<p>The Minister of Heavy Industry and Public Enterprises said in Parliament in a written reply to a question that the Department of Public Enterprises is not considering any proposal to enhance the age of superannuation of employees of all sick Central Public Sector Enterprises (CPSEs) from 58 to 60 years.</p>
<p>However, Board for Reconstruction of Public Sector Enterprises (BRPSE) has been directed to undertake in-depth examination with regard to enhancement of age of superannuation from 58 to 60 years in respect of such CPSEs whose revival packages have been approved by the Government and which will continue to be in public sector after implementation of revival package, and thereafter make suitable recommendations to the concerned administrative Ministry for obtaining approval of competent authority.</p>
<p>BRPSE has also been directed to ensure that the issue of the enhancement of age of superannuation from 58 to 60 years is adequately addressed while examining/recommending future proposals for revival of sick/loss making CPSEs and that the revival package has specific recommendation in this regard.</p>
<p>BRPSE has not made any specific recommendation regarding enhancement of age of superannuation from 58 to 60 years in respect of employees of ITI Limited.</p>
<p><strong>Enhancement of age of retirement of Board and below Board level employees of profit earning Central Public Sector Enterprises (CPSEs).</strong></p>

<strong>PERSONNEL POLICIES</strong><br />
<strong>(b) Composition of Board of Directors</strong><br />

<p><strong>Enhancement of age of retirement of Board and below Board level employees of profit earning Central Public Sector Enterprises (CPSEs).</strong></p>
<p>The Government had taken a decision to increase the age of retirement from 58 to 60 years of Board level and below Board level employees of Central Public Sector Enterprises (CPSEs) in May 1998.  In May 2000, sick/unviable CPSEs were permitted to roll back the age of retirement from 60 to 58 years with the approval of the Cabinet. Subsequently in August 2001, the Cabinet delegated the authority to Minister-in-charge to approve proposals for roll back of age of retirement from 60 to 58 years for all CPSEs and all categories of employees, which are duly approved by their Board of Directors. This decision was reviewed in April 2005 and it was decided that the power for roll back of age of retirement of all categories of employees of CPSEs would thereafter vest with the Cabinet.</p>
<p>2. In the meantime, several sick CPSEs have started making profit and these CPSEs have requested for enhancement of age of retirement of its employees from 58 to 60 years.  The matter has further been reviewed by the Government and it has now been decided that the Minister-in-charge of the administrative Ministry/ Department concerned is empowered to approve the proposals of CPSEs to enhance the age of retirement from 58  to 60 years, provided that-</p>
<p>(a) The CPSE concerned should as per its audited annual accounts have made net profits for the last 3 years continuously and should have a positive net worth during the last three years.</p>
<p>(b)The CPSE has not availed any budgetary support during the last 3 years and no budgetary support will be availed by the CPSE in future.</p>
<p>(c) The proposals are approved by the Board of Directors of the CPSE concerned and have the concurrence of Financial Advisor of the concerned administrative Ministry/Department.</p>
<p>3. All the administrative Ministries/Departments are requested to take note of the above decision and to advise the CPSEs under their administrative control suitably in the matter.</p>

Subject: <strong>Withholding of 10% gratuity from the retiring Government servants – clarification regarding.</strong></p>
<p>The undersigned is directed to say that this Department has been receiving representations from individuals and Pensioners Associations that Government Departments have been withholding 10% of the amount of gratuity from each retirees even when they had not been provided any Government accommodation.</p>
<p>2. The recovery and adjustment of Govt. dues from retirement gratuity is regulated under Rules 71 to 73 of the CCS (Pension) Rules, 1972. Rule (1) to (3) of Rule 72 ibid provide for recovered of actual amount of Govt. dues in respect of Govt. accommodation from pay &amp; allowances before retirement and from Retirement Gratuity. Sub rule (5) of Rule 72 ibid stipulates that if, in any particular case, it is not possible for the Directorate of Estates to determine the outstanding licence fee, that Directorate shall inform the Head of Office that ten per cent of gratuity may be withheld pending receipt of further information. The withheld amount of gratuity is to be paid back to government servant immediately on production of ‘No Demand Certificate’ (NDU) from Dte of Estates. Thus, if no ‘Govt. dues’ in respect of Govt. accommodation are outstanding then the rules do not provide for withholding of any part of the gratuity on retirement of the Govt. servant. If no Government accommodation is allotted to a Government servant, in accordance with Dte of Estate’s OM No. 18011/5/1990-Pol-III dated 12.10.2010, it is for the Administrative Ministry to issue an ‘NDC&#8221;.</p>
<p>3. As regards recovery in respect of ‘Govt. dues’ other than those pertaining to Govt. accommodation, the Head of Office is required to complete assessment of such dues eight months prior to the date of retirement [Rule 73(2)]. The actual amount of such dues and the dues   which come to the notice subsequently and remaining outstanding are to be adjusted against the amount of retirement gratuity becoming payable to the Govt. servant on retirement. Thus, there is no provision for withholding any part of gratuity for the purpose of recovery of outstanding government dues other than those pertaining to government accommodation.</p>

<p>The Minister of Personnel, Public Grievances and Pensions Shri.V.Narayanasamy said in a written reply to the Lok Sabha on 5th December 2012 as follows&#8230;</p>
<p>&#8220;There is no such proposal at present. As per Fundamental Rule 56, except as otherwise provided in the Rule, every Government Servant shall retire from service on attaining the age of 60 years&#8221;.</p>

<div>The below questions raised by the Hon&#8217;ble Member of Parliament Shri.Aswamedh Devi in the Lok Sabha and the Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Ministers Office Shri. V. NARAYANASAMY answered to the question below quoted on 05.12.2012 in the written form as follows&#8230;</div>

<div><strong>Questions :-</strong></div>
<div>Whether the Union Government employees recruited after January, 2004 are not eligible for retirement benefits such as pension, GPF and gratuity..?</div>
<div>Whether not providing gratuity, pension and GPF facility is a discrimination with employees recruited after January, 2004 as the same is being provided to the employees of private sector..?</div>
<div>Whether the Government proposes to provide all retirement benefits including gratuity to the Government servants recruited after January, 2004..?</div>

<div><strong>Answer :-</strong></div>
<div>A new restructured defined contribution pension system for the new entrants to Central Government service, except to the Armed Forces, replacing the system of defined benefit pension including GPF, was notified on 22nd December, 2003. The Government employees appointed on or after 1.1.2004 and governed by the New Pension System can withdraw 60% of their Pension Fund as a lumpsum when they retire and the balance 40% of their wealth is used to purchase an annuity scheme from a life insurance company of their choice, which will pay him/her a monthly pension for the rest of his life. In casethe employees leave the New Pension Scheme prior to age 60, the mandatory anuitization would be 80% of the pension wealth.</div>

<div>The monthly annuity under the New Pension Scheme is only a replacement of pension on retirement and family pension on death after retirement. The benefits of Death-cum-Retirement Gratuity (DCRG) and pension/family pension have been provisionally allowed, vide Department of Pension &amp; Pensioners` Welfare OM No. 38/41/06-P&amp;PW(A) dated 5.5.2009, in respect of the Central Government servants covered by the New Pension Scheme in cases where a Government Servant is retired on invalidation/disability and in the case of death of a Government servant in service, on the same rates as are applicable under the old pension scheme, i.e. CCS (Pension) Rules, 1972.</div>

<div>The details of DCRG payable to employees of Central Government under NPS are as under:</div>
<div></div>
<div>(i) The retirement gratuity is payable to the retiring Government servant. A minimum of 5 years qualifying service and eligibility to receive service gratuity/ pension is essential to get this one time lump sum benefit. Retirement gratuity is calculated @ l/4lh of a month`s Basic Pay plus Dearness Allowance drawn before retirement for each completed six monthly period of qualifying service. The maximum retirement gratuity payable is 16 XA times the Basic Pay, subject to a maximum of Rs. 10 lakhs.</div>

<div>(ii) If the Government Servant dies while in service, the death gratuity shall be paid to his family at the rates furnished in the table below:</div>

<div><strong>OFFICE MEMORANDUM</strong></div>
<p>Subject: <strong>Restrictions on top level executives of Central Public Sector Enterprises (CPSEs) joining private commercial undertakings after retirement.</strong></p>
<p>The undersigned is directed to refer to this Department’s O.M. of even number dated 15th May, 2008 (copy enclosed) on the subject mentioned above.</p>
<p>2. The Government has reviewed the position regarding time limit of 30 days for concerned administrative Ministry / Department to communicate the decision on the application(s) seeking permission to accept any appointment/post after retirement in view of the fact that in many cases, a functional Director/CMD would have worked in more than one CPSE during the last five years preceding the retirement and therefore the concerned administrative Ministry / Department would require more than 30 days to consider all aspects/factors as brought out in OM. dated 15th May, 2008 before arriving at a final decision on such applications. It has accordingly been decided to revise Para 7 of the DPE O.M. dated 15th May, 2008 laying down time limits to read as follows.</p>
<p>“The administrative Ministry / Department shall normally take a final decisionon the application for granting permission to accept any appointment/post after retirement and communicate the same to the applicant within a period of 30 days from the date of receipt of the application complete in all respects. In case no decision is communicated within 60 days, the applicant may take up the assignment presuming that the permission has been granted”.</p>
<p>3. All the administrative Ministries/Departments are requested to take note of the above guidelines while processing application of jop level executives of CPSEs for post retirement employment and also bring the contents of these guidelines to the notice of the CPSE(s) under their respective administrative control.</p>
