<p>The undersigned is directed to state that, in continuation of this Ministry’s OM of even number dt. 25.7.2014 and 21.8.2014 on the above cited subject, briefs on three allowances (viz, Running Allowance, Additional Allowance and Breakdown Allowance) peculiar to</p>
<p>Indian Railways are being referred to the Seventh CPC for their consideration and recommendation. The under mentioned information/document are being attached herwith for further necessary actoion please.</p>

<p>There is a slight change in 7th CPC’s visit to Bengaluru. The Commission now proposes to visit Bengaluru between 24th and 26th August, 2014 instead of the earlier announced date of 25th-27th August, 2014.</p>
<p>The commission has, in its first phase of interaction, been seeking the views of various stakeholders on its terms of reference. To this end, meetings have been held in Delhi with various organisations and heads of various agencies.</p>
<p>In its second phase of interaction, the Commission plans to hold meetings in different parts of the country to facilitate stakeholders staying in various areas to present their views personally before the Commission and ensure larger representation. This exercise is being undertaken to enable the Commission to get a firsthand impression about the functioning and the condition of service prevailing in different parts of the country.</p>
<p>Accordingly, the Commission, headed by its Chairman, Justice Shri A. K. Mathur, proposes to visit Bengaluru between 24th August and 26th August 2014. The Commission would like to invite various entities/associations/federations representing any/all categories of employees covered by the terms of Reference of the Commission to present their views.</p>
<p>Your request for a meeting with the Commission may be sent through e-mail to the Secretary, 7th Central Pay Commission at secy-7cpc@nic.in. The memorandum already submitted by the requesting entity may also be sent as an attachment with this e-mail. An early response in this regard would facilitate proper scheduling of the meetings.</p>

<p>As per the request of the JCM National Council Staff side, 7th Central Pay Commission has granted extension of time upto 15.07.2014 (15th July 2014) for submission of memorandum by individual organizations other than JCM staff side. The following is the revised time schedule (Last date).</p>
<p>1.  JCM National Council Staff side                :  30.06.2014</p>
<p>2.  All other Federations/Unions/Associations  :  15.07.2014</p>
<p>JCM National Council Staff side will be submitting a common memorandum before 30.06.2014 on the common demands of the Central Government Employees. The Copy of the JCM Staff side memorandum will be placed in the website.</p>
<p>All affiliated organizations of the Confederation are requested to prepare their sectional memorandum well in advance and be ready to submit it before 15.07.2014 to the 7th CPC. New Pay scales demanded by the JCM Staff side will be available in the common memorandum of the JCM Staff side.</p>
<p>Confederation National Secretariat meeting will be held on 31.05.2014 at ITEF Head Quarters (Rajouri Garden) at 2 PM as already notified to finalise the common memorandum. (Please note the time change from 11 AM to 2 PM). All National Secretariat members are requested to attend the meeting.</p>

<div>New Delhi: The Delhi High Court on Tuesday declined to stay the functioning of the Seventh Pay Commission while hearing a plea that challenged a notification on inclusion of a former IAS officer as a member of the panel.</div>
<div></div>
<div>Justice Sudershan Kumar Misra also issued notice to the central government on the plea filed by retired members of the all India Services, central civil services and armed forces against the government&#8217;s February 28 notification constituting the commission.</div>
<div></div>
<div>The petitioners argued that inclusion of a former Indian Administrative Service officer, Vivek Rae, in the four-member commission give rise to a &#8220;real likelihood of bias&#8221; on his part to give a favourable recommendation to the IAS.</div>
<div></div>
<div>The petition said: &#8220;The impugned resolution, by retaining the practice of including a member of the IAS as a member of the commission has given rise to a real likelihood of bias on the part of such member in favour of maintaining the status quo, under which the IAS enjoys a position of special privilege in respect of pay fixation.&#8221;</div>
<div></div>
<div>Rae has a directed pecuniary interest in the recommendations of the commission, as it would also determine his pension and retirement benefits, alleged the plea.</div>
<div></div>
<div>The petitioners further questioned the practice of previous pay commissions providing an &#8220;edge&#8221; in pay scales to members of the IAS over other members of the AIS and other central civil services including India Forest Services (IFS), Indian Police Service (IPS), Indian Revenue Service (IRS), and all other group A central services.</div>
<div></div>
<div>&#8220;Past report of the commission rise to a reasonable apprehension that the reason for the repeated rejection of the demands for parity of other services in the AIS with the IAS is attributable to the fact that the commission has always comprised of a member of the IAS,&#8221; the petition submitted.</div>
<div></div>
<div>Central government counsel, however, argued the commission was not a &#8220;one-man show&#8221; and that it recommendations inturn have to go through scrutiny of the government and Rae was included in the commission because of his wide experience in the field.</div>
<div></div>
<div>Former Supreme Court judge Justice Ashok Kumar Mathur is the chairman of the commission and former petroleum and natural gas secretary Rae, National Institute of Public Finance and Policy (NIPFP) Rathin Roy, OSD in finance ministry&#8217;s expenditure department Meena Agarwal are the members.</div>

<strong><br />
</strong>A. To examine the principles, the date of effect thereof that should govern the structure of pay, allowances and other facilities/benefits whether in cash or in kind to the following categories of employees :-1. Central government employees – industrial and non-industrial.<br />
2. Personnel belonging to the All India Services.<br />
3. <strong>Personnel belonging to the Armed Forces.</strong><br />
4. Personnel to the Union Territories.<br />
5. Officers and employees of the Indian Audit and Accounts Department.<br />
6. Members of the regulatory bodies (excluding the RBI) set up under Acts of Parliament*.<br />
7. Officers and employees of Supreme Court of India**.</p>
<p>B. To transform the Central Government Organisations into modern, professional and citizen-friendly entities that are dedicated to the service of the people.</p>
<p>C. To work out a comprehensive pay package for the categories of Central Government employees mentioned at (A) above that is suitably linked to promoting efficiency, productivity and economy through rationalization of structures, organizations, systems and processes within the government, with a view leveraging economy, accountability, responsibility, transparency, assimilation of technology and discipline.</p>
<p>D. To harmonize the functioning of the Central Government Organisations with the demands of the emerging global economic scenario. This would also take in account, among other relevant factors, the totality of benefits available to the employees, need of rationalization and simplification, thereof, the prevailing pay structure and retirement benefits available under the Central Public Sector Undertakings, the economic conditions in the country, the need to observe fiscal prudence in the management of the economy, the resources of the Central Government and the demands thereon on account of economic and social development, defence, national security and the global economic scenario, and the impact upon the finances of the States if the recommendations are adopted by the States.</p>
<p>E. To examine the principles which should govern the structure of pension, death-cum-retirement gratuity, family pension and other terminal or recurring benefits having financial implications to the present and former Central Government employees appointed before January 1, 2004.</p>
<p>F. To make recommendations with respect to the general principles, financial parameters and conditions which should govern payment of bonus and the desirability and feasibility of introducing Productivity Linked Incentive Scheme in place of the existing ad hoc bonus scheme in various Departments and to recommend specific formulae for determining the productivity index and other related parameters.</p>
<p>G. To examine desirability and the need to sanction any interim relief till the time the recommendations of the Commission are made and accepted by the Government. *A. vi substituted by Ministry of Finance Resolution No.5/2/20006-E.III (A) dated the 7th December, 2006. **A. vii substituted by Ministry of Finance Resolution No.5/2/2006-E.III (A) dated the 8th August, 2007.</p>
<p>The Commission will devise its own procedure and may appoint such Advisers, institutional consultants and experts, as it may consider necessary for any particular purpose. It may call for such information and take such evidence, as it may consider necessary. Ministries and Departments of the Government of India will furnish such information and documents and other assistance as may be required by the Commission.</p>
<p>The Government of India trusts that State Governments, Service Association and others concerned will extend to the Commission their fullest cooperation and assistance. The Commission will have its headquarters in Delhi.</p>
<p><strong>The Commission will make its recommendations within 18 months of the date of its constitution.</strong> It may consider, if necessary, sending reports on any of the matters as and when the recommendations are finalized.</td>

<p>The Union Cabinet today gave its approval to the Terms of Reference of 7th Central Pay Commission (CPC) as follows:-<br />
a) To examine, review, evolve and recommend changes that are desirable and feasible regarding the principles that should govern the<strong> emoluments structure including pay, allowances and other facilities/benefits,</strong> in cash or kind, having regard to rationalization and simplification therein as well as the specialized needs of various Departments, agencies and services, in respect of the following categories of employees:-<br />
i. Central Government employees-industrial and non-industrial;<br />
ii. Personnel belonging to the All India Services;<br />
iii. Personnel of the Union Territories;<br />
iv. Officers and employees of the Indian Audit and Accounts Department;<br />
v. Members of regulatory bodies (excluding the Reserve Bank of India) set up under Acts of Parliament; and<br />
vi. Officers and employees of the Supreme Court.</p>
<p>b) To examine, review, evolve and recommend changes that are desirable and feasible regarding principles that should govern the emoluments structure, concessions and facilities/benefits, in cash or kind, as well as retirement benefits of personnel belonging to the Defence Forces, having regard to historical and traditional parities, with due emphasis on aspects unique to these personnel.</p>
<p>c) To work out the framework for an emoluments structure linked with the need to attract the most suitable talent to Government service, promote efficiency, accountability and responsibility in the work culture, and foster excellence in the public governance system to respond to complex challenges of modern administration and rapid political, social, economic and technological changes, with due regard to expectations of stakeholders, and to recommend appropriate training and capacity building through a competency based framework.</p>
<p>d) To examine the existing schemes of<strong>payment of bonus</strong>, keeping in view, among other things, its bearing upon performance and productivity and make recommendations on the general principles, financial parameters and conditions for an appropriate incentive scheme to reward excellence in productivity, performance and integrity.</p>
<p>e) To review the variety of existing allowances presently available to employees in<strong> addition to pay and suggest their rationalization and simplificatio</strong>n, with a view to ensuring that the pay structure is so designed as to take these into account.</p>
<p>f) To examine the principles which should govern the structure of pension and other retirement benefits, including revision of pension in the case of employees who have retired prior to the date of effect of these recommendations, keeping in view that retirement benefits of all <strong>Central Government employees appointed on and after 01.01.2004 are covered by the New Pension Scheme (NPS).</strong></p>
<p>g) To make recommendations on the above, keeping in view:<br />
i. the economic conditions in the country and need for fiscal prudence;<br />
ii. the need to ensure that adequate resources are available for developmental expenditures and welfare measures;<br />
iii. the likely impact of the recommendations on the finances of the State Governments, which usually adopt the recommendations with some modifications;<br />
iv. the prevailing emolument structure and retirement benefits available to employees of Central Public Sector Undertakings; and<br />
v. the best global practices and their adaptability and relevance in Indian conditions.</p>
<p>h) To recommend the date of effect of its recommendations on all the above.<strong>The Commission will make its recommendations within 18 months of the date of its constitution.</strong></p>
<p><strong>It may consider, if necessary, sending interim reports on any of the matters as and when the recommendations are finalised. </strong></p>
<p>The decision will result in the benefit of improved pay and allowances as well as rationalization of the pay structure in case of Central Government employees and other employees included in the scope of the 7th Central Pay Commission.</p>
<p><strong>Background</strong><br />
Central Pay Commissions are periodically constituted to go into various issues of <strong>emoluments’ structure, retirement benefits </strong>and other service conditions of Central Government employees and to make recommendations on the changes required.</td>

<p>Central gazetted officers finalise demands</strong></p>
<p>A workshop organised by the Confederation of Central Government Gazetted Officers’ Organisations, Tamil Nadu region, has finalised the common minimum demands to be placed before the 7 Central Pay Commission, including a just and equitable pay at the entry level of Group ‘B’ officers.</p>
<p>It was also agreed upon at the workshop here on Saturday to demand a joint consultative machinery to redress their grievances and a minimum of five promotions during their tenure — from entry to Group ‘B’ level either by promotion or direct recruitment.</p>
<p>The workshop for the constituents of the Confederation sought merger of 50 per cent dearness allowance for all purposes with effect from January 1, 2011 or 100 per cent DA with effect from January 1, 2014 for the serving officers. Other demands included free and hassle-free medical facilities to Group ‘B’ officers and adequate travel entitlements.</p>

<p>‘Name chief, members of 7th pay commission’</p>
<p>The Central Civil Pensioners’ Forum urged the Centre to announce the name of the chairman and committee members of the VII Central Pay Commission at the earliest, with terms of references in consultation with pensioners representatives and with clear instruction to submit its recommendations before June 2015.</p>
<p>A resolution to this effect was adopted at a fourth annual general body meeting of the forum at Srirangam recently.</p>
<p>Another resolution demanded that the government declare interim relief in addition to DA due from January 1, 2014 with effect from that date as the DA was crossing 100 basic points.</p>
<p>The meeting urged the government to drop the proposed health insurance scheme under consideration for the past several years as it was not favoured in several advanced countries in the world.</p>
<p>The government should recognise government headquarters hospitals in all the districts to function as CGHS for central government pensioners by appointing separate doctors for this purpose and utilise the facilities available in such hospitals.</p>
<p>Yet another resolution demanded the Centre to reconsider its decision to revise FMA to Rs. 1,200 to pensioners residing in non-CGHS areas as in the case of EPF and public sector undertaking pensioners.</p>
<p>The meeting urged the Centre to consider to exempt all pensions from Income Tax Act, to grant HRA to all pensioners, enhanced pension for 10 years to the family on the death of the pensioner, exempt from service tax the telephone bills of phones in the name of pensioners and senior citizens. V.S. Ramanujam presided over the programme. N. Guruswamy, president, presented the Pensioners Day address.</p>
<p>Mr. Ramanujam was elected as the new president. N. Guruswamy is the new general secretary and V. Hari Vasudevan secretary (finance) on the occasion.</p>
