<h2 class="wp-block-heading">Outcome of the issues discussed in the Standing Committee meeting of the National Council &#8211; JCM held on 20/09/2023 under the Chairpersonship of Secretary (P) DOPT</h2>



<p>As already informed to you the meeting of the&nbsp;Standing Committee of National Council &#8211; JCM was held on 20/09/2023&nbsp;under the Chairpersonship of Secretary (P) DOPT. AIDEF was represented by Comrade C. Srikumar in the meeting. At the outset after the introductory remarks made by the Chairperson and before taking up the agenda points Staff Side raised the following important issues:-</p>



<p>1) More than 20 lakh Central Government Employees are in NPS. A huge rally on the 10th of August 2023 was held at Ramleela Maidan New Delhi in which more than 3 lakhs of Central &amp; State Government Employees participated demanding for Scrapping of the No Guarantee NPS and to restore the Defined and Guaranteed Old Pension Scheme. The Staff Side once again reiterates its demand that the NPS should be scrapped and the Old Pension Scheme should be restored at the earliest.</p>



<p>2) The office of the Staff Side is receiving innumerable representations on issues which can be sorted out at the Departmental Level itself. Since the Departmental Councils are not functioning and meetings are not taking place, all the issues are referred to our office and we are forced to bring all those issues to your notice. It is therefore essential that the Departmental Council &#8211; JCMs should meet regularly in accordance with the JCM scheme and regular meetings at the Departmental Level should be held with the Staff Side so that the National Council &#8211; JCM can concentrate on the common issues of Central Government employees.</p>



<p>This is a serious matter and hence DOPT may take up the matter with all the Secretaries of the various Ministries and Departments to ensure that the JCM functions effectively in accordance with the spirit of the JCM Scheme.</p>



<p>3) The Meeting of the National Council &#8211; JCM is also overdue. The last meeting of the National Council &#8211; JCM was held through video conference during 21/06/2021. We request the Cabinet Secretary through you that he may convene the meeting of the National Council JCM at the earliest.</p>



<p>4) Despite High Court orders upheld by Supreme Court for grant of 3 MACP nd in GP Rs 4600 to the Master craftsman of MOD who were given 2 ACP in the Grade pay of Rs.4200, the DOPT have advised the MOD to withdraw the same. All the concerned employees have retired long back and as per DOPT instructions there cannot be any recovery and as per CCS Pension Rules, Pension once fixed cannot be revised downwards other than on penalties moreover the DOPT Instructions to Defence Ministry amounts to contempt of Court.</p>



<p>Therefore DOPT may Direct MOD not to take any precipitative action in this regard. A copy of letter written by the AIDEF is this regard is being handed over to Secretary DOPT. The same may please be considered favorably.</p>



<p>5) Another matter of serious concerned is the non-implementation of the DOPT O M dated 02/03/2016 on the subject of recoveries of wrongful / excess payments by the employers impermissible in Law. According to this instruction any excess payment made to the employees due to the mistake of the administration and not because of any false claim by the employees the concerned department should process the case for waiver of recovery and get the approval of Department of expenditure. However in many field units / offices instead of following these guidelines recoveries of huge amount from the employees and retiring employees are being effected.</p>



<p>Therefore DOPT may issue strict instructions to all the departments to follow the DOPT O M date 02/03/2016 and not to recover any amount from the employees and retiring employees in accordance with the DOPT OM.</p>



<p>6) Department of Pension &amp; Pensioners Welfare have issue orders on 03/03/2023 for conversion of NPS employees to Old Pension Scheme if they were recruited on or after 01/01/2004 on the basis of the notification / Advertisement issued before 22/12/2003. Due to a confusion with regard to Notification and Advertisement the benefit of Old Pension Scheme is not being extended to the concerned employees. This needs to be clarified by the Department of Pension or DOPT.</p>



<p>It is proposed that the Notification letter issued by the concerned Ministry / Department / Field Units for recruitment of certain number of vacancies in different categories should be taken as the date of Notification since in many cases the advertisement by the DAVP in the employment News etc are delayed by months together. Moreover there are many issues which needs to be clarified since the field units are not implementing the Department of Pension order dated 03/03/2023. A separate meeting with the Staff Side may please be convened in this regard.</p>



<p>7) The Staff Side is repeatedly representing for releasing the 18 months frozen DA / DR arrears to the Central Government employees &amp; Pensioners. However till date a favorable decision is not taken by the Government. It is therefore requested that Government may reconsider the decision &amp; released DA/ DR Arrears due for 18 months as a Diwali gift.</p>



<p>8) Posts lying vacant in all the Central Government Departments should be filled up to stop outsourcing and contract etc.</p>



<p>Thereafter the following Agenda Points were taken up for discussion.&nbsp;Decision take on each of the agenda points is given below:-</p>

<div class="schema-faq wp-block-yoast-faq-block"><div class="schema-faq-section" id="faq-question-1695350376922"><strong class="schema-faq-question">1. Extension of CGHS facilities to the Civilian Employees of left out Industrial Establishment under Western Command of Navy Mumbai.<br /></strong> <p class="schema-faq-answer"><strong>Decision</strong>: After discussion representative / senior officer from NHQ stated that the NHQ fully agree with the demand of the Staff Side and stated they have already recommended the case to Ministry of Health&amp; Family Welfare. Additional Secretary Assured that Health Ministry will consider the demand of the Staff Side and the recommendations of NHQ will issue necessary instructions in consultation with Department of Expenditure if required.</p> </div> <div class="schema-faq-section" id="faq-question-1695350426272"><strong class="schema-faq-question">2. Empanelment of Private Day Care Therapy Centers for Ayurveda, Yoga &amp; Naturopathy under CGHS in all the CGHS governed cities / towns<br /></strong> <p class="schema-faq-answer"><strong>Decision</strong>: Ministry of Health have already taken a decision to empanel private Health Care Organization of Ayurveda, Yoga and Naturopathy etc under CGHS if they apply for the same. Moreover Private day care therapy centers under Ayush is established at Delhi on a trial basis. After 6 months Ministry of Health will review the position and there after decision will be taken for extending the benefits for other cities / towns</p> </div> <div class="schema-faq-section" id="faq-question-1695350493444"><strong class="schema-faq-question">3. To retain the status of more than 70,000 Defence Civilian Employees who are on deemed deputation with the newly created 7 Ordnance Factory Corporations as Central Government Employees / Defence Civilian Employees till their Superannuation.<br /></strong> <p class="schema-faq-answer">Decision: The Staff Side informed about the harassment being faced by the employees of Ordnance Factories Post Corporatization. In violation of the Cabinet decision and the commitment given by the Government before the Hon’ble High Court, the 7 Corporations are tinkering with the service conditions of the employees like changing the working hours, implementing incentive scheme by replacing piece work system, not implementing he settlement reached between AIDEF and DDP in the presence of CLC on the formation of IR Machineries in the Corporations, Non Grant of Compassionate Appointments, and the DDPs apathy towards the employees, not holding of the meetings with the Federation etc.<br />Moreover now the Government have decided to merge Corporations and reduce to 4 Corporations. This has further created fear and apprehensions in the minds of the employees. We have decided to issue contempt of Court Notice to the Government and the Corporations for violation of the assurance given in the High Court. We demanded that the Government instead of extending the deemed deputation should issue a notification for retaining the status of employees as Central Government Employees / Defence Civilian employees till their retirement.<br />Responding to the views expressed by the Staff Side JS (LS ) from DDP informed that the corporations are making the HR Policies and option will be asked from the employees whether they would like to join the Corporations or they would like to remain as Government Employees.<br />Secretary DOPT directed JS (LS) DDP that the concerns expressed by the staff Side are serious and the same should be communicated to the Defence Secretary and meetings should be held with the Staff Side to settle the issues represented by them.</p> </div> <div class="schema-faq-section" id="faq-question-1695351077452"><strong class="schema-faq-question">4. Provision to book two rooms through e-Sampada Portal in CPWD Guest Houses / Holiday Homes</strong> <p class="schema-faq-answer">Decision: The demand will be examined by Ministry of Housing and Urban Affairs.</p> </div> <div class="schema-faq-section" id="faq-question-1695351413540"><strong class="schema-faq-question">5. Restoration of historic Pay-Parity between Income Tax Inspector and analogous posts in Department of Revenue and Inspector of CBI/ ACIO Gr.-I of IB</strong> <p class="schema-faq-answer">Decision: After discussion Secretary (P) desired that Department of Revenue should hold separate meeting with the Staff Side and explore the possibility of resolving the issue.</p> </div> <div class="schema-faq-section" id="faq-question-1695351456530"><strong class="schema-faq-question">6. Revision of Deposit linked Insurance Scheme under the GPF for Central Government Employees</strong> <p class="schema-faq-answer">Decision: We objected and protested against the decision taken by the Department of Expenditure to reject the demand. After discussion it was decided that the Department of Expenditure would reconsider its decision and the proposal of DOP&amp;PW to increase the Deposit Linked Insurance from GPF to Rs. 5 Lakh</p> </div> <div class="schema-faq-section" id="faq-question-1695353400192"><strong class="schema-faq-question">7. Revision of calculation Ceiling Limit of PLB and Ad hoc Bonus for the Central Government Employees</strong> <p class="schema-faq-answer">Decision: Bonus ceiling will be revised only if the Bonus Act is amended by the Labour Ministry. After discussion it was decided that a reference will be made to the Labour Ministry in this regard</p> </div> <div class="schema-faq-section" id="faq-question-1695353447699"><strong class="schema-faq-question">8. Restoration of festival advance to the Central Government Employees</strong> <p class="schema-faq-answer">Decision: After discussion Special Secretary Department of Expenditure stated the Government may consider for granting Rs 20,000 as festival advance to be recovered in 10 installments. The staff Side demanded the amount may be increased to Rs. 50,000. The Department of Expenditure will take a final decision in this regard.</p> </div> <div class="schema-faq-section" id="faq-question-1695353535607"><strong class="schema-faq-question">9. Stepping up of pay of seniors promoted prior to 31.12.2015 getting lesser basic pay than the juniors promoted after 01.01.2016</strong> <p class="schema-faq-answer">Decision: The Staff Side stated that since the Department of Expenditure have approved stepping up of pay on the above circumstances to the Armed Forces personnel there is no justification on the part of the Government to deny the same benefits to the Civilian Central Government employees. After discussion Special Secretary Department of Expenditure agreed to consider the demand.</p> </div> <div class="schema-faq-section" id="faq-question-1695353602404"><strong class="schema-faq-question">10. Extending the benefit of option to Central Government Employees to switch over to the 7th CPC Pay Scale from a date! beneficial to the employees and also for extending revised option for the employees who were given entry pay benefit on promotion in the 6th CPC Pay Scale to switch over to 6th CPC Pay Scale w.e.f.01.01.2006</strong> <p class="schema-faq-answer">Decision: After discussion Special Secretary Department of Expenditure th th agreed to consider the option period for switching over to 7 CPC up to 25 July 2017 from the date of promotion / MACP etc. As regards issuing a general Government order for extending option to the entry pay th beneficiaries on promotion to switch over to 6 CPC w.e.f. 01/01/2006 would be considered in consultation with the Government Department</p> </div> <div class="schema-faq-section" id="faq-question-1695353650423"><strong class="schema-faq-question">11. Subversion of JCM norms with misuse of CCS(RSA) Rules, 1993</strong> <p class="schema-faq-answer">Decision: The Staff Side demanded that the withdrawal of the recognition granted to the NFPE and AIPEU (Gr. C) should be reconsider and the recognition should be granted back. When the official side stated that the matter is sub-judice then the Staff Side is ready to withdraw the Court case if the Government agrees to restore the recognition. As regards the position in ISRO not recognizing the majority Association and dissolving of the JCM would be referred to ISRO to find out the position and thereafter the matter will be further discussed.</p> </div> <div class="schema-faq-section" id="faq-question-1695353690079"><strong class="schema-faq-question">12. Necessary clarification to ensure that the service Associations which are governed by the CCS (RSA) Rule 1993, are kept out of the purview of Rule 15 (1) (c)</strong> <p class="schema-faq-answer">Decision: The Staff Side insisted the DOPT should issue clarification that the DOPT instructions that no Government employee should hold elected office for more than 2 terms / 5 years is not applicable to service associations recognized under RSA Rules 1993 and to the cooperative societies which are register under the Government of India Cooperative Societies Act or under the respective State Government Cooperative Society Act. We also stated that employees are being illegally issued Show Cause Notices for initiating disciplinary action in the Navy on the above pretext.<br />Therefore the matter may be treated urgently and necessary clarification should be issued to avoid punitive actions against the office bearers of the Associations and elected Directors of the Cooperative Societies. Secretary DOPT assured that the entire matter would be reconsidered and necessary instructions would be issued.</p> </div> <div class="schema-faq-section" id="faq-question-1695353729644"><strong class="schema-faq-question">13. Extension of LTC-80 one time relaxation in the case of employees who availed LTC to Andaman &amp; Nicobar Island (A&amp;N) by purchasing air tickets from other than authorized agents</strong> <p class="schema-faq-answer">Decision: After discussion Secretary DOPT agreed to reconsider the demand of the Staff Side and assured a decision would be taken at the earliest.<br />Notional Increment to the employees retiring / retired on 30th of June and 31st of December While concluding the meeting the Staff Side requested Special Secretary Expenditure to issue Government orders for grant of Notional Increment to the employees retiring / retired on 30th of June and 31st of December. Special Secretary informed that the matter is under serious consideration and a decision would be taken soon.<br />As regards the Action Taken Reports on the Agenda Points of the previous meetings and the Arbitration Awards a separate meeting would be held with the Staff Side after 10tt of October 2023.</p> </div> </div>

<p>Respected Sir,</p>



<p>This Federation vide letter referred above have represented to your honour to reconsider the decision taken by the Government to freeze the 3 additional DA/DR due to the <a href="https://centralgovernmentnews.com/" target="_blank" rel="noreferrer noopener">Central Government Employees</a> and Pensioners w.e.f. 01/01/2020. We have also brought to your notice that when the entire country was in COVID-19 lockdown, it is the major chunk of the Central Govt. Employees who are working day and night to fight against the spread of the <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a> Virus including the Defence Civilian Employees. You will appreciate that they are all working under serious risk of the Pandemic. While your honour announced a special economic and comprehensive package of Rs.20 Lakh Crore, the Central Government Employees and Pensioners were anxiously waiting for the announcement of the Hon’ble Finance Minister with the hope that the Central Govt. Employees &amp; Pensioners also will be given some relief in the economic package by releasing the additional DA/DR due to them, which was already approved by the Cabinet during March 2020.</p>

<p>Sir, to our dismay in both the economic relief measures announced by the Hon’ble FM even though she mentioned that the Government ‘s attentive to the needs of all the segment of the economy and society, it is unfortunate that no relief has been given to the Central Govt. and the pensioners to overcome the present economic crisis and exorbitant price rise of the essential commodities. Therefore we are forced to knock once again your door for getting justice to the Central Govt. Employees and pensioners. We therefore request you to kindly withdraw the earlier decision taken by the Govt. to freeze the DA/DR and release the same at the earliest.</p>

<p>Dear Comrades,</p>
<p>Hope all the affiliates organized/planned to hold protest demonstrations in this week against the betrayal for NDA Government.</p>
<p>Go far a hectic campaign against the NDA Government’s attitude towards the Government employees and shameful backed out from the commitment given by the Group of Ministers on 30th June 2016.</p>
<p>Copies of the letter written to Shivgopal Mishra, the so-called leader of Central Government Employees by Confederation of Central Government Employees &amp; Workers (CCGEW), National Federation of Atomic Energy Employees (NFAEE) and All India Defence Employees Federation (AIDEF) are attached herewith.</p>
<p>All Affiliates are requested to popularize the stand taken by the Confederation and Federations of various sections of employees and built unity among the employees.</p>

<p style="text-align: center;"><em>“CSD Canteen facilities for Defence Civilian retired employees – Long pending demand accepted by MoD”</em></p>
<p><em> </em></p>
<p>For a number of years the Defence Civilian employees have obtained the facility to buy items at subsidized prices from CSD canteens. Especially, Ordnance Employees could buy anything from groceries to bike – at super-subsidized rates from the CSD Canteens, also called Unit Run Canteens. But these facilities were denied to retired employees.</p>
<p>&nbsp;</p>
<p>There is no doubt that such concessions are of tremendous importance post-retirement, when the person faces extreme financial crunch. There is no denying the fact that the mental satisfaction is much higher when these items are bought at subsidized rates from these canteens. Also, denying this privilege after retirement becomes a prestige issue of sorts.</p>
<p>&nbsp;</p>
<p>After prolonged fights by all the federations of employees union, the Centre is accepted to extend the subsidized CSD canteen facility to retired defence civilian employees too. It is being said that the Minister of Defence has given his approval to the order.</p>
<p>&nbsp;</p>
<p>More information on this is expected soon. Issues like who qualifies for the facility, what are the items they cold buy at subsidized rates, and providing Smart Cards, etc., have not yet been decided.</p>
<p>&nbsp;</p>
<p>One thing is for sure – retired employees can now proudly shop at the CSD canteens.</p>

<p>INDWF General Secretary Shri.R.Srinivasan published on its official blog regarding the burning issue of ‘Corporatisation of Ordnance Factories’. He said, that the media is highlighting in the press that M of D proposing to corporatise the Ordnance Factories in ‘The Hindu’ on 18th Jan 2015. Also damaging statements are appearing in the Press against Ordnance Factories. In this respect, all the three recognised Federations submitted a Joint Memorandum to Hon’ble Defence Minister on 30.12.2014 requesting him to call for a meeting to discuss the proposal of M of D about Ordnance Factories. But till date, no intimation has been received from M of D.</p>
<p>&nbsp;</p>
<p>Still the cloud is not clear and the M of D is proceeding on its own without consulting or discussing with the stake holder including working class organisations.</p>

<p><strong>All India Defence employees Federation opposes corporatisation of Ordnance Factories</strong></p>
<p>AIDEF convey it, Stand to the Defence Minister Shri.Manohar Parrikar</p>
<p>It is seen from the media report that the Government is considering the proposal to corporatised the Ordnance Factories. The 4 lakhs Defence Civilian Employees and their trade Unions have opposed any move of the Govt in the past to corporatised the Ordnance Factories, which is not in the interest of National Security of the country. Moreover the experien. with various Public Sector Units and corporation reveal that ultimately it will result in Privatisation. The Ordnance Factories are captive industry established for manufacturing Military Equipments including Tanks, Arms, Ammunitions, Vehicles and other troop comforts, strategic uniforms etc. Therefore the Defence Production Ordnance Factories should be under the control of Government. In this regard there are written agreement with the Federations of the Defence Civilian Employees by the then Defence Ministers, including the then Defence Minister, now Hon’ble President of India Shri.Pranab Mukherjee, that Ordnance Factories would not be corporatised. A delegation of AIDEF met Defence Minister Shri.Manohar Parrikar on 1.1/2015 and conveyed the views of the employees that Ordnance Factories should not be privatised. The Ordnance Factories should not be privatised in view of the agreernent with the recognised Federations. The Defence Minister has assured that he will call a meeting of the 3 Federations after 15. of Feb. 2015 to discuss the entire issues until such time no decision would taken in this regard.</p>
<p>In the meantime the recognised Federations and Associations of Defence Civilian Employees are meeting on the 27, of Jan. 2015 to consider the development and the proposal of the Defence Ministry and to take further course of action to fight against any move of the Government to corporatise the most Stratigical Defence Industry, the 41 Ordnance Factories.</p>

We expect AIDEF will take up the issue of upgradation of Grade pay of LDC &amp; UDC also.</div>

<div>Sub: <strong>Non-implementation of decisions taken in the National 6th CPC Anomaly committee</strong>.</div>
<div>Ref: Minutes of the National Anomaly Committee meeting held on 17/07/2012.</div>
<div></div>
<div>We wish to draw your kind attention to the above mentioned subject. After the implementation of 6th CPC recommendations w.e.f.1/1/2006, Govt. of India constituted a National Anomaly Committee with representatives of staff side to settle the various anomalies arosed as a result of 6th CPC. The following two major issues which affects the major section of the Central Govt. employees was raised in the meeting and discussed in the subsequent meetings and an understanding was reached between the official side and the staffside. <strong>However it is unfortunate that the Govt. has not taken any decision on these two issues which has now</strong> forced the employees to approach Court of Law. Therefore to avoid multiplicity of litigations in the service matters of the Central Govt. employees, we request you to kindly intervene in the matter and arrange to issue necessary instructions for implementing the following two major issues.</div>

<div>1)<strong> Anomaly in the entry pay between Direct Recruite and promotee</strong></div>
<div>There arosed an anomaly in Rule-8 of the CCS(RP) Rules &#8211; 2008, basically due to the fact that it is for the first time that the pay commission has recommended specific entry level pay for Direct Recruits (DRs). This has resulted in employees who were appointed in service prior to the Direct Recruits and got promoted earlier getting less pay as compared to their counterparts recruited directly and who joined after 1/1/2006. The official She stated that in such cases stepping up of pay is permissible subject to certain conditions. However the staffside hoisted that on promotion , the pay of all the promotees should be fixed at the entry level of pay of that post as in the case of the Direct Recruits wherever there is a provision of Direct Recruitment in the Recruitment Rules. The staffside requested that wherever there is a provision in the recruitment rule for direct recruitment in a post then in such cases the entry pay given to a direct recruitee should be automatically given to the promotee irrespective of the fact, whether a junior direct recruite is available or not. This proposal of the staffside was agreed by the official side and the DOP&amp;T has proposed for implementation of this decision to the Department of Expenditure for issuing necessary Govt. orders. However till date no Govt. orders is issued on the subject.</div>

<div>2) <strong>Grant of MACP benefits in the promotional hierarchy of the Post instead of the next Grade pay in the Pay Band.</strong></div>
<div>In the ACP scheme implemented by the Govt. w.e.f. 9/8/1999, based on the recommendation of the 5th CPC, the benefit was given in the promotional hierarchy of the respective posts. However the scheme was modified as MACP by 6th CPC and while implementing the same from 1/9/2008, it was changed from promotional hierarchy to next Grade pay in the Pay band. Due to this the employees are subjected to huge financial loss. To quote an eg. in the ACP scheme an employee in the GP of Rs.1900 was given ACP benefits in the next promotional post in the GP of Rs.2400, whereas in the case of MACP the benefit was given only in the next GP of Rs.2000/-. This major anomaly was pointed out by the staffside in the National Anomaly Committee and the staffside has given various suggestions for the consideration of the official side, it was agreed in the meeting that the suggestions given by the staffside would be considered. However, since no positive decision was coming from the Govt., the aggrieved employees have started approaching various courts. The matter went up to the Hon&#8217;ble Supreme Court and the Supreme Court was kind enough to rule that MACP benefits should be given in the promotional hierarchy and not in the next GP. After this Judgement various Federations of the Central Govt. employees have represented to implement the decision of the Hon&#8217;ble Supreme Court to all similarly placed employees. However it is regretted to inform you that the Govt. has implemented the benefit only for the petitioner .</div>

<div>Sir, we once again request your kind intervention in the matter and necessary directions may please be given to the DOP&amp;T and Department of Expenditure to settle the above major two anomalies, seas to avoid any further litigation on the matter.</div>

<p>Only sectional demands discussed by defence ministry. No discussion or ensurance about DA merger, Interim Relief, Date of effect of 7th CPC and New Pension Scheme. On the other hand, despite of 96 percent Railway employees voted in favour of indefinite strike on the issues of Pay Commission, DA Merger, Interim Relief, New Pension Scheme etc, Railway unions have not taken it seriously.</p>
<p>CONFEDERATION IS THE ONLY ORGANISATION WHICH IS CONDUCTING UNCOMPROMISING FIGHT AGAINST THE POLICIES OF THE CENTRAL GOVT. AND ALSO FOR THE JUSTIFIED DEMANDS OF THE CENTRAL GOVT. EMPLOYEES. AND WE CONDUCTED THE TWO DAY STRIKE SUCCESSFULLY.</p>
<p>LET US KEEP UP THIS FIGHTING SPIRIT AND CONTINUE OUR STRUGGLE IN THE COMING DAYS.</p>

<p>Subject :- <strong>Follow up action on the ‘Minutes’ of the Meeting held on 06.02.2014 under the Chairmanship of AS(A) with the representatives of Recognized Federations of MoD i.e. AIDEF, INDWF &amp; BPMS in connection with the Notice of “Indefinite Strike” from 17.02.2014 by Defence Civilian employees.</strong></p>
<p>A copy of the ‘Minutes’ of the above meeting is enclosed for perusal and necessary appropriate action.</p>
<p>2. All concerned are requested to ensure necessary appropriate action, wherever necessary, on the issues concerning them.</p>

<p><em>‘Minutes’ of the Meeting held on 06.02.2014 under the Chairmanship of AS(A) with the representatives of Recognized Federations of MoD i.e. AIDEF, INDWF &amp; BPMS in connection with the notice of “Indefinite Strike” from 17.02.2014 by Defence Civilian Employees:</em></p>
<p><strong>The Declaration made by the Federations.</strong><br />
I. List of participants is at Annexure.</p>
<p>II. At the outset, AS(A) welcomed the representatives of the Federations and Official Side Members. He stated that the efforts will be made to sort out the problems expeditiously in the best interest of employees. The representatives of the Federations expressed their unhappiness at the accumulation of pending demands which compelled them to come at this juncture to go on ‘Indefinite Strike’ but hoped to get good discussion and solutions to their problems today. Then, AS(A) invited the representatives of all the three Recognized Federations to discuss the issues indicated in their Charter of Demands.</p>
<p>III. Discussions on Agenda Points raised :</p>
<p>&nbsp;</p>
<blockquote><p>Agenda Point-1 Grant of 2nd / 3rd MACP in Grade Pay Rs 4600/- to the Artisan Staff of Defence Establishments who were granted 2‘ ACP in the Char to 31.12.2005 in spite of MoD’s recommendation matter is pending with Defence Finance)<br />
Decision : Addl FA &amp; JS(RS) agreed to the issuance of clarification on this issue. Staff Side demanded discussions on the framing of RRs for MCM and Chargeman before referring the same to DOP&amp;T and Was also agreed to.</p>
<p>Agenda Point-2 Correlation of the hourly rate of Industrial Workers deployed on Piece Work system in Ordnance Factories in 6th CPC Pay Scale w.e.f. 01.01.2006 (in spite of MoD’s recommendation matter is pending with Defence Finance)<br />
Decision: Demand was agreed to. However, the issue of giving retrospective effect to the same will be examined separately.</p>
<p>Agenda Point-3 Grant of Departmental Overtime Wages to the Industrial Workers deployed on Piece Work ; system in the Ordnance Factories(in spite of MoD’s recommendation matter is pending with Defence Finance).<br />
Decision: The demand will be re-examined by DDP and a justified action will be taken as per policy.</p>
<p>Agenda Point No-4 Grant of hourly rate to the Piece Workers of Ordnance Factories who were given MACP benefits. (inspite of MoD’s recommendation matter is pending with Defence Finance).<br />
Decision: Depending upon the decision on agenda point No.1, a decision on this issue will be taken by,DDP.</p>
<p>Agenda Point No-5 Grant of revised ACP benefits to the labourers who have completed 30 years of service by granting an one time exem tion of Trade Test. MoD’s; recommendation in the matter is pending with DoP&amp;T).<br />
Decision: To get the matter expedited, a meeting with DOP&amp;T is to be held</p>
<p>Agenda Point No-6 Grant of revised ACP benefits to the erstwhile Group “D” NIEs (MoD’s recommendation in the matter is pending with DoP&amp;T).<br />
Decision: As detailed in reply to Item No. 5.</p>
<p>Agenda Point No-7 Revision of Night Duty Allowance w.e.f. 01.01.1996 and from 01.01.2006 in the 5th and 6th CPC rates respectively by implementing the Court Judgments on the subject<br />
Decision: Defence Finance will look into the matter expeditiously</p>
<p>Agenda Point No-8 Doubling of the Risk Allowance for Defence Civilian Employees w.e.f. 01.09.2008 has agreed in the National Anomaly Committee Meeting.<br />
Decision: DOP&amp;T may be reminded and matter to be pursued</p>
<p>Agenda Point No-9 Implementation of the following judgment to the similarly placed employees as per provisions of DOP&amp;T OM No. A11019/2/98-AT dated 03 September, 1998.<br />
i) Grant of MACP in promotional hierarchy (Government’s SLP dismissed in the case of CAT Chandigarh Bench Judgment on OA No.1038/CH of 2010.<br />
Decision: Comments noted.</p>
<p>ii) Placement from HS Grade to HS Grade-I should be ignored for granting MACP (Judgment of CAT Principal Bench New Delhi in the case of Employees of 505 ABW, New Delhi referring various Supreme Court Judgments)<br />
Decision: Comments noted.</p>
<p>iii) Restoration of the opportunity of Chowkidars and Safaiwalas of MES for re-designation as Mate (SS) (Judgment of the Hon’ble CAT Ernakulam Bench in OA No.109/2012 dated 12.12.2012)<br />
Decision: Matter already resolved.</p>
<p>iv) Removal of discrimination and grant of skilled pay scale of Rs.260-4000/ 950- 1500 to non-petitioner Valvemen of MES (Judgment of Hon’ble CAT Jodhpur Bench in OA NO.51/2002 dated 21st July, 2003)<br />
Decision: D(Works-II) to consider the matter and expedite the same.</p>
<p>v) Inclusion of HRA and Transport Allowance etc. for computation of OT Wages under Factories Act 1948 based on the judgment of Madras High Court.<br />
Decision: Comments noted.</p>
<p>vi) Implementation of higher Pay Scale and grade structure for the similarly placed Cooks of all Defence Establishments as granted to the Cooks of Air Force vide MoD Letter No. Air HO/23064/Cooks/PC-4/444-CC/D(Air-III) dated 12th November 2013 based on the judgment of Hon’ble Principal Bench CAT, New Delhi.<br />
Decision: Directions may be issued to cadre controlling authorities to carryout the cadre review of Cooks cadre in line with Cooks of the Air HQr.</p>
<p>Agenda Point No-10 Approval of all cadre review proposals of MTs, Durwanl Fireman, Drivers, Storekeeping Staff, Industrial Canteen Staffs Para Medical Staff, Stenographers, DEO, JWM and Clerical Staff of OFB, DRDO, DGOA, Navy, EME, AOC, Air Force and other Directorates pending at different level.<br />
Decision: (i) Cadre reviews pending with Defence Finance be finalized.</p>
<p>(ii) Cadre review proposal not submitted shall be submitted within in one month and settled.</p>
<p>(iii) DRDO shall consult Staff Side Federations before finalization of DRTC cadre review.<br />
Agenda Point No-11 Grant of PR1S to the DRDO Employees at par with Department of Atomic Energy and ISRO.<br />
Decision: DRDO shall expedite a decision at RM level.</p>
<p>Agenda Point No-12 Revision of Fixed Medical Allowance to the Defence Employees posted at hard stations/isolated places and also grant of medical reimbursement for impatient treatment for such employees by implementing the judgment of Punjab and Haryana High Court.<br />
Decision: Matter may be pursued with Ministry of Health &amp; Family Welfare to expedite a decision.</p>
<p>Agenda Point No-13 Grant of Four Grade Structure to the Ammunition Mechanic or NAD under navy.<br />
Decision: Matter may be pursued with Ministry of Finance to expedite a decision.</p>
<p>Agenda Point No-14 Grant of Four Grade Structure to the Meter Reader of MES at Par with the Artisan Staff<br />
Decision: Matter may be pursued with DOP&amp;T to expedite a decision. Agenda Point No-15 Extension of CSD Canteen facilities for retired defence civilian employees at par with Ex-Serviceman.</p>

Decision: Matter may be taken up again.</p>
<p>Agenda Point No-16 Revision of Bonus payment ceiling and Gratuity ceiling limit. Decision: Not discussed being national issue.<br />

<p>Agenda Point No-17  Opening of CGHS Dispensaries in all major cities and reorganization of Hospitals under CGHS in Hill Stations.<br />
Decision: Not discussed as the issue relates to Ministry of Health &amp; F.W.</p>
<p>Agenda Point No-18 Withdraw DPP-2013 which is against the interest of DRDO and Ordnance Factories<br />
Decision: The demand may be examined by DDP.</p>
<p>Agenda Point No-19 No FDI in Defence Sector<br />
Decision: Comments noted</p>
<p>Agenda Point No-20 No disturbance in the functioning of DRDO by implementing Professor Rama Rao<br />
Committee recommendations.<br />

<p>Agenda Point No-21 No arbitrary reduction of manpower in the various Army Units in the name of ASEC Report in violation of the Cabinet Secretary’s directions.<br />
Decision: instructions in this regard may follow.</p>

<p>Agenda Point No-25 Withdraw the New Pension Scheme<br />

<p>Agenda Point No-26 Grant of Compassionate Appointment 100% as being granted by the Railway Ministry.<br />
Decision: The matter may be taken up with DOP&amp;T at higher level</p>
<p>Agenda Point No-27 No reduction of sanctioned strength of the Ordnance Factories based on Sourab Kumar Committee Report.<br />
Decision: Comments noted</p>
<p>Agenda Point No-28 Regular meeting with the recognized Federations by the MoDand other Directorates should be ensured.<br />
Decision : Staff Side was advised to submit a calendar on the line of action.</p>
<p>Agenda Point No-29 Three meetings of the Departmental Council (JCM) and four meetin . of the JCM-III Level Council as per the constitution of the JCM Scheme should be ensured.<br />
Decision: Timely meetings may be ensured.</p>
<p>Agenda Point No-30 Grant of Trade Unions rights to all the non gazetted employees working in the Defence Establishments as being given in the case of Railway. (Up to 4200).<br />
Decision: As detailed in reply to item No.32.</p>

<p>Agenda Point No-32 Grant of Trade Unions rights to the Defence Civilian Employees posted at area declared under SRO-17E.<br />
Decision; On agenda point Nos.30, 31 &amp; 32, a meeting will be held onreceipt of comments from the Federations.</p>
<p>Agenda Point No-33 : Settle all the 6th CPC Anomalies and all Cadre review proposals before 7th CPC starts functiong.<br />
Decision : As detailed in reply to Item No. 10.</p>
<p>Agenda Point No-34 Accept all the terms of reference of 7th CPC submitted by the Staff Side of National Council (JCM) to the DoP&amp;T.<br />
Decision : As being done previously, Staff Side may be consulted before submitting the proposal to VII CPC on common issues.</p>
<p>Agenda Point No-35 Implement the revised comprehensive pay package for the CentraI Government Employees as on 01.01.2014.<br />
Decision : Not discussed being national issue.</p>
<p>Agenda Point No-36 To consider the demand of merger of Dearness Allowance/Dearness Relief with Basic Pay and Basic Pension and also grant of interim relief.<br />
Decision: Not discussed being national issue.</p></blockquote>
<p>Addl. Secy (A) appealed the Federations that considering the discussion and decisions taken in the meeting, the Federations may please consider to withdraw their proposed ‘Indefinite Strike’ action.</p>
<p>The representatives of the Federations expressed the hope to get the ‘Minutes’ of the meeting by 11th February, 2014 so as to enable them to take a final decision on the proposed strike. The meeting ended with a vote of thanks to the Chair.</p>

<p>Three federations representing around 4 lakh Defence Civilian Employees today decided to postpone their proposed indefinite strike from February 17 after receiving assurances from Defence Minister AK Antony regarding their demands.</p>
<p>&#8220;Defence Ministry has agreed to settle some of the demands related to cadre restructuring, promotional issues, piece rate and incentive revisions for production workers along with revision in the night duty allowance, etc.,&#8221; said an office bearer of the All-India Defence Employees Federation.</p>
