<p><strong><em>Non Payment of Bonus to Postal Employees 2022 before the Durga Pooja, disappointment and anguish prevailing amongst the staff</em></strong></p>

<p>The undersigned is directed to convey the sanction of the President of India to the payment of&nbsp;<strong>Productivity Linked Bonus for the Accounting year 2021-22 equivalent of emoluments of 60 (Sixty)Days to the employees of Department of Posts in MTS, /Group ‘C’ and non-gazetted Group ‘B’</strong>. Ex-gratia payment of bonus to Gramin Dak Sevaks who are regularly engaged after observing all engagement formalities, and Ad-hoc payment of bonus to Casual laborers who have been conferred Temporary Status are also to be paid equivalent to allowance/wages respectively for&nbsp;<strong>60 (Sixty) Days</strong>&nbsp;for the same period.</p>

<p>Respected Sir,</p>



<p>It has been customary all these years that productivity linked bonuses used to be paid before the Durga Pooja so that the employees of the department could celebrate the occasion and Diwali to follow up with the same sort of enthusiasm. But this year has been a big exception. We do not know the reason. One of the causes could be that the Postal Department could not submit the bonus proposal to the Finance Ministry. Whatever the reason, we must acquaint you with the ground reality where a great amount of resentment and anger is prevailing. The Puja Festival has passed with despair in the postal employees, especially the GDS and Diwali is knocking at the door. We must reiterate that the Bonus is not alms doled to the employees. It is a deferred wage and is paid at the time of some festival. There are well studied norms for measuring productivity which have no relation with profit or loss. The railways paid the bonus much in time and the condition of the postal employees as compared to the railway employees and dissatisfaction prevailing can be well imagined.</p>

<p>A kind reference is invited this unions letter of even no dated 01-08-2019 in which we had pointed out that those who did opt for <strong><a href="https://centralgovernmentnews.com/category/nps/" target="_blank" rel="noreferrer noopener">NPS</a></strong> but were not found eligible for the pension scheme are to be paid amount of gratuity as well severance amount at the prescribed rate. But such persons even after years of their retirement are still looking for payment of the Gratuity and severance amount. While in some cases the payment of Gratuity has been ordered/ paid, the severance amount has not been paid to any of the retired GDS. We had requested that instructions should be issued for payment of these amounts we need not point out that the SDBS scheme has been introduced in lieu of the severance amount. Therefore, those not found eligible for SDBS have a right to be paid severance amount in addition to the Gratuity. But nothing appears to have been done.</p>

<p>A kind reference is invited to our letters of even no dated 04-08-2018 in which we had requested this letter to you because the Changes in the Schedule could not have been made without your approval. We have firm belief that our views will be objectively Considered and the changes would be rescinded schedule as existing previously would be restored:</p>



<ol class="wp-block-list"><li>We feel that before bringing about such fundamental changes in the schedule this union which the only union recognized should have been consulted and we would have given constrictive suggestions. Unfortunately this did not happen and the administration brought out the changes unilaterally.</li><li> The Hon‘ble Supreme Court of India observed sometime back that discharge/ dismissal from service is a financial capital punishment. We feel that it being so such punishment is to be awarded by a person who has sufficient experience in person management and jurisprudence. you may agree that it is not for no reasons that cases involving theft, dacoity murder and attempt to murder etc are only to be considered by the district and session Jude who is pretty senior and has vast experience in jurisprudence.</li><li>The schedule as existed earlier was more balanced, judicious for the following reason :</li></ol>

<ul class="wp-block-list"><li>(ii) In case of BPMs only superintends/ divisional heads were empowered to award all penalties including minor punishments Now the power to impose the minor penniless has been vested in the inspectors/ Asst superintends, the inspector are new to the job and have little experience in matters of jurisprudence. The institutional or practical training is hardly enough to give sufficient knowledge and experience. Similarly the Assistant superintendents also do not have much experience in dispensation of justice.</li></ul>



<p>The <a href="https://centralgovernmentnews.com/tag/BPMS/" target="_blank" rel="noreferrer noopener">BPMs</a>, on the other hand have multiple functions to discharge. It is quite natural that some minor genuine and inadvertent mistakes would occur. It officers with little experience are empowered to inflict even minor punishment this that will result in award of several unjustified and improper punishment.</p>



<p>It is all justified thus only the Divisional heads are empowered to consider case involving all punishments including menorahs.</p>



<p>(ii) In case of ABPMs (earlier <strong><a href="https://centralgovernmentnews.com/tag/GDS/" target="_blank" rel="noreferrer noopener">GDS</a></strong> delivery agents, mail carriers etc including such staff in RMS) the inspectors/ Asst superintendents were empowered only to award minor punishments while Divisional head were empower to award major punishments. Now powers to award all punishments including major ones have been vested in inspector/ Asst inspector’s superintendents.</p>



<p>We have disused in sub-para 3(i) above the qualification of the Asst superintendents To empower such authorities even to award “financial capital punishment” does not meet the balance of justice.</p>



<p>We feel that there is every justification for restoration of the earlier provisions.</p>



<p>4. We are aware that there are scopes of filing the appeal or revision petitions. But this a long process and it becomes too late before justice is done and the mental agony and loss suffered during the period is immeasurable.</p>



<p>5. It would be better to find a prevention than to find a cure which, however, proves to be too costly and tortuous.</p>



<p>We, therefore, request you kindly to look into the matter very purposefully, objectively and dispassionately and restore the powers to award all punishments to divisions heads in case of BPMs, in case of ABPMs the powers to award at least major punishments should remain with the divisional heads ie superintends Sr. superintendents. The appellate authorities may be accordingly redesignated.</p>

<p>Sub: <b>Problems faced by GDS BPMS while operating the RICT machines-Reg</b></p>
<p>The department of posts introduced RICT and DARPAN in Branch post offices. The GDS BPMs have to perform all kinds of transactions on RICT machine including B.O. Daily Account. Implementation of RICT must be after complete success of the scheme. Lots of problems are being faced by the staff, mainly because of network issues. At least in future all precautions should be taken before implementation of the said schemes. The GDS BPMs are facing following Problems.</p>
<blockquote class="tr_bq"><p>(i) Proper signals are not available during working hours. Due to network problem they are waiting for hours to open the device.</p>
<p>(ii) The device went back to login for every two minutes.</p></blockquote>
<p>After completion of one transaction, the GDS BPM has to login to continue the work. Due to this type of arrangement, GDS has to spend more time to complete the B.O. task.</p>
<p>You are requested to take appropriate steps to reduce the difficulties mentioned above.</p>
<p>This union also suggests that it is better to provide computers and printers to Branch offices in place of hand devices to work efficiently without interruption.</p>

<p>A kind reference is invited to the above mentioned subject where the substitute GDS are still drawing their TRCA in old scales. As per the recommendation of Sri.Nataraja Murthy committee orders were issued for payment of arrears to outsider/substitute GDS on revised TRCA, but up to this date nothing is heard so far. This issue was debated in our last All India Working Committee meeting held at Champawat, Uttrakhand. Hence it is requested to cause orders for payment of TRCA to the outsider/substitute GDS in the revised TRCA, including arrears w.e.f 1.01.2016.</p>
<p>An early orders in this regard would be highly appreciated at this end.</p>

<p>Dear Comrades,</p>
<p>Hearty Greetings,</p>
<p>We have scored some brownie points in implementation of Kamalesh Chandra GDS Committee though not to our satisfaction. For this achievement we had to wage a relentless struggle. You will agree that struggles requires and resources and we managed the affairs with our reserve fund.</p>
<p>We are aware that the department has played tricks in manipulating and distorting the committee’s report to the detriment of the GDS employees. And we shall have to be ready for a given fight. We are on the course of another struggle. We have submitted our list of issues which require solution. The department has adopted such tactics which have deprived us of our legitimate amount of arrears as recommended by the Committee. The date of effect of the new pay matrix from 01/07/2018 has hit us hard by inflicting cumulative losses which are hard to repairs several recommendations have been arbitrarily slashed while several vital recommendations appear to have been thrown into cold storage.</p>
<p>Shall we tolerate such injustice hands down or fight it with all our force? Certainly we shall strike hard to achieve every single pie that due to us. And struggles require resources. You will agree that your CHQ had to wage relentless struggle and has been able achieve some success. But in such struggles we used all our resources and the position today stands is that the CHQ is running short of funds. We may be required to take recourse to legal fight in courts on several issues and all these require fund and money.</p>
<p>May your CHQ, therefore appeals to our Divisional and Branch Secretaries to rise to the occasion. We understand that the arrears have been paid by now. Our appeal is that the Divisional/Branch Secretaries should raise CHQ struggle fund at the rate of Ks 100 per member and send to the CHQ by crossed D.D. to the CHQ. We sincerely hope that our appeal will be honoured.<br />
Dear Comrades, for some times, the CHQ is not receiving due quota from the Divisional/ Branch Unions which has aggravated the situation still more. We request our Divisional/Branch Secretaries to clear all arrears of quota and send the amount by crossed Bank draft.</p>
<p>We note with sorrow that the Contribution to our union journal “Rural Post Employees” has drastically came down, you may please note that you cannot get the information through what’s App or internet that our journal will provide.</p>
<p>We request that all Committee members of all Divisional/Branch Unions should necessarily contribute to the journal as regular members by remitting annual subscription of Rs 60/-,</p>
<p>Comrades, you are aware that Kerala has been reeling under severe floods which has created severe devastation. Humanity is trouble. The CHQ has donated an amount of Rs 10,000/-. We request our Circle/Divisional/Branch Secretaries to donate liberally to the CM/s disaster management fund.</p>
<p>Comrades, with your cooperation we assure you that we shall march forward to achieve newer results for our members.</p>

<p><strong>Today meeting held in Dak Bhawan at 11.00am</strong></p>
<p>Meeting conducted under the Chairmanship of DG (Posts), Member (P), DDG (Estt.), DDG (SR &amp; Legal), ADG (Estt), ADG (GDS) and other officers of the department attended.</p>
<p>Union Side: All three General Secretaries and other representatives, General Secretary, NAPE attended.<br />
Detailed discussion held between Administration and Union Representatives on the basis of JCA memorandum, major issues viz., date of implementation of new scales, payment of arrears, gratuity, financial upgradation, leave etc.,</p>
<p>Department categorically replied that in case of financial implication issues like date of implementation of new scales, arrears formula as already cleared by Cabinet and it can not be reopened. Regarding all other issues viz., Leave, Children Education Allowance, GIS, Transfer, ESI facility, SDBS, Financial upgradation etc will be considered positively and orders will be issued as early as possible.</p>
<p>But union representatives expressed their resentment and deep concern over the date of implementation of new scales, arrears payment formula and strongly demanded for reconsideration.</p>
<p>Department proposed the unions to submit a detailed note on all the issues raised in the meeting for further consideration at appropriate level.</p>
<p>The General Secretaries of GDS Unions discussed over the today&#8217;s meeting and decided to submit a detailed note soon. Further decided to meet again to decide further course of programme of action seriously.</p>

We are obliged to the union cabinet for approving the implementation of report. But we are sorry to submit that there is avoidable delay on the Part of the officials at Postal Directorate level In issuing orders. Even after two weeks of the cabinet decision not a single order has been processed and even the movement of the file illudes us. Probably, this is aimed at creating trust deficit.</p>

<p><strong>Demands the Government immediately implement the pro employee recommendations of Kamalesh Chandra Committee Report</strong></p>
<p>Centre of Indian Trade Unions (CITU) congratulates the nearly three lakh Gramin Dak Sevaks (GDS) of the Postal Department for the magnificent united all India Strike. All the four GDS Unions (AIPEU-GDS, AIGDSU, NUGDS &amp; BPEDU) are on an indefinite strike from 22 May 2018. All the postal employees’ unions have supported the strike. As per reports the strike is total and 1,29,500 Branch Post Offices remained closed.</p>
<p>More than 60% of the employees of the Postal Department are GDS and more than 80% of the Post Offices are GDS Branch Post Offices. Major revenue of the department comes from GDS. They are not treated as Postal employees and were paid a pittance. The Gramin Dak Sevaks have a great legacy of struggles and whatever facilities they are enjoying at present is the result of their bitter struggles along with the postal employees.</p>
<p>This strike was forced by the NDA government which not only denied to address the long pending demands of the Gramin Dak Sevaks for regularisation as government employees, but refused to implement the recommendations of Kamalesh Chandra Committee Report on the service conditions of the GDS. The Committee which was appointed by the government to look into the service conditions of the Gramin Dak Sevaks had submitted its report as early in November 2016. The Union Minister had promised to implement the pro-employee recommendations of the report. Even after eighteen months the orders are still awaited. The GDS and their unions were forced to go on an indefinite strike after the government had failed to meet even the latest deadline of April 2018, it had promised.</p>
<p>CITU expresses solidarity with the striking employees and demands that the NDA government must immediately settle the issue by agreeing to the just demands of these grass root level workers who deliver valuable service to the common people.</p>

<p>In spite of our countrywide requests, memorials, protest meetings/Demonstrations and Strikes there is unreasonable delay in consideration and implementation of the GDS Committee recommendations. The level of tolerance has already crossed it limits. This time we have accepted OFFICERS Committee with open mind but still discriminative attitude is seen towards this low paid and neglected/exploited lot.</p>
<p>The Gramin Dak Sevaks role in future INDIA POST especially in Banking is more significant and we are also carefully watching the developments. There cannot be any compromise about their status and service conditions in the changed scenario and the GDS should get what they deserve. The Government, being a model employer, should consider our reasonable demands in the interest of service to the rural population of this country. The old policies of the British regime such as cheap labour and exploitation are outdated in the present situation and it is high time that decisions are at the appropriate levels in democratic norms. India is a welfare state and we are eagerly waiting for BETTER TREATMENT TO G.D.S AT LEAST THIS TIME.</p>
<p>We do sincerely hope that you will take personal interest in this matter and play vital role for speedy implementation OF ALL RECOMMENDATIONS OF THE COMMITTEE TO TAKE EFFECT FROM 01.01.2016 at par with 7th CPC extended to Departmental counterparts.</p>
