<p>Sub: <strong>Minimum educational qualification for recruitment of staff from open market in Level-l of the pay matrix of 7th CPC.</strong></p>
<p>Attention is invited to instructions issued, vide this Ministry’s letter under RBE No. 129/2013 dated 09.12.2013, laying down qualification for recruitment of staff from open market to posts in Pay Band-1 of Rs. 5200-20200 having Grade Pay- 1800/- (now Level-l of the pay matrix of 7th CPC), through all modes, against direct recruitment quota as 10th pass or ITI or equivalent or National Apprenticeship Certificate (NAC) granted by NCVT.</p>
<p>2. The qualifications have further been reviewed and it has been decided by Board that the minimum educational qualification for recruitment of staff in Level-l of the pay matrix of 7th CPC (earlier Grade Pay Rs 1800/-) in Civil Engineering, Mechanical, Electrical and S&amp; T departments from open market, through all modes, will henceforth be as under:-</p>
<blockquote>
<p align="center"><strong>10th pass plus National Apprenticeship Certificate (NAC) granted by NCVT<br />
</strong><strong>OR<br />
</strong><strong>10th pass plus ITI.</strong></p>
</blockquote>
<p>3. For all other departments of the Railways, the minimum educational qualification will continue to be the same as mentioned in para-1 above.</p>
<p>4. Cases already under process will continue to be dealt in terms of earlier instructions.</p>

<p><strong>Sub: Option for pay fixation in the 7th CPC Pay Matrix level to the Railway employees </strong><strong>promoted during the period 01.01.2016 to 31.12.2016.</strong></p>
<p>Please refer to your letter No. IV/NFIR/7th CPC(Imp)/2016/R.B./Part I dated 06.01.2017, wherein it has been demanded that opportunity for revision of option for those staff promoted after the date of notification of RS(RP) Rules, 2016 (i.e 28.07.2016) and also for those staff promoted between 01.01.2016 and 31.12.2016 to switch over o 7th CPC Pay Matrix from the date subsequent to date of Railway Board’s notification be provided.</p>
<p>2. In this context it is stated that option for switching over to 7th CPC has been circulated and clearly specified under Rule 5 of RS(RP) Rules, 2016. Further, instructions for exercising the ,revised option in respect of officials who had Promotion/financial upgradation and had already exercised the option between the date of,effeet of recommendation (01.01.2016) and date of promulgation of RS(RP) Rules, 2Q3.6 ( 2016) has also been issued vide Board’s letter RBE No 124/2016 dated 20.10.20,16.1t, has already been notified under Rule 5 of RS(RP) Rules and further in the option form ctrculated along with RS(RP) Rules that the employee can elect to continue on ay Aa d and Grade Pay of his substantive/officiating post until the date of his next increment  at any subsequent increment raising he pay to particular limit or from the date of his promotion/upgradation.</p>
<p>3.Form the above, it can be appreciated that employee can continue such time, till<br />
promotion or vacation of the post and no cut off date (like 31.12.2016 mentioned in the reference) has been specified. However, the option exercised is final and one time dispensation has been extended to those promoted between 01.01.2016 and 28.07.2016 can not be extended in other cases. Decision on permitting further revision of option once taken can not belaken unilaterally by Ministry of Railways alone and needs to be taken by Ministry of Finance as it is a general policy matter pertaining to all Government employees.</p>

<p>Following the notification of Railway Services (Revised Pay) Rules, 2016, Railway Board has received references seeking clarifications regarding various aspects of fixation of pay in the revised pay structure as also pay fixation and grant of increment in future under revised pay structure. These matters have been considered by Ministry of Finance and the points of doubts are clarified as under:-</p>

<td width="50%">As per the provisions of FR 22 (I)(a)(1), the Government Servants (other than those appointed on deputation to ex- cadre post or ad-hoc basis or on direct recruitment basis) have the option, to be exercised within one month from the date of promotion, to have the pay fixed under this rule from the date of such promotion/appointment or from the date of next increment.Some    of  the  employees,  promoted between  01.01.2016   and the date of notification of RS(RP) Rules, 2016 had opted for their pay fixation  on promotion/financial up-gradation under MACPS from the date of their next increment in the lower grade. Consequent upon notification of RS(RP) Rules, 2016 i.e. 28th July, 2016, the option submitted by such employees has now turned out to be disadvantageous.</p>
<p>Whether such employee may be allowed to revise their option under FR 22 (l)(a)(1) at this stage.</td>
<td width="42%">Under the changed circumstances after notification of RS(RP) Rules, 2016, the employee   may   be  allowed to exercise   revised     option   for fixation   of     pay  under    FR 22(I)(a)(1). Such   revised  option shall    be  exercised  within   one month   of  issue    of   this  letter. Option so revised shall be final.</td>

<p><strong>Sub: Grant of pay fixation under 7th CPC Pay Matrix level to the RRB empanelled candidates who have completed training &#8211; case of SSEs (S&amp;T)-reg.</strong></p>
<p>Representations have since been received that RRB empanelled candidates for the post of SSE (S&amp;T) have completed the prescribed induction training on 1st June 2016 particularly on North Central Railway, but however, they have not been granted pay fixation in 7th CPC Pay Matrix till date. It has further been represented by the recruitees that similarly recruited candidaies as SSE, P. Way, C&amp;W etc., have already been granted pay fixation 7th CPC Pay Matrix. The discrimination against directly recruited SSEs (S&amp;T) has been causing disappointment and resentment among them, who feel that the Administration has been indifferent towards their entitlements of 7th CPC Pay Matrix.</p>
<p>NFIR, therefore, requests the Railway Board to kindly intervene and issue suitable instructions to the GMs of Zonal Railways (more particularly General Manager, N.C. Railway) for ensuring that all such SSE (S&amp;T) trainees who have completed training are granted 7th CPC pay from the date subsequent to the date of completion of training without loss of time.</p>

<p>Ref: NFIR&#8217;s letter No. IV/NFIR/7 CPC (Imp)/2016/R.B. dated 24/26-08-2016 addressed to Railway Board.</p>
<p>Federation vide its letter of even number dated 24/26-08-2016 brought to the notice of Railway Board a case non-fixation of pay of staff working in Pay Band-1S/Rs. 4440-7440 in whose favour no orders have been passed for fixation of these staff pursuant to the implementation of the recommendations of 7th CPC. For the purpose the Federation cited Railway Board’s notification issued under RBE No. 90/2016 where there are no instructions for these staff.</p>
<p>In addition to above, Federation proposed to the Board to consider the skills and service experience gained by the staff, presently in- 1S, for considering placement in Level-I (Rs. 18000/-) of the</p>
<p>7th CPC Pay Matrix. Federation feels sad to point out that thereafter a period of over three months has passed there is no feed back with the result the employees have been made to suffer unnecessarily. A copy of Federation&#8217;s letter dated 24/26-08-2016 is enclosed for reference.</p>
<p>NFIR, thereofore, requests the Railway Board once again to take further necessary action and advise to the Federation only.</p>
