Subject: Status of Vigilance Clearance and Major/Minor Penalty certificate for preparation of panel of Principal Private Secretaries (PPS) of CSSS for SLY 2016 reg.

The undersigned is directed to refer to this Department’s OM of even number dated 03.05.2016, 05.07.2016, 10.08.2016 and 24.08.2016 on the subject mentioned above and to circulate herewith the latest position regarding availability of ACRs/APARs, Vigilance Clearance, Major/Minor penalty certificate and disclosure certificate in respect of PSs of CSSS. All the cadre units are requested to check at their end the details of the non-availability of ACRs/APARs in respect of PPSs working in their cadre units and make available the requisite records to this Division immediately but not later than 23.09.2016 in any case. It may please be appreciated that the process is getting inordinately delayed for want of complete information as stated above.

2. The officers concerned are also requested to take necessary action, in their own interest, in expediting the requisite information urgently. The cadre units are also requested to upload the data (ACRs/APARs etc.) in the web based system at cscms.nic.in before submitting the same to this Department.

3. The list of officers and status of ACRs/APARs, Vigilance Clearance, Major/Minor penalty certificate and disclosure certificate may be seen/ downloaded on/from the website of this Department: www.http://persmin.nic.in, DoP&T, OMs & Orders, Central Service, CSSS, ACR- Status of Completion.

Subject:- Status of ACRs/APARs and disclosure certificate in respect of PPS grade of CSSS – reg.

The underSigned is directed to refer to this Department’s OM of even number dated 08.08.2014 followed by reminders dated 01.01.2015, 05.02.2015, 19.03.2015, 24.04.2015, 08.05.2015, 22.05.2015 & 02.06.2015 on the subject cited above and to say that ACRs/APARs in respect of some PPSs are yet to be received in this Division despite several reminders as per the list annexed to this OM.

2. It may be noted that panel of Sr. PPS for SLY 2015 is to be prepared before 01.07.2015 so that the eligible officers are promoted on time. Delay in submission of APARs and their disclosure certificate by the concerned cadre units is likely to delay the preparation of panel, which has to be finalized after receipt of recommendation of UPSC in this regard.

3. The concerned cadre units are, therefore, requested to check the details of the non-availability of ACRs/APARs and disclosure certificate in respect of PPS working in their cadre unit and make available the records to this Division immediately.

OFFICE MEMORANDUM

Subject: Entries in ACRs/APARs and proper disposal of representation in a quasi-judicial Manner by the competent authority against remarks in ACRs/ APARs or for upgradation/downgradation of the final grading.

This Department has issued OM dated 14th May, 2009 wherein the new system of communicating the entries in APAR is made applicable with effect from the reporting period 2008-09. This Department’s OM dated l e April, 2010 Ministries and Departments have been further asked to provide a copy of the reckonable below bench mark ACRs for the period prior to the reporting period 2008-09 to the concerned employee for his representation, before such ACRs are placed before future DPCs. This OM also lays  down that the representations against the remarks or for up gradation of final grading in the APAR be considered by the competent authority objectively in a quasi-judicial manner on the basis of material placed before it. It provides that the competent authority shall take into account the contentions of the officer who has represented against the particular remarks/ grading in the APAR and also take the views from the reporting and reviewing officer and in case of up gradation of the final grading given in the APAR, gives specific reasons in the order.

2. The UPSC has brought to the notice of this Department that in the DPCs being held in the aegis of the Commission, orders of the competent authority do not contain specific reasons for such up gradation in a number of cases. In this regard this Department has already issued OM No. 2011/1/2005-Estt. A(Pt. II) dated 19th May, 2011 which, inter alia, states that such orders cannot be termed as disposed off in a quasi-judicial manner as laid down in the aforesaid OM dated 13.04.2010. Grading an officer below the bench mark by the DPC in such cases on the ground of up gradation being without giving sufficient reasons is prone to avoidable representations.

3. It is reiterated that proper disposal of representation in a quasi-judicial manner as outlined in this Department’s OM dated 13.04.2010 is mandatory before the under consideration ACR/APAR may be placed/considered before/by the DPC.

4. All the Cadre Controlling Authorities, Ministries/Departments are advised to ensure compliance of this before sending proposals for consideration of DPCs.
