<p><strong>Payment of 7th CPC Leave Salary to the Running Staff  &#8211; Railway Employees NFIR</strong></p>

<p>Subject: <strong>Payment of Leave Salary to the Running Staff after implementation of 7th CPC recommendations-reg.</strong></p>



<p>Ref: (i) NFIR’s PNM Items No. 47/2018 &amp; 57/2016.<br />
(ii) Railway Board’s letter No. E(P&amp;A)II/2017/RS-22 dated 28/12/2018 (RBE No.2204/2018).<br />
(iii) NFIR’s letter No. IV/NFIR/7th CPC (Imp)/Allowance/2016/Part II dated 12/01/2019, 18/03/2019, 28/05/2019 &amp; 17/08/2019.</p>



<p>Federation invites kind attention of the Railway Board to the references cited above relating to payment of Leave Salary to the Running Staff pursuant to the implementation of the recommendations of <a rel="noreferrer noopener" aria-label="7th Central Pay Commission (opens in a new tab)" href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank">7th Central Pay Commission</a>. Federation once again reiterates that though the Railway Board have issued orders vide RBE No. 204/2018 dated 28/12/2018 but, however, there is no clarity in the said orders regarding date of effect i.e. from 01/01/2016, consequently in the provision in IPAS, date of effect has been taken as 01/07/2017 and the Running Staff have been put to recurring financial loss for 18 months (from 01/01/2016 to 30/06/2017) leave salary. Though the Federation has been making efforts to persuade the Railway Board to set right the technical snag but however action to correct/up-date IPAS has no been taken yet with the result Federation continues to receive grievances from the Running Staff from Zonal Railways.</p>

<p>NFIR, therefore, once again urges upon the <a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener" aria-label="Railway (opens in a new tab)">Railway</a> Board to kindly intervene and issue suitable instructions to all concerned to rectify/up-date the IPAS giving effect to the instructions vide RBE No. 204/2018 dated 28/12/2018 from 01/01/2016 repeat from 01/01/2016 and not from 01/07/2017.</p>

<p>During discussions with the Financial Commissioner (Railways) at Rail Bhavan,  New Delhi, following pending issues were brought to her notice by NFIR for taking immediate action:-</p>

<ul class="wp-block-list"><li>Payment of Special Allowance to Stock Verifiers who were posted from the cadre of JAA on passing Appendix IV A (IREM Examination) &#8211; NFIR&#8217;s PNM Item No. 22/2012</li><li>Grant of one time relaxation for promotion against DR quota Vacancies of Accounts clerks to the eligible erstwhile Group &#8216;D&#8217; staff of Accounts Department &#8211; NFIR PNM Item No. 30/2012.</li><li>Implementation of commitment given to the Federation on NFIR&#8217;s PNM Item No. 15/2013 during separate meeting held with the Member Staff and FC for granting stepping up of pay to the SSOs (Accounts) w.e.f. 01/01/2006 at par with their Junior (non-qualified)</li><li>Implementation of 7th CPC recommendations for grant of GP 5400 to SSOs w.e.f. 01/01/2016. Correspondence between Railway Ministry and DoP&amp;T/ MoF and back references continued &#8211; Accounts staff disappointed over abnormal delay.</li></ul>



<p>After discussion on the above, FC has assured to take action on each item for quick finalization. She also assured to discuss with MoF /DoP&amp;T on items (iii) and (iv).</p>



<p>The Federation also met Member Staff today at 9th December, 2019 and explained the necessity to take personal initiative for securing clearance for upgradation of 75% posts of Supervisors to GP 4800/Pay Level-8. Member Staff has assured to personally pursue even by reaching North Block (DoP&amp;T/MoF).</p>

<p>2.Despite reminders, this Department has received comments only from 26 Ministries/Departments which are &#8211; M/o Panchayati Raj, D/o Public Enterprises, Cabinet Secretariat, D/o Atomic Energy, D/o Agriculture and Cooperation, Inter-State Council Secretariat &#8211; MHA, D/o Justice, DARPG, D/o Chemicals &amp; Petrochemicals, D/o Food &amp; Public Administration, M/o Petroleum &amp; Natural Gas, M/o External Affairs, D/o Rural Development, M/o Housing Urban Affairs, Secretariat of Vice- President, D/o Biotechnology, PMO, M/o Tribal Affairs, D/o Fertilizers, M/o Culture, M/o MSME, D/o Expenditure, M/o Earth Sciences, D/o Defence, D/o Space and Railway Board. </p>



<p>3.It is requested that the aforesaid data may be furnished to this Department in the format prescribed in O.M dt. 07.03.2018 (copy enclosed) at the earliest. <p>Copies of Federation&#8217;s letter dated 12/01/2019 &amp; 18/03/2019 are enclosed wherein following specific points have been mentioned:- </p>



<ul class="wp-block-list"><li>Instructions issued vide RBE No. 20412018 dated 21/12/2018 do not contain the relevant provision made in Para 3.23 (b) of Board&#8217;s letter No. E(P&amp;A)II-80/RS-10 dated 17/07/1981 which have not been incorporated.</li><li>Board&#8217;s instructions contained in Para 2 of RBE No. 204/2018 dated 28/12/2018 are not being complied with on many Zones/Divisions with retrospective effect i.e.01/01/2016 due to Technical problems being faced in IPAS which has failed to accept amendments from back date.</li></ul>



<p>NFIR, therefore, once again requests the Railway Board to kindly issue modified instructions to RBE No. 204/018 so that the remaining portion of Board&#8217;s earlier order dated 17/07/1981 also finds place in the<br /> instructions and at the same time payments are made to the Running Staff from retrospective effect i.e.01/01/2016 duly updating the IPAS. Action taken in the matter may kindly be apprised to the Federation.</p>

<p>Subject: <strong>Pay fixation of SCS/Non-SCS officers promoted to IAS subsequent to the implementation of 7th CPC recommendations-reg.</strong></p>



<p>Sir/Madam.</p>



<p>In supersession of this Department&#8217;s letter of even number dated the 7th April, 2017 on the above mentioned subject, I am directed to say that the initial pay of a promoted officer or an officer appointed by selection as the case may be shall be fixed at the stage of the senior scale next above his actual pay. There is no provision of increment at the stage of initial fixation.</p>



<p>Rule 5(6) of lAS (Pay) Rules, 2016 provides for the fixation of pay of a Member of Service on promotion to Selection Grade (Level-13) of Pay Matrix by adding one increment in the Level- 12 of Pay Matrix and two additional increments in the Level 13 to which he is promoted. Rule 5(5) of lAS (Pay) Rules, 2016 provides that the pay of a member of the Service in the Senior Time Scale shall, on promotion to the Junior Administrative Grade he fixed in Level 12 of the Pay Matrix.</p>



<p>in respect of fixation of pay of officers who were promoted/Selected in lAS through SCS/Non-SCS respectively in Senior Time Scale/Junior Administrative Grade after 01.01.2016, the initial pay shall be fixed in the respective level of the Senior Scale i.e Level 11,12 01. 13 based on the year of allotment in the lAS. However, the pay drawn in the State Civil Services will be protected in the concerned Level. An illustration is as under: </p>



<p><strong>Shri X who is drawing pay at Rs. 48920 (Rs.40220 [pay in the pay band + GP Rs.8700] is promoted/selected to lAS on 04.03.2016. lie is allotted 2010 batch. The pay on promotion/selection to lAS would be as under:</strong></p>

<p>4. The pay of IAS officers who were promoted/selected in IAS through SCS/Non-SCS respectively prior to 01.01.2016 will be converted as per 7th CPC on 01.01.2016 and they shall  notionally in the Level of Pay Matrix, in accordance with the length of service as per their allotment year, at the stage of the senior scale. On their actual promotion to JAG/Selection Grade, the pay of these officers will then be fixed as per IAS (Pay) Rules, 2016. That is, the officers will be eligible for two additional increments on their actual promotions to Level 12/ Level 13 after completion of 9/13 years of service in IAS respectively. An Illustration is as under: </p>

<p>The provision contained in part (7) of Schedule-I of AS (Pay) Rules, 2016, which provides that &#8216;Notwithstanding anything contained in these rules, the pay of a promoted officer or an officer  appointed by selection, as the case may be, shall not at any time exceed the basic pay which he would have drawn as a direct recruit on that date if he had been appointed to the Indian Administrative Service on the date on which he was appointed to the State Civil Service or in a Gazetted post in the non-State Civil Service, after attaining the age of twenty five years, as the case may be&#8221; shall be adhered to. </p>

<p>Sub:- <strong>Payment of leave salary to the running staff after the implementation of 7th CPC recommendations.</strong></p>
<p>Some of the Zonal Railways have raised the issue that leave salary is not being paid to the running staff on the revised pay in the 7th CPC pay structure, GS/AIRF and GS/NFIR have also made various references to the Railway Board in this regard. NFIR has also raised the issue in the forum of PNM as Item No. 47/2018.</p>
<p>2. The issue has been examined in Board&#8217;s office and it is clarified that as per Rule 1412(III) of IREC Vol. II and Rule 924(i)(k) of IREM-I, Pay Element (presently 30% until further orders) will be reckoned for calculation of Leave Salary of Running Staff on the revised basic pay in the 7th CPC pay structure.</p>
<p>3. This issues with the concurrence of the Finance Directorate of Railway Board.</p>

<p align="center"><strong>NOTIFICATION</strong></p>
<p align="right">New Delhi, the 11th December, 2018</p>
<p><strong>G.S.R. 1209(E).</strong>&#8211; In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules, 1972, namely:-</p>
<p>1. (1) These rules may be called the Central Civil Services (Leave) (Fourth Amendment) Rules, 2018.</p>
<p>(2) They shall come into force on the date of their publication in the Official Gazette.</p>
<p>2. In the Central Civil Services (Leave) Rules, 1972,</p>
<p>(A) in rule 28, in sub-rule (1) for clauses (a), (b) and (c), the following clauses shall be substituted, namely:-</p>
<blockquote><p>&#8220;(a) The leave account of every Government servant (other than a military officer) who is serving in a Vacation Department shall be credited with earned leave, in advance&#8217; in two installments of five days each on the first day of January and July of every calendar year.</p>
<p>(b) In respect of any year in which a Government Servant avails a portion of the vacation, he shall be entitled to additional earned leave in such proportion of twenty days, as the number of days of vacation not taken bears to the full vacation, provided the total earned leave credited shall not exceed thirty days in a calendar year.</p>
<p>(c) If, in any year, the Government servant does not avail any vacation, earned leave will be as per Rule 26 instead of clauses (a) and (b).&#8221;;</p></blockquote>
<p>(B) in rule 29, for sub-rule (1), the following sub-rule shall be substituted, namely:-</p>
<p>&#8220;(1) The half pay leave account of every Government servant (other than a military officer and a Government servant serving in a Vacation Department) shall be credited with half pay leave in advance, in two installments of ten days each on the first day of January and July of every calendar year.&#8221;;</p>
<p>(C) in rule 43-C. (a) for sub-rule (1), the following sub-rule shall be substituted, namely&#8221;;</p>
<blockquote><p>&#8220;(1) Subject to the provisions of this rule, a female Government servant and single male Government servant may be granted child care leave by an authority competent to grant leave for a maximum period of seven hundred and thirty days during entire service for taking care of two eldest surviving children, whether for rearing or for looking after any of their needs, such as education, sickness and the like.&#8221; ;</p>
<p>(b) for sub-rules (3) and (4), the following sub-rules shall be substituted, namely:-</p>
<p>&#8220;(3) Grant of child care leave to a female Government servant and a single male Government servant under sub-rule (1) shall be subject to the following conditions, namely:-</p>
<blockquote><p>(i) it shall not be granted for more than three spells in a calendar year;</p>
<p>(ii) in case of a single female Government servant, the grant of leave in three spells in a calendar year shall be extended to six spells in a calendar year.</p>
<p>(iii) it shall not ordinarily be granted during the probation period except in case of certain extreme situations where the leave sanctioning authority is satisfied about the need of child care leave to the probationer, provided that the period for which such leave is sanctioned is minimal.</p>
<p>(iv) child care leave may not be granted for a period less than five days at a time.</p></blockquote>
<p>(4) During the period of child care leave, a female Government servant and a single male Government servant shall be paid one hundred percent of the salary for the first three hundred and sixty five days, and at eighty percent of the salary for the next three hundred and sixty five days.</p>
<p><strong> Explanation.- </strong>Single Male Government Servant&#8217; means – an unmarried or widower or divorcee Government servant.&#8221;;</p></blockquote>
<p>(D) for rule 44, the following rule shall be substituted, namely:-</p>
<p>&#8220;44. Work Related Illness and Injury Leave:-</p>
<p>The authority competent to grant leave may grant Work Related Illness and Injury Leave ( herein after referred to as WRIIL) to a Government servant (whether permanent or temporary), who suffers illness or injury that is attributable to or aggravated in the performance of her or his official duties or in consequence of her or his official position subject to the provisions contained in sub-rule (1) of rule 19 of these rules, on the following conditions, namely :</p>
<blockquote><p>(1) Full pay and allowances shall be granted to all employees during the entire period of hospitalisation on account of WRIIL.</p>
<p>(2) Beyond hospitalization, WRIIL shall be governed as follows:</p>
<p>(a) A Government servant (other than a military officer) full pay and allowances for the six months immediately following hospitalisation and Half Pay for twelve months beyond the said period of six months. The Half Pay period may be commuted to full pay with corresponding number of days of Half Pay Leave debited from the employees leave account.</p>
<p>(b) For officers of Central Armed Police Forces full pay and allowances for six months immediately following the hospitalisation and full pay only for the next twenty four months.</p>
<p>(c) For personnel below the rank of officer of the Central Armed Police Forces full pay and allowances, with no limit regarding period.</p>
<p>(3) In the case of persons to whom the Workmen&#8217;s Compensation Act, 1923 applies, the amount of leave salary payable under WRIIL shall be reduced by the amount of compensation paid under the Act.</p>
<p>(4) No Earned Leave or Half Pay Leave shall be credited during the period that employee is on WRIIL.&#8221;.</p></blockquote>

<p>The undersigned is directed to refer to this Deptt&#8217;s O.M. of even no. dt. 07.03.2018 requesting the Ministries/Departments to provide the details  regarding number of employees eligible for Risk Allowance and estimated annual expenditure in the prescribed performa thereon.</p>
<p>2. Despite reminders dt. 17.04.2018 and 29.10.2018, till date only 15 Ministries/Departments have responded. All Ministries/Departments who have still not furnished the information are requested to furnish the same in the attached proforma latest by 30.11.2018 failing which it will be presumed that the remaining Ministries/Departments have no information to furnish and that they have no employees in receipt of Risk Allowance. <p>Subject: <strong>CONDIMENT EXPENDITURE &#8211; IMPLEMENTATION OF 7TH CPC RECOMMENDATIONS</strong></p>
<p><strong>CORRIGENDUM</strong></p>
<p>In partial modification to GoI, MoD Order No. 21704/Q/ST-6(Condirnents)/538/D(QS)/2018, dated 01.02.2018, the following may be read:</p>
<p><strong>Para1 FOR</strong></p>
<p>&#8221; I am directed to refer to MoD Order No. 21704/Q/ST-56/5100/D(QS) dated 12th October, 2015 and to convey the sanction of the President of India for continuation of <strong>Rs. 103.30</strong> per man per month for Condiment Allowance till 30.06.2017. Consequent to the decision taken by Government on recommendations of the 7th CPC&#8217;s after abolition of Condiment Allowance, Condiment Expenditure entitled to Defence Service personnel would be <strong>Rs. 89.78</strong> per man per month with effect from 01.07.2017&#8243;</p>
<p><strong>READ</strong></p>
<p>&#8221; I am directed to refer to MoD Order No. 21704/Q/ST-56/5100/D(QS) dated 12th October; 2015 and to convey the sanction of the President of India POI- continuation of <strong>Rs. 103.30</strong> per man per month for Condiment Allowance till 30.06.2017. Consequent to the decision taken by Government on recommendations of the 7th CPC&#8217;s after abolition of Condiment Allowance, Condiment Expenditure entitled to Defence Service personnel is hereby enhanced to <strong>Rs.119.26</strong> per month/man with effect from 01.07.2017 &#8221;</p>

<p>&#8221; The above changes will also be applicable to Indian Air Force and Indian Navy. &#8221;</p>

<p>Subject: <strong>Grant of Dearness Allowance to Central Government employees &#8211; Revised Rates effective from 1.7.2018.</strong></p>
<p>The undersigned is directed to refer to this Ministry&#8217;s Office Memorandum No.1/1/2018-E-II (B) dated 15th March, 2018 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government, employees shall be enhanced from the existing rate of <strong>7% to 9%</strong> of the basic pay with effect from<strong> 1st July, 2018</strong>.</p>
<p>2. The term &#8216;basic pay&#8217; in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix as per 7th CPC recommendations accepted by the Government, but does not include any other type of pay like special pay, etc.</p>
<p>3. The Dearness Allowance will continue to be a distinct element of remuneration and will not be treated as pay within the ambit of FR 9(21).</p>
<p>4. The payment on account of Dearness Allowance involving fractions of 50 paise and above may be rounded to the next higher rupee and the fractions of less than 50 paise may be ignored.</p>
<p>5. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In respect of Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.</p>
<p>6. In so far as the employees working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.</p>
