<h3 class="wp-block-heading">Sub: Revision of Regulation relating to rate of Family Pension (Normal rate &amp; Enhanced rate) of Pension Regulation for the Army, Part-I (2008) in the line of amendment done in Sub Rule (3) of Rule 54 of CCS Pension Rule, 1972 by DoP&amp;PW-reg.</h3>



<p>Sir,</p>



<p>The undersigned is directed to refer to the provision of Note 3 (i) &amp; (ii) below Army Instruction 51/80 and Regulation 64 (b) in Pension Regulation for Army, Part-I (2008) under which the minimum of 7 years of continuous qualifying service is required for grant of enhanced rate of Family Pension for the Armed Forces personnel.</p>



<p>2. Consequent upon issue of Gazette Notification No. 550 dated 19.09.2019 of the Ministry of Personnel, Public Grievances &amp; Pensions, Department of Pension and Pensioners’ Welfare (DoP&amp;PW), the condition of minimum requirement of 7 years of continuous service for grant of enhanced rate of Ordinary Family Pension in the sub rule (3)(a) &amp; (b) of Rule 54 of CCS Pension Rule, 1972 has been deleted w.e.f 1st October, 2019 and now Government servants who died in service/ invalided out even with less than 7 years of qualifying service shall be eligible for enhanced rate of Family Pension. This notification also has a provision where a Government servant who died within ten years before the 1* day of October 2019 without completing continuous service of seven years, his family shall be eligible for family pension at enhanced rates in accordance with sub rule (3) with effect from the 1° day of October 2019, subject to fulfillment of other conditions for grant of family pension.</p>



<p>3, . Now, the President is pleased to decide that the same provision shall be extended to Armed Forces Personnel also. Accordingly, the clause &#8220;after having rendered not less than 7 years continuous qualifying service&#8221; of Regulation 64{b) of Pension Regulations for the Army, Part-I (2008) stands deleted w.e.f. 01.10.2019.</p>

<p>4. It has also been decided that where an Armed Forces Personnel died within ten years before the 1° October, 2019 without completing continuous service of seven years, his family shall be eligible for ordinary family pension at enhanced rate as per Regulations 64(b) of Pension Regulations for the Army Part-I (2008) with effect from the 1st October 2019 subject to fulfillment of other conditions for grant of Ordinary Family Pension.</p>



<p>5. Further, the provision of Army Instruction No. 51/1980 would stand modified upto this extent w.e.f. 01.10.2019. The regulation and their instructions for grant of Ordinary Family Pension in Navy and Air Force shall also be amended accordingly.</p>



<p>6. This issues with the concurrence of the Finance Division of this Ministry vide their ID No. 10(02)/2020/FIN/ PEN dated 23.09.2020.</p>

<p>I am directed to convey the sanction of the President to regularise the absence period on account of ‘<strong>Lockdown</strong>‘ due to orders of GOI/ State Govt. /Local authorities/service Hqrs. on account of anti <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a></strong> measures as Special Casual Leave in r/o Army /Navy/ Air Force personnel.</p>



<p>2. Personnel are permitted to utilise fastest available means of travel (as per their entitled class/ mode so as to return to their units at the earliest, post-lifting of lockdown.</p>



<p>3. The grant of <em>Special Casual Leave</em> period shall not have any impact on current leave entitlement and permissible service of the personnel.</p>

<p>Subject: <strong>Clarification regarding grant of Dual Family Pension i.e. Ordinary Family Pension (OFP) from Military Side as well as Special Family Pension (SFP)/ Liberalised Family Pension (LFP) for re-employed Military service &#8211; reg.</strong></p>



<p>Sir,</p>



<p>The undersigned is directed to state that references have been received seeking clarification as to whether Special Family Pension (SFP)/Liberalised Family Pension (LFP) is admissible on death of a military pensioner re-employed in military service, and his death is attributable to military service.</p>



<p>2. Prior to 17.01.2013, the NOKs of Armed Force Pensioner who got re-employed in Civil Department/PSUs/Autonomous bodies/Local Fund of Central/State Governments after getting retired from military service were authorized to draw Ordinary Family Pension (OFP) either from military side or from civil side whichever was beneficial to them in terms of Gol, MoD letter No. 10(6)/92/D(Pens/Sers) dated 28.09.1992 and regulation 78 of Pension Regulation Part-I, 2008. Subsequently, vide GoI, MoD letter No. 01(05)/2010-D(Pen/Policy) dated 17.01.2013, two family pensions were allowed w.e.f. 24.09.2012 in the event of death of a re-employed military pensioner.</p>



<p>3. It was further clarified that dual family pension is admissible irrespective of the fact whether the re-employment was in civil or military department vide GoI, MoD letter No. 10(17)/2012-D(Pen/Pol) dated 21.03.2013. Hence, the family pensioners of military personnel re-employed in military e.g. Territorial Army/Defence Security Corps (TA/DSC) are also covered in the ambit of the Gol, MoD letter No. 01(05)/2010-D(Pen/Policy) dated 17.01.2013 for grant of dual family pension w.e.f. 24.09.2012. However, the admissibility of dual family pension was restricted to ordinary family pension (OFP).</p>



<p>4. Department of Pension and Pensioners’ Welfare vide their OM No. 1/3/2016-P&amp;PW(F) dated 24.01.2019 has clarified that the provisions of two family pensions, one in respect of military/civil service and the other for civil service after re-employment, as available in terms of CCS (Pension) Rules, is also applicable under CCS (EOP) Rules.</p>



<p>5. The matter regarding extending the admissibility of Special Family Pension (SFP)/Liberalised Family Pension (LFP) in cases of death attributable to military service in terms of Gol, MoD letter No. 1(2)/97/D(Pen-C) dated 31.01.2001 in the case a of dual family pension has been examined. It has been decided that Department of Pension and Pensioners’ Welfare OM No. 1/3/2016-P&amp;PW(F) dated 24.01.2019 would apply mutatis-mutandis to military/civil pensioners re-employed in military service and it is clarified that the provision of two family pensions, one in respect of military/ civil service and Special Family Pension (SFP)/ Liberalised Family Pension (LFP) for re-employed military service is also applicable. Special Family Pension (SFP)/ Liberalised Family Pension (LFP) if any, would be admissible in terms of GoI,</p>



<p>6. Where, however, on death of the re-employed ex-serviceman if the family is eligible for Special Family Pension (SFP)/ Liberalised Family Pension (LFP) for first service, family pension for second spell of service would be Ordinary Family Pension.</p>



<p>7. Special Family Pension (SFP)/ Liberalised Family Pension (LFP) shall be granted only in respect of one service and in no case, Special Family Pension (SFP)/ Liberalised Family Pension (LFP) will be granted for both the services.</p>



<p>8. The financial benefits in the past cases will accrue with effect from 24.09.2012.</p>



<p>9. Pension Regulation of the three Services shall be amended in due course.</p>



<p>10. This issues with the concurrence of the Finance Division of this Ministry vide their ID No. 10(02)/2017/FIN/PEN dated 21.06.2019.</p>

<p>In continuation of MoD letter No.17(11)/2018ANE/D(Res-I) dated 7.3.2019, I am directed to convey the sanction of the Government prescribing one time contribution for ECHS membership and entitlement of ward in empanelled hospitals / medical facilities in respect of World War-II Veterans, Short Service Commissioned Officers (SSCOs), Emergency Commissioned Officers (ECOs) and Pre-mature Retirees (PMR) and their spouses as under :-</p>

<p>Sir,<br />
Consequent upon the judgement of Hon&#8217;ble Supreme Court dated 08 Dec 2017 in the matter of Civil Appeal Dy. No.3744 of 2016 (UOI vs Shri Balbir Singh Turn &amp; Anr), I am directed to refer to this Ministry&#8217;s letter No.Air HQ/99141/1/1/ AFPCCfD(Air-III) /02/ 2011 dated 03 June 2011 and to state that the President is pleased to make the following amendment in Para 8 of the aforesaid letter:-</p>



<p><strong>For:</strong> &#8220;The scheme would be operational w.e.f. 01 Sep 2008. In other words, financial upgradations as per the provisions of the earlier ACP Scheme (of Aug 2003) would be granted till 31.08.2008&#8221;. </p>



<p><strong>Read:</strong> &#8221; The scheme would be operational w.e.f. 01 Jan 2006. In other words, financial upgradations as per the provisions of the earlier ACP Scheme (of Aug 2003) would be granted till 31.12.2005&#8243;.</p>



<p>The other terms &amp; conditions (including eligibility) as mentioned in the MoD letter No.Air HQ/99141/1/1 /AFPCC /D(Air-III) /02 /2011 dated 03 June 2011 would continue to remain the same.</p>



<p>This issues with the concurrence of the Ministry of Defence (Finance) vide their Dy. NO.662 RF No.9(15)/2018/AF/P&amp;W dated 28.11.2018.</p>

<p>2. The allowance shall be admissible to the recipient of the award and on his death to his widow lawfully married by a valid ceremony. The widow will continue to receive the allowance until her death. Ordinarily, the widow who was first married shall receive the allowance but with the special sanction of the Government the allowance may be divided equally between the lawful widows of the recipient.</p>
<p>3. When the award has been made posthumously to a bachelor, the monetary allowance shall be paid to his father or mother, and in case the posthumous awardee was a widower, the allowance shall be paid to his son below 18 years or unmarried daughter as the case may be.</p>
<p>4. Each bar to the decoration will carry the same amount of monetary allowance as admissible to the original award.</p>
<p>5. The monthly monetary allowance will be paid in respect of all gallantry awards received by an individual.</p>
<p>6. Payments, if any, already made for the period beyond the date of issue of this letter will be adjusted against the payment due under this letter.</p>
<p>7. The expenditure on this account will be debitable to the relevant Heads of the Defence Services Estimates.</p>
<p>8. This issues with the concurrence of Ministry of Finance (Department of Expenditure) vide their U.O. No.7/67/E.III.A/98 dated 11th September, 2017.</p>

<p>2. The allowance shall be admissible to the recipient of the award and on his death to his widow lawfully married by a valid ceremony. The widow will continue to receive the allowance until her death. Ordinarily, the widow who was first married shall receive the allowance but with the special sanction of the Government the allowance may be divided equally between the lawful widows of the recipient.</p>
<p>3. When the award had been made posthumously to a bachelor, the monetary allowance shall be paid to his father or mother, and in case the posthumous awardee was a widower, the allowance shall be paid to his son below 18 years or unmarried daughter as the case may be.</p>
<p>4. Each bar to the decoration will carry the same amount of monetary allowance as admissible to the original award.</p>
<p>5. The monthly monetary allowance will be paid in respect of all gallantry awards received by an individual.</p>
<p>6. Payments, if any, already made for the period beyond the date of issue of this letter will be adjusted against the payment due under this letter.</p>
<p>7. The expenditure on this account will be debitable to the relevant Heads of the Defence Services Estimates.</p>
<p>8. This issues with the concurrence of Ministry of Finance (Department of Expenditure) vide their U.O. No. 7/67/E.III.A/98 dated 11th September, 2017.</p>

<p>Subject : <b>Revision of pension of Maj. Genl and equivalent rank Officers in Air Force &amp; Navy retired between 1.1.1996 to 31.10.1996-reg.</b></p>
<p>The undersigned is directed to refer to GOI, MoD letter No.4(110)/07/D(Pen/Legal) dated 15.07.2009 issued for revision of pension of Pre-1996 retired Major Generals and equivalent rank officers in Air Force and Navy. With the issue of this letter, the revised pension of Pre-1996 retired Major General and equivalent rank officers in Air Force and Navy happened to be higher than pension of some Major General and equivalent rank officers in Air Force and Navy retired between 1.1.1996 to 31.10.1996.</p>
<p>2. The above anomaly in pension had been under examination of the Government for some time. The President is pleased to decide that the pension of Major General and equivalent rank officers in Air Force and Navy who retired between 1.1.1996 to 31.10.1996 will be brought at par with the pension of similarly situated Major General and equivalent rank officers in Air Force and Navy who had retired prior to 1,1.1996 provided that the last pay drawn of a post 1996 retired Major General and equivalent rank officers in Air Force and Navy is the same as the notional pay taken into account for revision of a similarly situated Pre-1996 Major General and equivalent rank officers in Air Force and Navy.</p>
<p>3. Above upward revision of pension, however, will not affect the entitlement of Gratuity that has already been determined. Also, no benefit of commutation of pension will be admissible for the additional amount of the pension.</p>
<p>4. The provision of this letter shall be effective from the date following the date of retirement.</p>
<p>5. This issues with the concurrence of MoD(Fin/Pen) U.0 No. 10(02)/2014/Fin/ Pen dated 30.06.2016</p>

<p>Subject: <strong>Simplification of procedure for endorsement of Family Pension entitlement in the PPO of living Armed Force Pensioners-reg.</strong></p>
<p>I am directed to refer Gol, MoD letter No.6(4)/87/1369/B/D(Pens/Sers) dated 30.06.1988, which was issued for taking appropriate action for endorsement of Family Pension in the Pension Payment Orders of Armed Forces Personnel. For this purpose an application from “Appendix A” was enclosed along with ibid letter under which details of re-employment, family pension from other sources were required to be filled.</p>
<p>(2) After implementation of Cabinet Secretaries Commitee-2012 recommendations for grant of dual family pension to NOK of Armed Forces Pensioners, the matter was under consideration of this ministry for modification in “Appendix A”. It has now been decided to modify Appendix ‘A‘. The revised Appendix ‘A’ is attached with this letter.</p>
<p>(3) The other terms and conditions for endorsement of family pension in the PPO shall remain unchanged.</p>
<p>(4). These orders issue with the concurrence of MoD(Fin/Pen) vide their ID No.10(16)/2015/Fin/Pen dt. 30th June 2016.</p>

In continuation of Govt. of India, Ministry of Defence letters No.22(1)/01/US(WE)/D(Res) dated 30th December, 2002 and No.22D(44)/2007/US(WE)/D(Res) dated 18th October, 2010, the undersigned is directed to convey the approval of the competent authority to the following revised interim Scales of Contractual Manpower for ECHS Clinics, to tide over the immediate functional difficulties being faced by ECHS clinics in providing quality medical care to ECHS beneficiaries:-</p>

<p>2. After the revised scale the total posts will become 6800 with an increase of 1709 additional contractual posts of various categories. The above scales of contractual manpower will be reviewed after a detailed work study is carried out.</p>
