<h3 class="wp-block-heading">Sub: Drawing Transport Allowance in r/o Officers who are drawing pay in Levels 14 and above of 7 CPC &#8211; reg.</h3>



<p>Ref: GOI, M/o Finance, Department of Expenditure’s OM No. 21/5/2017-E-II(B) dated 07/07/2017.</p>



<p>With reference to the subject cited above, it is intimated that monthly Transport Allowance is being drawn by some of the officers, who are drawing pay in Levels 14 and above in the 7 CPC pay matrix and who are entitled to the use of the official car. But, as per para (iv) of the OM mentioned under reference &#8211; </p>



<ul class="wp-block-list"><li>(iv) Officers drawing pay in Levels 14 and above in the Pay Matrix, who are entitled to the use of official car in terms of Department of Expenditure’s O.M. No.20(5)-E.II(A)/93 dated 28.01.1994, shall be given the option to avail the official car facility or to draw Transport Allowance at the rates of Rs.15,750/- p.m. plus Dearness Allowance thereon. Before, allowing Transport Allowance @ Rs.15,750/- plus D.A. thereon, the option exercised by an officer will be examined by the administrative Ministry and his/her entitlement to the use of official car in terms of the O.M. dated 28.01.1994 ibid will require to be certified by the competent authority. In case, an officer opts to draw Transport Allowance @Rs.15,750/- p.m. plus D.A. thereon, he/she will not be allowed to change his/her option during the remaining period of his/her current assignment.</li></ul>



<p>In this regard, it is intimated that necessary certificate may be obtained in r/o the officers who are working under the jurisdiction of your office and copies of the same may please be forwarded to this office for further necessary action while processing the salary bills.</p>

<h3 class="wp-block-heading">Sub: Grant of Transport Allowance @Rs.7000/- pm + DA thereon to the IRMS Officers drawing Grade Pay of Rs.10000 (now Pay Level-14) under DACP Scheme.</h3>



<p>Attention is invited to the Board’s letter of even number dated 21/08/2019 (RBE No. 138/2019) whereby Board’s decision regarding the entitlement of Transport Allowance at the higher rate of Rs.7000/- pm + DA thereon (revised to Rs.15750/- pm + DA thereon based on the recommendations of 7th CPC) to IRMS Officers drawing Grade Pay of Rs.10000 (now Pay Level-14) has been communicated. As per the said decision IRMS Officers drawing Grade Pay of Rs.10000 (now Pay Level-14) under DACPS except those who are holding pinpointed administrative SAG posts mentioned in the Board’s (Health Date.) letter dated 26.02.2009, are not entitled to use the official car in terms of Board’s letter No. E(G)95AL4-9 dated 06/11/1995, and thus, would not be eligible to opt for the higher rate of Transport Allowance @ Rs.7000/- pm + DA thereon (which now stands revised to Rs.15750/- pm + DA thereon based on the recommendations of 7th CPC).</p>



<p>2. Consequent to the Board’s above decision the issue of recovery of the excess payment against Transport Allowance from such ineligible IRMS Officers has since been under examination and the Board has decided to recover the excess payment from such IRMS Officers who have not been found eligible for Transport Allowance at the higher rate.</p>



<p>3. This has the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<h3 class="wp-block-heading">Sub: Payment of Transport Allowance to Railway Employees working from home for entire calendar month(s) in view of COVID-19 Pandemic.</h3>



<p>References have been received in Board’s office secking clarification from Railways on the above mentioned subject. The matter has been considered in Board’s office and it has been decided that Transport Allowance is not admissible to such employees in terms of clarification No. 1 of Annexure-II issued vide Board’s letter dated 24-11-2003 (RBE No. 203/2003). This provision stipulates as under:</p>



<p><em>&#8221; if a Government servant is absent form Headquarters/ place of posting for a full calendar month, he will not be entitled to any Transport Allowance during that calendar month….&#8221;</em></p>



<p>Transport allowance in respect of such employees may be regulated accordingly..</p>

<p>Attention is invited to Board’s letter of even number dated 25-08-2015 whereby Railways were advised to keep in abeyance the payment of Transport Allowance @ Rs.7000/-p.m. + DA thereon to IRMS officers drawing Grade Pay of Rs.10,000/- under DACP Scheme. Subsequently, as per the interim order dated 27-10-2015 of Hon’ble CAT/New Delhi in O.A No.3528/2015, Railways were advised vide this office letter of even number dated 06-11-2015 that the payment of Transport Allowance to IRMS officers @Rs.7000/-p.m. + DA thereon, be continued till further orders.</p>



<p>2. The Hon’ble CAT/ New Delhi vide order dated 28-05-2019 has now disposed of the said O.A No. 3528/2015 has observed as under :-</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>&#8220;The OA is, therefore, disposed of directing the respondents to take a final decision regarding extension or otherwise of the Transport Allowance at the rate of Rs: 7000/- per month plus DA, to the members of the applicant Association, within a period of three months from the receipt of this order. However, the amount already paid towards the said allowance shall not be recovered, and the respondents shall not be under an obligation to pay the said allowance until a final decision is taken. There shall be no orders as to costs.&#8221;</p></blockquote>



<p>3. The matter has been accordingly considered by the competent authority and in view of fact that IRMS officers drawing Grade Pay of Rs.10,000/- (now pay level -14) under DACPS except those who are holding pinpointed administrative SAG posts mentioned in Board’s letter No.2009/H/16/1DACP dated 26-02-2009, are not entitled for use of official car in terms of Board’s letter No.E(G)95AL4-9, dated 06-11-1995, it has been decided that such officer shall not be eligible to opt for higher rate of Transport Allowance @Rs.7000/- p.m.+DA thereon (which now stands revised to Rs.15750/- p.m.+DA thereon based on the recommendations of the 7th CPC). These officers are entitled for Transport Allowance @Rs.7200/3600 + D.A thereon as per row- 2 of Board’s letter of even number dated 3-8-2017.</p>

<p>Subject: <strong>Transport Allowance at double the normal rates to persons with disabilities employed in Central Government.</strong></p>
<p>References have been received in this Department seeking clarification whether Transport Allowance at double the normal rate is admissible to persons with disabilities employed in Central Government who have been provided with Government Accommodation within one km. of office or within the campus housing the place of work and residence.</p>
<p>2. The matter has been considered in this Department and it clarified that persons with disabilities employed in Central Government, as mentioned in Para 2(iii) of 0M No.21/5/2017-EII(B) dated 07.07.2017 regarding grant of Transport Allowance as 7th CPC rates, are eligible to draw Transport Allowance at double the normal rates + DA thereon, irrespective of whether they are residing within the campus &#8211; housing the place of work and residence or Govt. or private accommodation within one km. of office.</p>
<p>3. All other terms and conditions regulating the Transport Allowance at double the normal rates will remain the same.</p>
<p>4. This is issued with the approval of Secretary (Expenditure).</p>

<p>Sub: Government’s decision on recommendation of the 7th Central Pay Commission – Transport Allowance to the Railway employees – Deprival of higher rate to those working in pay Level 1 &amp; 2 – reg.<br />
Ref: (i) Railways Board’s letter No. PC-V/2017/A/TA/1 dated 17/08/2017 (RBE No. 96/2017)<br />
(ii) NFIR’s Letter No. IV/NFIR/7 CPC/Allowance/2016/ Part I dated 28/08/2017.<br />
(iii) Railway Board’s letter No. PC-V/2015/PNM/NFIR/4 dated 17/20-11-2017.<br />
(iv) NFIR’s letter No. IV/NFIR/7 CPC (Imp)/ Allowance/2016/Part I dated 05/04/2018.</p>
<p>Kind attention of Railway Board is invited to the references cited above.</p>
<p>NFIR reiterates that pursuant to issuance of instructions dated 17/08/2017, situation has arisent wherein the Railway employees in Pay Level 3, drawing pay Rs. 21,700/- and above and also upto Pay Level 8 hitherto entitled for Transport Allowance @ Rs. 3600 + DA thereon (in A1/A class cities and in other cities @ Rs 1800 + DA thereon) have been deprived of the said rate (due to the new norm for entitlement)</p>
<p>In this context, Federation furnishes below the rates granted pursuant to acceptance of the recommendations of the 5th CPC and 6th CPC:-<br />
(a) Recommendations of 5th CPC – Transport Allowance<br />

<p>From the above, it could be seen that those in pay scale below Rs.6500-10500 i.e. upto Rs. 6000-9800 (S1 to S10A) were allowed Transport Allowance at the uniform rate of Rs. 100/- p.m. in A1/A class cities irrespective of their pay.<br />
(b) After introduction of 6th CPC Pay Band/Grade Pay, the Railway Board vide circular (RBE No. 111/2008 – effective from 01/09/2008 and RBE No. 95/2015) had prescribed following rates for payment of Transport Allowance to the employees.</p>

<p>A comparison of two tables mentioned above, reveals that Railway employees were allowed higher rate of Transport Allowance on their drawing pay Rs. 7440/- irrespective of Grade Pay/Pay Band. However, the modified Board’s instructions issued vide letter dated 03/08/2017 and 17/08/2017,have deprived the Transport Allowance @ Rs. 3600+DA thereon to those in Pay Level 1 and 2 (7th CPC) due to imposition of restriction i.e. reaching the pay Rs. 24700/- Federation, therefore requests the Railway Ministry to kindly refer the matter to Ministry of Finance, for mitigating the problem.</p>

(ii) NFIR&#8217;s letter No.IV/NFIR/7CPC/Allowance/2016/Part I dated 28/08/2017.<br />
(iii) Railway Board&#8217;s letter No.PC-V/2015/PNM/NFIR/4 dated 17/20-1l-2017.</p>
<p>Federation does not agree with the view taken by the Railway Ministry in this case as conveyed to NFIR vide Board&#8217;s letter dated 17/20-11-2017. Federation wants that the Railway Ministry should prepare proper case based on the facts and contentions of NFIR as explained in our letter dated 28/08/2017 tobe placed before DoP&amp;T/MoF.</p>
<ol>
<li>Federation reiterates that as a result of issuance of instructions dated 17/08/2017, a situation has arisen wherein the Railway employees in Pay Level 3, drawing pay Rs. 21,700/- and above upto Level 8 hitherto entitled for Transport Allowance @ Rs. 3600 + DA thereon (in A1/A class cities and in other cities @ Rs.1800 + DA thereon) have been deprived of the said rate due to the new norm for entitlement only when their pay reaches Rs.24,2001/-.</li>
</ol>
<p>III. Further it is relevant to take note that pursuant to acceptance of the recommendations of 5th CPC and 6th CPC, the rates revised as follows:-</p>
<p>(a) Recommendations of 5th CPC &#8211; Transport Allowance RBE No. 179/1997 (rates w.e.f. 01/08/1997)</p>

<li>From the comparison of two tables mentioned above, it could be seen that the Railway employees were allowed higher rate of Transport Allowance on drawing pay Rs. 7440/- irrespective of Grade Pay/Pay Band. The modified Board&#8217;s instructions issued vide letter dated 03/08/2017 and I7/08/2017, have deprived the Transport Allowance @ Rs. 3600+DA thereon to those in Pay Level 1 and 2 (7th CPC) due to imposition of restriction i.e. reaching the pay Rs.24700/- ignoring the fact that the staff were already drawing pay @ Rs.7440 in 6th CPC Pay Band/Grade Pay.</li>
</ol>
<p>Federation, therefore requests the Railway Ministry to kindly anange to make out case in the light of NFIR&#8217;s contentions for rendering justice to those staff of Pay Level 1 &amp; 2 for granting Transport Allowance at rate i.e. 3600/- + DA thereon when they reach the corresponding pay @ Rs.21700/- and not 24200/- to meet the ends of justice and refer to MoF.</p>
<p>A copy of the reference made to the MoF may be endorsed to the Federation for taking follow up action.</p>

<p><strong>Existing Provisions:</strong> Granted to cover the expenditure involved in commuting between place of residence and place of duty. The existing rates are as under:</p>

<p>Officers drawing GP 10000 and higher, who are entitled to the use of official car, have the option to avail of the existing facility or to draw TPTA @ Rs.7000 + DA.</p>
<p>&nbsp;</p>
<p>Differently abled employees are granted TPTA at double rates subject to a minimum of Rs.1000+DA.</p>
<p><strong> </strong></p>
<p><strong>Recommendations of 7th CPC:</strong> Transport Allowance is already fully DA indexed. Therefore, following rates of Transport Allowance are recommended:</p>

<p>Officers in Pay Level 14 and higher, who are entitled to the use of official car, will have the option to avail themselves of the existing facility or to draw the TPTA at the rate of Rs.15,750+DA pm.</p>
<p>Differently abled employees will continue to be paid at double rate, subject to a minimum of Rs.2,250 plus DA.</p>

<p><strong>Demands:</strong><br />
<strong>I. National Council (Staff Side), JCM:</strong></p>
<p><strong> </strong></p>
<p><strong>i. There should be only two levels for Transport Allowance, as under:</strong><br />
<strong>Level 9 and above</strong><br />
<strong>Rs.7500+DA (Higher TPTA Cities)</strong><br />
<strong>Rs.3750 + DA (Other Places</strong><br />
<strong>Below Level 9</strong><br />
<strong>Rs.3750+DA (Higher TPTA Cities)</strong><br />
<strong>Rs.1875 + DA (Other Places)</strong></p>
<p><strong> </strong></p>
<p><strong>ii. Income Tax exemption, which was available for Transport Allowance, may be reintroduced.</strong></p>
<p><strong> </strong></p>
<p>II. Ministry of Health and Family Welfare: SAG Doctors should be paid Transport Allowance at the rates admissible to Joint Secretary in lieu of Staff Car.</p>
<p>&nbsp;</p>
<p>Analysis and Recommendations of the Committee: The Committee notes that the Transport Allowance is fully indexed to Dearness Allowance and the rates have accordingly been revised by the 7th CPC. As the demands do not relate to any changes recommended by the 7th CPC, the recommendations of the 7th CPC on Transport Allowance may be accepted without any change.</p>
<p>&nbsp;</p>
<p>When this allowance was introduced by 5th CPC, the entire amount was exempted from Income Tax. However, the Committee is not making any recommendations relating to raising of Income Tax ceiling on Transport Allowance as it is not within the purview of the Committee. The matter may be taken up separately with Department of Revenue.</p>

<h3>7th CPC Transport Allowance 7440 issue settled for Matrix Level 1 and 2 (Grade Pay 1800 and 1900)</h3>
<p><i><b>Department of Expenditure issued an important amendment order regarding Transport Allowance on 2nd August, 2017. Central Government employees who are drawing pay of 24200 and above in Pay Level 1 and 2 of the Pay Matrix, shall be eligible for grant of Transport Allowance 3600 for TPTA Cities and 1800 for all Other Places.</b></i></p>
<p><i><b>The Central Government employees those who were in Grade Pay 1800 and 1900 and their pay in the pay band equivalent to 7440 and above eligible for higher Transport Allowance.</b></i></p>

Sub: <strong>Transport Allowance to Railway Employees &#8211; reg.</strong></p>
<p>Ref: Ministry of Finance (Department of Expenditure) O.M. No.2115/2017-E III(B)<br />
dated 71712017 &amp; 210812017 .</p>
<p>In the Standing Committee Meeting of NC/JCM held at North Block, New Delhi on 2l/0712017, chaired by the Addl: Secretary (Expenditure), the Federation has pointed out the erroneous decision of the Government, reducing the existing entitlement rates of Transport Allowance to those staff in pay level 1 and 2 of the pay matrix and urged to rectify the same immediately.</p>
<p>Responding to the point raised by NFIR, the Ministry. of Finance. (Department of Expenditure) has since issued O.M. No.2115/2017-E.II(B) dated 2nd August,2017 that employees who are drawing pay of Rs.24200/- and above in pay level 1 &amp; 2 of the pay matrix shall be eligible for payment of Transport Allowance at Rs.3600/- plus D.A., thereon at the cities mentioned in the Annexure to the O.M. of even no. dated 07/07/2017 and at Rs.1800/- plus D.A. thereon at all other places with effect from 01/07/2017.</p>
<p>In the light of the MoF&#8217;s O.M., dated 02/08/2017, NFIR requests the Railway Board to issue corresponding orders immediately, duly endorsing copy to the Federation.</p>
