<p><strong>Subject: Clarification on regularization of absence during COVID–19 pandemic period.</strong></p>



<p>Madam/Sir,</p>



<p>This Department is in receipt of various references regarding regularization of absence of officers/officials of Department of Posts during lockdown / quarantine period, etc. The matter has been considered and with the approval of the competent authority, following clarification is issued for regularization of absence:</p>

<p>2. The leave sanctioning authority accordingly, after satisfying himself/herself, shall issue appropriate orders in respect of the quarantine period/absence of official / officer . In case the official / officer is not satisfied with the decision of the leave sanctioning authority he/she may prefer a representation to next higher authority. The next higher authority will decide the case within 15 days of receipt of representation.</p>



<p>3. These orders shall cover all the period of absence of an official / officer since imposition of first lockdown i.e. 24.03.2020 and shall be in force till further orders.</p>

<p>Subject:- <strong>Clarification on regularization of absence during COVID-19 pandemic lockdown period &#8211; regarding.</strong></p>



<p>This Department has been receiving several references requesting for clarification relating to the regularization of absence during the COVID-19 epidemic lockdown period.</p>



<ol class="wp-block-list" start="2"><li>In this regard, it is stated that this Department has already issued a clarification on regularization of absence during <strong><a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">COVID-19 </a></strong>lockdown period vide DoPT&#8217;s OM no. 14029/5/2020-Estt.(L)(pt.) dated 28.07.2020 (copy enclosed).</li><li>It is further clarified that this Department&#8217;s OM dated 28.07.2020 has been issued in view of the circumstances that the country is going through due to COVID-19 situations and the unavoidable problems faced by the Government employees in different sectors under the Government of India. A general terminology has been adopted to cover all kinds of problems faced by the employees due to the COVID-19 situation. The said OM may not touch all specific circumstantial problems faced by all employees under the Government of India; however, an interpretation of such circumstances in congruence with the clarification made in the above OM is adaptable.</li><li>Therefore, all Ministries / Departments may examine cases relating to regularization of absence during the COVID-19 lockdown period in the light of this Department&#8217;s <strong><a href="https://centralgovernmentnews.com/regularization-of-absence-during-covid-19-epidemic-lockdown-period-latest-dopt-order/" target="_blank" rel="noreferrer noopener">OM dated 28.07.2020</a></strong> referred to above and the guidelines issued by the Ministry of Health and Family Welfare and Ministry of Home Affairs from time to time.</li></ol>

<p><strong>Ref.: Railway Board’s letters No.(EG) 2020/LE 2/1 dated 06.08.2020 and 03.09.2020</strong></p>



<p>We are thankful to Railway Board for issuing instructions in the matter of treatment of absence during <strong><a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a></strong> epidemic lockdown.</p>



<p>Many of the employees have had to remain away from their work, subsequent to the lockdown, whose absence is pending regularization. Many of the employees were forced to remain under quarantine due to various situations, which can be classified broadly as follows:-</p>



<p><strong>(i) An employee was asked to remain in quarantine on return from outstation duty.<br />(ii) An employee remained in quarantine due to Central/ State Government instructions.<br />(iii) An employee was advised by <a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener">Railway</a> Medical Authority to remain in quarantine.<br />(iv) An employee who chose to remain in quarantine as a precaution.<br />(v) An employee who worked from home due to co-morbidity or underlying medical conditions as per Central/ State Government instructions.<br />(vi) An employee stayed at home as a precautionary measure and later found to be COVID-19 positive.</strong></p>

<p>It is, therefore, requested that, necessary instructions for treating absence of an employee during aforementioned situations, as “<strong>Special Casual Leave</strong>”, may kindly be issued at the earliest. Orders issued for maximum 30 days “Special Casual Leave” should also be cancelled as these being granted in special circumstances of COVID-19 epidemic where lockdown had been for more than four months and all sorts of transport had not been under operation.</p>

<h3 class="wp-block-heading">Sub: Interim Procedure Order on regularization of absence during COVID &#8211; 19 epidemic lockdown period.</h3>



<p>DOP&amp;T has issued a clarification vide their <strong>letter No.14029/5/2019-Estt (L)(Pt.2) dated 28/07/2020</strong> on regularization of absence during COVID-19 epidemic lockdown period for Central Government employees who proceeded on leave with station leave permission but could not report for duty due to non-availability of public transport/f lights and restrictions on inter/ intra state movement of persons as per Ministry of Home Affairs’ Orders from time to time, to contain the spread of <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a></strong> pandemic in the country. A copy of this letter has been circulated to Zonal Railways for compliance vide Board’s letter No. E(G) 2020/LE/2/1 dated 06/08/2020 (Copy enclosed).</p>



<p>It has been noticed that different Zonal <a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener">Railways</a> are following/adopting different procedure for regularization of absence of Railway employees during COVID-19 epidemic lockdown. In view of this, it has been decided to adopt a uniform interim procedure order over Indian Railways with a view to maintain and update leave records as per extant procedure. Therefore, it has been decided to regularize the absence during COVID-19 epidemic lockdown period as per following measures for only those situations which have not been covered w1der the above mentioned DOP&amp;T’s letter dated 28/07/2020 as an interim relief/measure till further clarification is received from DOP&amp;T.</p>

<p>Regularization of the above mentioned leave will require the counter signature of atleast JAG level officer. The ceiling of maximum Special Casual Leave may be limited to 30 days.</p>



<p>This issues with the concurrence of the Finance Directorate of Railway Board.</p>

<p><strong>Subject: Clarification on regularization of absence during COVID-19 lockdown period- reg.</strong></p>



<p>Please refer ISRO HQ Note/ letter No. HQ: ADMN: COVID:20 dated 20.04.2020 seeking clarification with regard to regularization of absence during <strong><a href="https://centralgovernmentnews.com/tag/covid-19/">COVID-19</a></strong> lockdown period imposed by the Government to contain the spread of Corona virus.</p>

<p>2. ISRO HQ proposal has been examined in the Department and following clarifications are issued:</p>

However, no DA to be paid.</td></tr><tr><td>2</td><td>Employees who were on leave prior to issue of lockdown orders (25.03.2020) and the leave ended during lockdown period. Employees available in Headquarters or not.</td><td>Deemed to have joined duty from the Date of expiry of leave.In case of leave on medical grounds, subject to production of fitness Certificate.</td></tr><tr><td>3</td><td>Employees who were on leave prior to issue of lockdown orders (25.03.2020) and the leave ended on 20.03.2020, but could not join duty on 23.03.2020 (Monday}, due to Stoppage of train/bus/flights.</td><td>Deemed to have joined on 25.03.2020, treating the period from 21.03.2020 to 24.03.2020 as leave. Employees shall submit leave application for this period to the concerned leave sanction authority.The absence during the lockdown period i.e. from 25/03/2020 to till lift-off of&nbsp; lockdown period, due to non-availability of public transport facility, shall be treated as Special Casual Leave as stipulated vide Cabinet Secretariat (Department of Personnel), O.M. No. 27/6/71-Estt. (B), dated 01.11.1971.</td></tr><tr><td>4</td><td>Employees who left HQ on week-end, i.e. 20.03.2020, but could not return to HQ on 23.03.2020 due to stoppage of Train/ buses/flights.</td><td>&#8211;</td></tr><tr><td>5</td><td>Employees who were on leave prior to issue of orders on lockdown (25.03.2020) and the leave expiring during the lock down period, but wish to curtail the leave before expiry and join duty.</td><td>Curtailment of sanctioned leave requires approval based on official exigency, which is not normally Envisaged during lock-down period. In some cases, officiating promotion may also have been given to the senior in the lower grade. Further, the offices remain closed, except for essential services. Hence, curtailment of leave may not be agreed to. From the date following the date of expiry of leave, the employee may be deemed to have joined duty, subject to fulfilment of other requirements based on the type of leave availed.</td></tr><tr><td>6</td><td>If an employee is unable to report for duty on lifting of lockdown, due to non-availability of public transport, restrictions on inter-zone/district movement etc.</td><td>May be allowed to work from home till such time public transport facility is restored subject to Government orders on movement of public transport.</td></tr></tbody></table></figure>



<p>3. The DOS/ ISRO Centres/ Units are requested to note the above clarifications for taking appropriate action, if any. <strong>Further, it is to inform that the above clarifications are subject to the clarifications issued by the Nodal Ministry, if any later. In case, the Nodal Ministry advice /clarifications differs from the clarifications issued by DOS, then clarifications issued by Nodal Ministry will prevail over the DOS clarifications.</strong></p>
