<p>Sub :- <strong>Revision of pension w.e.f. 1.1.2006 of Pre-2006 pensioners who retired from the 5th CPC scale of Rs. 6500-10500/- or equivalent pay scale in the earlier Pay Commission periods.</strong></p>



<p>Instructions have been issued vide this Department’s OM of even number dated 4.1.2019 that for the purpose of revision of pension/family pension w.e.f. 1.1.2006 under para 4.2 of the O.M. dated 1.9.2008, the Grade Pay of Rs. 4600/- may be considered as the corresponding Grade pay in the case of pre-2006 pensioners who retired/died in the 5th CPC scale of Rs. 6500-10500/- or equivalent pay scale in the earlier Pay Commission periods.</p>



<p>It was also provided that the revised pension w.c.f. 1,1.2006 in terms of para 4.2 of OM dated 1.9.2008, for the pre-2006 pensioners who retired from the pay scale of Rs, 6500-10500/- in the 5 th CPC or equivalent pay scales in the earlier Pay Commissions would be Rs. 8345/-.</p>



<p>The entries at serial number 13 in the annexure of this Department’s OM No. 38/37/08- P&amp;PW(A) dated 28.1.2013 were also revised accordingly.</p>



<p>2. This Department has issued concordance tables for revision of pension, w.e.f. 1.1.2016, of pre-2016 pensioners by notional fixation of pay in the 7th CPC vide this Departments OM dated 6.7.2017, Tables No.24 &amp; 25 in these concordance tables indicated the revised pension/family pension based on the corresponding 6th CPC grade pay of Rs. 4200/- in respect of pre-2006 pensioners/family pensioners who retired/died in the 5th CPC scale of 6500-10500/- or equivalent pay scale in the earlier Pay Commission periods.  Consequent on the decision to consider the Grade Pay of Rs. 4600/- as the corresponding Grade pay in the case of pre-2006 pensioners who retired/died in the 5th CPC scale of<strong> Rs. 6500-10500/-</strong> or equivalent pay scale in the earlier Pay Commission periods and based on the fitment tables provided by Ministry of Finance (Department of Expenditure), Tables No.24 &amp; 25 have been revised. Accordingly, revised concordance Tables No.24 &amp; 25 arc enclosed herewith.</p>



<p>3. All the Ministries/Departments are requested to revise pension/family pension w.e.f. 1.1.2016 in respect of pre-2006 pensioner family pensioners who retired/died in the 5th CPC scale of <strong>Rs. 6500-10500/- </strong>or equivalent pay scale in the earlier Pay Commission periods using the concordance tables enclosed herewith. The other provisions / instructions for revision of pension of pre-2016 pensioners, as contained in this Department’s OM of even number dated 12.5.2017 and 6.7.2017 will remain unchanged.</p>



<p>4. This issues with the approval of Ministry of Finance (Department of Expenditure) vide their OM No. 30-1/33(c)/ 2016-1.C./E.III,A dated 28.6.2019</p>

<span style="text-decoration: underline;">&#8211; BIG LOSS IN PENSION IF IT IS DENIED</span></strong></p>

<p align="left"><strong>M</strong><strong>ost of the Pre 2016 pensioners will suffer heavy loss in Revised Pension, if the</strong> <strong>Option 1 recommended by the Seventh CPC is denied to them.</strong></p>
<p align="left"><strong>It was after 20 years that 7</strong><strong>t</strong><strong>h </strong><strong>CPC recommended parity between past pensioners and those retiring after 1-1-2016 under Option 1    which means  consideration of increments earned while in service as detailed in Para 10.1.67 of  the Report. This objective of PARITY (Recommended by Commission after examining all factors in depth in Chapter 10) is fulfilled  only with  the  implementation  of  option  1  without  any  dilution/deviation.  Non implementation of option 1 on the plea of non availability of record in a few cases will have the following adverse effects:</strong></p>
<blockquote>
<p align="left"><strong>i)    Pre 2006 pensioners, in particular, who are victim of modified parity will suffer a much bigger loss compared to the post 2006 retirees because in their case the basic pension which is multiplied by 2.57 in the interim phase takes into accounts their increments before retirement. This aspect has been examined in the case of Pre &amp; Post S 19 pensioner as an example. From the Table 1 given below, it will be clear that  the  reduction  in  pension  for  post  2006  pensioner  is  of  a  uniform  small magnitude as compared to the loss increasing exponentially with each increment lost in case of pre 2006 pensioner. Similar is the case in other scales also</strong></p>
<p align="left"><strong>ii)  7</strong><strong>t</strong><strong>h   </strong><strong>CPC  has  considered  pre  2016  pensioners  as  one  homogeneous  group  (Para</strong><strong>10</strong><strong>.1.53 refers). It means that all pre 2016 pensioners have to be treated alike. But with denial of option 1, pre 2016 pensioners will get divided into two groups i.e. Pre</strong> <strong>20</strong><strong>0</strong><strong>6 and Post 2006 Pensioners &#8211; which violates the settled law of equality between the equals.</strong></p>
<p align="left"><strong>iii) In  many  cases,  Option  3  gives  much  lower  pension compared  to  option  1 recommended  by  7</strong><strong>t</strong><strong>h   </strong><strong>CPC.  This will  be  clear  from  Table  2  below.  Where  a comparison has been made between two options.</strong></p>

The loss in pension for post 2006 pensioners is in the range of Rs.1700 (from 1468 to a max of 2076 as per col. 6) only and is nearly constant , whereas for pre-2006 pensioners  the loss in pension increases  by almost Rs.1000/- for every one increment (<em>Refer cols. 6 &amp; 8</em>).<br />
3. For example, the loss suffered in pension of pre 2006 pensioner in losing 5 increments works out to 6868 as against 1710 for post 2006 pensioner.</strong><br />

<p>INTERPRETATION OF PROPOSED OPTION 3 FOR REVISED PENSION HOW FAR IS IT AN ALTERNATIVE TO OPTION 1 RECOMMENDED BY 7Tth CPC? By N. P. MOHAN, President, RSCWS</p>
<p>The most significant recommendation of 7th CPC is to bring parity between past pensioners with those retiring after 1-1-2016 (Para 10.1.67). A long standing demand of the pensioners, who have been the victim of Modified Parity in the last two decades from 1-1-1996 (5th CPC), has been addressed by the Commission The parity is sought to be achieved by the recommendation of Option 1 for revised pension which provides for consideration of increments earned in the last Level by a pensioner while in service. Recognizing the delay in checking record for ascertaining the increments for implementation of this option, revised pension in the interim phase was recommended to be fixed by multiplying the pension fixed after 6th CPC by MF of 2.57 (Option 2). This option has already been implemented.</p>
<p>While accepting the above recommendations, Govt. had constituted a 5 member Committee under the chairmanship of Secretary (Pension) to examine the feasibility of implementation of Option 1. The Committee in its meeting with JCM on 6th October has suggested an alternative option (Option 3) to overcome the difficulty of tracing record in some cases. It has been indicated in Para 5 of the minutes of the meeting “that the Committee has found that the alternative method of arriving at notional pay in Seventh CPC by applying formula for pay revision for serving employees in each Pay Commission and giving 50% of this as pension to be beneficial to all pensioners in comparison to the fitment method.”</p>
<p>Dispensation of revised pension under alternative Option 3 will depend on the decision of the Govt on the recommendations of this Committee. The impact of Option 3 as understood from the proposal of the Committee mentioned in above is reflected in the 3 tables indicating the revised pension.</p>
<p style="text-align: center;"><strong>EXAMPLE OF REVISED PENSION UNDER OPTIONS 1 &amp; 2 of 7th CPC &amp; OPTION 3 BASED ON NOTIONAL PAY IN SUCCESSIVE PAY COMMISSIONS</strong><br />

<p>A copy of Department of Pension and Pensioners Welfare (DOP&amp;PW)&#8217;s No.O.M. No.42/14/2016-P&amp;PW(G) dated 24th October 2016 on the above subject is enclosed for information and compliance. These instructions shall apply mutatis and mutandis on the Railways also. Rule 10 of of CCS (Commutation of Pension) Rules, 1981 corresponds to Rule 11 of Railway Services (Commutation of Pension) Rules, 1993 DOP&amp;PW’s O.M. dated 04.08.2016 referred to in the enclosed O.M., was adopted on Railways vide letter of even number dated 12.08.2016.</p>
<p>2. Since, DOP&amp;PW’s O.M. dated 04.08.2016 was circulated on Railways vide Board’s letter of even number dated 12.08.2016 the option mentioned in Para 3 of O.M. dated 24.10.2016 may be given to Railway employees who retired between the period 01.01.2016 and 12.08.2016.</p>

<p>Subject: <strong>Implementation of the recommendation of the 7th CPC &#8211; Option regarding commutation of additional amount of pension.</strong></p>
<p>The undersigned is directed to state that in pursuance of Government&#8217;s decision on recommendation of 7th Central Pay Commission, orders have been issued for revision of provisions regulating pension/gratuity/commutation of pension etc. vide this Department’s OM 38/37/2016-P&amp;PW(A) dated 04.08.2016. In para of the said OM, it has been mentioned that there will be no change in the provisions relating to commutation values, the limit upto which the pension can be commuted or the period after which the commuted pension is to be restored.</p>
<p>2. As per Rule 10 of CCS (Commutation of Pension) Rules, 1981, an applicant who has commuted a percentage of his final pension and after commutation his pension has been revised and enhanced retrospectively as a result of Government’s decision, the applicant shall be paid the difference between the commuted value determined with reference to enhanced pension and the commuted value already authorised. For the payment of difference, the applicant shall not be required to apply afresh.</p>
<p>3. References have been received in this Department that many pensioners who retired after 01.01.2016 and have drawn pension/commuted value of pension based on their pre-revised pay/pension do not wish to commute the pension which has become additionally commutable on revision of pay/pension on implementation of recommendations of 7th CPC. the matter has been examined in consultation with Ministry of Finance (Department of Expenditure), It has been decided that those pensioners who retired from 01.01.2016 till 04.08.2016 i.e. the date of issue of orders for revised pay/pension based on the recommendations of the 7th CPC may be given an option, in relaxation of Rule 10 of CCS (Commutation of Pension) Rules, 1981, not to commute the pension which has become additionally commutable on revision of pay/pension on implementation of recommendations of the 7th CPC. The Cases where the additional pension after 7th CPC has already been commuted will not be re-opened.</p>
<p>4. In their application to the employees of Indian Audit and Accounts Department, these orders issue in consultation with Comptroller and Auditor General of India.</p>
<p>5. This issues with the concurrence of Ministry of Finance, Department of Expenditure ID No.192/E.V/2016, dated 30.09.2016.</p>

<p>The 7th Pay Commission report has recommended an average 23.55% hike in salaries and allowances of Central government staff and the same is likely to be replicated in all the states too, except Puducherry where the same system as in Centre is already applicable – minimum pay set at Rs 18,000 per month and maximum pay at Rs 2,50,000 per month &#8211; recommended date of implementation: 01, January, 2016.</p>
<p>Here we provide all you ever wanted to know in 10 points on most crucial aspects of the 7th Pay Commission report:</p>
<blockquote><p><em><strong><span style="color: #008000;">1. 7th Pay Commission pension, pay scales, allowances &#8211; Minimum Pay: </span></strong></em></p>
<p>Based on the Dr Wallace Aykroyd formula (nutrition) , the minimum pay (salary) in government is recommended to be set at Rs 18,000 per month; Maximum Pay: Rs 2,25,000 per month for Apex Scale and Rs 2,50,000 per month for Cabinet Secretary and others presently at the same pay level. If passed, the salary hikes this report is recommending are likely to boost demand for consumer goods across the spectrum, even though it could also be inflationary. (Reuters)<br />
<span style="color: #008000;"><em><strong>2. 7th Pay Commission pension, pay scales, allowances &#8211; Advances: </strong></em></span></p>
<p>a. All non-interest bearing Advances have been abolished; b. Regarding interest-bearing Advances, only Personal Computer Advance and House Building Advance (HBA) have been retained. HBA ceiling has been increased to Rs 25 lakhs from the present Rs 7.5 lakhs. (PTI)</p>
<p><span style="color: #008000;"><em><strong>3. 7th Pay Commission pension, pay scales, allowances &#8211; Pension: </strong></em></span></p>
<p>The Commission recommends a revised pension formulation for civil employees including CAPF personnel as well as for Defence personnel, who have retired before 01.01.2016. This formulation will bring about parity between past pensioners and current retirees for the same length of service in the pay scale at the time of retirement. The 7th Pay Commission received many grievances relating to New Pension System (NPS). It has recommended a number of steps to improve the functioning of NPS. It has also recommended establishment of a strong grievance redressal mechanism. (PTI)<br />
<span style="color: #008000;"><em><strong>4. 7th Pay Commission pension, pay scales, allowances &#8211; Performance Related Pay: </strong></em></span></p>
<p>The Commission has recommended introduction of the Performance Related Pay (PRP) for all categories of Central Government employees, based on quality Results Framework Documents, reformed Annual Performance Appraisal Reports and some other broad Guidelines. The Commission has also recommended that the PRP should subsume the existing Bonus schemes. (PTI)<br />
<span style="color: #008000;"><em><strong>5. 7th Pay Commission pension, pay scales, allowances &#8211; New Pay Structure: </strong></em></span></p>
<p>Considering the issues raised regarding the Grade Pay structure and with a view to bring in greater transparency, the present system of pay bands and grade pay has been dispensed with and a new pay matrix has been designed. Grade Pay has been subsumed in the pay matrix. The status of the employee, hitherto determined by grade pay, will now be determined by the level in the pay matrix. The rate of Annual Increment is being retained at 3 percent. (PTI)<br />
<span style="color: #008000;"><em><strong>6. 7th Pay Commission pension, pay scales, allowances &#8211; Modified Assured Career Progression (MACP): </strong></em></span></p>
<p>a. Performance benchmarks for MACP have been made more stringent from “Good” to “Very Good”; b. The Commission has also proposed that annual increments not be granted in the case of those employees who are not able to meet the benchmark either for MACP or for a regular promotion in the first 20 years of their service; c. <p><span style="color: #008000;"><em><strong>7. 7th Pay Commission pension, pay scales, allowances &#8211; Military Service Pay (MSP): </strong></em></span></p>
<p>The Military Service Pay, which is a compensation for the various aspects of military service, will be admissible to the Defence forces personnel only. As before, Military Service Pay will be payable to all ranks up to and inclusive of Brigadiers and their equivalents. The current MSP per month and the revised rates recommended are as follows: (Reuters)<br />
<span style="color: #008000;"><em><strong>8. 7th Pay Commission pension, pay scales, allowances &#8211; Short Service Commissioned Officers: </strong></em></span></p>
<p>Short Service Commissioned Officers will be allowed to exit the Armed Forces at any point in time between 7 and 10 years of service, with a terminal gratuity equivalent of 10.5 months of reckonable emoluments. The Seventh Pay Commission also says they will further be entitled to a fully funded one year Executive Programme or a M.Tech. programme at a premier Institute to better their prospects in later life. <span style="color: #008000;"><em><strong>9. 7th Pay Commission pension, pay scales, allowances &#8211; Allowances: </strong></em></span></p>
<p>The Commission has recommended abolishing 52 allowances altogether. Another 36 allowances have been abolished as separate identities, but subsumed either in an existing allowance or in newly proposed allowances. Allowances relating to Risk and Hardship will be governed by the proposed Risk and Hardship Matrix. a. Risk and Hardship Allowance: Allowances relating to Risk and Hardship will be governed by the newly proposed nine-cell Risk and Hardship Matrix, with one extra cell at the top, viz., RH-Max to include Siachen Allowance. <span style="color: #008000;"><em><strong>10. 7th Pay Commission pension, pay scales, allowances – Financial Implications: </strong></em></span></p>
<p>The total financial impact in the FY 2016-17 is likely to be Rs 1,02,100 crore, over the expenditure as per the “Business As Usual” scenario. Of this, the increase in pay would be Rs 39,100 crore, increase in allowances would be Rs 29,300 crore and increase in pension would be Rs 33,700 crore. In percentage terms the overall increase in pay &amp; allowances and pensions over the “Business As Usual” scenario will be 23.55 percent. <p>Now, we have attempted to estimate 7th Pay Commission Pension for Central Government Pensioners and Railway Pensioners on the basis of 6th CPC Pension Fixation. Pensioners may please note that this is only an approximate estimation of pension based on the factors taken into account by Government while implementing 6th Pay Commission. So, if 7th Pay Commission adopts different set of principles for determining 7th Pay Commission pension then this estimation may not be correct. Also, due to non-availability of fitment table for 7th Pay Commission Pay revision as of now, 50% of minimum of 7th CPC pay band equivalent to pay scale in which pensioner retired which will be assured by every pay commission could not be calculated.</p>

<p>Government issued Office Memorandum F.No.38/37/08-P&amp;PW(A) dated 01.09.2008 (Click here to read this OM), for implementing 6th CPC recommendations on revised Pension for Pre-2006 Pensioners and Family Pensioners. As per this OM, revised pension / Family Pension with effect from 01.01.2006 is worked out by adding together:</p>

<p>In addition to the above pension fixation method, as per Para 2 and 3 of OM F.No.38/37/08-P&amp;PW(A) dated 28.01.2013, Pension has to be stepped up to 50% of the sum of minimum of the pay in the pay band plus the grade pay corresponding to the pre-revised pay scale from which the pensioner had retired as arrived at with reference to the fitment tables given in OM No.1/1/2008-IC dated 30th August 2008 (Fitment Table applicable to Central Government Employees for 6CPC revision)</p>
