<p>(a) whether there is a proposal to retire employees of Central and State Government after completing a maximum service period of 30 years;</p>



<p>(b) if so, whether the Government will mandate the same for all employees of the Central Government in different States;</p>



<p>(c) if so, whether the Government will also mandate the same for all employees of different State Governments; and</p>



<p>(d) the objective behind placing a ceiling limit of 30 years of service for Government employees?</p>

<p>In view of the unprecedented situation arising out of country-wide lock down declared by the Government consequent to we outbreak <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener" aria-label="COVID-19 (opens in a new tab)">COVID-19</a>, it is clarified that the central Government employees who are attaining the <a href="https://centralgovernmentnews.com/tag/age-of-superannuation/" target="_blank" rel="noreferrer noopener" aria-label="age of superannuation (opens in a new tab)">age of superannuation</a> on 31st March, 2020 in terms or Fundamental Rule 56 and due to retire. shall retire from Central Government service on 31st March, 2020, irrespective of whether they are working from home or working from office.</p>

<p style="text-align: center;"><span style="text-decoration: underline;">NOTIFICATION</span></p>
<p style="text-align: right;">New Delhi, the 11th August, 2018</p>
<p>G.S.R. 767(E).- In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Fundamental Rules, 1922, namely :-</p>
<p>1. Short title and commencement.- (1)These rules may be called the Fundamental (Second Amendment) Rules, 2018.</p>
<p>(2) They shall come into force on the date of their publication in the Official Gazette.</p>
<p>2. In the Fundamental Rules, 1922, in rule 56, for clause (bb), the following shall be substituted, namely: &#8220;(bb) (i) The age of superannuation in respect of the doctors belonging to &#8211;</p>
<p>(i) Central Health Service;<br />
(ii) Indian Railways Medical Service;<br />
(iii) AYUSH and working under the Ministry of AYUSH;<br />
(iv) Civilian doctors under the Directorate General of Armed Forces Medical Service;<br />
(v) Medical Officers of the Indian Ordnance Factories Health Service;<br />
(vi) Dental Doctors under the Department of Health and Family Welfare;<br />
(vii) Dental doctors under the Ministry of Railways; and<br />
(viii) General Duty Medical Officers, Specialist Grade doctors and Teaching Medical Faculty working in Bhopal Memorial Hospital and Research Centre,</p>
<p>shall be sixty-two years unless they exercise the option of posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes and functions including advisory and consultancy depending on their expertise and experience, as decided by the competent authority in the concerned Ministry or Department from time to time, in case they desire to continue in their service upto the age of sixty-five years:</p>
<p>Provided that the age of superannuation in respect of the doctors belonging to the General Duty Medical Officers sub-cadre of Central Armed Police Forces and Assam Rifles and Specialist Medical officers of Central Armed Police Forces and Assam Rifles shall be sixty-five years.</p>
<p>(ii) The serving doctors belonging to the services referred to in sub-clause (i) who have either already attained the age of sixty-two years or attaining the age of sixty-two years within six months from the date of publication of these amendment rules in the Official Gazette, may exercise their option in regard to their posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes and functions including advisory and consultancy as specified in sub-clause (i), within a period of thirty days from the date of the commencement of the Fundamental (Second Amendment) Rules, 2018.</p>
<p>(iii) The serving doctors who fail to exercise the option in regard to their posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes and functions including advisory and consultancy as specified in sub-clause (i), within the period specified in sub- clause (ii), shall be superannuated form their service on attaining the age of sixty-two years or on expiry of a period of thirty days from the date of the commencement of the Fundamental (Second Amendment) Rules, 2018, whichever is later.&#8221;</p>

<p>Cabinet approves enhancement of age of superannuation of General Duty Medical Officers, Specialist Grade doctors and Teaching Medical Faculty working in Bhopal Memorial Hospital and Research Centre, Bhopal</p>
<p>The Union Cabinet chaired by Prime Minister Shri Narendra Modi has approvedthe proposal of Department of Health Research, Ministry of Health &amp; Family Welfare to enhance the age of superannuation of General Duty Medical Officers, Specialist Grade doctors and Teaching medical faculty working in Bhopal Memorial Hospital and Research Centre, Bhopal to sixty-five years at par with doctors of Central Health Services and doctors working under other Central government hospitals/institutes.</p>
<p>The age of superannuation in respect of General Duty Medical Officers and Specialists included in Teaching, Non-Teaching and Public Health sub-cadres of Central Health Services was increased to sixty-five years vide a Notification in January, 2018.</p>
<p>The Government decision will meet the shortage of faculty and specialist doctors in the BMHRC and improve the patient care facility to the victims of Bhopal Gas Tragedy and members of their families.</p>

<p>Subject: <b>Enhancement in the age of superannuation of Doctors of Ord Fy Board (Department of Defence Production, Min of Def).</b></p>
<p>Respected Sir,</p>
<p>With due regards, your attention is invited to the speech of Hon’ble Prime Minister of India Sri Narendra Modi which he delivered on 26th May, 2016 in Saharanpur (U.P.) in a rally to observe the second anniversary of his Government, which was as under:</p>
<blockquote><p>There is a shortage of doctors. In government hospitals, their retirement is 60 years in some states, 62 in some others. If adequate number of medical institutes were there, then we would have more doctors and would not feel the shortage. It is difficult to make doctors in two years but poor families cannot be forced to live without doctors.</p></blockquote>
<blockquote><p>Therefore from Uttar Pradesh, I want to announce this to my countrymen that this week our government&#8217;s Cabinet will take a decision within a week and the retirement age of our doctors, whether in states or Government of India, would be made 65 years instead of 60 or 62.</p></blockquote>
<p>Honouring the promise of Prime Minister, the Department of Personnel &amp; Training, MoP, PG &amp; P, GOI issued Notification (GSR No. 567-E, Dated 31.05.2016) for amendment in FR 56 (bb) whereby the age of superannuation in respect of General Duty Medical Officers and Specialists included in Teaching, Non-Teaching and Public Health Sub-cadres of Centre Health Service has been enhanced to 65 yrs.</p>
<p>Considering the huge shortage of Specialists (75%) &amp; GDMOs (25%) in Indian Ordnance &amp; Ordnance Equipment Factories (Department of Defence Production, Min of Defence) this issue was brought to notice of Hon&#8217;ble Defence Minister, Shri Manohar Parrikar by this federation and requested him to take appropriate action to enhance the retirement age of IOFHS Cadre.</p>
<p>In turn Hon&#8217;ble Defence Minister assured for extension of coverage of FR 56(bb) in favour of IOFHS Cadre forthwith. Thereafter, in the month of August, 2016 MoD has sent a proposal to DoP&amp;T for necessary approval / action and to expedite that the Secretary, Department of Defence Production also wrote a <b>DO Letter</b> to Secretary, DoP&amp;T to expedite the matter but the file is moving from one Ministry / Department to another.</p>
<p>It is worth to mention here that Min of Railways, Home Affairs, Municipality Corporation of Delhi etc. have already enhanced the superannuation age of their Doctors and meanwhile Min of Health &amp; Family Welfare has clarified vide F.No. Z.16024/11/2016-CHS.V Dated 30.08.2016 that Departments / Ministries may take decision, with the approval of their respective competent authorities on the enhancement of the age of superannuation of doctors.</p>
<p>Now the time has come for Bureaucratic System to respect, accept &amp; adopt the Hon’ble Prime Minister&#8217;s <b>3S</b> Speed, Skill &amp; Scale to resolve the issues of Government Employees.</p>
<p>Therefore, you are requested to issue necessary directives to the concerned authorities to extend the provisions of FR 56(bb) in respect of all the doctors of OFB so that the organization as well as the incumbents may also be benefitted with enhanced age of superannuation of 65 yrs with effect from 31.05.2016.</p>

<p>With due regards, your attention is invited to this federation’s letter of even no. dated 30.07.2016 whereby it has been requested to your good self to enhance the age of superannuation of Doctors of Ordnance Factories and during your visit at the residence of Sri Rakesh Singh, Member of Parliament (Lok Sabha) from Jabalpur (M.P.) you have kindly assured this Federation BPMS to resolve the issue without further delay.</p>
<p>Thereupon, for extension of coverage of FR 56(bb) in favour of IOFHS Cadre, in the month of August, 2016 MoD has sent a proposal to DoP&amp;T for necessary approval / action and to expedite it, the Secretary, Department of Defence Production also wrote a ‘DO Letter’ to Secretary, DoP&amp;T to expedite the matter but the file is moving from one Ministry / Department to another.</p>
<p>Meanwhile Min of Health &amp; Family Welfare has clarified vide F.No. Z.16024/11/2016- CHS.V Dated 30.08.2016 that Departments / Ministries may take decision, with the approval of their respective competent authorities on the enhancement of the age of superannuation of doctors.</p>
<p>In such circumstances, being the competent authority of Min of Defence, you are requested to approve the proposal of enhancement of superannuation of doctors of OFB without obtaining the permission of DoP&amp;T as the other Ministries like MHA, Railways etc. have already done.</p>

<p>Sub: <strong>Grant of extension/re-employment to Central Government servants beyond the age of superannuation</strong></p>

<p> Attention of all the Ministries/Departments is invited to the Government of India(Transaction of Business) Rules which prescribe that the ACC is the competent authority to decide the cases of extension in service beyond the age of superannuation. Attention is also invited to DoPT’s OM. No. 26012/6/2002-Estt, (A) dated 09.12.2002 on the subject mentioned above laying down instructions/criteria for grant of extension in service to the categories of personnel referred in proviso to F.R. 56(d). The ACC has observed that in sorne of the cases, the Departments are not taking timely action to reconstitute the Departmental Peer Review Committee (DPRC) and are unilaterally extending the service of the officers beyond the age of superannuation without first obtaining approval of the ACC.</p>

<p>2. It has also been observed that Ministries/Departments often submit proposals late to the EO Division as a result of which submission of cases for consideration of the ACC also gets delayed.</p>

<p>3. In view of the above, all the Scientific Ministries/Departments are hereby advised to take timely action for constitution of the DPRC for considering the cases for extension of service of specialists in medical or scientific fields, beyond the normal date of superannuation and ensure that proposals seeking approval of the ACC be invariably submitted at least two months in advance of the date of superannuation.</p>

<p>4. It is also reiterated that in absence of specific approval of ACC towards extension of his services beyond the date of superannuation, an officer should stand retired on his date of superannuation and under no circumstances should the Ministry/Department concerned extend his services beyond superannuation unilaterally without the approval &amp; ACC</p>
