<h3 class="wp-block-heading">Subject: Pay fixation/placement of SCS/Non-SCS officers inducted to IAS consequent upon the implementation of 7th CPC recommendations &#8211; reg.</h3>

<p>Instructions have been issued from time to time regarding (A) pay fixation of IAS officers inducted from SCS/ Non-SCS consequent upon the implementation of 7th CPC recommendations; (B) methodology for fix ing the pay of those members of service, who have been inducted to IAS from SCS/ Non-SCS with seniority of 9 years or more in IAS and have not completed their MCTP Phase-III and; (C) stepping up of pay of senior member of All India Service vis-a-vis pay of his junior in the cadre. In order to bring clarity to the existing instructions and enable uniform implementation, an effort has been made to review, consolidate and reiterate the guidelines issued so far on the subject at one place.</p>



<h4 class="wp-block-heading"><strong>A. Pay fixation of SCS/Non-SCS officers inducted to IAS consequent upon the implementation of 7th CPC recommendations</strong></h4>



<p>2. The initial pay of an IAS officer promoted from SCS or appointed by selection from Non-SCS , as the case may be, shall be fixed at the relevant stage of the Senior Scale e. Senior Time Scale (Level 11), Junior Administrative Grade (Level 12) and Selection Grade (Level 13) based on seniority obtained by him, by protecting his State Pay. There is no provision of increment at the stage of initial fixation.</p>



<p>3. Consequent upon induction to IAS, promotion from one to another grade of IAS is considered as per extant provisions of IAS (Pay) Rules, 2016 read with IAS promotion guidelines.</p>



<p>4. In respect of fixation of pay of officers who were promoted/Selected in IAS through SCS/ Non-SCS respectively in Senior Time Scale/Junior Administrative Grade after 01.01.2016, the initial pay shall be fixed in the respective level of the Senior Scale i.e Level-11, 12 or 13 based on the year of allotment in the IAS. However, the pay drawn in the State Civil Services will be protected in the concerned Level.</p>



<p><strong>Illustration:</strong></p>



<p>5. Shri X who is drawing pay at 48920 (Rs.40220 [pay in the pay band + GP Rs.8700] is promoted/ selected to IAS on 04.03.2016. He is allotted 2010 batch. The pay on promotion/selection to IAS would be as under:</p>

<p>6. The pay of IAS officers who were promoted/selected in IAS through SGS/ Non-SGS respectively prior to 01 .01 .2016 will be converted as per 7th CPC on 01 .01.2016 and they shall be placed in the Level in the Pay Matrix in accordance with the length of service as per the allotment However, pay of those officers, who are due to get promoted to JAG/ Selection Grade of IAS on 01.01.2016 , will be first converted notionally on 01.01.2016 as per 7th CPC (i.e before promotion) and shall be placed notionally in the Level of Pay Matrix, in accordance with the length of service as per their allotment year, at the stage of the senior scale. On their actual promotion to JAG/ Selection Grade, the pay of these officers will then be fixed as per IAS (Pay) Rules, 2016 . That is, the officers will be eligible for two additional increments on their actual promotions to Level 12/ Level 13 after completion of 9/ 13 years of service in IAS respectively.</p>

<p>7. <strong>The provision contained in part (7) of Schedule-I of IAS (Pay) Rules,</strong> <strong>2016, which provides that Notwithstanding anything contained in these rules,</strong> <strong>the pay of a promoted officer or an officer appointed by selection, as the case may be, shall not at any time exceed the basic pay which he would have drawn as a direct recruit on that date if he had been appointed to the Indian Administrative Service on the date on which he was appointed to the State Civil Service or in a Gazetted post in the non-State Civil Service, after attaining the age of twenty five years, as the case may be” shall be adhered to.</strong></p>



<p><strong>B. Guidelines regarding methodology for fixing the pay of those members of service, who have been inducted to IAS from SCS/Non-SCS with seniority of 9 years or more in IAS and have not completed their MCTP Phase-III.</strong></p>



<p>8. The provisions regarding MCTP-111 in IAS (Pay) Rules, 2016 are as under:</p>



<p>“Provided that a member of the service shall be appointed to the Junior Administrative Grade only after he has completed phase Ill mandatory Mid Career Training Programme with effect from the date on which he would have been eligible for appointment in the Junior Administrative Grade if not for completion of the mandatory Mid Career Training Programme.”</p>



<p>The above provisions stipulate for completion of MCTP-III for promotion of IAS officers from Senior Time Scale (STS) to Junior Administrative Grades (JAG). However, there may be situations where IAS officers appointed&nbsp;<em>/&nbsp;</em>selected from SCS&nbsp;<em>/&nbsp;</em>Non-SCS with a seniority of 9 years &nbsp;or more as per provisions of &nbsp;IAS (Regulation of Seniority) Rules, 1987, ARE REQUIRED TO BE placed directly in Junior Administrative Grade of IAS in the light of the instructions mentioned in para 2 to 7. In such situations , provisions regarding MCTP-III cannot extend to such officers, ipso-facto.</p>



<p>9. It has also been noticed that though the instructions mentioned in para 2 to 7 above comprehensively covers the matters pertaining to fixation of pay and grant of grade in IAS, on induction to IAS on being appointed&nbsp;<em>/&nbsp;</em>selected from SCS&nbsp;<em>/&nbsp;</em>Non­ SCS, there may arise certain doubts due to extant provisions regarding MCTP III which inter-alia provides it to be one of the criterion for considering IAS officers for promotion to the JAG.</p>



<p>10. Accordingly, it is clarified that as per the provisions contained in the instructions mentioned in para 2 to 7 above, the members of service having attained seniority of 9 years or more are eligible to be directly placed in Level 12 (JAG) on their induction to IAS on being appointed&nbsp;<em>/&nbsp;</em>selected from SGS&nbsp;<em>/&nbsp;</em>Non-SGS, in the manner explained &nbsp;in the said &nbsp; Further, while doing so, the &nbsp;State Government shall ensure that such members of service shall be relieved to attend said MCTP-III in the first instance of nomination for the purpose and it shall be explicitly stipulated in the order itself that such members of service will have to mandatorily complete their training on being nominated for the same, failing which their promotion to next higher grade will be affected .</p>



<h4 class="wp-block-heading"><strong>C. Guidelines regarding stepping up of pay of senior member of All India Service vis-a vis- of his junior in the cadre-reg.</strong></h4>



<p>11. The matter regarding anomalies in the pay of senior members of All India Service vis-a-vis pay of their juniors in the cadre who have been promoted to the Service or to a higher grade in the Service subsequent to the seniors, have been examined in this department and in this regard it is stated that such anomalies on account of fixation of pay on promotion, including the promotion from State Service to All India Service, can be solved by stepping up the pay of the senior member of Service at par with the pay of junior in the cadre from the date when the anomaly arose, subject to fulfillment of following conditions:</p>



<ul class="wp-block-list"><li>(i) Both junior and senior should belong to the same cadre both in lower and higher In the case of anomaly in the pay of officers promoted from State service to IAS/ IPS/ IFS in a State cadre, both junior and senior should belong to same cadre in the State Service (lower grade).</li><li>(ii) Anomaly must have arisen as a result of fixation of pay either on promotion from one grade to another grade in IAS/ IPS/ IFS or on promotion from State Service to IAS/ IPS/ IFS, as the case may be.</li><li>(iii) Posts in higher and lower grade must be identical and in lower grade senior must not be drawing less pay than junior for whatsoever reasons.</li></ul>



<p>For example if the junior officer draws higher rate of pay than the senior in the lower post or State service post by virtue of advance increments or on any other account, the above provisions will not be invoked to step up the pay of the senior officer.</p>

<p>Reference: (i) PCDA, Bangalore 5 letter no. Pay Tech/Pay fix com dated 14-05-2018, 91-12-2018 and 16-07-2021<br />(ii) CDA secunderabad’s letter no paytech/ 4024/CGDA Corr dated 20-02-2018 and 07-07-2021</p>



<p>The issue of the mode/ methodology of pay fixation and subsequent DNI on the merger of posts of JSO and SSO-II in DGQA in terms of DGQA, New Delhi’s letter no. A/92163 /CR/ DGQA/ Adm-7B dated 98-03-2016 had been referred to the MoD for clarification.</p>



<p>2. In response, Mob/D (Civ-D) vide their noting dated 95-08-2020 forwarded DoE’s ID no. 03-04/2019-E-II.A dated 15-07-2020 (copies enclosed), which clarifies that the JSOs after their placement/ merger with the SSO-ll w.e.f. 08-03-2016, are not eligible for grant of annual increment on 01-07-2016. The issue was again referred to MoD for taking up the issue of method to be adopted for pay fixation on such merger of JSO to SSO-II in DGQA organization with Department of Expenditure for obtaining clarification On the same. MoD as per their noting dated 23-03-2021 has stated that DOPT vide their note 8 dated 20-06-2019 (copies enclosed) have clarified the point wherein at para 3 they have stated that since this present issue does not involve fixation of pay under Rule 13 of CCS (RP) Rules, 2016, the provision of pay fixation on option as enunciated in DOPT OM No. 13/92/2017-Estt(Pay-I) dated 27-07-2017 is not applicable in the present case as it involves merger/upgradation of posts consequent to Cadre Review.</p>



<p>3. As such, it is viewed that in such cases of merger of the post of JSO (GP Rs 4800/- in PB 2) with SSO-II (GP Rs 5400/- in PB 3), the pay MAY be regulated by mere placement of JSOs to the corresponding stage in level 10 of the pay matrix (Corresponding to GP Rs 5400/- in PB 3), i.e. the pay level of the past of SSO-II.</p>

<p>2. The proposal of M/o Defence regarding fixation of pay and of ascertainment of date of next increment upon merger of the posts of JSO and SSO as 4 result of cadre review in DGQA has been examined in this Department. It has been proposed to this Division to allow option for fixation of pay from the date of next increment so that the said merger/UP gradation of posts may prove to be financially beneficial to the employees.</p>



<p>3. In this context it is informed that this Division has issued guidelines on the methodology of fixation of pay On promotion to a post carrying higher responsibilities of greater importance of a Government Servant in case he opts to get his pay fixed under Rule 13 of CCS(RP)Rules, 2016 vide OM No.13/02/2017-Estt(Pay-I) dated 27th July, 2017 (pg.7-9/C). Since this present issue does not of pay under Rule 13, of CCS(RP) Rules, 2016, the provision of pay fixation on option as enunciated in OM ibid is not applicable in the present case as it involve merger/up-gradation of posts consequent to cadre review.</p>



<p>4. Further it is relevant to mention that provisions on accrual of increment laid under Rule 10 of CCS(RP)Rules, 2016 as well as matter relating to revision of pay and up gradation of posts in respect of Ministries/Department come under the domain of D/o Expenditure. Accordingly, any guidelines “for pay fixation on merger of post may be issued by MoD in consultation with D/o Expenditure in the light of extant instructions/guidelines on merger of posts as 4 result of cadre review in DGQA.</p>

<p>The reference of the Ministry of Defence referred to this Department vide MoD’s I.D. Note dated 19.08.2019 on pre-page on File number-12012/2/2016 AG/PB(Pt.I) regarding eligibility to get next increment by Junior Scientific Officer (JSO) drawing Grade Pay of ₹4800/-, PB-2(Level-8) after merger of the post w.e-f. 08.03.2016 with Senior Scientific Officer-II(SSO-II) having GP-5400, PB-3 (Level-10) in DGQA of Ministry of Defence has been considered in this Department.</p>



<p>2. Since JSOs were drawing pay in Level-8 of the Pay Matrix of the 7th CPC and after their placement/merger with the SSO-II w.e.f. 8.3.2016, they have been placed in the Pay Level-11 admissible to the post of SSO-II, they are not eligible for grant of annual increment on 01.07.2016 as the post to which the increment was due on 01.07.2016 got changed. Such employee will accrue next increment on 01.01.2017 in accordance with the provisions of the Rule-10 of the GCS(RP) Rules.</p>

<p>I am directed to refer to references being received from the various Ministries / Departments of Central Government and from the State Governments, on the above-mentioned Subject and to say that Rule 4 (A) (ii) (a) &amp;(b) of AS (Pay) Rules, 2016 state that:</p>



<h4 class="wp-block-heading"><strong><a href="https://centralgovernmentnews.com/7th-cpc-pay-fixation-method-for-all-central-government-employees-with-illustration/" target="_blank" rel="noreferrer noopener">7th CPC Pay Fixation Method for all Central Government Employees with Illustration</a></strong></h4>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>“(a) where, in the fixation of pay, the pay of members of the Service drawing pay at two or more stages in pre-revised Pay Band and Grade Pay or scale, as the case may be, get fixed at same Cell in the applicable Level the Pay Matrix, one additional increment Shall be given for every two stages bunched and the pay of member of Service drawing higher pay in pre-revised structure shall be fixed at the next vertical Cell in the applicable Level.</p><p>(b) For this purpose, pay drawn by two members of the Service in a given pay Band and Grade Pay or scale where the higher pay is at least 3% more than the lower pay Shall constitute two stages. Officers drawing pay where the difference is less than 3% shall not be entitled for this benefit.”</p></blockquote>



<p>2. Accordingly, it is stated that the bunching benefits are granted to an officer when his/ her pay arrives equal to his/her junior due to revision of pay as per the new Pay Commission and not in the case when the junior gets equal pay due to promotion to next promotional grade. Hence. the bunching benefits do not apply to the cases where the junior officer is drawing equal pay to that of his/ her senior due to pay fixation in the promotional grade. However, a comparative chart worked out for indicating instances, wherein junior officer gets equal to that of his senior and senior office not being eligible for bunching, is enclosed for ready reference.</p>



<p>3. This issues with the approval of the competent authority.</p>

<p>Federation invites kind attention to its letter dated 05/11/2019 wherein the undersigned, citing para 4.12 of the minutes of 47th meeting of National Council of JCM held on 13th April 2019 at Rail Bhavan, New Delhi, requested<br /> to kindly intervene into the matter to see that orders granting pay re-fixation to former Defence Forces personnel ex-servicemen re-employed in the Central Government Organisations / Departments, are issued, taking into consideration the last pay drawn in Defence Forces at the time of retirement.</p>

<p><strong>Date of next increment under Rule 10 of the CCS RP Rules, 2016 &#8211; DoE</strong></p>



<p>The undersigned is directed to invite the attention to <strong>Rule 10 of the CCS (RP) Rules, 2016</strong> which provides for the entitlement of employees for drawal of <strong>annual increment</strong> either on 1st January or 1st July depending on the date of appointment, promotion or grant of financial upgrdation. The Sub-Rule (2) thereof provides that increment in respect of an employee appointed or promoted or granted financial up-gradation including up-gradation under <strong>Modified Assured Carrier Progression Scheme (MACPS)</strong> during the period between the 2nd day of January and 1st day of July (both inclusive) shall be granted on 1st day of January and the increment in respect of an employee appointed or promoted or granted financial up-gradation under <strong>MACPS </strong>during the period between the 2nd day of July and 1st day of January (both inclusive) shall be granted on 1st day of July.</p>

<p>2. A number of references were received in the Ministry of Finance seeking clarifications regarding drawal of next increment by the employees promoted on 1st July, 2016. On consideration of the matter, Department of Expenditure vide it’s Office Memorandum of even number dated 31.07.2018 has clarified that in case an employee is promoted or granted financial up-gradation including up-gradation under the <strong>MACP scheme </strong>on 1st January or 1st July, where the pay is fixed in the Level applicable to the post on which promotion is made in accordance with the <strong>Rule 13 of the CCS (RP) Rules, 2016</strong>, the first increment in the Level applicable to the post on which promotion is made shall accrue on the following 1st July or 1st January, as the case may be, provided a period of 6 months qualifying service is strictly fulfilled. The next increment thereafter shall, however, accrue only after completion of one year.</p>



<p>3. Consequent upon issue of Office Memorandum dated 31.07.2018 different Ministries/ Departments have sought clarification on applicability of DOE’s O.M dated 31.07.2018 keeping in view the provisions of <strong>Rule 10 of CCS (RP) Rules 2016 , Rule 22(I)(a)(1) of Fundamental Rules &amp; provisions of Stepping up of pay</strong>. The issues on which various Ministries/Departments have sought clarifications and decisions thereon are brought in the succeeding paragraphs.</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><strong>Issue No. 1</strong>: Whether after promotion on 1st July and fixation of pay with two increments the date of next increment will be 1st January or 1st July</p></blockquote>



<p>4. During the regime of <strong>6th CPC</strong>, when the annual increment was admissible uniformly on 1st July every year, employees completing 6 months and above in the revised pay structure as on 1st July were eligible for grant of increment. In the <strong>7th CPC</strong> regime there are two dates of increments 1st January and 1st July. Keeping in view the spirit of 6th CPC, O.M dated 31.07.2018 was issued providing for accrual of next increment on 1st July/1st January in respect of employees getting promotion on 1st January/1st July provided 6 months qualifying service is strictly fulfilled.</p>



<p>5. The instructions contained in the O.M. dated 31.07.2018 are self-explanatory in respect of the cases of promotion/ financial up-gradation falling on 1st July or Pt January. These instructions provide that in case of promotion/financial up-gradation on 1st July and 1st January and getting fixation of pay in the Level applicable to the post in which promotion is made in accordance with Rule 13 of the CCS (RP) Rules 2016, the first increment in the level in which promotion is made shall accrue on the following 1st January or 1st July, as the case may be, provided a period of 6 months’ qualifying service is fulfilled.</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><strong>Issue No.2:</strong> Accrual of next increment in case of regular promotion /financial up-gradation of an employee on any date other than the date of annual increment and option for pay fixation is exercised under FR 22(I)(a)(1).</p></blockquote>



<p>6. The opportunity to exercise of option for pay fixation under FR 22(I)(a)(1) is available to employees in case of promotion/financial up-gradation. Therefore, the Central Government Employee promoted on regular basis/granted financial up-gradation on any date other than the date of his/her annual increment in lower grade and exercises the option under FR 22(I)(a)(1) read with Department of Personnel &amp; Training’s OM No.13/02/2017-Estt.(Pay-I) dated 27.07.2017 for fixation of pay from the date of accrual of next increment in the scale of pay in lower grade, he may be allowed the 1st increment in promotional grade on 1st January/ 1st July as the case may be after completion of 6 months’ qualifying service after such fixation on 1st July/1st January (i.e., the date of increment in lower grade) on the analogy of Department of Expenditure’s OM dated 31.07.2018. The next increment, thereafter, shall however, accrue only after completion of one year.</p>



<p>7. Since there is material change, it has also been approved that the employees who have been regularly promoted or granted financial up-gradation on or after 01.01.2016 and desire to exercise/re-exercise option for pay fixation under FR22(I)(a)(1) shall be given an opportunity to exercise or re-exercise of the option there under. Such an <strong>option shall be exercised within one month of issue of this O.M.</strong></p>



<p>8. These instructions will be applicable with effect from 01.01.2016.</p>



<p>9. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Auditor General of India.</p>

<p>The references have been received in this office seeking clarification whether the AAOs who have been granted NFU in the Pay Level 9 in terms of this office O.M. No, A-60015/1/2018/  MF, CGA(A)/ NGE/7th CPC/238 dated 4th July, 2018, are eligible for benefit of fixation of pay on promotion as Accounts Officer, The matter was taken up with the Department of Expenditure, Ministry of Finance accordingly.</p>

<p>The Department of Expenditure vide, I.D. No, 02-01/2018-E,IIIA dated 09.09.2019 has viewed that the benefit of fixation of pay under Rule 13 at CCS (Revised Pay) Rules 2016, if availed at the time of NFU, the same should be offset at the time of promotion in the same level in order to avoid double fixation benefits. As such the AAOs (CCAS) who have been granted  NFU in Pay Level 9 and availed benefit of fixation of pay under Rule 13 of<br /> the CCS (RP) Rules 2016, are not eligible for grant of same benefit on promotion as Account Officer in the same Level i.e. Pay Level 9.</p>



<p>All respective accounting units of Ministries/ Departments concerned are advised to revival such cases in the light of clarification as mentioned in Para 2 above.</p>

<p>Sir,<br /> Subject: <strong>CCS (RP) Rules, 2016 &#8211; Opportunity for revision of option to come over to revised pay structure &#8211; Clarifications.</strong></p>



<p>Ref: This office Lr. No.669/ PM·II/IFA/Genl./ 7thCPC Pay fixation dated 23.07.2018 .</p>



<p>Following the O.M.No.4-13/17/IC/E-IIA  dated 12th December, 2018 issued by the Department of Expenditure, Ministry of Anance on the opportunity for revision of option to come over to reyised pay structure, this office has received references seeking clarification on the eligibility of the officials for exercising revised option from some of the units namely; O/o CPMG &#8211; Vijayawada, HRO &#8211; &#8216;V&#8217; Division and Waltair RS HO in Visakhapatnam Division in A.P. Circle. The matter has been perused with reference to the OM dated 12.12.2018 and the CCS (RP) Rules, 2016 and the point of doubts are clarified as under:-</p>



<p>1. <strong>Point of doubt</strong> : In view of M.F., O.M. No.4-13/17-IC/E-IIIA dated 12th December, 2018 whether the officials who are awarded financial upgradation In Feb./ March/ August/ September, 2017 and December 2018 are eligible to exercise revised option to come over to revised pay structure on the date of their financial up-gradation under <strong>MACPS</strong>.</p>



<p><strong>Clarification</strong>:- The Central Govt. employees have been permitted another opportunity to revise their Initial option to come into revised pay structure in <strong>terms of Rules 5 &amp; 6 thereof of CCS (RP) Rules, 2016</strong> vide M.F., OM No.<br /> 4-13/ 17-IC/E-IIIA dated 12-12-2018. Wherein, it has been also repeated to make the meaning dear that <strong>all other terms and conditions as laid down in the said Rules 5 &amp; 6 shall continue to be applicable for the revised options. </strong>As per the second provision of the Rule 5, in cases where a Government servant has been placed in a higher grade pay or scale between 1st January 2016 and the date of notification of these rules on account of promotion or up-gradation, the Government servant may switch over to the revised pay structure from the date of such promotion or up-gradation, as the case may be. <strong>Hence it is clarified that the officials who ace awarded promotion/ financial upgradation after the date of notification of the CCS (RP) Rules, 2016 (j,e. 25.07.2016) are not entitled to exercise option/revised option -to come over to the revised pay structure on the date of their promotion/ financial upgradation.</strong></p>



<p>2. <strong>Point of doubt</strong>:  In view of M.F., O.M. No.4-13/ 17-IC/E-IIIA dated 12th December, 2018 whether the officials who are awarded financial upgradation In Feb./ March, 2017 under MACPS are eligible to exercise revised option to come over to revised pay structure on the date of their subsequent increment in pre revised pay structure (i.e. on 01.07.2017).</p>



<p><strong>Clarification</strong>:- As furnished In the clarification on point of doubt &#8211; 1 above, <span style="text-decoration: underline;">all other terms and conditions as laid down In the Rules 5 &amp;. 6 thereof shall continue to be applicable</span> for exercising revised option. As per the first provision of the Rule 5, a Government servant may elect to Continue to draw  pay in the existing pay structure until the date on which he earns his next or any subsequent increment In the existing pay structure or until he vacates his post or ceases to draw pay in the existing pay structure. As per explanation-1 under the Rule 5, <span style="text-decoration: underline;"><strong>the option to retain the existing pay structure under the provisions to this rule shall be admissible only in respect of one existing pay Band and Grade pay or Scale.</strong></span></p>



<p>Further, switching over to the revised pay structure either on 01-01-2016 or<br />
from a later date than 01-01-2016 i.e. on the date of promotion/ upgradation<br />
or the date next/ any subsequent increment, are applicable under Rule 5 in case of post/ Pay Band or Grade Pay held on 01-01-2016. Thus, if the date of next or any subsequent increment (i.e. on 01-07-2016 or any subsequent date of increment) for a post/Pay Band or Grade Pay held on 01-01-2016 falls after the date of promotion, then the date of next/ any  subsequent increment for the post/ Pay Band or Grade Pay held on 01-01-2016 has no relevance for option, as this post/ Pay Band or Grade Pay on 01.01.2016 is no longer held on the date of next/ any subsequent date of Increment.</p>



<p><strong>Hence. it is clarified that the officials who are awarded promotion/ financial up gradation under MACPS prior to the next or any subsequent date of increment in the pre revised Day structure are not entitled to exercise option/revised option to come over to revised Day structure on the date of next or any subsequent date of increment i e 01.07.2016 or 01.07.2017 etc. (With regards to the said clarifications this officer. No. 69/ PM-II/IFA/ Genl./ 7thCPC Pay fixation Visakhapanam  by endorsing copies to all the Regional Offices and the Divisional Heads may also be referred to.)</strong></p>



<p><strong>Point of doubt on Method of fixation of pay:</strong> As per the representations, the officials are seem to be on the opinion that fixation of their pay on promotion/ up-gradation on or after 01 -01-2016 will be done first in pre  revised pay structure (6th CPC) and then (after placement to the promotional grade in pre revised pay structure), the revision of pay in the revised pay structure will be done as per Rule 7 of CCS (RP) Rules, 2016.</p>



<p><strong>Clarification </strong>: In case of an admissible option is exercised to come over to revised pay structure on the date of promotion/ up-gradation or on the date of next/ any subsequent increment in pre revised pay structure; <strong>revision of pay will be made first as prescribed in clause A of sub rule 1 under Rule 7 of the CCS (RP) Rules, 2016 w.r.t. the existing basic pay in pre revised pay structure-e i.e. in the prescribed existing Pay Band and Grade Pay, and after switching over to the r-evised pay structure, the fixation of pay on promotion (after 01.01.2016) shall be made as prescribed in rule 13 of the CCS-(RP) Rules, 2016.</strong></p>

<p>Subject: <strong>Pay fixation of SCS/Non-SCS officers promoted to IAS subsequent to the implementation of 7th CPC recommendations-reg.</strong></p>



<p>Sir/Madam.</p>



<p>In supersession of this Department&#8217;s letter of even number dated the 7th April, 2017 on the above mentioned subject, I am directed to say that the initial pay of a promoted officer or an officer appointed by selection as the case may be shall be fixed at the stage of the senior scale next above his actual pay. There is no provision of increment at the stage of initial fixation.</p>



<p>Rule 5(6) of lAS (Pay) Rules, 2016 provides for the fixation of pay of a Member of Service on promotion to Selection Grade (Level-13) of Pay Matrix by adding one increment in the Level- 12 of Pay Matrix and two additional increments in the Level 13 to which he is promoted. Rule 5(5) of lAS (Pay) Rules, 2016 provides that the pay of a member of the Service in the Senior Time Scale shall, on promotion to the Junior Administrative Grade he fixed in Level 12 of the Pay Matrix.</p>



<p>in respect of fixation of pay of officers who were promoted/Selected in lAS through SCS/Non-SCS respectively in Senior Time Scale/Junior Administrative Grade after 01.01.2016, the initial pay shall be fixed in the respective level of the Senior Scale i.e Level 11,12 01. 13 based on the year of allotment in the lAS. However, the pay drawn in the State Civil Services will be protected in the concerned Level. An illustration is as under: </p>



<p><strong>Shri X who is drawing pay at Rs. 48920 (Rs.40220 [pay in the pay band + GP Rs.8700] is promoted/selected to lAS on 04.03.2016. lie is allotted 2010 batch. The pay on promotion/selection to lAS would be as under:</strong></p>

<p>4. The pay of IAS officers who were promoted/selected in IAS through SCS/Non-SCS respectively prior to 01.01.2016 will be converted as per 7th CPC on 01.01.2016 and they shall  notionally in the Level of Pay Matrix, in accordance with the length of service as per their allotment year, at the stage of the senior scale. On their actual promotion to JAG/Selection Grade, the pay of these officers will then be fixed as per IAS (Pay) Rules, 2016. That is, the officers will be eligible for two additional increments on their actual promotions to Level 12/ Level 13 after completion of 9/13 years of service in IAS respectively. An Illustration is as under: </p>

<p>The provision contained in part (7) of Schedule-I of AS (Pay) Rules, 2016, which provides that &#8216;Notwithstanding anything contained in these rules, the pay of a promoted officer or an officer  appointed by selection, as the case may be, shall not at any time exceed the basic pay which he would have drawn as a direct recruit on that date if he had been appointed to the Indian Administrative Service on the date on which he was appointed to the State Civil Service or in a Gazetted post in the non-State Civil Service, after attaining the age of twenty five years, as the case may be&#8221; shall be adhered to. </p>
