<p>Sub: <strong>Revision of pension in respect of pensioners of KVS retired prior to 01.01.2016 in respect of 7th CPC.</strong></p>
<p>Sir/Madam,</p>
<p>It is to inform that the Ministry of HRD has granted approval for adoption of 7th CPC to the pensioners of the Kendriya Vidyalaya Sangathan vide letter No. F.3-45/2017-UT-2 dated 13.06.2018 in terms of following OMs of Govt. of India (copy enclosed):</p>
<p>1. OM No. 38/37/08-P&amp;PW(A)(l) dated 04.08.2016.<br />
2. OM No. 38/37/08-P&amp;PW(A) dated 12.05.2017.<br />
3. OM No. 38/37/08-P&amp;PW(A) dated 06.07.2017.<br />
The following modus operandi has to be adopted by the Pension Disbursing Authority i.e. State Bank of India, Parliament Street, New Delhi, for revision of pension:</p>
<p>1. In case of pensioners retired prior to 01.01.2016, the revised pension/family pension with effect from 01.01.2016 shall be determined by multiplying the pension/family pension, as had been fixed at the time of implementation of 6th Central Pay Commission(CPC) (pension drawn on 31.12.2015) by 2.57 in terms of OM NO. 38/37/2016-P&amp;PW(A)(ii) dated 04.08.2016. The amount of revised pension/family pension so arrived at shall be rounded off to next higher rupee. The revised pension/family pension will be the basic pension/family pension only without the element of additional pension available to the old pensioners/family pensioners on attaining the specified age.</p>
<p>2. The revised pension in accordance with 7th CPC will be applicable with effect from August 2018. The arrears of pension (w.e.f. 01.01.2016) will not be paid to pensioners till further instructions from this office.</p>
<p>3. In case of pensioners retired between 01.01.2016 to 31.05.2018, the revised order according to 7th CPC for individual case will be issued by the (Kendriya Vidyalaya Sangathan. in such cases also existing pension is to be revised with effect from August 2018 and the arrears of pension for 7th CPC will not be paid till further instructions from this office. It is relevant to mention that with effect from June 2018, the Kendriya Vidyalaya Sangathan is issuing the Pension Payment Orders as per recommendations of 7th CPC.</p>
<p>4. The Dearness rates for all the pensioners drawing pension according to 7th CPC will be paid as mentioned in this office letter of even number dated 05.07.2018 (copy attached).</p>
<p>5. The Govt. of India; Ministry of Personnel, PG &amp; Pensions vide OM No. 4/34/2017-P&amp;PW(D) dated 19.07.2017 has enhanced the amount of Fixed Medical Allowance from Rs.500/- to Rs.1000/- with effect from 01.07.2017. The Fixed Medical Allowance (FMA) of Rs.1000/- is to be paid to all the pensioners with effect from August, 2018. The arrears of FMA i.e. from 01.07.2017 to 31.07.2018 will only be paid at the time of payment of arrears of pension in accordance with 7th CPC for which the necessary instructions will be issued by this office.</p>

<p>University Grant Commission has published an important order regarding the arrears of 7th Pay Commission for Non-Teaching Staff of Central Universities.</p>
<p>As per the instructions received from the Ministry of Human Resources Development(MHRD), 30% of additional liability by Central Universities for implementation of 7th CPC recommendations for Non-Teaching Staff of Central Universities.</p>
<p>The UGC (Under MHRD) has already released 70% of arrears from 1.1.2016 to 31.12.2017 to University/College Teachers and Other Academic Staff, University Officers, Non-Teaching Staff and Teachers working in Model Schools.</p>

<p>Dear Sir,</p>
<p>Sub: <strong>Payment of arrears arising out of leave salary consequent to the implementation of the report of 7th CPC for the period from 01/01/2016 and onwards &#8211; denial of payment on Zonal Railways.</strong></p>
<p>Federation invites kind attention of the Railway Board to the provisions contained in Para 924 read with Sub-Para (iv) of IREM Vol. I wherein it has been stipulated that when Running Staff are on leave (including Casual Leave), they shall be paid leave salary based on the Basic Pay plus 30% thereof and other Allowances including DA/ADA due on the Basic Pay plus 30% thereof. Reports continued to be received from many zones that the arrears arising out of leave salary as a result of implementation of 7th CPC with effect from 01/01/2016 are not being paid to the Running Staff more particularly the West Central Railway.</p>
<p>In this connection, Federation also invites kind attention of the Railway Board letter No. E(P&amp;A)II-2016/FE.2/5 dated 16/10/2017 (RBE No. 148/2017) wherein instructions were issued for reckoning of 30% pay element for calculation of leave salary on 6th CPC pay, to the Running Staff during the period 0l/01/2016 to 31/08/2008 on raising the issue by NFIR through PNM agenda item No. 57/2016 at the level of Railway Board. Unfortunately, similar instructions have not been issued for payment of leave salary taking into account 30oh of pay element to the Running Staff consequent to implementation of the recommendations of 7th CPC w.e.f. 01/01/2016 with the result running staff are not being paid leave salary on Zonal Railways reckoning 30% pay element on 7th CPC Pay in the absence of Board&#8217;s instructions.<br />
NFIR, therefore, requests the Railway Board to consider the above facts and issue suitable instructions to the Zonal Railways for reckoning 30% pay element for payment of leave salary (7th CPC Pay) to the Running Staff w.e.f. 01/01/2016 and onwards. A copy of the instructions may be endorsed to the Federation.</p>

<p>Sir / Madam</p>
<p>With reference to the subject mentioned above and in continuation of the CSIR letters of even number dated 11.05.2017 and 02.06.2017, the undersigned is directed to state that the matter has been considered by the Secretary, DSIR &amp; Director General, CSIR in consultation with JS &amp; FA,DSIR / CSIR and following has been decided:</p>
<blockquote><p>a) Pension / Family pension for all pensioners (pre-2016 &amp; post 2016) may be revised notionally in terms of CSIR circular letter No.5-1(428) / 2017 &#8211; PD dated 11.05.2017. For this notional revision of pension DoP&amp;PW OM dated 04.08.2016, 12.05.2017, 06.07.2017, 18.07.2017 and Ministry of Finance, Department of Expenditure OM 23.05.2017 may be used.</p>
<p>b) Payment of revised pension / family pension (i.e monthly pension) to all the pensioners (both pre-2016 and post 2016) as per 7th CPC, from the month of September, 2017 onwards may be made.</p>
<p>c) Those retiring from the month of September, 2017 will be paid the eligible gratuity as per revised / enhanced ceiling and commutation of pension as per the 7th CPC pension amount.</p>
<p>d) Those who retired between 01-01-2016 and 31-08-2017 will be paid the difference in gratuity between the eligible amount as per revised ceiling and what they were paid at the time of retirement.</p>
<p>e) For the payment of arrears on account of revision of other pensionary benefits for the period 01.01.2016 to 31.08.2017 (viz., arrears of pension and the difference between original and revised commutation amount), separate instructions will follow. Therefore, these amounts of arrears will NOT be paid until further orders.</p></blockquote>

<p>(a) the details of the recommendations of Committee on Allowances formed after implementation of 7th CPC in 2016;</p>
<p>(b) the details of the accepted recommendations of said Committee;</p>
<p>(c) the details of the rejected recommendations of the said Committee; and</p>
<p>(d) whether Government has saved around Rs.40,000/- crores by delaying tactics and by rejecting arrears on allowances to Central Government employees and if so, the reasons therefor?</p>

<p>(a) to (d): The Committee on Allowances (CoA) recommended the acceptance of the recommendations of the Seventh Central Pay Commission (7th CPC) with 33 modifications. The recommendations of the CoA were accepted with 8 modifications by the Government. The 7th CPC recommendations on allowances were approved by the Government on 28.06.2017 with modifications in respect of 34 allowances. As per the established practice relating to implementation of earlier Central Pay Commission&#8217;s recommendations on allowances, the recommendations of the 7th CPC on allowances have been implemented prospectively with effect from 01.07.2017.</p>

										<content:encoded><![CDATA[<p><strong>Central Government fails to implement 7th pay commission arrears on allowances</strong></p>
<p>New Delhi: Despite all that has been said about the arrears on allowances under the 7th Pay Commission recommendations, an important issue for central government employees, which has now been notified on June 6 without arrears.</p>
<p>Finance Minister Arun Jaitley had claimed his commitment to implement the allowances after four months of the basic pay hike but it failed to come true.</p>
<p>More than 18 months have passed since the 7th pay commission report was submitted and 11 months have elapsed since the union cabinet approved the 7th Pay Commission recommendations for basic salary hike of central government employees, the centre now notified 7th pay commission allowances without arrears.</p>
<p>The government has given higher basic pay in August 2016 with arrears, effective from January 1, 2016 to its employees on the recommendations of the 7th pay commission but the increased allowances, which comes into effect from July 1, 2017.</p>
<p>The government used delaying tactics to save the government money to pay revised allowances without arrears. Hence the ‘Committee on Allowances’ headed by the Finance Secretary Ashok Lavasa was formed for examination allowances.</p>
<p>However. the government stuck with the 7th Pay Commission’s recommendations on allowances and gave nod accordingly but no recommendation of the ‘Committee on Allowances’ was approved.</p>
<p>The delay in the implementation of allowances is chiefly because of the financial gains of the government, while financial condition of the government is very sound.</p>
<p>The delayed implementation of allowances have saved the government nearly Rs 40,000 crore.</p>
<p>The non-payment of arrears on allowances has caused tremendous irritation and frustration among the central government employees.</p>

<p>Option-I parity for pensioners recommended by 7th CPC and accepted (??) by cabinet, mercilessly rejected by appointing a feasibility Committee.</p>
<p>NPS Committee is for further strengthening NPS and not for withdrawal of NPS or for guaranteeing minimum pension as 50% of last pay drawn.</p>
<p>MACP promotion denied to thousand of employees by imposing stringent conditions on bench mark.</p>
<p>Gramin Dak Sevak Committee Report submitted to Government on 24.11.2016 (Seven months over) still under process.</p>
<p>Exploitation of casual and contract workers continues. Equal pay for equal work denid.</p>
<p>Autonomous body employees and pensioners cheated by Government by denying their legitimate wage revision and pension revision.</p>
<p>No negotiated settlement on the charter of demands submitted to Government by JCM (staff side) and Confederation.</p>

										<content:encoded><![CDATA[<p><strong>7th Pay Commission Allowance: Why arrears from January 2016 should be provided to Central Government employees</strong></p>
<p><strong><em>Although 15 days have been passed the Committee on Allowances has not made its report public.</em></strong></p>
<p>New Delhi, May 10: Almost 18 months have passed and a large number of central government employees are eagerly waiting for arrears on allowances. The National Joint Council of Action (NJCA), the joint body of employee unions, believe that the demands made by central government employees on arrears on allowances from January 2016 is genuine. Shiv Gopal Mishra the NJCA convenor while speaking to India.com said: &#8220;As the 7th Pay Commission was scheduled to be implemented from January 2016, it is the right of central government employees to seek arrears from specified date&#8221;.</p>
<p>On being asked whether the government is delaying the arrears as it may adversely affect the exchequer the NJCA chief &#8220;The employees wait for pay commission hike, for ten years. If this government had failed to implement the 7th pay Commission recommendations on the scheduled dates then they must at least release the arrears to address the resentment among the employees.</p>
<p>&#8220;For an ideal employer, it is necessary to revise the wages and allowances on the specified date. Government of India is also an ideal employer. Although it has failed to implement the 7CPC on its slated date, it is now bound to provide arrears.</p>
<p>The NJCA chief had also dismissed the concerns raised by RBI and a few days ago its convenor said to India.com that &#8220;The delay has been done by the Lavasa committee, why must employees pay the price. If RBI thinks that it would cause an adverse impact on inflation, then they should think of an alternative method to control inflation.&#8221;</p>
<p>Earlier this week, Shiv Gopal Mishra while speaking to India.com said, &#8220;<em>Arrears would mostly be provided to the employees</em>&#8220;.</p>
<p>Although 15 days have been passed the Committee on Allowances has not made its report public and the Finance Ministry said, &#8220;Modifications have been suggested in some allowances which are applicable universally to all central government employees&#8221;.</p>
<p>Meanwhile, the committee is also looking for the suggestion of the 7th Pay Commission which has called for abolition of 52 of the 196 existing allowances, apart from subsuming 36 smaller allowances.</p>

<p>In this regard, I am directed to invite your attention to Rule 7(3) of the CCS (Revised Pay) Rules, 2016 as per which &#8216;A Government servant who is on leave on the 1st day of January, 2016 and is entitled to leave salary shall be entitled to pay in the revised pay structure from 1st day of January, 2016 or the date of option for the revised pay structure&#8217;.</p>
<p>Accordingly, an employee who is entitled to leave salary shall be entitled to pay in the revised pay structure from 01.01.2016, the arrears are also payable from 01.01.2016 provided the employee is entitled for leave salary.</p>
<p>This issues with the concurrence of Fin. &amp; A/c&#8217;s.</p>
