<p>Subject: <strong>Extension of time limit for receipt and disposal of anomalies relating to Seventh Central Pay Commission &#8211; regarding</strong></p>
<p>The undersigned is directed to refer to the aforementioned subject and to state that, in further partial modification of this Department’&#8217;s O.M. of even no. dated 16.08.2016, as amended on 20.02.2017, 14.03.2017, 05.05.2017, 17.07.2017 and 14.03.2018, the time limits for receipt and disposal of anomalies relating to the Seventh Central Pay Commission are further extended as under:</p>
<blockquote><p>(i) time limit for receipt of anomalies is extended from 15.08.2017 to 15.05.2018; and</p>
<p>(ii) time limit for disposal of anomalies is extended from 15.02.2018 to 15.11.2018.</p></blockquote>
<p>2. This issues with the concurrence of Department of Expenditure, Ministry of Finance.</p>

<p><strong>Sub:- Extension of time limit for forwarding of 7th CPC Anomalies for consideration in the Departmental Anomaly Committee &#8211; regarding.</strong></p>
<p>The undersigned is directed to say that in partial modification of this Ministry’s letter of even no. dated 05.10.2016, the time limits for receipt and disposal of anomalies, as mentioned in paragraph 4 of the letter are amended as under</p>
<blockquote><p>(i) The time limit for receipt of anomalies is extended by three months from the date of expiry of receiving anomalies: i.e. from 04.04.2017 to 04.07.2017; and</p>
<p>(ii) The time limit for disposal of anomalies is extended by three months from the date of expiry of one year for the date of expiry of one year from the date of its constitution i.e. from 04.10.2017 to 04.01.2018.</p></blockquote>

<p>Sub:- <strong>Meeting of Departmental Anomaly Committee to settle the anomalies arising out of the implementation of 7th CPC</strong></p>
<p>I am directed to bring to your kind attention that Departmental Anomaly Committee for Railways consisting of representatives of official side and the staff side to settle the anomalies arising out Of the 7th Central Pay Commission&#8217;s recommendations was constituted vide Railway Board’s letter dated 5.10.2016. Subsequently, the definition of anomaly has also been modified vide Board&#8217;s letter dated 29.03.2016.</p>
<p>2 Now, it is proposed hold the first meeting of the Departmental Anomaly Committee to discuss the various anomalies arising out of the implementation of 7th CPC&#8217;s recommendations, It is requested to advice a convenient date of time for holding the meeting along with the tentative agenda/anomalies coming within the definition of anomaly already circulated vide Railway Board&#8217;s letter dated 29.032016 to be discussed in the said meeting.</p>
<p>On receipt of the suggestions the final agenda and the schedule of the meeting will be advised.</p>

										<content:encoded><![CDATA[<p><strong>7th Pay Commission &#8211; Central Government Employees upset &#8211; No reference to CPC Anomalies by Jaitley in Budget 2017 &#8211; NJCA</strong></p>
<p>Pessimism gripped central government employees with Finance Minister Arun Jaitley making no reference to the anomalies related to 7th Pay Commission in his Budget speech.</p>
<p>&#8220;Most of the central government employees were eagerly waiting for Finance Minister Arun Jaitley to make some announcement on minimum wages. But after Mr Jaitley&#8217;s speech ended without mentioning anything about the increase in the minimum wage, most of us were upset,&#8221; NJCA convenor Shiv Gopal Mishra said while speaking to India.com.</p>
<p>&#8220;Ab toh asha ki kiran kaheen naheen hai, sirf nirasha hee nirasha hai (We are losing hope. We can only see disappointment),&#8221; the leading unionist further added. NJCA has proactively been involved in talks with Centre, seeking revision of minimum salary from Rs 18,000 to Rs 26,000, among other demands.</p>
<p>Although Mishra indicated that the government may not backtrack on their stance over minimum salary, he claimed that the allowances would be hiked by April 1. &#8220;There are chances the government hikes the allowances from April 1. However, we would launch our protests against the government if they fail to revise the minimum salary,&#8221; he added.</p>
<p>The 7th Pay Commission was approved by Union Cabinet on July 1, 2016. The date of implementation was fixed as January 1, 2016. The central government employees were provided the hiked salaries from the month of July, along with arrears of six months. However, the hike was related only to the basic component of their pay. The increase in allowances was upheld, due to the anomalies raised by employee unions.</p>
<p>7th Pay Commission report affected nearly 47 lakh central government employees, along with 53 lakh pensioners. Implementation of the report has revised the minimum salary from Rs 7,000 to Rs 18,000. The maximum salary has been capped at Rs 2,50,000.</p>
<p>The total salary hike sanctioned through 7th Pay Commission is 23 per cent. However, the central government employees, so far, have received a hike of 14.3 per cent, which is related to the basic pay. The remaining 9 per cent of the hike is related to the allowances component.</p>
<p>Although the government has indicated that the allowance hike would be implemented by March, there is no word whether the central government employees would be provided arrears on allowances, akin to the manner in which they were provided on basic pay. Providing arrears to central government employees, keeping January 1, 2016 as the base, would create significant amount of burden on the exchequer.</p>

<p>Sub: Brief of the 1st meeting of the National Anomaly Committee</p>
<p>The first meeting of the National Anomaly Committee was held today under the Chairmanship of Secretary(P), Government of India, to discuss the issue of calculation of Disability Pension for Defence Forces Personnel as per recommendations of the 7th CPC, which was attended by the Member Staff Railway Board and the Secretaries from other departments of the Government of India.</p>
<p>AIRF was represented by the undersigned and Com. J.R. Bhosale, Treasurer AIRF while Army personnel were represented by the officials of all the three wings of the defence. At the outset, I urged upon the Secretary (DoP&amp;T), to frame the definition of the &#8220;Anomaly&#8221;, which has been already demanded by the Staff Side, NC/JCM.</p>
<p>This is in respect of report of the VII CPC, which has granted slab system on Disability Pension for the Defence Personnel, which was far short of the existing disability pension for the army officers. We explained the life of the army personnel and their cases of disability in the enemies’ action.</p>
<p>After threadbare discussions we urged upon the Official Side to see that there is no drop in the disability pension for any of the categories of the army personnel and paramilitary forces, rather they should be well compensated for their best they are giving for defending our motherland.</p>

<p>Provided that a Government servant may elect to continue to draw pay in the existing pay structure until the date on which he earns his next or any subsequent increment in the existing pay structure or until he vacates his post or ceases to draw pay in the existing pay structure:</p>

<p>Provided further that in cases where a Government servant has been placed in a higher grade pay or scale between 1st day of January, 2016 and the date of notification of these rules on account of promotion or upgradation, the Government servant may elect to switch over to the revised pay structure from the date of such promotion or upgradation, as the case may be.</p>
<p>&nbsp;</p>

<p><b>Explanation 1.</b> The option to retain the existing pay structure under the provisos to this rule shall be admissible only in respect of one existing Pay Band and Grade Pay or scale.</p>
<p>&nbsp;</p>

<p><b>Explanation 2</b>. The aforesaid option shall not be admissible to any person appointed to a post for the first time in Government service or by transfer from another post on or after the 1st day of January, 2016, and he shall be allowed pay only in the revised pay structure.</p>

<p><b>Explanation 3.</b> Where a Government servant exercises the option under the provisos to this rule to retain the existing pay structure of a post held by him in an officiating capacity on a regular basis for the purpose of regulation of pay in that pay structure under Fundamental Rule 22, or under any other rule or order applicable to that post, his substantive pay shall be substantive pay which he would have drawn had he retained the existing pay structure in respect of the permanent post on which he holds a lien or would have held a lien had his lien not been suspended or the pay of the officiating post which has acquired the character of substantive pay in accordance with any order for the time being in force, whichever is higher.</p>

<p>Contrary to above, vide letter No. AN/XIV/14142/Seventh CPC/Vol-I, Dated 08.09.2016 the CGDA issued clarification No. 3 on <b>Implementation of Seventh Central Pay Commission</b> which reads as under:</p>

<p>As regards exercising option for Seventh CPC from 07/2016 i.e. on accrual of next increment in respect of cases who have been promoted / upgraded between 01.01.2016 and 30.06.2016 is concerned, Para 13 and Para 5 of CCS (RP) Rules, 2016 may be referred which clearly states that in respect of the above cases, a government servant may elect to switch over the revised pay structure from the date of such promotion or upgradation implying that the option to switch over to the revised pay structure from 07/2016 is not available. Provision of Para 15 of Min of Finance Gazette notification dated 25.07.2016 may also be referred.</p>

<p><span data-blogger-escaped-style="text-decoration: underline;"><b>Point of Doubt No.2</b></span>: If the pay of an employee <b>XYZ</b> was Rs.12200 in PB-1 plus 2800 GP as on 31.12.2015 and on completion of 10 yrs regular service, he was granted financial upgradation on 15.03.2016 in the Grade pay of 4200, kindly clarify:</p>

<p><i>(i) Whether <b>XYZ</b> is compelled to opt 7th CPC w.e.f. 01.01.2016 and his pay will be fixed as illustration mentioned in the Rule 13 of CCS (RP) Rules, 2016;</i></p>

<p style="text-align: center;"><strong>Part -1</strong></p>
<p> With due regards, your attention is invited to Para 4.(2) of the Gazette Notification on Resolution (No. 1-2/2016-IC, Dated 25.07.2016) issued by Ministry of Finance (Department of Expenditure) which reads as under:</p>
<p>4. (1) The Pay Matrix, in replacement of the Pay Bands and Grade Pays as in force immediately prior to the notification of this Resolution, shall be as specified in Annexure I in respect of civilian employees.</p>
<p>(2) With regard to fixation of pay of the employee in the new Pay Matrix as on 1st day of January, 2016, the existing pay (Pay in Pay Band plus Grade Pay) in the <strong>pre-revised structure as on 31st day of December, 2015 shall be multiplied by a factor of 2.57.</strong> The figure so arrived at is to be located in the Level corresponding to employee’s Pay Band and Grade Pay or Pay Scale in the new Pay Matrix. If a Cell identical with the figure so arrived at is available in the appropriate Level, that Cell shall be the revised pay; otherwise the next higher cell in that Level shall be the revised pay of the employee.</p>
<p>(3) After fixation of pay in the appropriate Level as specified in sub-paragraph (2) above, the subsequent increments in the Level shall be at the immediate next Cell in the Level.</p>
<p>Whereas the Rule 7 of the CCS (RP) Rules, 2016 reads as under:</p>
<p>7. Fixation of pay in the revised pay structure:</p>
<p><em>(1) The pay of a Government servant who elects, or is deemed to have elected under rule 6 to be governed by the revised pay structure on and from the 1st day of January, 2016, shall, unless in any case the President by special order otherwise directs, be fixed separately in respect of his substantive pay in the permanent post on which he holds a lien or would have held a lien if such lien had not been suspended, and in respect of his pay in the officiating post held by him, in the following manner, namely:-</em></p>
<p><em> (A) in the case of all employees:</em></p>
<p><em> (i) the pay in the applicable Level in the Pay Matrix shall be the pay obtained by multiplying the existing basic pay by a factor of 2.57, rounded off to the nearest rupee and the figure so arrived at will be located in that Level in the Pay Matrix and if such an identical figure corresponds to any Cell in the applicable Level of the Pay Matrix, the same shall be the pay, and if no such Cell is available in the applicable Level, the pay shall be fixed at the immediate next higher Cell in that applicable Level of the Pay Matrix.</em></p>
<p><em> </em>Further, Annexure of Implementation Cell, 7th CPC (O.M. No. 1-5/2016-IC, Dated 29.07.2016) clearly states that the Basic Pay (Pay in the applicable Pay Band plus applicable Grade Pay or basic pay in the applicable scale) in the pre-revised structure as on 01.01.2016 will be multiplied by 2.57.</p>
<p>&nbsp;</p>
<p><strong>Point of Doubt No.1</strong>: Some of the Local Account offices are saying that as per Para 4.(2) of Resolution, the <strong>Basic Pay ( pre-revised Pay in Pay Band plus Grade Pay as on 31.12.2015</strong>, <strong>not as on 01.01.2016</strong>) will be multiplied by 2.57.</p>
<p>Kindly clarify which basic pay will be multiplied by 2.57:</p>
<p style="text-align: center;"> <strong>(a) pre-revised Pay in Pay Band plus Grade Pay as on 31.12.2015</strong><br />
<strong> Or</strong><br />
<strong>(b) pre-revised Pay in Pay Band plus Grade Pay as on 01.01.2016</strong></p>
<p><strong> Effect in both conditions may be illustrated below</strong>: The pay of an employee &#8220;XYZ&#8221; was Rs. 12200 in PB-1 plus 2800 GP as on 31.12.2015 and on completion of 10 yrs regular service, he was granted financial upgradation on 01.01.2016 in the Grade pay of 4200. Thus his pre-revised basic pay was become Rs. 12650 in PB-2 plus Rs. 4200 GP as on 01.01.2016.</p>
<p>In such condition, LAO is fixing his pay as under :</p>
<p>(a) Pre &#8211; Revised Basic Pay as on 31.12.2015 : 12200 + 2800 = 15000<br />
(b) Amount (a) is multiplied by 2.57 : 15000 x 2.57 = 38550<br />
(c) Revised Pay in Pay Matrix in Level 5 : 39200<br />
(d) Pay after giving one increment in : 40400 Level 5 on 01.01.2016<br />
(e)Pay in upgraded level 6 (GP 4200) : <strong>41100</strong> as on 01.01.2016</p>
<p>As per federation&#8217;s interpretation, the fixation will be as under :</p>
<p>(a) Pre-Revised Basic Pay as on 31.12.2015 : 12200 + 2800 = 15000<br />
(b) Pre-Revised Basic Pay as on 01.01.2016 : 12650 + 4200 = 16850 due to fixation benefit under FR 22.(I)(a)(1)<br />
(c) Amount (b) is multiplied by 2.57 : 16850 x 2.57 = 43304<br />
(d) Pay in upgraded level 6 (GP 4200) : <strong>43600</strong> as on 01.01.2016<em><br />

<p>Statement by Air Chief Marshal Arup Raha Chairman, Chief of Staff Committee (COSC) regarding 7th pay commission: Armed Forces</p>
<p>The 7th Pay Commission anomalies in respect of the Armed Forces were discussed with the Hon’ble Raksha Mantri in detail by the Service Chiefs and the members of the Armed Forces Pay Commission Cell. The Hon’ble Raksha Mantri is seized of all the issues and has assured to resolve them at the earliest. The Services are satisfied with the response.</p>

										<content:encoded><![CDATA[<p><strong>Exercise option within Three Months of the Date of Notification</strong></p>
<p>To Exercise option under the provisos to rule 5 with in three months of the Notification of Revised Pay Rule 2016 is issued.</p>
<p>shall be exercised in writing in the form appended to these rules so as to reach the authority mentioned in sub-rule (2) within three months of the date of notification of Revised Pay Rule 2016.</p>
<p><strong>Exercise of option :-</strong></p>
<p>(1) The option under the provisos to rule 5 shall be exercised in writing in the form appended to these rules so as to reach the authority mentioned in sub-rule (2) within three months of the date of notification of these rules or where any revision in the existing pay structure is made by any order subsequent to the date of notification of these rules, within three months of the date of such order:</p>
<p><strong>Provided that :-</strong></p>
<p>(i) in the case of a Government servant who is, on the date of such notification or, as the case may be, date of such order, out of India on leave or deputation or foreign service or active service, the said option shall be exercised in writing so as to reach the said authority within three months of the date of his taking charge of his post in India; and</p>
<p>(ii) where a Government servant is under suspension on the 1st day of January, 2016, the option may be exercised within three months of the date of his return to his duty if that date is later than the date prescribed in this sub-rule.</p>
<p>(2) The option shall be intimated by the Government servant to the Head of his Office along with an undertaking, in the form appended to these rules.</p>
<p>(3) If the intimation regarding option is not received by the authority within the time specified in subrule (1), the Government servant shall be deemed to have elected to be governed by the revised pay structure with effect from the 1st day of January, 2016.</p>
<p>(4) The option once exercised shall be final.</p>
<p>Note 1: Persons whose services were terminated on or after 1st January, 2016 and who could not exercise the option within the prescribed time limit, on account of discharge on the expiry of the sanctioned posts, resignation, dismissal or discharge on disciplinary grounds, shall be entitled to exercise option under sub-rule (1).</p>
<p>Note 2: Persons who have died on or after the 1st day of January, 2016 and could not exercise the option within prescribed time limit are deemed to have opted for the revised pay structure on and from the 1st day of January, 2016 or such later date as is most beneficial to their dependents if the revised pay structure is more favorable and in such cases, necessary action for payment of arrears shall be taken by the Head of Office.</p>
<p>Note 3: Persons who were on earned leave or any other leave on 1st day of January, 2016 which entitled them to leave salary shall be entitled to exercise option under sub-rule (1).</p>
