<p>Subject: <strong>Exercise of Split Option under Saving Clause of FR-22(1)(a)(1) by officers of all grades of Central Secretariat Service (CSS) cadre</strong></p>



<p>The undersigned is directed to say that the matter relating to extending the benefit of “split-option’ available under Saving Clause of FR-22(1)(a)(1) to the serving officers of all grades of Central Secretariat Service (<a href="https://centralgovernmentnews.com/category/css/" target="_blank" rel="noreferrer noopener">CSS</a>) cadre promoted on adhoc basis was examined in this Department in consultation with Department of Expenditure.</p>



<ol class="wp-block-list" start="2"><li>According to above clause to FR-22(I)(a)(1), save in cases of appointment on deputation to an ex-cadre post, or to a post on an ‘adhoc basis’, the Government servant shall have the option, to be exercised within one month from the date of promotion or appointment, as the case may be, to have the pay fixed under the said rule from the date of such promotion or appointment or to have the pay fixed initially at the stage of the time scale of the new post above the pay in the lower grade or post from which he is promoted on ‘regular’ basis, which may be refixed in accordance with the said rule on the date of accrual of next increment in the scale of pay of the lower grade or post.</li><li>After giving due consideration to the special circumstances in which regular appointments could not be made in various grades of CSS Cadre for a long time and in the meanwhile many of the officers of CSS cadre were promoted on adhoc basis and are continuing as such without being reverted, it has been decided to relax one-time the condition of promotion/ appointment on regular’ basis and allow the option as laid down in saving clause below FR-22(I)(a)(1) in case of officers of CSS cadre promoted on adhoc basis subject to the following conditions:</li></ol>



<ul class="wp-block-list"><li>An undertaking may be obtained from each officer, who exercises option in terms of Saving Clause below FR-22(I)(a)(1) to the effect that in case, his name is not approved for regular appointment, he would be liable to refund the over payment, if any, on this account. No recovery will, however, be made in case of a person continuing on an adhoc basis, who retires before his case is considered for regular appointment; and</li><li>The relaxation will apply to those cases where an officer has continued on adhoc basis for more than a year without break.</li></ul>



<ol class="wp-block-list" start="4"><li>All Ministries/ Departments may decide the issue of allowing the benefit of ‘split-option’ as a one-time measure, to the eligible and willing officers of CSS cadre who were promoted on adhoc basis and are still in service as on the date of issue of this O.M. on a case to case to basis, in consultation with their Financial Advisers and subject to fulfillment of above conditions and other conditions prescribed under the Rules.</li><li>This issues with the concurrence of the Department of Expenditure vide their I.D Note No.03-10/ 2020-E-III(A) dated 23.07.2020.</li></ol>

<p><strong>DoPT Orders 2019: Intimation of vacancies in Under Secretary Grade of CSS</strong></p>

<p>Subject: <strong>Intimation of vacancies in Under Secretary Grade of CSS</strong></p>



<p>The undersigned is directed to refer to this Departments&#8217; O.M. of even number dated 04.02.2019 whereby transfer order of 143 Under Secretaries (adhoc) who were initially promoted on &#8220;as is where is basis&#8221; was issued. So far around 23 officers have not reported to their respective Ministries/Departments where they were ordered to be posted.</p>



<p>2. Meanwhile, preparation is under way for the next round of adhoc promotions in Under Secretary grade. For this, this Department is required to assess the vacancies. Few Ministries/Departments have been reporting vacancies taking into account the current vacancies as well as the vacancies against which Under Secretaries have not reported for duty so far as mentioned in para 1 above. It is clarified that this Department has not cancelled the transfer order of any officers who are yet to join their respective Ministries/ Departments. Therefore, the vacancies remaining unfilled in Ministries/ Departments due to non joining of these officers cannot be filled up by a new incumbent. Simultaneously, the Ministries/Departments from where the officers are yet to be relieved may not adjust them against any subsequent vacancies which have now arisen.</p>



<p>3. All the Ministries/ Departments are requested to account for only those vacancies which have occurred in Under Secretary Grade after 04.02.2019 due to promotion to next higher grade, deputation, retirement etc. and intimate the same to this Department to enable us to fill them up in the fresh exercise of promotion.</p>

<p>Subject: <strong>Grant of Non-Productivity Linked Bonus (ad-hoc bonus) to Central Government Employees for the year 2015-16.</strong></p>
<p>The undersigned is directed to convey the sanction of the President to the grant of Non-Productivity Linked Bonus (Ad-hoc Bonus) equivalent to 30 days emoluments for the accounting year 2015-16 to the Central Government employees in Groups &#8216;C&#8217; and &#8216;D&#8217; and all non-gazetted employees in Group &#8216;B&#8217;, who are not covered by any Productivity Linked Bonus Scheme. The calculation ceiling for payment of ad-hoc Bonus under these orders shall be monthly emoluments of Rs. 7000/-, as revised w.e.f 01/04/2014 vide OM No.7/4/2014-E.III(A), dated 29th August, 2016. The payment of ad-hoc Bonus under these orders will also be admissible to the eligible employees of Central Para Military Forces and Armed Forces. The orders will be deemed to be extended to the employees of Union Territory Administration which follow the Central Government pattern of emoluments and are not covered by any other bonus or ex-gratia scheme.</p>
<p>2. The benefit will be admissible subject to the following terms and conditions:-</p>
<p>(i) Only those employees who were in service as on 31.3.2016 and have rendered at least six months of continuous service during the year 2015-16 will be eligible for payment under these orders. Pro-rata payment will be admissible to the eligible employees for period of continuous service during the year from six months to a full year, the eligibility period being taken in terms of number of months of service (rounded off to the nearest number of months);</p>
<p>(ii) The quantum of Non-PLB (ad-hoc bonus) will be worked out on the basis of average emoluments/calculation ceiling whichever is lower. To calculate NonPLB (Ad-hoc bonus) for one day, the average emoluments in a year will be divided by 30.4 (average number of days in a month). This will, thereafter, be multiplied by the number of days of bonus granted. To illustrate, taking the calculation ceiling of monthly emoluments of Rs. 7000 (where actual average  emoluments exceed Rs. 7000), Non-PLB (Ad-hoc Bonus) for thirty days would work out to Rs. 7000×30/30.4=Rs.6907.89 (rounded off to Rs.6908/-).</p>
<p>(iii) The casual labour who have worked in offices following a 6 days week for at least 240 days for each year for 3 years or more (206 days in each year for 3 years or more in the case of offices observing 5 day week), will be eligible for this Non-PLB (Ad-hoc Bonus) Payment. The amount of Non-PLB (ad-hoc bonus) payable will be (Rs.1200×30/30.4 i.e.Rs.1184.21 (rounded off to Rs.1184/-). In cases where the actual emoluments fall below RS.1200/- p.m., the amount will be calculated on actual monthly emoluments.</p>
<p>(iv) All payments under these orders will be rounded off to the nearest rupee.</p>
<p>(v) The clarificatory orders issued vide this Ministry’s OM No.F.14 (10)-E.Coord/88 dated 4.10.1988, as amended from time to time, would hold good.</p>
<p>3. The expenditure on this account will be debilable to the respective Heads to which the pay and allowances of these employees are debited.</p>
<p>4. The expenditure to be incurred on account of Non-PLB (Ad-hoc Bonus) is to be met from within the sanctioned budget provision of concerned Ministries/Departments for the current year.</p>
<p>5. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders are issued in consultation with the Comptroller and Auditor General of India.</p>

<p>New Delhi: Concerned over the increasing pay disparity between defence personnel and their civilian counterparts, the three Service chiefs will soon meet the Defence Minister Manohar Parrikar to convey more such “shortcomings” in the recommendations of the Seventh Pay Commission.</p>
<p>A notification issued by the state Finance Department today said the whole time state government employees drawing upto 80,000 salary would draw Dearness Allowances at the rate of 75 per cent with effect from January 1, 2016.</p>
<p>There would also be an adhoc increase in the existing wages of daily rated workers under the government with effect from January 1, 2016, the notification said.</p>
<p>Chief Minister Mamata Banerjee had announced the hike in September this year addressing a meeting of the Trinamool Congress affiliated West Bengal State Government Employees Federation.</p>
<p>However, she had said no arrears would be paid.</p>
<p>The state government had last time hiked DA by seven per cent on January 9, 2015.</p>
<p>With this decision, nearly seven lakh state government employees would be benefited, while the ten per cent hike in DA would cost the state exchequer around Rs 2,500 crore annually, state government officials said.</p>
<p>The state government already have set up the sixth pay commission for its employees.</p>

<p>Subject: <strong>Zone of consideration for inclusion in Select List of Section Officers&#8217; Grade of CSS for the years 2012 against Seniority Quota &#8211; regarding</strong></p>
<p>The undersigned is directed to convey the approval of the Competent authority for issue of zone of consideration for inclusion in Select List (Seniority Quota) of 2012 in the Section Officers&#8217; Grade of CSS( as per the Annexure-I attached) which has since been drawn up on centralized basis. The zone has been prepared in terms of CSS Rules, 2009 read with CSS (preparation of Select Lists for the Section Officers&#8217; and Assistants&#8217; Grades) Regulations, 2013. The vacancies against which the officers have been included in the Select List relate to the period from 01 .07.2012 to 30.06.2013. The size of the Select List 2012 shall be as under:</p>

<p>2. One of the conditions as per CSS Rules, 2009 and regulations issued thereunder for inclusion in the Select List for a particular year is that the officer should have undergone and successfully completed such mandatory training programmes as may be prescribed by the Government. However, as many Assistants/Section Officers (adhoc) have not undergone/nominated for the mandatory training programme I.e. Level B till date, approval of the competent authority has been obtained for relaxation of this condition for Assistants belonging to Select List up-to 2002. Out of the remaining Officers, the following two officers, have exhausted all the available three nominations and not eligible for further nomination. They have, therefore , been excluded from the zone of promotion:</p>

<p>3. Additional zone of consideration in respect of 60 officers for inclusion in the Select List 2012 has been prepared in lieu of those who are in the zone of consideration but retired on  Superannuation/expired/retired voluntarily and officers who were still on deputation within the same Select List Year 2012 etc. in terms of this Department&#8217;s a .M. No.22011/18/87-Estt(D) dated 09.04.1996 as per the details given below:</p>

<p>4. While every effort has been made to incorporate the correct details of the officials w.r.!. their date of birth, place of posting etc., in case any discrepancy is noted, the same may be intimated to this Department for rectification at the earliest, latest by 28-02-2015. If any of the official included in the zone has left the cadre unit prior to 01.07.2012 (Le. the crucial date for promotion) for the reasons other than as mentioned in the zone, the same may also be intimated.</p>
<p>5. The cadre unit authorities are requested to take immediate action for conducting DPC as per regulation 5 of CSS (preparation of Select Lists for the Section Officers&#8217; and Assistants&#8217; Grades) Regulations, 2013 in respect of<br />
(i) all the officials included in the zone (including retired persons) (as per Annexure-I);</p>
<p>(ii) the officials covered in previous zones (upto Select List 2011) in whose cases ope recommendations have been kept in sealed cover on earlier occasions.</p>
<p>6. Ministries/Departments, where the officials approved for inclusion in the zone for SOSL-2012 and are currently posted as Section Officer on ad-hoc basis or as Assistant, are requested to notify the appointment of these officials as per Annexure-I to this a .M. to the grade of Section Officer on regular basis once they are found &#8216;FIT&#8217; by the respective DPCs. In terms of Rule 2 (c) (iii) of CSS Rules, approved service in the grade of Section Officer will count from 1&#8243; July 2012. However, in terms of DPC guidelines, promotions are effective from a prospective date and no notional fixation of pay from a date prior to the date of actual promotion will be allowed Notification for regular promotion should be issued subject to the following conditions:<br />
(i) the official concerned is clear from vigilance angle in terms of this Department&#8217;s a.M. No .22034/4/2012-Estt.(D) dated 02.11 .2012 and other relevant instructions on the subject;</p>
<p>(ii) Successful completion of Level &#8216;S&#8217; Training of the officer may again be got verified:</p>
<p>(iii) If an officer is undergoing penalty notification should not be issued for regular promotion and in such cases notification should be issued only after the currency of the penalty is over in terms of DoPT&#8217;s a .M. No.22034/5/2004-Estt.(D) dated 15.12.2004. Such cases should also be informed to this Department.</p>
<p>(iv) The officers, who were in service on crucial dates but had retired as AssistanUSection Officer (ad-hoc) subsequently on superannuation or otherwise, have also been considered for inclusion of their names in the aforesaid Select List of Section Officers in pursuance of this Department&#8217;s OM No. 22011/4/98-Estt. (D) dated 12.10.1998 to identify the correct zone of consideration for the relevant Select List. However, their appointment should not be notified as retired persons would not be available to for actual promotion from a prospective date.</p>
<p>7. Details of persons promoted and otherwise, may be intimated to this department in the prescribed proforma (Annexure-II) to enable further necessary action to issue Select List of Section Officers for the year 2012, latest by 28-02-2015 .</p>
<p>8. All those officials who are included in the Select List 2012 are retained in their respective cadres on their promotion within the sanctioned strength of the cadre in the SO&#8217;s grade except those who have been transferred under RTP. It is emphasized that in case of officers under transfer under RTP, the DPC shall be conducted by the Cadre Units they are transferred to. Such officers may be relieved immediately to join new cadre to avail benefits of regular promotion.</p>
<p>9. Some officers included in the zone of promotion for Select List of Section Officers&#8217; Grade for the year/2012 (Seniority Quota) may be on deputation as on date. To avail the benefit of promotion, such officers have tvvo options:</p>
<p>(i) They may repatriate to their parent cadre; or</p>
<p>(ii) They may avail proforma promotion from the date of promotion of their immediate junior.<br />
All Ministries/Departments are, therefore, requested to consider the requests for proforma promotion, if any, in terms of this Department&#8217;s OM No. 6/8/2009-Estt (Pay-II) dated 17th June, 2010 and issue necessary orders without referring the matter to this department.</p>
<p>10. Copy of notifications should invariably be endorsed to this Department for record.</p>

<p><strong>Subject:</strong> Nomination of Stenographers Grade ‘D’ / PA (ad-hoc) of CSSS for appointment to the Grade of Personal Assistants of CSSS for the Select List Year -2010 (Part) on regular basis under the Zoning Scheme for Seniority Quota (SQ).</p>
<p>The undersigned is directed to refer to this Departments O.M. of even number dated 16.2.2012 wherein the range of seniority for promotion from Stenographers Grade ‘D’ to Personal Assistant Grade of CSSS for the Select List Year-2010 has been laid down and to say that on the basis of information furnished by the Cadre Units, it has been decided to nominate the Stenographers Grade ‘D’/PA(ad-hoc) whose names appear in the Annexure to this O.M. for appointment/promotion to the PA Grade of CSSS on regular basis under the Zoning Scheme on their inclusion in the Select List Year 2010 (Part) (SO).</p>
<p>2. It is requested that urgent action may be taken to appoint/promote these officers to PA Grade of CSSS against the Select List Year 2010 (SQ) provided they are clear from vigilance angle. A copy of the appointment! promotion order issued in this regard by the Cadre Units duly indicating the CSL number of the officers may be forwarded to this Department immedateIy.</p>
<p>3. No request for retention will be entertained as cadre allocation has been made on the basis of vacancies reported under seniority quota by the respective cadre units and in accordance with Rotational Transfer Policy for CSSS personnel issued vide O.M. No. 13/1/2009-CS.II dated 1 5.7.2011 .</p>
<p>4. Cadre units are also requested to ensure that the officers concerned are relieved within 45 days from the date of issue of this O.M. to take up the new posting in the cadre unit allocated failing which their nomination order shall be cancelled by this Department. In case an officer nominated against the Select List Year, 2010 refuses regular promotion, cadre units concerned may initiate action in terms of this Department’s O.M. No.5/1/2008- CS.l(S) dated 8.4.2011 under intimation to this Department.</p>
<p>5. The unfilled vacancies of SC/ST category may be carried foiward to the Select List Year 201 1 since sufficient number of SC/ST candidates are not available in the zoneof promotion for Select List Year 2010.</p>
<p>6. This O.M. is available on the website ofthis Department viz. www.persmin.nic.in -&gt; Central Services Wing -&gt; CS Division -&gt; CSSS Promotion (Regular) 4 Steno Grade .&#8217;D&#8217; to &#8216;C&#8217;.</p>
