<p>Sub : <strong>Regulation of pension and other retirement benefits of Government servants who were on Extraordinary leave/ unauthorized absence/ suspension as on 1.1.2016 and retired/ died thereafter without joining duty</strong>.</p>



<p>The undersigned is directed to say that in accordance with Rule 33 of the CCS (Pension) Rules, for calculation of pension, the expression ’emoluments’ means basic pay as defined in Rule 9(21) (a) (i) of the Fundamental Rules which a Government servant was receiving immediately before his retirement or on the date of his death. In accordance with Note 3 under this rule, if a Government servant immediately before his retirement or death while in service had been absent from duty on extraordinary leave or had been under suspension, the period whereof does not count as service, the emoluments which he drew immediately before proceeding on such leave or being placed under suspension shall be the emoluments for the purpose of this rule.</p>



<p>2. Doubts have been raised in regard to the manner in which the pension and other retirement benefits of Government servants, who were on extraordinary leave/ unauthorized absence/ suspension as on 1.1.2016 and retired/ died thereafter without joining duty, would be regulated. The matter has been examined in consultation with the Ministry of Finance (Department of Expenditure) and the following clarifications are issued:</p>

The pension / family pension thus calculated will be revised in the accordance with the instructions contained in the Department’s O.M. No. 38/37/ 16-P&amp;PW(A) dated 12.05.2017 read with O.M.No. 38/37/16-P&amp;PW(A) <br />(ii) dated 04.08.2016 and will be paid to the pensioner/ family pensioner from the date it becomes due.For the purpose of gratuity, the emoluments shall also include Dearness Allowance ( as per 6th CPC) admissible on the date of retirement/death of the Government servant.The Pension/family pension/ commutation of pension and gratuity will be regulated in accordance with the rules/instructions applicable before 1.1.2016</td></tr><tr><td>Government servant, who was on extraordinary leave &#8211; the period whereof counts as qualifying service &#8211; as on 1.1.2016 and retired/ died thereafter without joining duty.</td><td>The pay of such a Government servant will be notionally revised w.e.f. 1.1.2016 and this notionally revised basic pay will be reckoned as emoluments for the purpose of pension.For the purpose of gratuity, the emoluments shall also include Dearness Allowance ( as per 7th CPC) admissible on the date of retirement/ death of the Government Servant.His pension/ family pension, commutation of pension and gratuity will be regulated in accordance with the instructions contained in this Department’s O.M. No. 38/37/16-P&amp;PW(A) dated 12.05.2017 read with O.M. No 38/37/16-P&amp;PW(A)(i) dated 04.08.2016 and will be paid to the pensioner/ family pensioner from the date it becomes due.</td></tr><tr><td>Government servant, who was under suspension as on 1.1.2016 and retired thereafter without joining duty.</td><td>Such a Government servant, on retirement, is entitled to only provisional pension. The emoluments which he drew immediately before suspension shall be the emoluments for the purpose of provisional pension. This provisional pension will be revised in accordance with Department’s O.M. No. 38/49/ 16-P&amp;PW(A) dated 12.02.2018. The provisional pension will be reviewed /regularized on conclusion of the departmental/judicial proceedings and issue of final orders thereon.</td></tr></tbody></table></figure>



<p>3. These orders issue with the concurrence of Ministry of Finance (Department of Expenditure) vide their U.O. No. 1(23)/ EV/2019 dated 05.02.2020.</p>



<p>4. In their application to the employees of Indian Audit and Accounts Department, the orders are issued under Article 148(5), of the Constitution With the concurrence of the Comptroller and Auditor General of India.</p>

<p>Kindly find enclosed the Minutes of the Meeting held on 10.01.2020 at 10:00 AM at Conference Hall of Central Pension Accounting Office (CPAO) with all Heads of <a href="https://centralgovernmentnews.com/tag/cppcs/" target="_blank" rel="noreferrer noopener" aria-label="CPPCs (opens in a new tab)">CPPCs</a> /Government Business Divisions of State Bank of India to review the implementation of 7th CPC pension revision and to discuss other issues under the Chairmanship or Chief Controller (Pension) for information and further necessary action.</p>

<p>A Meeting was held on 10.01.2020 under the Chairmanship of Chief Controller (Pensions) with the representatives of CPPCs of SBI to discuss the timely payment of revised pension and arrears under <a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener" aria-label="7th CPC (opens in a new tab)">7th CPC</a> and other pension related issues.  At the outset, Chief Controller (Pensions) welcomed all the participants and emphasized on the need of timely payment of revised pension and arrears in the accounts of the pensioners by the CPPCs. Agenda items of the meeting were discussed in detail and the following decisions were taken.</p>



<p>List of participants is attached at Annexure-I.</p>



<p><strong>Agenda Item No. 1- Implementation of 7th CPC Pension Revision and its reporting by CPPCs</strong></p>



<p>It has been observed from the reports as on 30th December, 2019 that there are delays in crediting the revised pensions as well as arrears of pensions/family pensions by the CPPCs. As per the reports, there arc many cases which are pending for more than 31 days. CPPC-wise details of the pending cases were handed over to all the representatives. Most of the CPPCs reported that they had already revised and credited pension to the pensioner / family pensioner accounts.</p>



<p>It was informed by the CPPCs that revision of pension cases are pending due to following reasons,</p>



<p>a) Discontinued PPO (more than 3 years.)</p>



<p>b) Non submission of life certificate.</p>



<p>Keeping in view of the above, it was decided that all the CPPCs would :</p>



<p>a) reconcile the scams of revised pension cases provided to them</p>



<p>b) prepare a list of discontinued PPOs and forward it to CPAO.</p>



<p>c) prepare a list of cases in which life certificate is pending along with details of the pensioners and forward it to CPAO.</p>

<h4 class="wp-block-heading">Agenda Item No. 2 &#8211; Obtaining KYC from CPPCs for settlement of pending revision cases.</h4>



<p>Most of the revisions pertaining to 7th CPC are already done. As per the records of <a href="https://centralgovernmentnews.com/cpao-discontinuation-of-bsr-code-2/" target="_blank" rel="noreferrer noopener" aria-label="CPAO (opens in a new tab)">CPAO</a>, 119690 revision of pension cases are still pending as details of some pensioners are not available with either concerned PAO or I lead of Office.</p>



<p>Although KYC details were received from all the CPPCs of Sl:JI, All the CPPCs are req uested to furnish the detail of the KYC detail as and when it is asked by the CPAO.</p>

<h4 class="wp-block-heading">Agenda Item No. 3 &#8211; IT related issue w.r.t e-Revision and fresh Pension cases</h4>



<ul class="wp-block-list"><li><strong>Acknowledgement of SSA</strong></li></ul>



<p>All the CPPCs of SBI were instructed to ensure forwarding the acknowledgement of e-SSA electronically to CPAO at the earliest so that the difference between e-SA forwarded by the CPAO and e-SSA received by the CPPCs could be nullified. CPPCs were also provided the formal for Acknowledgement. All the CPPCs were advised to share their inputs with NIC, CPAO, if any problem is faced.</p>



<p>All the CPPCs were also instructed to acknowledge the receipt of SSA and Physical PPO booklet received by them .</p>

<ul class="wp-block-list"><li><strong>Development of e-PPO Booklet</strong></li></ul>



<p>CPAO is forwarding the e-PPOs received from PFMS to the CPPCs along with physical PPO booklets for making necessary changes in their system. However, the manual PPO booklet is deemed sacrosanct for making payment. It was also intimated in the meeting that physical PPO booklet will be discontinued soon.</p>



<p>All the CPPCs were again requested to make necessary changes in their software accordingly and comments, if any, may please be submitted to CPAO.</p>

<h4 class="wp-block-heading">Agenda Item No.4- Compliace of Internal Audit observations on 7th CPC revisions.</h4>



<p>It has been observed that clear and complete compliance reports arc not being submitted by the concerned CPPCs .</p>



<p>All the CPPCs were requested to give full details in their compliance reports of the objection raised by Internal Audit Wing so that the same could be verified and settled. All the CPPCs were also been asked to improve and strengthen their internal control mechanism to avoid re-occurrence of the mistakes pointed out by the Internal Audit Wing of CPAO.</p>



<p>The possibility of providing a utility lo upload the compliance report on the Bank’s login section of CPAOs website will also be explored.</p>



<p>Internal Audit Wing was instructed to prepare an “Audit Manual” under the guidance of Technical Section, CPAO.</p>

<h4 class="wp-block-heading">Agenda Item No. 5 &#8211; Timely commencement of family pension, additional pension &amp; restoration of commuted portion of pension by CPPCs</h4>



<p>It has been observed that family pension, additional pension and commuted portion of pension are not timely commenced/restored. Since these issues are regularly discussed in the various meetings i.e. SCOVA Meeting, High Level Meeting, Standing Committee Meeting, etc., all the CPPCs were advised to ensure timely payments.</p>

<h4 class="wp-block-heading">Agenda Item No.6 &#8211; Timely submission of Life Certificates :</h4>



<p>CPAO is responsible for the disbursement of death/disability pension under NPS­ Additional Relief. First time identification of the pensioners is being done in the Bank branches based on the KYC details available with the CPPCs where the pensioners / family pensioners have opened their pension accounts. CPAO starts the pension payment based on the first time identification report received from CPPCs. These CPPCs branches are also responsible for sending the life certificates of the pensioners / family pensioners to CPAO for the continuation of pension to NPS-AR pensioners, in the month of November as CPAO is the disbursing authority.</p>



<p>However, it is noticed that in many cases, despite submission of life certificates by the pensioners, bank branches have not forwarded the same to CPAO. It has also come to notice of this office that some bank branches are refusing to accept life certificate from NPS-AR pensioner for onward transmission to CPAO.</p>



<p>It was decided that CPAO will send the details of pending life certificates of NPS-AR pensioners to concerned CPPCs with a request to instruct concerned branches to obtain and furnish the life certificate to CPAO in time so that pensioners are not put under any financial hardship.</p>



<p>All the CPPCs were requested to accept life certificate both physically and digitally and promote “jeevan Praman” among pensioners.</p>



<p>Further, CPPCs were once again informed that they should not make payment in NPS-AR cases.</p>

<h4 class="wp-block-heading">Agenda item No .7 &#8211; Return of Old PPO by the CPPCs .</h4>



<p><strong>Allotment of 12 digits PPO Number</strong></p>



<p>It has been noticed from the CPAO data base that some pensioners are still drawing pension from the old alpha numeric code. These alpha numeric data is reflected in the Payment scroll. CPPC-wise derails were provided to the concerned CPPCs.</p>



<p>It was decided that all the CPPCs will send a scan copy of the PPO for allotment of 12 digit PPO Number.</p>



<ul class="wp-block-list"><li><strong>Return of Inactive PPOs.</strong></li></ul>



<p>Pension Payment Orders which are not in operation /inactive may be returned to CPAO for deletion from the CPAO database. It is noticed from the database of CPAO that old PPOs which arc inactive arc not being forwarded by the bank to the CPAO. CPPCs were advised to forward the same to CPAO al the earliest</p>

<p>Agenda Item No.8- Submission of e-scrolls and Master Data Reconciliation</p>



<ul class="wp-block-list"><li><strong>Submission of e-scrolls</strong></li></ul>



<p>It has been observed that there is slight improvement in submission of e-scrolls by CPPCs.</p>



<p>Details of pending scrolls were shared with the CPPCs and all the CPPCs were instructed to ensure that e-scrolls are updated on a daily basis to CPAO after matching it thoroughly with the pension payments made. The CPPCs should ensure that the date of scroll should be the date of transaction as appearing in the put through statement issued by RBI. <ul class="wp-block-list"><li><strong>Master Data Reconciliation</strong></li></ul>



<p>Correct and reconciled master data maintained at CPPC level is a must for ensuring correct payment of pension to the pensioners and avoid chances of excess/less/wrong payment of pension. However, many instances have come to the notice of CPAO regarding less/over payment of pension leading to the grievances and court cases by the pensioners. The reason for discrepancy in payment of pension is that CPPCs are not reconciling the master data with the CPAO database regularly. There is inordinate delay in uploading of Master Data by some CPPCs. Some CPPCs have not submitted their Master Data for last 2 years. For updating on Master Data at CPAO level, whenever any value/data in the pension of a pensioner/family pensioner is changed, the same is required to be reported by the bank through Format-F of e-Scroll However, it is noticed that CPPCs are not providing the changed information to the CPAO.</p>



<p>All the CPPCs were instructed to upload Master Data for reconciliation and submit the changed information in Format-F on “quarterly” basis. Furthermore, if any problem is faced by the CPPCs in uploading the master data, they may contact this office on email addresses mentioned below:</p>

<h4 class="wp-block-heading">Agenda Item No. 9-Discontinuation of BSR Code</h4>



<p>At present, BSR code is being used in CPAO to identify bank branches. It has been observed in many cases that Pensioners do not know BSR code of Pension Account Holding Branch and even many bank branches do not know their BSR Code and often misunderstand it with branch code. IFSC is another uniq ue code which can be used to identify individual bank branches and is known to both CPPCs and pensioners.RBI has also given its consent for using IFSC instead of BSR code for identification of Bank Branches.</p>



<p>However, the IFSC from all the CPPCs of SBI have been received. All the CPPCs and GBDs of SBI are requested to send the IFSC of the branches as and when it is asked by the CPAO.</p>

<p>All present, pensioner copy of SSA is being sent to the pensioners through post. References arc being received by pensioners that they are not receiving their SSA copy due to following reasons.</p>



<ol class="wp-block-list"><li>Some pensioners change their addresses after retirement.</li><li>Some pensioners/family pensioners are illiterate and they are not well versed with technology to take printout of their SSA from CPAOs website.</li></ol>



<p>All the CPPCs agreed to provide a copy of SSA to the pensioner by the Pension Account Holding Branch on request of the pensioner.</p>

<h4 class="wp-block-heading">Agenda Item No. 11-Pendency of Pensioners’ Grievances for more than 3 months through Web Responsive Pensioners’ Service (WRPS)</h4>



<p>It has been observed that many grievances are pending with CPPC, some of which are more than 30 days. CPPCs informed that they had disposed some of the grievances but not updated them under WRPS module.</p>



<p>CPPCs were requested to ensure that all the grievances which are pending with them are disposed of within one month and update the same on the WRPS portal so that pensioners are informed accordingly.</p>

<h4 class="wp-block-heading">Agenda Item No.12- Providing of Payment Details to all the Pensions</h4>



<p>As per CPPC guidelines, CPPCs should provide account statement, TDS details, pension slip, the Due and Drawn Statement in respect of each arrear and the Annual Income Statement to the pensioner.</p>



<p>CPPCs were requested to follow the CPPC guidelines and provide the pension slip, breakup of the pension and arrear payments and other information as required to the pensioners.</p>

<p>All the CPPCs were suggested lo develop a mechanism for acknowledgement of c· PPOs by CPPCs.</p>

<p>It has been observed from the e scrolls received in the O/o PCDA that some of the CPPCs are crediting pension and Family pension very late in the account of pensioner especially civilian pensioner. All the CPPCs were handed the pendency list and were requested to improve their performance in crediting the pension/ family pension on time.</p>



<p>c. To provide image of PPO for data purification</p>



<p>All the CPPCs were requested in the meeting to provide PPO image to them to facilitate data purification which was agreed to.</p>

Ref: NFIR’s letter No. II/35/20l8 dated 08/09/2018</p>
<p>In view of difficulties faced for revision of pension (w.e.f. 01/01/2016 -7th CPC) of retired Running Staff consequent upon non-reckoning of 55% add on pay element to retired Running Staff, 30% add on pay element for retired Loco inspectors (pre-2016) and non-reckoning of &#8216;<strong>Charge Allowance</strong>&#8216; granted to JA Grade Officers (worked on adhoc basis and retired) which is counted as pay for all purposes as per extant instructions, NFIR vide its letter dated 08/09/2018 requested the Railway Board to make adequate provisions in the ARPAN software to enable the zonal Railways tb redress the grievances of retired staff.</p>
<p>Along with its communication dated 08/09/2018, Federation also enclosed copies of Western Railway and Sourh Central Railway&#8217;s letters dated 06/07/2018 &amp; 10/08/2018 wherein specific difficulties/problems faced by the zonal Railways were highlighted’ Federation feels disappointed that though a period of more than two months passed, neither.rectification in the software ARPAN has bleen don. no, Federation apprised of steps taken to mitigate problem.</p>
<p>While enclosing copy of Federation&#8217;s letter dated 08/0912018 (together with enclosures), NFIR once again requested Railway Board to kindly intervene to see that rectification in the software is ensured soon. Federation may please be apprised of the action taken in the matter.</p>

(2) GoI, MoD letter No.17 (01)/2017/(02)/D(Pension/Policy) dated 17.10.2018.</p>
<p>Attention is invited to Para-4 of Gol, MoD letter No. 17 (01)/2017/(02)/D(Pension/Policy) dt 05.09.2017 circulated vide Circular No. 585 dated 21.09.2017, wherein it has been mentioned that revision of pension/family pension of all Armed Forces Personnel who retired! died prior to 01.01.2016 under first formulation was to be revised by notionally fixing their pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale! pay band and grade pay at which they retired! died. This was to be done by notional pay fixation under each intervening Pay Commission based on the formula for revision of pay. The revised rates of Military Service Pay, Non Practising Allowance, where applicable, and ‘X’ Group pay Classification Allowance for JCOs/ ORs, if applicable, notified in terms of 7th CPC orders, also to be added to the amount of pay notionally arrived at under the 7th CPC pay matrix and termed as notional reckonable emoluments as on 01.01.2016. The higher of the two Formulations i.e. the pension/family pension already revised in accordance with Gol, MoD letter No. 17(01)/2016-D(Pen/PoI) dated 29th October 2016 and modified vide letter No. 17(01)/2017 (01)/D(Pen/PoIicy) dated 04.09.2017 or the revised pension/ family pension worked out in accordance with Para 5 above, shall be granted to pre-2016 Armed Force Pensioners as revised Pension/ Family Pension w.e.f. 01.01.2016.</p>
<p>2. GoI, MoD vide letter No. 17(01)/2017/(02)/D(Pension/ Policy) dated 17.10.2018 has issued concordance tables to facilitate fixation of notional pay of pre-2016 defence pensioners! family pensioners by the concerned Record offices and attached Pay Account Offices in case of JCO/ORs of the three Services and PCDA(O) Pune/ Naval Pay Office, Mumbai/ AFCAO New Delhi in case of Commissioned Officers of Army/ Navy/Air Forces respectively. A copy of ibid Gol, MoD letter dated 17.10.2018 enclosed herewith for further necessary action, which is self-explanatory.</p>
<p>3. In view of the above, Record Offices are requested to prefer/forward the claims for revision of pension in respect of Pre-1.1.2016 pensioners/family pensioners in accordance with the instructions given in this office Circular No. 585 dated 21.09.2017 by using this concordance table for fixing the notional pay of the pensioner. However, it is informed that the LPC-cum-Data Sheet circulated in Circular No. 585 dated 21.09.2017 is under modification along with amendment in the software programme. An utility programme in this regard is also under development. The same along with detailed instructions will follow shortly.</p>

The following modus operandi has to be adopted by the Pension Disbursing Authority i.e. State Bank of India, Parliament Street, New Delhi, for revision of pension:</p>
<p>1. In case of pensioners retired prior to 01.01.2016, the revised pension/family pension with effect from 01.01.2016 shall be determined by multiplying the pension/family pension, as had been fixed at the time of implementation of 6th Central Pay Commission(CPC) (pension drawn on 31.12.2015) by 2.57 in terms of OM NO. 38/37/2016-P&amp;PW(A)(ii) dated 04.08.2016. The amount of revised pension/family pension so arrived at shall be rounded off to next higher rupee. The revised pension/family pension will be the basic pension/family pension only without the element of additional pension available to the old pensioners/family pensioners on attaining the specified age.</p>
<p>2. The revised pension in accordance with 7th CPC will be applicable with effect from August 2018. The arrears of pension (w.e.f. 01.01.2016) will not be paid to pensioners till further instructions from this office.</p>
<p>3. In case of pensioners retired between 01.01.2016 to 31.05.2018, the revised order according to 7th CPC for individual case will be issued by the (Kendriya Vidyalaya Sangathan. in such cases also existing pension is to be revised with effect from August 2018 and the arrears of pension for 7th CPC will not be paid till further instructions from this office. It is relevant to mention that with effect from June 2018, the Kendriya Vidyalaya Sangathan is issuing the Pension Payment Orders as per recommendations of 7th CPC.</p>
<p>4. The Dearness rates for all the pensioners drawing pension according to 7th CPC will be paid as mentioned in this office letter of even number dated 05.07.2018 (copy attached).</p>
<p>5. The Govt. of India; Ministry of Personnel, PG &amp; Pensions vide OM No. 4/34/2017-P&amp;PW(D) dated 19.07.2017 has enhanced the amount of Fixed Medical Allowance from Rs.500/- to Rs.1000/- with effect from 01.07.2017. The Fixed Medical Allowance (FMA) of Rs.1000/- is to be paid to all the pensioners with effect from August, 2018. The arrears of FMA i.e. from 01.07.2017 to 31.07.2018 will only be paid at the time of payment of arrears of pension in accordance with 7th CPC for which the necessary instructions will be issued by this office.</p>

<p><strong>Abolition of Contributory Pension Scheme</strong></p>
<p>Representations have been received from various Associations of Government Employees on the problems being faced and the demand to withdraw the National Pension System (NPS).</p>
<p>The 7th Central Pay Commission (CPC) also in its report examined the issues related to NPS and made recommendations for addressing these issues. Pursuant thereto, it was decided to constitute a Committee of Secretaries to suggest measures for streamlining NPS. The Committee has submitted its report.</p>
<p>Due to rising and unsustainable pension bill and keeping in view of fiscal imperatives, it is not possible for the government to revert back to old pension scheme.</p>

<p>Subject: <strong>Payment of arrears accruing in respect of deceased pensioners/family pensioners to the nominee/legal heir.</strong></p>
<p>On death of the pensioners/family pensioners, the pension account is closed by the bank and the balance amount in the account of pensioners/family pensioners is paid to the nominees/legal heirs. However, it is observed that the life time arrears arising subsequently on account of Pay Commission etc. are not paid to the nominees/legal heirs of the deceased pensioners/family pensioners either on account of fact that the pension/family pension is not revised by the concerned Pension Sanctioning Authority (PSA) or the amount of arrears of revised pension/family pension is not paid due to closure of the bank account. In such cases action is to be taken by the concerned Pay &amp; Accounts Officer as per provision of para 7.5.6 of the Civil Accounts Manual (copy attached).</p>
<p>DP&amp;PW vide its OM No. 1/22/2012-P&amp;PW (E) dated 10th July, 2013 (copy enclosed) has clearly defined the procedure so that nominees/legal heirs of pensioners/family pensioners are not subjected to harassment in claiming the payment of arrears of pension.</p>
<p>In view of the above, all the Head of Offices/PAOs/CPPCs of banks are requested to comply with the procedure as mentioned in the above OM of DP&amp;PW for speedy settlement of claims of pension arrears.</p>

<p>Subject: <strong>Common mistakes by PAOs in processing of Revision of Pension under 7th CPC .</strong></p>
<p>7th CPC Pension Revision cases are to be settled in a time bound manner. This office is receiving more than 3000 pension revision cases on daily basis. However, it has been observed that about 5 to 10 percent cases are returned by this office to PAOS due to Various discrepancies. The reasons to return are indicated by this office in each case. To facilitate the PAOs, a list of common mistakes made by PAOs has been prepared and enclosed herewith at Annexure-A.</p>
<p>In view of above all the PAOs are requested to ensure that 7th CPC revision cases are sent correctly to CPAO to speed up the processing of the same in a time bound manner.</p>

<p>The 7th Central Pay Commission had recommended two formulations for revision of pension of employees who retired before 01.01.2016 and the employees were given option to choose whichever</p>
<p>formulation was beneficial. As per the first formulation, the Commission recommended for revision of pension based on notional pay arrived at by adding the number of increments an employee had earned in the appropriate level while in service.</p>
<p>This formulation was later on examined by a Committee under the Chairmanship of Secretary, Department of Pension and Pensioners&#8217; Welfare. The Committee recommended that instead of counting of increments earned in the retiring scale and applying directly to the 7th Pay Commission Pay Matrix, a more scientific and rational method would be to refix pay in each successive Pay Commission as per the formula for revision of pay right up to the 7th Pay Commission.</p>
<p>This method of fixing notional pay and pension would benefit a larger number of pensioners as compared to the increment method which benefits only a select segment of pensioners who served for a longer period in the retiring scale without being promoted to a higher grade. This has been accepted by the Government and appropriate orders have been issued.</p>
