medical facilities, so available for the Railwaymen, have been achieved by the Organised Labour after sustained struggle and persuasions in the wake of aforementioned peculiar working conditions.</p>



<p><a href="https://centralgovernmentnews.com/special-casual-leave-to-be-consider-the-absence-during-covid-19-epidemic-lockdown-period-airf/">Special Casual Leave to be consider the absence during COVID-19 epidemic lockdown period – AIRF</a></p>



<p>It is a matter of concern that, Railway Board have not given any cognizance to AIRF’s viewpoint, already communicated to Railway Board vide AIRF’s letter dated 19.11.2020, addressed to D.G.(H.R.), Railway Board, and without consulting Organised Labour, who are representing more than one million Railway Employees and equal number of Retired Railway Employees(total number of beneficiaries being around one crore), Railway Board have been proceeding ahead for Medical Insurance to all the Railway Employees. This arbitrary change in the policy of medical assistance to Railway Employees is bound to create a lot of anguish in the minds of Serving as well as Retired Railway Employees.</p>



<p>AIRF, vide its communications No.AIRF/71 dated 06.08.2020, No.AIRF/101 dated 16.09.2020 and 19.11.2020 has already objected to the Railway Board’s proposal of Medical Insurance to all the Railway Employees, quoting various reasons, but instead of holding a discussion with the Recognised Federations, further information is being sought by the Railway Board from the Zonal Railways and Production Units, vide their letter No.E(W)2020 /Misc./ Dashboard-GIS dated 30.12.2020, with a view to proceed further in the matter.</p>



<p>AIRF is of the firm opinion that, Railway Administration should not compel and force Serving as well as Retired Railway Employees to accept the proposal of Medical Insurance being initiated by the Railway Board.</p>



<p>It would, therefore, be quite appropriate that, such type of exercises, which are bound to create avoidable discontentment and resentment among Serving as well as Retired Railway Employees, should be stalled immediately. We presume that, this exercise is being undertaken to appease some of the Corporates who are dealing in Insurance Business.</p>



<p>Railwaymen are already in endurance because of National Pension System(NPS), therefore, AIRF would not accept any kind of Medical Insurance to Railway Employees on Indian Railways, which would further aggravate the situation.</p>



<p>AIRF sincerely hope that, Railway Board will take it seriously, and stall such type of exercises, in the larger interest of Industrial Harmony, otherwise we will be forced to launch a massive agitation against anti-labour policies of the Railway Board.</p>



<p>This may kindly be treated as “<strong>Most Urgent</strong>”.</p>

<p>Ref.: Railway Board’s letter No.E(NG)I-2007/CFP/20 dated 13.07.2020</p>



<p>While drawing your kind attention on the subject cited above, it is to be mention that, repeatedly matter is being dealt within wrong direction by Rail Coach Factory, Kapurthala, Administration as also by the Railway Board under the policy of intake of the erstwhile Group D <a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener">Railway</a> Staff in Workshop/Production Unit against 10% and 40% quota of Direct Recruitment, from outside the departments, meant for Store Khalasis, Safaiwalas and Gangmen (Track Maintainers) respectively with the defined criteria of seniority, which is irrelevant in this case.</p>



<p>Subjected issue is entirely different. Every Workshop and Production Unit, wherever any Incentive Scheme, i.e. RITES or CLW Pattern, is prevailing, it has some Non-Incentive Area (Shops) and Incentive Covered Shop activities. In many a places fresh recruits are initially posted in Non-Incentive Area(Shops), and wherever any Group `C’ (GP Rs.1900) vacancy occurs, these Non-Incentive Area(Shops) erstwhile Group `D’ staff, based on seniority, are posted in Incentive Shops/ Groups. Unfortunately, RCF/KXH Administration, instead of treating erstwhile Group `D’ staff, working in Non-Incentive Area in RCF/ KXH premises itself, are treated under the policy meant for Outside (from other departments) Intake Policy, which is basically wrong and sheer injustice with them.</p>



<p>Nowhere else, in any of the Workshop or Production Unit, such problem has been heard, since posting in Incentive or Non-Incentive Area within the premises is based on local policies in consultation with the Organised Labour.</p>



<p>AIRF, therefore, urges upon that, RCF/KXH Administration be clarified suitably, so that, erstwhile Group D Staff, working in Non-Incentive Area, could be posted in Incentive Shop/ Group in a hassle-free manner without any age bar since they are the employees of the same Production Unit and should not be treated as brought from outside unit/ other departments.</p>

<p>Please refer Board’s letter of even number dated 08.03.2018 (RBE No. 36/2018) whereby the revised rates of NDA for <strong><a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">7th CPC</a></strong> period effective from 01.07.2017 were conveyed to zonal <strong><a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener">Railways</a></strong>. Subsequent to issue of DoP&amp;T’s OM dated 13.07.2020 on Night Duty Allowance, further instructions issued vide Board’s letter dated 29.09.2020 (RBE No. 83/2020) prescribing Rs.43600 as ceiling of Basic Pay for entitlement of NDA. Federations have represented against the decision of ceiling-limit of pay and demanded for its review. While considering Federations’ demand Board have decided to refer the matter to DoP&amp;T for clarification and, in the interim, recovery of NDA from Railway employees who have become ineligible for the same after issue of Board’s letter dated 29.09.2020 (RBE No. 83/2020) be deferred until further orders.</p>

<h3 class="wp-block-heading">Sub: Proposed call for &#8220;Bonus Day&#8221; by AIRF and rallies &amp; demonstrations by NFIR on 20th October, 2020 by its affiliated Unions throughout Indian Railways on the issue of Productivity Linked Bonus to Railwaymen.</h3>



<p>It has come to notice that AIRF will organise &#8220;<strong>Bonus Day</strong>&#8221; across the length and breadth of Indian Railways by all its affiliated Unions on 20th October, 2020. NFIR has also given call for launching rallies and demonstrations on 20th October, 2020 throughout the Indian Railways involving all sections of Railway employees on the issue relating to payment of Productivity Linked Bonus to Rail workforce. The Federation has called upon its affiliated Unions to organise demonstrations and rallies at all levels expressing strong protest against delay in payment of PLB.</p>

<p>3. In view of aforesaid, there should not be any room for complacency on the part of the Railway administrations and all necessary stringent steps must be taken to ensure discipline and smooth functioning of rail movement. It must be ensured that Railway Servants need to seek necessary permissions from the Competent Authority on their respective Railways/ Production Units to leave their headquarters.</p>



<p>4. Their particular attention should be drawn to relevant penal provisions i.e. Section 173, 174 and 175 of the Railways Act, 1989 which are attracted in cases of abandoning train without authority, obstructing running of train and endangering the safety of persons by disobeying rules etc.</p>

<p>5. In case any Railway Servant participates in the aforementioned rallies and demonstrations, a report indicating the number of Railway Servants who take part in the proposed rallies and demonstrations may be conveyed to Board’s office on the evening of 20th October, 2020.</p>

<p><strong>Sub: Regularization of absence during COVID-19 epidemic lockdown period</strong></p>



<p><strong>Ref.: Railway Board’s letters No.(EG) 2020/LE 2/1 dated 06.08.2020 and 03.09.2020</strong></p>



<p>We are thankful to Railway Board for issuing instructions in the matter of treatment of absence during <strong><a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a></strong> epidemic lockdown.</p>



<p>Many of the employees have had to remain away from their work, subsequent to the lockdown, whose absence is pending regularization. Many of the employees were forced to remain under quarantine due to various situations, which can be classified broadly as follows:-</p>



<p><strong>(i) An employee was asked to remain in quarantine on return from outstation duty.<br />(ii) An employee remained in quarantine due to Central/ State Government instructions.<br />(iii) An employee was advised by <a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener">Railway</a> Medical Authority to remain in quarantine.<br />(iv) An employee who chose to remain in quarantine as a precaution.<br />(v) An employee who worked from home due to co-morbidity or underlying medical conditions as per Central/ State Government instructions.<br />(vi) An employee stayed at home as a precautionary measure and later found to be COVID-19 positive.</strong></p>

<p>It is, therefore, requested that, necessary instructions for treating absence of an employee during aforementioned situations, as “<strong>Special Casual Leave</strong>”, may kindly be issued at the earliest. Orders issued for maximum 30 days “Special Casual Leave” should also be cancelled as these being granted in special circumstances of COVID-19 epidemic where lockdown had been for more than four months and all sorts of transport had not been under operation.</p>
