<p>(a) the steps taken by the Government to implement the Seventh Pay Commission recommendations for physiotherapists regarding cadre restructuring till date; </p>



<p>(b) the duties and responsibilities of physiotherapists employed at Safdarjung hospital, RML hospital, Kalawati Saran hospital, JIPMER and AIIMS; </p>



<p>(c) whether the physiotherapists at the above hospitals are being given Hospital Patient Care Allowance (HPCA); and </p>



<p>(d) if so, the details thereof and if not, the reasons therefor?</p>

<p>STATEMENT REFERRED TO IN REPLY TO LOK SABHA <br />
STARRED QUESTION NO.63* FOR 14TH DECEMBER, 2018</p>



<p>(a) As per decision of the Government on the recommendations of the 7th CPC notified vide Resolution dated 25.07.2016, necessary action on the recommendations of the 7th CPC pertaining to cadre restructuring of physiotherapists have already been taken up for implementation in some of the Central Government hospitals/institution.</p>



<p>(b) The duties and responsibilities of physiotherapists performed in Safdarjung hospital, RML hospital, Kalawati Saran hospital, Jawaharlal Institute of Post Graduate Medical Education and Research (JIPMER), Puducherry and All India Institute of Medical Sciences (AIIMS), New Delhi and six other new AIIMS located at Patna, Jodhpur, Bhubaneswar, Rishikesh, Bhopal, and Raipur broadly include the following:</p>



<ol class="wp-block-list"><li> physiotherapists works with patients who have a range of conditions including Neuro-musculoskeletal, Geriatric, Post-surgical, ICU Patients, Pediatric, Cardiovascular and respiratory. They help to diagnose, assess and treat their physical problems</li><li> treat in and out patients of Orthopedic, Neurological, Medical Surgery, Pediatrics and Gynecological, cardio-thoracic, respiratory &amp; intensive care condition by means of electrotherapy, heat therapy, hydrotherapy, exercise therapy and massage</li><li> provide physiotherapy care including exercise, hot packs, wax bath, short-wave-diathermy, ultrasonic therapy, cervical &amp; lumbar traction, gait training, electrical stimulation &amp; bed-side physiotherapy in ward as prescribed by the medical specialist, etc. </li><li> administer and supervise students and junior physiotherapists and other support workers, who are involved in physical care of patients.</li><li> participation in rehabilitation of patients </li><li> co-ordinate and participate in training programmes related to physiotherapist</li></ol>



<p>(c) &amp; (d) As per the guidelines issued from time to time for grant of Hospital Patient Care Allowance (HPCA), HPCA is admissible to employees belonging to categories of Group ‘C’ and ‘D’ (non-ministerial) whose regular duties involve continuous and routine contacts with patients infected with communicable diseases or those who have to routinely handle, as their primary duty, infected materials, instruments and equipment which can spread infection.</p>



<p>Hospital Patient Care Allowance (HPCA) is not being given to Physiotherapists in Safdarjung, Dr. RML, Lady Hardinge Medical College and Associated Hospitals and AIIMS, New Delhi and six new AIIMS located at different parts of the country as the physiotherapists working in these hospitals/institutes are Group ‘A’ and ‘B’ category employees. In Kalawati Saran Children Hospital, the physiotherapist are not getting HPCA as these employees are in the pay scale of Group ‘B’ category.</p>



<p>However, JIPMER, Puducherry continues to give Patient Care Allowance to physiotherapists as per the directions of Hon’ble Apex Court. These directions were issued consequent upon re-classification of Group ‘C’ category posts to Group ‘B’ posts based on the replacement scale as there was no change in the duties and responsibilities of the post held by the incumbents.</p>

<p>Sir,<br />
The Central Govt has implemented 7th Pay Commission recommendation regarding the hike in the pay, salary of the Central Govt employees, pensioners and family pensioners w.e.f January 1,2016 besides releasing 2 percent DA w.e.f July 1, 2016.</p>
<p>The J&amp;K Govt has also hiked the salary and perks of ministers, and legislators. Besides, our neighbouring states have also implemented 7th CPC recommendations in favour of their respective Govt PSU employees and pensioners etc.</p>
<p>But, it is unfortunate that the J&amp;K State Govt, PSU employees, pensioners and family pensioners who also deserve the hike in pay and pension have been asked to wait for two years for implementation of 7th CPC recommendations by none other than the present Chief Minister J&amp;K State. One fails to understand as to why the employees and the pensioners have to wait for two years for their due. Why does not the State raise the demand of money with the Central Govt for implementation of 7th CPC recommendations in favour of the State Govt employees, pensioners and family pensioners.</p>
<p>Any way, I hope that the J&amp;K State Govt will kindly realize that when they (legislators/ministers) themselves deserve the hike in salary; pay and perks of the State Govt, employees and pensioners also deserve and need it as well. Many Govt Employees and Pensioners Association have urged the J&amp;K State Govt for implementation of the 7th CPC recommendations including EJAC(Q) personally meeting the Chief Minister, Finance Minister J&amp;K State and through print and electronic media by the undersigned also but all in vain till date.</p>
<p>Therefore, it is requested to the Chief Minister, Finance Minister J&amp;K State not to wait for two years but to implement the 7th CPC recommendations in favour of the J&amp;K State Govt PSU/Employees and Pensioners at an earliest in toto/at par with the Central Government Employees.<br />

<p>New Delhi: The government on Saturday has notified revised pension of pre-2016 Defence Forces Pensioners on the recommendations of the 7th Pay Commission.</p>
<p>As per the order, for the pre January 1 pensioners, the revised pension w.e.f. January 1 shall be determined by multiplying the basic pension/basic family pension as had been drawn as on December 31 by 2.57 to arrive at revised pension under the seventh CPC.</p>
<p>The implementation of the 7th Pay Commission recommendation relating to methodology for calculation of disability element has been referred to the Anomaly Committee.</p>
<p>The disability element which was being paid to pre-2016 Defence Forces Pensioners as on December 31 will continue to be paid pending decision on the recommendations of the Anomaly Committee.</p>

<p><b> </b>New Delhi: In a bonanza for over 1 crore government employees and pensioners, the Cabinet today approved implementation of the 7th Pay Commission, which had recommended an overall hike of <strong><span style="color: #ff0000;">23.5 per cent</span></strong>.</p>
<p>&nbsp;</p>
<p>“Congratulations to central government officers, employees &amp; pensioners on a historic rise in their salary &amp; allowances through the 7th CPC (Central Pay Commission),” Finance Minister Arun Jaitley tweeted shortly after the meeting of the Cabinet headed by Prime Minister Narendra Modi.</p>
<p>&nbsp;</p>
<p>It wasn’t however know immediately if the Cabinet had bettered the hike recommended in salary and allowances of nearly 50 lakh government employees and 58 lakh pensioners.</p>
<p>&nbsp;</p>
<p>An official said the Cabinet has approved implementation of the recommendations from January 1, 2016.</p>
<p>The pay panel had in November last year recommended 14.27 per cent hike in basic pay at junior levels, the lowest in 70 years. The previous 6th Pay Commission had recommended a 20 per cent hike which the government doubled while implementing it in 2008.</p>
<p>&nbsp;</p>
<p>After considering the increase proposed in allowances, the hike in remunerations comes to 23.55 per cent.</p>
<p>The 23.55 per cent overall hike in salaries, allowances and pension would entail an additional burden of Rs 1.02 lakh crore or nearly 0.7 per cent of the GDP, to the exchequer.</p>
<p>&nbsp;</p>
<p>The entry level pay has been recommended to be raised to Rs 18,000 per month from current Rs 7,000 while the maximum pay, drawn by the Cabinet Secretary, has been fixed at Rs 2.5 lakh per month from current Rs 90,000.</p>
<p>&nbsp;</p>
<p>The secretaries’ panel may have recommended raising minimum entry level pay at Rs 23,500 a month and maximum salary of Rs 3.25 lakh.</p>
<p>&nbsp;</p>
<p>While the Budget for 2016-17 fiscal did not provide an explicit provision for implementation of the 7th Pay Commission, the government had said the once-in-a-decade pay hike for government employees has been built in as interim allocation for different ministries.</p>
<p>&nbsp;</p>
<p>Around Rs 70,000 crore has been provisioned for it, the official said.</p>

<p>1. Bharat Pensioners Samaj(BPS) Federation of pensioners’ associations, a conglomerate of over 628 pensioners’ organizations as an accredited Federation under the Government of India, had appealed to the Secretary, Ministry of personnel, Public Grievances and Pensions, on 16.2.2016 during the meeting on Aadhar seeding to hold a meeting of Pensioners Associations to discuss 7th CPS pension related recommendations, though he had agreed to hold such a meeting but it did not materialize.</p>
<p>2. Now BPS has come to know through NJCA News letter dated 27.5.2016 issued after their meeting with you on 26.5.2016that the Department of Pension is opposed to the first option recommended by the 7th CPC to bring about the parity with the past pensioners, as they consider it to be infeasible and impracticable (due to the non-availability of the requisite records)</p>
<p>3. It is hard to believe, how a department meant for the welfare of pensioners which helped pensioners to get better deal in earlier pay commissions could arrive at such a damaging and misleading decision without even consulting the stake holders.</p>
<p>4. Sir, Service record is a permanent one and if it to be destroyed, proper permission from the Competent Authority is to be obtained. In any case, service record of pensioners can always be reconstructed taking the details from various sources available with the department and the material collected from the Pensioner. This has been done in the past while implementing parity enunciated by fifth CPC and even while implementing modified parity of 6th CPC. It is also being done now implementing OROP. In this regard Your kind attention is also drawn to recent Bombay High court Nagpur judgement dated 09.03.2015 in case of Smt. Saija v. General Manager, Central Railway O.A.No. 2131 of 2011 (Bombay Bench at Nagpur)</p>

<p>New Delhi: The long wait for implementation of 7th Pay Commission recommendation will soon come to an end.</p>
<p>As per media reports, the new increased pay scale for all central government employees will be given from next month.</p>
<p>Meanwhile, the group of secretaries headed by Cabinet Secretary PK Sinha is all set to meet on June 11 to give final shape to the changes on 7th Pay Commission recommendation.</p>
<p>Government in January set up a high-powered panel headed by Cabinet Secretary P K Sinha to process the recommendations of the 7th Pay Commission which will have bearing on the remuneration of 47 lakh central government employees and 52 lakh pensioners.</p>
<p>The Empowered Committee of Secretaries will function as a Screening Committee to process the recommendations with regard to all relevant factors of the Commission in an expeditious detailed and holistic fashion.</p>
<p>The government had earlier stated that implementation of new pay scales recommended by the 7th Pay Commission is estimated to put an additional burden of Rs 1.02 lakh crore, or 0.7 percent of GDP, on the exchequer in 2016-17.</p>

<p><i>The 7th pay commission has recommended for Income Tax, Central Excise and Customs and Service Tax department which works under finance ministry, a grade pay of Rs.4600. However for CBI, IB, Delhi Police inspectors etc the recommended grade pay is Rs.4800. </i></p>
<p>On an average the Inspectors of various departments of finance ministry bring revenue to the Government to the tune of around 7000 crores in a year.</p>
<p>The Inspectors attached to the finance ministry are not happy with the 7th pay commission recommendations, however they are more furious that their voice has not been listened by their higher officials and by the empowered Committee of Secretaries as well. The agitated inspectors claim that since independence this will be the first time they will be drawing less salary than inspectors attached to other ministries, thanks to the 7th pay commission, they say.</p>
<p>The 7th pay commission has recommended only replacement scale for Income Tax, Central Excise and Customs and Service Tax department which works under finance ministry. In other words, 7th pay commission has proposed the revised pay only on the basis of their present grade pay which is Rs.4600 for these Officers. However for CBI, IB, and Delhi Police inspectors etc 7th pay Commission has recommended revised pay on the basis of upgraded grade pay of Rs.4800.  Presently, CBI, IB, and Delhi Inspectors are getting a grade pay of Rs. 4600 at par with Central Excise, Customs and Income Tax Inspectors.</p>
<p>Inspectors working under the Ministry of Finance feel that the 7th Pay Commission recommendations not only reduces their salary but also breaks their morale, because till date they have been treated equally with their ranks in other departments, however the 7th CPC recommendation makes them inferior, though in the same rank.</p>
<p>Ashok Kumar Knnojia, representing the Group B and Group C employees in the IT department said they are more pained by the response of their own higher officials than the 7th pay commission. He said, though the 7th pay commission did injustice to us, our own higher officials who should have raised the voice strongly lost in presenting our plight to the empowered Committee.</p>
<p>As per Mr. Ashok Kumar, they were unable to get an appointment to meet their own department secretary. After a big struggle he did meet him and expressed the plight of the inspectors, however Mr. Ashok said, till date there is no positive response.</p>
<p>There are more than 32,000 inspectors working in Income Tax, Central Excise and Customs and Service Tax department which comes under finance ministry.</p>

<p>The notification to put into effect the 7th pay commission recommendation will be issued after the completion of states assemblies’ poll process as the model code of conduct is currently in place, sources of Finance Ministry said on Wednesday.</p>
<p>The assemblies’ election of Tamil Nadu, West Bengal, Assam, Kerala and Puducherry states, which will be held from April 4 to May 16 and the counting of votes in the states will take place on May 19 but the model code of conduct will remain in place till May 21.</p>
<p>So, it is believed that the government will announce 7th pay commission award after the end of model code of conduct of states assemblies election.</p>
<p>The government doesn’t want to give any chance to the Opposition to deter its image in the polls and hence, sources, said that the announcement of the dates of the the model code of conduct of states polls seems to be the cut-off point for notification of the 7th pay commission award.<br />
The 7th pay commission recommendations will benefit 48 lakh central government employees and 52 lakh pensioners including dependents.</p>
<p>“The BJP led central government decided execution time of the pay commission’s proposals in April but the Empowered Committee of Secretaries headed by cabinet Secretary can’t sort out some anomalies of 7th pay commission recommendations like scrapping of advances, allowances and minimum pay before declaration of states Assemblies polls,” sources said.</p>
<p>Sources also said the Implementation cell of the Empowered Committee of Secretaries for the 7th pay commission recommendation in Finance Ministry works hard to send a summary of the pay commission implementation to PMO for its nod. After PMO’s nod, it would be placed before the cabinet for its nod through cabinet secretary.</p>
<p>Sources said the 7th Pay Commission recommendations implementation notification will be issued in June, after cabinet nod.</p>
<p>The 7th Pay Commission was set up by the UPA government in February 2014, The Commission headed by Justice A K Mathur submitted its 900-page final report to Finance Minister Arun Jaitley on February 19, recommending 23.55 per cent hike in salaries and allowances of Central government employees and pensioners.</p>
<p>The panel recommended a 14.27 per cent increase in basic pay, the lowest in 70 years. The previous 6th Pay Commission had recommended a 20 per cent hike, which the government doubled while implementing it in 2008.<br />
The 7th pay commission recommended fixing the highest basic salary at Rs 250,000 and the lowest at Rs 18,000and its increased the pay gap between the minimum and maximum from existing 1:12 to 1: 13.8</p>
<p>The government constitutes the Pay Commission almost every 10 years to revise the pay scale of its employees and pensioners, often these are adopted by states after some modifications. However, the 7th Pay Commission suggested to discontinue the practice of appointing pay commissions in future.</p>

<p>New Delhi: Seventh Pay Commission recommendation is a big challenge facing the central government to accept its.</p>

<p>All central government employees, officers, Unions and association protested against the Seventh Pay Commission recommendations and they demanded a re-look at the Seventh Pay Commission report.</p>
<p>The Confederation of Civil Service Associations (COSCA), representing thousands of officers of 20 civil services, including Indian Police Service (IPS), met finance minister Arun Jaitley early this month.</p>
<p>&nbsp;</p>
<p>The purpose of that meeting was to press their demand that the group of secretaries of revision pay panel report headed by cabinet secretary, which will examine the report before the Cabinet nod, must not be dominated by one service, read IAS.</p>
<p>&nbsp;</p>
<p>What they want is the removal of the edge that the IAS enjoys so far, something that was fiercely opposed by one member in the Pay Commission, thereby making it difficult for the government to draw a conclusion.</p>
<p>“The government can’t make the pill more bitter than it is. We expect the government instead to sweeten the Commission’s recommendations further,” says IRS officer Jayant Misra, who is also the convenor of COSCA.</p>
<p>&nbsp;</p>
<p>“We have also appealed to the finance minister and cabinet secretary that the the group of secretaries of revision pay panel report must not have more than 25 per cent members from one particular service so that the report can be examined objectively and impartially.”</p>
<p>&nbsp;</p>
<p>The Central Secretariat Service which is considered the backbone of the Central government ministries and the one that comprises over 12,000 employees, is planning a massive agitation in the coming week near North Block. They will protest against what they call an unfair treatment meted out by the Pay Commission because “some officers with vested interests” misled the Commission.</p>
<p>&nbsp;</p>
<p>The Trade unions also protested the Seventh Pay Commission recommendations and said the proposed hike was lowest in many decades and were not in sync with inflation.</p>
<p>&nbsp;</p>
<p>If the government decides to accept the Pay Commission recommendation as it is. The government will take a hit of Rs 39,100 crore on account of salary hikes and another Rs 29,300 crore from allowances. Of the allowances, a whopping Rs 17,200 crore will be on account of only one allowance — house rent.</p>
<p>&nbsp;</p>
<p>If the government delays implementing the Pay Commission report, it can save some allowances amount.</p>
<p>While the pay hike per se will be retrospective, with government servants getting arrears with effect from January 1, 2016 if the government accepts it as the effective date, the payment on account of allowances is prospective in nature.</p>
<p>&nbsp;</p>
<p>Money is, however, not the only challenge that the government has to cope with at this juncture.</p>
<p>&nbsp;</p>
<p>The bigger challenge is how to arrest the growing discontent among various layers of civil servants who are at loggerheads with each other. Whereas IPS, IRS, IIS among others want parity with IAS in terms of rank and pay, the next layer, the Central Secretariat Service, has its angst against their immediate superiors in the civil services hierarchy.</p>
<p>&nbsp;</p>
<p>“We are not in a tussle with the IAS. But many Group “A” services officers don’t want us to move up the ladder. We have taken the agitation path, as the Pay Commission did not even hear us out because of some officials with vested interests,” says Rakesh Kumar, general secretary of the Central Secretariat Service Forum.</p>
<p>&nbsp;</p>
<p>However, the Finance Ministry has set up a cell in the Expenditure Department headed by joint secretary R K Chaturvedi for a period of one year with effect from November 20, 2015 to implement the recommendations of the Seventh Pay Commission.</p>
