<h3 class="wp-block-heading">Subject: Revised Pay Levels as per recommendations of the Seventh Central Pay Commission &#8211; Issue of instructions on revision in minimum qualifying service required for promotion &#8211; regarding</h3>



<p>The undersigned is directed to refer to this Department’s OM No. AB.14017/ 13/2016-Estt.(RR) dated 9.8.2016, wherein all Ministries/ Departments were advised to amend the Service Rules and Recruitment Rules by substituting the existing Pay Band and Grade Pay with the new pay structure i.e. &#8220;Level in the Pay Matrix”, as per the recommendations of 7th CPC and the CCS (Revised Pay) Rules 2016 issued by Department of Expenditure vide Notification dated 25th July, 2016, straightaway without making a reference to the Department of Personnel and Training (DOP&amp;T)/ Union Public Service Commission (UPSC).</p>



<p>2. Attention is invited to this Department’s OM No AB.14017/61/2008- Estt. (RR) dated 24.3.2009, which was issued following implementation of the recommendation of the 6th CPC, indicating the revised minimum qualifying service required for promotion, to be prescribed in the Service/Recruitment Rules, as per the revised pay structure introduced as per recommendations of the 6th CPC and accepted by the Government. The said OM was issued in the context of earlier instructions issued vide DOPT OM No. AB.14017/2/97-Estt. (RR) dated 25.5.1998, prescribing the minimum qualifying service as per 5th CPC pay scales.</p>



<p>3. Instructions revising the minimum qualifying service required for promotion, as per 7th CPC Pay Matrix/ Pay Levels, have not been issued so far and proposals for framing/ amendment of RRs/Service Rules are still being considered, based on the requirements prescribed in OM dated 24.3.2009. Though the levels in Revised Pay Matrix as per 7th CPC Pay Matrix, generally correspond to the pre-revised Grade Pays/ Pay Scales (6th CPC), however, a need was felt to prescribe minimum qualifying service for promotion as per Pay Levels in the Revised Pay Matrix.</p>



<p>4. Therefore, the instructions issued vide DOPT OM dated 24.3.2009 has been reviewed, in consultation with the UPSC and with the approval of the competent authority it has been decided to revise the norms prescribing minimum eligibility service required for promotion, as per 7th CPC Pay Matrix and Pay Levels. The revised norms for minimum eligibility service for promotion have been indicated in the table at Annexure-I.</p>



<p>5. Therefore, the revised norms prescribing minimum eligibility service required for promotion, as per 7th CPC Pay Matrix and Pay Levels, given in Annexure-I , may be incorporated in the Recruitment Rules/ Service Rules by malting suitable amendments. All the Ministries/ Departments are, therefore, requested to effect necessary amendments to the Recruitment Rules/ Service Rules, in this regard, after following the due procedure.</p>



<p>6. The Recruitment/ Service Rules are of statutory nature. Moreover, any amendment in these Rules generally have prospective effect. Therefore, in terms of para 3.1.3 of DoPT OM No. AB. 14017/48/ 2010-Estt. RR dated 31.12.2010, wherever required, suitable &#8216;protection clause&#8217; may be incorporated in the amendment proposed in the Recruitment/ service Rules, providing for retention of existing eligibility service for existing incumbents holding the feeder posts on regular basis, where the eligibility service for promotion prescribed in the existing rules is being enhanced and where the change is likely to affect the promotion of these incumbents.</p>



<p>7. Ministries/ Departments may initiate action to complete the review in this regard and furnish necessary amendment proposals to the DOPT and the UPSC in the case of Group A and Group B posts within six months from the date of issue of this Office Memorandum.</p>

<p>No separate posts of Asstt. Headmasters/Asst Head-mistresses/Vice Principals should be created. Where considered necessary, the senior-most post-graduate teacher in scale Rs.6500 -10500 (RSRP) selection grade working in a Higher Secondary School/senior-most graduate teacher in scale Rs.5500 &#8211; 9000 (RSRP) working in a High School, should be put to work as Asstt. Headmaster/Asstt. Headmistress/ Vice-Principal by reducing his/her teaching load. (Railway Board’s letter No. E(W)62/SC-2/44 dt. 4.5.63 and, PC-V98/Ill 1/26 dt. 23.10.1988</p>



<p>However, in Higher Secondary Schools/Inter Colleges, with an enrolment of 1000 or more students, the senior-most Post Graduate Teachers in scales of Rs.7500-12000 (RSRP)/Rs.8000-13500 (RSRP), as the case may be designated and utilised as Vice­ Principals by reducing their teaching workload. If necessary, selected suitable Post Graduate Teachers may be shifted to locations where needed, if they are not readily available there. </p>

<p>As regards 6th CPC Schedules regarding the pay scale of teaching staff have been circulated by Board’s letter No. PC VI/2008/If RSRP/1 dated 22.09.2008 &amp; 17.07.2009. The scales allotted to the teaching staff are as under:</p>

<p>No specific recommendations have been made by the 7th CPC in respect of Pay Scales of Teaching Staff of Railway schools, therefore, only replacement Pay Level in the Pay Matrix is applicable to Teaching Staff.</p>



<p>Each case of transfer of a Railway School to the State Government should be examined on merits. Where this can be done, the Railway Administrations may agree to license the school buildings on nominal license fee and give the furniture free of cost so as to make it attractive for the State Govt. to take over the school. In any case, approval of the Railway Board may be obtained before any Railway School is handed over to the State Government.</p>

<p>The main objective of conducting inspections in Railway Schools is to streamline their day-to-day administration and effect necessary, improvements in educational standards. Vigorous follow-up action should be taken on Inspection Reports submitted by Inspecting Officers and whenever deficiencies have been pointed out these should be speedily rectified.</p>



<p>The Chief Personnel Officers should take a personal interest and ensure that necessary improvements, were called for, are affected with a view to improving the standard of Railway Schools. It should also be ensured that Railway Schools are regularly inspected by the State Govt. Inspectors and their recommendations implemented to the extent possible. In this connection, attention is also invited to the recommendations of Educational Advisers which were sent along with Board’s letter No. E(W)58/ED1/9 dated 21.9.1959.</p>

<p>Any changes in the pattern of classes in Railway Schools such as addition or abolition of classes, upgradation or down gradation of schools etc. should be reported to Board for information together with the reasons necessitating such changes.</p>

<p><strong>Concessions to the Scheduled Caste and Scheduled Tribe Communities in the matter of admission to the Railway Schools including Oak Grove School at Jharipani:</strong></p>



<p>(1) It has been decided by the Railway Board that the following concessions should be allowed to the students belonging to the Scheduled Caste and Scheduled Tribe communities in the admission to the Railway schools:</p>



<ul class="wp-block-list"><li>(a) A distinct reservation of 15% for SC and 7.5% for ST candidates;</li><li>(b) Where admissions are made with reference to percentage of marks obtained, 1 % reduction in marks may be allowed in the case of SC and ST candidates provided the lower percentage does not fall below the minimum marks required to pass the qualifying examination;</li><li>(c) The upper age limit for SCs/STs may be raised by three years;</li><li>(d) No child/ward of a member of staff belonging to SC/ST community should be refused admission in Primary classes; .<br />(e) In other classes, admission should not normally be refused up to the extent of the<br />quota exclusive of any who secures admission on merits.</li></ul>



<p>(2) To ensure that the concessions in the matter of admission as referred to above are actually available to the SC and ST communities, the Railway administration should maintain the following data:</p>

<h3 class="wp-block-heading">Subject: Implementation of the recommendation of 7th CPC &#8211; Para 11.12.140 &#8211; Grant of Grade Pay of Rs. 5400 (PB 2) i.e. Level 9 of Pay Matrix in case of Assistant Accounts Officer of Defence Accounts Department of Ministry of Defence: Grant of Non-Functional Up-gradation (NFU).</h3>



<p>The CGDA, Delhi Cantt office vide their letter no. AN/XIV/14162/7th CPC/ Vol-II dated 13.11.2020 has intimated that the revised pay scale of the post of Assistant Accounts Officer in Defence Accounts Department would be in Level-8 of Pay Matrix and Level-9 (<a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener"><strong>7th CPC</strong></a>) on completion of 04 years in Grade Pay of Rs. 4800/-(PB-2) Level 8. This is a Non-Functional Up-gradation (NFU) which is subject to the following terms and conditions:-</p>



<ul class="wp-block-list"><li>(i) The grant of NFU will be admissible on completion of 4 years of regular service in the cadre from the date of joining as AAO. The aforesaid Non-Functional Up-gradation (NFU) to AAQs is effective from 01.01.2016.</li><li>(ii) The NFU will be subject to vigilance clearance.</li><li>(iii) Benefits of Pay Fixation as per Rule 13 of CCS (Revised Pay) Rules 2016 shall be available at the time of grant of Non-Functional Up-gradation to AAQs.</li><li>(iv) After the grant of NFU to AAOs in Pay Level-9 and their Pay Fixation under Rule 13 of CCS (RP) Rules 2016, there will be no further pay fixation on promotion.</li><li>(v) NFU will be reckoned for financial up-gradation under <a href="https://centralgovernmentnews.com/latest-macp-orders-from-dopt/" target="_blank" rel="noreferrer noopener">MACP Scheme</a>. Subsequent financial up-gradation under MACPs, if any, is to be reckoned from the date of grant of NFU.</li></ul>



<p>2. To consider the grant of NFU, it is requested to furnish the details of all eligible AAOs who are completing 04 years in the grade pay of Rs. 4800/- up to 30.06.2021 on the under-mentioned Performa. The requisite details should reach this office through mail ID pedawcan3 .dad@hub.nic.in latest by 01.03.2021. It may also be ensured that no elected official is left out from your office/section.</p>

<h3 class="wp-block-heading">Subject: Grant of revised AICTE pay scales to the Civilian Professorial staff of (i) College of Military Engineering (CME), Pune; (ii) Military College of Telecommunication Engineering (MCTE), Mhow; (iii) Military College of Electronics and Mechanical Engineering (MCEME), Secunderabad; (iv) Indian Naval Academy (INA), Ezhimala; (v) Naval College of Engineering (ai part of INA, Ezhimala); and (vi) EME School, Baroda</h3>



<p>Sir,</p>



<p>I am directed to refer to this Ministry’s letter No. 3/3/2009/D(Civ-11) dated 10.11.2010 on the above mentioned subject and to state that in view of the revision of pay AICTE pay scales in the Technical Institutions as notified vide Ministry of Human Resource Development’s (MHRD) letter No. 1-37/2016-TS. II dated 18.01.2019 read with their letters of even number dated 29.01.2019 and All India Council for Technical Education’s (AICTE) Notification No. 61-1/RIFD/ 7th CPC/2016-17 dated 01.03.2019, the President is pleased to further revise the pay scales of Civilian Professorial Staff of the training institutions as mentioned in the subject of the letter. The revised pay scales and other provisions shall be as per the following paragraphs.</p>



<h4 class="wp-block-heading"><strong><a href="https://centralgovernmentnews.com/7th-pay-commission-pay-matrix-table-for-defence-personnel/" target="_blank" rel="noreferrer noopener">7TH PAY COMMISSION PAY MATRIX TABLE FOR DEFENCE PERSONNEL</a></strong></h4>



<ol class="wp-block-list" start="2"><li><strong>Designation</strong>: –</li></ol>



<p>There shall be only three designations in respect of Civilian Professorial Staff, namely Assistant Professors, Associate Professors and Professors.</p>



<ol class="wp-block-list" start="3"><li><strong>Revised Pay: –</strong></li></ol>



<h4 class="wp-block-heading">(I) Pay Fixation Method:</h4>



<p>The revised pay structure for different categories of Civilian Professoria l Staff is based on the following: –</p>



<ul class="wp-block-list"><li>The formula followed by the 7th CPC is followed in the academic pay structure, movig from the concept of Pay Band and Academic Grade Pay to that of Academic Levels and Cells.</li><li>The first academic level (corresponding to AGP of 6000) is numbered as academic level 10. Similarly, the other academic levels are 11, 12, 13A1, 14 and 15.</li></ul>



<ul class="wp-block-list"><li>Each cell in an academic level is at 3% higher than the previous cell in that level.</li><li>The index of Rationalisation (IOR) is 2.67 for present AGP of less than 10,000 and 2.72 for the AGP of Rs. 10,000 and above.</li><li>The entry pay for each level is as follows</li></ul>

<ul class="wp-block-list"><li>The Pay Matrix based on the above propositions on Academic Levels, Cell and Entry Pay is at Annexure.</li><li>For fixation of pay of an employee in the Pay Matrix as on 01st January, 2016, the existing pay (Pay in Pay Band plus Academic Grade Pay) in the pre­ revised structure as on 31st December, 2015 shall be multiplied by a factor of 57. The figure so arrived at is to be located in the Academic Level corresponding to employee’s Pay Band and Academic Grade Pay in the new Pay Matrix. If a Cell identical with the figure so arrived at is available in the appropriate Academic Level, that Cell shall be the revised pay; otherwise the next higher cell in that Academic Level shall be the revised pay of the employee. If the figure arrived at in this manner is less than the first cell in that Academic Level, then the pay shall be fixed at the first cell of that Academic Level.</li></ul>



<p>&nbsp; In cases where in revision of pay, the pay of Government Servants drawing pay at two or more stages in pre-revised Pay Band and Grade Pay or scale, as the case may be, gets fixed at same Cell in the applicable Level in the new Pay Matrix, one additional increment shall be given for every two stages bunched and the pay of Government Servant drawing higher pay in the pre-revised structure shall be fixed at the next vertical Cell in the applicable Level as per Ministry of Finance, Department of Expenditure OM No. 1-6/2016-IC dated 07.09.2016 and subsequent clarification issued vide DoE’s OM No. 1-6/2016-IC/E-lllA dated 07.02.2019.</p>

<ol class="wp-block-list" start="4"><li><strong>Increment</strong>: –</li></ol>



<ul class="wp-block-list"><li>The annual increment is given in the Pay Matrix at 3%, with each cell being higher by 3% over the previous cell in the same level, rounded off to nearest The annual increment to each employee would move up in the same academic level, with an employee moving from the existing cell in the academic level to the immediate next cell in the same academic level.</li><li>There shall be two dates for grant of increment namely, 01st January and 1st July of every year, instead of existing date of 1st July, provided that an employee shall be entitled to only one annual increment on either one of these two dates depending on the date of appointment, promotion or grant of financial up-gradation.</li></ul>



<ol class="wp-block-list" start="5"><li><strong>Promotion: –</strong></li></ol>



<p>&nbsp; When an individual gets a promotion, his new pay on promotion would be fixed in the Pay Matrix as follows:</p>



<p>On promotion, he would be given a notional increment in his existing Academic Level of Pay, by moving him to next higher cell at that level. The pay shown in this cell would now be located in the new Academic level corresponding to the post to which he has been promoted. If a cell identical with that pay is available in the new level, that cell shall be the new pay; otherwise the next higher cell in that level shall be the new pay of the employee. If the pay arrived at in this manner is less than the first cell in the new level, then the pay shall be fixed at the first cell of that level.</p>



<ol class="wp-block-list" start="6"><li><strong>Career Advancement Scheme (CAS): –</strong></li></ol>



<p>  Stages of promotion under the CAS of incumbent and newly-appointed Assistant Professors/Associate Professors/ Professors shall be as per the eligibility and CAS Promotion Criteria prescribed in para 2.9 and para 5.2 of AICTE Notification No. 61-1/RIFD/7th CPC/2016-17 dated 01.03.2019.</p>



<ol class="wp-block-list" start="7"><li><strong>Incentives for Ph.D and other higher qualifications: –</strong></li></ol>



<p>&nbsp; Incentives for Ph.D and other higher qualifications shall be applicable as prescribed in&nbsp;<strong>para 2.22</strong>&nbsp;of AICTE Notification No. 61-1/R IFD/7th CPC/2016-17 dated 01.03.2019.</p>



<ol class="wp-block-list" start="8"><li><strong>Service conditions and other allowances as applicable to Central Govt servants: –</strong></li></ol>



<p>For all matters of service conditions and other allowances other than those mentioned in the foregoing paragraphs, namely pay scales, incentives for Research Qualifications and upward movements under CAS, the Civilian Professorial Staff will continue to- be governed by the rules applicable to Defence Civilians in other Defence Establishments.</p>



<ol class="wp-block-list" start="9"><li><strong>Date of implementation of revised&nbsp;</strong><strong>pay&nbsp;</strong><strong>and allowances and&nbsp;</strong><strong>payment of</strong>&nbsp;<strong>arrears:</strong></li></ol>



<ul class="wp-block-list"><li>The revised Pay and revised rates of Dearness Allowance under this scheme shall be effective from 01.01.2016.</li><li>Other allowances such as Leave Travel Concession, Special Compensatory Allowances, Children’s Education Allowance, Transport Allowance, House Rent Allowance, Deputation Allowance, House Building Allowance, Travelling Allowance shall be applicable from the date as notified by the Central Government/respective State and UT Government from time to time.</li><li>Payment of arrears shall be made during the financial yea r e. 2020-2 1, after deduction of admissible income tax.</li><li>An undertaking shall be taken from every beneficiary under this scheme to the effect that any excess payment made on account of incorrect fixation of pay in the revised Pay Level or grant of inappropriate Pay Level and Pay Cells or any other excess payment made shall be adjusted against the future payments due or otherwise to the beneficiary.</li></ul>



<ol class="wp-block-list" start="10"><li><strong>Recruitment&nbsp;</strong><strong>Rules</strong><strong>:&nbsp;</strong>–</li></ol>



<p>&nbsp; Appointment/recruitment to all posts of Civilian Professorial Staff will be carried out as per the qualifications prescribed under the AICTE Scheme for the respective posts. The concerned Headquarters/Directorates may review the RRs to be in line wit h AICTE scheme.</p>



<ol class="wp-block-list" start="12"><li>Further modifications/amendments, if any to the MHRD scheme of revision of pay of teachers as per 7th CPC issued vide MHRD letter No. 1-37/2016-TS.ll dated 01.2019 read with their letter of even number dated 29. 01.2019 and AICTE Regulations notified vide AICTE Notification No. 61-1/RIFD/7th CPC/20 16-17 dated 01.03.2019 shall be applicable automatically to the teachers/ Civilian Professorial Staff of the above mentioned Defence Technical Colleges.</li><li>Anomalies, if any, in the implementation of this Scheme may be brought to the notice of the concerned Headquarters/ Directorates for clarification/ decision of the Central Government.</li><li>Any clarifications on points other than pay and allowances will be provided by the concerned Division(s) dealing with the subject(s).</li><li>This issues with the approval of Ministry of Finance (Deptt. of Expenditure) vide their UO Note 10(18)/E. 111(8)/2017 dated 23.11.2020 and concurrence of Defence (Finance) (AG/PA) vide their ID No. 1(48)/201 O-AG/PA/59 dated 24 .11.2020.</li></ol>

<h3 class="wp-block-heading">Sub: Implementation of recommendation of 7th CPC &#8211; Para 11.12.140 &#8211; Grant of Grade of Rs. 5400 (PB2) i.e. Level 9 of Pay Matrix in case of Assistant Accounts Officer of Defence Accounts Department of Ministry of Defence.</h3>



<p>Sanction of the Gol, Ministry of Finance, Department of Expenditure on the above subject conveyed vide its OM No. F.No. 25-2/2017-IC/E.III(ii) dated 06.11.2020 is hereby communicated. The OM has been issued in pursuance of the recommendations of <strong><a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">7th CPC</a></strong> as contained in para 11.12.140 of the Report and Government Resolution No. G.I, M.F. No. 1-2/2016-IC dated 25th July 2016.</p>



<h4 class="wp-block-heading"><strong><a href="https://centralgovernmentnews.com/7th-pay-commission-revised-pay-matrix-table-for-central-government-employees-pay-matrix-level-9/" target="_blank" rel="noreferrer noopener">7th Pay Commission Revised Pay Matrix Table for Central Government Employees &#8211; Pay Matrix Level 9</a></strong></h4>



<p>2. In accordance with the ibid OM, the revised pay scale of the post of Assistant Accounts Officer in <strong><a href="https://centralgovernmentnews.com/category/defence/" target="_blank" rel="noreferrer noopener">Defence</a></strong> Accounts Department would be in Level 8 of Pay Matrix and Level 9 on completion of 4 years in Grade Pay of Rs. 4800/- (PB-2)/ Level 8. This is a Non-Functional Upgradation (NFU), which is subject to the following terms and conditions:-</p>



<h4 class="wp-block-heading"><a href="https://centralgovernmentnews.com/macp-on-completion-of-10-20-30-years-of-service-or-10-years-of-service-after-previous-promotion-aaos-senior-auditor-adr-clerk-mts/" target="_blank" rel="noreferrer noopener"><strong>MACP on completion of 10/20/30 Years of Service or 10 years of service after previous promotion: AAOs, Senior Auditor, Adr, Clerk, MTS</strong></a></h4>



<ul class="wp-block-list"><li>(i) The grant of NFU will be admissible on completion of 4 years of regular service in the cadre from the date of joining as AAO. The aforesaid Non-Functional Upgradation (NFU) to AAQs is effective from 01.01 2016.</li><li>(ii) The NFU will be subject to vigilance clearance. While issuing orders, it may be ensured that none of circumstances for adoption of sealed cover procedure exists and the official is not undergoing any penalty under CCS (CCA) rules 1965.</li><li>(iii) The orders for grant of Non-Functional Upgradation to AAOs shall be issued by the Appointing Authority.</li><li>(iv) Benefit of Pay Fixation as per Rule 13 of CCS (Revised Pay) Rules 2016 shall be available at the time of grant of Non-Functional Upgradation to AAOs. Option for pay ‘fixation may be exercised within one month of issue of orders for grant of NFU.</li><li>(v) After the grant of NFU to AAOs in Pay Level-9 and their pay fixation under Rule 13 of CCS (RP) Rules 2016, there will be no further pay fixation on promotion to the post Accounts Officer in Pay Level-9.</li><li>vi) NEU will be reckoned for financial upgradation under Modified Assured Career Progression scheme (MACPS). Subsequent financial upgradation under MACPS, if any, is to be reckoned from the date of grant of NFU.</li></ul>

<p>Sub: <strong>Recruitment against Cultural/ Scouts and Guides Quota &#8211; Master Circular.</strong></p>



<p>Pursuant to the issue of the Master Circular No. 7190 dated 22.10.1990, instructions have been amended and new orders issued on the policy regarding recruitment against Cultural/ Scouts and Guides Quota. Instructions issued from time to time on the above subject have now been consolidated below for the information and guidance of all concerned.</p>



<p>2. <strong><span style="text-decoration: underline;">Recruitment against Scouts &amp; Guides Quota in Level &#8211; 1 and Level &#8211; 2 of 7th CPC Pay Matrix.</span></strong></p>



<p>(i) The annual quota for recruitment on Scouts and Guides has been fixed by this Ministry on the Zonal Railways and Production Units as below:</p>

<p><strong>Note</strong>: Northern Railway will recruit additional 1 per year in Level -2 of 6th CPC Pay Matrix (6th CPC GP 1900) and 2 per year in Level-1 (<a href="https://centralgovernmentnews.com/category/6cpc/" target="_blank" rel="noreferrer noopener" aria-label="6th CPC (opens in a new tab)">6th CPC</a> GP 1800) who will be posted in Research Designs &amp; Standards Organisation (ROSO), not to be utilized elsewhere.</p>



<p>(ii) Recruitment should be done at the Zonal Administrative For this, each Zone should conduct the recruitment by clubbing the requirement/ quota fixed for all their respective divisions as well as Production Units (which are also districts under their respective zones), falling within their territorial jurisdiction. This should be done by way of open advertisement following the procedure laid down vide this Ministry’s letter No. E(NG)II/96/RR-1/62 dated 17.09.98.</p>



<p>(iii) The recruitment will be done only in Level -2 of <a href="https://centralgovernmentnews.com/tag/7th-cpc-revised-pay-matrix-table/" target="_blank" rel="noreferrer noopener" aria-label="7th CPC Pay Matrix (opens in a new tab)">7th CPC Pay Matrix</a> (6th CPC GP 1900/-) and Level -1 of 7th CPC of Pay Matrix (6th CPC GP 1800/-).</p>



<p>(iv) The educational qualification and age limit for consideration for appointment against the quota will be the same as applicable for direct recruitment to Level -2 &amp; Level-1  Examination Fee may be charged @ Rs.500/- (Rupees Five Hundred) per candidate with the provision for refunding Rs.400/- to candidates actually appearing in the written examination. However, for candidates belonging to SC/ ST/ Ex-Serviceman/ Persons with Benchmark Disabilities (PwBDs), Women, Minorities and Economic Backward Classes Rs.250/- will be charged , with a provision for refunding the same to those who appear in the written examination.</p>

<p>(v) Power for Recruitment of Scouts and Guides quota shall lie with the General Application shall be called separately for Level-2 (6th CPC GP Rs.1900/-) and Level-1 (6th CPC GP 1800/-). The selection shall also be conducted separately . A candidate may apply both for Level-2 and Level-1.</p>



<p>(vi) The following qualification would apply for the recruitment of Scouts &amp; Guides to posts in Level-2 and Level-1.</p>



<ul class="wp-block-list"><li>A President Scout/ Guide/ Rover/ Ranger Or Himalayan Wood Badge (HWB) holder in any section;</li><li>Should have been an active member of Scouts Organization for the last 5 years. The &#8216;Certificate of Activeness&#8217; should be as per Annexure-1; and</li><li>Should have attended two events at National level <strong>OR</strong> All Indian Railways&#8217; level <strong>AND</strong> Two events at State</li></ul>



<p>(vii) The candidate , who apply in response to the notification and are found eligible for consideration for appointment against Scout &amp; Guides quota, should be assessed on the basis of following criteria :</p>

<p>(viii) For selection in Level-2, the recruitment committee shall consist of three Senior Administrative Grade (SAG) officers to b nominated by the General Manage For the selection in Level-1, the General Manager of Zonal Railways/ PUs may re-delegate the power for nomination of Junior Administrative Grade (JAG) Committee and acceptance of recommendation/ approval of panel for recruitment against Scouts &amp; Guides Quota for the Post of Level-1 of 7th CPC Pay Matrix (erstwhile Group ‘D’ posts) to PCPO of Zonal Railways/ PUS. For selection in Level-1, the committee shall consist of three Junior Administrative Grade officers. One of them should be an officer holding honorary post of Commissioner in Scouting/ Guiding organization in the committee of a Zone/ Division/ unit other than the one conducting the recruitment. One of the three members should be necessarily be from the Personnel department.</p>

<p>(ix) A written declaration will be obtained from all the candidates who finally qualify for appointment as per Annexure-III. If the candidate violates any of the said declarations furnished by him/ her, he/ she should be taken up for D&amp;AR by the concerned CPO/ Senior DPO on the recommendation of State Chief Commissioner/ District Chief Commissioner, as the case may</p>



<p>(x) Higher fixation of pay will not be admissible to a person appointed against Scouts &amp; Guides Quota</p>



<p>(xi) The persons appointed against Scouts &amp; Guides quota to the category of Clerks will be required to possess proficiency in typing within a period of two years from the date of their appointment, and their appointment will be provisional subject to the prescribed typing qualification within the stipulated In case of non­ acquisition of typing skills within the prescribed period, no additional time will be given and services of such candidate will be summarily terminated.</p>



<p>(xii) The Candidates selected for appointment under the Scout &amp; Guide quota should be posted by the competent authority in consultation with the concerned State Chief Commissioner/ District Chief</p>



<p>(xiii) It may be noted that instead of notifying the posts against this quota as unreserved (UR), this should be mentioned as open to all candidates and candidates belonging to SC/ ST/ OBC Categories who apply against notification published for this quota be extended relaxation in age limit as admissible in a general open market recruitment. However, in case of being selected with any relaxation on account of being a candidate from the above categories, he/she will be taken against reserved roster point.</p>



<p>(xiv) The field units are directed that they should finalize and fill up the posts against this quota during the respective financial year without fail.</p>

<h4 class="wp-block-heading">3. Recruitment against Cultural Quota posts in Level-2 and Level-1 of 7th CPC Pay Matrix.</h4>



<p>(i) The annual quota for recruitment on Cultural quota has been fixed by this Ministry on the Zonal Railways</p>

<p>(ii) Recruitment should be done by the Railway Administration themselves</p>



<p>(iii) The recruitment against the quota should be done by open advertisement, following the procedure laid down in this Ministry&#8217;s letter N E(NG)II 96/ RR-1/62 dated 17.09.98.</p>



<p>(iv) The educational qualifications for consideration for appointment against the quota will be the same as applicable for recruitment to &#8216;Level 2&#8217; categories .</p>



<p>(v) The recruitment will be done only in the Level 2 of 7th CPC Pay Matrix.</p>



<p>(vi) Age limit as applicable for recruitment to other equivalent categories shall be follow</p>



<p>(vii) The following qualifications would apply for recruitment to level-2 posts against Cultural</p>



<p><strong>Essentials</strong>:</p>



<ul class="wp-block-list"><li>Educational Qualification: The minimum qualification prescribed for Level 2</li><li>Possession of degree/ diploma/ certificate in Music/dance/drama etc. from Recognized institute</li></ul>



<p><strong>Desirable:</strong></p>



<ul class="wp-block-list"><li>Experience in the field and performance given on AIR (Air India Radio) / Doordarshan</li><li>Prizes won at National</li></ul>



<p>(viii) The candidates who apply in response to notification issued and are found eligible for consideration for appointment against Cultural Quota should be assessed on the following basis.</p>

<p>(ix) The Recruitment Committee shall consist of three members to be nominated by the General Manger; which will include one SAG officer from personnel department , second SAG officer from any other department and an outside member of appropriate standing in the relevant field or a faculty member of any recognised University/Cultural Institution or a representative from Doordarshan/AIR (All India Radio) etc as the third</p>



<p>(x) Higher Fixation of pay will not be admissible to persons appointed against Cultural Quota.</p>



<p>(xi) The persons appointed against Cultural quota to all the categorises of Clerks will be required to possess proficiency in Typing within a period of two years from the date of appointment and their appointment will be provisional subject to acquiring the prescribed typing qualification within the stipulated (Board’s letter No. E(NG)II/98/RR -2/7 dated. 03.03 .1999).</p>

<p>4. This Ministry have no objection for the recruitment of more Scouts &amp; Guides, if suitable person are available, within the overall ceiling limit for cultural-cum-Scouts and Guides Quota referred in para 2 above.</p>

<p>5. <strong>General :</strong></p>



<p>(a) While referring to this Circular, the original letters referred to herein should be read for a proper This circular is only a consolidation of the instructions issued so far and should not be treated as a substitution to the originals. In case of doubt, the original circular should be relied upon as authority.</p>



<p>(b) The instructions contained in the original circulars referred to shall have only prospective effect from the date of issue unless specifically indicated otherwise in the concerned circular. For Dealing with old cases, the instructions in force at the relevant time should be referred to; and</p>



<p>(c) if any circular on the subject, which has not been superseded, has not been taken into consideration while preparing this consolidated letter, the said circular, which has been missed through oversight should be treated as valid and Such a missing circular, if any, may be brought to the notice of the Railway Board.</p>

<p><strong>Group D/Pay matrix Level 1 vacancies in Railways for disabled canditates (Divyangjans)</strong></p>



<ul class="wp-block-list"><li>&nbsp;Total Vacancies reserved for Disabled candidates (Divyangjan) were 
revised upwards by Railways from 729 to over 2400 with around 600 for 
each of the 4 Disability categories of LD, VI, HI and MD.</li><li>&nbsp;&nbsp;&nbsp; There were total about 1.87 crore applicants. Written Exams (Computer-based 100% objective in 15 languages)</li><li>&nbsp;&nbsp;&nbsp; Around 1,55,000 (1.55 lakhs) Disabled candidates took the exam 
for the around 2400 posts notified as reserved for such candidates.</li><li>&nbsp;&nbsp;&nbsp; Around 34000 Disabled candidates scored above this threshold qualifying limit </li></ul>

<p><strong>Clarification by Ministry of Railways regarding Recruitment of Divyangjans on Gr-D/Level-1 Vacancies</strong></p>



<p>There
 is recent and continuing sit-in by Disabled persons (‘Divyangjan’) at 
Mandi House in Delhi regarding some issues for Level-1 jobs in the 
Railways for Divyangajans. At the outset, on this sensitive matter, it 
is categorically stated that insofar as Divyangjan candidates are 
concerned, Railways have ensured that notification of the required 
number of reserved vacancies, conduct of the entire recruitment 
exercise, and filled up of posts meant for Divyangjan have been not only
 transparent and fair, but also in accordance with statutory provisions 
and the law of the land in this regard. Nevertheless, necessary details 
with regard to the whole issue are brought out below.</p>



<p>
<strong>Background</strong></p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; A centralized 
notification (CEN 02/18) for around 63000 Level-1 vacancies for all 
Railway zones across Indian Railways was issued in Feb’18 by Railway 
Recruitment Boards.</p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; This notification had 
initially 729 vacancies for Disabled in 3 Categories- Orthopaedic, 
Visual, and Hearing Disabled. The major chunk of vacancies was notified 
for Orthopaedically Disabled, based on job &amp; suitability 
requirements of the posts advertised. Candidates could apply to be 
considered for vacancies of one of the 16 Railway zones of their choice.</p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;
 An organization of visually impaired persons filed a PIL in Hon’ble 
Delhi High Court in Feb’18. In the meantime, the revised Disabilities 
Act, 2016 had been enacted by then and notified by the Department of 
Personnel &amp; Training of the Govt. of India in Jan 2018. In terms of 
this Act, the total vacancies to be reserved for Persons with Benchmark 
Disabilities (PwBD) was revised upwards to 4%, with prescribed 
bifurcation among Disability categories.</p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In 
compliance of Court hearings and directions in the case, the provisions 
of this revised Disabilities Act was made applicable to the CEN 02/2018 
recruitment exercise as well. This meant that 4% vacancies had to be 
kept reserved for Disabled candidates. As specified in the Act, this was
 to be distributed equally as 1% each among 4 Disability Categories – 
Locomotor Disability (LD) that was earlier called Orthopaedic; Visually 
Impaired (VI), Hearing Impaired (HI), and an added Disability category 
of Multi-Disability (MD). MD would include candidates suffering from 
more than one Disability among the other three, as defined by medical 
benchmark standards.</p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Accordingly, total 
Vacancies reserved for Disabled candidates (Divyangjan) were revised 
upwards by Railways from 729 to over 2400 with around 600 for each of 
the 4 Disability categories of LD, VI, HI and MD.</p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;
 In the meantime, a window of one month was provided on February 28, 
2018 for candidates to apply because of the applicability of the revised
 Disability Act.</p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; There were total about 1.87 
crore applicants. Written Exams (Computer-based 100% objective in 15 
languages) were conducted in the latter part of 2018. Around 1,55,000 
(1.55 lakhs) Disabled candidates took the exam for the around 2400 posts
 notified as reserved for such candidates. All prescribed facilities 
such as scribes, extra time, careful seating arrangements etc. were 
arranged for Disabled candidates. Minimum qualifying/cut-off threshold 
scores that were 40 for General candidates and 30 for SC/ST/OBC 
candidates were relaxed by 2 marks to 38 and 28 respectively for 
Disabled candidates. Around 34000 Disabled candidates scored above this 
threshold qualifying limit. Based on number of vacancies and their merit
 position in the particular Disability category in that Railway, 
commensurate number of qualified candidates were called for Document 
Verification and medical examination, prior to being offered 
appointment. Against those who are either absent or have not cleared 
verification of Documents and meeting the medical standards as per their
 Disability, candidates next in line as per merit have been called. So 
far, around 1025 Disabled candidates have already been selected for 
appointment. As authenticity of certificates and determining of medical 
status is taking additional time in the case of some Disabled 
candidates, this number of 1025 will go up in the coming weeks.</p>



<p><strong>Sequence of Events</strong></p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;
 Last month, some protesters under a banner “Toshiyas” did a sit-in in 
Delhi for 3 days from Oct 23-Oct 25, 2019. Apart from generic grievances
 regarding Government policy of reservation for Disabled categories and 
how this should be implemented in recruitments, they had also alleged 
irregularities in individual cases due to which they were aggrieved that
 meritorious Disabled candidates had not been selected.</p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;
 A detailed three-way discussion with the protesters, senior Railway 
officers and senior officers of the Ministry of Social Justice was 
chaired by Secretary, M/o Social Justice on 24 Oct 2019.</p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;
 On 25th October, the Court of Chief Commissioners of Persons with 
Disabilities (CCPD) heard the Petitioners and took their submissions on 
record. The Railways’ position and point-wise clarifications were also 
taken on record, following which the Court passed orders the same 
evening. These orders directed display of cut-offs for each Disability 
category not only on the respective Railway Recruitment cell websites of
 each Railway zone, but also on the Railway Board website. Directions to
 Railway zones to expedite the process, ensuring that no non-Divyangjan 
was appointed to a Divyangjan-reserved post, and careful consideration 
of any list of individual candidates’ grievances to be furnished by the 
Petitioner were also given.</p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The directions 
above were complied by Railways and compliance report also sent to the 
Court (CCPD), with a copy to the Petitioner.</p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 
After a specific request by Railway Board’s office, the Petitioner in 
the case at CCPD furnished a list of around 184 candidates across 10 
Railway zones, who, it was claimed, had not been selected even though 
they had qualified as per merit.</p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The list was 
carefully examined by Railways Administration and it was found that 
around 21 of the 184 had not secured the relaxed threshold cut-off/ 
qualifying score of 38 (for UR) or 28 (for SC/ST/OBC). The around 163 
others had crossed this minimum threshold but were far short in terms of
 merit score when compared to the last such candidate selected&nbsp; in that 
Disability category by that Railway zone. This detailed position in 
respect of the entire list submitted by him was sent to the Petitioner.</p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;
 On Ministry of Railways’ own initiative, a further detailed follow-up 
meeting with the main Petitioner and several of the original protesters 
was again held at Patna on 23rd November 2019 with senior officers of 
the Board to collect any residual grievances.</p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 
Again some protesters under a fresh banner have suddenly gone on a 
sit-in since 26th November. These protesters were part of the earlier 
group, but have now reportedly splintered/broken away and have sat on 
this dharna.</p>



<p>·&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Two more attempts at resolving 
the matter through discussions with senior Railway officers have failed 
first at Rail Bhawan on 26th Nov evening, and the second at the protest 
site on 27th evening, as the protesters are sticking to their demand of 
being given jobs in Railways irrespective of their merit position, 
Disability category, and vacancies notified in the Railway zone they 
have chosen.</p>



<p><strong>Railways’ position on issues raised by the Protesters</strong></p>



<p>The demands pertaining to Level-1 recruitment cover 5 broad aspects as under:</p>

<p>Any large competitive examination has to be conducted as per merit 
and as per statutory provisions. In a situation where around 2400 
vacancies are reserved for Divyangjan and there are 1.55 lakh Divyangjan
 applicants, it is clear that the end of the recruitment exercise will 
unfortunately result in around 1.53 lakh Divyangjan not making the cut. 
As long as those selected are strictly as per merit for that Disability 
category and that Railway zone, the process should be accepted by all 
stakeholders. The point about whether the present 1% distribution of 
vacant posts across the 4 Disability categories is equitable considering
 the relative populations/number of applicants in each Disability is a 
larger policy issue involving other Ministries of the Government of 
India and other expert bodies. Railways cannot act unilaterally in the 
matter. As things stand, the Railways are bound to follow statutory 
provisions as notified. Any specific irregularities/grievances, if 
pointed out, will be promptly examined and corrective action, if 
necessitated, taken. This has been repeatedly emphasized to the 
protesters. The Railways continues to remain committed to the cause of 
Divyangjans.</p>



<p>It is also relevant to mention that 
another group of Disabled persons under a different NGO has already gone
 to Hon’ble Delhi High Court raising similar issues as these protesters.
 Matter is sub judice there. Indian Railways will respect the judicial 
verdict in the matter, as and when it is delivered.</p>

<p>Subject: <strong>Fixation of pay of disabled/medically unfit running staff on being appointed against alternative (stationary) posts in revised (7th CPC) pay structure</strong></p>



<p>As the Zonal Railways am aware, pay of medically unfit Railway servants while absorbing them in alternative post is presently fixed as per instructions contained in Board&#8217;s letter No.E(NG)I-2008/RE-3/4 dated 30.04.2013. These provisions provides that while determining pay in Pay Band for the purpose of fixation of pay of medically unfit running staff in alternative (stationary) post, an amount equal to such percentage of basic pay (pay in Pay Band + Grade Pay) representing pay element of running allowance as may be in force from time to time may be added to the existing pay in Pay Band and the resultant figure (ignoring the fraction of rupee, if any) rounded off to the next multiple of 10, would be the pay in the Pay Band in the alternative post with no change in the Grade Pay of substantive post, in suitable alternative post.</p>

<p>2. The above issue of pay fixation of medically disabled / unfit running staff on such circumstances in pursuance of the 7th CPC regime has been under consideration of Board. It is pointed out that upto and including the 5th CPC pay regime, the pay scales had fixed stages and method of pay fixation of such running staff was governed in terms of para Nos. 1307 and 1308 of Board’s letter No.E(NG)I-96/RE-3/9(2) dated 29.04.1999. With the restoration of fixed and defined pay intervals in the form of distinct cells within each pay level in the 7th CPC pay matrix, it is clarified that the principles of pay fixation enunciated in Board’s letter ibid which will now hold good. This means that while fixing the pay of a medically decategorised running staff in an alternative stationary post if the resultant pay (after 30% addition) does not correspond to any cell, in the same pay level, then the pay will be fixed in the next &#8211; below cell of the same pay level and difference in pay will be protected as personal pay which will be adjusted in future increment (s).</p>



<p>3. It may also be noted that pay fixation as per para &#8211; 2 above will not apply for medical de-categorisation cases of 6th CPC regime, covered under Board’s letter dated 30.04.2013 referred to at para 01 above.</p>



<p>This issues with the concurrence of Finance Directorate of Ministry of Railways.</p>

<p>Subject: <strong>Grant of Dearness Allowance to Central Government employees- Revised Rates effective from 1.7.2019.</strong></p>



<p>The undersigned is directed to refer to this Ministry&#8217;s Office Memorandum No, 1.11/2019-E II (B) dated 27th February, 2019 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 1<strong>2% to 17% of the basic pay with effect from 1st July, 2019</strong>.</p>



<p>2. The term &#8216;basic pay&#8217; in the revised pay structure means the pay drawn in the prescribed Level in the <strong>Pay Matrix</strong> as per 7th CPC recommendations accepted by the Government, but does not include any other type of pay like special pay, etc.</p>



<p>3. The Dearness Allowance will continue to be a distinct element of remuneration and will not be treated as pay within the ambit of FR 9(21).</p>

<p>4. The payment on account of Dearness Allowance involving fractions of 50 paise and above may be rounded to the next higher rupee and the fractions of less than 50 paise may be ignored.</p>



<p>5. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In respect of Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of ( Railways, respectively.</p>



<p>6. In so far as the employees working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.</p>
