Your valuable inputs on various issues mentioned in the Terms of Reference will be of great assistance while finalising the report, hence you are requested to submit your Memorandum containing the views of your Association to the Seventh Central Pay Commission.</div>

<p>The 7th Pay Commission compiled a list of questions and sent it along with a circular to all the Ministries/Departments of Indian Government, inviting their suggestions. It has come to our knowledge that the circular was also sent to all the Central Government employee federations. This could be treated as a irrefutable proof of the fact that the 7th Pay Commission has already started its work!</p>
<p>Although this is part of the usual procedure, it is a well known fact that Central Government employees treat certain questions as an indication of the mindset of the 7th Pay Commission.</p>
<p><em>Let’s see the questions…</em></p>
<p>What kind of impact did the 6th Pay Commission’s reforms on the Pay Scale structure have, when they were implemented? Do you think such changes were required? The Pay Commission has included questions about the results and procedures of reducing Pay Scale and Pay Bands.</p>
<p>Has Grade Pay Concept been effective? If no, the Commission wants to know what could be done to get the desired results.</p>
<p>The questions regarding increments have triggered curiosity and interest. Has the purpose behind making July 1 the date of implementing the annual increment, served its purpose? Or, are there any changes required in it?</p>
<p><strong>With annual increment fixed at 3%, what, according to you, would be a reasonable and acceptable level?</strong></p>
<p><strong>What are the pros and cons of the MACP Scheme?</strong></p>
<p>House Rent Allowance is currently being given according to three categories, based on the population of the city. What criteria should be taken into account for the calculation of House Rent Allowance? This particular question assumes great significance.</p>
<p>Questions have been raised about the ratio of the salary of the lowest level employee and the top management. While debates on this issue have been on for a while now, it is worth pointing out that the question has also appeared on the 7th Pay Commission’s list.</p>
<p>The list also has questions and a number of sub-questions about raising Government salaries to match the payments given in private sectors.</p>
<p>Questions have been asked about the possibility of incorporating attributes like talent and performance in job evaluation.</p>
<p>The sub-list also has questions regarding bonus, variable increments, performance-based schemes, State Government employees’ pay scales, and pensions.</p>
<p>One thing is for sure – the circular and its questions have become the hottest topic of discussion and countless debates among government employees right now.</p>

<p>‘Name chief, members of 7th pay commission’</p>
<p>The Central Civil Pensioners’ Forum urged the Centre to announce the name of the chairman and committee members of the VII Central Pay Commission at the earliest, with terms of references in consultation with pensioners representatives and with clear instruction to submit its recommendations before June 2015.</p>
<p>A resolution to this effect was adopted at a fourth annual general body meeting of the forum at Srirangam recently.</p>
<p>Another resolution demanded that the government declare interim relief in addition to DA due from January 1, 2014 with effect from that date as the DA was crossing 100 basic points.</p>
<p>The meeting urged the government to drop the proposed health insurance scheme under consideration for the past several years as it was not favoured in several advanced countries in the world.</p>
<p>The government should recognise government headquarters hospitals in all the districts to function as CGHS for central government pensioners by appointing separate doctors for this purpose and utilise the facilities available in such hospitals.</p>
<p>Yet another resolution demanded the Centre to reconsider its decision to revise FMA to Rs. 1,200 to pensioners residing in non-CGHS areas as in the case of EPF and public sector undertaking pensioners.</p>
<p>The meeting urged the Centre to consider to exempt all pensions from Income Tax Act, to grant HRA to all pensioners, enhanced pension for 10 years to the family on the death of the pensioner, exempt from service tax the telephone bills of phones in the name of pensioners and senior citizens. V.S. Ramanujam presided over the programme. N. Guruswamy, president, presented the Pensioners Day address.</p>
<p>Mr. Ramanujam was elected as the new president. N. Guruswamy is the new general secretary and V. Hari Vasudevan secretary (finance) on the occasion.</p>

<p>Cabinet proposal soon to constitute 7th Pay Commission</strong></p>
<p>The central government is likely to constitute the 7th Pay Commission for revising the salaries of its over 50 lakh employees before the start of process of next general elections due in May, 2014.</p>
<p>“The Finance Ministry is working out a Cabinet proposal for constitution of the 7th Pay Commission which could be taken up for consideration in the next couple of weeks,” a source said.</p>
<p>According to information available, the government’s intention to constitute 7th Pay Commission before going for polls is clear as it has made provision of Rs. 3.5 crore in the second supplementary demands for grants in this regard which was approved by Parliament in the just concluded Winter Session.</p>
<p>Earlier in September this year, Finance Minister P. Chidambaram had announced that Prime Minister Manmohan Singh has approved setting up of the 7th Pay Commission.</p>
<p>According to the announcement, the Commission will be mandated to submit its report in two years time and its recommendations would be implemented from January 1, 2016.</p>
<p>However, after that announcement, no formal proposal was put up before the Union Cabinet for constitution of the Commission.</p>
<p>As per the practice, the Commission is headed by a former Supreme Court Judge and its other members would include experts and officials.</p>
<p>Meanwhile, the government is also believed to have approved fixing minimum pension of Rs 1,000 per month under the Employees’ Pension Scheme 1995 (EPS-95) run by retirement fund body Employees’ Provident Fund Organisation (EPFO).</p>
<p>The government is also understood to have cleared maximum basic wage ceiling of Rs. 15,000 per month for deduction of Provident Fund from existing Rs. 6,500 per month for private sector workers, in general, covered under schemes run by EPFO.</p>

<p>It is now three months that the Government announced setting up of the Seventh Central Pay Commission. The names of the Chairperson and members as well as the terms of reference (ToR) are yet to be announced.</p>
<blockquote><p>
The fourth, fifth and sixth Central Pay Commission’s recommendations were implemented as follows: 4th CPC 1.1.1986; 5th CPC 1.1.1996; 6th CPC 1.1.2006</p></blockquote>
<p>The average time taken by a Pay Commission to submit its recommendations has been about two years. Accordingly, allowing about two years for the 7th CPC to submit its report, the recommendations are likely to be implemented with effect from 1.1.2006.</p>
<p style="text-align: center;">
<span style="text-decoration: underline;"><strong>CHARTER OF DEMANDS</strong></span></p>
<p>A study has established that 6th CPC based increase in pension has not been uniform for all pay scales as compared to the scales of 5thCPC. It has been observed that at the lower level, the increase in pension has been much lower. In respect of PB-1, the increase in pension was 1.86% over 5th CPC scales (5200 is 1.86% of 2750 the lowest of corresponding 5th CPC scale), in case of PB-2 the situation is same (1.86%), whereas in the case of PB-4, it is 2,6%, and in higher scales HAG, it ranges minimum 3% and more. We seek equitable and uniform increase in all cases.</p>
<p>Pension calculation formula should be simple &amp; uniform. It should be directly related to last pay drawn with simple equation such as 50% of last basic pay plus DR and family pension 30% of last basic pay plus DR. For pre 2016 pensioners notional pay fixation should be done &amp; there should be common multiplication factor for all the pensioners.</p>
<blockquote><p>1. Merger of 50% DR with basic pension w.e.f 1st Jan 2014. Presently DR is 90% and from 1st Jan, 14 is expected to be above 10%.</p>
<p>2. We seek full parity between past and future retirees. Any improvement in service conditions introduced for serving employees, such as full pension at 10/20 years service must be extended to past pensioners/retirees.</p>
<p>2. We seek Old age pension to start from the age of 65 years, as is the case in Punjab and some other states and additional pension should be granted on yearly basis instead of five years.</p>
<p>3. The rates of pension should be minimum 60% of last pay drawn, and that of Family pension</p>
<p>4. The distinction between organized cadres and others must be done away with. All employees of central Govt. must be treated equally, and any incentive, such as NFU must be extended to all similarly placed personnel.</p>
<p>5. Pensioners must be provided with adequate Medical facilities by providing medical insurance cover and enlarging the coverage of private empanelled hospitals and by appointing medical specialists. If need be retired medical specialists may be appointed in CGHS Dispensaries.</p>
<p>6. Defence civilian pensioners must be extended CSD canteen facilities which they enjoy during their service tenure.</p>
<p>7. LTC Facility be provided to the pensioners on the pattern of Punjab Government rules.</p>
<p>8. Enhanced of Fixed Medical Allowance (FMA) from present Rs.300 to Rs.2500. There can’t be &amp; must not be allowed discrimination between different two sets of pensioners (pensioners of Labour Ministry are being Paid Rs 2000.</p>
<p>9. Income tax exemption limit should be raised to Rs.5lacs for sr. citizen pensioners.</p>
<p>10. Enhanced family should be paid for 10 years even in the case of death after retirement.</p></blockquote>

<p>Dear Colleagues,<br />
Hon’ble Union Finance Minister made an announcement on 25th September, 2013 for constituting 7th Central Pay Commission; the Government has invited the leaders of the Federations (JCM National Council) for a meeting on 24.10.2013 to discuss the probable terms of reference of 7th Central Pay Commission.</p>
<p>In the meeting held on October, 24, 2013 at North Block, Room No.190, Chaired by Secretary, DOP&amp;T the Federation leaders pointed out the following issues needs to be considered and settled.</p>
<p>Anomalies arisen consequent upon the implementations of VI CPC.</p>
<p>Anomalies relating to MACP Scheme vis-a-vis ACPs to be resolved as already discussed in Anomaly Committee</p>
<p>Merger of DA with Pay as was done during the year 2004.</p>
<p>All Cadre Review proposals should be cleared and should be de-linked with 7th CPC.</p>
<p>The Draft Terms of Reference – Finalised by the staff Side is given below:</p>
<p>(A) To examine the existing structure of pay, allowances and other benefits/facilities, retirement benefit like Pension, gratuity, other terminal benefits etc., to the following categories of employees.</p>
<p>Central Government employees – industrial and non-industrial.<br />
Personnel belonging to All India Services.<br />
Personnel belonging to the Defence forces.<br />
Personnel called as Grameen Dak Sevak belonging to the Postal department.<br />
Personnel of Union territories.<br />
Officers and employees of the Indian Audit and Accounts Department.<br />
Officers and employees of the Indian Audit and Accounts Department.<br />
Officers and employees of the Supreme Court.<br />
Members of Regulatory bodies (excluding RBI) set up under Act of Parliament.</p>
<p>(B)  To work out the comprehensive revised pay packet for the categories of Central Government employees mentioned in (A) above as on 01.01.2014.</p>
<p>(C)  The Commission will determine the pay structure, benefits facilities, retirement benefits etc., taking into account the need to provide minimum wage with reference to the recommendation of the 15th Indian Labour Conference (1957) and the subsequent judicial pronouncement of the honourable Supreme Court thereon as on 01.01.2014.</p>
<p>(D) To determine the Interim relief needed to be sanctioned immediately to the Central Government employees and pensioners mentioned in (A) above.</p>
<p>(E)  To determine the percentage of Dearness Allowance/Dearness relief immediately to be merged with pay and pension.</p>
<p>(F) To settle the anomalies reached in various fora of JCM.</p>
<p>(G) To work out the improvement needed to the existing retirement benefits, like pension, death cum retirement gratuity, family pension and other terminal or recurring benefits maintaining parity amongst past, present and future pensioners and family pensioners including those who entered in service on or after 01.01.2014.</p>
<p>(H) To recommend methods for providing cashless/hazzle free Medicare facilities to the employees and pensioners including postal pensioners.</p>

<div>Record Note of the meeting held Qn 24.10.2013 at 3.00 PM to discuss the possible Terms of Reference (ToR) for the 7th CPC with the representatives of the Staff Side of JCM</div>

<div>A meeting was held on 24.10.2013 at 3.00 PM in Committee Room No 190, North Block under the chairmanship of Dr S.K.Sarkar, Secretary DOP&amp;T to discuss the possible Terms of Reference (ToR) for the 7th Central Pay Commission, which is going to be set up by the Government, with the representatives of the Staff Side of JCM. List of Participants to this meeting is at Annexure I.</div>
<div></div>
<div>At the outset, Secretary (P) welcomed the Staff side representatives and thanked them for attending this meeting on a short notice. He indicated that since this meeting has been convened to discuss the possible Terms of Reference (ToR) for the 7th Central Pay Commission, he hoped that the discussions would remain so focused.</div>
<div></div>
<div>Sh Umraomal Purohit, Secretary, Staff Side, in his opening remarks stated that it would have been preferable that there was a proposal from the official side on this issue to the Staff Side and then the same could have been discussed further in a meeting where the Finance Secretary could also be invited. He then pointed out that the new concept of Pay Bands and Grade Pay structure as per the 6th CPC, which changed the pay structure in Government, had resulted in a new experience which was mixed. He stated that though the 6th CPC did not recommend merger of DA with Pay, they could not have anticipated such a high rate of inflation which resulted in such high rate of DA; the rate of Dearness Allowance presently was 90% and due to high inflation there was a need to consider merger of a part of DA with Pay. He also raised the question of Interim Relief pending finalisation of 7th CPC recommendations. Shri Purohit further mentioned that anomalies of 6th CPC should be resolved on priority before 7th CPC. He also suggested that there must be some machinery which should resolve anomalies within one year of implementation of CPC report.</div>
<div></div>
<div>M.Raghavaiah, while thanking the Chairman raised the issue of anomalous situations which had arisen due to the new concept of Pay Bands and Grade Pay structure as per the 6th CPC. He suggested that the Finance Ministry should look into this aspect as to how anomalies cropped up due to this and how these can be avoided in future. He was of the view that the anomalies cases which stand referred to the Ministry of Finance need to be cleared. He referred to anomalies relating to MACP scheme vis a vis ACP scheme and resolution pending thereon required to be resolved as already discussed in the Joint Committee meetings on MACPS. He also demanded that there should be merger of DA with Pay as was agreed to in 2004. He also</div>
<div>pointed out that the Railway Ministry’s proposals on 6th CPC related matters presently pending with Ministry of Finance should be cleared.</div>
<div></div>
<div>The other representatives from Staff Side raised the following issues</div>
<div></div>
<div>

<ol>1.Entry level pay to promotee employees at par with that admissible to Direct Recruits as was agreed in the National Anomaly Committee;</ol>
</ul>
</ul>
<ul>
<ul>
<ol></ol>
<ol>2.One of the ToR should be to set up a special bilateral mechanism to sort out anomalies arising out of Pay Commission recommendations;</ol>
</ul>
</ul>
<ul>
<ul>
<ol></ol>
<ol>3.Professional approach should be adopted in dealing with peculiarities concerning Railways and Defence civilian employees;</ol>
</ul>
</ul>
<ul>
<ul>
<ol></ol>
<ol>4.There should be parity between pre &amp; Post CPC retirees for the purpose of pension etc.;</ol>
</ul>
</ul>
<ul>
<ul>
<ol></ol>
<ol>5.Cadre review/restructuring proposals should be delinked from the 7th CPC so that these are not delayed;</ol>
</ul>
</ul>
<ul>
<ul>
<ol></ol>
<ol>6.Wage Revision should be effective after every 5 years as in the case of PSUs;</ol>
</ul>
</ul>
<ul>
<ul>
<ol></ol>
<ol>7.If there is going to be separate CPC for the Armed Forces as had been reported in media, or if there is a representative of Armed Forces in the 7th CPC then there should be a representative of Labour in the CPC;</ol>
</ul>
</ul>
<ul>
<ul>
<ol></ol>
<ol>8.CPC should not go by “Central Secretariat” structure to make its recommendations which does not take into account specific complexities in large Government organisations like Railways, Postal Department and Defence establishments.</ol>
</ul>
</ul>
<ul>
<ul>
<ol></ol>
<ol>9.Allowances should be enhanced concurrently with the pay consequent upon Pay commission implementation.</ol>
</ul>
</ul>
<ul>
<ul>
<ol></ol>
<ol>10.Supreme Court has upheld that MACP should be in the hierarchy of the Post and also for grant of NDA in 7th CPC rates w.e.f. 1/4/2007. These judgments should be implemented to all similarly placed employees.</ol>
</ul>
</ul>
<ul>
<ol></ol>
<ol>11.The Secretary Staff side in the end requested that a copy of Terms of Reference as proposed by the Ministry of Finance may be circulated and then another meeting with Secretary, Department of Expenditure and Department of Personnel &amp; Training be arranged to discuss &amp; finalise the Terms of Reference of 7th CPC.</ol>
</ul>

<div>In his concluding remarks, the Chairman thanked the participants for their views and requested the Staff Side that they may send their suggestions in writing also.</div>
